			 States-India peaceful atomic energy cooperation</header>
			<section id="id5A3F4FF80B41435883AE6C9559918895" section-type="section-one"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the
			 <quote><short-title>United States-India Peaceful Atomic
			 Energy Cooperation Act</short-title></quote>.</text>
			</section><section id="id45707D4C3F88400F9B7A3528ED3DD467"><enum>102.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 Congress that—</text>
				<paragraph id="ID7f6f7c78ba9341899e8f22a1b73e5d9b"><enum>(1)</enum><text>strong bilateral
			 relations with India are in the national interest of the United States;</text>
				</paragraph><paragraph id="IDa42c410dfffe40a0a773c8bc11a2e290"><enum>(2)</enum><text>the United States
			 and India share common democratic values and the potential for increasing and
			 sustained economic engagement;</text>
				</paragraph><paragraph id="ID1da59d9b2f0a49bfb7d6b220299ac9ae"><enum>(3)</enum><text>commerce in civil
			 nuclear energy with India by the United States and other countries has the
			 potential to benefit the people of all countries;</text>
				</paragraph><paragraph id="ID9530a17a316742249eeed683a4eb411f"><enum>(4)</enum><text>such commerce
			 also represents a significant change in United States policy regarding commerce
			 with countries not parties to the Nuclear Non-Proliferation Treaty, which
			 remains the foundation of the international non-proliferation regime;</text>
				</paragraph><paragraph id="IDbe7d8b54b52b4003b9d74b51057ecead"><enum>(5)</enum><text>any commerce in
			 civil nuclear energy with India by the United States and other countries must
			 be achieved in a manner that minimizes the risk of nuclear proliferation or
			 regional arms races and maximizes India’s adherence to international
			 non-proliferation regimes, including, in particular, the Guidelines of the
			 Nuclear Suppliers Group (NSG); and</text>
				</paragraph><paragraph id="ID14078748155745f59a83c10f1ce0d2b2"><enum>(6)</enum><text>the United States
			 should not seek to facilitate or encourage the continuation of nuclear exports
			 to India by any other party if such exports are terminated under United States
			 law.</text>
				</paragraph></section><section id="ID3180c9382dbc414dabb00cf2d2779e05"><enum>103.</enum><header>Declaration of
			 policy concerning United States-India peaceful atomic energy
			 cooperation</header><text display-inline="no-display-inline">It shall be the
			 policy of the United States with respect to any peaceful atomic energy
			 cooperation between the United States and India—</text>
				<paragraph id="IDac77038ca72b48eca4e69c0e2694bf6e"><enum>(1)</enum><text>to achieve as
			 quickly as possible a cessation of the production by India and Pakistan of
			 fissile materials for nuclear weapons and other nuclear explosive
			 devices;</text>
				</paragraph><paragraph id="IDc97f28cdc480405391546939711955dd"><enum>(2)</enum><text>to achieve as
			 quickly as possible the Government of India's adherence to, and cooperation in,
			 the full range of international non-proliferation regimes and activities,
			 including India's—</text>
					<subparagraph id="id8795747CC78245E9B3BA7336C23DA157"><enum>(A)</enum><text>full
			 participation in the Proliferation Security Initiative;</text>
					</subparagraph><subparagraph id="id33C8EE3A728E4A579CBDB040BD58F4EE"><enum>(B)</enum><text>formal commitment
			 to the Statement of Interdiction Principles;</text>
					</subparagraph><subparagraph id="idAA3BA3CC92AD43E797D3B326728B1788"><enum>(C)</enum><text>public
			 announcement of its decision to conform its export control laws, regulations,
			 and policies with the Australia Group and with the Guidelines, Procedures,
			 Criteria, and Controls List of the Wassenaar Arrangement; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1CD05779E8D14FCC8D3A09507248610E"><enum>(D)</enum><text>demonstration of
			 satisfactory progress toward implementing the decision described in
			 subparagraph (C);</text>
					</subparagraph></paragraph><paragraph id="ID9abb77c3dc6a4664a10f0fa0d80e3113"><enum>(3)</enum><text>to ensure that
			 India remains in full compliance with its non-proliferation, arms control, and
			 disarmament agreements, obligations, and commitments;</text>
				</paragraph><paragraph id="IDd3b78876e7284a598c5bc012e898e238"><enum>(4)</enum><text>to ensure that
			 any safeguards agreement or Additional Protocol thereto to which India is a
			 party with the International Atomic Energy Agency (IAEA) can reliably safeguard
			 any export or reexport to India of any nuclear materials and equipment;</text>
				</paragraph><paragraph id="id8773D05D937A48C9B7194E1749351B2B"><enum>(5)</enum><text>to meet the
			 requirements set forth in subsections a.(1) and a.(3)–a.(9) of section 123 of
			 the Atomic Energy Act of 1954 (42 U.S.C. 2153);</text>
				</paragraph><paragraph id="ID475e061b90fc42cbb6d1ed34c02d3a03"><enum>(6)</enum><text>to act in a
			 manner fully consistent with the Guidelines for Nuclear Transfers and the
			 Guidelines for Transfers of Nuclear-Related Dual-Use Equipment, Materials,
			 Software and Related Technology developed by the multilateral Nuclear Suppliers
			 Group and the rules and practices regarding NSG decision-making;</text>
				</paragraph><paragraph id="id7011C69449C74E2BAD6E91B351695057"><enum>(7)</enum><text>given the special
			 sensitivity of equipment and technologies related to the enrichment of uranium,
			 the reprocessing of spent nuclear fuel, and the production of heavy water, to
			 work with members of the Nuclear Suppliers Group, individually and
			 collectively, to further restrict the transfers of such equipment and
			 technologies, including to India;</text>
				</paragraph><paragraph id="IDe4f462daa88b46e1b52688574aa3d900"><enum>(8)</enum><text>to maintain the
			 fullest possible international support for, adherence to, and compliance with
			 the Nuclear Non-Proliferation Treaty; and</text>
				</paragraph><paragraph id="idA09D455177E9453A89BBBC7819B302B1"><enum>(9)</enum><text>that exports of
			 nuclear fuel to India should not contribute to, or in any way encourage,
			 increases in the production by India of fissile material for non-civilian
			 purposes.</text>
				</paragraph></section><section id="ID205a5b7243854489b53b99f3d3a4d6d7"><enum>104.</enum><header>Waivers for
			 cooperation with india</header>
				<subsection id="id617C09702A0549FAAB2682D72F78EC8A"><enum>(a)</enum><header>Waiver
			 authority</header><text display-inline="yes-display-inline">If the President
			 submits a determination under section 105 to the appropriate congressional
			 committees, the President may—</text>
					<paragraph id="id063A92DEF492483FB0D180369CED79CB"><enum>(1)</enum><text display-inline="yes-display-inline">subject to subsection (b), exempt a
			 proposed agreement for cooperation with India arranged pursuant to section 123
			 of the Atomic Energy Act of 1954 (42 U.S.C. 2153) from the requirement of
			 subsection a.(2) of such section;</text>
					</paragraph><paragraph id="IDff64df6c539743fa881e997f1293ab5b"><enum>(2)</enum><text>waive the
			 application of section 128 of the Atomic Energy Act of 1954 (42 U.S.C. 2157)
			 with respect to exports to India; and</text>
					</paragraph><paragraph id="IDaea1a02330a146c79de9eba7d296de39"><enum>(3)</enum><text>waive the
			 application of any sanction with respect to India under—</text>
						<subparagraph id="ID5822912d2006482ba48da243a7c12812"><enum>(A)</enum><text>section 129
			 a.(1)(D) of the Atomic Energy Act of 1954 (42 U.S.C. 2158(a)(1)(D)); and</text>
						</subparagraph><subparagraph id="ID80db5071c3db44909e31b7b77917e6b6"><enum>(B)</enum><text>section 129 of
			 such Act (42 U.S.C. 2158) regarding any actions that occurred before July 18,
			 2005.</text>
						</subparagraph></paragraph></subsection><subsection id="idC4722D81E8CA4FC0AF1A9890C4991782"><enum>(b)</enum><header>Joint
			 resolution of approval requirement</header><text>An agreement for cooperation
			 exempted by the President pursuant to subsection (a)(1) shall be subject to the
			 second proviso in subsection d. of section 123 of the Atomic Energy Act of 1954
			 (42 U.S.C. 2153(d)) applicable to agreements exempted by the President pursuant
			 to subsection (a) of such section.</text>
				</subsection></section><section id="id961522EE82814F769B7A22C571D7A1D4"><enum>105.</enum><header>Determination
			 regarding United States-india peaceful atomic energy cooperation</header><text display-inline="no-display-inline">The determination referred to in section 104
			 is a written determination by the President, which shall be accompanied by a
			 report to the appropriate congressional committees, that—</text>
				<paragraph id="idE352802FC6BE4B2693C3AD28DFCEAEE3"><enum>(1)</enum><text>India has
			 provided to the IAEA and the United States a credible plan to separate its
			 civil nuclear facilities, materials, and programs from its military facilities,
			 materials, and programs;</text>
				</paragraph><paragraph id="id400D5531DDF74DC595BB7E665442C36F"><enum>(2)</enum><text>India has filed a
			 complete declaration regarding its civil nuclear facilities and materials with
			 the IAEA;</text>
				</paragraph><paragraph id="idBCF7AB7A345E4FF5A133AC01478E38AE"><enum>(3)</enum><text>an agreement
			 between India and the IAEA requiring the application of safeguards in
			 perpetuity in accordance with IAEA standards, principles, and practices to
			 civil nuclear facilities, programs, and materials described in paragraph (2)
			 has entered into force and the text of such agreement has been made available
			 to the appropriate congressional committees;</text>
				</paragraph><paragraph id="id360CCF7CE4FA4E17A147D0C4E2ABB4CB"><enum>(4)</enum><text>India and the
			 IAEA are making substantial progress toward implementing an Additional
			 Protocol;</text>
				</paragraph><paragraph id="idE8FDF3A9B3E048B3BB720457B26B4D04"><enum>(5)</enum><text>India is working
			 with the United States to conclude a multilateral treaty on the cessation of
			 the production of fissile materials for use in nuclear weapons or other nuclear
			 explosive devices;</text>
				</paragraph><paragraph id="idC2DB4279E86541DAA17863AD79585C5C"><enum>(6)</enum><text>India is
			 supporting international efforts to prevent the spread of enrichment and
			 reprocessing technology to any state that does not already possess full-scale,
			 functioning enrichment or reprocessing plants;</text>
				</paragraph><paragraph id="id65A8D902C77F41A2837277002644F2E8"><enum>(7)</enum><text>India has secured
			 nuclear and other sensitive materials and technology through the application of
			 comprehensive export control legislation and regulations, including through
			 effective enforcement actions, and through harmonization of its control lists
			 with, and adherence to, the guidelines of the Missile Technology Control Regime
			 and the Nuclear Suppliers Group; and</text>
				</paragraph><paragraph id="ID3526846e560a4bb5940b596e7c620c9c"><enum>(8)</enum><text>the Nuclear
			 Suppliers Group has decided to permit civil nuclear commerce with India
			 pursuant to a decision taken by the Nuclear Suppliers Group that—</text>
					<subparagraph id="ID3d928c2efbb14aed9eea9880370e9d0f"><enum>(A)</enum><text>was made by
			 consensus; and</text>
					</subparagraph><subparagraph id="ID6b87fde810204b278e23eb63c9234425"><enum>(B)</enum><text>does not permit
			 nuclear commerce with any non-nuclear weapon state other than India that does
			 not have IAEA safeguards on all nuclear materials and all peaceful nuclear
			 activities within the territory of such state, under its jurisdiction, or
			 carried out under its control anywhere.</text>
					</subparagraph></paragraph></section><section id="ID01946a32df764c23be378b6fd1d259f3"><enum>106.</enum><header>Prohibition on
			 certain exports and reexports</header>
				<subsection id="IDc85582fbf55a4eb8a7ba7e7122b01968"><enum>(a)</enum><header>Sense of
			 Congress on Licensing Policy</header><text>It is the sense of Congress that it
			 is in the interest of the United States to permit the timely consideration of
			 applications for the export and reexport to India of any nuclear materials and
			 sensitive technology requiring authorizations pursuant to parts 110 and 810 of
			 title 10, Code of Federal Regulations, to the extent that such exports and
			 reexports are consistent with United States laws, regulations, and policies in
			 effect at the time such export or reexport applications are to be
			 considered.</text>
				</subsection><subsection id="IDbbd66de48d2c4c65ab3e5886b7d2653e"><enum>(b)</enum><header>Prohibition</header>
					<paragraph id="IDe723a82f67684467a06860ff117c0d06"><enum>(1)</enum><header>In
			 general</header>
						<subparagraph id="id0774E93161C14069B50868E458402C9D"><enum>(A)</enum><header>Nuclear
			 regulatory commission</header><text>Except as provided in paragraph (2), the
			 Nuclear Regulatory Commission may not authorize pursuant to part 110 of title
			 10, Code of Federal Regulations, licenses for the export or reexport to India
			 of any equipment, materials, or technology related to the enrichment of
			 uranium, the reprocessing of spent nuclear fuel, or the production of heavy
			 water.</text>
						</subparagraph><subparagraph id="ID8817ab67cda84479899f3048680a969d"><enum>(B)</enum><header>Secretary of
			 Energy</header><text>Except as provided in paragraph (2), the Secretary of
			 Energy may not authorize pursuant to part 810 of title 10, Code of Federal
			 Regulations, licenses for the export or reexport to India of any equipment,
			 materials, or technology related to the enrichment of uranium, the reprocessing
			 of spent nuclear fuel, or the production of heavy water.</text>
						</subparagraph></paragraph><paragraph id="id99825F7662924299ACA2979143AB7E37"><enum>(2)</enum><header>Exceptions</header><text>Exports
			 or reexports otherwise prohibited under paragraph (1) may be approved
			 if—</text>
						<subparagraph id="id0A928061B5704939B40AFA923D6867B7"><enum>(A)</enum><text>the end
			 user—</text>
							<clause id="id18B23FDC6C7E4277B3390164A9A30B71"><enum>(i)</enum><text>is
			 a multinational facility participating in an IAEA-approved program to provide
			 alternatives to national fuel cycle capabilities; or</text>
							</clause><clause id="idEE12EFA9D1604B0BADD0CFD0E7EC5099"><enum>(ii)</enum><text>is
			 a facility participating in, and the export or reexport is associated with, a
			 bilateral or multinational program to develop a proliferation-resistant fuel
			 cycle; and</text>
							</clause></subparagraph><subparagraph id="id29CCB89C3FD14FF4875A7A74143F8BF8"><enum>(B)</enum><text>the President
			 determines that the export or reexport will not improve India's ability to
			 produce nuclear weapons or fissile material for military uses.</text>
						</subparagraph></paragraph></subsection></section><section id="id30C84C689E404D808801F6C0091DD01B"><enum>107.</enum><header>End-use
			 monitoring program</header>
				<subsection id="id618E602FB5694F2E8EB09277B8A65792"><enum>(a)</enum><header>In
			 general</header><text>The President shall ensure that all appropriate measures
			 are taken to maintain accountability with respect to nuclear materials,
			 equipment, and technology sold, leased, exported, or reexported to India and to
			 ensure United States compliance with Article I of the Nuclear Non-Proliferation
			 Treaty.</text>
				</subsection><subsection id="id525B7391471C43D383F76EB972164235"><enum>(b)</enum><header>Measures</header><text>The
			 measures taken pursuant to subsection (a) shall include the following:</text>
					<paragraph id="id53AC6EED228749E095B41FF846724C3C"><enum>(1)</enum><text>Obtaining and
			 implementing assurances and conditions pursuant to the export licensing
			 authorities of the Nuclear Regulatory Commission and the Department of Commerce
			 and the authorizing authorities of the Department of Energy, including, as
			 appropriate, conditions regarding end-use monitoring.</text>
					</paragraph><paragraph commented="no" id="id4090D739D2B74A8E92002FC7D17AF49F"><enum>(2)</enum><text>A detailed system
			 of reporting and accounting for technology transfers, including any retransfers
			 in India, authorized by the Department of Energy pursuant to section 57 b. of
			 the Atomic Energy Act of 1954 (42 U.S.C. 2077(b)). Such system shall be capable
			 of providing assurances that—</text>
						<subparagraph commented="no" id="idCA3C46860D994B77827B79AA26264703"><enum>(A)</enum><text>the identified
			 recipients of the nuclear technology are authorized to receive the nuclear
			 technology;</text>
						</subparagraph><subparagraph commented="no" id="id76141AC2D7F440BCBB6716033C8EEBB9"><enum>(B)</enum><text>the nuclear
			 technology identified for transfer will be used only for peaceful safeguarded
			 nuclear activities and will not be used for any military or nuclear explosive
			 purpose; and</text>
						</subparagraph><subparagraph commented="no" id="id6A2B57AB288944CE8C57F200ADC70C5D"><enum>(C)</enum><text>the nuclear
			 technology identified for transfer will not be retransferred without the prior
			 consent of the United States, and facilities, equipment, or materials derived
			 through the use of transferred technology will not be transferred without the
			 prior consent of the United States.</text>
						</subparagraph></paragraph><paragraph commented="no" id="id93C765683AD942F4B7009B8C37730FBF"><enum>(3)</enum><text>In the event the
			 IAEA is unable to implement safeguards as required by an agreement between the
			 United States and India arranged pursuant to section 123 of the Atomic Energy
			 Act of 1954 (42 U.S.C. 2153), arrangements that conform with IAEA safeguards
			 standards, principles, and practices that provide assurances equivalent to that
			 intended to be secured by the system they replace, including—</text>
						<subparagraph commented="no" id="id7279E5DA7B95424B9596B5BEEE35F51A"><enum>(A)</enum><text>review in a
			 timely fashion of the design of any equipment transferred pursuant to the
			 agreement for cooperation, or of any facility that is to use, fabricate,
			 process, or store any material so transferred or any special nuclear material
			 used in or produced through the use of such material and equipment;</text>
						</subparagraph><subparagraph commented="no" id="idEC5F4DD2CB8D4D1DAB592A5F3EE44080"><enum>(B)</enum><text>maintenance and
			 disclosure of records and of relevant reports for the purpose of assisting in
			 ensuring accountability for material transferred pursuant to the agreement and
			 any source or special nuclear material used in or produced through the use of
			 any material and equipment so transferred; and</text>
						</subparagraph><subparagraph commented="no" id="idCFE765D4CF174F48A4F3963B75760F06"><enum>(C)</enum><text>access to places
			 and data necessary to account for the material referred to in subparagraph (B)
			 and to inspect any equipment or facility referred to in subparagraph
			 (A).</text>
						</subparagraph></paragraph></subsection><subsection commented="no" id="id16202DF79EE8451D9434FFA7B0526C1F"><enum>(c)</enum><header>Implementation</header><text>The
			 measures described in subsection (b) shall be implemented to provide reasonable
			 assurances that the recipient is complying with the relevant requirements,
			 terms, and conditions of any licenses issued by the United States regarding
			 such exports, including those relating to the use, retransfer, safe handling,
			 secure transit, and storage of such exports.</text>
				</subsection></section><section id="IDc787fe93d96f44fe8acb4643a01a60c8"><enum>108.</enum><header>Implementation
			 and compliance</header>
				<subsection id="ID9ec20f0ba2e543ce86a8fa91e02d3c6b"><enum>(a)</enum><header>Information on
			 nuclear activities of India</header><text>The President shall keep the
			 appropriate congressional committees fully and currently informed of the facts
			 and implications of any significant nuclear activities of India,
			 including—</text>
					<paragraph id="IDc7b2723181ba476098a813a342818072"><enum>(1)</enum><text>any material
			 non-compliance on the part of the Government of India with—</text>
						<subparagraph id="IDb3797396ed9a4cc790fabc7cb24f4b1b"><enum>(A)</enum><text>the
			 non-proliferation commitments undertaken in the Joint Statement of July 18,
			 2005, between the President of the United States and the Prime Minister of
			 India;</text>
						</subparagraph><subparagraph id="ID11f63e142f554ed38e806225b33701f6"><enum>(B)</enum><text>the separation
			 plan presented in the national parliament of India on March 7, 2006, and in
			 greater detail on May 11, 2006;</text>
						</subparagraph><subparagraph id="IDe7ebbaacc37e4d3dbdf3f5cf656aac84"><enum>(C)</enum><text>a safeguards
			 agreement between the Government of India and the IAEA;</text>
						</subparagraph><subparagraph id="IDd9169bff56634c0b90d0de2a9466442c"><enum>(D)</enum><text>an Additional
			 Protocol between the Government of India and the IAEA;</text>
						</subparagraph><subparagraph id="IDfb9e3e815d9f47849dfbc49d2b1ab78b"><enum>(E)</enum><text>a peaceful
			 nuclear cooperation agreement between the Government of India and the United
			 States Government pursuant to section 123 of the Atomic Energy Act of 1954 (42
			 U.S.C. 2153) or any subsequent arrangement under section 131 of such Act (42
			 U.S.C. 2160);</text>
						</subparagraph><subparagraph id="id6E64C2575276480398F6AF47C48360E8"><enum>(F)</enum><text>the terms and
			 conditions of any approved licenses; and</text>
						</subparagraph><subparagraph id="idA172D1867E844AD8B10048C097D9A284"><enum>(G)</enum><text>United States
			 laws and regulations regarding the export or reexport of nuclear material or
			 dual-use material, equipment, or technology;</text>
						</subparagraph></paragraph><paragraph id="ID1adf5328b70041acaef27f3ff9204f17"><enum>(2)</enum><text>the construction
			 of a nuclear facility in India after the date of the enactment of this
			 Act;</text>
					</paragraph><paragraph id="ID0e82a43cb9f84d17b7ae6350439bf40e"><enum>(3)</enum><text>significant
			 changes in the production by India of nuclear weapons or in the types or
			 amounts of fissile material produced; and</text>
					</paragraph><paragraph id="ID37dc98e28b204335bf0622495e51995c"><enum>(4)</enum><text>changes in the
			 purpose or operational status of any unsafeguarded nuclear fuel cycle
			 activities in India.</text>
					</paragraph></subsection><subsection id="ID30c28a1c97ef4b2a9691fc190267c0f3"><enum>(b)</enum><header>Implementation
			 and compliance report</header><text>Not later than 180 days after the date on
			 which an agreement between the Government of India and the United States
			 Government pursuant to section 123 of the Atomic Energy Act of 1954 (42 U.S.C.
			 2153) enters into force, and annually thereafter, the President shall submit to
			 the appropriate congressional committees a report including—</text>
					<paragraph id="idE2571FF2D9534A309A47FC913ACE1858"><enum>(1)</enum><text>a description of
			 any additional nuclear facilities and nuclear materials that the Government of
			 India has placed or intends to place under IAEA safeguards;</text>
					</paragraph><paragraph id="ID2517c8fdd40a41e3b0552c840c085014"><enum>(2)</enum><text>a comprehensive
			 listing of—</text>
						<subparagraph id="ID76db7cf4f2664c26994ed0f94e8ea667"><enum>(A)</enum><text>all licenses that
			 have been approved by the Nuclear Regulatory Commission and the Secretary of
			 Energy for exports and reexports to India under parts 110 and 810 of title 10,
			 Code of Federal Regulations;</text>
						</subparagraph><subparagraph id="ID33fd884c892f48e99af25e90a359d28a"><enum>(B)</enum><text>any licenses
			 approved by the Department of Commerce for the export or reexport to India of
			 commodities, related technology, and software which are controlled for nuclear
			 non-proliferation reasons on the Nuclear Referral List of the Commerce Control
			 List maintained under part 774 of title 15, Code of Federal Regulations;</text>
						</subparagraph><subparagraph id="idB97A58735DAC4594896F1C5E278AE3E9"><enum>(C)</enum><text>any other United
			 States authorizations for the export or reexport to India of nuclear materials
			 and equipment; and</text>
						</subparagraph><subparagraph id="IDd86af719eb7644deb24f6043b396c6c3"><enum>(D)</enum><text>with respect to
			 each such license or other form of authorization described in subparagraphs
			 (A), (B), and (C)—</text>
							<clause id="ID876fee835be64afbbd9f96b94eda0281"><enum>(i)</enum><text>the
			 number or other identifying information of each license or
			 authorization;</text>
							</clause><clause id="IDf3511b8474874eb3a54a5d9caf54541e"><enum>(ii)</enum><text>the name or
			 names of the authorized end user or end users;</text>
							</clause><clause id="ID607de7ee51dc4673b700da5f660f12c6"><enum>(iii)</enum><text>the name of the
			 site, facility, or location in India to which the export or reexport was
			 made;</text>
							</clause><clause id="ID9df74838400c417f8dfd7573dfffec04"><enum>(iv)</enum><text>the terms and
			 conditions included on such licenses and authorizations;</text>
							</clause><clause id="ID03f86458a0f34cf58ab1338ce228140f"><enum>(v)</enum><text>any
			 post-shipment verification procedures that will be applied to such exports or
			 reexports; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID6761fb629f104185a4f86b58805f79c9"><enum>(vi)</enum><text>the term of
			 validity of each such license or authorization;</text>
							</clause></subparagraph></paragraph><paragraph id="ID31d9abe19ad04fb5942aa089245aece4"><enum>(3)</enum><text>any significant
			 nuclear commerce between India and other countries, including any such trade
			 that—</text>
						<subparagraph id="ID6a836a555401456eb59f1094f9014437"><enum>(A)</enum><text>does not comply
			 with applicable guidelines or decisions of the Nuclear Suppliers Group;
			 or</text>
						</subparagraph><subparagraph id="ID6b818fa07da844018dfb8018d58e3190"><enum>(B)</enum><text>would not meet
			 the standards applied to exports or reexports of such material, equipment, or
			 technology of United States origin;</text>
						</subparagraph></paragraph><paragraph id="id43B24EF198544E8CAD6D1F6B5511CCB8"><enum>(4)</enum><text>either—</text>
						<subparagraph id="IDb4a644e70592407794093b76742e0d1b"><enum>(A)</enum><text>a certification
			 that India is in full compliance with the commitments and obligations contained
			 in the agreements and other documents referenced in subparagraphs (A) through
			 (F) of subsection (a)(1); or</text>
						</subparagraph><subparagraph id="id36D9E6ACDD8643D392F6AFA9618E5E5E"><enum>(B)</enum><text>if the President
			 cannot make such certification, an identification and assessment of all
			 compliance issues arising with regard to the adherence by India to its
			 commitments and obligations, including—</text>
							<clause id="IDb357747bc64b4f2d9b7f507958da527c"><enum>(i)</enum><text>the
			 steps the United States Government has taken to remedy or otherwise respond to
			 such compliance issues;</text>
							</clause><clause id="ID3c2f9bb855294729a674f999d6a8bc71"><enum>(ii)</enum><text>the responses of
			 the Government of India to such steps; and</text>
							</clause><clause id="ID77dd2c851cc246d2ba910f4c1842438a"><enum>(iii)</enum><text>an assessment
			 of the implications of any continued noncompliance, including whether nuclear
			 commerce with India, if not already terminated under section 129 of the Atomic
			 Energy Act of 1954 (42 U.S.C. 2158), remains in the national security interest
			 of the United States;</text>
							</clause></subparagraph></paragraph><paragraph id="idCCFD3569DF4B4C638D931511C0809441"><enum>(5)</enum><text>a detailed
			 description of—</text>
						<subparagraph id="id4A5ED087947F4AE8A8895E7DBD97133A"><enum>(A)</enum><text>United States
			 efforts to promote national or regional progress by India and Pakistan in
			 disclosing, securing, capping, and reducing their fissile material stockpiles,
			 pending creation of a world-wide fissile material cut-off regime, including the
			 institution of a Fissile Material Cut-off Treaty;</text>
						</subparagraph><subparagraph id="id646FC410D3734811AA446A3839E4B494"><enum>(B)</enum><text>the reactions of
			 India and Pakistan to such efforts; and</text>
						</subparagraph><subparagraph id="idDE7F09B5B1D64155845BB80631E39B85"><enum>(C)</enum><text>assistance that
			 the United States is providing, or would be able to provide, to India and
			 Pakistan to promote the objectives in subparagraph (A), consistent with its
			 obligations under international law and existing agreements; and</text>
						</subparagraph></paragraph><paragraph id="id06C0627B8F65420D9646545F29CA8239"><enum>(6)</enum><text>a detailed
			 description of efforts and progress made toward the achievement of
			 India's—</text>
						<subparagraph id="id1A4150CD18E94735ACB2973ED68E4797"><enum>(A)</enum><text>full
			 participation in the Proliferation Security Initiative;</text>
						</subparagraph><subparagraph id="id03D2F888EC504803A8FF25F9E1686532"><enum>(B)</enum><text>formal commitment
			 to the Statement of Interdiction Principles;</text>
						</subparagraph><subparagraph id="id3383CB6081564DB4AF8BC890735CD450"><enum>(C)</enum><text>public
			 announcement of its decision to conform its export control laws, regulations,
			 and policies with the Australia Group and with the Guidelines, Procedures,
			 Criteria, and Controls List of the Wassenaar Arrangement; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1EFD306D177B4A3DAC9B202DD6FD5F98"><enum>(D)</enum><text>demonstration of
			 satisfactory progress toward implementing the decision described in
			 subparagraph (C).</text>
						</subparagraph></paragraph></subsection><subsection id="IDc8dc076c7a4f40afb8f0ec78ab1372cf"><enum>(c)</enum><header>Submittal with
			 other annual reports</header>
					<paragraph id="id4AC7FCEAA719415796FB151BBF4384E6"><enum>(1)</enum><header>Report on
			 proliferation prevention</header><text>Each annual report submitted under
			 subsection (b) after the initial report may be submitted together with the
			 annual report on proliferation prevention required under section 601(a) of the
			 Nuclear Non-Proliferation Act of 1978 (22 U.S.C. 3281(a)).</text>
					</paragraph><paragraph id="id772EB628A505475A837FEAF9D283F8A2"><enum>(2)</enum><header>Report on
			 progress toward regional non-proliferation</header><text>The information
			 required to be submitted under subsection (b)(5) after the initial report may
			 be submitted together with the annual report on progress toward regional
			 non-proliferation required under section 620F(c) of the Foreign Assistance Act
			 of 1961 (22 U.S.C. 2376(c)).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA3069CCD5501477AA3DA0BD075E30824"><enum>(d)</enum><header>Form</header><text>Each
			 report submitted under this section shall be submitted in unclassified form but
			 may contain a classified annex.</text>
				</subsection></section><section id="IDca26d8d37b724d0d82d18702ee0a6830"><enum>109.</enum><header>United States
			 compliance with its Nuclear Non-Proliferation Treaty obligations</header><text display-inline="no-display-inline">This title shall not be deemed to constitute
			 authority for any action in violation of any obligation of the United States
			 under the Nuclear Non-Proliferation Treaty.</text>
			</section><section id="IDe8d7e02322b84232b3a422b308db45e1"><enum>110.</enum><header>Inoperability
			 of determination and waivers</header><text display-inline="no-display-inline">A
			 determination under section 105 and any waiver under section 104 shall cease to
			 be effective if the President determines that India has detonated a nuclear
			 explosive device after the date of the enactment of this Act.</text>
			</section><section id="IDd764cdde95e14042bf2bfde87bea630d"><enum>111.</enum><header>MTCR adherent
			 status</header><text display-inline="no-display-inline">Congress finds that
			 India is not an MTCR adherent for the purposes of Section 73 of the Arms Export
			 Control Act (22 U.S.C. 2797b).</text>
			</section><section id="idA47C869FBEC044A0A072E45BD3FCA6A8"><enum>112.</enum><header>Technical
			 amendment</header><text display-inline="no-display-inline">Section 1112(c)(4)
			 of the Arms Control and Nonproliferation Act of 1999 (title XI of the Admiral
			 James W. Nance and Meg Donovan Foreign Relations Act, Fiscal Years 2000 and
			 2001 (as enacted into law by section 1000(a)(7) of Public Law 106–113 and
			 contained in appendix G of that Act; 113 Stat. 1501A–486)) is amended—</text>
				<paragraph id="idBFC6B7E0A97845DEA1BD0B2D3F6EFC23"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking
			 <quote>and</quote> after the semicolon at the end;</text>

				</paragraph></section><section id="id48441B349F174859849BBFD0D1803591"><enum>113.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="id1E78899DDC3C4EAC94F19CDFD947AF2A"><enum>(1)</enum><text>The term
			 <term>Additional Protocol</term> means a protocol additional to a safeguards
			 agreement with the IAEA, as negotiated between a country and the IAEA based on
			 a Model Additional Protocol as set forth in IAEA information circular (INFCIRC)
			 540.</text>
				</paragraph><paragraph id="idDFD9D8FDE183448797B7915CF4E5B33B"><enum>(2)</enum><text>The term
			 <term>appropriate congressional committees</term> means the Committee on
			 Foreign Relations of the Senate and the Committee on International Relations of
			 the House of Representatives.</text>
				</paragraph><paragraph id="id0087D735E2564567ACC0B9F5D6BEFAEF"><enum>(3)</enum><text>The term
			 <term>atomic energy</term> has the meaning given the term in section 11 c. of
			 the Atomic Energy Act of 1954 (42 U.S.C. 2014(c)).</text>
				</paragraph><paragraph id="id3717FBCDDC4449E4975C8E68C103B788"><enum>(4)</enum><text>The term
			 <term>dual-use material, equipment, or technology</term> means material,
			 equipment, or technology that may be used in nuclear or non-nuclear
			 applications.</text>
				</paragraph><paragraph id="id0A82EA72F96E41A48217796E396A5DF9"><enum>(5)</enum><text>The term
			 <term>IAEA safeguards</term> has the meaning given the term in section 830(3)
			 of the Nuclear Proliferation Prevention Act of 1994 (22 U.S.C. 6305(3)).</text>
				</paragraph><paragraph id="id4F5867C8BF52458F90B1CA36FDE8A8E1"><enum>(6)</enum><text>The term
			 <term>nuclear materials and equipment</term> means source material, special
			 nuclear material, production and utilization facilities and any components
			 thereof, and any other items or materials that are determined to have
			 significance for nuclear explosive purposes pursuant to subsection 109 b. of
			 the Atomic Energy Act of 1954 (42 U.S.C. 2139(b)).</text>
				</paragraph><paragraph id="id03A2BB9381F8445E9314C7BD57134037"><enum>(7)</enum><text>The term
			 <term>Nuclear Non-Proliferation Treaty</term> means the Treaty on the
			 Non-Proliferation of Nuclear Weapons, done at Washington, London, and Moscow
			 July 1, 1968, and entered into force March 5, 1970 (21 UST 483).</text>
				</paragraph><paragraph id="idAF873FCC7EFB4BC68480D5BBB4FDCD1E"><enum>(8)</enum><text>The terms
			 <term>nuclear weapon</term> and <term>nuclear explosive device</term> mean any
			 device designed to produce an instantaneous release of an amount of nuclear
			 energy from special nuclear material that is greater than the amount of energy
			 that would be released from the detonation of one point of trinitrotoluene
			 (TNT).</text>
				</paragraph><paragraph id="id43752C7923FD4DDDB03248F9035091A4"><enum>(9)</enum><text>The terms
			 <term>reprocessing</term> and <term>reprocess</term> refer to the separation of
			 nuclear materials from fission products in spent nuclear fuel.</text>
				</paragraph><paragraph id="id40C1DE78BCD74555ABC0FBD26F696B3D"><enum>(10)</enum><text>The term
			 <term>sensitive nuclear technology </term> has the meaning given the term in
			 section 4(5) of the Nuclear Nonproliferation Act of 1978 (22 U.S.C.
			 3203(5)).</text>
				</paragraph><paragraph id="idD7E028F22B2F428AA6A3AB9008CCC57B"><enum>(11)</enum><text>The term
			 <term>source material</term> has the meaning given the term in section 11 z. of
			 the Atomic Energy Act of 1954 (42 U.S.C. 2014(z)).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC7066A0889754BEDBD41E35680BA70A7"><enum>(12)</enum><text>The term
			 <term>special nuclear material</term> has the meaning given the term in section
			 11 aa. of the Atomic Energy Act of 1954 (42 U.S.C. 2014(aa)).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34740E7F53124C238197B6ED4265BB24"><enum>(13)</enum><text>The term
			 <term>unsafeguarded nuclear fuel-cycle activity</term> means research on, or
			 development, design, manufacture, construction, operation, or maintenance
			 of—</text>
					<subparagraph id="idA7FA5919A35942EC9283D3876DF57B08"><enum>(A)</enum><text>any existing or
			 future reactor, critical facility, conversion plant, fabrication plant,
			 reprocessing plant, plant for the separation of isotopes of source or special
			 fissionable material, or separate storage installation with respect to which
			 there is no obligation to accept IAEA safeguards at the relevant reactor,
			 facility, plant, or installation that contains source or special fissionable
			 material; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id34713EF8E7774919977CC64412E17E1E"><enum>(B)</enum><text>any existing or
			 future heavy water production plant with respect to which there is no
			 obligation to accept IAEA safeguards on any nuclear material produced by or
			 used in connection with any heavy water produced therefrom.</text>
					</subparagraph></paragraph></section></title><title id="id50915B4ED4F945EDB6371E2E5BF8054A"><enum>II</enum><header>United States
			 additional protocol implementation</header>
			<section id="id05A245A0DF59463294636E7AD265CCB8"><enum>201.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote>United States Additional Protocol Implementation
			 Act</quote>.</text>
			</section><section id="idF3994B8E13694F059B811D65EB020EEE"><enum>202.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID2E214A2B02DE4F7A927C3DDEE47B7E26"><enum>(1)</enum><header>Additional

			 access</header><text display-inline="yes-display-inline">The term
			 <term>complementary access</term> means the exercise of the IAEA’s access
			 rights as set forth in Articles 4 to 6 of the Additional Protocol.</text>

			 <term>executive agency</term> has the meaning given such term in section 105 of

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID898438FCC705467EAF414FB12A43CCD2"><enum>(8)</enum><header>Location</header><text display-inline="yes-display-inline">The term <term>location</term> means any
			 geographic point or area declared or identified by the United States or
			 specified by the International Atomic Energy Agency.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDC87A6DB085E46A0AC765C811A90887B"><enum>(9)</enum><header>Nuclear
			 non-proliferation treaty</header><text display-inline="yes-display-inline">The
			 term <term>Nuclear Non-Proliferation Treaty</term> means the Treaty on the
			 Non-Proliferation of Nuclear Weapons, done at Washington, London, and Moscow
			 July 1, 1968, and entered into force March 5, 1970 (21 UST 483).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1E0667ED6EB644E98221DBDE89B8D318"><enum>(10)</enum><header>Nuclear-weapon
			 state party and non-nuclear-weapon state party</header><text display-inline="yes-display-inline">The terms <term>nuclear-weapon State
			 Party</term> and <term>non-nuclear-weapon State Party</term> have the meanings
			 given such terms in the Nuclear Non-Proliferation Treaty.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID16D4FC4E83CF493686FE20CAE19B9418"><enum>(11)</enum><header>Person</header><text display-inline="yes-display-inline">The term <term>person</term>, except as
			 otherwise provided, means any individual, corporation, partnership, firm,
			 association, trust, estate, public or private institution, any State or any
			 political subdivision thereof, or any political entity within a State, any
			 foreign government or nation or any agency, instrumentality or political
			 subdivision of any such government or nation, or other entity located in the
			 United States.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEC4CC01E4BEC40C2A8922CE68490D9D4"><enum>(13)</enum><header>United
			 states</header><text display-inline="yes-display-inline">The term <term>United
			 States</term>, when used as a geographic reference, means the several States of
			 the United States, the District of Columbia, and the commonwealths,
			 territories, and possessions of the United States and includes all places under
			 the jurisdiction or control of the United States, including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDEFE560CA80D6464CB7C365B9475084B0"><enum>(A)</enum><text display-inline="yes-display-inline">the territorial sea and the overlying
			 airspace;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9C21CAA72BA947B08614D8DE5F2F5960"><enum>(B)</enum><text display-inline="yes-display-inline">any civil aircraft of the United States or
			 public aircraft, as such terms are defined in paragraphs (17) and (41),
			 respectively, of section 40102(a) of title 49, United States Code; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID092A666F7FE845ECA3B9212975205A95"><enum>(C)</enum><text display-inline="yes-display-inline">any vessel of the United States, as such
			 term is defined in section 3(b) of the Maritime Drug Law Enforcement Act (46
			 U.S.C. App. 1903(b)).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAD42E330E7B846B098B02EC4AA9E0E09"><enum>(14)</enum><header>Wide-area
			 environmental sampling</header><text display-inline="yes-display-inline">The
			 term <term>wide-area environmental sampling</term> has the meaning set forth in
			 Article 18g. of the Additional Protocol.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idBFC5A063A0E145E2BB06238AC5B589B6"><enum>203.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this title, or the
			 application of such provision to any person or circumstance, is held invalid,
			 the remainder of this title, or the application of such provision to persons or
			 circumstances other than those as to which it is held invalid, shall not be
			 affected thereby.</text>
			</section><subtitle id="id1409086485B7419B9161EAA67C1D29E1"><enum>A</enum><header>General
			 provisions</header>
				<section id="idA6FB7E4B719445DCAB36D0694D6F09E3"><enum>211.</enum><header>Authority</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID61B6BD548C734D5296D3B012D27883E1"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">The President is
			 authorized to implement and carry out the provisions of this title and the
			 Additional Protocol and shall designate through Executive order which executive
			 agency or agencies of the United States, which may include but are not limited
			 to the Department of State, the Department of Defense, the Department of
			 Justice, the Department of Commerce, the Department of Energy, and the Nuclear
			 Regulatory Commission, shall issue or amend and enforce regulations in order to
			 implement this title and the provisions of the Additional Protocol.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID934708D91DEB429EB24B4445D1CC6A5D"><enum>(b)</enum><header>Included
			 Authority</header><text display-inline="yes-display-inline">For any executive
			 agency designated under subsection (a) that does not currently possess the
			 authority to conduct site vulnerability assessments and related activities, the
			 authority provided in subsection (a) includes such authority.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDF397560B8DCA43E584E9C10AA63E14A5"><enum>(c)</enum><header>Exception</header><text display-inline="yes-display-inline">The authority described in subsection (b)
			 does not supersede or otherwise modify any existing authority of any Federal
			 department or agency already having such authority.</text>
					</subsection></section></subtitle><subtitle id="idA610161362CE454D963E47713BF55EC6"><enum>B</enum><header>Complementary
			 access</header>
				<section id="idAE851F82CD224F418169D37462024097"><enum>221.</enum><header>Requirement
			 for authority to conduct complementary access</header>
					<subsection commented="no" display-inline="no-display-inline" id="IDB6C4B2BB8D224D448BB4D358715AFD95"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No complementary access to any location in
			 the United States shall take place pursuant to the Additional Protocol without
			 the authorization of the United States Government in accordance with the
			 requirements of this title.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDF9A5911548C04A9796DEBAA58B3F1F36"><enum>(b)</enum><header>Authority</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID9EBABBC1172C4ED8B9E7BF646877B6B1"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Complementary access
			 to any location in the United States subject to access under the Additional
			 Protocol is authorized in accordance with this title.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD68C5DD9B9D443BE8FFCA4780945ADC3"><enum>(2)</enum><header>United states
			 representatives</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID6077A718D1884A6D8E18026C75EC9123"><enum>(A)</enum><header>Restrictions</header><text display-inline="yes-display-inline">In the event of complementary access to a
			 privately owned or operated location, no employee of the Environmental
			 Protection Agency or of the Mine Safety and Health Administration or the
			 Occupational Safety and Health Administration of the Department of Labor may
			 participate in the access.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID281E25201C5146019AEDEA15DB49B550"><enum>(B)</enum><header>Number</header><text display-inline="yes-display-inline">The number of designated United States
			 representatives accompanying IAEA inspectors shall be kept to the minimum
			 necessary.</text>
							</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id314321FB9BD64DA3AFC447DD67013364"><enum>222.</enum><header>Procedures for
			 complementary access</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID4BF037B304434410AE4345C4504211F6"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Each instance of
			 complementary access to a location in the United States under the Additional
			 Protocol shall be conducted in accordance with this subtitle.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDCBF30289731A4703B2D61DEE8689F752"><enum>(b)</enum><header>Notice</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID6E8CA5B74D0D43D8BB8D7CD621CFA151"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Complementary access
			 referred to in subsection (a) may occur only upon the issuance of an actual
			 written notice by the United States Government to the owner, operator,
			 occupant, or agent in charge of the location to be subject to complementary
			 access.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID975609335E3A43048D98516900CBB5FA"><enum>(2)</enum><header>Time of
			 notification</header><text display-inline="yes-display-inline">The notice under
			 paragraph (1) shall be submitted to such owner, operator, occupant, or agent as
			 soon as possible after the United States Government has received notification
			 that the IAEA seeks complementary access. Notices may be posted prominently at
			 the location if the United States Government is unable to provide actual
			 written notice to such owner, operator, occupant, or agent.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID69135CE6560241BAA408B06E60DA0625"><enum>(3)</enum><header>Content of
			 notice</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID603B4866A87C4A6890DF2A0CD02400C5"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The notice required
			 by paragraph (1) shall specify—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID9A69F2BCC3FA44F9A4469F329C7F5D13"><enum>(i)</enum><text display-inline="yes-display-inline">the purpose for the complementary
			 access;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID2C390282568548A088B35F8356DD63D7"><enum>(ii)</enum><text display-inline="yes-display-inline">the basis for the selection of the
			 facility, site, or other location for the complementary access sought;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID3550B1BE8FCE4DAA914B783B0C10F18B"><enum>(iii)</enum><text display-inline="yes-display-inline">the activities that will be carried out
			 during the complementary access;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID9960DA05024A4794AAFE9ABA9F3719F6"><enum>(iv)</enum><text display-inline="yes-display-inline">the time and date that the complementary
			 access is expected to begin, and the anticipated period covered by the
			 complementary access; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID2ED9D8D6E01B45BC86F51FFA15A419D5"><enum>(v)</enum><text display-inline="yes-display-inline">the names and titles of the
			 inspectors.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID91E01F5E28464800806111E00C7E0EE6"><enum>(4)</enum><header>Separate
			 notices required</header><text display-inline="yes-display-inline">A separate
			 notice shall be provided each time that complementary access is sought by the
			 IAEA.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB708CE5D8303416C94EE6AE5BE817EF6"><enum>(c)</enum><header>Credentials</header><text display-inline="yes-display-inline">The complementary access team of the IAEA
			 and representatives or designees of the United States Government shall display
			 appropriate identifying credentials to the owner, operator, occupant, or agent
			 in charge of the location before gaining entry in connection with complementary
			 access.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID53DC90831B104A59A6D122E0E278AC61"><enum>(d)</enum><header>Scope</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID34F0C3C4CEF34F05BD3023CE7D934615"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 a warrant issued under section 223, and subject to the United States
			 Government’s rights under the Additional Protocol to limit complementary
			 access, complementary access to a location pursuant to this title may extend to
			 all activities specifically permitted for such locations under Article 6 of the
			 Additional Protocol.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8DFC574822CE442DB1B8CFDCCA04CBFB"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Unless required by the Additional Protocol,
			 no inspection under this title shall extend to—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID114E7B9A51D943F98B8D9A63D906A12B"><enum>(A)</enum><text display-inline="yes-display-inline">financial data (other than production
			 data);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9B5AA7ADB0AC45F3ADBC456BAB7646D9"><enum>(B)</enum><text display-inline="yes-display-inline">sales and marketing data (other than
			 shipment data);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID147DBA271C9E4E1495FE754EC8D8D835"><enum>(C)</enum><text display-inline="yes-display-inline">pricing data;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5A36910EFE1E4A1199BB8133B375ED5A"><enum>(D)</enum><text display-inline="yes-display-inline">personnel data;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCC4FC6528F474B348C3A669259185AEB"><enum>(E)</enum><text display-inline="yes-display-inline">patent data;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD97C580248E643B0A76671DD60C34BB2"><enum>(F)</enum><text display-inline="yes-display-inline">data maintained for compliance with
			 environmental or occupational health and safety regulations; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID93151350D1DC45FD96C3039CA8902E72"><enum>(G)</enum><text display-inline="yes-display-inline">research data.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5C4D266F04EF482F95059250B2639BCA"><enum>(e)</enum><header>Environment,
			 Health, Safety, and Security</header><text display-inline="yes-display-inline">In carrying out their activities, members
			 of the IAEA complementary access team and representatives or designees of the
			 United States Government shall observe applicable environmental, health,
			 safety, and security regulations established at the location subject to
			 complementary access, including those for protection of controlled environments
			 within a facility and for personal safety.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="idBAB76DB13AC9496C97FE2F28DED057F0"><enum>223.</enum><header>Consents,
			 warrants, and complementary access</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID189F4534131642309D7C2AF9820097D7"><enum>(a)</enum><header>In
			 General</header>
						<paragraph commented="no" display-inline="no-display-inline" id="IDC1BF6209F7B540BE875134996501371F"><enum>(1)</enum><header>Procedure</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID1DA747749FAE4CFEBB86A9318F3B0FCA"><enum>(A)</enum><header>Consent</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), an
			 appropriate official of the United States Government shall seek or have the
			 consent of the owner, operator, occupant, or agent in charge of a location
			 prior to entering that location in connection with complementary access
			 pursuant to sections 221 and 222. The owner, operator, occupant, or agent in
			 charge of the location may withhold consent for any reason or no reason.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0321FE8DE3154792910B0B83F380FECC"><enum>(B)</enum><header>Administrative
			 search warrant</header><text display-inline="yes-display-inline">In the absence
			 of consent, the United States Government may seek an administrative search
			 warrant from a judge of the United States under subsection (b). Proceedings
			 regarding the issuance of an administrative search warrant shall be conducted
			 ex parte, unless otherwise requested by the United States Government.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID36D4C4671A6D4FBF9F89949FE5856C7D"><enum>(2)</enum><header>Expedited
			 access</header><text display-inline="yes-display-inline">For purposes of
			 obtaining access to a location pursuant to Article 4b.(ii) of the Additional
			 Protocol in order to satisfy United States obligations under the Additional
			 Protocol when notice of two hours or less is required, the United States
			 Government may gain entry to such location in connection with complementary
			 access, to the extent such access is consistent with the Fourth Amendment to
			 the United States Constitution, without obtaining either a warrant or
			 consent.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC4BB4D812DB047BAA97A2184AE3EE686"><enum>(b)</enum><header>Administrative
			 Search Warrants for Complementary Access</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID53C0C6A32DA94384B54F5A1174DC7E8A"><enum>(1)</enum><header>Obtaining
			 administrative search warrants</header><text display-inline="yes-display-inline">For complementary access conducted in the
			 United States pursuant to the Additional Protocol, and for which the
			 acquisition of a warrant is required, the United States Government shall first
			 obtain an administrative search warrant from a judge of the United States. The
			 United States Government shall provide to such judge all appropriate
			 information regarding the basis for the selection of the facility, site, or
			 other location to which complementary access is sought.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8D794C35EDD44526986C3E0A17295051"><enum>(2)</enum><header>Content of
			 affidavits for administrative search warrants</header><text display-inline="yes-display-inline">A judge of the United States shall promptly
			 issue an administrative search warrant authorizing the requested complementary
			 access upon an affidavit submitted by the United States Government—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDD2BFF2AAF54D44F7B401141013DA2722"><enum>(A)</enum><text display-inline="yes-display-inline">stating that the Additional Protocol is in
			 force;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID58ACFA8A173A4A83AC0D0075ABE13144"><enum>(B)</enum><text display-inline="yes-display-inline">stating that the designated facility, site,
			 or other location is subject to complementary access under the Additional
			 Protocol;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEEDC4E40A85F4210B3DBF798FD19A682"><enum>(C)</enum><text display-inline="yes-display-inline">stating that the purpose of the
			 complementary access is to verify the correctness and completeness of
			 information declared by the United States Government pursuant to Article 2 of
			 the Additional Protocol;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3895D536324840129BEDB23930CDA796"><enum>(D)</enum><text display-inline="yes-display-inline">stating that the requested complementary
			 access is in accordance with Article 4 of the Additional Protocol;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA0C4E01D54164D01B3394555AE154199"><enum>(E)</enum><text display-inline="yes-display-inline">containing assurances that the scope of the
			 IAEA’s complementary access, as well as what it may collect, shall be limited
			 to the access provided for in Article 6 of the Additional Protocol;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7C3FEBC66ED4467CB20873644EAC348D"><enum>(F)</enum><text display-inline="yes-display-inline">listing the items, documents, and areas to
			 be searched and seized;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0893FCA091AB4E2991E965AE27FF313D"><enum>(G)</enum><text display-inline="yes-display-inline">stating the earliest commencement and the
			 anticipated duration of the complementary access period, as well as the
			 expected times of day during which such complementary access will take place;
			 and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID07532ABC87604DD180CAE8CC1EC34A64"><enum>(H)</enum><text display-inline="yes-display-inline">stating that the location to which entry in
			 connection with complementary access is sought was selected either—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID728A893249C7450A8EC24576452A84A8"><enum>(i)</enum><text display-inline="yes-display-inline">because there is probable cause, on the
			 basis of specific evidence, to believe that information required to be reported
			 regarding a location pursuant to regulations promulgated under this title is
			 incorrect or incomplete, and that the location to be accessed contains evidence
			 regarding that violation; or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDB6F74D8B0E92477491FEB62D77C99356"><enum>(ii)</enum><text display-inline="yes-display-inline">pursuant to a reasonable general
			 administrative plan based upon specific neutral criteria.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBC0AACFB25BE4368ABF026AF64C732CB"><enum>(3)</enum><header>Content of
			 warrants</header><text display-inline="yes-display-inline">A warrant issued
			 under paragraph (2) shall specify the same matters required of an affidavit
			 under that paragraph. In addition, each warrant shall contain the identities of
			 the representatives of the IAEA on the complementary access team and the
			 identities of the representatives or designees of the United States Government
			 required to display identifying credentials under section 222(c).</text>
						</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id264E8541D3054EC08F52830864D6AFC9"><enum>224.</enum><header>Prohibited
			 acts relating to complementary access</header><text display-inline="no-display-inline">It shall be unlawful for any person
			 willfully to fail or refuse to permit, or to disrupt, delay, or otherwise
			 impede, a complementary access authorized by this subtitle or an entry in
			 connection with such access.</text>
				</section></subtitle><subtitle id="id34413A2880B7436680C80938E1B073C7"><enum>C</enum><header>Confidentiality
			 of information</header>
				<section id="id22BC5E4E30834BCD89A805D1A245E3BF"><enum>231.</enum><header>Protection of
			 confidentiality of information</header><text display-inline="no-display-inline">Information reported to, or otherwise
			 acquired by, the United States Government under this title or under the
			 Additional Protocol shall be exempt from disclosure under sections 552 of title
			 5, United States Code.</text>
				</section></subtitle><subtitle id="idE5B0BCE3990E426FB44FD40A66F81E2E"><enum>D</enum><header>Enforcement</header>
				<section id="idB6A555B9B66943818AC11D368B59FE97"><enum>241.</enum><header>Recordkeeping
			 violations</header><text display-inline="no-display-inline">It shall be
			 unlawful for any person willfully to fail or refuse—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID467DD40897F5438AB38B5A8FA56F69D9"><enum>(1)</enum><text display-inline="yes-display-inline">to establish or maintain any record
			 required by any regulation prescribed under this title;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID68DC7A68F2F64524BEA25619E2B6A5EE"><enum>(2)</enum><text display-inline="yes-display-inline">to submit any report, notice, or other
			 information to the United States Government in accordance with any regulation
			 prescribed under this title; or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDED995354D32043F397A7DC4B40A9C6D2"><enum>(3)</enum><text display-inline="yes-display-inline">to permit access to or copying of any
			 record by the United States Government in accordance with any regulation
			 prescribed under this title.</text>
					</paragraph></section><section commented="no" display-inline="no-display-inline" id="idAC61530267994328A4B0C054F1E14050"><enum>242.</enum><header>Penalties</header>
					<subsection commented="no" display-inline="no-display-inline" id="IDC480E859FBDB41448675BE2D6796D2EC"><enum>(a)</enum><header>Civil</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID1A69935DEA554F669991012E72B4EA8F"><enum>(1)</enum><header>Penalty
			 amounts</header><text display-inline="yes-display-inline">Any person that is
			 determined, in accordance with paragraph (2), to have violated section 224 or
			 section 241 shall be required by order to pay a civil penalty in an amount not
			 to exceed $25,000 for each violation. For the purposes of this paragraph, each
			 day during which a violation of section 224 continues shall constitute a
			 separate violation of that section.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3604B0A6BA4E4633B72802F3140D55BB"><enum>(2)</enum><header>Notice and
			 hearing</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID5539CEE7BF6F4BB3AE38A1CE5EC1B2EB"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Before imposing a
			 penalty against a person under paragraph (1), the head of an executive agency
			 designated under section 211(a) shall provide the person with notice of the
			 order. If, within 15 days after receiving the notice, the person requests a
			 hearing, the head of the designated executive agency shall initiate a hearing
			 on the violation.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE6B212C9CC234E12A7270A4668216F0D"><enum>(B)</enum><header>Conduct of
			 hearing</header><text display-inline="yes-display-inline">Any hearing so
			 requested shall be conducted before an administrative judge. The hearing shall
			 be conducted in accordance with the requirements of section 554 of title 5,
			 United States Code. If no hearing is so requested, the order imposed by the
			 head of the designated agency shall constitute a final agency action.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC0BEC77088E34EAEBEC3931CDF9D753D"><enum>(C)</enum><header>Issuance of
			 orders</header><text display-inline="yes-display-inline">If the administrative
			 judge determines, upon the preponderance of the evidence received, that a
			 person named in the complaint has violated section 224 or section 241, the
			 administrative judge shall state his findings of fact and conclusions of law,
			 and issue and serve on such person an order described in paragraph (1).</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4CC9E1AAD60E40CCAE1540F35C2323B8"><enum>(D)</enum><header>Factors for
			 determination of penalty amounts</header><text display-inline="yes-display-inline">In determining the amount of any civil
			 penalty, the administrative judge or the head of the designated agency shall
			 take into account the nature, circumstances, extent, and gravity of the
			 violation or violations and, with respect to the violator, the ability to pay,
			 effect on ability to continue to do business, any history of such violations,
			 the degree of culpability, the existence of an internal compliance program, and
			 such other matters as justice may require.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE58282E24D7B4589902202D2EFF0E78B"><enum>(E)</enum><header>Content of
			 notice</header><text display-inline="yes-display-inline">For the purposes of
			 this paragraph, notice shall be in writing and shall be verifiably served upon
			 the person or persons subject to an order described in paragraph (1). In
			 addition, the notice shall—</text>
								<clause commented="no" display-inline="no-display-inline" id="IDB384E98155C54FADA453825F4AE683DC"><enum>(i)</enum><text display-inline="yes-display-inline">set forth the time, date, and specific
			 nature of the alleged violation or violations; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID1058C476390747CAAD2022A5A5AD2713"><enum>(ii)</enum><text display-inline="yes-display-inline">specify the administrative and judicial
			 remedies available to the person or persons subject to the order, including the
			 availability of a hearing and subsequent appeal.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD194DC9EA7894A779DA080AB398F051E"><enum>(3)</enum><header>Administrative
			 appellate review</header><text display-inline="yes-display-inline">The decision
			 and order of an administrative judge shall be the recommended decision and
			 order and shall be referred to the head of the designated executive agency for
			 final decision and order. If, within 60 days, the head of the designated
			 executive agency does not modify or vacate the decision and order, it shall
			 become a final agency action under this subsection.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8EADFBEDC9694291823386D64A88D2A8"><enum>(4)</enum><header>Judicial
			 review</header><text display-inline="yes-display-inline">A person adversely
			 affected by a final order may, within 30 days after the date the final order is
			 issued, file a petition in the Court of Appeals for the District of Columbia
			 Circuit or in the Court of Appeals for the district in which the violation
			 occurred.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD56996BDE1A7469D8AAAD62820229C4B"><enum>(5)</enum><header>Enforcement of
			 final orders</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDBA528D5A99E14BC586B5E2505EE99CE0"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">If a person fails to
			 comply with a final order issued against such person under this subsection
			 and—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID5B8929BF5E1843B4BEE8617EDBEB5081"><enum>(i)</enum><text display-inline="yes-display-inline">the person has not filed a petition for
			 judicial review of the order in accordance with paragraph (4), or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDCE38C31AE41F42E4A8BD7C8DC2FCCF92"><enum>(ii)</enum><text display-inline="yes-display-inline">a court in an action brought under
			 paragraph (4) has entered a final judgment in favor of the designated executive
			 agency,</text>
								</clause><continuation-text commented="no" continuation-text-level="subparagraph">the head of the designated
			 executive agency shall commence a civil action to seek compliance with the
			 final order in any appropriate district court of the United States.</continuation-text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8739532D33B54B458F09E149D3B8DB90"><enum>(B)</enum><header>No
			 review</header><text display-inline="yes-display-inline">In any such civil
			 action, the validity and appropriateness of the final order shall not be
			 subject to review.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2B7ED8E6739843C5BE7CEFCED888BBB7"><enum>(C)</enum><header>Interest</header><text display-inline="yes-display-inline">Payment of penalties assessed in a final
			 order under this section shall include interest at currently prevailing rates
			 calculated from the date of expiration of the 60-day period referred to in
			 paragraph (3) or the date of such final order, as the case may be.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1CFBFB13831D454AB78A5FD350A31141"><enum>(b)</enum><header>Criminal</header><text display-inline="yes-display-inline">Any person who violates section 224 or
			 section 241 may, in addition to or in lieu of any civil penalty which may be
			 imposed under subsection (a) for such violation, be fined under title 18,
			 United States Code, imprisoned for not more than five years, or both.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="ID6EE8893E118149079FA6B55125FFF41F" section-type="subsequent-section"><enum>243.</enum><header>Specific
			 enforcement</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID5F3AC4F29001454BBEEBA844F617D2AD"><enum>(a)</enum><header>Jurisdiction</header><text display-inline="yes-display-inline">The district courts of the United States
			 shall have jurisdiction over civil actions brought by the head of an executive
			 agency designated under section 211(a)—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID133BBCBC108B4618A4BEA464C2783218"><enum>(1)</enum><text display-inline="yes-display-inline">to restrain any conduct in violation of
			 section 224 or section 241; or</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA584293E9C394A24B361103387671D9F"><enum>(2)</enum><text display-inline="yes-display-inline">to compel the taking of any action required
			 by or under this title or the Additional Protocol.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD327B7EE9E004FE2989BBC9F14C07107"><enum>(b)</enum><header>Civil
			 Actions</header>
						<paragraph commented="no" display-inline="no-display-inline" id="IDBAB6DBB884B14F3793F5248FAC499832"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A civil action
			 described in subsection (a) may be brought—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDB91FD68F72CA4BA998736573BD76C340"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a civil action described in
			 paragraph (1) of such subsection, in the United States district court for the
			 judicial district in which any act, omission, or transaction constituting a
			 violation of section 224 or section 241 occurred or in which the defendant is
			 found or transacts business; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4961F4BF0FE14424A5E111F05B509D83"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a civil action described in
			 paragraph (2) of such subsection, in the United States district court for the
			 judicial district in which the defendant is found or transacts business.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC8C6AEDE3C8548548F310F5A5985C418"><enum>(2)</enum><header>Service of
			 process</header><text display-inline="yes-display-inline">In any such civil
			 action, process shall be served on a defendant wherever the defendant may
			 reside or may be found.</text>
						</paragraph></subsection></section></subtitle><subtitle id="idF3D628F31EF4464F8FBD7CD2C0D6478E"><enum>E</enum><header>Environmental
			 sampling</header>
				<section id="id8A58D1A5F9B040DCBDA1B6B3CC46A977"><enum>251.</enum><header>Notification
			 to Congress of IAEA board approval of wide-area environmental sampling</header>
					<subsection commented="no" display-inline="no-display-inline" id="IDC5565AF4E9FC4008AFDFE78DD847D5A7"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Not later than 30
			 days after the date on which the Board of Governors of the IAEA approves
			 wide-area environmental sampling for use as a safeguards verification tool, the
			 President shall notify the appropriate congressional committees.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5A3DDB9EEC2743C3AE53AA676787CC96"><enum>(b)</enum><header>Content</header><text display-inline="yes-display-inline">The notification under subsection (a) shall
			 contain—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID20E91E3D08B1457DAB606FB0572DC254"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the specific methods and
			 sampling techniques approved by the Board of Governors that are to be employed
			 for purposes of wide-area sampling; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5FDB83EBC2024118B44A3BE091AEF65D"><enum>(2)</enum><text display-inline="yes-display-inline">a statement as to whether or not such
			 sampling may be conducted in the United States under the Additional
			 Protocol.</text>
						</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID06E5EC60521441ABADBEAA36494ADE55" section-type="subsequent-section"><enum>252.</enum><header>Application of
			 national security exclusion to wide-area environmental sampling</header><text display-inline="no-display-inline">In accordance with Article 1(b) of the
			 Additional Protocol, the United States shall not permit any wide-area
			 environmental sampling proposed by the IAEA to be conducted at a specified
			 location in the United States under Article 9 of the Additional Protocol unless
			 the President has determined and reported to the appropriate congressional
			 committees that—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID3A4831F786DF48298581D2BA5951395A"><enum>(1)</enum><text display-inline="yes-display-inline">the proposed use of wide-area environmental
			 sampling is necessary to increase the capability of the IAEA to detect
			 undeclared nuclear activities in the territory of a non-nuclear-weapon State
			 Party;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID549B5E276CF2410A9FDB82F9614B547B"><enum>(2)</enum><text display-inline="yes-display-inline">the proposed use of wide-area environmental
			 sampling will not result in access by the IAEA to locations, activities, or
			 information of direct national security significance; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA414A74A91E846228085AF5809E49C72"><enum>(3)</enum><text display-inline="yes-display-inline">the United States—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID4F4A0CFC8EA64A26B32A2B438F45A6FF"><enum>(A)</enum><text display-inline="yes-display-inline">has been provided sufficient opportunity
			 for consultation with the IAEA if the IAEA has requested complementary access
			 involving wide-area environmental sampling; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDFF07EB9E5534DDB9BF5D60B1DB4832C"><enum>(B)</enum><text display-inline="yes-display-inline">has requested under Article 8 of the
			 Additional Protocol that the IAEA engage in complementary access in the United
			 States that involves the use of wide-area environmental sampling.</text>
						</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="ID0652C99CD5A348C6ADEF6A4A50447088" section-type="subsequent-section"><enum>253.</enum><header>Application of
			 national security exclusion to location-specific environmental
			 sampling</header><text display-inline="no-display-inline">In accordance with
			 Article 1(b) of the Additional Protocol, the United States shall not permit any
			 location-specific environmental sampling in the United States under Article 5
			 of the Additional Protocol unless the President has determined and reported to
			 the appropriate congressional committees that—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID4034B630E8B040959BA421736D69D249"><enum>(1)</enum><text display-inline="yes-display-inline">the proposed use of location-specific
			 environmental sampling will not result in access by the IAEA to locations,
			 activities, or information of direct national security significance; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID09E0EA221C4D44768FE08EE03E3B30EE"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to the proposed use of
			 environmental sampling, the United States—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDA9F8F10681D04F9B9F5579FC3BEA82D4"><enum>(A)</enum><text display-inline="yes-display-inline">has been provided sufficient opportunity
			 for consultation with the IAEA if the IAEA has requested complementary access
			 involving location-specific environmental sampling; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA67D899716F14A0C8324CD299015DF67"><enum>(B)</enum><text display-inline="yes-display-inline">has requested under Article 8 of the
			 Additional Protocol that the IAEA engage in complementary access in the United
			 States that involves the use of location-specific environmental
			 sampling.</text>
						</subparagraph></paragraph></section></subtitle><subtitle id="id4A32C3B09ED64A3CA2A5248E357D2E81"><enum>F</enum><header>Authorization of
			 appropriations</header>
				<section id="id6B7CDD4622934DA8BEC6979DD7952ABC"><enum>261.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 title.</text>
