<subsection id="id824B759DAF40491592BF398241C89993"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">Section 1 of the Violence Against Women and Department of Justice Reauthorization Act of 2005 is amended by—</text> 
<paragraph id="id03980FB4F4FD4AA5A89611E7C54F3059"><enum>(1)</enum><text>inserting <quote>(a)<header-in-text level="subsection" style="OLC"> In general</header-in-text></quote> before <quote>This</quote>; and</text> </paragraph>
<paragraph id="id0EE8A4415B8246D7B706413A5F8EF808"><enum>(2)</enum><text>adding at the end the following:</text>

<subsection id="IDe8717c5013224d59bed9a8b958ba679d"><enum>(b)</enum><header>Separate short titles</header><text>Section 3 and titles I through IX of this Act may be cited as the <quote><short-title>Violence Against Women Reauthorization Act of 2005</short-title></quote>. Title XI of this Act may be cited as the <quote><short-title>Department of Justice Appropriations Authorization Act of 2005</short-title></quote>.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="ID7290e3050b5f41069f18ad300c242773"><enum>(b)</enum><header>Clarify effective dates</header><text>The Violence Against Women Act and Department of Justice Reauthorization Act of 2005 (Public Law 109–162) is amended by adding after section 3 the following new section:</text>

<section id="IDf55961f30a234d8d8e4a56e9acf8265f"><enum>4.</enum><header>Effective date of specific sections</header> 
<subsection id="ID051626c0d8974ac496baa0621aae26b3"><enum></enum><text>Notwithstanding any other provision of this Act or any other law, sections 101, 102 (except the amendment to section 2101(d) of the Omnibus Crime Control and Safe Streets Act of 1968 included in that section), 103, 121, 203, 204, 205, 304, 306, 602, 906, and 907 of this Act shall not take effect until the beginning of fiscal year 2007.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="ID05dabd08ce2f4b10b316be8b8e6dd954"><enum>(c)</enum><header>Ensure comprehensive definitional section</header> 
<paragraph id="idD428A19A95B44198B8E8C17AC69EB7DB"><enum>(1)</enum><header>Crimes on campuses</header><text>Section 304 of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (Public Law 109–162) is amended by adding at the end the following:</text>

<subsection id="IDc2f61298bd8d4825834008e8673cae16"><enum>(e)</enum><header>Tribal definitions</header><text>Section 40002(a) of the Violence Against Women Act of 1994, as added by section 3 of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (Public Law 109–162), is amended—</text> 
<paragraph id="id3053CB72479449A2986A03749CCF93AD"><enum>(1)</enum><text>in paragraph (1), by striking <quote>Alaskan</quote> and inserting <quote>Alaska Native</quote>;</text> </paragraph>
<paragraph id="id1E42CCF1FD5A41A38CF9B1AB66286844"><enum>(2)</enum><text>by redesignating paragraphs (31) through (36) as paragraphs (32) through (37), respectively; and</text> </paragraph>
<paragraph id="ID33028278a1d446d9bc35879933fe6a92"><enum>(3)</enum><text>by adding after paragraph (30) the following:</text>

<paragraph id="ID4d1ba0a27b6246c1ace7c09e02164c7b"><enum>(31)</enum><header>Tribal nonprofit organization</header><text>The term <term>tribal nonprofit organization</term> means—</text> 
<subparagraph id="ID9e000408245b4027b0407132d92ed034"><enum>(A)</enum><text>a victim services provider that has as its primary purpose to assist Native victims of domestic violence, dating violence, sexual assault, or stalking; and</text> </subparagraph>
<subparagraph id="IDa707cc6be90c49dfa9b6d4b9958bb1de"><enum>(B)</enum><text>staff and leadership of the organization must include persons with a demonstrated history of assisting American Indian or Alaska Native victims of domestic violence, dating violence, sexual assault, or stalking.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="IDab0f97cd4a52494d8652b5ac2a8a5774"><enum>(f)</enum><header>Clarify matching provision in the universal grant condition</header><text>Section 40002(b) of the Violence Against Women Act of 1994, as added by section 3 of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (Public Law 109–162), is amended by striking paragraph (1) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="idCEE8C2D84CD84328A8CF5C1A0EA50957" style="OLC"> 
<paragraph id="ID6c472cba9a7a4d2ca7e5af243e52a731"><enum>(1)</enum><header>Match</header><text>No matching funds shall be required for any grant or subgrant made under this Act for—</text> 
<subparagraph id="ID32db7038eb86431db2008e764a4032f4"><enum>(A)</enum><text>any tribe, territory, or victim service provider; or</text> </subparagraph>
<subparagraph id="IDddc97449d72b49659e58eb09ded23ec9"><enum>(B)</enum><text>any other entity, including a State, that—</text> 
<clause id="IDc0658969180d4e60b91c005528a351e8"><enum>(i)</enum><text>petitions for a waiver of any match condition imposed by the Attorney General or the Secretaries of Health and Human Services or Housing and Urban Development; and</text> </clause>
<clause id="ID87bb4f3e4b3f4e25bd8976bc08bc789d"><enum>(ii)</enum><text>whose petition for waiver is determined by the Attorney General or the Secretaries of Health and Human Services or Housing and Urban Development to have adequately demonstrated the financial need of the petitioning entity.</text> </clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
<section id="ID38e08c71bd004b76972641e12ad2220c"><enum>2.</enum><header>Title I—Law enforcement tools</header> 
<subsection id="ID5d4d28a6111344a88b60fa9d334f2fc6"><enum>(a)</enum><header>Duplicate provision</header><text>Title I of the Violence Against Women Act of 2005 (Public Law 109–162) is amended by striking section 108.</text> </subsection>
<subsection id="id2A6997990E0D4AD7BD4C95577F61D519"><enum>(b)</enum><header>Authorization period</header><text>Section 1167 of the Violence Against Women Act of 2005 is amended by striking <quote>2006 through 2010</quote> and inserting <quote>2007 through 2011</quote>.</text> </subsection>
<subsection id="ID45c590f441484f52a2875a914dba121f"><enum>(c)</enum><header>Definition of spouse of intimate partner</header><text>Section 2266(7)(A) of title 18, United States Code, is amended by striking clause (ii) and inserting the following:</text>

<clause id="IDb3d65f2a37324ec0a4e2b4455518b49c"><enum>(ii)</enum><text>section 2261A—</text> 
<subclause id="id1D5B243FBEC840388B4EB24040A02022"><enum>(I)</enum><text>a spouse or former spouse of the target of the stalking, a person who shares a child in common with the target of the stalking, and a person who cohabits or has cohabited as a spouse with the target of the stalking; or</text> </subclause>
<subclause id="id999B7FE6661846019A5AA5F5A3F214A7"><enum>(II)</enum><text>a person who is or has been in a social relationship of a romantic or intimate nature with the target of the stalking, as determined by the length of the relationship, the type of the relationship, and the frequency of interaction between the persons involved in the relationship.</text> </subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection commented="no" id="ID137af441381c4c10beef259db2bbddbd"><enum>(d)</enum><header>Strike repeated sections</header><text>The Violence Against Women and Department of Justice Reauthorization Act of 2005 is amended by striking sections 1134 and 1135.</text> </subsection>
<subsection id="IDf3dfd30cc7e54bcdb443623c7e05e81d"><enum>(e)</enum><header>Conditions on technical assistance</header><text>Section 40002(b)(11) of the Violence Against Women Act of 1994 is amended by inserting before <quote>If there</quote> the following: <quote>Of the total amounts appropriated under this title, not less than 3 percent and up to 8 percent, unless otherwise noted, shall be available for providing training and technical assistance relating to the purposes of this title to improve the capacity of the grantees, subgrantees, and other entities.</quote>.</text> </subsection>
<subsection id="IDad5e9b72da034a4e9dcc3570a152b1cb"><enum>(f)</enum><header>Remove the technical assistance provision in STOP and grants To encourage arrest</header><text display-inline="yes-display-inline">The Omnibus Crime Control and Safe Streets Act of 1968 is amended—</text> 
<paragraph commented="no" id="idCAFEBF121DAB487DAD164E29306FCB5B"><enum>(1)</enum><text display-inline="yes-display-inline">in section 2007, by striking subsection (i), as added by section 101 of the Violence Against Women and Department of Justice Reauthorization Act of 2005; and</text> </paragraph>
<paragraph id="IDefb7a3fc3d5d4fa69319773857bc3dab"><enum>(2)</enum><text>by striking section 2106, as added by section 102 of the Violence Against Women and Department of Justice Reauthorization Act of 2005.</text> </paragraph></subsection>
<subsection id="ID029630925e0b4c97905ea3174a85d667"><enum>(g)</enum><header>Correct STOP grant allocation</header><text display-inline="yes-display-inline">Section 2007 (b)(2) of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3796gg–1), as amended by section 101 of the Violence Against Women and Department of Justice Reauthorization Act of 2005, is amended by striking <quote>and the coalitions for combined Territories of the United States</quote> and inserting <quote>the coalition for Guam, the coalition for American Samoa, the coalition for the United States Virgin Islands, and the coalition for the Commonwealth of the Northern Mariana Islands.</quote>.</text> </subsection>
<subsection commented="no" id="id497A2226F60E42018FE89BD91A0452B2"><enum>(h)</enum><header>Underserved populations report</header><text display-inline="yes-display-inline">Section 120(g) of the Violence Against Women and Department of Justice Reauthorization Act of 2005 is amended by striking <quote>, every 18 months,</quote>.</text> </subsection>
<subsection id="ID9459297c175a4905a641a014c0499eaa"><enum>(i)</enum><header>Correct definition of dating partner</header><text display-inline="yes-display-inline">Section 2266(10) of title 18, United States Code, as amended by section 116 of the Violence Against Women and Department of Justice Reauthorization Act of 2005, is further amended by striking <quote>and the existence of such a relationship</quote> and inserting <quote>. The existence of such a relationship is</quote>.</text> </subsection>
<subsection id="ID14beeb454cdb4c4ca538d1e56b6829a2"><enum>(j)</enum><header>Alter compliance time for forensic exam certification</header><text display-inline="yes-display-inline">Section 2010(d) of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3796gg–4(d)) as added by section 101 of the Violence Against Women and Department of Justice Reauthorization Act of 2005, is amended by—</text> 
<paragraph id="idDE15C37990244A3191F73DB55B85E300"><enum>(1)</enum><text>striking <quote>Nothing</quote> and inserting <quote>(1) <header-in-text level="paragraph" style="OLC">In general</header-in-text>.—</quote>; and</text> </paragraph>
<paragraph id="id90F75B8D840C4D5CA70EC3E1DBADD1C7"><enum>(2)</enum><text>inserting at the end the following:</text>

<paragraph id="ID51f9108329bc4676ae2babb3d150d98b"><enum>(2)</enum><header>Compliance period</header><text>States, territories, and Indian tribal governments shall have 3 years from the date of enactment of the Violence Against Women and Department of Justice Reauthorization Act of 2005 to come into compliance with this subsection.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="ID4171a33799a14ae58244e246645f008a"><enum>(k)</enum><header>Correct underserved populations grant program</header><text display-inline="yes-display-inline">Section 121 of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (Public Law 109–162) is amended—</text> 
<paragraph id="id5E78459055EE42A4AE69434A52A31FEC"><enum>(1)</enum><text>in subsection (a)(1), by inserting at the end the following : <quote>The requirements of the grant programs identified in paragraph (2) shall not apply to this new grant program.</quote>; and</text> </paragraph>
<paragraph id="id1EE7D2DC346A4229A0E02C6014D83242"><enum>(2)</enum><text>in subsection (b)(2) by striking the period and inserting “, including—</text> 
<quoted-block display-inline="no-display-inline" id="id6730529435AA4BC0AC1981CFA5553850" style="OLC"> 
<subparagraph id="id66A7D566150D484D96222D8166E68998"><enum>(A)</enum><text>working with State and local governments and social service agencies to develop and enhance effective strategies to provide culturally and linguistically specific services to victims of domestic violence, dating violence, sexual assault, and stalking;</text> </subparagraph>
<subparagraph id="id9F3AAF8B02994547A5FF42FFD49376C4"><enum>(B)</enum><text>increasing communities' capacity to provide culturally and linguistically specific resources and support for victims of domestic violence, dating violence, sexual assault, and stalking crimes and their families;</text> </subparagraph>
<subparagraph id="id784B3AC6E35848A6A54C1A746B2711BC"><enum>(C)</enum><text>strengthening criminal justice interventions, by providing training for law enforcement, prosecution, courts, probation, and correctional facilities on culturally and linguistically specific responses to domestic violence, dating violence, sexual assault, and stalking;</text> </subparagraph>
<subparagraph id="id7575BD90B4DF416898483ACB81DFAD8C"><enum>(D)</enum><text>enhancing traditional services to victims of domestic violence, dating violence, sexual assault, and stalking through the leadership of culturally and linguistically specific programs offering services to victims of domestic violence, dating violence, sexual assault, and stalking;</text> </subparagraph>
<subparagraph id="id865C921FF7A14775897F43778911449C"><enum>(E)</enum><text>working in cooperation with the community to develop education and prevention strategies highlighting culturally and linguistically specific issues and resources regarding victims of domestic violence, dating violence, sexual assault, and stalking;</text> </subparagraph>
<subparagraph id="id753BB4B44DCB4E48A526D09186435125"><enum>(F)</enum><text>providing culturally and linguistically specific programs for children exposed to domestic violence, dating violence, sexual assault, and stalking;</text> </subparagraph>
<subparagraph id="id5D7BF6D0775F41BD9AE4CBF97F6C3EB4"><enum>(G)</enum><text>providing culturally and linguistically specific resources and services that address the safety, economic, housing, and workplace needs of victims of domestic violence, dating violence, sexual assault, or stalking, including emergency assistance; or</text> </subparagraph>
<subparagraph id="id46EDE739F40F4E4BB484256F7FDFB157"><enum>(H)</enum><text>examining the dynamics of culture and its impact on victimization and healing.</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="ID0043bf0412c2459b9d992f4c572b9be5"><enum>(l)</enum><header>Fix allocation issue in STOP grants</header><text>Subparagraphs (A) and (B) of section 2007(c)(3) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3796gg–1(c)(3) (A) and (B)) are amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="idB353EB261C664593A73C0F272F4FF310" style="OLC"> 
<subparagraph id="IDcafdb06e2e03461cbaa0e1f9f6bf9650"><enum>(A)</enum><text>not less than 25 percent shall be allocated for law enforcement and not less than 25 percent shall be allocated for prosecutors;</text> </subparagraph>
<subparagraph id="ID97f6f15b0cf848148a795c27844839eb"><enum>(B)</enum><text>not less than 30 percent shall be allocated for victims services of which at least 10 percent shall be distributed to culturally specific community-based organizations; and</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="IDcbef261bd93f40b2829940f441d5eee7"><enum>(m)</enum><header>Correct GAO study</header><text>Section 119(a) of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (Public Law 109–162) is amended by striking <quote>of domestic violence.</quote> and inserting <quote>of these respective crimes.</quote></text> </subsection>
<subsection id="ID52e9583ab67d41a0bca753db4e6fbfd0"><enum>(n)</enum><header>Protection order correction</header><text>Section 106(c) of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (Public Law 109–162) is amended by striking <quote>the registration or filing of a protection order</quote> and inserting <quote>the registration, filing of a petition for, or issuance of a protection order, restraining order or injunction</quote></text> </subsection></section>
<section id="idD9F59C672CB44B59BB91B00CA4E19B8B"><enum>3.</enum><header>Title II—Improved services</header> 
<subsection id="ID897bb24222af45ef9822a116f525500c"><enum>(a)</enum><header>Sexual assault services into VAWA</header><text>Section 202 of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (Public Law 109–162) is repealed.</text> </subsection>
<subsection id="id231CFBD3FB124C278D65B0CEB99EAE9D"><enum>(b)</enum><header>Sexual assault services program</header><text display-inline="yes-display-inline">The Violence Against Women Act of 1994 (Public Law 103–322) is amended by adding at the end the following:</text>

<subtitle id="id4779751EB42D43F7A195B66DB9B6A503"><enum>P</enum><header>Sexual assault services</header> 
<section id="ID458eef3ba8cd49569f159ccea0800bf4"><enum>41601.</enum><header>Sexual assault services program</header> 
<subsection id="ID7BAB5CA9A0F641E2A4B7206A31925498"><enum>(a)</enum><header>Purposes</header><text>The purposes of this section are—</text> 
<paragraph id="ID2776300FA91046EFB5B93DBB1B498A32"><enum>(1)</enum><text>to assist States, Indian tribes, and territories in providing intervention, advocacy, accompaniment, support services, and related assistance for—</text> 
<subparagraph id="IDDE19C51B5A48460C8C1B9690B28B4037"><enum>(A)</enum><text>adult, youth, and child victims of sexual assault;</text> </subparagraph>
<subparagraph id="ID71A85198727C429B99520F6CCD270280"><enum>(B)</enum><text>family and household members of such victims; and</text> </subparagraph>
<subparagraph id="ID70A54725C5B34D7BBE42CD459A649066"><enum>(C)</enum><text>those collaterally affected by the victimization, except for the perpetrator of such victimization; and</text> </subparagraph></paragraph>
<paragraph id="IDBE657C5CB4AC4389B4DF8471DF1E7969"><enum>(2)</enum><text>to provide for technical assistance and training relating to sexual assault to—</text> 
<subparagraph id="ID6FD4171E4F8A46B38F3A114368795136"><enum>(A)</enum><text>Federal, State, tribal, territorial and local governments, law enforcement agencies, and courts;</text> </subparagraph>
<subparagraph id="ID0716C091C1D543688BCC434117729686"><enum>(B)</enum><text>professionals working in legal, social service, and health care settings;</text> </subparagraph>
<subparagraph id="ID9376BEDA2B5949978EDFF16B14059B0F"><enum>(C)</enum><text>nonprofit organizations;</text> </subparagraph>
<subparagraph id="ID8804D862937E467D9DA1424E8323BC04"><enum>(D)</enum><text>faith-based organizations; and</text> </subparagraph>
<subparagraph id="ID6BD6B6B8BB5B484E8EF1E840DD50022E"><enum>(E)</enum><text>other individuals and organizations seeking such assistance.</text> </subparagraph></paragraph></subsection>
<subsection id="IDEAC34998B1CA4CA29CF007770A746CFC"><enum>(b)</enum><header>Grants to States and territories</header> 
<paragraph id="ID04B78995BEB742ADAAE63B23016D48F5"><enum>(1)</enum><header>Grants authorized</header><text>The Attorney General shall award grants to States and territories to support the establishment, maintenance, and expansion of rape crisis centers and other programs and projects to assist those victimized by sexual assault.</text> </paragraph>
<paragraph id="ID2E589704175B4C46B780F8123EC24FD8"><enum>(2)</enum><header>Allocation and use of funds</header> 
<subparagraph id="IDB436368ADCB74BEBA81E67352B70DE17"><enum>(A)</enum><header>Administrative costs</header><text>Not more than 5 percent of the grant funds received by a State or territory governmental agency under this subsection for any fiscal year may be used for administrative costs.</text> </subparagraph>
<subparagraph id="ID444E01F72981409D866A2794132752C0"><enum>(B)</enum><header>Grant funds</header><text>Any funds received by a State or territory under this subsection that are not used for administrative costs shall be used to provide grants to rape crisis centers and other nonprofit, nongovernmental organizations for programs and activities within such State or territory that provide direct intervention and related assistance.</text> </subparagraph>
<subparagraph id="ID1EF849BCE928431CAC418391BD1DFEFC"><enum>(C)</enum><header>Intervention and related assistance</header><text>Intervention and related assistance under subparagraph (B) may include—</text> 
<clause id="ID0B3E18C746084D3D9C7F16C0934D9B86"><enum>(i)</enum><text>24-hour hotline services providing crisis intervention services and referral;</text> </clause>
<clause id="ID338BE4D73ED74E42B1458D9B4F9460B5"><enum>(ii)</enum><text>accompaniment and advocacy through medical, criminal justice, and social support systems, including medical facilities, police, and court proceedings;</text> </clause>
<clause id="ID3F532F8CB5464E3C8B3D6A397857CCB9"><enum>(iii)</enum><text>crisis intervention, short-term individual and group support services, and comprehensive service coordination and supervision to assist sexual assault victims and family or household members;</text> </clause>
<clause id="ID7C2ED133E7B84446BE9F334DC290D548"><enum>(iv)</enum><text>information and referral to assist the sexual assault victim and family or household members;</text> </clause>
<clause id="ID2464E22F7F384D68B48C19FBA4D2A36B"><enum>(v)</enum><text>community-based, linguistically and culturally specific services and support mechanisms, including outreach activities for underserved communities; and</text> </clause>
<clause id="IDA1B3152BC8F8463CBEBD2104F112A5FC"><enum>(vi)</enum><text>the development and distribution of materials on issues related to the services described in clauses (i) through (v).</text> </clause></subparagraph></paragraph>
<paragraph id="IDE242E47693EE40C58F2334D9A3EA7AA7"><enum>(3)</enum><header>Application</header> 
<subparagraph id="ID6B6A4D98E08446B7A10D4E298D932D3C"><enum>(A)</enum><header>In general</header><text>Each eligible entity desiring a grant under this subsection shall submit an application to the Attorney General at such time and in such manner as the Attorney General may reasonably require.</text> </subparagraph>
<subparagraph id="ID753FD1A7047A436D9A1FBB96C91D9EB2"><enum>(B)</enum><header>Contents</header><text>Each application submitted under subparagraph (A) shall—</text> 
<clause id="IDC230D1E42BAA4162AA8F4A3775CCE66D"><enum>(i)</enum><text>set forth procedures designed to ensure meaningful involvement of the State or territorial sexual assault coalition and representatives from underserved communities in the development of the application and the implementation of the plans;</text> </clause>
<clause id="IDA37CB679035B49A39696A030E432C3FE"><enum>(ii)</enum><text>set forth procedures designed to ensure an equitable distribution of grants and grant funds within the State or territory and between urban and rural areas within such State or territory;</text> </clause>
<clause id="IDE8DE6BFB2BA44DC18674CD821B3BDFB1"><enum>(iii)</enum><text>identify the State or territorial agency that is responsible for the administration of programs and activities; and</text> </clause>
<clause id="IDE753DFE8529B471BBE901A07DDDE6146"><enum>(iv)</enum><text>meet other such requirements as the Attorney General reasonably determines are necessary to carry out the purposes and provisions of this section.</text> </clause></subparagraph></paragraph>
<paragraph id="IDC818273B6FFA4746AF5EF1BE4652E4A7"><enum>(4)</enum><header>Minimum amount</header><text>The Attorney General shall allocate to each State not less than 1.50 percent of the total amount appropriated in a fiscal year for grants under this section, except that the United States Virgin Islands, American Samoa, Guam, the District of Columbia, Puerto Rico, and the Commonwealth of the Northern Mariana Islands shall each be allocated 0.125 percent of the total appropriations. The remaining funds shall be allotted to each State and each territory in an amount that bears the same ratio to such remaining funds as the population of such State and such territory bears to the population of all the States and the territories. The District of Columbia shall be treated as a territory for purposes of calculating its allocation under the preceding formula.</text> </paragraph></subsection>
<subsection id="ID03AA5DC78D494E88B2AA73383BBD03C9"><enum>(c)</enum><header>Grants for culturally specific programs addressing sexual assault</header> 
<paragraph id="ID5A6AA4DAB31B4511AA6E466D172EBF51"><enum>(1)</enum><header>Grants authorized</header><text>The Attorney General shall award grants to eligible entities to support the establishment, maintenance, and expansion of culturally specific intervention and related assistance for victims of sexual assault.</text> </paragraph>
<paragraph id="ID54433DE4FACF4475AD9DA5462E4E2ABE"><enum>(2)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under this section, an entity shall—</text> 
<subparagraph id="IDB7BF14B2FF744696A09DF21E35C0EF8F"><enum>(A)</enum><text>be a private nonprofit organization that focuses primarily on culturally specific communities;</text> </subparagraph>
<subparagraph id="IDCAE89F824B924E19B5BB61D38D62F024"><enum>(B)</enum><text>must have documented organizational experience in the area of sexual assault intervention or have entered into a partnership with an organization having such expertise;</text> </subparagraph>
<subparagraph id="ID5CF60034DF6649E3B37488D1C400FD19"><enum>(C)</enum><text>have expertise in the development of community-based, linguistically and culturally specific outreach and intervention services relevant for the specific communities to whom assistance would be provided or have the capacity to link to existing services in the community tailored to the needs of culturally specific populations; and</text> </subparagraph>
<subparagraph id="ID3F113480105044548CD414B7B486173D"><enum>(D)</enum><text>have an advisory board or steering committee and staffing which is reflective of the targeted culturally specific community.</text> </subparagraph></paragraph>
<paragraph id="IDFF46537D6FCE4A7CAB686BEC3D687405"><enum>(3)</enum><header>Award basis</header><text>The Attorney General shall award grants under this section on a competitive basis.</text> </paragraph>
<paragraph id="ID14161BCB69B643CA8FF436AD279B6FC3"><enum>(4)</enum><header>Distribution</header> 
<subparagraph id="ID067919E4F2194A8A806FBB0EAC585065"><enum>(A)</enum><text>The Attorney General shall not use more than 2.5 percent of funds appropriated under this subsection in any year for administration, monitoring, and evaluation of grants made available under this subsection.</text> </subparagraph>
<subparagraph id="ID1ADE792872BE4E20BC7D8E7134223148"><enum>(B)</enum><text>Up to 5 percent of funds appropriated under this subsection in any year shall be available for technical assistance by a national, nonprofit, nongovernmental organization or organizations whose primary focus and expertise is in addressing sexual assault within underserved culturally specific populations.</text> </subparagraph></paragraph>
<paragraph id="ID299C8D8C838A452792E9EA531C661880"><enum>(5)</enum><header>Term</header><text>The Attorney General shall make grants under this section for a period of no less than 2 fiscal years.</text> </paragraph>
<paragraph id="ID25E3EEC047E74832AAF6879E405E094B"><enum>(6)</enum><header>Reporting</header><text>Each entity receiving a grant under this subsection shall submit a report to the Attorney General that describes the activities carried out with such grant funds.</text> </paragraph></subsection>
<subsection id="IDA81A531BB8674D18A8FA14373FF0E817"><enum>(d)</enum><header>Grants to State, territorial, and tribal sexual assault coalitions</header> 
<paragraph id="ID0DA97FFBC7F540F8A1EA95DB22FB4C99"><enum>(1)</enum><header>Grants authorized</header> 
<subparagraph id="ID4AFF55C4947C4AB68CBDC9C802DDD3AC"><enum>(A)</enum><header>In general</header><text>The Attorney General shall award grants to State, territorial, and tribal sexual assault coalitions to assist in supporting the establishment, maintenance, and expansion of such coalitions.</text> </subparagraph>
<subparagraph id="ID4371C7F88C7A4699A7019733C9FCCD7D"><enum>(B)</enum><header>Minimum amount</header><text>Not less than 10 percent of the total amount appropriated to carry out this section shall be used for grants under subparagraph (A).</text> </subparagraph>
<subparagraph id="IDE6DA4C8F9CCE4DCF8CDE3764A1D6F10F"><enum>(C)</enum><header>Eligible applicants</header><text>Each of the State, territorial, and tribal sexual assault coalitions.</text> </subparagraph></paragraph>
<paragraph id="ID62526C89949B4B76AF0790510D053AF9"><enum>(2)</enum><header>Use of funds</header><text>Grant funds received under this subsection may be used to—</text> 
<subparagraph id="IDDFFAD265DF454774A8D9BEF1FFA7075F"><enum>(A)</enum><text>work with local sexual assault programs and other providers of direct services to encourage appropriate responses to sexual assault within the State, territory, or tribe;</text> </subparagraph>
<subparagraph id="IDF21E2186F19F4C4683D2EC9858A9A3C6"><enum>(B)</enum><text>work with judicial and law enforcement agencies to encourage appropriate responses to sexual assault cases;</text> </subparagraph>
<subparagraph id="ID04389504BDC046D280FA5C1AE0CC3B18"><enum>(C)</enum><text>work with courts, child protective services agencies, and children’s advocates to develop appropriate responses to child custody and visitation issues when sexual assault has been determined to be a factor;</text> </subparagraph>
<subparagraph id="ID0AB828F161BF4B8988639F1036DABB5B"><enum>(D)</enum><text>design and conduct public education campaigns;</text> </subparagraph>
<subparagraph id="ID22AFF8779300420482E5D4F61BC583BC"><enum>(E)</enum><text>plan and monitor the distribution of grants and grant funds to their State, territory, or tribe; or</text> </subparagraph>
<subparagraph id="ID08EAECF24AD14820A71AA7CBA122530D"><enum>(F)</enum><text>collaborate with and inform Federal, State, or local public officials and agencies to develop and implement policies to reduce or eliminate sexual assault.</text> </subparagraph></paragraph>
<paragraph id="ID68F9E3F7554E40F897073989C88AE039"><enum>(3)</enum><header>Allocation and use of funds</header><text>From amounts appropriated for grants under this subsection for each fiscal year—</text> 
<subparagraph id="ID2EFC9CE7C1D844809EE236AAA0EDFD92"><enum>(A)</enum><text>not less than 10 percent of the funds shall be available for grants to tribal sexual assault coalitions; and</text> </subparagraph>
<subparagraph id="IDEC57B13AA882460CAEFBAED731B0C3C2"><enum>(B)</enum><text>the remaining funds shall be available for grants to State and territorial coalitions, and the Attorney General shall allocate an amount equal to <fraction>1/56</fraction> of the amounts so appropriated to each of those State and territorial coalitions.</text> </subparagraph></paragraph>
<paragraph id="IDAEDAD7AC36F8423190E50313C9D10A2F"><enum>(4)</enum><header>Application</header><text>Each eligible entity desiring a grant under this subsection shall submit an application to the Attorney General at such time, in such manner, and containing such information as the Attorney General determines to be essential to carry out the purposes of this section.</text> </paragraph>
<paragraph id="ID4D179A079BFF4D268408EFFDA4959E3C"><enum>(5)</enum><header>First-time applicants</header><text>No entity shall be prohibited from submitting an application under this subsection during any fiscal year for which funds are available under this subsection because such entity has not previously applied or received funding under this subsection.</text> </paragraph></subsection>
<subsection id="ID2DCCA1E70ACE4E38B008E97481610339"><enum>(e)</enum><header>Grants to tribes</header> 
<paragraph id="ID4DF18CAE6098430CB28C1BA94A6BDECC"><enum>(1)</enum><header>Grants authorized</header><text>The Attorney General may award grants to Indian tribes, tribal organizations, and nonprofit tribal organizations for the operation of sexual assault programs or projects in Indian tribal lands and Alaska Native villages to support the establishment, maintenance, and expansion of programs and projects to assist those victimized by sexual assault.</text> </paragraph>
<paragraph id="IDC5315E1D3D864582B8B4C890EAA6DA35"><enum>(2)</enum><header>Allocation and use of funds</header> 
<subparagraph id="IDAE0CD14A2EC543A2AB68B4452DEA6489"><enum>(A)</enum><header>Administrative costs</header><text>Not more than 5 percent of the grant funds received by an Indian tribe, tribal organization, and nonprofit tribal organization under this subsection for any fiscal year may be used for administrative costs.</text> </subparagraph>
<subparagraph id="IDAE8E1F4F4A9C4475930E04368E3DE43C"><enum>(B)</enum><header>Grant funds</header><text>Any funds received under this subsection that are not used for administrative costs shall be used to provide grants to tribal organizations and nonprofit tribal organizations for programs and activities within Indian country and Alaskan native villages that provide direct intervention and related assistance.</text> </subparagraph></paragraph></subsection>
<subsection id="IDE0CD6940375F4E0B97EDDD22C937A9B5"><enum>(f)</enum><header>Authorization of appropriations</header> 
<paragraph id="ID97DAFC9F4FBC44CA9F2C133F4874FCB3"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated $50,000,000 to remain available until expended for each of the fiscal years 2007 through 2011 to carry out the provisions of this section.</text> </paragraph>
<paragraph id="IDFD57531E1B8642B4AFE945BF7AEFE005"><enum>(2)</enum><header>Allocations</header><text>Of the total amounts appropriated for each fiscal year to carry out this section—</text> 
<subparagraph id="ID8BCCF237EA274F62B51FAD1131F765B3"><enum>(A)</enum><text>not more than 2.5 percent shall be used by the Attorney General for evaluation, monitoring, and other administrative costs under this section;</text> </subparagraph>
<subparagraph id="ID16861D45E7E143E3AF12D2802DF1C28E"><enum>(B)</enum><text>not more than 2.5 percent shall be used for the provision of technical assistance to grantees and subgrantees under this section;</text> </subparagraph>
<subparagraph id="ID4FEBEC6D27EE474EB8299CDE4A7D6CC3"><enum>(C)</enum><text>not less than 65 percent shall be used for grants to States and territories under subsection (b);</text> </subparagraph>
<subparagraph id="IDBBD8357DB782423CA3E11B769588DC3C"><enum>(D)</enum><text>not less than 10 percent shall be used for making grants to State, territorial, and tribal sexual assault coalitions under subsection (d);</text> </subparagraph>
<subparagraph id="IDC0C9073578B2413FA8B90F15520723F4"><enum>(E)</enum><text>not less than 10 percent shall be used for grants to tribes under subsection (e); and</text> </subparagraph>
<subparagraph id="ID7B9ECE14EB884187BEEF0FC9F5899390"><enum>(F)</enum><text>not less than 10 percent shall be used for grants for culturally specific programs addressing sexual assault under subsection (c).</text> </subparagraph></paragraph></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
<section id="IDe8b72888463a4e21aaf93dc5b9018009"><enum>4.</enum><header>Title III—Young victims</header> 
<subsection id="IDf9996cb773d648ecbc39dc8e53763bee"><enum>(a)</enum><header>Correct citation in section 41204</header><text>Section 41204(f)(2) of the Violence Against Women Act of 1994 (42 U.S.C. 14043c–3) is amended by striking <quote>(b)(4)(D)</quote> and inserting <quote>(b)(4)</quote>.</text> </subsection>
<subsection id="IDf35ca8efdba6432f978a8dd6c71c80ac"><enum>(b)</enum><header>Correct campus grant program’s purpose areas</header><text>Section 304(b)(2) of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (Public Law 109–162) is amended by striking the first sentence and inserting <quote>To develop and implement campus policies, protocols, and services that more effectively identify and respond to the crimes of domestic violence, dating violence, sexual assault and stalking, and to train campus administrators, campus security personnel, and personnel serving on campus disciplinary or judicial boards on such policies, protocols, and services.</quote>.</text> </subsection>

<subsection id="id8BD4278D35474016A49AC71C2552D227"><enum>(d)</enum><header>Selection of tenants</header><text>Section 8(d)(1)(A) of the United States Housing Act of 1937 (42 U.S.C. 1437f(d)(1)(A)) is amended to read as follows:</text>

<subparagraph id="id8AFB06529D0E4DEEBC821CFF9EAD5DA9"><enum>(A)</enum><text>the selection of tenants shall be the function of the owner, subject to the annual contributions contract between the Secretary and the agency, except that with respect to the certificate and moderate rehabilitation programs only, for the purpose of selecting families to be assisted, the public housing agency may establish local preferences, consistent with the public housing agency plan submitted under section 5A (42 U.S.C. 1437c–1) by the public housing agency and that an applicant or participant is or has been a victim of domestic violence, dating violence, or stalking is not an appropriate basis for denial of program assistance or for denial of admission if the applicant otherwise qualifies for assistance or admission;</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="id7AAC933CA5F842829BBCB8E6A9DF2F08"><enum>(e)</enum><header>Technical amendments to housing assistance program</header><text>Section 8 of the United States Housing Act of 1937 (42 U.S.C. 1437f) is amended—</text> 
<paragraph id="IDfae5c22627d7464898572f3f2f8a72c3"><enum>(1)</enum><text>in subsection (c)(9)(C), by striking clause (ii) and inserting the following:</text>

<subsection id="ID0e38ab77f465410c9cabd2d8d5a269b9"><enum>(ii)</enum><text>Notwithstanding clause (i) or any Federal, State, or local law to the contrary, an owner or manager may bifurcate a lease under this section, or remove a household member from a lease under this section, without regard to whether a household member is a signatory to a lease, in order to evict, remove, terminate occupancy rights, or terminate assistance to any individual who is a tenant or lawful occupant and who engages in criminal acts of physical violence against family members or others, without evicting, removing, terminating assistance to, or otherwise penalizing the victim of such violence who is also a tenant or lawful occupant. Such eviction, removal, termination of occupancy rights, or termination of assistance shall be effected in accordance with the procedures prescribed by Federal, State, and local law for the termination of leases or assistance under the relevant program of HUD-assisted housing.</text> </subsection><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph>
<paragraph id="ID3eaf72c2ce2f4da99148d7afa2694212"><enum>(2)</enum><text>in subsection (d)(1)(B)(iii), by striking subclause (II) and inserting the following:</text>

<subsection id="idC8437325E78F4C0AA1FF8A40E9A07F02"><enum>(g)</enum><header>Availability of funds</header><text>Section 108(b) of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3712g(b)) is amended by striking <quote>revert to the Treasury</quote> and inserting <quote>be deobligated</quote>.</text> </subsection>
