		<official-title>To waive application of the Indian Self-Determination and
		  Education Assistance Act to a specific parcel of real property transferred by
		  the United States to 2 Indian tribes in the State of Oregon, and for other
		  purposes.</official-title>

		<section id="HA51980F0F4474F72831D485509261BC2" section-type="section-one"><enum>1.</enum><header>Findings</header><text display-inline="no-display-inline">With respect to the parcel of real property
			 in Marion County, Oregon, deeded by the United States to the Confederated
			 Tribes of Siletz Indians of Oregon and the Confederated Tribes of the Grand
			 Ronde Community of Oregon by quitclaim deed dated June 18, 2002, and recorded
			 in the public records of Marion County on June 19, 2002, Congress finds
			 that—</text>
			<paragraph id="HD34DE566DE144D749704E8BCABA444E2"><enum>(1)</enum><text>the parcel of land
			 described in the quitclaim deed, comprising approximately 19.86 acres of land
			 originally used as part of the Chemawa Indian School, was transferred by the
			 United States in 1973 and 1974 to the State of Oregon for use for highway and
			 associated road projects;</text>
			</paragraph><paragraph id="id651537E663684D3395B552B0B0E9C604"><enum>(2)</enum><text>Interstate Route
			 5 and the Salem Parkway were completed, and in 1988 the Oregon Department of
			 Transportation deeded the remaining acreage of the parcel back to the United
			 States;</text>
			</paragraph><paragraph id="HE91A465496F54803BC44CB0033CA6BCA"><enum>(3)</enum><text>the United States
			 could no longer use the returned acreage for the administration of Indian
			 affairs, and determined it would be most appropriate to transfer the property
			 to the Confederated Tribes of Siletz Indians of Oregon and the Confederated
			 Tribes of the Grand Ronde Community of Oregon;</text>
			</paragraph><paragraph id="HD97B388805B942DCA1D40D6F4871805"><enum>(4)</enum><text>on
			 request of the Confederated Tribes of Siletz Indians of Oregon and the
			 Confederated Tribes of the Grand Ronde Community of Oregon, the United States
			 transferred the parcel jointly to the Tribes for economic development and other
			 purposes under the Indian Self-Determination and Education Assistance Act (25
			 U.S.C. 450 et seq.);</text>
			</paragraph><paragraph id="H14628CD9E4004EAEB611018929FC1064"><enum>(5)</enum><text>the transfer of
			 the parcel was memorialized by the United States in 2 documents,
			 including—</text>
				<subparagraph id="id1F9AFF0E1D7C43EB804A62A3D24A8FE8"><enum>(A)</enum><text>an agreement
			 titled <quote>Agreement for Transfer of Federally Owned Buildings,
			 Improvements, Facilities and/or Land from the United States of America the
			 [sic] Confederated Tribes of the Grand Ronde Community of Oregon and the
			 Confederated Tribes of Siletz Tribe [sic] of Oregon</quote>, dated June 21,
			 2001; and</text>
				</subparagraph><subparagraph id="id8C501E418E80417FBA283B97D49E2BA5"><enum>(B)</enum><text>a quitclaim deed
			 dated June 18, 2002, and recorded in the public records of Marion County,
			 Oregon, on June 19, 2002 (reel 1959, page 84);</text>
				</subparagraph></paragraph><paragraph id="HA2829E54325547BA8294563FDB1143A3"><enum>(6)</enum><text display-inline="yes-display-inline">use of the parcel by Tribes for economic
			 development purposes is consistent with the intent and language of the Indian
			 Self-Determination and Education Assistance Act (25 U.S.C. 450 et seq.) and
			 other Federal Indian law—</text>
				<subparagraph id="id03EFEE6086644C7FB170908AB549688E"><enum>(A)</enum><text display-inline="yes-display-inline">to encourage tribal economic development;
			 and</text>
				</subparagraph><subparagraph id="id275E46506CC3482C82ED1F59277F4B43"><enum>(B)</enum><text display-inline="yes-display-inline">to promote economic self-sufficiency for
			 Indian tribes;</text>
				</subparagraph></paragraph><paragraph id="H49CAC019366740BE8334002DAC88667"><enum>(7)</enum><text display-inline="yes-display-inline">the United States does not desire the
			 return of the parcel and does not intend under any circumstances to take action
			 under the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450
			 et seq.) or any other legal authority to seek the return of the parcel;
			 and</text>
			</paragraph><paragraph id="id82DB2141D75340849BE0B6888684624C"><enum>(8)</enum><text display-inline="yes-display-inline">in reliance on this intent, the Tribes have
			 committed over $2,500,000 to infrastructure improvements to the parcel,
			 including roads and sewer and water systems, and have approved plans to further
			 develop the parcel for economic purposes, the realization of which is dependent
			 on the ability of the Tribes to secure conventional financing.</text>
			</paragraph></section><section id="H7969B20B62A0410FBE558BA51BF7DEC8"><enum>2.</enum><header>Waiver of
			 application of Indian Self-Determination and Education Assistance Act</header>
			<subsection id="H4BD78B55DAC74003889BBA1E9DF56E57"><enum>(a)</enum><header>Nonapplication
			 of law</header><text>Notwithstanding any other provision of law, the Indian
			 Self-Determination and Education Assistance Act (25 U.S.C. 450 et seq.) shall
			 not apply to the transfer of the parcel of real property in Marion County,
			 Oregon, deeded by the United States to the Confederated Tribes of Siletz
			 Indians of Oregon and the Confederated Tribes of the Grand Ronde Community of
			 Oregon by quitclaim deed dated June 18, 2002, and recorded in the public
			 records of Marion County on June 19, 2002.</text>
			</subsection><subsection id="H88972EB3D79A40819F08BBF1001BD0DA"><enum>(b)</enum><header>New
			 deed</header><text>The Secretary of the Interior shall issue a new deed to the
			 Tribes to the parcel described in subsection (a) that shall not include—</text>
				<paragraph id="idF2A58E298B7746B5A5E45C965EADCBD3"><enum>(1)</enum><text>any restriction
			 on the right to alienate the parcel; or</text>
				</paragraph><paragraph id="id6F9A290F9BC84C2C9E8C2E2073BE0E19"><enum>(2)</enum><text>any reference to
			 any provision of the Indian Self-Determination and Education Assistance Act (25
			 U.S.C. 450 et seq.).</text>
				</paragraph></subsection><subsection id="H117C7EDDC1F64560A4DE76CCAB0334FE"><enum>(c)</enum><header>Prohibition on
			 gaming</header><text>Class II gaming and class III gaming under the Indian
			 Gaming Regulatory Act (25 U.S.C. 2701 et seq.) shall not be conducted on the
			 parcel described in subsection (a).</text>
