		<official-title>To amend the Small Business Investment Act of 1958 to
		  reauthorize and expand the New Markets Venture Capital Program, and for other
		  purposes.</official-title>

		<section display-inline="no-display-inline" id="H7AEEB04809E34A5185DBA0DB24BE61EB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Securing
			 Equity for the Economic Development of Low Income Areas Act of
			 2006</quote>.</text>
		</section><section display-inline="no-display-inline" id="id6E3AF491C14E44FBB11D2935BB789285"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph display-inline="no-display-inline" id="idDC304EF644B0443B9D8EEF78BE107369"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>Administration</term> and
			 <term>Administrator</term> mean the Small Business Administration and the
			 Administrator thereof, respectively;</text>
			</paragraph><paragraph display-inline="no-display-inline" id="idB979AF7578184FDF9E200D5C5264815D"><enum>(2)</enum><text>the term
			 <term>low-income geographic area</term> has the same meaning as in section 351
			 of the Small Business Investment Act of 1958 (15 U.S.C. 689), as amended by
			 this Act;</text>
			</paragraph><paragraph display-inline="no-display-inline" id="id321C9D7DEECF4184881CBB84A3EB0E56"><enum>(3)</enum><text>the term
			 <term>New Markets Venture Capital company</term> has the same meaning as in
			 section 351 of the Small Business Investment Act of 1958 (15 U.S.C. 689);
			 and</text>
			</paragraph><paragraph display-inline="no-display-inline" id="id99E852B977364D3CA2A99DAE0ECFA989"><enum>(4)</enum><text>the term
			 <term>New Markets Venture Capital Program</term> means the program under part B
			 of title III of the Small Business Investment Act of 1958 (15 U.S.C. 689 et
			 seq.).</text>
			</paragraph></section><section commented="no" id="H781BFA61E7724450B4F378AD91DE7BC8"><enum>3.</enum><header>Expansion of New
			 Markets Venture Capital Program</header>
			<subsection id="H82023748A5AE41A79000FD4F8EA3FFB1"><enum>(a)</enum><header>Selection of
			 companies in each geographic region</header><text display-inline="yes-display-inline">Section 354 of the Small Business
			 Investment Act of 1958 (15 U.S.C. 689c) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H108F9F9E071A4F08A27B3DFBEFBF48AA" style="OLC">
					<subsection id="H2BF1CC38072044D4A36F67DBA2E898F4"><enum>(f)</enum><header>Geographic
				requirement</header><text>In selecting companies to participate as New Markets
				Venture Capital companies in the program established under this part, the
				Administrator shall select, to the extent practicable, from among companies
				submitting applications under subsection (b), not fewer than 1 company from
				each geographic region of the
				Administration.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H8C1E80C73AF14CCBB33800A91B616EBB"><enum>(b)</enum><header>Participation in
			 New Markets Venture Capital Program</header>
				<paragraph id="H86DD3EE76AE542F8AAF2CEA4C33A8D8"><enum>(1)</enum><header>Administration
			 participation required</header><text>Section 353 of the Small Business
			 Investment Act of 1958 (15 U.S.C. 689b) is amended in the matter preceding
			 paragraph (1), by striking <quote>under which the Administrator may</quote> and
			 inserting <quote>under which the Administrator shall</quote>.</text>
				</paragraph><paragraph commented="no" id="HB3CADAAC5E654934BF3C41D3E25E50CB"><enum>(2)</enum><header>Small
			 manufacturer participation agreements required</header><text>Section 353 of the
			 Small Business Investment Act of 1958 (15 U.S.C. 689b) is amended—</text>
					<subparagraph commented="no" id="idCB3CD0AE8C624BFD853E7DB757F1A886"><enum>(A)</enum><text>by striking
			 <quote>In accordance with this part,</quote> and inserting the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="id500A981C77824EFD857C46B4F0B6220E" style="OLC">
							<subsection commented="no" id="id350E21902FB949A6A37E1A5D132C55D6"><enum>(a)</enum><header>In
				general</header><text>In accordance with this
				part,</text>
							</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" id="id736C584C796544528E34E63A07A08048"><enum>(B)</enum><text>in subsection
			 (a)(1), as so designated by this paragraph, by inserting after <quote>section
			 352</quote> the following: <quote>(with not fewer than 1 such agreement to be
			 with a company engaged primarily in development of and investment in small
			 manufacturers, to the extent practicable)</quote>; and</text>
					</subparagraph><subparagraph commented="no" id="id7D66F2086E374186A4B3134265D597DF"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id480710B5B6EB4651A574CA04DA0012F1" style="OLC">
							<subsection commented="no" id="id9FEAFC78C345497EAA14F7FD5900CFE9"><enum>(b)</enum><header>Rule of
				construction</header><text>Subsection (a)(1) shall not be construed to
				authorize the Administrator to decline to enter into a participation agreement
				with a company solely on the basis that the company is not engaged primarily in
				development of and investment in small
				manufacturers.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection></section><section id="H7A90143650F940319B7787A40017E551"><enum>4.</enum><header>Report to
			 Congress</header><text display-inline="no-display-inline">Not later than 1 year
			 after the date of enactment of this Act, the Administrator shall submit to
			 Congress a report evaluating the success of the New Markets Venture Capital
			 Program in promoting economic development and creating wealth and job
			 opportunities in low-income geographic areas, among individuals living in such
			 areas, by encouraging developmental venture capital investments in smaller
			 enterprises.</text>
		</section><section id="H1493DFC62F1C4BBCB8CDA4538893E3A6"><enum>5.</enum><header>Establishment of
			 Office of New Markets Venture Capital</header><text display-inline="no-display-inline">Title II of the Small Business Investment
			 Act of 1958 (15 U.S.C. 671) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H6C13057D3271480E8BFD4B41BD9546B" style="OLC">
				<section id="H129B2542BB71478AAADC9E003D465F27"><enum>202.</enum><header>Office of New
				Markets Venture Capital</header>
					<subsection id="HDA3EB00D4EDD434FACBC132FC474ACBA"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Investment
				Division of the Administration, the <quote>Office of New Markets Venture
				Capital</quote>.</text>
					</subsection><subsection id="HC233748466D24813B999CAA43E628D57"><enum>(b)</enum><header>Director</header><text>The
				Office of New Markets Venture Capital shall be headed by a Director, who shall
				be appointed by the Administrator.</text>
					</subsection><subsection id="H26D2735B9A264DB299B00623FBE9468"><enum>(c)</enum><header>Responsibilities
				of Director</header><text>Subject to the direction and control of the
				Administrator, the responsibilities of the Director of the Office of New
				Markets Venture Capital are—</text>
						<paragraph id="H4C81FD89AC4A4FFCA3C0FB6069883CC3"><enum>(1)</enum><text>to administer the
				New Markets Venture Capital Program under part B of title III;</text>
						</paragraph><paragraph id="H5A48BB68D2C04876907030F32C613645"><enum>(2)</enum><text>to periodically
				assess the nature and scope of the New Markets Venture Capital Program and to
				advise the Administrator on recommended changes to the program, based on such
				assessment;</text>
						</paragraph><paragraph id="H9B26CA0BEE8344F58E8F6CECEC6B7786"><enum>(3)</enum><text>to work to expand
				the number of small business concerns participating in the New Markets Venture
				Capital Program;</text>
						</paragraph><paragraph id="H0E9F74456A8247A6A6DF80259F1C03CB"><enum>(4)</enum><text>to encourage
				investment in small manufacturing; and</text>
						</paragraph><paragraph id="H8DEB8553263A4988A6724936C63FCD36"><enum>(5)</enum><text display-inline="yes-display-inline">to perform such other duties relating to
				such responsibilities as the Administrator may
				provide.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HF595AAEAD2224F3DB4D1B008716AFB3"><enum>6.</enum><header>Low-income
			 geographic areas</header>
			<subsection id="H86588257C65B4AB29595DC3B8CE7004"><enum>(a)</enum><header>Modification of
			 definition of low-income geographic area for purposes of New Markets Venture
			 Capital Program</header>
				<paragraph id="HD9663DA8DFD94E34B4DEE9C2C0A8B8F9"><enum>(1)</enum><header>In
			 general</header><text>Section 351 of the Small Business Investment Act of 1958
			 (15 U.S.C. 689) is amended—</text>
					<subparagraph id="idEDA367EFFBC44E69A546019A4ECF200E"><enum>(A)</enum><text>by striking
			 paragraphs (2) and (3) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="idA69BCA066ED741279A630D1B5662869F" style="OLC">
							<paragraph id="id715DA427A71E47E991DAD31D3D2F8508"><enum>(2)</enum><header>Low-income
				geographic area</header><text>The term <term>low-income geographic area</term>
				has the meaning given the term <term>low-income community</term> in section 45D
				of the Internal Revenue Code of 1986 (relating to the new markets tax
				credit).</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="id3D6C31332A0B416F98A0AA96F86DF6A9"><enum>(B)</enum><text>by redesignating
			 paragraphs (4) through (8) as paragraphs (3) through (7), respectively.</text>
					</subparagraph></paragraph><paragraph id="HF85761FA31094DFEA9AD1EE7B3F7CC72"><enum>(2)</enum><header>Retroactive
			 application of amended definition to capital requirement</header><text>The
			 definition of a low-income geographic area in section 351(2) of the Small
			 Business Investment Act of 1958, as amended by paragraph (1), shall apply to
			 private capital raised under section 354(d)(1) of the Small Business Investment
			 Act of 1958 (15 U.S.C. 689c(d)(1)) before, on, or after the date of enactment
			 of this Act.</text>
				</paragraph></subsection><subsection id="H1D5ADB2364B14F98B34CD035FE54E23"><enum>(b)</enum><header>Study on
			 availability of equity capital</header>
				<paragraph id="HEE4BBAEE8C3E48D3AFDC3D4337F9BA10"><enum>(1)</enum><header>Study
			 required</header><text>Not later than the end of the 180-day period beginning
			 on the date of enactment of this Act, the Chief Counsel for Advocacy of the
			 Administration shall conduct a study on the availability of equity capital in
			 low-income geographic areas.</text>
				</paragraph><paragraph id="H7DA2EF13DA604E46B57CF85B8B251CB"><enum>(2)</enum><header>Report</header><text>Not
			 later than 90 days after the completion of the study under paragraph (1) the
			 Administrator shall submit to Congress a report containing the findings of the
			 study required under paragraph (1) and any recommendations of the Administrator
			 based on such study.</text>
				</paragraph></subsection></section><section id="H37DF8D7CE4BA43A9AF14057C65DA5C92"><enum>7.</enum><header>Limitation on
			 time for final approval of companies</header><text display-inline="no-display-inline">Section 354(d) of the Small Business
			 Investment Act of 1958 (15 U.S.C. 689c(d)) is amended by striking <quote>a
			 period of time, not to exceed 2 years,</quote> and inserting <quote>2
			 years</quote>.</text>
		</section><section id="HB5E4233E3821432198B0F94838A14605"><enum>8.</enum><header>Applications for
			 New Markets Venture Capital Program</header><text display-inline="no-display-inline">Not later than 60 days after the date of
			 enactment of this Act, the Administrator shall prescribe standard documents for
			 an application for final approval by a New Markets Venture Capital company
			 under section 354(e) of the Small Business Investment Act of 1958 (15 U.S.C.
			 689c(e)). The Administrator shall ensure that such documents are designed to
			 substantially reduce the cost burden of the application process on a company
			 making such an application.</text>
		</section><section id="id6AEE152269E44217AF8A29BB7FEDD4F8"><enum>9.</enum><header>Operational
			 assistance grants</header><text display-inline="no-display-inline">Section
			 358(a)(4)(A) of the Small Business Investment Act of 1958 (15 U.S.C.
			 689g(a)(4)(A)) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="id92B8E0A096F849A89989537E669ED8B2" style="OLC">
				<subparagraph commented="no" display-inline="no-display-inline" id="ID9118EE7BE96745ADA175D9A4A15973BF"><enum>(A)</enum><header>New markets
				venture capital companies</header><text display-inline="yes-display-inline">Notwithstanding section 354(d)(2), the
				amount of a grant made under this subsection to a New Markets Venture Capital
				company shall be equal to the lesser of—</text>
					<clause commented="no" display-inline="no-display-inline" id="idDF334BA00F6543588D5A2C7F8612E6BE"><enum>(i)</enum><text display-inline="yes-display-inline">10 percent of the private capital raised by
				the company; or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="id8C88C42060624D43AE3D179C4722E03E"><enum>(ii)</enum><text display-inline="yes-display-inline">$1,000,000.</text>
					</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H9D4ADED0E94E4AE090CE92ED6428C64"><enum>10.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="H1711C00241E64EE7A4BCBA7283B303C5"><enum>(a)</enum><header>Reauthorization
			 of New Markets Venture Capital Program</header><text>Section 368(a) of the
			 Small Business Investment Act of 1958 (15 U.S.C. 689q(a)) is amended in the
			 matter preceding paragraph (1), by striking <quote>fiscal years 2001 through
			 2006</quote> and inserting <quote>fiscal years 2006 through
			 2009</quote>.</text>
			</subsection><subsection id="H8DACAAC494BC4665982FC43195209B00"><enum>(b)</enum><header>Office of New
			 Markets Venture Capital</header><text>There is authorized to be appropriated to
			 carry out section 202 of the Small Business Investment Act of 1958, as added by
			 this Act, $1,000,000.</text>
