		<official-title>To amend title XVIII of the Social Security Act to waive
		  the monthly beneficiary premium under a prescription drug plan or an MA–PD plan
		  during months in which an individual enrolled in such a plan has a gap in
		  prescription drug coverage.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Prescription for Fairness Act of
			 2006</short-title></quote>.</text>
		</section><section id="id176E6A8A3EAE4209BAD8169B3CCF50BF"><enum>2.</enum><header>Waiver of
			 monthly beneficiary premium during coverage gap</header>
			<subsection id="idDE055A44F6A4403E8A5BDBA0C172E3F3"><enum>(a)</enum><header>In
			 general</header><text>Section 1860D–13(a) of the Social Security Act (42 U.S.C.
			 1395w–113(a)) is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="idA6A221C54A7D43B1935E0316007E0EA8" style="OLC">
					<paragraph id="id350D8F802357424FA93D211687739475"><enum>(7)</enum><header>Waiver of
				monthly beneficiary premium during coverage gap</header>
						<subparagraph id="id22D3CA096A9E4619936CBCD81ACEF824"><enum>(A)</enum><header>In
				general</header><text>During the period beginning on the date of enactment of
				the <short-title>Prescription for Fairness Act of
				2006</short-title> and ending on September 30, 2008, in the case of an
				individual enrolled in a prescription drug plan or an MA–PD plan which does not
				provide any coverage of benefits after the individual has reached the initial
				coverage limit under paragraph (3) of section 1860D–2(b) and before the
				individual has reached the annual out-of-pocket threshold specified in
				paragraph (4)(B) of such section, the following rules shall apply:</text>
							<clause id="id70C5961D64594D429BD9F29475FE1C39"><enum>(i)</enum><text>The individual is
				not responsible for payment of the monthly beneficiary premium (as computed
				under paragraph (2) and adjusted under paragraph (1)) under such a plan for any
				month during which such coverage is not provided.</text>
							</clause><clause id="id2F1889A36E444500999A4AEDAFE10298"><enum>(ii)</enum><text>The Secretary
				shall provide for payment of such monthly beneficiary premium under such a plan
				on behalf of such an individual for any month described in clause (i). Such
				payment shall be made from the Medicare Prescription Drug Account.</text>
							</clause></subparagraph><subparagraph id="idD577C617DF1C4CA0A251159127B7C6F2"><enum>(B)</enum><header>Refund of
				premiums paid</header><text>In the case of such an individual who pays the
				monthly beneficiary premium under such a plan for a month during which such
				coverage is not provided, the Secretary shall refund an amount equal to the
				premium paid. Such refund shall be made from such
				Account.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idACDE4FF366D64D2F96537C14B7A5F9C4"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 1854(b)(1) of the Social Security Act (42
			 U.S.C. 1395w–24(b)(1)) is amended—</text>
				<paragraph id="idAE7934ED81EE4C8BA7FDB455705A0810"><enum>(1)</enum><text>in subparagraph
			 (A), by inserting <quote>and, if applicable, the waiver under subparagraph
			 (D)</quote> after <quote>subparagraph (C)</quote>; and</text>
				</paragraph><paragraph id="id14E82A3CEC3041F5BD4E3A738C22B490"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="id85811D403801409EBE065A95EEB1D66D" style="OLC">
						<subparagraph id="id25E76FB9C0E340959A62DE12151C011D"><enum>(D)</enum><header>Waiver of MA
				monthly prescription drug beneficiary premium</header><text>During the period
				beginning on the date of enactment of the <short-title>Prescription for Fairness Act of 2006</short-title> and
				ending on September 30, 2008, the provisions of section 1860D–13(a)(7) shall
				apply to the MA monthly prescription drug beneficiary premium in the same
				manner as they apply to the monthly beneficiary premium under such
				section.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id90353A6272594545B44FAC05EA6FFB4E"><enum>3.</enum><header>Reduction of
			 medicare advantage regional plan stabilization Fund amount</header>
			<subsection id="IDB269EA5ED08A4283A7F4A5E4B1D89F36"><enum>(a)</enum><header>In
			 general</header><text>Section 1858(e)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395w–27a(e)(2))
			 is amended—</text>
				<paragraph id="id30BE2074C76C4BEF923443644453F370"><enum>(1)</enum><text>in subparagraph
			 (A)(i), by striking <quote>There shall</quote> and inserting <quote>Subject to
			 subparagraph (E), there shall</quote>; and</text>
				</paragraph><paragraph id="id20CC5060053C48B3816D027572DC8B76"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="id265C834567904C4B9025437AB6C7A690" style="OLC">
						<subparagraph id="idA9E15A5FB5D1449DBD377F38F2545346"><enum>(E)</enum><header>Reduction in
				initial funding to offset cost of waiver of prescription drug
				premium</header><text>The Secretary shall reduce the amount available under
				subparagraph (A)(i) by an amount equal to the Secretary’s estimate of the
				increased expenditures from the Medicare Prescription Drug Account by reason of
				the amendments made by section 2 of the <short-title>Prescription for Fairness Act of
				2006</short-title>.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID70AAE434D82F45BE8567701E083BF940"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall take effect as if
			 included in the enactment of section 221(c) of the Medicare Prescription Drug,
			 Improvement, and Modernization Act of 2003 (Public Law 108–173; 117 Stat.
			 2181).</text>
