			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Reclaiming the Nation's Water
			 Act</short-title></quote>.</text>
		</section><section id="id68725285705F4CA4A5DFB5F0BDBB76A3"><enum>2.</enum><header>Purpose;
			 definitions</header><text display-inline="no-display-inline">The Reclamation
			 Wastewater and Groundwater Study and Facilities Act (43 U.S.C. 390h et seq.) is
			 amended—</text>
			<paragraph id="id08BE4593467446219AE11DB18BA0A85C"><enum>(1)</enum><text>by striking
			 section 1603;</text>
			</paragraph><paragraph id="idA3D49DB3151443609A6B4534B26DC38F"><enum>(2)</enum><text>by redesignating
			 section 1602 as section 1603; and</text>
			</paragraph><paragraph id="id6E2CE11B10594E40AD3DB25E618E0744"><enum>(3)</enum><text>by inserting
			 after section 1601 the following:</text>
				<quoted-block display-inline="no-display-inline" id="idC93C4CE0EF1C48F6A49A391A1719FEC1" style="OLC">
					<section id="idA0D172A6C6974A8E81FCDC6E9E7B8C87"><enum>1602.</enum><header>Purposes;
				Definitions</header>
						<subsection id="id0F1FB4793F51457691BE1F8967A37954"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this title are—</text>
							<paragraph id="idF38A7797931C45B78A74843740B8B30C"><enum>(1)</enum><text display-inline="yes-display-inline">to assist in the development of permanent
				local and regional water reclamation and reuse projects in—</text>
								<subparagraph id="idF1FF86D0DCA1491DBB8911CE87E8449C"><enum>(A)</enum><text display-inline="yes-display-inline">the States and areas referred to in the
				first section of the Act of June 17, 1902 (43 U.S.C. 391); and</text>
								</subparagraph><subparagraph id="id114F2F2F07F14D49819373C1D6B3B2B6"><enum>(B)</enum><text display-inline="yes-display-inline">the State of Hawaii; and</text>
								</subparagraph></paragraph><paragraph id="idF14BE45D05594501A1B8D43D64F43DA7"><enum>(2)</enum><text display-inline="yes-display-inline">to further improvements in water
				reclamation and reuse technologies through the conduct of—</text>
								<subparagraph id="idF1D56F4BDBFE43C8A68B96EA15E5F5D5"><enum>(A)</enum><text display-inline="yes-display-inline">research; and</text>
								</subparagraph><subparagraph id="id9306026488D14D1590B7CA382AD9D408"><enum>(B)</enum><text display-inline="yes-display-inline">demonstration activities in the States and
				areas described in subparagraphs (A) and (B) of paragraph (1).</text>
								</subparagraph></paragraph></subsection><subsection id="idB32EECF935F04602BFE84B6CD0D2E05B"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this title:</text>
							<paragraph id="id83D5FF755567449DABCF6FEA3D559A7C"><enum>(1)</enum><header>Financially
				capable project sponsor</header><text>The term <quote>financially capable
				project sponsor</quote> means a non-Federal project sponsor that is capable of
				providing—</text>
								<subparagraph id="idF013E52C656A4F879C82A69310B96EC7"><enum>(A)</enum><text>the non-Federal
				share of the project costs; and</text>
								</subparagraph><subparagraph id="idB1404CCC4F754D548EA51CF6B6E1CFA8"><enum>(B)</enum><text>100 percent of
				the operations and maintenance costs of the project.</text>
								</subparagraph></paragraph><paragraph id="ID30907ED9C83E4FE7ACB7E0E34D2F8AA1"><enum>(2)</enum><header>Non-federal
				project sponsor</header><text>The term <term>non-Federal project sponsor</term>
				means a State, regional, or local authority or other qualifying entity, such as
				a water conservation district, water conservancy district, or rural water
				district or association.</text>
							</paragraph><paragraph id="ID6E2C1C0EEC784738883ABF61DAA43791"><enum>(3)</enum><header>Federal
				reclamation laws</header><text>The term <term>Federal reclamation laws</term>
				means the Act of June 17, 1902 (32 Stat. 388, chapter 1093), and Acts
				supplemental to and amendatory of that Act (43 U.S.C. 371 et seq.).</text>
							</paragraph><paragraph id="id062CFBEBED64494A864018103B9CF02E"><enum>(4)</enum><header>Reclaim;
				reclamation</header><text>The terms <quote>reclaim</quote> and
				<quote>reclamation</quote> include recycling and desalination.</text>
							</paragraph><paragraph id="idD5DDC203258041709D6F7933E697B300"><enum>(5)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the
				Secretary of the Interior.</text>
							</paragraph><paragraph id="idA01D79D03AB54035918E84F6EBC3B1EE"><enum>(6)</enum><header>Technically and
				financially viable project</header><text>The term <quote>technically and
				financially viable project</quote> means a project that—</text>
								<subparagraph id="id12702E584C534015B6E60CB155B7C61B"><enum>(A)</enum><text>is a technically
				viable project; and</text>
								</subparagraph><subparagraph id="idB46DFCEF2624440DBBA79CA372377EFC"><enum>(B)</enum><text>has a financially
				capable project sponsor.</text>
								</subparagraph></paragraph><paragraph id="id6DA12AA8C54640FB9C52F5894319FAEC"><enum>(7)</enum><header>Technically
				viable project</header><text display-inline="yes-display-inline">The term
				<quote>technically viable project</quote> means a project that—</text>
								<subparagraph id="idA5BC3BB6854D4F89A9F7AE29BB8224B2"><enum>(A)</enum><text display-inline="yes-display-inline">meets generally acceptable engineering,
				public health, and environmental standards; and</text>
								</subparagraph><subparagraph id="id10F524147B344D7EA4B558DF3FECC19F"><enum>(B)</enum><text display-inline="yes-display-inline">has obtained or is expected to obtain
				approval of all Federal, State, and local permits necessary for implementation
				of the
				project.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idD907F878604347EA9648DE2BC191254E"><enum>3.</enum><header>General
			 authority</header><text display-inline="no-display-inline">Section 1603(a) of
			 the Reclamation Wastewater and Groundwater Study and Facilities Act (as
			 redesignated by section 2(2)), is amended—</text>
			<paragraph id="idF59710C79A27456C9136A1F98B977CCD"><enum>(1)</enum><text>by striking
			 <quote>The Secretary of the Interior</quote> and all that follows through
			 <quote>is directed to</quote> and inserting <quote>The Secretary, acting
			 pursuant to Federal reclamation laws, shall</quote>;</text>
			</paragraph><paragraph id="id657035B5C8784414A05ADE5F65DDF453"><enum>(2)</enum><text>by striking
			 <quote>investigate and identify</quote> and inserting <quote>participate
			 in</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5CB7BA2C2F7E4282AE8DE09BC5D4F829"><enum>(3)</enum><text>by striking
			 <quote>to conduct research, including desalting</quote> and inserting
			 <quote>conduct research, including desalination</quote>.</text>
			</paragraph></section><section id="idF33CCD021DCA458B81BA84682701127F"><enum>4.</enum><header>Review of
			 proposals submitted by non-federal project sponsors</header><text display-inline="no-display-inline">The Reclamation Wastewater and Groundwater
			 Study and Facilities Act (43 U.S.C. 390h et seq.) is amended by striking
			 section 1604 and inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="id704B00B99E4445C5A5F1533314EE5909" style="OLC">
				<section id="id43D5DAF10B604F83B573076EADB480C8"><enum>1604.</enum><header>Review of
				proposals submitted by non-federal project sponsors</header>
					<subsection id="idC58C9E7D67174398B4475CD5EA0FDD14"><enum>(a)</enum><header>Authority to
				review</header><text>The Secretary shall review any project proposal under this
				title that is—</text>
						<paragraph id="id746873628EBD4DA390AC0EBA1122FBCE"><enum>(1)</enum><text>developed by a
				non-Federal project sponsor—</text>
							<subparagraph id="id7428A7C80C14410BB1F4456F7EC99583"><enum>(A)</enum><text>independently;
				or</text>
							</subparagraph><subparagraph id="idC3474B90D6AB479DBECA7D90C498CA94"><enum>(B)</enum><text>with the
				assistance of the Department of the Interior or any other governmental or
				nongovernmental entity; and</text>
							</subparagraph></paragraph><paragraph id="id9496CA3E7BEC45E896F62DFA06533ED3"><enum>(2)</enum><text>submitted or
				resubmitted to the Secretary by a non-Federal project sponsor, including a
				project proposal that has been previously reviewed for feasibility by the
				Secretary.</text>
						</paragraph></subsection><subsection id="id30D72988A5694A81BC74A0AE9E22DFB8"><enum>(b)</enum><header>Requirements</header><text>In
				addition to complying with any requirements of other Federal laws, a project
				proposal submitted by a non-Federal project sponsor under this section
				shall—</text>
						<paragraph id="ID07753f3edf624facbfc5cca175fd59c7"><enum>(1)</enum><text>provide
				sufficient evidence, as determined by the Secretary, to demonstrate that the
				project—</text>
							<subparagraph id="idF855881549A7424FB1AE1F3B497A9113"><enum>(A)</enum><text>is a technically
				viable project; and</text>
							</subparagraph><subparagraph id="id7F99D431DA98479D816713EAABF9400F"><enum>(B)</enum><text>has a financially
				capable project sponsor; and</text>
							</subparagraph></paragraph><paragraph id="ID7fdebd3c05484450b19e0d2966affeb9"><enum>(2)</enum><text>provide
				information on each of the factors described in subsection
				(d)(1)(B)(ii).</text>
						</paragraph></subsection><subsection id="IDa1be2ccae5164a939e1369868466f8ac"><enum>(c)</enum><header>Determination
				of financial and technical viability</header>
						<paragraph id="IDbd37e4897f104c398caab34f8bfd5f48"><enum>(1)</enum><header>In
				general</header><text>Not later than 30 days after the date on which a
				non-Federal project sponsor submits a project proposal (including any
				supporting documentation) under subsection (a)(2), the Secretary shall provide
				to the non-Federal project sponsor written notice on whether the project
				proposal includes sufficient information under paragraph (2) for the Secretary
				to determine whether the proposed project is a technically and financially
				viable project.</text>
						</paragraph><paragraph id="ID1f7d372e2c674288a88379c2e9bec896"><enum>(2)</enum><header>Checklist</header><text>A
				project proposal shall include sufficient information for a determination under
				paragraph (1) if the proposal includes—</text>
							<subparagraph id="IDc0c8b5e493f549389a451af3d6856aca"><enum>(A)</enum><text>a map of the
				proposed project area and service area;</text>
							</subparagraph><subparagraph id="IDcec775c34f9e4b1ea4291099bdb00b41"><enum>(B)</enum><text>a project
				description or plan, including engineering plans;</text>
							</subparagraph><subparagraph id="IDca2d3cf4b9f94ddfbe99afb80fc2d9d0"><enum>(C)</enum><text>the initial cost
				estimates for the project;</text>
							</subparagraph><subparagraph id="ID87edc932b89c4a9e8bde75db28912e19"><enum>(D)</enum><text>a financial plan
				for the project; and</text>
							</subparagraph><subparagraph id="ID55470dbfb9144ab8a02c056a122c47fc"><enum>(E)</enum><text>a report on the
				status of any Federal, State, and local permits that are necessary to implement
				the project.</text>
							</subparagraph></paragraph><paragraph id="IDd70f0208037f488db5c88aab9d8601a4"><enum>(3)</enum><header>Determination
				of insufficient information</header>
							<subparagraph id="idC3D9BD1F5D494CA8ACCEFBEB8E405B07"><enum>(A)</enum><header>In
				general</header><text>If the Secretary determines that there is insufficient
				information in the project proposal for the Secretary to determine whether the
				project is a technically and financially viable project—</text>
								<clause id="id5BA0CBFD4F774BEC9183CE67BF79C83D"><enum>(i)</enum><text>the Secretary
				shall provide to the non-Federal project sponsor written notice that identifies
				any information that the Secretary determines to be necessary to make the
				determination; and</text>
								</clause><clause id="id22204FC98E524BE6A865E9A83E746410"><enum>(ii)</enum><text>the non-Federal
				project entity may submit a revised project proposal to the Secretary.</text>
								</clause></subparagraph><subparagraph id="ID14082954a8a344aabaa6c0698409f931"><enum>(B)</enum><header>Notification</header><text>Not
				later than 21 days after the date on which a non-Federal project sponsor
				submits a revised proposal to the Secretary under subparagraph (A)(ii), the
				Secretary shall provide to the non-Federal project sponsor written notice that
				describes whether sufficient information has been provided to make a
				determination on whether the project is a technically and financially viable
				project.</text>
							</subparagraph></paragraph></subsection><subsection id="IDd5a15c193629458bb57509b8312b319c"><enum>(d)</enum><header>Notice to
				congress</header>
						<paragraph id="ID1cda8d6d03ae401084471607f89ea4c4"><enum>(1)</enum><header>In
				general</header><text>Not later than 180 days after the date on which the
				Secretary determines that a project proposal includes sufficient information to
				make a determination on whether the project is a technically and financially
				viable project, the Secretary shall submit to Congress a written notice of the
				findings of the Secretary that includes—</text>
							<subparagraph id="ID1fac2b76f97640399594625caf51eb11"><enum>(A)</enum><text>a statement and
				explanation of the determination on whether the project is a technically and
				financially viable project; and</text>
							</subparagraph><subparagraph id="ID3dd75abe777e4e9aa45780f1a5bf9ac3"><enum>(B)</enum><text>a concise
				recommendation of the Secretary on whether the project should be authorized for
				construction, that is based on, but is not required to describe—</text>
								<clause id="idD31EBD242B284F79BBCE295A9E16E25A"><enum>(i)</enum><text>the results of
				the review of the project proposal under subsection (a); and</text>
								</clause><clause id="id45F24A4B36AB4FC384ACC4C00B8F20FA"><enum>(ii)</enum><text>the
				consideration of the following factors:</text>
									<subclause id="IDbe4ea92a30104a16acbad4b48206c855"><enum>(I)</enum><text>The cost per
				acre-foot of water to be produced by the project.</text>
									</subclause><subclause id="id9DABD7595F8042F780EF725A6BA63334"><enum>(II)</enum><text>The quality and
				quantity of water to be produced by the project.</text>
									</subclause><subclause id="IDbe76c2fed7924b449855d30a92cb0217"><enum>(III)</enum><text>The
				cost-effectiveness of the project compared with other available alternatives,
				including whether other comparatively cost-effective alternatives for meeting a
				significant water supply need for the project exist.</text>
									</subclause><subclause id="IDeeae2c9ed3fe41d08ab279c1a33d911a"><enum>(IV)</enum><text>Any
				environmental benefits or adverse effects of the project.</text>
									</subclause><subclause id="IDbcc7a3511d0a4912854a9c4476f8e729"><enum>(V)</enum><text>The extent to
				which the project would help serve an identified Federal interest.</text>
									</subclause><subclause id="IDf3a39aebdee04d48bb456ba351a3a4c8"><enum>(VI)</enum><text>The extent to
				which the project would provide regional benefits.</text>
									</subclause><subclause id="IDdb96f62a9ec9432c8b052c839f7beabf"><enum>(VII)</enum><text>Whether the
				project demonstrates innovative or alternative technologies or processes
				relating to water treatment or waste minimization and management.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="ID5092e7d4b89048099bc904483f18a51f"><enum>(2)</enum><header>Availability</header><text>To
				ensure that the determination and recommendation submitted under paragraph (1)
				are made publicly available, the Secretary shall—</text>
							<subparagraph id="ID41034cdfd41b411897defb89df901e91"><enum>(A)</enum><text>transmit a copy
				of the written notice under paragraph (1) to—</text>
								<clause id="idB4C4D3B19D14400780B1C4B73716C831"><enum>(i)</enum><text>the Committee on
				Energy and Natural Resources of the Senate; and</text>
								</clause><clause id="id7DEAC15DE9CC4766AE47A6B8ABB70468"><enum>(ii)</enum><text>the Committee on
				Resources of the House of Representatives; and</text>
								</clause></subparagraph><subparagraph id="ID651d275a653949e09c6eef1217367fff"><enum>(B)</enum><text>publish in the
				Federal Register notice of the availability of the written notice.</text>
							</subparagraph></paragraph></subsection><subsection id="ID47c6800af6ac4f869bd357e135e0b014"><enum>(e)</enum><header>Revisions to
				proposal</header>
						<paragraph id="idD83DC50DE9EB4D2CA19023E44EB5EF35"><enum>(1)</enum><header>In
				general</header><text>If the Secretary determines under subsection (d)(1)(A)
				that a project is not a technically and financially viable project, the
				Secretary shall not be required to conduct further analysis of the project
				until the non-Federal project sponsor—</text>
							<subparagraph id="id6F1C6F2750844DA7B16ADABE3C2CED01"><enum>(A)</enum><text>conducts an
				additional investigation of the project; and</text>
							</subparagraph><subparagraph id="id40C27A4BB1EA4FF1A8AC303A2E273FEC"><enum>(B)</enum><text>resubmits a
				revised project proposal in accordance with this section.</text>
							</subparagraph></paragraph><paragraph id="ID2e67330e7acd4a59ace8968c3d4be500"><enum>(2)</enum><header>Costs</header><text>The
				non-Federal project sponsor shall pay any costs associated with revising the
				project proposal under paragraph (1).</text>
						</paragraph></subsection><subsection commented="no" id="id230793A9335B4E14A8B89D0D9A3776F8"><enum>(f)</enum><header>Congressional
				determination and authorization</header>
						<paragraph commented="no" id="idA7C2B9DD75FC41259D92A030F87D9F15"><enum>(1)</enum><header>Congressional
				determination</header><text>Congress may make the determination on whether to
				authorize a project under this title if—</text>
							<subparagraph commented="no" id="id3697DD43D22F46F891CA97E383FAE6AA"><enum>(A)</enum><text>the Secretary
				submits the written notice under subsection (d)(1);</text>
							</subparagraph><subparagraph commented="no" id="idC2A50E129A5D427D839E18DC9392A59C"><enum>(B)</enum><text>by the date that
				is 60 days after the date on which a non-Federal project sponsor submits a
				project proposal under subsection (a)(2), the Secretary does not submit written
				notice to the non-Federal project sponsor under subsection (c)(1); or</text>
							</subparagraph><subparagraph commented="no" id="idEBD1FE84F8D24DE7A3ED85BE28E29F6C"><enum>(C)</enum><text>by the date that
				is 180 days after the date on which the Secretary determines that a project
				proposal includes sufficient information to make a determination on whether the
				project is a technically and financially viable project, the Secretary does not
				submit the written notice under subsection (d)(1).</text>
							</subparagraph></paragraph><paragraph commented="no" id="idFC36F2AF801E42389E316CAC5DEE55A9"><enum>(2)</enum><header>Congressional
				authorization</header><text>Nothing in this section precludes Congress from
				authorizing a project under this title.</text>
						</paragraph></subsection><subsection id="id518E501CA53E473C9AE2DCCED276BE92"><enum>(g)</enum><header>Transition
				provisions</header>
						<paragraph id="ID287214e3db7e4517a148b2f251e2e45b"><enum>(1)</enum><header>In
				general</header><text>A non-Federal project sponsor that has submitted to the
				Secretary for review a feasibility study for a project under this title before
				the date of enactment of the Reclaiming the Nation's Water Act may—</text>
							<subparagraph id="id43FA5B8C2A2A40CF9557A0A86E62DBB3"><enum>(A)</enum><text>submit a new
				project proposal for approval under subsection (a); or</text>
							</subparagraph><subparagraph id="id5D131451AF7043F0A501E0686157C2B8"><enum>(B)</enum><text>notify the
				Secretary in writing that the non-Federal project sponsor elects to seek
				approval of the project using the previously submitted feasibility
				study.</text>
							</subparagraph></paragraph><paragraph id="IDa80b3c7ebf6840e8bf3df35a715cf7f7"><enum>(2)</enum><header>Supplemental
				information</header><text>If the non-Federal project sponsor makes the election
				under paragraph (1)(B), the non-Federal project sponsor may supplement the
				previously submitted feasibility study to provide additional
				information—</text>
							<subparagraph id="idE2BBE0907B6B406D8BD4FF3E4DA66226"><enum>(A)</enum><text>on whether the
				project is a technically and financially viable project; and</text>
							</subparagraph><subparagraph id="id2E1A7EC916F741BCB40C7B1A3CAF9364"><enum>(B)</enum><text>to address each
				of the factors described in subsection (d)(1)(B)(ii).</text>
							</subparagraph></paragraph><paragraph id="IDbfa2f38f8f4741c6a1e20f56119749cc"><enum>(3)</enum><header>Determination
				of technical and financial viability</header><text>Not later than 90 days after
				the date on which the Secretary receives notice of an election under paragraph
				(1)(B), the Secretary shall determine whether the project is a technically and
				financially viable project.</text>
						</paragraph><paragraph id="IDe7f696423077426492d9d3efdef9a4c7"><enum>(4)</enum><header>Notice to
				congress</header><text>Not later than 180 days after the date on which the
				Secretary receives notice of an election under paragraph (1)(B), the Secretary
				shall submit to Congress written notice on the determination and recommendation
				of the Secretary with respect to the proposal in accordance with subsection
				(d).</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idCB7317E40E654D0FABFCEDD9B4730ADF"><enum>5.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">Section 1631 of
			 the Reclamation Wastewater and Groundwater Study and Facilities Act (43 U.S.C.
			 390h–13) is amended—</text>
			<paragraph id="id1E28C7ADEB99417D85C7C73836950B91"><enum>(1)</enum><text>in subsection
			 (b)(1)—</text>
				<subparagraph id="idAB997533C55142BE89AB0F51A76A442D"><enum>(A)</enum><text>by striking
			 <quote>may not be appropriated</quote> and inserting <quote>may not be expended
			 by the Secretary</quote>; and</text>
				</subparagraph><subparagraph id="idF45F1501B0FA49069187FFE95DFDD39F"><enum>(B)</enum><text>by striking
			 subparagraphs (A) and (B) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6B062E958CBC4917A4CADF1AC23F1638" style="OLC">
						<subparagraph id="id46F2634C9B5B4D54AE8F3C65C430F5C8"><enum>(A)</enum><text>Congress has
				authorized the construction of the project;</text>
						</subparagraph><subparagraph id="idB71A1A6CBC6F4D3680A43981A6BAA5BC"><enum>(B)</enum><text>the Secretary has
				determined that the project has a financially capable project sponsor;
				and</text>
						</subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="idB5023ADD9C564904978BC36FDCD769A1"><enum>(2)</enum><text>in subsection
			 (c), by striking <quote>the non-Federal project sponsor</quote> and all that
			 follows through <quote>project's costs</quote> and inserting <quote>the project
			 has a financially capable project sponsor</quote>; and</text>
			</paragraph><paragraph id="id922BF109EFDE4BD98351A24EE1BE7329"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA6CE0B9A65344E3598DAD4F37EB45E49" style="OLC">
					<subsection id="id0669F25CDC9C4F5793084993F0BB2F93"><enum>(e)</enum><header>Limitation on
				new projects</header>
						<paragraph id="id5675F2A1DCB9444BA584FF19945D5C4D"><enum>(1)</enum><header>In
				general</header><text>The Federal share of the total costs of any project
				authorized under this title after the date of enactment of the Reclaiming the
				Nation's Water Act shall be not more than 20 percent.</text>
						</paragraph><paragraph id="id00A587D78BC647628E9F161B59B531F1"><enum>(2)</enum><header>Operation and
				maintenance costs</header><text>No Federal funds shall be used to pay the costs
				of operating and maintaining any project authorized under this title after the
				date of enactment of the Reclaiming the Nation's Water Act.</text>
						</paragraph></subsection><subsection id="idD03E5175249F479AB118DC65BCCA86D9"><enum>(f)</enum><header>Deauthorization</header><text>Any
				project authorized under this title that has not received Federal funding by
				the date that is the later of the date that is 10 years after the date of
				enactment of the Reclaiming the Nation's Water Act or 10 years after the date
				on which construction of the project is authorized shall be
				deauthorized.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id25365C71A6D04D78914A3BEF1259718E"><enum>6.</enum><header>Reuse planning
			 assistance program</header><text display-inline="no-display-inline">The
			 Reclamation Wastewater and Groundwater Study and Facilities Act (43 U.S.C. 390h
			 et seq.) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id26EEB00D825C4509B4A32802E58FDAB5" style="OLC">
				<section id="id64E91AF02E4F4A2489C7CBA66D27CD07"><enum>1639.</enum><header>Reuse
				planning assistance program</header>
					<subsection id="ID0e957875b89847c5af39d7963aac6581"><enum>(a)</enum><header>In
				general</header><text>The Secretary may cooperate with any non-Federal project
				sponsor in the preparation of any plan (including a project proposal) for the
				development of reclaimed water for reuse applications or environmental benefits
				that are in the public interest, as determined by the Secretary.</text>
					</subsection><subsection id="ID7304dd413a3a450188ba9945329d6843"><enum>(b)</enum><header>Agreement</header>
						<paragraph id="idEB3CA4AC10FE4E10BD8E11F3BBFE8455"><enum>(1)</enum><header>In
				general</header><text>At the request of a non-Federal project sponsor, the
				Secretary may enter into an agreement with the non-Federal project sponsor to
				provide for the preparation of a project proposal for review under section
				1604(a).</text>
						</paragraph><paragraph id="ID128f8175469b4cc6b650e444d6660887"><enum>(2)</enum><header>Requirements</header><text>Any
				project proposal prepared under an agreement entered into under paragraph (1)
				shall comply with the <act-name parsable-cite="NEPA69">National Environmental
				Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.), including
				any regulations promulgated to carry out that Act.</text>
						</paragraph><paragraph id="IDc1adf8198d3e43d38c25f74b9d977a22"><enum>(3)</enum><header>Consultation</header><text>The
				Secretary shall consult and cooperate with appropriate Federal, State,
				regional, and local entities during the development of each project proposal
				prepared under an agreement entered into under paragraph (1).</text>
						</paragraph></subsection><subsection id="ID4f305629c8fc4e99b480d28a9b753ba9"><enum>(c)</enum><header>Authorization
				of appropriations</header>
						<paragraph id="idF94A2B2226BB4063830FAA712416CD28"><enum>(1)</enum><header>In
				general</header><text>There is authorized to be appropriated to carry out this
				section not more than $4,400,000 for fiscal year 2007 and each fiscal year
				thereafter, of which—</text>
							<subparagraph id="idE7710A8879A24B95BC5569C1D356A6BD"><enum>(A)</enum><text>not more than
				$500,000 shall be expended in any 1 fiscal year for a plan for any 1 project;
				and</text>
							</subparagraph><subparagraph id="ID7b1f5399bc0c41e784838fb75a855b4f"><enum>(B)</enum><text>not more than a
				total of $1,000,000 shall be made available to a non-Federal project sponsor to
				prepare a plan for any 1 project.</text>
							</subparagraph></paragraph><paragraph id="ID5e2569b584d040e1938700c2393a11aa"><enum>(2)</enum><header>Federal
				share</header><text>The Federal share of the total costs of any plan for a
				project prepared under an agreement entered into under subsection (b)(1) shall
				be not more than 50
				percent.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id1A6C507CE34F4B649FCCA1B42531F20D"><enum>7.</enum><header>Technical and
			 conforming amendments</header>
			<subsection id="id0CB1556B7FEE4904A6298FF7917DD2D2"><enum>(a)</enum><header>Technical
			 amendments</header><text>The Reclamation Wastewater and Groundwater Study and
			 Facilities Act (43 U.S.C. 390h et seq.) is amended—</text>
				<paragraph id="idD81D9FDD327B421CA31630FEB8F50D99"><enum>(1)</enum><text>in section
			 1612(a) (43 U.S.C. 390h–10(a)), by striking <quote>California or</quote> and
			 inserting <quote>California, or</quote>; and</text>
				</paragraph><paragraph id="id47B574126F0E49E49580DE04434B9B50"><enum>(2)</enum><text>in section
			 1632(a) (43 U.S.C. 390h–14(a))—</text>
					<subparagraph id="id4246F65BA8694CE5A1E8AE409175E17F"><enum>(A)</enum><text>by striking
			 <quote>Secretary of the Interior</quote> and inserting
			 <quote>Secretary</quote>; and</text>
					</subparagraph><subparagraph id="id4BFE1AFB09DC4367991E58FC7BE12E5A"><enum>(B)</enum><text>in paragraph (2),
			 by striking the comma and inserting a semicolon.</text>
					</subparagraph></paragraph></subsection><subsection id="id53537B45EB3045839185ADF652960D21"><enum>(b)</enum><header>Conforming
			 amendments</header><text>The table of sections in
			 <external-xref legal-doc="act" parsable-cite="RPAAA92/2">section
			 2</external-xref> of the <act-name parsable-cite="RPAAA92">Reclamation Projects
			 Authorization and Adjustment Act of 1992</act-name> (43 U.S.C. prec. 371) is
			 amended—</text>
