		  the use of mercury in the manufacture of chlorine and caustic soda, and for
		  other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Missing Mercury in Manufacturing
			 Monitoring and Mitigation Act</short-title></quote>.</text>
		</section><section id="ID8cf14fc425f64b39ba45dbb6818f7ac5"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="IDf4044d514ef949939331590fb4e956ce"><enum>(1)</enum><text>mercury and
			 mercury compounds are highly toxic to humans, ecosystems, and wildlife;</text>
			</paragraph><paragraph id="ID41db740cd5d14740ba8bdfd879195f4a"><enum>(2)</enum><text>as many as 10
			 percent of women in the United States of childbearing age have mercury in their
			 bloodstreams at a level that could pose risks to their unborn babies, and as
			 many as 630,000 children born annually in the United States are at risk of
			 neurological problems relating to mercury exposure in utero;</text>
			</paragraph><paragraph id="ID07d7b84121b849fbaca29ccb9df508ae"><enum>(3)</enum><text>the most
			 significant source of mercury exposure to people in the United States is
			 ingestion of mercury-contaminated fish;</text>
			</paragraph><paragraph id="ID46612688742e429593dc57493fde9fa8"><enum>(4)</enum><text>the Environmental
			 Protection Agency reports that, as of 2004, as a result of mercury
			 contamination—</text>
				<subparagraph id="id710BFDF8293344C2A0165FFEC4774F12"><enum>(A)</enum><text>44 States have
			 fish advisories covering more than 13,000,000 lake acres and more than 750,000
			 river miles;</text>
				</subparagraph><subparagraph id="id1083256F85A54E06AD231A5F47072ABA"><enum>(B)</enum><text>in 21 States, the
			 freshwater fish advisories are statewide; and</text>
				</subparagraph><subparagraph id="id0A872C9EB8BB4FAA8A08E0864FE504E3"><enum>(C)</enum><text>in 12 States, the
			 coastal fish advisories are statewide;</text>
				</subparagraph></paragraph><paragraph id="ID88b3cd762bd14bdd8ccaef91601bc277"><enum>(5)</enum><text>the long-term
			 solution to mercury pollution is to minimize global mercury use and releases of
			 mercury to eventually achieve reduced contamination levels in the environment,
			 rather than reducing fish consumption, since uncontaminated fish represents a
			 critical and healthy source of nutrition for people worldwide;</text>
			</paragraph><paragraph id="id246611FA72304B8DA56693D7E431C490"><enum>(6)</enum><text>an estimated
			 additional 24,000 to 30,000 tons of mercury are used at mercury cell
			 chlor-alkali plants worldwide;</text>
			</paragraph><paragraph id="ID7541630d60054cd599902cc5bd04c997"><enum>(7)</enum><text>mercury pollution
			 is a transboundary pollutant that—</text>
				<subparagraph id="idFA0569E5EB5A4F3D98100E2F3D4DBAEB"><enum>(A)</enum><text>is deposited
			 locally, regionally, and globally; and</text>
				</subparagraph><subparagraph id="idF8B51DDFCBEB490E8509CA3414C41D49"><enum>(B)</enum><text>affects bodies of
			 water near industrial areas, such as the Great Lakes, as well as bodies of
			 water in remote areas, such as the Arctic Circle;</text>
				</subparagraph></paragraph><paragraph id="idE079981206664AE9B8FFBB21DD0AE06A"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id0E5717A303904AA6A8BD902D6683D1E6"><enum>(A)</enum><text>of the approximately 30
			 plants in the United States that produce chlorine, only 8 use the obsolete
			 <quote>mercury cell</quote> chlor-alkali process; and</text>
				</subparagraph><subparagraph id="id66F242893E024931B771F13213822A6F" indent="up1"><enum>(B)</enum><text>the 8 plants described in subparagraph
			 (A) that use the mercury cell chlor-alkali process release or lose a quantity
			 of mercury that rivals the mercury emissions of all coal-fired power plants in
			 the United States;</text>
				</subparagraph></paragraph><paragraph id="id25A6970A6D4346059F56E173337D0AF1"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id1245BE0440EF4D4292DB5E1660A89351"><enum>(A)</enum><text>only about 10 percent
			 of the total quantity of chlorine and caustic soda produced comes from the
			 chlor-alkali plants described in paragraph (8) that use the mercury cell
			 chlor-alkali process; and</text>
				</subparagraph><subparagraph id="idF1CDDFBA5F1B49B3B9FBF6F8F4B7BF90" indent="up1"><enum>(B)</enum><text>cost-effective alternatives are
			 available and in use in the remaining 90 percent of chlorine and caustic soda
			 production, and other countries, including Japan, have already banned the
			 mercury cell chlor-alkali process;</text>
				</subparagraph></paragraph><paragraph id="ID638bdf6000f042f9ac909c8942438124"><enum>(10)</enum><text>as of the date
			 of enactment of this Act, the chlor-alkali industry in the United States
			 possesses approximately 2,500 tons of mercury at facilities using the mercury
			 cell process and historically has used substantially greater quantities of
			 mercury because many more facilities in the past used the mercury cell
			 process;</text>
			</paragraph><paragraph id="ID22d88a9d8a564c1796a6dae130020e60"><enum>(11)</enum><text>the chlor-alkali
			 industry acknowledges that—</text>
				<subparagraph id="id498BBFFCB8B148C7A676A5E65C9FAAFF"><enum>(A)</enum><text>mercury can
			 contaminate products manufactured at mercury cell facilities; and</text>
				</subparagraph><subparagraph id="id243898AFCDB64CFA9759B474811A4AE9"><enum>(B)</enum><text>the use of some
			 of those products results in the direct and indirect release of mercury;</text>
				</subparagraph></paragraph><paragraph id="id269F3D3391084CCC91DF6F741338A01C"><enum>(12)</enum><text>despite those
			 quantities of mercury known to have been used or to be in use, the chlor-alkali
			 industry and the Environmental Protection Agency have failed—</text>
				<subparagraph id="id2C8D455F40634021B9390C9DAF0D3790"><enum>(A)</enum><text>to adequately
			 account for the disposition of the mercury used at those facilities; and</text>
				</subparagraph><subparagraph id="idE2F73B8B461442188352C1D920B428A3"><enum>(B)</enum><text>to accurately
			 estimate current mercury emissions; and</text>
				</subparagraph></paragraph><paragraph id="idFF78DFFD9ADE4E779D1E2DE97380E97D"><enum>(13)</enum><text>it is critically
			 important that the United States work aggressively toward the monitoring and
			 mitigation of domestically-used mercury.</text>
			</paragraph></section><section id="ID220c1f5352ab4c3dbd290c030a5e891c"><enum>3.</enum><header>Statement of
			 policy</header><text display-inline="no-display-inline">Congress declares that
			 the United States should develop policies and programs that will—</text>
			<paragraph id="IDe06ffa6add66420aa329414755c45205"><enum>(1)</enum><text>reduce mercury
			 use and emissions within the United States;</text>
			</paragraph><paragraph id="ID3fc31c2892124db1bae7364910ac05de"><enum>(2)</enum><text>reduce mercury
			 releases from the reservoir of mercury currently in use or circulation within
			 the United States; and</text>
			</paragraph><paragraph id="IDa36ff772b3b34c779752b10af41666e6"><enum>(3)</enum><text>reduce exposures
			 to mercury, particularly exposures of women of childbearing age and young
			 children.</text>
			</paragraph></section><section id="ID6229335c45244d34858a9d3c4db25c67"><enum>4.</enum><header>Use of mercury
			 in chlorine and caustic soda manufacturing</header>
			<subsection id="id0EC5BB669DC045788A216896D13E93C0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title I of the Toxic
			 Substances Control Act (15 U.S.C. 2601 et seq.) is amended by inserting after
			 section 6 the following:</text>
				<quoted-block display-inline="no-display-inline" id="idCD68DCF3A1CD4C8C8A31B3C72C71CB53" style="OLC">
					<section id="id6278E404A1B94010AB620463769A6031"><enum>6A.</enum><header>Use of mercury
				in chlorine and caustic soda manufacturing</header>
						<subsection id="id101CE5D250734B5D9D50040982E944DD"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="idC678F1CD8C3241F29307E7B4103D678B"><enum>(1)</enum><header>Chlor-alkali
				facility</header><text>The term <term>chlor-alkali facility</term> means a
				facility used for the manufacture of chlorine or caustic soda using a mercury
				cell process.</text>
							</paragraph><paragraph id="id0DA96555988C4B7E96A628DAF4BDDDA1"><enum>(2)</enum><header>Hazardous
				waste; solid waste</header><text>The terms <term>hazardous waste</term> and
				<term>solid waste</term> have the meanings given those terms in section 1004 of
				the Solid Waste Disposal Act (42 U.S.C. 6903).</text>
							</paragraph></subsection><subsection id="id51C3A4641093483E9D6330A3992BBC99"><enum>(b)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Effective beginning January 1, 2012, the
				manufacture of chlorine or caustic soda using mercury cells is prohibited in
				the United States.</text>
						</subsection><subsection id="ID2584e964bd8b4e748170f971e1fba501"><enum>(c)</enum><header>Reporting</header>
							<paragraph id="idF331BB2F67B24010A6A84A355E2F1D8B"><enum>(1)</enum><header>In
				general</header><text>Not later than April 1, 2007, and annually thereafter
				through April 1, 2012, the owner or operator of each chlor-alkali facility
				shall submit to the Administrator and the State in which the chlor-alkali
				facility is located a report that identifies—</text>
								<subparagraph id="idD300004DBF3742488719F9E6C48237C2"><enum>(A)</enum><text>each type and
				quantity of mercury-containing hazardous waste and nonhazardous solid waste
				generated by the chlor-alkali facility during the preceding calendar
				year;</text>
								</subparagraph><subparagraph id="id6CF3373C14F44B7AB62E544532B5C0B0"><enum>(B)</enum><text>the mercury
				content of the wastes;</text>
								</subparagraph><subparagraph id="id53AAB437EEF5402FA4D13EB48C76CDCF"><enum>(C)</enum><text>the manner in
				which each waste was managed, including the location of each offsite location
				to which the waste was transported for subsequent handling or
				management;</text>
								</subparagraph><subparagraph id="ID37de7ade313b47ffb4d32726d0f15224"><enum>(D)</enum><text>the volume of
				mercury released, intentionally or unintentionally, into the air or water by
				the chlor-alkali facility, including mercury released from emissions or
				vaporization;</text>
								</subparagraph><subparagraph id="ID0ce60692b5734ebcb90368fd0492a9fa"><enum>(E)</enum><text>the volume of
				mercury estimated to have accumulated in pipes and plant equipment of the
				chlor-alkali facility, including a description of—</text>
									<clause id="idA9B64C5C409249E9AAB1A76B80467555"><enum>(i)</enum><text>the applicable
				volume for each type of equipment; and</text>
									</clause><clause id="idB9B409BB2B2D424BAA0D6D489133DDC3"><enum>(ii)</enum><text>methods of
				accumulation; and</text>
									</clause></subparagraph><subparagraph id="idF5546448D12B4305B3DBEBF9691FCF15"><enum>(F)</enum><text>the quantity and
				forms of mercury found in all products produced for sale by the chlor-alkali
				facility.</text>
								</subparagraph></paragraph><paragraph id="idD1839AAA08A746D1BB55A61C7B74141C"><enum>(2)</enum><header>Avoidance of
				duplication</header><text>To avoid duplication, the Administrator may permit
				the owner or operator of a facility described in paragraph (1) to combine and
				submit the report required under this subsection with any report required to be
				submitted by the owner or operator under subtitle C of the Solid Waste Disposal
				Act (42 U.S.C. 6921 et seq.).</text>
							</paragraph></subsection><subsection id="ID0cf9d52323b14ab5ad33377c20212f5b"><enum>(d)</enum><header>Inventory</header>
							<paragraph id="id030C7E9D5C2A465E9C3DAEBB50BF72C4"><enum>(1)</enum><header>In
				general</header><text>For each chlor-alkali facility that ceases operations on
				or after July 1, 2008, not later than 1 year after the date of cessation of
				operations, the Administrator, in consultation with the State in which the
				facility is located, shall conduct a comprehensive mercury inventory covering
				the life and closure of the chlor-alkali facility, taking into the
				account—</text>
								<subparagraph id="id5DAA30AEC0714046A369452912F002A3"><enum>(A)</enum><text>the total
				quantity of mercury purchased to start and operate the chlor-alkali
				facility;</text>
								</subparagraph><subparagraph id="id3112B9611D124EAB8FBA8A4193BF912E"><enum>(B)</enum><text>the total
				quantity of mercury remaining in mercury cells and other equipment at the time
				of closure of the chlor-alkali facility;</text>
								</subparagraph><subparagraph id="id014509C74B4C41108B31A2C4178F7E6B"><enum>(C)</enum><text>the estimated
				quantity of mercury in hazardous waste, nonhazardous solid waste, and products
				generated at the chlor-alkali facility during the operational life of the
				chlor-alkali facility; and</text>
								</subparagraph><subparagraph id="idF44515E15ACA4B93BB3798500B7445DD"><enum>(D)</enum><text>the estimated
				aggregate mercury releases from the chlor-alkali facility into air and other
				environmental media.</text>
								</subparagraph></paragraph><paragraph id="id4A848DACD6EE4D70B1C68266648BEB89"><enum>(2)</enum><header>Records and
				information</header><text>In carrying out paragraph (1), the Administrator
				shall obtain mercury purchase records and such other information from each
				chlor-alkali facility as are necessary to determine, as accurately as
				practicable from available information, the magnitude and nature of mercury
				releases from the chlor-alkali facility into air and other environmental
				media.</text>
							</paragraph></subsection><subsection id="ID75dec4b9b98b43dfbd7626f71d87e5db"><enum>(e)</enum><header>Transfer to
				storage</header>
							<paragraph id="idCFC2EAF954B44DCAB58E2B94CEFDC8B6"><enum>(1)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than July 1, 2008, the
				Administrator shall promulgate regulations establishing the terms and
				conditions necessary to facilitate the transfer and storage of mercury located
				at closed or closing chlor-alkali facilities, including the allocation of costs
				and potential liabilities of that transfer and storage.</text>
							</paragraph><paragraph id="id6234F54F582C4BC98A2014C9FB4A2B44"><enum>(2)</enum><header>Deadline for
				transfer</header><text display-inline="yes-display-inline">Beginning on July 1,
				2008, elemental mercury located at a closed or closing chlor-alkali facility
				that has ceased operations shall be transferred to a storage facility
				established by the Administrator in accordance with the regulations promulgated
				under paragraph (1).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8440aa3d2b7b45febf0a37dada745b12"><enum>(f)</enum><header>Health
				assessment</header><text>Not later than July 1, 2009, for each chlor-alkali
				facility that continues to operate as of July 1, 2008, the Administrator, in
				coordination with the Administrator of the Agency for Toxic Substances and
				Disease Registry, shall conduct a health assessment of employees at the
				chlor-alkali facility.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idF2414E6516D84505A6448A674C760109"><enum>(g)</enum><header>Regulations</header><text>In
				addition to regulations described in subsection (e)(1), the Administrator may
				promulgate such regulations, including the establishment of a reporting form
				for use in accordance with subparagraph (c), as are necessary to carry out this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idC927508AB36F4A2F931B371A0B03814E"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents of the Toxic Substances Control
			 Act (15 U.S.C. 2601 note) is amended by inserting after the item relating to
			 section 6 the following:</text>
