		<section id="idF37925C8A9C54E8B8710E0EAC058A10A" section-type="section-one"><enum>1.</enum><header>Short title; authority;
			 findings</header>
			<subsection id="idDD9D8F04ADEC40029563282FFA10247A"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Unprivileged Combatant Act of
			 2006</short-title></quote>.</text>
			</subsection><subsection id="idBA9E06E8A18141159124B7124EC513CB"><enum>(b)</enum><header>Authority</header><text>The
			 requirements, conditions, and restrictions established by this Act are made
			 under the authority of Congress under clauses 1, 10, 11, 12, 13, 14, and 18 of
			 article I, section 8 of the Constitution of the United States.</text>
			</subsection><subsection id="id92F0E3459CDA4649B35CF891EF60CB24"><enum>(c)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
				<paragraph id="IDcbfeb5d108bf492d8b4e788a6b3477e8"><enum>(1)</enum><text>Article I,
			 section 8, of the Constitution provides that the Congress has the power to
			 <quote>constitute Tribunals inferior to the Supreme Court; … define and punish
			 … Offenses against the Law of Nations; … make Rules concerning Captures on Land
			 and Water; … make all Laws which shall be necessary and proper for carrying
			 into Execution the foregoing Powers and all other Powers vested by this
			 Constitution in the Government of the United States, or in any Department or
			 Officer thereof</quote>.</text>
				</paragraph><paragraph id="ID92e11f557e3b43f3924814161dd9f715"><enum>(2)</enum><text>The Supreme Court
			 has repeatedly recognized military tribunals, as stated in Madsen v. Kinsella
			 343 U.S. 341, 1952, <quote>[s]ince our nation’s earliest days, such tribunals
			 have been constitutionally recognized agencies for meeting many urgent
			 governmental responsibilities related to war....They have taken many forms and
			 borne many names. Neither their procedure nor their jurisdiction has been
			 prescribed by statute. It has been adapted in each instance to the need that
			 called it forth.</quote> Madsen, citing In re Yamashita, 327 U.S. 1
			 (1946).</text>
				</paragraph><paragraph id="ID74f60e5b3d5c4099a9db7fd76c2da5e1"><enum>(3)</enum><text>The President has
			 inherent authority to convene military tribunals arising from his role as
			 Commander and Chief of the Armed Forces under article II of the Constitution
			 and from title 10 of the United States Code. Due to the extraordinary
			 circumstances of the ongoing war on terrorism, it is appropriate for Congress
			 to provide additional and explicit authorization of and procedures for military
			 tribunals to adjudicate and punish offenses relating to the war on
			 terrorism.</text>
				</paragraph><paragraph id="ID3d1f76742b7743e2a7213ea08fe68b72"><enum>(4)</enum><text>This Act is in
			 direct response to the United State Supreme Court’s ruling in Rasul v. Bush.
			 With the passage of this Act, the 109th Congress will have addressed the
			 concerns of the Supreme Court’s Rasul majority, and therefore alien enemy
			 combatants detained or prosecuted under this Act may not challenge their
			 detentions in the Federal courts of the United States via the habeas or any
			 other statute.</text>
				</paragraph></subsection></section><section id="id3359DC471461466FB260DB7B57672638"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act, the following
			 definitions apply:</text>
			<paragraph id="id69EBDCAA3C4D43A6B6F5323D46BD2232"><enum>(1)</enum><header>Classification
			 tribunal</header><text>The term <term>classification tribunal</term> means any
			 tribunal conducted under section 9 or any related proceeding.</text>
			</paragraph><paragraph id="id99C16493241543ACA6C22930BD124BF4"><enum>(2)</enum><header>Classification
			 tribunal board</header><text>The term <term>classification tribunal
			 board</term> means a board established pursuant to section 9(d).</text>
			</paragraph><paragraph id="idE26CD4D372264006BD6FABF1D71F37D0"><enum>(3)</enum><header>Classified
			 information</header><text>The term <term>classified information</term> has the
			 meaning given that term in section 1(a) of the Classified Information
			 Procedures Act (18 U.S.C. App.).</text>
			</paragraph><paragraph id="id4D2BB17028474D6E894402736296A822"><enum>(4)</enum><header>Commission</header><text>The
			 term <term>commission</term> means a military commission established pursuant
			 to section 3.</text>
			</paragraph><paragraph commented="no" id="idBAB0ABE87DB84B3EB41BBFC5E8BE13AF"><enum>(5)</enum><header>Criminal
			 prosecution</header><text>The term <term>criminal prosecution</term> means a
			 prosecution for a violation of any criminal law, including subchapter X of
			 chapter 47 of title 10, United States Code (the Uniform Code of Military
			 Justice) or pursuant to the Department of Defenses Military Commission
			 Instruction number two.</text>
			</paragraph><paragraph commented="no" id="id93CB53BD388F42F2B59F9D886A37D4F7"><enum>(6)</enum><header>Detainee</header><text>The
			 term <term>detainee</term> means a person who is in the custody of the
			 Department of Defense at Guantanamo Bay, Cuba, and who has not been charged
			 with a criminal offense during that period.</text>
			</paragraph><paragraph id="idD659A949720349CE87D7876A35746C08"><enum>(7)</enum><header>International
			 terrorism</header><text>The term <term>international terrorism</term> has the
			 meaning given that term in section 101 of the Foreign Intelligence Surveillance
			 Act of 1978 (50 U.S.C. 1801).</text>
			</paragraph><paragraph id="id8116A42D1EA54B3FBB0709CC715853E6"><enum>(8)</enum><header>Judge</header><text>The
			 term <term>judge</term> means a United States military judge designated by the
			 Secretary of Defense to hear cases under this Act.</text>
			</paragraph><paragraph id="idFB22C9F9B2AC48C9BD0D5EB976CF79C6"><enum>(9)</enum><header>Protected
			 information</header><text>The term <term>protected information</term> means
			 information—</text>
				<subparagraph id="IDc920b8a16f9e40edbb5cbc3285828d63"><enum>(A)</enum><text>that is
			 classified information;</text>
				</subparagraph><subparagraph id="IDd2b5dff83ce147849e4ecd1920d2ea55"><enum>(B)</enum><text>protected by law
			 or rule from unauthorized disclosure;</text>
				</subparagraph><subparagraph id="ID8f9e998b61bf425db953d0574e0d4921"><enum>(C)</enum><text>the disclosure of
			 which may endanger the physical safety of participants in Commission
			 proceedings, including prospective witnesses;</text>
				</subparagraph><subparagraph id="ID9abbdc0c2ac547f6a7f358a81c251b9c"><enum>(D)</enum><text>concerning
			 intelligence and law enforcement sources, methods, or activities; or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID58908390c39548698a614a0f8c229ec3"><enum>(E)</enum><text>the disclosure of
			 which would otherwise jeopardize national security interests.</text>
				</subparagraph></paragraph><paragraph id="idD25538260E5248BD9EA699ADE4855008"><enum>(10)</enum><header>United States
			 person</header><text>The term <term>United States person</term> has the meaning
			 given that term in section 101 of the Foreign Intelligence Surveillance Act of
			 1978 (50 U.S.C. 1801).</text>
			</paragraph><paragraph id="idC5137F39FBBA4B5BADF30F6FF088C710"><enum>(11)</enum><header>Unprivileged
			 combatant</header><text>The term <term>unprivileged combatant</term> means an
			 individual—</text>
				<subparagraph id="idBFD4177C271E48BC8A404A667379B667"><enum>(A)</enum><text display-inline="yes-display-inline">who has been designated as an enemy
			 combatant by a Combatant Status Review Tribunal prior to the enactment of this
			 Act; or</text>
				</subparagraph><subparagraph id="idBF9195604A50488AAE84BD4541164148"><enum>(B)</enum><text display-inline="yes-display-inline">who a Field Tribunal conducted by the
			 United States military as provided in this Act determines—</text>
					<clause id="id593C260F8A6C405B8FF7D95D9A8ED1BF"><enum>(i)</enum><text display-inline="yes-display-inline">is not entitled to the protections set out
			 in the Convention Relative to the Treatment of Prisoners of War, done at
			 Geneva, August 12, 1948 (6 UST 3516) (referred to in this Act as the
			 <quote>Geneva Convention</quote>); and</text>
					</clause><clause id="id4F2976ED736F4681939215F7A1F3D8BA"><enum>(ii)</enum><text>has—</text>
						<subclause id="ID089d7da1b3dd49fd8e5c4b9f09b528e4"><enum>(I)</enum><text>knowingly
			 assisted, conspired with, or solicited for a group or an individual hostile to
			 the United States;</text>
						</subclause><subclause id="ID1ba8573822ec4c80ba21552825f8f55b"><enum>(II)</enum><text>knowingly
			 attempted to assist others in taking up arms against the United States;</text>
						</subclause><subclause id="id27006D1F9E3F4BC69B66548987F1501C"><enum>(III)</enum><text>conspired with
			 or solicited others to take up arms against the United States; or</text>
						</subclause><subclause id="ID6ea03594f4ca4826b4166b927112b95b"><enum>(IV)</enum><text>has taken up
			 arms against, or intentionally assisted combat operations against, the United
			 States.</text>
						</subclause></clause></subparagraph></paragraph><paragraph id="id69DAF6F8865E46C2B4A5F3097C7F6A9F"><enum>(12)</enum><header>Appropriate
			 committees of Congress</header><text>The term <term>appropriate committees of
			 Congress</term> means the Committee on the Judiciary and the Committee on Armed
			 Services of the Senate and the Committee on the Judiciary and the Committee on
			 Armed Services of the House of Representatives.</text>
			</paragraph></section><section id="idE17538E4596E41A2AE6740B315852493"><enum>3.</enum><header>Authorizing
			 military commissions</header><text display-inline="no-display-inline">The
			 President is authorized to establish military commissions for the trial of
			 individuals for offenses as provided in this Act.</text>
		</section><section id="idC0E08F70B5F34C4A9E0CDEAD775E1E3D"><enum>4.</enum><header>Jurisdiction</header>
			<subsection id="id33D53AA406DC47CDBC8A3EA122D9FBF0"><enum>(a)</enum><header>Unprivileged
			 combatants</header><text>This Act establishes exclusive jurisdiction to hear
			 any matter involving an unprivileged combatant who has been detained by the
			 Department of Defense for not less than 180 consecutive days at Guantanamo Bay,
			 Cuba.</text>
			</subsection><subsection id="id8BECE532C8B54A058A25DD233484F7D5"><enum>(b)</enum><header>Offenses</header>
				<paragraph id="id7A4202AB1A1744648AA3ACF02EFDFC07"><enum>(1)</enum><header>Criminal
			 prosecutions</header><text>A commission shall have jurisdiction to hear any
			 criminal prosecution involving international terrorism, including any offense
			 under chapter 113B of title 18, United States Code.</text>
				</paragraph><paragraph id="IDe0df396136674912a08a8dbf9d97c9a9"><enum>(2)</enum><header>Offenses
			 against the laws of war</header><text>A commission shall have exclusive
			 jurisdiction over violations of the laws of war committed by unprivileged
			 combatants.</text>
				</paragraph><paragraph id="ID79df96a6fade477f93519a22e645cbfb"><enum>(3)</enum><header>Other
			 offenses</header><text>A commission shall have jurisdiction over other offenses
			 traditionally triable by military commissions or pursuant to the Department of
			 Defense's Military Commission Instruction Number Two.</text>
				</paragraph></subsection></section><section id="id777A7018B464428B885E066FA1E37730"><enum>5.</enum><header>Appellate
			 jurisdiction</header>
			<subsection id="id004C90B5BB1645E0B49E13125BEDC4AE"><enum>(a)</enum><header>Final
			 decisions</header><text>The United States Court of Military Appeals shall have
			 exclusive jurisdiction of appeals from all final decisions of a classification
			 tribunal board or commission under this Act.</text>
			</subsection><subsection id="idAEFAF2CDD0094FEDBDA498829BA7789D"><enum>(b)</enum><header>Review by
			 Supreme Court</header>
				<paragraph id="ID397c40cf416545f5b335eb72c9455c26"><enum>(1)</enum><header>Certiorari</header><text>The
			 decisions of the United States Court of Military Appeals are subject to review
			 by the Supreme Court by writ of certiorari.</text>
				</paragraph><paragraph id="ID7074f41d8de04f8a8c0956d60df98937"><enum>(2)</enum><header>Exemption from
			 certain petition requirements</header><text>A person who files a petition for a
			 writ of certiorari under paragraph (1) shall not be required to submit—</text>
					<subparagraph id="idB90B40085ECC4019A5DDBB3C35FE0E8C"><enum>(A)</enum><text>prepayment of any
			 fees and costs or security therefor; or</text>
					</subparagraph><subparagraph id="id7DCFAECCAB6446BCB59FB1B3FA8D0334"><enum>(B)</enum><text>the affidavit
			 required by section 1915(a) of title 28, United States Code.</text>
					</subparagraph></paragraph></subsection><subsection id="id1E9B3101496341D8AF5F8F97F4ED7A29"><enum>(c)</enum><header>Conforming
			 amendments</header>
				<paragraph id="idBA478D9B31644F2AB25F61F8ADB3C0B6"><enum>(1)</enum><header>In
			 general</header><text>Section 1005 of the Detainee Treatment Act of 2005 (10
			 U.S.C. 801 note) is amended—</text>
					<subparagraph id="id0F1BD78F0CF247E6B1D38B743120D945"><enum>(A)</enum><text>in subsection
			 (e), by striking paragraphs (2) through (4); and</text>
					</subparagraph><subparagraph id="idBFFAB97E51B244AE9A1754E7988395CD"><enum>(B)</enum><text>by striking
			 subsection (h) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id49EE332A02E043AC905F6F9766C891DE" style="OLC">
							<subsection id="id31E021BEE77D4BE891B36F61E1FE091A"><enum>(h)</enum><header>Effective
				date</header><text>This section shall take effect on the date of enactment of
				this
				Act.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="idDC60D47F9EDF4E748124B85F3B8A9A43"><enum>(2)</enum><header>Habeas</header><text>Section
			 2241(e) of title 28, United States Code, is amended—</text>
					<subparagraph id="id5DB707FCC37D45CAA2E481881733B3BA"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>section 1005 of the Detainee
			 Treatment Act of 2005</quote> and inserting <quote>the Unprivileged Combatant
			 Act of 2006</quote>;</text>
					</subparagraph><subparagraph id="id63D8B538E35D4E6799DD0A28A828E877"><enum>(B)</enum><text>by striking
			 paragraph (2)(B) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="idED3A3C6D72AC4041ABA61135C0D2F7C1" style="OLC">
							<subparagraph id="id6BD8876C474848B3AAC0D5093B55FDB5"><enum>(B)</enum><text>has been
				determined by a classification tribunal to meet the requirements of paragraph
				(1) or (2) of section 9(a) of the Unprivileged Combatant Act of
				2006.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection></section><section id="id541C4F5D6D2640EAAAAD53083E18A1EF"><enum>6.</enum><header>Commission</header>
			<subsection id="id41D756AFC75142AF8C96C63C29114A37"><enum>(a)</enum><header>Commission
			 personnel</header>
				<paragraph id="id77079A788C1E4C058990B7E4D3F879D8"><enum>(1)</enum><header>Members</header>
					<subparagraph id="IDde36bfcbd4974c198ddf3fdcb585da52"><enum>(A)</enum><header>Appointment</header><text>The
			 Secretary of Defense shall designate no less than 12 United States military
			 judges to serve as members of a commission and to assume other duties assigned
			 in this Act.</text>
					</subparagraph><subparagraph id="ID024eefba41f84180a4e5140acd6f64b3"><enum>(B)</enum><header>Number of
			 members</header><text>Each commission shall consist of at least 3 military
			 officers, at least one of whom shall be a military judge.</text>
					</subparagraph><subparagraph id="idDD5290089F804B379EE96A05C8DEE64A"><enum>(C)</enum><header>Alternate
			 members</header><text>For each such commission, there shall also be 1 or 2
			 alternate members. The alternate member or members shall attend all sessions of
			 the commission. In case of incapacity, resignation, or removal of any member,
			 an alternate member shall take the place of that member.</text>
					</subparagraph><subparagraph id="ID8c2fa3d4bf41449d98efd68ebefaedd3"><enum>(D)</enum><header>Qualifications</header><text>Each
			 member and alternate member of the commission shall be a military
			 officer.</text>
					</subparagraph><subparagraph id="ID96e54becab88447e86fcb274abbf0ecc"><enum>(E)</enum><header>Presiding
			 officer</header>
						<clause id="id205EFBEAD7264EC4B6BB967D6424AD1E"><enum>(i)</enum><header>In
			 general</header><text>From among the members of the commission, the Secretary
			 of Defense shall designate a presiding officer who is a military judge to
			 preside over the proceedings of that commission.</text>
						</clause><clause id="idDC5145D32AFC41C0B3AB9A9AC636F452"><enum>(ii)</enum><header>Duties</header><text>The
			 duties of the presiding officer shall be as follows:</text>
							<subclause id="id91750533811A471E9C1262490FC6C6DB"><enum>(I)</enum><text>The presiding
			 officer shall admit or exclude evidence at trial in accordance with the rules
			 of this Act. The presiding officer shall have authority to close proceedings or
			 portions of proceedings in accordance with this Act or for any other reason
			 necessary for the conduct of a full and fair trial.</text>
							</subclause><subclause id="id729EE6CDF1A7447BBA463CAE242F3337"><enum>(II)</enum><text>The presiding
			 officer shall ensure that the discipline, dignity, and decorum of the
			 proceedings are maintained, shall exercise control over the proceedings to
			 ensure proper implementation of the President's Military Order and this Act,
			 and shall have authority to act upon any contempt or breach of commission rules
			 and procedures. Any attorney authorized to appear before a commission who is
			 thereafter found not to satisfy the requirements for eligibility or who fails
			 to comply with laws, rules, regulations, or other orders applicable to the
			 commission proceedings or any other individual who violates such laws, rules,
			 regulations, or orders may be disciplined as the presiding officer deems
			 appropriate, including revocation of eligibility to appear before that
			 commission. The Court may further revoke that attorney's or any other person's
			 eligibility to appear before any other commission convened under this
			 Act.</text>
							</subclause><subclause id="idC1E076453D22432DAC757CBD28B27028"><enum>(III)</enum><text>The presiding
			 officer shall ensure the expeditious conduct of the trial. In no circumstance
			 shall accommodation of counsel be allowed to delay proceedings
			 unreasonably.</text>
							</subclause><subclause id="id79CCAB3D32394042AB0227E80BED1F60"><enum>(IV)</enum><text>The presiding
			 officer may certify interlocutory questions to the Military Commission Review
			 Panel for the Armed Forces as the presiding officer deems appropriate.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection id="idDD1972F2F2634E3DB883B1E614570758"><enum>(b)</enum><header>Powers of a
			 commission</header><text>A commission shall have the following powers:</text>
				<paragraph id="id3F3EC4F1ECAB4BD09C2FEBF7715FA455"><enum>(1)</enum><text>To summon
			 witnesses to the trial and to require their attendance and testimony and to put
			 questions to them.</text>
				</paragraph><paragraph id="ID247727d698b94a76938db80bc5439ac1"><enum>(2)</enum><text>To require the
			 production of documents and other evidentiary material.</text>
				</paragraph><paragraph id="ID6a506ce198594616a43980cc14aeb61f"><enum>(3)</enum><text>To administer
			 oaths to witnesses.</text>
				</paragraph><paragraph id="ID638f297e4a6f4357b9048d23607aba3f"><enum>(4)</enum><text>To appoint
			 officers for the carrying out of any task designated by the commission,
			 including the power to have evidence taken.</text>
				</paragraph></subsection></section><section id="id14D52E7D94174F409EF9D4624F4236D2"><enum>7.</enum><header>Persons in
			 custody</header>
			<subsection id="idF505F41AF32B4BC19E5267B0D046D2BD"><enum>(a)</enum><header>In
			 general</header><text>Not later than 60 days after the date of enactment of
			 this Act, the Secretary of Defense shall develop—</text>
				<paragraph id="id8E4243E8993441FFBE4EF100F23F97BF"><enum>(1)</enum><text>a complete
			 listing of all persons who—</text>
					<subparagraph id="id9DADCA0AAB714821888DEA61BC45AB39"><enum>(A)</enum><text>are being
			 detained by the Department of Defense at Guantanamo Bay, Cuba; and</text>
					</subparagraph><subparagraph id="id113A788FC6854B3DA7B53B4BDA10ADF0"><enum>(B)</enum><text>the Government
			 wishes to continue to detain as an unprivileged combatant; and</text>
					</subparagraph></paragraph><paragraph id="idF07864186D354C9BAA04A59E8CF51FE8"><enum>(2)</enum><text>a detailed
			 summary of the evidence upon which the determination to keep a person described
			 in paragraph (1) in custody was made.</text>
				</paragraph></subsection><subsection id="idF508E26DE5474339B1B63905CE04209E"><enum>(b)</enum><header>Congressional
			 oversight</header><text>Not later than 10 days after developing the list
			 described in subsection (a), the Secretary of Defense shall submit an
			 unclassified version of that list to the appropriate committees of Congress. A
			 classified, unredacted version of that list shall also be submitted to the
			 appropriate committees of Congress for review.</text>
			</subsection><subsection id="id50E2C0FDACAC4E1C9B03DF5938060271"><enum>(c)</enum><header>Updated
			 list</header>
				<paragraph id="id9035391DAD444569A9F8556BCDD82CC7"><enum>(1)</enum><header>In
			 general</header><text>Not less than once every 60 days after the date the list
			 described in subsection (a) is completed, the Secretary of Defense shall update
			 the list of the persons described in subsection (a) and submit to the
			 appropriate committees of Congress a detailed report for each person on such
			 list that includes—</text>
					<subparagraph id="ID12ccac3d7afe4b6a90ba2863a5d01c9c"><enum>(A)</enum><text>the name and
			 nationality of each such person; and</text>
					</subparagraph><subparagraph id="ID97b3aa2cd6e345f79d04b9e230e688dc"><enum>(B)</enum><text>with respect to
			 each such person—</text>
						<clause id="ID7caf241afada4bc8807c09ca77c9ecc3"><enum>(i)</enum><text>a
			 detailed statement of why such person has not been charged, repatriated, or
			 released;</text>
						</clause><clause id="ID506e308d41724bb7b7e8477ac6a28c6a"><enum>(ii)</enum><text>a
			 statement of when the United States intends to charge, repatriate, or release
			 such person;</text>
						</clause><clause id="ID4042433ea9914dcb95454c025624d320"><enum>(iii)</enum><text>a
			 description of the procedures to be employed by the United States to determine
			 whether to charge, repatriate, or release such person and a schedule for the
			 employment of such procedures; and</text>
						</clause><clause id="ID6f595bf5204e4d9697625031224795b7"><enum>(iv)</enum><text>if
			 the Secretary of Defense has transferred or has plans to transfer such person
			 from the custody of the Secretary to another agency or department of the United
			 States, a description of such transfer.</text>
						</clause></subparagraph></paragraph><paragraph id="ID82be67379dd24ff2aa828f9626790d74"><enum>(2)</enum><header>Form of
			 reports</header><text>Each report required by this subsection shall be
			 submitted in an unclassified form, to the maximum extent practicable, and may
			 include a classified annex, if necessary.</text>
				</paragraph><paragraph id="ID6a138b03947140b492b0c4db9eadc484"><enum>(3)</enum><header>Appropriate
			 committees of congress defined</header><text>In this subsection, the term
			 <term>appropriate committees of Congress</term> means—</text>
					<subparagraph id="IDabb3d4920e3d4fdbacba5bb8c32310ad"><enum>(A)</enum><text>the Committee on
			 Armed Services, the Committee on the Judiciary, and the Select Committee on
			 Intelligence of the Senate; and</text>
					</subparagraph><subparagraph id="ID35ede617536649408807a0ead2b08154"><enum>(B)</enum><text>the Committee on
			 Armed Services, the Committee on the Judiciary, and the Permanent Select
			 Committee on Intelligence of the House of Representatives.</text>
					</subparagraph></paragraph></subsection><subsection id="id4B0315B474AE4C49B64535C00381676E"><enum>(d)</enum><header>Congressional
			 oversight</header><text>Not later than 10 days after updating the list of
			 persons under subsection (c), the Secretary of Defense shall submit that
			 updated list to the appropriate committees of Congress in both unclassified and
			 unredacted, classified form.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id57F5D0F163514C9A9D00E9260455791E"><enum>8.</enum><header>Field
			 tribunals</header>
			<subsection commented="no" display-inline="no-display-inline" id="id4183A81A997D41609A7409A5A52BA248"><enum>(a)</enum><header>In
			 general</header><text>Not more than 30 days after a suspected unprivileged
			 combatant has been detained by United States forces, the Department of Defense
			 shall conduct a field tribunal in order to determine whether the detainee is an
			 unprivileged combatant and whether the detainee is entitled to the rights
			 afforded under the Geneva Convention.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idEA02D15A4A8A4F73A18E60530047EC91"><enum>(b)</enum><header>Procedures</header><text>The
			 procedures governing a field tribunal shall be promulgated by the Department of
			 Defense</text>
			</subsection></section><section id="idB0FC6B3411A342B1B46CA7F7AF47F4CC"><enum>9.</enum><header>Classification
			 tribunals</header>
			<subsection id="id69A3646D757E48A8AC3D75999E35EB70"><enum>(a)</enum><header>In
			 general</header><text>A detainee shall be released and repatriated to an
			 appropriate country unless a classification tribunal board finds by a
			 preponderance of the evidence that—</text>
				<paragraph id="ID2ee83cd9491b407fb9e68903689ab040"><enum>(1)</enum><text>the detainee is a
			 threat to the national security interest of the United States; or</text>
				</paragraph><paragraph id="IDfc099e86d0d9482d9f85d796a922aff6"><enum>(2)</enum><text>there are
			 reasonable grounds to believe that if released the detainee would take up arms
			 against the United States.</text>
				</paragraph></subsection><subsection id="idF5604277D5B04F068443F1CF79C7B691"><enum>(b)</enum><header>Compliance with
			 Geneva Conventions</header><text>If a detainee is found to be a privileged
			 combatant entitled to provisions under the Convention Relative to the Treatment
			 of Prisoners of War, done at Geneva, August 12, 1948 (6 UST 3516), then the
			 detainee must be treated in accordance with that convention.</text>
			</subsection><subsection id="id3ECC8F825F834287A115A60FD988BFA1"><enum>(c)</enum><header>Citizen of the
			 United States</header><text>If a detainee is found to be a citizen of the
			 United States of America, the detainee shall not be held or tried under this
			 Act.</text>
			</subsection><subsection id="id18C4092A55BA414CA55EA5149E28AFFB"><enum>(d)</enum><header>Classification
			 tribunal board</header><text>A classification tribunal shall be conducted by a
			 board appointed by the Secretary of Defense and consist solely of line
			 officers, one of whom shall be an attorney.</text>
			</subsection><subsection id="idDB970C52DBD24ADF870A8699C7A2F6AC"><enum>(e)</enum><header>Determination</header>
				<paragraph id="id5C4DF76361AC4409BF607CD85F0B1A42"><enum>(1)</enum><header>In
			 general</header><text>If a classification tribunal board finds that a detainee
			 meets the requirements of subsection (a), the classification tribunal board
			 shall order that the detainee shall continue to be detained by the Department
			 of Defense, subject to periodic review under subsection (h).</text>
				</paragraph><paragraph id="id16800C5A9D3C41ED98888CF9FFCBB52D"><enum>(2)</enum><header>Time
			 period</header><text>The time period for the detention of a detainee under
			 paragraph (1) may not exceed the time period that United States forces are
			 engaged in combat operations as defined by the Department of Defense in the
			 nation or theater where the detainee was captured so long as the detainee is
			 found to be a privileged combatant.</text>
				</paragraph><paragraph id="id1ED90F5C79254F05A8D3F6B5F1ADF42A"><enum>(3)</enum><header>Conclusion of
			 combat</header><text>At the conclusion of combat operations within a given
			 theater or nation—</text>
					<subparagraph id="idA613E5C538BB4A5D8E7C47B9319D7778"><enum>(A)</enum><text>a privileged
			 combatant that was captured in that area shall be either indicted under this
			 Act or repatriated to the appropriate country; and</text>
					</subparagraph><subparagraph id="id51F8878AA88E4676BE51EC25C5503B1C"><enum>(B)</enum><text>an unprivileged
			 combatant may continue to be detained pursuant to subsection (a).</text>
					</subparagraph></paragraph></subsection><subsection id="IDbe2bed2902124c608ee8103e6bd2ff07"><enum>(f)</enum><header>Considerations</header>
				<paragraph id="id6587BD1DE1694920A119977B49A8DCCF"><enum>(1)</enum><header>In
			 general</header><text>In making a determination under subsection (a), a
			 classification tribunal board shall consider any information brought to its
			 attention regarding the need for continued detention, including—</text>
					<subparagraph id="id64DCCEBE358D441A82DA87C8ACABBBA2"><enum>(A)</enum><text>the detainee’s
			 alleged position or rank in any hostile organization;</text>
					</subparagraph><subparagraph id="id1979AF4E442B4057A4D228A4BA2B1393"><enum>(B)</enum><text>the activities of
			 that hostile organization;</text>
					</subparagraph><subparagraph id="id3FB5706BD56649D78662A6432E3535A8"><enum>(C)</enum><text>any statements
			 made by the detainee in response to interrogation; and</text>
					</subparagraph><subparagraph id="id36C7059624F74812B0455FAFAC377271"><enum>(D)</enum><text>the detainee’s
			 history of violence or terrorist activity.</text>
					</subparagraph></paragraph><paragraph id="id541CA145F8A849C3B738A97EC8299797"><enum>(2)</enum><header>Prima facie
			 evidence</header><text>If the Government represents that a detainee was
			 captured during a military engagement while taking up arms against, or
			 supporting military operations against, the Armed Forces of the United States
			 or its allies, there shall be prima facie evidence that, if released, the
			 detainee would take up arms against the United States.</text>
				</paragraph></subsection><subsection id="id99A700181F3C456BB8C07C2100978B42"><enum>(g)</enum><header>Timing</header><text>A
			 detainee shall be afforded a classification tribunal as soon as is reasonably
			 practicable but not later than 180 days after the detainee's capture and not
			 later than 30 days after the detainee is listed under section 7, unless
			 continued.</text>
			</subsection><subsection id="ID3d22d09af1b04ec39f47901b750787f0"><enum>(h)</enum><header>Periodic
			 review</header>
				<paragraph id="id481FE462B27A40B297AA09CB5CD89B9D"><enum>(1)</enum><header>In
			 general</header>
					<subparagraph id="id9A2296F2818343C7ABFAD1457748B6A4"><enum>(A)</enum><header>Semiannual
			 review</header><text>The classification tribunal shall conduct a classification
			 hearing for each detainee not less frequently than every 180 days, in
			 accordance with the procedures established under this section and section
			 10.</text>
					</subparagraph><subparagraph id="id84894EB815A349A79D0BE250F0D3DEB6"><enum>(B)</enum><header>Action
			 period</header><text>A detainee apprehended during a military engagement while
			 taking up arms against, or supporting military operations against, the Armed
			 Forces of the United States or its allies may be detained until the cessation
			 of armed hostilities in the nation or region in which they were
			 captured.</text>
					</subparagraph></paragraph><paragraph id="idF891E14861C34D0CAF34B1922BFB2EA2"><enum>(2)</enum><header>Argument</header><text>The
			 Government and the detainee may be heard regarding the review under paragraph
			 (1).</text>
				</paragraph></subsection></section><section id="id41DC21B2821A4A138ECA2E055C556C59"><enum>10.</enum><header>Classification
			 tribunal procedures</header>
			<subsection id="id6BFB7BE60E524F8B8E4F9FE4436DCAFF"><enum>(a)</enum><header>Detainees</header>
				<paragraph id="id64CDDEE9942442D6AC243B591BBF0B83"><enum>(1)</enum><header>In
			 general</header><text>A detainee shall not be required to testify or present
			 any evidence at a classification tribunal.</text>
				</paragraph><paragraph id="idEA21A9C680714A44868FCC64190D8077"><enum>(2)</enum><header>Presence</header><text>A
			 detainee shall be entitled to be present at the classification tribunal, unless
			 the head of the tribunal has decided to admit classified information.</text>
				</paragraph></subsection><subsection id="idF895D49489B548459BB8306FC076456D"><enum>(b)</enum><header>Counsel</header>
				<paragraph id="idBCA26E5964CB44ECA6A33089E6AF5DF8"><enum>(1)</enum><header>In
			 general</header><text>A detainee is entitled to the assistance of counsel
			 admitted to practice under this Act at every stage of the classification
			 tribunal, including the periodic review of orders under subsection (e).</text>
				</paragraph><paragraph id="id428BFE1FF1A24B60B0B5107229E4F663"><enum>(2)</enum><header>Right to
			 appointed counsel</header><text>A detainee who is unable to obtain counsel is
			 entitled to have counsel admitted to practice before a commission under this
			 Act.</text>
				</paragraph><paragraph id="idBA593F38465F4CCB8D60D488DC2D8C63"><enum>(3)</enum><header>Refusal of
			 counsel</header><text>A detainee may waive counsel but shall not be entitled to
			 protected information.</text>
				</paragraph></subsection><subsection id="idB81796E800CB41C199B43BB30945F538"><enum>(c)</enum><header>Discovery</header>
				<paragraph id="ID8608bd68e18e48878c8dd55ad9cd2d97"><enum>(1)</enum><header>Government's
			 disclosure</header><text>Not later than 3 days prior to the classification
			 tribunal, the Government shall make available for inspection by counsel for the
			 detainee any affidavit or affirmation the Government intends to offer in
			 support of continuing to detain the detainee. A classification tribunal board
			 shall maintain a copy of any submissions made by the Government for inspection
			 by the detainee and for transmittal, if necessary, to that tribunal.</text>
				</paragraph><paragraph id="ID4049de5ecf214152873c730355732458"><enum>(2)</enum><header>Detainee's
			 disclosure</header><text>If the detainee chooses to submit any evidence, such
			 evidence, including a list of any witnesses the detainee intends to call, shall
			 be made available to the Government for inspection not later than 3 days prior
			 to the classification tribunal.</text>
				</paragraph></subsection><subsection id="id39519C2592EF464EB1E0C1AEA0FDAC15"><enum>(d)</enum><header>Evidence</header>
				<paragraph id="idBE3638DCF9D04D9F8856D34B78B31BD6"><enum>(1)</enum><header>In
			 general</header><text>The Federal Rules of Evidence shall not apply to a
			 classification tribunal.</text>
				</paragraph><paragraph id="id5814D8F417174D1ABD7FB094D9C2FCAA"><enum>(2)</enum><header>Admissibility
			 standard</header><text>Evidence shall be admitted if the classification
			 tribunal board determines the evidence would have probative value to a
			 reasonable person.</text>
				</paragraph><paragraph id="id7B64B43798FA4F21B9BABEC9E9FA2255"><enum>(3)</enum><header>Affidavit or
			 affirmation</header><text>The Government may proceed by proffer and submit any
			 relevant information by affidavit or affirmation, unless decided unreliable by
			 the members of the classification tribunal board.</text>
				</paragraph><paragraph id="idA9352EA4B39E4561AE5A80F0B89084AF"><enum>(4)</enum><header>Cross-examination</header>
					<subparagraph id="id2C1A928516A04BBA9DD815A8C591846E"><enum>(A)</enum><header>Government
			 witnesses</header><text>If a Government chooses to call witnesses, the detainee
			 may cross-examine those witnesses on all relevant facts.</text>
					</subparagraph><subparagraph id="idFE1DB5D0D86B426F91F7BB9E9A240C22"><enum>(B)</enum><header>Detainee
			 witnesses</header><text>If a detainee calls any witnesses, they shall be
			 subject to cross examination.</text>
					</subparagraph><subparagraph id="id750D6C7048574C5CB722094B03247A0B"><enum>(C)</enum><header>Detainee</header><text>If
			 the detainee chooses to testify, the detainee shall be subject to
			 cross-examination.</text>
					</subparagraph></paragraph></subsection><subsection id="id898EAB2488ED4A6C8B6668F538A83B8F"><enum>(e)</enum><header>Defenses</header><text>A
			 detainee may challenge whether the detainee satisfies the elements required
			 under subsection (a).</text>
			</subsection><subsection id="IDb41402c1b4fb4a88b9de929cd97a941c"><enum>(f)</enum><header>Proceedings</header>
				<paragraph id="id4A57F96F56384D16B67B1245B38CAFD6"><enum>(1)</enum><header>In
			 general</header><text>A classification tribunal shall be closed to the
			 public.</text>
				</paragraph><paragraph id="IDa3464a165bcd43e7a9843021a15eff49"><enum>(2)</enum><header>Security
			 clearances</header><text>Each person present at a classification tribunal,
			 other than the detainee, shall possess a security clearance appropriate to the
			 level of any classified information being presented.</text>
				</paragraph><paragraph id="idF7C4102B87C14CE5B4E2ECD19254F243"><enum>(3)</enum><header>Public
			 information regarding proceedings</header><text>After the classification
			 tribunal board rules in the classification tribunal, the parties shall propose
			 a nonclassified summary to that board. The board shall publicly release a
			 summary, containing any information generated at the tribunal which can be
			 disclosed in a manner consistent with the Classified Information Procedures Act
			 (18 U.S.C. App.) and the national security of the United States.</text>
				</paragraph></subsection><subsection id="ID90e8d351d4a647658ff2d5920473d862"><enum>(g)</enum><header>Reinstituting
			 classification proceedings</header>
				<paragraph id="id13B066C9BBDA48CC95FB6E9C6F596B05"><enum>(1)</enum><header>In
			 general</header><text>If a matter involving the classification tribunal of a
			 detainee is dismissed without prejudice by the classification tribunal or
			 withdrawn by the Government at, or prior to, the classification tribunal, the
			 Government may reinstitute the matter with the tribunal board that dismissed or
			 permitted the withdrawal of the matter.</text>
				</paragraph><paragraph id="idBBE17C69483D417EB36D6139C6D4E9DA"><enum>(2)</enum><header>Time
			 limit</header><text>A complaint reinstituting proceedings under paragraph (1)
			 shall be filed not later than 10 days after the dismissal or withdrawal of the
			 matter.</text>
				</paragraph><paragraph id="idC165AF6310624DF48176E2A771504DFC"><enum>(3)</enum><header>Number</header><text>The
			 Government may reinstitute proceedings under paragraph (1) not more than twice
			 and only if approved by the ranking member on the classification tribunal
			 board.</text>
				</paragraph></subsection></section><section id="idBA6AEB67370B48548D0C56AAE30C894B"><enum>11.</enum><header>Continuance of
			 classification tribunals</header>
			<subsection id="ID0ee830d963fd45e8b678c39787b7dc9c"><enum>(a)</enum><header>Continuances</header>
				<paragraph id="id9B9BD8529BFC4F36A229B791DD6E2257"><enum>(1)</enum><header>In
			 general</header><text>A classification tribunal board may, for cause shown,
			 grant a continuance of a classification tribunal.</text>
				</paragraph><paragraph id="id1B9D3C73E1E34ED18B5E09A002345BD1"><enum>(2)</enum><header>Continuance</header>
					<subparagraph id="id5B2ECDDF11BE4E2EA0D02C75FE70545B"><enum>(A)</enum><header>In
			 general</header><text>Upon motion of the Government, the classification
			 tribunal board may grant a continuance for as long as necessary, but no longer
			 than a 6-month period, under paragraph (1) if the classification tribunal board
			 determines that the detainee is a high level individual in the planning or
			 financing of terrorist activities or the individual possess information vital
			 to the safety of the United States or its citizens.</text>
					</subparagraph><subparagraph id="id45585AED6D814F63829DBA2EFD76742A"><enum>(B)</enum><header>Subsequent
			 continuances</header><text>The Government may obtain subsequent continuances
			 for additional 6-month periods so long as the classification tribunal board
			 finds such continuances are necessary to the informational gathering purposes
			 as it related to the national security of the United States.</text>
					</subparagraph></paragraph><paragraph id="id12D8D7E67C6F410797FE2E243FC20AA6"><enum>(3)</enum><header>Ex parte
			 applications</header>
					<subparagraph id="idDC70C74E8FFB4818B5D1B60FBD5CB7A5"><enum>(A)</enum><header>In
			 general</header><text>The Government may move for a continuance under paragraph
			 (1) ex parte.</text>
					</subparagraph><subparagraph id="idBAA642A2AFA6488895A78BADCE07A97E"><enum>(B)</enum><header>Detainee
			 rights</header><text>A detainee—</text>
						<clause id="id7EF05225C7E54CF69C5258355F4DBAE3"><enum>(i)</enum><text>is
			 not entitled to representation by counsel in connection with any such ex parte
			 motion; and</text>
						</clause><clause id="id55CCB5EAB2404B05B40E23D773D01AF9"><enum>(ii)</enum><text>shall not be
			 given notice of the request for a hearing prior to the ruling of the
			 classification tribunal board on the Government's request for a continuance
			 pursuant to paragraph (2).</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id11591B21B2B8490BBFF374DA061BE47E"><enum>(b)</enum><header>Grant of
			 continuance</header><text>For each continuance granted under subsection (a),
			 the classification tribunal board shall note on the record of the
			 proceedings—</text>
				<paragraph id="id17A3DF164820444D87AA458E438BE1E7"><enum>(1)</enum><text>the grounds for
			 granting each such continuance;</text>
				</paragraph><paragraph id="ID8680c619e65e4919a3480d5e0ccd8a96"><enum>(2)</enum><text>the identity of
			 the party requesting the continuance;</text>
				</paragraph><paragraph id="ID072f929ad98849699f48567e80fab773"><enum>(3)</enum><text>the new date and
			 time for the tribunal hearing; and</text>
				</paragraph><paragraph id="idC4E46E80903F438792EDECEBA80B4BD5"><enum>(4)</enum><text>the reasons that
			 the date under paragraph (3) was chosen.</text>
				</paragraph></subsection></section><section id="id0497917CFE454E4793AD690BFE90522A"><enum>12.</enum><header>Criminal
			 prosecution procedures generally</header>
			<subsection id="idAD90C017018444B2BCDF8A346C60F2C2"><enum>(a)</enum><header>Counsel</header>
				<paragraph id="idFF40BFE8013F485988F9069C73BB2012"><enum>(1)</enum><header>In
			 general</header><text>A defendant in a criminal proceeding under this Act has a
			 right to be represented by counsel admitted to practice before a commission
			 under this Act.</text>
				</paragraph><paragraph id="ID6b81b25c77374ff49cd12ca16a4d3ce9"><enum>(2)</enum><header>Appointed
			 counsel</header>
					<subparagraph id="idCAB90EE096C4409F8DF06969D80351E2"><enum>(A)</enum><header>In
			 general</header><text>A defendant who is unable to obtain counsel is entitled
			 to have counsel appointed and to be represented by such counsel at every stage
			 of the proceeding subsequent to being indicted.</text>
					</subparagraph><subparagraph id="IDe03ad588c98c48b686ff955728f3a539"><enum>(B)</enum><header>Appointment
			 procedure</header><text>The Secretary of Defense shall determine the rules for
			 appointing counsel to practice before the commission.</text>
					</subparagraph></paragraph></subsection><subsection id="id829DFF3EFA674437ABFB4DDBE89A9BD4"><enum>(b)</enum><header>Discovery</header>
				<paragraph id="ID20b61aaa01c3438c926fd8c955bce52c"><enum>(1)</enum><header>Classified
			 documents and objects</header><text>The Government shall provide the defense
			 with access to evidence the Government intends to introduce at trial and with
			 access to evidence known to the Government or which should be known to the
			 Government that tends to exculpate the accused. Information disclosed to the
			 defense may not be disclosed to the defendant if it is classified as defined by
			 this Act. The defense may submit classified information for review under
			 section 12(b)(2).</text>
				</paragraph><paragraph commented="no" id="id2B0F7198255E48FEAADA0175C79EE76E"><enum>(2)</enum><header>Separate
			 commission concerning classified information</header><text>The Secretary of
			 Defense shall appoint a commission to conduct a thorough review of the
			 classification system for national security information, including the policy,
			 procedures, and practices of the system. The Secretary of Defense shall
			 determine what level of security clearance is necessary to conduct the review
			 under this paragraph. No person shall be appointed as a member of the
			 commission who does not have a security clearance at or above the level of
			 clearance so designated by the Secretary. The commission shall make
			 recommendations to the Secretary of Defense as to the declassification of
			 information relevant to the trial of detainees.</text>
				</paragraph><paragraph id="idF921DE67C8614FCB8987EDEFCBCB4345"><enum>(3)</enum><header>Regulating
			 discovery</header>
					<subparagraph id="id059FA8CA83034AFEBD0920050905F807"><enum>(A)</enum><header>In
			 general</header><text>A commission may, for good cause, deny, restrict, or
			 defer discovery or inspection, or grant other appropriate relief.</text>
					</subparagraph><subparagraph id="idA89AF606EE434DCAA505178580C1B345"><enum>(B)</enum><header>Ex parte
			 request</header><text>A party may make an ex parte request in writing that a
			 commission deny, restrict, or defer discovery or inspection under subparagraph
			 (A). If the a commission grants a request under this subparagraph, the
			 Commission shall preserve the entire text of the party's request under
			 seal.</text>
					</subparagraph><subparagraph id="idCB2316F95F9E4F3FADDF649191C93A24"><enum>(C)</enum><header>Failure to
			 comply</header><text>If a party fails to comply with the rules of discovery
			 applicable to a commission, the commission may—</text>
						<clause id="ID025ec8ed5d5a4d90896b6a144764c299"><enum>(i)</enum><text>order that party
			 to permit the discovery or inspection, specify its time, place, and manner, and
			 prescribe other just terms and conditions; or</text>
						</clause><clause id="IDdc2c752801c14b17b67203ef2110be63"><enum>(ii)</enum><text>grant a
			 continuance.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idA51C5B7E385A44BC8A7B04CAA8871736"><enum>(c)</enum><header>Open
			 proceedings</header>
				<paragraph id="idEAB89DBD56E04F589332090586640494"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraphs (2) and (3), a
			 proceeding before a commission shall be open to the public.</text>
				</paragraph><paragraph id="id85BB1A5075F74EF4AD071C3F4FB6D7B3"><enum>(2)</enum><header>Classified
			 information</header>
					<subparagraph id="id36BA336C462C471EB4B025B138894DC6"><enum>(A)</enum><header>In
			 general</header><text>Upon motion by the Government, a proceeding before a
			 commission shall be closed to the public if necessary to avoid disclosure of
			 classified information.</text>
					</subparagraph><subparagraph id="id494725D30B1D4BDB8BD450F98D08E7DD"><enum>(B)</enum><header>Nondisclosure</header><text>A
			 priority under subparagraph (A) shall not disclose any information presented
			 during a closed session to individuals excluded from such proceeding or part
			 thereof including the defendant.</text>
					</subparagraph></paragraph><paragraph id="idECA47C2250814839A81F0805BE0CDAFD"><enum>(3)</enum><header>Other
			 bases</header><text>A commission may order that a hearing be held, in whole or
			 in part, in camera, if the commission determines—</text>
					<subparagraph id="id47392C0477BE48FB8E49BCB25B877A5E"><enum>(A)</enum><text>it is appropriate
			 for the security of a witness or a Government employee or to protect public
			 safety; or</text>
					</subparagraph><subparagraph id="id641499DBC7404B8FA7AF4D94326717C9"><enum>(B)</enum><text>that an open
			 hearing would deter a witness from testifying freely or prevent the witness
			 from testifying at all.</text>
					</subparagraph></paragraph><paragraph id="idACEFF4539963457C98EE6EC6DCB0AABC"><enum>(4)</enum><header>Extrajudicial
			 statements</header><text>At the discretion of a commission, the commission may
			 issue an order limiting extrajudicial statements by the parties.</text>
				</paragraph></subsection><subsection id="ID030626247e5f423ab632662e9facdd88"><enum>(d)</enum><header>Protected
			 information</header>
				<paragraph id="ID0a1a2ea6b0ae4595a03e62efe1531761"><enum>(1)</enum><header>In
			 general</header><text>A commission may issue protective orders as necessary to
			 safeguard protected information in a proceeding before that commission.</text>
				</paragraph><paragraph id="idFEE650317A6A4C1FB9BFCE9C90287EDF"><enum>(2)</enum><header>Notification</header><text>As
			 soon as practicable, a party shall notify a commission of any intent to offer
			 evidence including protected information .</text>
				</paragraph><paragraph id="ID2799c3c4da364a0996e7f5857fa517b1"><enum>(3)</enum><header>Trial
			 record</header>
					<subparagraph id="idD6759C2836254B53B06297F0FF9189EC"><enum>(A)</enum><header>In
			 general</header><text>All exhibits admitted as evidence but containing
			 protected information shall be sealed and annexed to the record of
			 trial.</text>
					</subparagraph><subparagraph id="idF0577A332FEC4CC09B24B4E9314C1C45"><enum>(B)</enum><header>Protected
			 information not admitted</header><text>Any protected information not admitted
			 as evidence, but reviewed by a commission in camera and withheld from the
			 defendant's counsel over objection shall be sealed and annexed to the record of
			 the trial, with any associated motions and responses and any materials
			 submitted in support thereof, as additional exhibits.</text>
					</subparagraph></paragraph></subsection><subsection id="idA1A61C03248348DABD3D3FD0E5D94873"><enum>(e)</enum><header>Record of
			 trial</header>
				<paragraph id="IDa0d2e110bdf041e8af643eff62d50a7f"><enum>(1)</enum><header>Requirement for
			 record</header><text>A record of each proceeding by a commission shall be
			 prepared promptly after the conclusion of the trial.</text>
				</paragraph><paragraph id="ID8f3397ff27464e299df517af0d104527"><enum>(2)</enum><header>Verbatim
			 transcript</header><text>The record of trial shall include a verbatim written
			 transcript of all sessions of the trial.</text>
				</paragraph><paragraph id="IDc0323ef6fbd94483891f958061a92bb9"><enum>(3)</enum><header>Exhibits and
			 other evidence</header><text>The record of trial shall also include all
			 exhibits and other real or demonstrative evidence, except that photographs may
			 be substituted for any large written or graphic exhibits and any other real or
			 demonstrative evidence. If a photograph is substituted for an exhibit or other
			 evidence, the Government shall retain the original exhibit or other evidence,
			 respectively, until no further appeal of the results of the trial is
			 authorized.</text>
				</paragraph><paragraph id="ID2139dd638e7f44059c67b98c56a47d44"><enum>(4)</enum><header>Classified
			 information</header><text>In the case of a conviction of a charge on which
			 classified information is admitted as evidence by a commission, the copy of the
			 record of trial submitted to the commission shall include the classified
			 information.</text>
				</paragraph></subsection></section><section id="idB7E6127677AF466097BF5B398F91EA58"><enum>13.</enum><header>Trial
			 procedures for unprivileged combatants</header>
			<subsection id="id99585AF60186426A98597CBC16D888B9"><enum>(a)</enum><header>Specialized
			 procedures</header>
				<paragraph id="id1C65F48FFB7F40FFB543BF7BA1C119EC"><enum>(1)</enum><header>Standard of
			 proof</header><text>All 3 members of a commission shall agree that the
			 defendant is guilty beyond a reasonable doubt for a defendant to be found
			 guilty.</text>
				</paragraph><paragraph commented="no" id="id6B3AEA53A5504633901CDE2961E05042"><enum>(2)</enum><header>Rules of
			 procedure</header>
					<subparagraph commented="no" id="id6FBB22F8CE5F4A3AA0F06C950AC10629"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), the Secretary of
			 Defense shall draft supplementary rules to govern all proceedings under this
			 section.</text>
					</subparagraph><subparagraph commented="no" id="id9364C50B39BF4656A1C8F851F91C9B1F"><enum>(B)</enum><header>Standard</header><text>Evidence
			 is admissible if the Secretary of Defense determines that the evidence would
			 have probative value to a reasonable person.</text>
					</subparagraph></paragraph><paragraph id="IDbd64115ca50348b3a54e633ace71c269"><enum>(3)</enum><header>Form of
			 trial</header><text>Any trial under this subsection shall take place before 2
			 military officers or attorneys and at least one military judge.</text>
				</paragraph><paragraph commented="no" id="idBF15FECC81C145D7AB2A8825D3BBAD00"><enum>(4)</enum><header>Bad
			 acts</header><text>Other bad acts may be considered if they would have fallen
			 within the definition under this Act of either terrorism or terrorist activity
			 and they are deemed to be relevant by a commission including propensity.</text>
				</paragraph></subsection><subsection id="id3156739E3C504BE58CBBCD8A5FC8B18A"><enum>(b)</enum><header>Custody</header><text display-inline="yes-display-inline">The Department of Defense shall retain
			 custody of any person determined by a commission to be unprivileged combatants
			 after the person has been either convicted or sentenced in accordance with this
			 Act, unless the Department of Defense deems otherwise. Decisions made by a
			 commission in regards to a detainee's guilt or innocence may be considered by a
			 tribunal when assessing the need to continue the detention of a
			 detainee.</text>
			</subsection></section><section id="id18D4276FDE354918B210F8EE8B31DF98"><enum>14.</enum><header>Communication
			 with persons in custody</header><text display-inline="no-display-inline">An
			 individual detained, indicted, or convicted under this Act shall only be
			 permitted to communicate with the interpreter assigned to the individual, the
			 counsel representing the individual, prison personnel, and any other individual
			 approved by the Secretary of Defense.</text>
		</section><section id="idDFF674A739A943DA87ED15D813352203"><enum>15.</enum><header>Commission
			 counsel</header>
			<subsection id="idF8C6C36E9524476DABFC41B0F72169A1"><enum>(a)</enum><header>In
			 general</header><text>A person shall be admitted to practice before a
			 commission if the person—</text>
				<paragraph id="idA61FABB37F074811B14ACE74AF80554F"><enum>(1)</enum><text>is a United
			 States citizen;</text>
				</paragraph><paragraph id="id471FB1A6D7904CA9B39699B63680811B"><enum>(2)</enum><text>has been admitted
			 to the practice of law in a State, district, territory, or possession of the
			 United States, or before a Federal court;</text>
				</paragraph><paragraph id="id9CF3D258CD474D7C963610CC3D925782"><enum>(3)</enum><text>has not been
			 sanctioned or otherwise the subject of disciplinary action by any court, bar,
			 or other competent governmental authority for misconduct;</text>
				</paragraph><paragraph id="idB012B51D717C46E08B517D1DAB0991AB"><enum>(4)</enum><text>is eligible for
			 access to information classified at the level of secret as defined by the
			 Department of Defense; and</text>
				</paragraph><paragraph id="idE041DB3E254C415CABD2AABDE4366639"><enum>(5)</enum><text>signs a written
			 agreement to comply with all applicable regulations or instructions for
			 counsel, including any rules of court for conduct during the course of
			 proceedings.</text>
				</paragraph></subsection><subsection id="ID795f0edaafff48629fd0aa1ce08576c5"><enum>(b)</enum><header>Consultation
			 with colleagues</header><text>Any person admitted under subsection (a) shall
			 not confer with any colleague who does not have the appropriate
			 clearance.</text>
			</subsection><subsection id="ID916741fc927347468a2530378bfbde39"><enum>(c)</enum><header>Security
			 Clearance</header>
				<paragraph id="ID4fc622062042482085c38c876b4f6da4"><enum>(1)</enum><header>Expedited
			 Consideration</header><text>The Secretary of Defense shall ensure that a person
			 seeking to be admitted under subsection (a) is timely processed for the
			 security clearance required for access to materials necessary for providing a
			 defendant with effective assistance of counsel.</text>
				</paragraph><paragraph id="ID0bbb0f5bf09a48f0b032919c94b89f07"><enum>(2)</enum><header>Counsel
			 Ineligible for Clearance</header><text>If the Secretary of Defense determines a
			 person is not eligible for the necessary security clearance, the person shall
			 not be permitted to represent an individual in any proceeding before the
			 Commission. The determination of the Secretary of Defense shall be final and is
			 not subject to appeal to, or other review by, any court of the United
			 States.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDece783b38a9446078363903898c13768"><enum>(d)</enum><header>Travel
			 Expenses</header><text>The Secretary of Defense shall reimburse any person not
			 employed by the Government who is representing an individual before the
			 Commission for travel away from the home or regular place of business of the
			 person in connection with such representation. The rates for the payment of
			 travel expenses under this subsection shall be those authorized for employees
			 of agencies under subchapter I of chapter 57 of title 5, United States
			 Code.</text>
