			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Save Our Safety Net Act of
			 2005</short-title></quote>.</text>

			</subsection></section><section id="ID0a04a4a38a514f72b09428bb40bee719"><enum>2.</enum><header>Ensuring
			 adequate physician payment for emergency department visits</header><text display-inline="no-display-inline">Section 1833 of the Social Security Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C.
			 1395</external-xref>l) is amended by adding at the end the following new
			 subsection:</text>
			<quoted-block display-inline="no-display-inline" id="id735A2D864549407BAE4528C3B43C74D8" style="OLC">
				<subsection id="id0B3ADA8EFA3A4F71B482A72C43644EE0"><enum>(v)</enum><header>Save our safety
				net payments for physicians’ services provided in an emergency
				department</header><text display-inline="yes-display-inline">In the case of
				physicians’ services furnished to an individual covered under the insurance
				program established by this part in an emergency department on or after January
				1, 2006, in addition to the amount of payment that would otherwise be made for
				such services under this part, there also shall be paid to the physician or
				other person (or to an employer or entity in the cases described in clause (A)
				of section 1842(b)(6)) from the Federal Supplementary Insurance Trust Fund an
				amount equal to 10 percent of the payment amount for the service under this
				part.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id9F05E5A5B7914D0B87580A19E8B671FE"><enum>3.</enum><header>Ensuring
			 adequate hospital outpatient fee schedule amounts for clinic and emergency
			 department visits</header>
			<subsection id="ID9B634162D4E04587A58046DD7E8D4282"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="act" parsable-cite="SSA/1833(t)">Section 1833(t)</external-xref> of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref>l(t))
			 is amended—</text>
				<paragraph id="IDA690D16963D5422E8FCD29F551C6C900"><enum>(1)</enum><text>in paragraph
			 (3)(C)(ii), by striking <quote>paragraph (8)(B)</quote> and inserting
			 <quote>paragraphs (8)(B), (11)(B), and (13)(A)(i)</quote>;</text>
				</paragraph><paragraph id="ID8F1CAD1876FB4732ABF0385618787E00"><enum>(2)</enum><text>in paragraph
			 (3)(C)(iii), by inserting <quote>(but not the conversion factor computed under
			 paragraph (13)(B))</quote> after <quote>this subparagraph</quote>;</text>
				</paragraph><paragraph id="IDDC0F14ACBA394494A446E07C008FBA68"><enum>(3)</enum><text>in paragraph
			 (3)(D)—</text>
					<subparagraph id="ID8CC2565B4DF84DC7B9BF4979A2BF4CDA"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>conversion factor computed under subparagraph (C) for the
			 year</quote> and inserting <quote>applicable conversion factor computed under
			 subparagraph (C), paragraph (11)(B), or paragraph (13)(B) for the year</quote>;
			 and</text>
					</subparagraph><subparagraph id="IDA1C5E38C293F4C6A86195F4CA3F01E88"><enum>(B)</enum><text>in clause (ii),
			 by inserting <quote>, paragraph (9)(A), or paragraph (13)(C)</quote> after
			 <quote>paragraph (2)(C)</quote>;</text>
					</subparagraph></paragraph><paragraph id="ID9577FDCDB31642149D09CECD5100DCF1"><enum>(4)</enum><text>in paragraph (9),
			 by amending subparagraph (B) to read as follows:</text>

						<subparagraph id="IDFD07325F87D94918A7F2DC9CCFD3D79E"><enum>(B)</enum><header>Budget
				neutrality adjustment</header>
							<clause id="ID93F908E5BDE24153898752A7E5848E5D"><enum>(i)</enum><header>In
				general</header><text>If the Secretary makes revisions under subparagraph (A),
				then the revisions for a year may not cause the estimated amount of
				expenditures under this part for the year to increase or decrease from the
				estimated amount of expenditures under this part (including expenditures
				attributable to the special rules specified in paragraph (13)) that would have
				been made if the revisions had not been made.</text>
							</clause><clause id="ID6C65F8C85E914F5ABBA99D8BB616CF1F"><enum>(ii)</enum><header>Exemption from
				reduction</header><text>The relative payment weights determined under paragraph
				(13)(C) and the conversion factor computed under paragraph (13)(B) shall not be
				reduced by any budget neutrality adjustment made pursuant to this
				subparagraph.</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID856D7ED6D3694C76A5007780E719B2AF"><enum>(5)</enum><text>by redesignating
			 paragraphs (13) through (16) as paragraphs (14) through (17), respectively, and
			 by inserting after paragraph (12) the following new paragraph:</text>

						<paragraph id="IDB2207321E9C3491F9EF014B8E9433400"><enum>(13)</enum><header>Special rules
				for calculating medicare OPD fee schedule amount for clinic and emergency
				visits</header>
							<subparagraph id="IDE1862E7CCD034BFF95BF503883D1DCBF"><enum>(A)</enum><header>In
				general</header><text>In computing the medicare OPD fee schedule amount under
				paragraph (3)(D) for covered OPD services that are furnished on or after
				January 1, 2006, and classified within a group established or revised under
				paragraph (2)(B) or (9)(A), respectively, for clinic and emergency visits (as
				described in subparagraph (D)), the Secretary shall—</text>
								<clause id="IDB4D0B010F205464FBBF2EB8B953D59BD"><enum>(i)</enum><text>substitute for
				the conversion factor calculated under paragraph (3)(C) the conversion factor
				calculated under subparagraph (B); and</text>
								</clause><clause id="IDE9022098B9F0457CB72F01714932FC3C"><enum>(ii)</enum><text>substitute for
				the relative payment weight established or revised under paragraph (2)(C) or
				(9)(A), respectively, the relative payment weight determined under subparagraph
				(C) for such group.</text>
								</clause></subparagraph><subparagraph id="IDF9762F0C20DA4BE9B0A32EDDAF574E12"><enum>(B)</enum><header>Calculation of
				conversion factor</header><text>For purposes of subparagraph (A)(i), the
				conversion factor calculated under this subparagraph is—</text>
								<clause id="IDBC997EFBA429406CBF1B89A50092B194"><enum>(i)</enum><text>for services
				furnished during 2006, an amount equal to the product of—</text>
									<subclause id="ID81b11a27e05648f3a15f288cfdf7d71f"><enum>(I)</enum><text>the conversion
				factor specified for such year in the final rule published on November 10,
				2005, increased by the percentage by which such conversion factor is reduced
				for such year pursuant to paragraph (2)(E), and not taking into account any
				subsequent amendments to such final rule; and</text>
									</subclause><subclause id="ID1ad12a1e1cab4fb6bd165726d80f324b"><enum>(II)</enum><text>1.10; and</text>
									</subclause></clause><clause id="IDA0D790A3E5E44B40B8832FEBD2729668"><enum>(ii)</enum><text>for services
				furnished in a year beginning on or after January 1, 2007, the conversion
				factor computed under this subparagraph for the previous year increased by the
				OPD fee schedule increase factor specified under paragraph (3)(C)(iv) for the
				year involved.</text>
								</clause></subparagraph><subparagraph commented="no" id="IDE6B7A3D1692E4566976C594EC1BC4486"><enum>(C)</enum><header>Determination
				of relative payment weights</header><text>For purposes of subparagraph (A)(ii),
				the relative payment weight determined under this subparagraph for a covered
				OPD service that is classified within such a group is—</text>
								<clause commented="no" id="IDCA23A288DE284E7782BD4D9643B68F12"><enum>(i)</enum><text>for services
				furnished during 2006, the relative payment weight specified for such group for
				such period in the final rule published November 10, 2005, and not taking into
				account any subsequent amendments to such final rule; and</text>
								</clause><clause commented="no" id="ID819BF4DAB9D84FBD994433F6EA822936"><enum>(ii)</enum><text>for services
				furnished in a year beginning on or after January 1, 2007—</text>
									<subclause commented="no" id="ID6F7CD152397C40228D7914003D3D7EF1"><enum>(I)</enum><text>for ambulatory
				patient classification group 0601 (relating to mid-level clinic visits), or a
				successor to such group, the relative payment weight specified for such group
				in the final rule referred to in clause (i); and</text>
									</subclause><subclause commented="no" id="ID56B221A0D43E4D96A7C3E4F0ADE37F55"><enum>(II)</enum><text>for other
				ambulatory patient classification groups described in subparagraph (D), the
				relative payment weight established or revised under paragraph (2)(C) or
				(9)(A), respectively, for such group for such year (but without regard to any
				budget neutrality adjustment under paragraph (9)(B)).</text>
									</subclause></clause></subparagraph><subparagraph commented="no" id="IDF1181A21C94849D281B77642C3B167F0"><enum>(D)</enum><header>Groups for
				clinic and emergency visits</header><text>For purposes of this paragraph, the
				groups established or revised under paragraph (2)(B) or (9)(A), respectively,
				for clinic and emergency visits are ambulatory patient classification groups
				0600, 0601, 0602, 0610, 0611, 0612, and 0620 as defined for purposes of the
				final rule referred to in subparagraph (C)(i) (and any successors to such
				groups).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="ID1A38933641AE4C6186949F562DF5E1ED"><enum>(b)</enum><header>Limitation on
			 secretarial authority</header><text>Notwithstanding
			 <external-xref legal-doc="act" parsable-cite="SSA/1833(t)">section
			 1833(t)</external-xref> of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42
			 U.S.C. 1395</external-xref>l(t)), as amended by subsection (a), the Secretary
			 of Health and Human Services may not make any adjustment under—</text>
				<paragraph commented="no" id="IDABE1E24FD578486200622796DFA4B7CC"><enum>(1)</enum><text>paragraph (2)(F),
			 (3)(C)(iii), (9)(B), or (9)(C) of
			 <external-xref legal-doc="act" parsable-cite="SSA/1833(t)">section
			 1833(t)</external-xref> of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42
			 U.S.C. 1395</external-xref>l(t)); or</text>
				</paragraph><paragraph commented="no" id="IDA52EE62B658C423EA06506ED5FB7EC00"><enum>(2)</enum><text>any other
			 provision of such section;</text>
				</paragraph><continuation-text commented="no" continuation-text-level="subsection">to ensure that the amendments made
			 by subsection (a) do not cause the estimated amount of expenditures under part
			 B of title XVIII of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395j">42 U.S.C. 1395j</external-xref> et seq.) to exceed
			 the estimated amount of expenditures that would have been made under such part
			 but for such amendments.</continuation-text></subsection></section><section id="id5D77429C14404BB5AB45C3DFDDC156A0"><enum>4.</enum><header>Permanent
			 extension of adjustment to limit decline in payments for certain hospitals
			 under hospital outpatient PPS</header>
			<subsection id="id027C981425BB4CB4B8F735F486F54DE8"><enum>(a)</enum><header>In
			 general</header><text>Section 1833(t)(7)(D)(i) of the Social Security Act (42
			 U.S.C. 1395l(t)(7)(D)(i)), as amended by section 5105 of the Deficit Reduction
			 Act of 2005 (Public Law 109–171), is amended—</text>
				<paragraph id="idEA17C67972B64E3D9B24E69206E5210E"><enum>(1)</enum><text>in the clause
			 heading—</text>
					<subparagraph id="idB968975D63084757AE5D60DC1B1E53F6"><enum>(A)</enum><text>by striking
			 <quote><header-in-text level="clause" style="traditional">Temporary</header-in-text></quote> and inserting
			 <quote><header-in-text level="clause" style="traditional">Permanent</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="id18678FA0BF1B41359C1C172759843668"><enum>(B)</enum><text>by striking
			 <quote><header-in-text level="clause" style="traditional">Rural</header-in-text></quote></text>
					</subparagraph></paragraph><paragraph id="id0473E29ADCA942C3857D6DCF9CD3FC37"><enum>(2)</enum><text>by striking
			 subclause (II);</text>
				</paragraph><paragraph id="id39A8D8ABA2F54E00B6663E8E491898FD"><enum>(3)</enum><text>by striking
			 <quote>(I) In the case</quote> and inserting <quote>In the case</quote>;</text>
				</paragraph><paragraph id="id7C974CCDBB13459593ABD4924841BE88"><enum>(4)</enum><text>by striking
			 <quote>located in a rural area, for</quote> and inserting <quote>, for</quote>;
			 and</text>
				</paragraph><paragraph id="id2D106ECE57134D4B948B500FBA48FB2E"><enum>(5)</enum><text>by striking
			 <quote>furnished before January 1, 2006</quote>.</text>
				</paragraph></subsection><subsection id="id4324845C243D4DD9A6026FFA0E70DFE9"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to covered
			 OPD services furnished on or after January 1, 2006.</text>
			</subsection></section><section id="idFC345806B12B455C8D1A562996D04538"><enum>5.</enum><header>Fairness in the
			 Medicare disproportionate share hospital (DSH) adjustment for rural
			 hospitals</header><text display-inline="no-display-inline">Section
			 1886(d)(5)(F)(xiv)(II) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1395ww(d)(5)(F)(xiv)(II)) is amended—</text>
			<paragraph id="idB4AC5F89220E40A49A0A1B71058740F5"><enum>(1)</enum><text>by striking
			 <quote>or, in the case</quote> and all that follows through <quote>subparagraph
			 (G)(iv)</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA83B4AD3BF6D409CA17516F9526EC10D"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting at the end the following new
			 sentence: <quote>The preceding sentence shall not apply to any hospital with
			 respect to discharges occurring on or after October 1, 2006.</quote>.</text>
