2.In this Act:
(1)The
term Administrator means the Administrator of General
Services.
(2)The
term Committee means the Green Building Advisory Committee
established under section 103(a).
(3)The
term Director means the individual appointed to the position
established under section 101(a).
(4)
(A)The term Federal facility means any building
or facility the intended use of which requires the building or facility to
be—
(i)accessible to the
public; and
(ii)constructed or
altered by or on behalf of the United States.
(B)The
term Federal facility does not include a privately-owned
residential or commercial structure that is not leased by the Federal
Government.
(5)High-Performance
green buildingThe term high-performance green
building means a building that, during its life-cycle—
(A)reduces energy,
water, and material resource use;
(B)improves indoor
environmental quality including, reducing indoor pollution, improving thermal
comfort, and improving lighting and acoustic environments that affect occupant
health and productivity;
(C)reduces negative
impacts on the environment throughout the life-cycle of the building, including
air and water pollution and waste generation;
(D)increases the use
of environmentally preferable products, including biobased, recycled content,
and nontoxic products with lower life-cycle impacts;
(E)increases reuse
and recycling opportunities;
(F)integrates systems
in the building;
(G)reduces the
environmental and energy impacts of transportation through building location
and site design that support a full range of transportation choices for users
of the building; and
(H)considers indoor
and outdoor effects of the building on human health and the environment,
including—
(i)improvements in
worker productivity;
(ii)the life-cycle
impacts of building materials and operations; and
(iii)other factors
that the Office considers to be appropriate.
(6)The
term life-cycle, with respect to a high-performance green
building, means all stages of the useful life of the building (including
components, equipment, systems, and controls of the building) beginning at
conception of a green building project and continuing through site selection,
design, construction, landscaping, commissioning, operation, maintenance,
renovation, deconstruction or demolition, removal, and recycling of the green
building.
(7)The term life-cycle assessment means a
comprehensive system approach for measuring the environmental performance of a
product or service over the life of the product or service, beginning at raw
materials acquisition and continuing through manufacturing, transportation,
installation, use, reuse, and end-of-life waste management.
(8)The term life-cycle costing, with respect to
a high-performance green building, means a technique of economic evaluation
that—
(A)sums, over a given
study period, the costs of initial investment (less resale value),
replacements, operations (including energy use), and maintenance and repair of
an investment decision; and
(B)is
expressed—
(i)in present value
terms, in the case of a study period equivalent to the longest useful life of
the building, determined by taking into consideration the typical life of such
a building in the area in which the building is to be located; or
(ii)in annual value
terms, in the case of any other study period.
(9)The
term Office means the Office of High-Performance Green Buildings
established under section 102(a).
<enum>I</enum><header>Office of
High-Performance Green Buildings</header>
<section id="ID485F22E1688A4FAD98A236A464195736"><enum>101.</enum><header>Oversight</header>
<subsection id="ID2747FB2C241040D293B3F5F33F3E047F"><enum>(a)</enum><header>In
general</header><text>The Administrator shall establish within the General
Services Administration, and appoint an individual to serve as Director in, a
position in the career-reserved Senior Executive service, to—</text>
<paragraph id="ID2DBE0DB7FD4546C097ED8614140B530B"><enum>(1)</enum><text>establish and
manage the Office in accordance with section 102; and</text>
</paragraph><paragraph id="ID4ECA8496A2F2451E897D0C896E49CA21"><enum>(2)</enum><text>carry out other
duties as required under this Act.</text>
</paragraph></subsection><subsection id="ID11A6C8E759E843678916DB10E6EB8F34"><enum>(b)</enum><header>Compensation</header><text>The
compensation of the Director shall not exceed the maximum rate of basic pay for
the Senior Executive Service under section 5382 of title 5, United States Code,
including any applicable locality-based comparability payment that may be
authorized under section 5304(h)(2)(C) of that title.</text>
</subsection></section><section id="ID53A9736CCCAD41DCB29BE7AC27922E92"><enum>102.</enum><header>Office of
High-Performance Green Buildings</header>
<subsection id="ID014490D03C864BCA93D48B7C1EB9A6AD"><enum>(a)</enum><header>Establishment</header><text>The
Director shall establish within the General Services Administration an Office
of High-Performance Green Buildings.</text>
</subsection><subsection id="ID39D10265510F4650B877DB52882333A7"><enum>(b)</enum><header>Duties</header><text>The
Director shall—</text>
<paragraph id="ID9BAC1FDE7B7142E28836047D4EEBA223"><enum>(1)</enum><text>ensure full
coordination of high-performance green building information and activities
within the General Services Administration and all relevant agencies,
including, at a minimum—</text>
<subparagraph id="id10BA725D30D34820AB77671816DD6C34"><enum>(A)</enum><text>the Environmental
Protection Agency;</text>
</subparagraph><subparagraph id="idD80C3149C39C4C36A460F9ECA0B65351"><enum>(B)</enum><text>the Office of the
Federal Environmental Executive;</text>
</subparagraph><subparagraph commented="no" id="idE0A9000C5C834453ADA4FBECB9C387CD"><enum>(C)</enum><text>the Office of
Federal Procurement Policy;</text>
</subparagraph><subparagraph id="idE8330C0F990B4F3391819816A5C490A7"><enum>(D)</enum><text>the Department of
Energy;</text>
</subparagraph><subparagraph id="id9AA77A3CDFDB4887A24DAE5DFB52565E"><enum>(E)</enum><text>the Department of
Health and Human Services;</text>
</subparagraph><subparagraph id="idC0BB054A561448BB86C332D25192082E"><enum>(F)</enum><text>the Department of
Defense; and</text>
</subparagraph><subparagraph id="id526C963CC96E4A6888046AC085064390"><enum>(G)</enum><text>such other Federal
agencies as the Director considers to be appropriate;</text>
</subparagraph></paragraph><paragraph id="ID849315EB932B4C8E8386FFC1213F941A"><enum>(2)</enum><text>establish a
senior-level Federal green building advisory committee, which shall provide
advice and recommendations in accordance with section 103;</text>
</paragraph><paragraph id="id0A5DEE2781804A6490A42685B0DC6A8D"><enum>(3)</enum><text>identify and
biennially reassess improved or higher rating standards recommended by the
Committee;</text>
</paragraph><paragraph id="ID523CB432F40647C382E297ACEE1EC41E"><enum>(4)</enum><text>establish a
national high-performance green building clearinghouse in accordance with
section 104, which shall provide green building information through—</text>
<subparagraph id="IDB0B9F14566E74D22BB19A299F57249B0"><enum>(A)</enum><text>outreach;</text>
</subparagraph><subparagraph id="ID35E1D24568444A84AADDE7D0FAC102C7"><enum>(B)</enum><text>education;
and</text>
</subparagraph><subparagraph id="ID916401666E4B4B7293B371DEC3187B82"><enum>(C)</enum><text>the provision of
technical assistance;</text>
</subparagraph></paragraph><paragraph id="IDB600B393EA654AB0B9A3FFD11AD6FC5A"><enum>(5)</enum><text>ensure full
coordination of research and development information relating to
high-performance green building initiatives under section 105;</text>
</paragraph><paragraph id="idA83FE43555FE4F10A26F747083C313B7"><enum>(6)</enum><text>identify and
develop green building standards that could be used for all types of Federal
facilities in accordance with section 105;</text>
</paragraph><paragraph id="id9A9909ECE35D486DA637771218AA24B0"><enum>(7)</enum><text>establish green
practices that can be used throughout the life of a Federal facility;</text>
</paragraph><paragraph id="ID617494485FE046F3B3D0CB9BC1C0FD27"><enum>(8)</enum><text>review and analyze
current Federal budget practices and life-cycle costing issues, and make
recommendations to Congress, in accordance with section 106; and</text>
</paragraph><paragraph id="idEF046BB5A3EC489584AABCFC0CE770A0"><enum>(9)</enum><text>complete and
submit the report described in subsection (c).</text>
</paragraph></subsection><subsection id="ID57AC75C0E6FC4E2B9888F7611DE22EE9"><enum>(c)</enum><header>Report</header><text>Not
later than 2 years after the date of enactment of this Act, and biennially
thereafter, the Director shall submit to Congress a report that—</text>
<paragraph id="IDA3E6D668078D4AA3A5A29164F4B00FF0"><enum>(1)</enum><text>describes the
status of the green building initiatives under this Act and other Federal
programs in effect as of the date of the report, including—</text>
<subparagraph id="ID1DECC1640F034CC9B84DB66B29643733"><enum>(A)</enum><text>the extent to
which the programs are being carried out in accordance with this Act;
and</text>
</subparagraph><subparagraph id="ID7BCD4EFBC3224A6E8F29DB5BC155C56B"><enum>(B)</enum><text>the status of
funding requests and appropriations for those programs;</text>
</subparagraph></paragraph><paragraph id="ID6EE397FE3F84487CB3498BDE593F576E"><enum>(2)</enum><text>identifies within
the planning, budgeting, and construction process all types of Federal facility
procedures that inhibit new and existing Federal facilities from becoming
high-performance green buildings as measured by—</text>
<subparagraph id="ID47A6F842CDD747CE98637F80CB70611D"><enum>(A)</enum><text>a silver rating,
as defined by the Leadership in Energy and Environmental Design Building Rating
System standard established by the United States Green Building Council (or an
equivalent rating); or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID530760D322BD43BF88346465B219EA02"><enum>(B)</enum><text>an improved or
higher rating standard, as identified by the Committee;</text>
</subparagraph></paragraph><paragraph id="IDF3D1AC968634443882BE632FB2F35DF7"><enum>(3)</enum><text>identifies
inconsistencies, as reported to the Committee, in Federal law with respect to
product acquisition guidelines and high-performance product guidelines;</text>
</paragraph><paragraph id="ID89BA1CC2547C42C0B412D2D60A1AE3AB"><enum>(4)</enum><text>recommends
language for uniform standards for use by Federal agencies in environmentally
responsible acquisition;</text>
</paragraph><paragraph id="idEB132E991A6C402A8E221BA1A6B15071"><enum>(5)</enum><text>in coordination
with the Office of Management and Budget, reviews the budget process for
capital programs with respect to alternatives for—</text>
<subparagraph id="idCCFA0846D0464F2289E7E7F6705C703A"><enum>(A)</enum><text>restructuring of
budgets to require the use of complete energy- and environmental-cost
accounting;</text>
</subparagraph><subparagraph id="id6DA95D64F16A4AC1B2D1815C8768624B"><enum>(B)</enum><text>using operations
expenditures in budget-related decisions while simultaneously incorporating
productivity and health measures (as those measures can be quantified by the
Office, with the assistance of universities and national laboratories);</text>
</subparagraph><subparagraph id="idC3F01277AFBB45349DC797D7170CFEFD"><enum>(C)</enum><text>permitting Federal
agencies to retain all identified savings accrued as a result of the use of
life-cycle costing for future high-performance green building initiatives;
and</text>
</subparagraph><subparagraph id="idA828289581174FCA87A910D80BDFA3E2"><enum>(D)</enum><text>identifying short-
and long-term cost savings that accrue from high-performance green buildings,
including those relating to health and productivity;</text>
</subparagraph></paragraph><paragraph id="id7A40161D5B2C4B37831FDEDBC53EA505"><enum>(6)</enum><text>identifies green,
self-sustaining technologies to address the operational needs of Federal
facilities in times of national security emergencies, natural disasters, or
other dire emergencies;</text>
</paragraph><paragraph id="id647D475BF7BE4704865C070059DEA56C"><enum>(7)</enum><text>summarizes and
highlights development, at the State and local level, of green building
initiatives, including executive orders, policies, or laws adopted promoting
green building (including the status of implementation of those initiatives);
and</text>
</paragraph><paragraph id="IDBE50E4206D5644F29BCE1AB39EA207AA"><enum>(8)</enum><text>includes, for the
2-year period covered by the report, recommendations to address each of the
matters, and a plan for implementation of each recommendation, described in
paragraphs (1) through (6).</text>
</paragraph></subsection><subsection id="ID4FD22EE901A04D49B38730997B1E1CDB"><enum>(d)</enum><header>Implementation</header><text>The
Office shall carry out each plan for implementation of recommendations under
subsection (c)(7).</text>
</subsection></section><section id="IDFF22B84361624EF5B7E5E5DB6CE16294"><enum>103.</enum><header>Green Building
Advisory Committee</header>
<subsection id="ID76D883745B8243FF87A562C04C25D284"><enum>(a)</enum><header>Establishment</header><text>Not
later than 180 days after the date of enactment of this Act, the Director shall
establish a committee to be known as the <quote>Green Building Advisory
Committee</quote>.</text>
</subsection><subsection id="ID5BAED6CCC08648649A9B0CB96888F9A2"><enum>(b)</enum><header>Membership</header><text>The
Committee shall be composed of representatives of, at a minimum—</text>
<paragraph id="ID3371DEAFD9C84A9AB718991402A0624E"><enum>(1)</enum><text>each agency
referred to in section 102(b)(1); and</text>
</paragraph><paragraph id="ID8A1FA22114904C39995A75E8A9063AC7"><enum>(2)</enum><text>other relevant
entities, as determined by the Director, including at least 1 representative of
each of the following:</text>
<subparagraph id="id34D14A95D5F14F42822A4DE81069B46C"><enum>(A)</enum><text>State and local
governmental green building programs.</text>
</subparagraph><subparagraph id="id6A71B82D919E4DBC98F7147D77E01B5A"><enum>(B)</enum><text>Independent green
building associations or councils.</text>
</subparagraph><subparagraph id="idF1CD4C7A59BA4F2B86E8F44F8E0F1D63"><enum>(C)</enum><text>Building experts,
including architects, material suppliers, and construction contractors.</text>
</subparagraph><subparagraph id="idBCFE4A53FD9E407DBDC692706FDDE08A"><enum>(D)</enum><text>Security advisors
focusing on national security needs, natural disasters, and other dire
emergency situations.</text>
</subparagraph><subparagraph id="id89485C21D9014E609C5D88731510A56C"><enum>(E)</enum><text>Children and adult
environmental health experts.</text>
</subparagraph></paragraph></subsection><subsection id="idF16FF3CD93014410850A7A3A130D8AFF"><enum>(c)</enum><header>Meetings</header><text>The
Director shall establish a regular schedule of meetings for the Committee,
which shall convene a minimum of 6 times each year.</text>
</subsection><subsection id="ID7ADAD0D6DA1C4AD886FC4BE00E160053"><enum>(d)</enum><header>Duties</header><text>The
Committee shall provide advice and expertise for use by the Director in
carrying out the duties under this Act, including such recommendations relating
to Federal activities carried out under sections 104 through 106 as are agreed
to by a majority of the members of the Committee.</text>
</subsection><subsection id="id6EBD99CA21774A439F0014760595FE94"><enum>(e)</enum><header>FACA
Exemption</header><text>The Committee shall not be subject to the Federal
Advisory Committee Act (5 U.S.C. App.).</text>
</subsection></section><section id="ID548ADB21E4F44BCFBC24AAC16933C489"><enum>104.</enum><header>Public
outreach</header><text display-inline="no-display-inline">The Director, in
coordination with the Committee, shall carry out public outreach to inform
individuals and entities of the information and services available
Government-wide by—</text>
<paragraph id="id38B8CB1CCAB849BC8A0785D2AC4EB9E2"><enum>(1)</enum><text>establishing and
maintaining a national high-performance green building clearinghouse, including
on the Internet, that—</text>
<subparagraph id="IDE030FDFF900342B1B606E91B5B19A8B7"><enum>(A)</enum><text>identifies
existing similar efforts and coordinates activities of common interest;
and</text>
</subparagraph><subparagraph id="IDED8DB79167A84AC280DF4A3BCB800BCF"><enum>(B)</enum><text>provides
information relating to high-performance green buildings, including hyperlinks
to Internet sites that describe the activities, information, and resources
of—</text>
<clause id="id4C8D19E2970D430ABD89AE2EA979C856"><enum>(i)</enum><text>the Federal
Government;</text>
</clause><clause id="ID38CD964689A74699B7A02242BB1A7E41"><enum>(ii)</enum><text>State and local
governments;</text>
</clause><clause id="ID2551ACF999B844D8BE3DF1919151E67D"><enum>(iii)</enum><text>the private
sector (including nongovernmental and nonprofit entities and organizations);
and</text>
</clause><clause id="ID732457B352C74B40877BB4CE03B3CE49"><enum>(iv)</enum><text>international
organizations;</text>
</clause></subparagraph></paragraph><paragraph id="IDD0585031847745FEB56BA37914ED8603"><enum>(2)</enum><text>identifying and
recommending educational resources for implementing high-performance green
building practices, including security and emergency benefits and
practices;</text>
</paragraph><paragraph id="IDE0647BF205374326B9BA06336790A0BC"><enum>(3)</enum><text>providing access
to technical assistance on using tools and resources to make more
cost-effective, energy-efficient, health-protective, and environmentally
beneficial decisions for constructing high-performance green buildings,
particularly tools available to conduct life-cycle costing and life-cycle
assessment;</text>
</paragraph><paragraph id="IDA8AF54976AC24366AAF848FABE9F9120"><enum>(4)</enum><text>providing
information on application processes for certifying a high-performance green
building, including certification and commissioning;</text>
</paragraph><paragraph id="ID4E3CBC8300024B13A1104255C31247BE"><enum>(5)</enum><text>providing
technical information, market research, or other forms of assistance or advice
that would be useful in planning and constructing high-performance green
buildings; and</text>
</paragraph><paragraph id="idC05D7F538C1148EBBD2A8E9933EC3955"><enum>(6)</enum><text>using such other
methods as are determined by the Director to be appropriate.</text>
</paragraph></section><section id="IDC130FA4466464E6094B82EA8A72AB602"><enum>105.</enum><header>Research and
development</header>
<subsection id="ID9A5093901CD6477E95F5FCCBCA4DA9B2"><enum>(a)</enum><header>Establishment</header><text>The
Director, in coordination with the Committee, shall—</text>
<paragraph id="IDC94181BB67174FF481DFACA9D649BB6C"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id4C75D0DEEE2646E29446ADD5BE80F3CA"><enum>(A)</enum><text>survey existing
research and studies relating to high-performance green buildings; and</text>
</subparagraph><subparagraph changed="deleted" committee-id="SSEV00" id="id028DA46DF025429FA385717C54C875E3" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>coordinate
activities of common interest;</text>
</subparagraph></paragraph><paragraph id="IDC1273476FD2C4A23B514F1EAB41C46AA"><enum>(2)</enum><text>develop and
recommend a high-performance green building research plan that—</text>
<subparagraph id="id6F2397AE3BD54A7984E73AAC77581526"><enum>(A)</enum><text>identifies
information and research needs, including the relationships between health,
occupant productivity, and each of—</text>
<clause id="IDef9fbacc112240e098e3630b7dc9b785"><enum>(i)</enum><text>pollutant
emissions from materials and products in the building;</text>
</clause><clause id="ID52f4ed5fe8a94ff798d5a54b349ed960"><enum>(ii)</enum><text>natural day
lighting;</text>
</clause><clause id="ID9d0981df34c94887a1016ead3800f688"><enum>(iii)</enum><text>ventilation
choices and technologies;</text>
</clause><clause id="IDa7b5d09d91784507b1bda2a00c59ca5e"><enum>(iv)</enum><text>heating, cooling,
and system control choices and technologies;</text>
</clause><clause id="ID2dcb3ff654cb4ad985554adbee14f0c9"><enum>(v)</enum><text>moisture control
and mold;</text>
</clause><clause id="ID63f46f845702457ea01a59949aebaf97"><enum>(vi)</enum><text>maintenance,
cleaning, and pest control activities;</text>
</clause><clause id="ID69c86e1dbf4e4dcfbc19f238c46955b8"><enum>(vii)</enum><text>acoustics;
and</text>
</clause><clause id="IDd6e081e3cc2b44aea1c90804b34e6def"><enum>(viii)</enum><text>other issues
relating to the health, comfort, productivity, and performance of occupants of
the building; and</text>
</clause></subparagraph><subparagraph id="id0721AEC70233436E91DCFA7BA6C7C5AB"><enum>(B)</enum><text>promotes the
development and dissemination of high-performance green building measurement
tools that, at a minimum, may be used—</text>
<clause id="ID113F5D1690554E559BE27AFA68845A3C"><enum>(i)</enum><text>to monitor and
assess the life-cycle performance of facilities (including demonstration
projects) built as high-performance green buildings; and</text>
</clause><clause id="ID2B7854F6561F46D28A2CAE9852E9B517"><enum>(ii)</enum><text>to perform
life-cycle assessments;</text>
</clause></subparagraph></paragraph><paragraph id="ID27455FA93F984359A51F0F23A10CE7AF"><enum>(3)</enum><text>assist the budget
and life-cycle costing functions of the Office under section 106;</text>
</paragraph><paragraph id="idBF6DFDD65F5A4362BDD1D037A664F1E7"><enum>(4)</enum><text>study and identify
potential benefits of green buildings relating to security, natural disaster,
and emergency needs of the Federal Government; and</text>
</paragraph><paragraph id="ID3CCBA7B4AE114B0F8E8863AC0DD8AE16"><enum>(5)</enum><text>support other
research initiatives determined by the Office.</text>
</paragraph></subsection><subsection commented="no" id="id824B140962DE4F4CAF23835B2FECF95C"><enum>(b)</enum><header>Indoor air
quality</header><text>The Director, in consultation with the Committee, shall
develop and implement a comprehensive indoor air quality program for all
Federal facilities to ensure the safety of Federal workers and facility
occupants—</text>
<paragraph commented="no" id="idB37A4FA6E2894E23BACB0C49C6FE00C8"><enum>(1)</enum><text>during new
construction and renovation of facilities; and</text>
</paragraph><paragraph commented="no" id="id1FF025911AC348BDB6B3FB2DDFB23430"><enum>(2)</enum><text>in existing
facilities.</text>
</paragraph></subsection></section><section id="IDD022407252DC427EBE757F8E7AB0FB36"><enum>106.</enum><header>Budget and
life-cycle costing and contracting</header>
<subsection id="IDF070241199B24F31B36555C434053237"><enum>(a)</enum><header>Establishment</header><text>The
Director, in coordination with the Committee, shall—</text>
<paragraph id="id3F7CB27EB114426D836DB812C112A409"><enum>(1)</enum><text>identify, review,
and analyze current budget and contracting practices that affect achievement of
high-performance green buildings, including the identification of barriers to
green building life-cycle costing and budgetary issues;</text>
</paragraph><paragraph id="id781636D6F82342EEAD3D709515EB7642"><enum>(2)</enum><text>develop guidance
and conduct training sessions with budget specialists and contracting personnel
from Federal agencies and budget examiners to apply life-cycle cost criteria to
actual projects;</text>
</paragraph><paragraph id="IDC0586ACB472341E589093710E4B79304"><enum>(3)</enum><text>identify tools to
aid life-cycle cost decisionmaking; and</text>
</paragraph><paragraph id="id9D796239E2584A6A826B9FF3391E1C4C"><enum>(4)</enum><text>explore the
feasibility of incorporating the benefits of green buildings, such as security
benefits, into a cost-budget analysis to aid in life-cycle costing for budget
and decision making processes.</text>
</paragraph></subsection></section><section id="IDCFF9D98D2E064BD0B8B736E64C359147"><enum>107.</enum><header>Authorization
of appropriations</header><text display-inline="no-display-inline">There is
authorized to be appropriated to carry out this title $4,000,000 for each of
fiscal years 2007 through 2012, to remain available until expended.</text>

school</header><text>The term <term>high-performance school</term> has the
meaning given the term <term>healthy, high-performance school building</term>

5586</external-xref> of the <act-name parsable-cite="ESEA">Elementary and
Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7277e">20 U.S.C. 7277e</external-xref>).</text>
</paragraph><paragraph commented="no" id="ID751564059E6D429C9C10744CBEC40349"><enum>(2)</enum><header>Local
educational agency</header><text>The term <term>local educational agency</term>
has the meaning given the term in
<external-xref legal-doc="act" parsable-cite="ESEA/9101">section
9101</external-xref> of the <act-name parsable-cite="ESEA">Elementary and
Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>

educational agency</header><text>The term <term>State educational agency</term>
has the meaning given the term in section 9101 of the Elementary and Secondary
Education Act of 1965 (20 U.S.C. 7801).</text>
</paragraph></section><section commented="no" id="id72C04DC5C644480ABC8E63FD0FC2AA0A"><enum>202.</enum><header>Grants for
healthy school environments</header>
<subsection commented="no" id="ID060BF7AAFB1042C8AA0D4107EAA2D9FA"><enum>(a)</enum><header>In
general</header><text>The Administrator of the Environmental Protection Agency,
in consultation with the Secretary of Education and the Secretary of Health and
Human Services, may provide grants to State and local educational agencies for
use in—</text>
<paragraph commented="no" id="ID5E74B6AD1BC84A24AFD56FF6ABF086E6"><enum>(1)</enum><text>providing
technical assistance for programs of the Environmental Protection Agency
(including the Tools for Schools Program and the Healthy School Environmental
Assessment Tool) to schools for use in addressing environmental issues;
and</text>
</paragraph><paragraph commented="no" id="ID2C5556F39C2547C9BB3C0F64D4799A3C"><enum>(2)</enum><text>development of
State school environmental quality plans, in partnership with the Environmental
Protection Agency, that include—</text>
<subparagraph commented="no" id="IDF7599ED279724CE8B86D43270B6E6230"><enum>(A)</enum><text>standards for
healthy high-performance school building design, construction, and
renovation;</text>
</subparagraph><subparagraph commented="no" id="IDC3793A1F85E34651BAEC1D814FA9F614"><enum>(B)</enum><text>identification of
ongoing school building environmental problems in the State, including
assessment of information on the exposure of children to environmental hazards
in school facilities, as provided by the Administrator of the Environmental
Protection Agency;</text>
</subparagraph><subparagraph commented="no" id="IDFAFAB2130A804DDAA45DD036D44D652D"><enum>(C)</enum><text>proposals for the
systematic improvement (including benchmarks and timelines) of environmental
conditions in schools throughout the State, including—</text>
<clause commented="no" id="ID9E6FC32AD62B4E73ACD9D6184CEB4D69"><enum>(i)</enum><text>school building
siting, construction, and maintenance;</text>
</clause><clause commented="no" id="ID4DC90BFC97D94141AE68FC6DE8261E48"><enum>(ii)</enum><text>indoor air
quality;</text>
</clause><clause commented="no" id="ID280EB4C854714295B2F17AC05E91B547"><enum>(iii)</enum><text>pest
control;</text>
</clause><clause commented="no" id="ID7D4608262F6246089A9D076978E280B4"><enum>(iv)</enum><text>radon
contamination;</text>
</clause><clause commented="no" id="IDC57B320FD0E8424E9D4933A2840269AF"><enum>(v)</enum><text>lead
contamination;</text>
</clause><clause commented="no" id="ID867866DE9B204159BBC85761CC4B501D"><enum>(vi)</enum><text>environmentally
preferable purchasing of products for classroom instruction and for
maintenance;</text>
</clause><clause commented="no" id="ID41E3956AC77643F5A9A1F054F0F48341"><enum>(vii)</enum><text>hazard
identification and remediation; and</text>
</clause><clause commented="no" id="IDDA55404971084C2A8317B754D92EEA51"><enum>(viii)</enum><text>modes of
transportation available to students and staff;</text>
</clause></subparagraph><subparagraph commented="no" id="ID51428A05060840E6A3163618A758D0FC"><enum>(D)</enum><text>recommendations
for improvements in the capacity of the State to track child and adult health
complaints relating to schools; and</text>
</subparagraph><subparagraph commented="no" id="id76730EE472C64D618EF6C88938933371"><enum>(E)</enum><text>plans for
operation as an emergency, self-sustaining evacuation center.</text>
</subparagraph></paragraph></subsection><subsection commented="no" id="id962413DD944B431DB4B022DFC86AF863"><enum>(b)</enum><header>Other
grants</header><text>The Administrator of the Environmental Protection Agency
may provide grants to qualified, nonprofit organizations to assist in community
and public education on healthy school environments.</text>
</subsection><subsection commented="no" id="ID6C91820340664E4580E24376A890FE7F"><enum>(c)</enum><header>Cost
sharing</header>
<paragraph commented="no" id="ID4C096BA6F69E40FF83F7C95D960076E1"><enum>(1)</enum><header>Federal
share</header><text>The Federal share of the cost of a project or activity
carried out using funds from a grant under subsection (a) shall not exceed 90
percent.</text>
</paragraph><paragraph commented="no" id="IDBD721D27E0BF47F3992E80CAB2169CCB"><enum>(2)</enum><header>Non-federal
share</header><text>The non-Federal share of the cost of a project or activity
carried out using funds from a grant under subsection (a) may be provided in
the form of cash or in-kind goods and services.</text>
</paragraph></subsection><subsection commented="no" id="IDE7A13DD9ACF745D1A1FBDF1211039BC1"><enum>(d)</enum><header>Grant
priority</header>
<paragraph commented="no" id="ID72D0EB3DEBAC4D40813AC1905DB25EC4"><enum>(1)</enum><header>In
general</header><text>In providing grants under this section for use in
carrying out the program referred to in subsection (a)(1), the Administrator of
the Environmental Protection Agency, in consultation with the Secretary of
Education, shall give priority to school districts with need for environmental
improvement as identified in the school environmental plans described in this
section.</text>
</paragraph><paragraph commented="no" id="ID3C2A79EC2C05429982A257F250180542"><enum>(2)</enum><header>Responsibility
of school districts and State educational agencies</header>
<subparagraph commented="no" id="IDFCA8787FC20F4868A8A5929965CCDF9A"><enum>(A)</enum><header>School
districts</header><text>Not later than 2 years after the date of enactment of
this Act, and annually thereafter, each school district that receives funds
from the Administrator of the Environmental Protection Agency to carry out a
program described in subsection (a) shall submit to the State educational
agency with jurisdiction over the school district a report that
includes—</text>
<clause commented="no" id="ID1834A3C81ABD45F7A9B1E481D2FFFD93"><enum>(i)</enum><text>a list of schools
in the districts that, as of the date of the report, have accepted funds or
other assistance from the Environmental Protection Agency for use in carrying
out this section; and</text>
</clause><clause commented="no" id="ID470A67759E664CBF9B93D8FD5AD8D08A"><enum>(ii)</enum><text>an overview of
the impact of the funds, including—</text>
<subclause commented="no" id="IDBFCD4BFB292947EBBE01672D8FE9521D"><enum>(I)</enum><text>general data
regarding measures of student health and attendance rates before and after
grant intervention; and</text>
</subclause><subclause commented="no" id="IDCF0DA7D975A1421BB9BF6A941692E9DA"><enum>(II)</enum><text>descriptions of
toxic or hazardous cleaning, maintenance, or instructional products eliminated
or reduced in use as part of the promotion or remediation of the indoor air
quality of schools within the school district; and</text>
</subclause></clause><clause commented="no" id="IDE03C639F428B40A6A3DBB627D9C473FA"><enum>(iii)</enum><text>basic
information on the potential influence of other factors (such as the
installation of carpet and HVAC systems and similar activities) on air
quality.</text>
</clause></subparagraph><subparagraph commented="no" id="ID20A36288954A4A649308622032B6C19F"><enum>(B)</enum><header>State
educational agency reports</header><text>Not later than 180 days after the date
on which each State educational agency has received the annual reports under
subparagraph (A) from all participating school districts, the State educational
agency shall submit to the Administrator of the Environmental Protection Agency
and Congress a consolidated report of all information received from the school
districts.</text>
</subparagraph></paragraph></subsection></section><section commented="no" id="ID7504C7DB55C44F4093AEB0C7C41B036F"><enum>203.</enum><header>Federal
guidelines for siting of school facilities</header><text display-inline="no-display-inline">The Administrator of the Environmental
Protection Agency, in consultation with the Secretary of Education and the
Secretary of Health and Human Services, shall develop school site selection
guidelines that account for—</text>
<paragraph commented="no" id="id3A6B63794DBF485793E504B53CF6C3FF"><enum>(1)</enum><text display-inline="yes-display-inline">the special vulnerability of children to
hazardous substances or pollution exposures in any case in which the potential
for contamination at a potential school site exists, as determined by the
Administrator of the Environmental Protection Agency, in consultation with the
Secretary of Education;</text>
</paragraph><paragraph commented="no" id="id40ADA17E766D4677B89B44AFD6D1BAA9"><enum>(2)</enum><text>modes of
transportation available to students and staff; and</text>
</paragraph><paragraph commented="no" id="id92102886B44544EA900C36F9BE108840"><enum>(3)</enum><text>the potential use
of a school at the site as an emergency shelter.</text>
</paragraph></section><section commented="no" id="IDC1A10A15172948578F1137795D446859"><enum>204.</enum><header>Environmental
health program</header>
<subsection commented="no" id="id4CF0154975D249B0AE38B012270D596C"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The Administrator of
the Environmental Protection Agency, in consultation with the Secretary of
Education, the Secretary of Health and Human Services, and other relevant
agencies, shall issue guidelines for use by the State in developing and
implementing an environmental health program for schools that—</text>
<paragraph commented="no" id="IDFDAE05AAF72F41E7929C7641713E6358"><enum>(1)</enum><text>takes into account
the status and findings of Federal research initiatives established under this
Act and other relevant Federal law with respect to school facilities, including
relevant updates on trends in the field, such as the impact of school facility
environments on student and staff—</text>
<subparagraph commented="no" id="IDB0278AC31B0B4271819F10E4321C3C4E"><enum>(A)</enum><text>health, safety,
and productivity; and</text>
</subparagraph><subparagraph commented="no" id="IDE28D2A4407AD41608ABB6AF74A077FE4"><enum>(B)</enum><text>disabilities or
special needs;</text>
</subparagraph></paragraph><paragraph commented="no" id="IDDC1DE2CA9C2544749B411F15300E7CC2"><enum>(2)</enum><text>provides research
using relevant tools identified or developed in accordance with section 105 to
quantify the relationships between—</text>
<subparagraph commented="no" id="ID9433724087D84B9996A91EB41E1BE35C"><enum>(A)</enum><text>human health,
occupant productivity, and student performance; and</text>
</subparagraph><subparagraph commented="no" id="IDD7E047B2842846A49CBB0EFBA035FCCC"><enum>(B)</enum><text>with respect to
school facilities, each of—</text>
<clause commented="no" id="IDE5EBFC13A5754E858AEF76B10F7550F4"><enum>(i)</enum><text>pollutant
emissions from materials and products;</text>
</clause><clause commented="no" id="ID79C19C937859477CB95B8A6EE9E191C7"><enum>(ii)</enum><text>natural day
lighting;</text>
</clause><clause commented="no" id="IDE3E7D742C739428FB13A0662CC88E59B"><enum>(iii)</enum><text>ventilation
choices and technologies;</text>
</clause><clause commented="no" id="ID314BCFCE31C84CE4806242933272B4D2"><enum>(iv)</enum><text>heating and
cooling choices and technologies;</text>
</clause><clause commented="no" id="ID4E0B2529A25241009817EEB27E0AF1E7"><enum>(v)</enum><text>moisture control
and mold;</text>
</clause><clause commented="no" id="ID8CAD2986C8EE40ADB0E19CBACE967288"><enum>(vi)</enum><text>maintenance,
cleaning, and pest control activities;</text>
</clause><clause commented="no" id="ID72BDEB51BF434055B633E3E6EA085F9E"><enum>(vii)</enum><text>acoustics;
and</text>
</clause><clause commented="no" id="IDCB682ED4D81A4FBF840CD116874DE7C1"><enum>(viii)</enum><text>other issues
relating to the health, comfort, productivity, and performance of occupants of
the school facilities;</text>
</clause></subparagraph></paragraph><paragraph commented="no" id="IDD9C1AF3CC92F4F249AF6BB535F29141D"><enum>(3)</enum><text>provides technical
assistance on siting, design, management, and operation of school facilities,
including facilities used by students with disabilities or special
needs;</text>
</paragraph><paragraph commented="no" id="IDA7B06219F1C24C53B74990F636B680FA"><enum>(4)</enum><text>collaborates with
federally funded pediatric environmental health centers to assist in on-site
school environmental investigations;</text>
</paragraph><paragraph commented="no" id="ID554800AB16DC488CB3597E14145E4E50"><enum>(5)</enum><text>assists States and
the public in better understanding and improving the environmental health of
children; and</text>
</paragraph><paragraph commented="no" id="IDBB736D13DCAE4D1599E6377D5CDDF440"><enum>(6)</enum><text>provides to the
Office a biennial report of all activities carried out under this title, which
the Director shall include in the report described in section 102(c).</text>
</paragraph></subsection><subsection commented="no" id="idF664D0D93FF94B7AB6928CE4358B6726"><enum>(b)</enum><header>Public
outreach</header><text>The Director shall ensure, to the maximum extent
practicable, that the public clearinghouse established under section 104
receives and makes available—</text>
<paragraph commented="no" id="idBF810B390FE5473B81DC8F318AC88D59"><enum>(1)</enum><text>information from
the Administrator of the Environmental Protection Agency that is contained in
the report described in subsection (a)(6); and</text>
</paragraph><paragraph commented="no" id="id1CEE47BE812046B4AF2808E79A344902"><enum>(2)</enum><text>information on the
exposure of children to environmental hazards in school facilities, as provided
by the Administrator of the Environmental Protection Agency.</text>
</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID5718DD1183B147329B8614B0D158F7AF" section-type="subsequent-section"><enum>205.</enum><header>Authorization of
appropriations</header><text display-inline="no-display-inline">There is
authorized to be appropriated to carry out this title $10,000,000 for the
period of fiscal years 2007 through 2012, to remain available until
expended.</text>
</section><enum>III</enum><header>Strengthening
Federal Leadership</header>
<section id="id62A737F0BE4D431CA1FC70406C97F28B"><enum>301.</enum><header>Incentives</header><text display-inline="no-display-inline">As soon as practicable after the date of
enactment of this Act, the Director shall identify incentives to encourage the
use of green buildings and related technology in the operations of the Federal
Government, including through—</text>
<paragraph id="id203C262FE3224F4983E79F389A8D23F2"><enum>(1)</enum><text display-inline="yes-display-inline">the provision of recognition awards;
and</text>
</paragraph><paragraph id="id0845094FFBA74A449168B094A5368668"><enum>(2)</enum><text display-inline="yes-display-inline">the maximum feasible retention of financial
savings in the annual budgets of Federal agencies for use in reinvesting in
future green building initiatives.</text>
</paragraph></section><section id="ID25ba5ba0e20c4a23b23c1ee46df1cd17"><enum>302.</enum><header>Federal
procurement</header>
<subsection id="ID5473c8a3b070428ca1ba798a2deb23a9"><enum>(a)</enum><header>In
general</header><text>Not later than 2 years after the date of enactment of
this Act, the Director of the Office of Federal Procurement Policy, in
consultation with the Director and the Under Secretary of Defense for
Acquisition, Technology, and Logistics, shall promulgate revisions of the
applicable acquisition regulations, to take effect as of the date of
promulgation of the revisions—</text>
<paragraph id="ID480603d3340748e98644c2a1e3ab10f7"><enum>(1)</enum><text>to direct any
Federal procurement executives involved in the acquisition, construction, or
major renovation (including contracting for the construction or major
renovation) of any facility—</text>
<subparagraph id="ID673aa23ea5164691a07e4587e6e015d4"><enum>(A)</enum><text>to employ
integrated design principles;</text>
</subparagraph><subparagraph id="IDe1d41cae96604b35b8b2cf14d857a708"><enum>(B)</enum><text>to improve site
selection for environmental and community benefits;</text>
</subparagraph><subparagraph id="ID093af8673bfc48dbbeae4f0e235fd0f6"><enum>(C)</enum><text>to optimize
building and systems energy performance;</text>
</subparagraph><subparagraph id="IDe421f24e92c646d5a1cc7f54f6ac57c4"><enum>(D)</enum><text>to protect and
conserve water;</text>
</subparagraph><subparagraph id="ID0893ef46d55b4f899ce40b3988dbc31e"><enum>(E)</enum><text>to enhance indoor
environmental quality; and</text>
</subparagraph><subparagraph id="ID3935803b888d4f1cb870370c70fb5451"><enum>(F)</enum><text>to reduce
environmental impacts of materials and waste flows; and</text>
</subparagraph></paragraph><paragraph id="ID2833ad2b3ba345118aca43a8c46d045b"><enum>(2)</enum><text display-inline="yes-display-inline">to direct Federal procurement executives
involved in leasing buildings, to give preference to the lease of facilities
that—</text>
<subparagraph id="ID98c47ba2c7d94c84984ceb2d744a1c2e"><enum>(A)</enum><text>are
energy-efficient; and</text>
</subparagraph><subparagraph id="ID484b88564f784909a2c1989066003433"><enum>(B)</enum><text>to the maximum
extent practicable, have applied contemporary high-performance and sustainable
design principles during construction or renovation.</text>
</subparagraph></paragraph></subsection><subsection id="IDc46508caff284c87a71363b70239496d"><enum>(b)</enum><header>Guidance</header><text>Not
later than 90 days after the date of promulgation of the revised regulations
under subsection (a), the Director shall issue guidance to all Federal
procurement executives providing direction and instructions to renegotiate the
design of proposed facilities, renovations for existing facilities, and leased
facilities to incorporate improvements that are consistent with this
section.</text>
</subsection></section><section id="id32A5D1453C9749A496B772645659C1D6"><enum>303.</enum><header> Federal green
building performance</header>
<subsection id="id34338762CDD24CFA8400450D60CB8B6E"><enum>(a)</enum><header>In
general</header><text>Not later than October 31 of each of the 2 fiscal years
following the fiscal year in which this Act is enacted, and at such times
thereafter as the Comptroller General of the United States determines to be
appropriate, the Comptroller General of the United States shall, with respect
to the fiscal years that have passed since the preceding report—</text>
<paragraph id="id040263A3E2FA42D0A3953D20393A0312"><enum>(1)</enum><text>conduct an audit
of the implementation of this Act; and</text>
</paragraph><paragraph id="id3A9DB6A3437443F8ABA379455AB9C679"><enum>(2)</enum><text>submit to the
Office, the Committee, the Administrator, and Congress a report describing the
results of the audit.</text>
</paragraph></subsection><subsection id="id5DF9EFE5BC09422E9D943687B8796E18"><enum>(b)</enum><header>Contents</header><text>An
audit under subsection (a) shall include a review, with respect to the period
covered by the report under subsection (a)(2), of—</text>
<paragraph id="idD52632CCE9704D18A5444F51A4FFC02D"><enum>(1)</enum><text>budget, life-cycle
costing, and contracting issues, using best practices identified by the
Comptroller General of the United States and heads of other agencies in
accordance with section 106;</text>
</paragraph><paragraph id="id8DD33ABE029B448680DA9123F1276347"><enum>(2)</enum><text>the level of
coordination among the Office, the Office of Management and Budget, and
relevant agencies;</text>
</paragraph><paragraph id="id417244F49BC34E27A25DDB1A18ECAD07"><enum>(3)</enum><text>the performance of
the Office in carrying out the implementation plan;</text>
</paragraph><paragraph id="id77FB419F638C46418FA2F1FE1E784780"><enum>(4)</enum><text>the design stage
of high-performance green building measures;</text>
</paragraph><paragraph id="idEDB0A5C377864950B7D76E89B4710E97"><enum>(5)</enum><text>high-performance
building data that were collected and reported to the Office; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFE6D4FBD93C940FABABA8BFD1C7AA326"><enum>(6)</enum><text>such other matters
as the Comptroller General of the United States determines to be
appropriate.</text>
</paragraph></subsection><subsection commented="no" id="ID2df149c338554d7ca50719d7040594ce"><enum>(c)</enum><header>Consultation</header><text>The
Director shall consult with the Committee to enhance and assist the
implementation of the Environmental Stewardship Scorecard announced at the
White House Summit on Federal sustainable buildings in January 2006, to measure
the implementation by each Federal agency of sustainable design and green
building initiatives.</text>
</subsection></section><enum>IV</enum><header>Demonstration
project</header>
<section id="ID1D40F9EB36534BCFB62CA6BBA113E7E0"><enum>401.</enum><header>Coordination of
goals</header>
<subsection id="ID0E3F0F15A5984296AE889E2D1C5CE8C6"><enum>(a)</enum><header>In
general</header><text>The Director shall establish guidelines to implement a
demonstration project to contribute to the research goals of the Office.</text>
</subsection><subsection id="ID75027799099D4010A610557A884D89EC"><enum>(b)</enum><header>Projects</header><text>In
accordance with guidelines established by the Director under subsection (a) and
the duties of the Director described in title I, the Director shall carry
out—</text>
<paragraph id="ID35A9A4428E82424481602AC1097EBA8F"><enum>(1)</enum><text>for each of fiscal
years 2008 through 2013, 1 demonstration project in a Federal building selected
by the Director in accordance with relevant agencies and described in
subsection (c)(1), that—</text>
<subparagraph id="ID40D65D552C7F43FC911DD20398F1F92D"><enum>(A)</enum><text>provides for the
evaluation of the information obtained through the conduct of projects and
activities under this Act; and</text>
</subparagraph><subparagraph id="ID3C80EE7E807A4759944206978866293A"><enum>(B)</enum><text>achieves a
platinum rating, as defined by the Leadership in Energy and Environmental
Design Building Rating System standard established by the United States Green
Building Council (or equivalent rating); and</text>
</subparagraph></paragraph><paragraph commented="no" id="IDD76FDE39C02F4EED9D28309941754BC5"><enum>(2)</enum><text>no fewer than 4
demonstration projects at 4 universities, that, as competitively selected by
the Director in accordance with subsection (c)(2), have—</text>
<subparagraph commented="no" id="id374981AEDA724CE0848BB869D88992DF"><enum>(A)</enum><text>appropriate
research resources and relevant projects to meet the goals of the demonstration
project established by the Office; and</text>
</subparagraph><subparagraph commented="no" id="id75B25512FAC4476E856A0E8FBA55E348"><enum>(B)</enum><text>the
ability—</text>
<clause commented="no" id="id2D8BA8A5F1A049FDA82FE16F97B2D872"><enum>(i)</enum><text>to serve as a
model for high-performance green building initiatives, including research and
education;</text>
</clause><clause commented="no" id="idA9BF6851AE734E829EB9D47EDCB0AA38"><enum>(ii)</enum><text>to identify the
most effective ways to use high-performance green building and landscape
technologies to engage and educate undergraduate and graduate students;</text>
</clause><clause commented="no" id="id4AB065593D614C5FB5F2D19FE1CCCCAB"><enum>(iii)</enum><text>to effectively
implement a high-performance green building education program for students and
occupants;</text>
</clause><clause commented="no" id="id346C7BA766EC40D0B55B7BA693819081"><enum>(iv)</enum><text>to demonstrate
the effectiveness of various high-performance technologies in each of the 4
climatic regions of the United States described in subsection (c)(2)(B);
and</text>
</clause><clause id="ID157ac8de6ca3455dac8d65f95781776c"><enum>(v)</enum><text>to explore
quantifiable and nonquantifiable beneficial impacts on public health and
employee and student performance.</text>
</clause></subparagraph></paragraph></subsection><subsection id="IDE58D8264674A4AB0ABD22E2987DF0695"><enum>(c)</enum><header>Criteria</header>
<paragraph id="ID3C0C7A6FFD2E4C6F82A02966DBE07F3C"><enum>(1)</enum><header>Federal
facilities</header><text>With respect to the existing or proposed Federal
facility at which a demonstration project under this section is conducted, the
Federal facility shall—</text>
<subparagraph id="ID0DCC50156973459785D7326ABE388A27"><enum>(A)</enum><text>be an appropriate
model for a project relating to—</text>
<clause id="ID35632BE9230B4FB79A8D1938561ACC4B"><enum>(i)</enum><text>the effectiveness
of high-performance technologies;</text>
</clause><clause id="ID0B0F578D29D240C09D75513D4DE281D7"><enum>(ii)</enum><text>analysis of
materials, components, systems, and emergency operations in the building, and
the impact of those materials, components, and systems, including the impact on
the health of building occupants;</text>
</clause><clause id="ID8F2B7CF6E44145C08E2C092829264512"><enum>(iii)</enum><text>life-cycle
costing and life-cycle assessment of building materials and systems; and</text>
</clause><clause id="ID4B95BB57BA984EBDB111D65909CC744A"><enum>(iv)</enum><text>location and
design that promote access to the Federal facility through walking, biking, and
mass transit; and</text>
</clause></subparagraph><subparagraph id="ID8B8D88250FE7485FB30268825E6C310F"><enum>(B)</enum><text>possess sufficient
technological and organizational adaptability.</text>
</subparagraph></paragraph><paragraph commented="no" id="ID577E3306E0F94390A5723ED64054F356"><enum>(2)</enum><header>Universities</header><text>With
respect to the 4 universities at which a demonstration project under this
section is conducted—</text>
<subparagraph commented="no" id="ID6B86B7CA42684FCAB48D5218C1F5D829"><enum>(A)</enum><text>the universities
should be selected, after careful review of all applications received
containing the required information, as determined by the Director, based
on—</text>
<clause commented="no" id="IDD0BC9446A50746C7896A588F0E4EE1B0"><enum>(i)</enum><text>successful and
established public-private research and development partnerships;</text>
</clause><clause commented="no" id="ID0710BACABC75420AA1345D2288E0E9E7"><enum>(ii)</enum><text>demonstrated
capabilities to construct or renovate buildings that meet high indoor
environmental quality standards;</text>
</clause><clause commented="no" id="IDEAFEF32F2DC14400B810935D913D6F79"><enum>(iii)</enum><text>organizational
flexibility;</text>
</clause><clause commented="no" id="ID4CDFAEB147474DE48CAB2D2E599B037E"><enum>(iv)</enum><text>technological
adaptability;</text>
</clause><clause commented="no" id="ID7D2D73B1C33947819A7B9BAD7B6FFB98"><enum>(v)</enum><text>the demonstrated
capacity of at least 1 university to replicate lessons learned among nearby or
sister universities, preferably by participation in groups or consortia that
promote sustainability;</text>
</clause><clause commented="no" id="idB19ABA346E074EF4A0F75761ED1BA9A6"><enum>(vi)</enum><text>the demonstrated
capacity of at least 1 university to have officially-adopted, institution-wide
<quote>green building</quote> guidelines for all campus building projects;
and</text>
</clause><clause id="ID94730eaf55e34af4863586ac760c2323"><enum>(vii)</enum><text>the demonstrated
capacity of at least 1 university to have been recognized by similar
institutions as a national leader in sustainability education and curriculum
for students of the university; and</text>
</clause></subparagraph><subparagraph commented="no" id="ID79D465F5246E4B29A3DC24522CDCE196"><enum>(B)</enum><text>each university
shall be located in a different climatic region of the United States, each of
which regions shall have, as determined by the Office—</text>
<clause commented="no" id="ID8F127772DA5A418EA15AC928C0882026"><enum>(i)</enum><text>a hot, dry
climate;</text>
</clause><clause commented="no" id="IDEA6AA33C64804BFEB0DB600EFC700285"><enum>(ii)</enum><text>a hot, humid
climate;</text>
</clause><clause commented="no" id="IDAC3F856882444EB99ED2C7F73DCCACAE"><enum>(iii)</enum><text>a cold climate;
or</text>
</clause><clause commented="no" id="ID7FC86FA5E4334026810828D5DE32300C"><enum>(iv)</enum><text>a temperate
climate (including a climate with cold winters and humid summers).</text>
</clause></subparagraph></paragraph></subsection><subsection commented="no" id="id24F933AD91FC4F66BB4932611117A850"><enum>(d)</enum><header>Report</header><text>Not
later than 1 year after the date of enactment of this Act, and annually
thereafter through September 30, 2013—</text>
<paragraph commented="no" id="id371E951D25484C6FADBF6DF4C1EACC54"><enum>(1)</enum><text>the Director shall
submit to the Administrator a report that describes the status of the
demonstration projects; and</text>
</paragraph><paragraph commented="no" id="id6881A1BE9C6642228BB5F14364468872"><enum>(2)</enum><text>each University at
which a demonstration project under this section is conducted shall submit to
the Administrator a report that describes the status of the demonstration
projects under this section.</text>
</paragraph></subsection></section><section commented="no" id="IDE58D46E413B64B048D5C3E31A856E911"><enum>402.</enum><header>Authorization
of appropriations</header>
<subsection commented="no" id="IDF626E8E527A54F57968D704BF8AE9521"><enum>(a)</enum><header>Federal
demonstration project</header><text>There is authorized to be appropriated to
carry out the Federal demonstration project described in section 401(b)(1)
$10,000,000 for the period of fiscal years 2008 through 2013, to remain

2.In this Act:
(1)The
term Administrator means the Administrator of General
Services.
(2)The
term Committee means the Green Building Advisory Committee
established under section 103(a).
(3)The
term Director means the individual appointed to the position
established under section 101(a).
(4)
(A)The term Federal facility means any building
or facility the intended use of which requires the building or facility to
be—
(i)accessible to the public;
and
(ii)constructed or altered
by or on behalf of the United States.
(B)The
term Federal facility does not include a privately-owned
residential or commercial structure that is not leased by the Federal
Government.
(5)High-performance green
buildingThe term high-performance green building
means a building—
(A)that, during its
life-cycle—
(i)reduces energy, water,
and material resource use and the generation of waste;
(ii)improves indoor
environmental quality, including protecting indoor air quality during
construction, using low-emitting materials, improving thermal comfort, and
improving lighting and acoustic environments that affect occupant health and
productivity;
(iii)improves indoor and
outdoor impacts of the building on human health and the environment;
(iv)increases the use of
environmentally preferable products, including biobased, recycled content, and
nontoxic products with lower life-cycle impacts;
(v)increases reuse and
recycling opportunities; and
(vi)integrates systems in
the building; and
(B)for which, during its
planning, design, and construction, the environmental and energy impacts of
building location and site design are considered.
(6)The term life cycle, with respect to a
high-performance green building, means all stages of the useful life of the
building (including components, equipment, systems, and controls of the
building) beginning at conception of a green building project and continuing
through site selection, design, construction, landscaping, commissioning,
operation, maintenance, renovation, deconstruction or demolition, removal, and
recycling of the green building.
(7)The term life-cycle assessment means a
comprehensive system approach for measuring the environmental performance of a
product or service over the life of the product or service, beginning at raw
materials acquisition and continuing through manufacturing, transportation,
installation, use, reuse, and end-of-life waste management.
(8)The term life-cycle costing, with respect to
a high-performance green building, means a technique of economic evaluation
that—
(A)sums, over a given study
period, the costs of initial investment (less resale value), replacements,
operations (including energy use), and maintenance and repair of an investment
decision; and
(B)is expressed—
(i)in present value terms,
in the case of a study period equivalent to the longest useful life of the
building, determined by taking into consideration the typical life of such a
building in the area in which the building is to be located; or
(ii)in annual value terms,
in the case of any other study period.
(9)The
term Office means the Office of High-Performance Green Buildings
established under section 102(a).
<enum>I</enum><header>Office of
High-Performance Green Buildings</header>
<section id="id68f48220-1cef-46a7-b07d-4a3f61106a96"><enum>101.</enum><header>Oversight</header>
<subsection id="id96be1add-1e76-4baa-b0cc-8ccab33d9faf"><enum>(a)</enum><header>In
general</header><text>The Administrator shall establish within the General
Services Administration, and appoint an individual to serve as Director in, a
position in the career-reserved Senior Executive service, to—</text>
<paragraph id="id1af6e3c0-c2d0-40e6-a8d2-36a9b1b1b993"><enum>(1)</enum><text>establish and manage the
Office in accordance with section 102; and</text>
</paragraph><paragraph id="idc93793c7-eb51-47c2-a429-24267f781684"><enum>(2)</enum><text>carry out other duties as
required under this Act.</text>
</paragraph></subsection><subsection id="id5135ac83-ddc3-46e1-b669-4f7921112fab"><enum>(b)</enum><header>Compensation</header><text>The
compensation of the Director shall not exceed the maximum rate of basic pay for
the Senior Executive Service under section 5382 of title 5, United States Code,
including any applicable locality-based comparability payment that may be
authorized under section 5304(h)(2)(C) of that title.</text>
</subsection></section><section id="id273b1d04-e30b-4472-9277-a4e431dbda09"><enum>102.</enum><header>Office of
High-Performance Green Buildings</header>
<subsection id="idb69bdc5a-71cd-4e28-9780-3aae0cab5e81"><enum>(a)</enum><header>Establishment</header><text>The
Director shall establish within the General Services Administration an Office
of High-Performance Green Buildings.</text>
</subsection><subsection id="idb7300533-27a5-4dc9-86ee-cb30008fb642"><enum>(b)</enum><header>Duties</header><text>The
Director shall—</text>
<paragraph id="iddb8701be-98e9-4011-9511-77bfd0d674dd"><enum>(1)</enum><text>ensure full coordination
of high-performance green building information and activities within the
General Services Administration and all relevant Federal agencies, including,
at a minimum—</text>
<subparagraph id="id013266d7-4798-4683-b978-e7c2259f35cf"><enum>(A)</enum><text>the Environmental
Protection Agency;</text>
</subparagraph><subparagraph id="id08afbd8f-68d6-415d-a0a5-906ad0edd075"><enum>(B)</enum><text>the Office of the Federal
Environmental Executive;</text>
</subparagraph><subparagraph commented="no" id="id11cc7f53-ba9d-45fc-825d-41ede29e0b68"><enum>(C)</enum><text>the Office of Federal
Procurement Policy;</text>
</subparagraph><subparagraph id="idb11f7f9e-19b0-43c4-a23f-f0eca61ff4fe"><enum>(D)</enum><text>the Department of
Energy;</text>
</subparagraph><subparagraph id="id73a199ed-1154-4db4-9c9a-bc3435ea99bb"><enum>(E)</enum><text>the Department of Health
and Human Services;</text>
</subparagraph><subparagraph id="id17d998d9-7dc1-4866-b587-049c76864500"><enum>(F)</enum><text>the Department of
Defense; and</text>
</subparagraph><subparagraph id="idc930b98a-fa8c-4cb3-b4fb-9e033dc712b8"><enum>(G)</enum><text>such other Federal
agencies as the Director considers to be appropriate;</text>
</subparagraph></paragraph><paragraph id="id6a00c366-c492-457d-8917-7133c046b9a6"><enum>(2)</enum><text>establish a senior-level
green building advisory committee, which shall provide advice and
recommendations in accordance with section 103;</text>
</paragraph><paragraph id="idecbce9c6-7df1-49bd-ba4a-fe47cba25a87"><enum>(3)</enum><text>identify and biennially
reassess improved or higher rating standards recommended by the
Committee;</text>
</paragraph><paragraph id="id5796a249-16e5-4ada-881e-8eb695a14362"><enum>(4)</enum><text>establish a national
high-performance green building clearinghouse in accordance with section 104,
which shall provide green building information through—</text>
<subparagraph id="id34f71ce7-fb52-4051-ae18-20bead343e0f"><enum>(A)</enum><text>outreach;</text>
</subparagraph><subparagraph id="id263bd70b-be41-4ac9-865f-ee921ed2a40e"><enum>(B)</enum><text>education; and</text>
</subparagraph><subparagraph id="iddc0db7e4-9401-405b-abaf-8f302e912efc"><enum>(C)</enum><text>the provision of
technical assistance;</text>
</subparagraph></paragraph><paragraph id="id4af13a76-2608-4883-96ef-031c5c7df96d"><enum>(5)</enum><text>ensure full coordination
of research and development information relating to high-performance green
building initiatives under section 105;</text>
</paragraph><paragraph id="id9c9ae2a3-fe75-47fc-8b69-4f7d2b1a9bf4"><enum>(6)</enum><text>identify and develop
green building standards that could be used for all types of Federal facilities
in accordance with section 105;</text>
</paragraph><paragraph id="id4cd43ec6-569c-4e15-97bd-51112718d07b"><enum>(7)</enum><text>establish green practices
that can be used throughout the life of a Federal facility;</text>
</paragraph><paragraph id="id1fe16397-b278-420a-9949-479ff5353b5e"><enum>(8)</enum><text>review and analyze
current Federal budget practices and life-cycle costing issues, and make
recommendations to Congress, in accordance with section 106; and</text>
</paragraph><paragraph id="idd35741be-375e-446d-9669-3b532b2a3b8b"><enum>(9)</enum><text>complete and submit the
report described in subsection (c).</text>
</paragraph></subsection><subsection id="iddf24e366-b1c9-4901-ac77-b77634fc8c78"><enum>(c)</enum><header>Report</header><text>Not
later than 2 years after the date of enactment of this Act, and biennially
thereafter, the Director shall submit to Congress a report that—</text>
<paragraph id="id4d0c37b0-2326-4a4c-b630-84971d4ea5ba"><enum>(1)</enum><text>describes the status of
the green building initiatives under this Act and other Federal programs in
effect as of the date of the report, including—</text>
<subparagraph id="id57bb012b-447b-4161-8d91-0ac3f6e0d4f8"><enum>(A)</enum><text>the extent to which the
programs are being carried out in accordance with this Act; and</text>
</subparagraph><subparagraph id="idcc5c0755-b1cc-45cf-9b61-f8d1302b9320"><enum>(B)</enum><text>the status of funding
requests and appropriations for those programs;</text>
</subparagraph></paragraph><paragraph id="id602978e6-fbbd-4350-ad16-fe2ccecf5bb8"><enum>(2)</enum><text>identifies within the
planning, budgeting, and construction process all types of Federal facility
procedures that inhibit new and existing Federal facilities from becoming
high-performance green buildings as measured by—</text>
<subparagraph id="ide13381e4-a7be-4717-9415-830d10fdc1cc"><enum>(A)</enum><text>a silver rating, as
defined by the Leadership in Energy and Environmental Design Building Rating
System standard established by the United States Green Building Council (or an
equivalent rating obtained through a comparable system); or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb5801795-55dc-41d0-ad5a-3bc520d1aac4"><enum>(B)</enum><text>an improved or higher
rating standard, as identified by the Committee;</text>
</subparagraph></paragraph><paragraph id="id512b73e3-5a7f-440a-88c8-311b3ccddba9"><enum>(3)</enum><text>identifies
inconsistencies, as reported to the Committee, in Federal law with respect to
product acquisition guidelines and high-performance product guidelines;</text>
</paragraph><paragraph id="id4d6e5cb5-62c8-4e7d-88dc-ea1e87dbe2af"><enum>(4)</enum><text>recommends language for
uniform standards for use by Federal agencies in environmentally responsible
acquisition;</text>
</paragraph><paragraph id="id9416452d-461b-4c38-8ecb-ec5595b6ce47"><enum>(5)</enum><text>in coordination with the
Office of Management and Budget, reviews the budget process for capital
programs with respect to alternatives for—</text>
<subparagraph id="id8c017c50-f664-4f07-b911-7ea476814237"><enum>(A)</enum><text>restructuring of budgets
to recommend the use of complete energy- and environmental-cost
accounting;</text>
</subparagraph><subparagraph id="id5fb925bb-74ea-4d66-8d92-80c2b6dc8448"><enum>(B)</enum><text>using operations
expenditures in budget-related decisions while simultaneously incorporating
productivity and health measures (as those measures can be quantified by the
Office, with the assistance of universities and national laboratories);</text>
</subparagraph><subparagraph commented="no" id="id8164d216-8241-464f-bc49-b41f9fceca77"><enum>(C)</enum><text>permitting Federal
agencies to retain all identified savings accrued as a result of the use of
life cycle costing; and</text>
</subparagraph><subparagraph id="id7b763041-9a44-410d-9503-f130a1f361c2"><enum>(D)</enum><text>identifying short- and
long-term cost savings that accrue from high-performance green buildings,
including those relating to health and productivity;</text>
</subparagraph></paragraph><paragraph id="id44ff89c8-6cf9-4ed9-92e5-2c26dad69455"><enum>(6)</enum><text>identifies green,
self-sustaining technologies to address the operational needs of Federal
facilities in times of national security emergencies, natural disasters, or
other dire emergencies;</text>
</paragraph><paragraph id="idD59FAA857B9A4BB28E337DD36FFA0936"><enum>(7)</enum><text>summarizes and highlights
development, at the State and local level, of green building initiatives,
including Executive orders, policies, or laws adopted promoting green building
(including the status of implementation of those initiatives); and</text>
</paragraph><paragraph id="idf1b92ee3-6b8c-4845-80f0-b6ae47c34549"><enum>(8)</enum><text>includes, for the 2-year
period covered by the report, recommendations to address each of the matters,
and a plan for implementation of each recommendation, described in paragraphs
(1) through (6).</text>
</paragraph></subsection><subsection id="id762cf9aa-36ed-412d-a0f4-cf9fb6495a46"><enum>(d)</enum><header>Implementation</header><text>The
Office shall carry out each plan for implementation of recommendations under
subsection (c)(7).</text>
</subsection></section><section id="id0c377226-0971-427f-8b56-c14c313cf455"><enum>103.</enum><header>Green Building
Advisory Committee</header>
<subsection id="ide6393ed9-d37d-419f-bc8a-8c5c2517be35"><enum>(a)</enum><header>Establishment</header><text>Not
later than 180 days after the date of enactment of this Act, the Director shall
establish an advisory committee, to be known as the <quote>Green Building
Advisory Committee</quote>.</text>
</subsection><subsection id="id987c9d6b-9208-4b7f-ac47-e1fb39dd4882"><enum>(b)</enum><header>Membership</header>
<paragraph id="id37DA66128D3B4753BCE3012F7099552D"><enum>(1)</enum><header>In
general</header><text>The Committee shall be composed of representatives of, at
a minimum—</text>
<subparagraph id="idc0c3f241-dc17-43c2-8a05-36d1cf746268"><enum>(A)</enum><text>each agency referred to
in section 102(b)(1); and</text>
</subparagraph><subparagraph id="idfe2fc620-6a48-4dab-ba2e-ab08b6444102"><enum>(B)</enum><text>other relevant agencies
and entities, as determined by the Director, including at least 1
representative of each of—</text>
<clause id="id9efa8e66-1451-4a45-a97c-e88149e9754a"><enum>(i)</enum><text>State and local
governmental green building programs;</text>
</clause><clause id="idd2b4bcdd-0a85-4f35-bf05-08c7eb47fb89"><enum>(ii)</enum><text>independent green
building associations or councils;</text>
</clause><clause id="id873e5270-ab6a-4edd-8b39-8054ba474357"><enum>(iii)</enum><text>building experts,
including architects, material suppliers, and construction contractors;</text>
</clause><clause id="idb9073fdd-e354-4507-a4ed-db9670e61e01"><enum>(iv)</enum><text>security advisors
focusing on national security needs, natural disasters, and other dire
emergency situations; and</text>
</clause><clause id="id3e76751f-1778-4055-adac-ff94d3292666"><enum>(v)</enum><text>environmental health
experts, including those with experience in children's health.</text>
</clause></subparagraph></paragraph><paragraph id="id7ABE33827B8F4E369DEA3E78AE992AD8"><enum>(2)</enum><header>Non-Federal
members</header><text>The total number of non-Federal members on the Committee
at any time shall not exceed 15.</text>
</paragraph></subsection><subsection commented="no" id="idbb75586a-9ba9-438b-bc1c-42a08fd7bda4"><enum>(c)</enum><header>Meetings</header><text>The
Director shall establish a regular schedule of meetings for the
Committee.</text>
</subsection><subsection id="id89bb4e71-461f-4193-8a25-835bb326a8d4"><enum>(d)</enum><header>Duties</header><text>The
Committee shall provide advice and expertise for use by the Director in
carrying out the duties under this Act, including such recommendations relating
to Federal activities carried out under sections 104 through 106 as are agreed
to by a majority of the members of the Committee.</text>
</subsection><subsection id="idcf82d134-5543-46fd-a601-02410b9722ac"><enum>(e)</enum><header>FACA
Exemption</header><text>The Committee shall not be subject to section 14 of the
Federal Advisory Committee Act (5 U.S.C. App.).</text>
</subsection></section><section id="id833d6859-eee1-40e9-a0a2-741fda4ce5aa"><enum>104.</enum><header>Public
outreach</header><text display-inline="no-display-inline">The Director, in
coordination with the Committee, shall carry out public outreach to inform
individuals and entities of the information and services available
Government-wide by—</text>
<paragraph id="id4456846f-17ba-4136-80ca-0cc0329f6505"><enum>(1)</enum><text>establishing and
maintaining a national high-performance green building clearinghouse, including
on the Internet, that—</text>
<subparagraph id="idb8620403-2d97-4c44-9cc1-e041f6c0edf8"><enum>(A)</enum><text>identifies existing
similar efforts and coordinates activities of common interest; and</text>
</subparagraph><subparagraph id="id55bae012-533a-48ff-8b71-24a61db69b7f"><enum>(B)</enum><text>provides information
relating to high-performance green buildings, including hyperlinks to Internet
sites that describe related activities, information, and resources of—</text>
<clause id="id7156303a-4352-4ef3-af69-de6df1aed871"><enum>(i)</enum><text>the Federal
Government;</text>
</clause><clause id="id9b72db58-7489-4ec1-b670-40675b774730"><enum>(ii)</enum><text>State and local
governments;</text>
</clause><clause id="id2f1582dc-0216-43f4-9a9f-208952754bbd"><enum>(iii)</enum><text>the private sector
(including nongovernmental and nonprofit entities and organizations);
and</text>
</clause><clause id="id300166c8-65f4-4ea0-b8c4-7367e3ba7eca"><enum>(iv)</enum><text>other relevant
organizations, including those from other countries;</text>
</clause></subparagraph></paragraph><paragraph id="id22fa5195-db94-444a-944f-78b8b052eff2"><enum>(2)</enum><text>identifying and
recommending educational resources for implementing high-performance green
building practices, including security and emergency benefits and
practices;</text>
</paragraph><paragraph id="id89119614-af23-4454-8e3e-9c79419ec750"><enum>(3)</enum><text>providing access to
technical assistance on using tools and resources to make more cost-effective,
energy-efficient, health-protective, and environmentally beneficial decisions
for constructing high-performance green buildings, including tools available to
conduct life-cycle costing and life-cycle assessment;</text>
</paragraph><paragraph id="idb8e9303c-0dd3-4756-9c27-e190c8587569"><enum>(4)</enum><text>providing information on
application processes for certifying a high-performance green building,
including certification and commissioning;</text>
</paragraph><paragraph id="idcbd47906-c4d2-4037-b47b-3865d6bcdbde"><enum>(5)</enum><text>providing technical
information, market research, or other forms of assistance or advice that would
be useful in planning and constructing high-performance green buildings;
and</text>
</paragraph><paragraph id="idf0f4d5b1-ca7c-4272-a722-c481a97af4fd"><enum>(6)</enum><text>using such other methods
as are determined by the Director to be appropriate.</text>
</paragraph></section><section id="id574d8b92-a61a-4187-8d14-59c5e4fe4280"><enum>105.</enum><header>Research and
development</header><text display-inline="no-display-inline">The Director, in
coordination with the Committee, shall—</text>
<paragraph id="id294eec75-422d-4420-a418-d988bc75fba6"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idc4def817-5db6-49aa-8802-d3538ed38e61"><enum>(A)</enum><text>survey existing
research and studies relating to high-performance green buildings; and</text>
</subparagraph><subparagraph changed="added" committee-id="SSEV00" id="id761dbb79-cb6b-4246-8206-3b6bf640af68" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>coordinate activities of
common interest;</text>
</subparagraph></paragraph><paragraph id="id798986f5-3060-410b-a251-866f4a7c6b78"><enum>(2)</enum><text>develop and recommend a
high-performance green building research plan that—</text>
<subparagraph id="id8dda10af-0154-4c8a-bc3a-27913d5d1d76"><enum>(A)</enum><text>identifies information
and research needs, including the relationships between human health, occupant
productivity, and each of—</text>
<clause id="ide515374c-bb6b-4ea4-ae0a-2900ff81f947"><enum>(i)</enum><text>emissions from materials
and products in the building;</text>
</clause><clause id="id1a94060f-2717-4252-ba76-41051d4f26b3"><enum>(ii)</enum><text>natural day
lighting;</text>
</clause><clause id="iddcb57102-7c9e-4813-bdd3-9a3ebbd2dd13"><enum>(iii)</enum><text>ventilation choices and
technologies;</text>
</clause><clause id="id21b159b6-9f29-43cd-8505-0374e1a4d4a4"><enum>(iv)</enum><text>heating, cooling, and
system control choices and technologies;</text>
</clause><clause id="id91ce8747-ca25-40c2-9cd0-9fd0c7cbe297"><enum>(v)</enum><text>moisture control and
mold;</text>
</clause><clause id="idae9002eb-d5ff-4456-ab37-3c346e537f4a"><enum>(vi)</enum><text>maintenance, cleaning,
and pest control activities;</text>
</clause><clause id="id78fe7c11-a795-46c1-ace7-a394de9360cd"><enum>(vii)</enum><text>acoustics; and</text>
</clause><clause id="ide0831a69-b0fa-4195-987e-dacea5480c38"><enum>(viii)</enum><text>other issues relating
to the health, comfort, productivity, and performance of occupants of the
building; and</text>
</clause></subparagraph><subparagraph id="id917efc00-0f78-4907-a646-f6dac18d8a98"><enum>(B)</enum><text>promotes the development
and dissemination of high-performance green building measurement tools that, at
a minimum, may be used—</text>
<clause id="id6cbb10d9-a2e3-4367-a7b5-7b07b76b58dd"><enum>(i)</enum><text>to monitor and assess the
life-cycle performance of facilities (including demonstration projects) built
as high-performance green buildings; and</text>
</clause><clause id="id83ede7ec-f22f-467a-bd63-612b0c8826b8"><enum>(ii)</enum><text>to perform life-cycle
assessments;</text>
</clause></subparagraph></paragraph><paragraph id="id1544b67a-bd9c-4587-8003-cfa12c47ca14"><enum>(3)</enum><text>assist the budget and
life-cycle costing functions of the Office under section 106;</text>
</paragraph><paragraph id="idaaa28f8c-b220-410b-ae68-0f1bab69a825"><enum>(4)</enum><text>study and identify
potential benefits of green buildings relating to security, natural disaster,
and emergency needs of the Federal Government; and</text>
</paragraph><paragraph id="id0a50943b-9298-4421-a46f-b1d637739e41"><enum>(5)</enum><text>support other research
initiatives determined by the Office.</text>
</paragraph></section><section id="idbc67ccea-c213-4625-a881-3b2d9e7a018f"><enum>106.</enum><header>Budget and life-cycle
costing and contracting</header>
<subsection id="id1ea30d57-96f3-49bd-b3b2-09cce3c477d6"><enum>(a)</enum><header>Establishment</header><text>The
Director, in coordination with the Committee, shall—</text>
<paragraph id="id64627288-0be2-4f9c-be8f-3ae4025cae58"><enum>(1)</enum><text>identify, review, and
analyze current budget and contracting practices that affect achievement of
high-performance green buildings, including the identification of barriers to
green building life-cycle costing and budgetary issues;</text>
</paragraph><paragraph id="ida7eaa191-d8e1-4b21-b549-be724e1d1f15"><enum>(2)</enum><text>develop guidance and
conduct training sessions with budget specialists and contracting personnel
from Federal agencies and budget examiners to apply life-cycle cost criteria to
actual projects;</text>
</paragraph><paragraph id="id36dd3722-ca04-4bef-9f3d-1df582174542"><enum>(3)</enum><text>identify tools to aid
life-cycle cost decisionmaking; and</text>
</paragraph><paragraph id="idf205694d-30b9-42ac-a56e-48712055f5d4"><enum>(4)</enum><text>explore the feasibility
of incorporating the benefits of green buildings, such as security benefits,
into a cost-budget analysis to aid in life-cycle costing for budget and
decision making processes.</text>
</paragraph></subsection></section><section id="idff68bd57-88a4-4418-a97b-63738a9465ef"><enum>107.</enum><header>Authorization of
appropriations</header><text display-inline="no-display-inline">There is
authorized to be appropriated to carry out this title $3,000,000 for each of
fiscal years 2008 through 2012, to remain available until expended.</text>
</section><enum>II</enum><header>Healthy High-Performance
Schools</header>
<section commented="no" id="idf3a4bba5-8b63-43e3-a4ec-e7847271d7cb"><enum>201.</enum><header>Definition of
high-performance school</header><text display-inline="no-display-inline">In
this title, the term <term>high-performance school</term> has the meaning given
the term <term>healthy, high-performance school building</term> in
<external-xref legal-doc="act" parsable-cite="ESEA/5586">section
5586</external-xref> of the <act-name parsable-cite="ESEA">Elementary and
Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7277e">20 U.S.C. 7277e</external-xref>).</text>
</section><section commented="no" id="idcd27edf9-2c22-44dd-9d25-dea72b2f6833"><enum>202.</enum><header>Grants for healthy
school environments</header><text display-inline="no-display-inline">The
Administrator of the Environmental Protection Agency, in consultation with the
Secretary of Education, may provide grants to qualified State agencies for use
in—</text>
<paragraph commented="no" id="ida2efc7b4-9062-4410-b602-3aaf85490d5f"><enum>(1)</enum><text>providing technical
assistance for programs of the Environmental Protection Agency (including the
Tools for Schools Program and the Healthy School Environmental Assessment Tool)
to schools for use in addressing environmental issues; and</text>
</paragraph><paragraph commented="no" id="idd9f870d8-e87f-4db1-9974-4e2e60b4a602"><enum>(2)</enum><text>development of State
school environmental quality plans that include—</text>
<subparagraph commented="no" id="idc21a33ee-3bd8-43d8-888a-8924d7c18cef"><enum>(A)</enum><text>standards for school
building design, construction, and renovation; and</text>
</subparagraph><subparagraph commented="no" id="idc7efa56f-4516-41dd-b6c7-ef9ee75a1809"><enum>(B)</enum><text>identification of ongoing
school building environmental problems in the State and recommended solutions
to address those problems, including assessment of information on the exposure
of children to environmental hazards in school facilities.</text>
</subparagraph></paragraph></section><section commented="no" id="id45748ca1-4c8e-43c6-88a8-1642388bf38d"><enum>203.</enum><header>Model guidelines for
siting of school facilities</header><text display-inline="no-display-inline">The Administrator of the Environmental
Protection Agency, in consultation with the Secretary of Education and the
Secretary of Health and Human Services, shall develop school site selection
guidelines that account for—</text>
<paragraph commented="no" id="id65bd9562-1c0b-417d-8ce8-0dcb8b5f791a"><enum>(1)</enum><text display-inline="yes-display-inline">the special vulnerability of children to
hazardous substances or pollution exposures in any case in which the potential
for contamination at a potential school site exists;</text>
</paragraph><paragraph commented="no" id="id402eae7a-d464-493c-9d4e-159fc531edfe"><enum>(2)</enum><text>modes of transportation
available to students and staff; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54a052a3-1991-4529-9332-f95fe6fdc5f0"><enum>(3)</enum><text>the potential use of a
school at the site as an emergency shelter.</text>
</paragraph></section><section commented="no" id="idF9D3A522975C46288EDE6CEF08E12A5C"><enum>204.</enum><header>Public
outreach</header>
<subsection commented="no" id="id4A7F55D5417D4508B771EF2ECB73D7E0"><enum>(a)</enum><header>In
general</header><text>The Administrator of the Environmental Protection Agency
shall provide to the Director information relating to all activities carried
out under this title, which the Director shall include in the report described
in section 102(c).</text>
</subsection><subsection commented="no" id="id1b016273-9aa0-4355-8bd6-258b7d3e1948"><enum>(b)</enum><header>Public
outreach</header><text>The Director shall ensure, to the maximum extent
practicable, that the public clearinghouse established under section 104
receives and makes available information on the exposure of children to
environmental hazards in school facilities, as provided by the Administrator of
the Environmental Protection Agency.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="idba9d4559-b695-4cba-b852-d570fed38715" section-type="subsequent-section"><enum>205.</enum><header>Authorization of
appropriations</header><text display-inline="no-display-inline">There is
authorized to be appropriated to carry out this title $5,000,000 for the period
of fiscal years 2008 through 2012, to remain available until expended.</text>
</section><enum>III</enum><header>Strengthening Federal
Leadership</header>
<section id="id3a858dd9-5d03-433f-9d74-8ed2dc153b32"><enum>301.</enum><header>Incentives</header><text display-inline="no-display-inline">As soon as practicable after the date of
enactment of this Act, the Director shall identify incentives to encourage the
use of green buildings and related technology in the operations of the Federal
Government, including through—</text>
<paragraph id="id9fa6fff4-971a-49eb-a22c-e122c33e2e4d"><enum>(1)</enum><text display-inline="yes-display-inline">the provision of recognition awards;
and</text>
</paragraph><paragraph id="idEC246B67FD3048B7A772D1093F000E0B"><enum>(2)</enum><text display-inline="yes-display-inline">the maximum feasible retention of financial
savings in the annual budgets of Federal agencies.</text>
</paragraph></section><section commented="no" id="id53e5387e-94d2-4437-a803-8409b1663125"><enum>302.</enum><header>Federal
procurement</header>
<subsection commented="no" id="idad2bbaf8-1e3b-47b6-84aa-70787b1c8226"><enum>(a)</enum><header>In
general</header><text>Not later than 2 years after the date of enactment of
this Act, the Director of the Office of Federal Procurement Policy, in
consultation with the Director and the Under Secretary of Defense for
Acquisition, Technology, and Logistics, shall promulgate revisions of the
applicable acquisition regulations, to take effect as of the date of
promulgation of the revisions—</text>
<paragraph commented="no" id="id19686145-8dbc-4ef7-963e-89052a1bbc36"><enum>(1)</enum><text>to direct any Federal
procurement executives involved in the acquisition, construction, or major
renovation (including contracting for the construction or major renovation) of
any facility, to the maximum extent practicable—</text>
<subparagraph commented="no" id="id2eae398f-1181-48a9-b50b-819b8f72f30a"><enum>(A)</enum><text>to employ integrated
design principles;</text>
</subparagraph><subparagraph commented="no" id="id9a3880d9-2acb-4390-a21a-614c9f1d562b"><enum>(B)</enum><text>to optimize building and
systems energy performance;</text>
</subparagraph><subparagraph commented="no" id="id97ba8352-242f-4d8f-8ac6-c5fb95805943"><enum>(C)</enum><text>to protect and conserve
water;</text>
</subparagraph><subparagraph commented="no" id="iddff9160d-2fef-4b5e-a0f3-320301aef766"><enum>(D)</enum><text>to enhance indoor
environmental quality; and</text>
</subparagraph><subparagraph commented="no" id="id852fd132-7c3e-474b-b8e2-3095f0a320e5"><enum>(E)</enum><text>to reduce environmental
impacts of materials and waste flows; and</text>
</subparagraph></paragraph><paragraph commented="no" id="id42a73ac3-dd48-4f1a-bb0b-af06bf9a1078"><enum>(2)</enum><text display-inline="yes-display-inline">to direct Federal procurement executives
involved in leasing buildings, to give preference to the lease of facilities
that, to the maximum extent practicable—</text>
<subparagraph commented="no" id="iddc75b705-57ff-4881-b4c4-932aebf73d0c"><enum>(A)</enum><text>are energy-efficient;
and</text>
</subparagraph><subparagraph commented="no" id="idc3ec3097-388e-4830-a315-da38ac0046c6"><enum>(B)</enum><text>have applied contemporary
high-performance and sustainable design principles during construction or
renovation.</text>
</subparagraph></paragraph></subsection><subsection commented="no" id="idC4C03B55AADE45D9948F6093FFC0B851"><enum>(b)</enum><header>Guidance</header><text>Not
later than 90 days after the date of promulgation of the revised regulations
under subsection (a), the Director shall issue guidance to all Federal
procurement executives providing direction and the option to renegotiate the
design of proposed facilities, renovations for existing facilities, and leased
facilities to incorporate improvements that are consistent with this
section.</text>
</subsection></section><section id="id91087931-2157-4e5e-b60c-66bdbd7ce5b1"><enum>303.</enum><header> Federal green
building performance</header>
<subsection id="id40127196-ae22-4b70-9d16-756ce32a492f"><enum>(a)</enum><header>In
general</header><text>Not later than October 31 of each of the 2 fiscal years
following the fiscal year in which this Act is enacted, and at such times
thereafter as the Comptroller General of the United States determines to be
appropriate, the Comptroller General of the United States shall, with respect
to the fiscal years that have passed since the preceding report—</text>
<paragraph id="id8390eb5c-0273-420f-a9fe-e56f59207fe8"><enum>(1)</enum><text>conduct an audit of the
implementation of this Act; and</text>
</paragraph><paragraph id="idef02b681-d929-4a31-90ab-dff8d97f1af9"><enum>(2)</enum><text>submit to the Office, the
Committee, the Administrator, and Congress a report describing the results of
the audit.</text>
</paragraph></subsection><subsection id="ida61fb435-8d21-4ecd-93ef-6702f6dc9dad"><enum>(b)</enum><header>Contents</header><text>An
audit under subsection (a) shall include a review, with respect to the period
covered by the report under subsection (a)(2), of—</text>
<paragraph id="idcf85562a-ab88-49ba-9480-a521e2eee787"><enum>(1)</enum><text>budget, life-cycle
costing, and contracting issues, using best practices identified by the
Comptroller General of the United States and heads of other agencies in
accordance with section 106;</text>
</paragraph><paragraph id="idef5c0204-1da4-4b40-bb96-0fa488bb6e13"><enum>(2)</enum><text>the level of coordination
among the Office, the Office of Management and Budget, and relevant
agencies;</text>
</paragraph><paragraph id="idc12debd3-147d-4e36-9abc-6adbcfbfd553"><enum>(3)</enum><text>the performance of the
Office in carrying out the implementation plan;</text>
</paragraph><paragraph id="id0d53fdc5-fc92-4c79-9a05-0bc1a47aff41"><enum>(4)</enum><text>the design stage of
high-performance green building measures;</text>
</paragraph><paragraph id="id8a784b7b-28a2-47c9-a737-e57c1b1fcda4"><enum>(5)</enum><text>high-performance building
data that were collected and reported to the Office; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddb01d5ae-87f9-4bdf-aa90-d216318890a2"><enum>(6)</enum><text>such other matters as the
Comptroller General of the United States determines to be appropriate.</text>
</paragraph></subsection><subsection commented="no" id="idb15c3cab-f219-4657-b5c2-6c71b3f1ffe8"><enum>(c)</enum><header>Environmental
Stewardship Scorecard</header><text>The Director shall consult with the
Committee to enhance, and assist in the implementation of, the Environmental
Stewardship Scorecard announced at the White House summit on Federal
sustainable buildings in January 2006, to measure the implementation by each
Federal agency of sustainable design and green building initiatives.</text>
</subsection></section><enum>IV</enum><header>Demonstration
project</header>
<section id="id534f4aad-7eec-4e7a-8b88-9472d2f9549d"><enum>401.</enum><header>Coordination of
goals</header>
<subsection id="id9b8e2290-b025-4166-8433-e35eccc4fe3d"><enum>(a)</enum><header>In
general</header><text>The Director shall establish guidelines to implement a
demonstration project to contribute to the research goals of the Office.</text>
</subsection><subsection id="id968bd2c8-a2c9-40fc-a621-730c468738cb"><enum>(b)</enum><header>Projects</header><text>In
accordance with guidelines established by the Director under subsection (a) and
the duties of the Director described in title I, the Director shall carry out a
demonstration project, in a Federal building in the State of Vermont in
accordance with subsection (c), that—</text>
<paragraph id="idba1a6bd7-4731-4331-b194-7b3450a52491"><enum>(1)</enum><text>provides for the
evaluation of the information obtained through the conduct of projects and
activities under this Act; and</text>
</paragraph><paragraph id="id43cec629-b60d-4d90-9ab7-4090eb13962b"><enum>(2)</enum><text>achieves a platinum
rating, as defined by the Leadership in Energy and Environmental Design
Building Rating System standard established by the United States Green Building
Council (or an equivalent rating obtained through a comparable system).</text>
</paragraph></subsection><subsection id="id3bddde1e-5137-4001-ac6f-04846e694ed0"><enum>(c)</enum><header>Criteria</header><text>With
respect to the existing or proposed Federal facility at which a demonstration
project under this section is conducted, the Federal facility shall—</text>
<paragraph id="id69a97f74-8739-48f6-a42c-8b6a38a7acc8"><enum>(1)</enum><text>be an appropriate model
for a project relating to—</text>
<subparagraph id="iddc394212-a802-41a7-b1f8-07220a43b3ba"><enum>(A)</enum><text>the effectiveness of
high-performance technologies;</text>
</subparagraph><subparagraph id="id52095b6f-7b69-4ad9-94d5-882839944dbf"><enum>(B)</enum><text>analysis of materials,
components, and systems, including the impact on the health of building
occupants;</text>
</subparagraph><subparagraph id="id5159bcda-1dbc-47ef-a8d0-98ea87b91c1d"><enum>(C)</enum><text>life-cycle costing and
life-cycle assessment of building materials and systems; and</text>
</subparagraph><subparagraph id="id4d6a5a3c-bb82-4f8b-9068-8278f04f2fa5"><enum>(D)</enum><text>location and design that
promote access to the Federal facility through walking, biking, and mass
transit; and</text>
</subparagraph></paragraph><paragraph id="ided17c09c-149f-43fc-9456-1f357f4f6840"><enum>(2)</enum><text>possess sufficient
technological and organizational adaptability.</text>
</paragraph></subsection><subsection id="id99f32d52-a64c-46e5-9b79-a43a72bc8916"><enum>(d)</enum><header>Report</header><text>Not
later than 1 year after the date of enactment of this Act, and annually
thereafter through September 30, 2013, the Director shall submit to the
Administrator a report that describes the status of and findings regarding the
demonstration project.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="idbbde3a80-7468-4255-aab3-71deff227956" section-type="subsequent-section"><enum>402.</enum><header>Authorization of
appropriations</header><text display-inline="no-display-inline">There is
authorized to be appropriated to carry out the Federal demonstration project
described in section 401(b) $5,000,000 for the period of fiscal years 2008
through 2012, to remain available until expended.</text>
