			 Immigration and Nationality Act</header><text display-inline="no-display-inline">Except as otherwise expressly provided,
			 whenever in this Act an amendment or repeal is expressed in terms of an
			 amendment to, or repeal of, a section or other provision, the reference shall
			 be considered to be made to a section or other provision of the Immigration and
			 Nationality Act (8 U.S.C. 1101 et seq.).</text>
		</section><section id="idB2919DB3766E4DE2B7640AB08EB79682"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id096F7DF12EB344A1AF9F1B716E5430F7"><enum>(1)</enum><header>Department</header><text>Except
			 as otherwise provided, the term <term>Department</term> means the Department of
			 Homeland Security.</text>
			</paragraph><paragraph id="idF222DFCC73CB4C75BEF49DD02167D01E"><enum>(2)</enum><header>Secretary</header><text>Except
			 as otherwise provided, the term <term>Secretary</term> means the Secretary of
			 Homeland Security.</text>
			</paragraph></section><section id="id0670E4B1EB444C0C8851AD6FB3E094E9"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, any amendment
			 made by this Act, or the application of such provision or amendment to any
			 person or circumstance is held to be invalid for any reason, the remainder of
			 this Act, the amendments made by this Act, and the application of the
			 provisions of such to any other person or circumstance shall not be affected by
			 such holding.</text>
		</section><title id="ID2A2FFD423CF1436F9DD8452E745E0A39"><enum>I</enum><header>Border
			 Enforcement</header>
			<subtitle id="ID986C5EFC122F474396415A5935A65A5B"><enum>A</enum><header>Assets for
			 Controlling United States Borders</header>
				<section id="IDF7325C3BB99A479F99C86F741881D245"><enum>101.</enum><header>Enforcement
			 personnel</header>
					<subsection id="ID7BB3AFA1A4F64263A86AA700E8862AE2"><enum>(a)</enum><header>Additional
			 personnel</header>
						<paragraph id="IDED300E7919FD46CB9471AE5B31729325"><enum>(1)</enum><header>Port of entry
			 inspectors</header><text>In each of the fiscal years 2007 through 2011, the
			 Secretary shall, subject to the availability of appropriations, increase by not
			 less than 500 the number of positions for full-time active duty port of entry
			 inspectors and provide appropriate training, equipment, and support to such
			 additional inspectors.</text>
						</paragraph><paragraph id="ID4B91CE089AA6476FBB7E55EF621D15A4"><enum>(2)</enum><header>Investigative
			 personnel</header>
							<subparagraph id="IDB7D67CAE44E44E928492A86A536C0F1B"><enum>(A)</enum><header>Immigration and
			 customs enforcement investigators</header><text>Section 5203 of the
			 Intelligence Reform and Terrorism Prevention Act of 2004 (Public Law 108–458;
			 118 Stat. 3734) is amended by striking <quote>800</quote> and inserting
			 <quote>1000</quote>.</text>
							</subparagraph><subparagraph id="IDFEDD33F817454D2B9873A193157EEF3C"><enum>(B)</enum><header>Additional
			 personnel</header><text>In addition to the positions authorized under section
			 5203 of the Intelligence Reform and Terrorism Prevention Act of 2004, as
			 amended by subparagraph (A), during each of the fiscal years 2007 through 2011,
			 the Secretary shall, subject to the availability of appropriations, increase by
			 not less than 200 the number of positions for personnel within the Department
			 assigned to investigate alien smuggling.</text>
							</subparagraph></paragraph><paragraph id="IDAC5500CA8CE34058A9B8E067941EE49E"><enum>(3)</enum><header>Deputy united
			 states marshals</header><text>In each of the fiscal years 2007 through 2011,
			 the Attorney General shall, subject to the availability of appropriations,
			 increase by not less than 50 the number of positions for full-time active duty
			 Deputy United States Marshals that investigate criminal matters related to
			 immigration.</text>
						</paragraph><paragraph id="IDDA3AE2A825314D6FA7CDB6582F3DAA8D"><enum>(4)</enum><header>Recruitment of
			 former military personnel</header>
							<subparagraph id="ID3657793DDCFB47A1BF8DF5B0082F3C0C"><enum>(A)</enum><header>In
			 general</header><text>The Commissioner of United States Customs and Border
			 Protection, in conjunction with the Secretary of Defense or a designee of the
			 Secretary of Defense, shall establish a program to actively recruit members of
			 the Army, Navy, Air Force, Marine Corps, and Coast Guard who have elected to
			 separate from active duty.</text>
							</subparagraph><subparagraph id="ID6512EDCCDA65486596B60C6107F37DF6"><enum>(B)</enum><header>Report</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the
			 Commissioner shall submit a report on the implementation of the recruitment
			 program established pursuant to subparagraph (A) to the Committee on the
			 Judiciary of the Senate and the Committee on the Judiciary of the House of
			 Representatives.</text>
							</subparagraph></paragraph></subsection><subsection id="ID23E7F2F122D946FAB955D88A1D9EEAE2"><enum>(b)</enum><header>Authorization
			 of Appropriations</header>
						<paragraph id="ID92D4B8B4469D48B7ACDD94ACB3227662"><enum>(1)</enum><header>Port of entry
			 inspectors</header><text>There are authorized to be appropriated to the
			 Secretary such sums as may be necessary for each of the fiscal years 2007
			 through 2011 to carry out subsection (a)(1).</text>
						</paragraph><paragraph id="ID146447105A1143C2BD36DF3D1D353334"><enum>(2)</enum><header>Deputy united
			 states marshals</header><text>There are authorized to be appropriated to the
			 Attorney General such sums as may be necessary for each of the fiscal years
			 2007 through 2011 to carry out subsection (a)(3).</text>
						</paragraph><paragraph id="IDF1BEA1A7817242468E2EE52C36968A22"><enum>(3)</enum><header>Border patrol
			 agents</header><text>Section 5202 of the Intelligence Reform and Terrorism
			 Prevention Act of 2004 (118 Stat. 3734) is amended to read as follows:</text>

								<section id="ID389F7EACC3154333840FC7E51C0E72AD"><enum>5202.</enum><header>Increase in
				Full-Time border patrol agents</header>
									<subsection id="IDE9FD722EAB6D488296506873BCD41A4D"><enum>(a)</enum><header>Annual
				Increases</header><text>The Secretary of Homeland Security shall, subject to
				the availability of appropriations for such purpose, increase the number of
				positions for full-time active-duty border patrol agents within the Department
				of Homeland Security (above the number of such positions for which funds were
				appropriated for the preceding fiscal year), by—</text>
										<paragraph id="ID0732832098164BCCB017AAA9C3CE8DAA"><enum>(1)</enum><text>2,000 in fiscal
				year 2006;</text>
										</paragraph><paragraph id="IDCBE48806B9C64B00A6C0A9A7D59947C6"><enum>(2)</enum><text>2,400 in fiscal
				year 2007;</text>
										</paragraph><paragraph id="ID61A2CB9FFDBA4B89A48AF2FA4834E89F"><enum>(3)</enum><text>2,400 in fiscal
				year 2008;</text>
										</paragraph><paragraph id="ID51C9D9812EC940439C80E40EF4604182"><enum>(4)</enum><text>2,400 in fiscal
				year 2009;</text>
										</paragraph><paragraph id="ID2AE11464BC664BA2BC258E816656B807"><enum>(5)</enum><text>2,400 in fiscal
				year 2010; and</text>
										</paragraph><paragraph id="IDCC2CAA18D10F47C28266E2F9FA47400A"><enum>(6)</enum><text>2,400 in fiscal
				year 2011.</text>
										</paragraph></subsection><subsection id="IDD0B72F3458934FCEB81B477131F09337"><enum>(b)</enum><header>Northern
				Border</header><text>In each of the fiscal years 2006 through 2011, in addition
				to the border patrol agents assigned along the northern border of the United
				States during the previous fiscal year, the Secretary shall assign a number of
				border patrol agents equal to not less than 20 percent of the net increase in
				border patrol agents during each such fiscal year.</text>
									</subsection><subsection id="IDA4079A171A38485289909BE71659A6EB"><enum>(c)</enum><header>Authorization
				of Appropriations</header><text>There are authorized to be appropriated such
				sums as may be necessary for each of fiscal years 2007 through 2011 to carry
				out this
				section.</text>
									</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section><section id="ID38F42AA836BA4AD0B37F650BE285F258"><enum>102.</enum><header>Technological
			 assets</header>
					<subsection id="IDEF9A1EFEE360449B8CFB3F76859F96B9"><enum>(a)</enum><header>Acquisition</header><text>Subject
			 to the availability of appropriations, the Secretary shall procure additional
			 unmanned aerial vehicles, cameras, poles, sensors, and other technologies
			 necessary to achieve operational control of the international borders of the
			 United States and to establish a security perimeter known as a <quote>virtual
			 fence</quote> along such international borders to provide a barrier to illegal
			 immigration.</text>
					</subsection><subsection id="ID5F822E27C9394C15BCE7916DE985C4EF"><enum>(b)</enum><header>Increased
			 Availability of Equipment</header><text>The Secretary and the Secretary of
			 Defense shall develop and implement a plan to use authorities provided to the
			 Secretary of Defense under chapter 18 of title 10, United States Code, to
			 increase the availability and use of Department of Defense equipment, including
			 unmanned aerial vehicles, tethered aerostat radars, and other surveillance
			 equipment, to assist the Secretary in carrying out surveillance activities
			 conducted at or near the international land borders of the United States to
			 prevent illegal immigration.</text>
					</subsection><subsection id="IDFD4178B1C99C4A5BA4570C150938D3DE"><enum>(c)</enum><header>Report</header><text>Not
			 later than 6 months after the date of enactment of this Act, the Secretary and
			 the Secretary of Defense shall submit to Congress a report that
			 contains—</text>
						<paragraph id="IDCD36DAF4C718466D80A16A241E3E91BB"><enum>(1)</enum><text>a description of
			 the current use of Department of Defense equipment to assist the Secretary in
			 carrying out surveillance of the international land borders of the United
			 States and assessment of the risks to citizens of the United States and foreign
			 policy interests associated with the use of such equipment;</text>
						</paragraph><paragraph id="ID74551F41DA504A5C954E56F769BE52D3"><enum>(2)</enum><text>the plan
			 developed under subsection (b) to increase the use of Department of Defense
			 equipment to assist such surveillance activities; and</text>
						</paragraph><paragraph id="ID36FC1727D83642FF90E378AED931B7A4"><enum>(3)</enum><text>a description of
			 the types of equipment and other support to be provided by the Secretary of
			 Defense under such plan during the 1-year period beginning on the date of the
			 submission of the report.</text>
						</paragraph></subsection><subsection id="ID4886CD7855394E1890D118A111C36D90"><enum>(d)</enum><header>Authorization
			 of Appropriations</header><text>There are authorized to be appropriated to the
			 Secretary such sums as may be necessary for each of the fiscal years 2007
			 through 2011 to carry out subsection (a).</text>
					</subsection><subsection id="ID2494982CBF134905820FBD6A3659798D"><enum>(e)</enum><header>Unmanned Aerial
			 Vehicle Pilot Program</header><text>During the 1-year period beginning on the
			 date on which the report is submitted under subsection (c), the Secretary shall
			 conduct a pilot program to test unmanned aerial vehicles for border
			 surveillance along the international border between Canada and the United
			 States.</text>
					</subsection><subsection id="ID737A3929A5804D689473DBD6FB43E4C1"><enum>(f)</enum><header>Construction</header><text>Nothing
			 in this section may be construed as altering or amending the prohibition on the
			 use of any part of the Army or the Air Force as a posse comitatus under section
			 1385 of title 18, United States Code.</text>
					</subsection></section><section id="ID74DD743DE34C4B8D938F8001A562ECB2"><enum>103.</enum><header>Infrastructure</header>
					<subsection id="ID67BE547EBD474F409D63B2B4532D674B"><enum>(a)</enum><header>Construction of
			 Border Control Facilities</header><text>Subject to the availability of
			 appropriations, the Secretary shall construct all-weather roads and acquire
			 additional vehicle barriers and facilities necessary to achieve operational
			 control of the international borders of the United States.</text>
					</subsection><subsection id="ID27172ADFA16243E38E4D002DF8C50082"><enum>(b)</enum><header>Authorization
			 of Appropriations</header><text>There are authorized to be appropriated to the
			 Secretary such sums as may be necessary for each of the fiscal years 2007
			 through 2011 to carry out subsection (a).</text>
					</subsection></section><section id="IDAB05F5B6DC7D4C9B82B6F28538A8190E"><enum>104.</enum><header>Border patrol
			 checkpoints</header><text display-inline="no-display-inline">The Secretary may
			 maintain temporary or permanent checkpoints on roadways in border patrol
			 sectors that are located in proximity to the international border between the
			 United States and Mexico.</text>
				</section><section id="ID6A11F7B6B7E443D98FB778724EE655A1"><enum>105.</enum><header>Ports of
			 entry</header><text display-inline="no-display-inline">The Secretary is
			 authorized to—</text>
					<paragraph id="ID8F3480A23DD8452BB8903CFCB38771BF"><enum>(1)</enum><text>construct
			 additional ports of entry along the international land borders of the United
			 States, at locations to be determined by the Secretary; and</text>
					</paragraph><paragraph id="IDDD66B765B50D4299A7DA53D8BD20544E"><enum>(2)</enum><text>make necessary
			 improvements to the ports of entry in existence on the date of the enactment of
			 this Act.</text>
					</paragraph></section><section id="ID6E01171C668143C2A7BCB954AD14B88B"><enum>106.</enum><header>Construction
			 of strategic border fencing and vehicle barriers</header>
					<subsection id="IDEEC12433FEFD49F99FD58101166CB14F"><enum>(a)</enum><header>Tucson
			 Sector</header><text>The Secretary shall—</text>
						<paragraph id="IDF9922B80A2E0454F82C2C73CC1FFB0DA"><enum>(1)</enum><text>replace all aged,
			 deteriorating, or damaged primary fencing in the Tucson Sector located
			 proximate to population centers in Douglas, Nogales, Naco, and Lukeville,
			 Arizona with double- or triple-layered fencing running parallel to the
			 international border between the United States and Mexico;</text>
						</paragraph><paragraph id="ID266F7A4CFD614CF0BD44352A4CF238C5"><enum>(2)</enum><text>extend the
			 double- or triple-layered fencing for a distance of not less than 2 miles
			 beyond urban areas, except that the double- or triple-layered fence shall
			 extend west of Naco, Arizona, for a distance of 10 miles; and</text>
						</paragraph><paragraph id="IDFBAF9E77EF004268A495599A562E2324"><enum>(3)</enum><text>construct not
			 less than 150 miles of vehicle barriers and all-weather roads in the Tucson
			 Sector running parallel to the international border between the United States
			 and Mexico in areas that are known transit points for illegal cross-border
			 traffic.</text>
						</paragraph></subsection><subsection id="ID6018AFF428E84774B6D3EDF92E0A7EAD"><enum>(b)</enum><header>Yuma
			 Sector</header><text>The Secretary shall—</text>
						<paragraph id="ID8AD3AEC8E0D54B5B91BE9B22418F4C5D"><enum>(1)</enum><text>replace all aged,
			 deteriorating, or damaged primary fencing in the Yuma Sector located proximate
			 to population centers in Yuma, Somerton, and San Luis, Arizona with double- or
			 triple-layered fencing running parallel to the international border between the
			 United States and Mexico;</text>
						</paragraph><paragraph id="IDEB5548FF9E4147DC889B4B68907D4F02"><enum>(2)</enum><text>extend the
			 double- or triple-layered fencing for a distance of not less than 2 miles
			 beyond urban areas in the Yuma Sector; and</text>
						</paragraph><paragraph id="ID6FB1D557896A4E14968335FA5ED2ED14"><enum>(3)</enum><text>construct not
			 less than 50 miles of vehicle barriers and all-weather roads in the Yuma Sector
			 running parallel to the international border between the United States and
			 Mexico in areas that are known transit points for illegal cross-border
			 traffic.</text>
						</paragraph></subsection><subsection id="ID99D020CFCFC34569B7425730F5AD37A2"><enum>(c)</enum><header>Other High
			 Trafficked Areas</header><text>The Secretary shall construct not less than 370
			 miles of triple-layered fencing which may include portions already constructed
			 in San Diego Tucson and Yuma Sectors, and 500 miles of vehicle barriers in
			 other areas along the southwest border that the Secretary determines are areas
			 that are most often used by smugglers and illegal aliens attempting to gain
			 illegal entry into the United States.</text>
					</subsection><subsection id="ID274C7AD31D4D417E9997065D15D7C9CF"><enum>(d)</enum><header>Construction
			 Deadline</header><text>The Secretary shall immediately commence construction of
			 the fencing, barriers, and roads described in subsections (a), (b), and (c) and
			 shall complete such construction not later than 2 years after the date of the
			 enactment of this Act.</text>
					</subsection><subsection id="ID1C9B67F35629428FB017175B1980075F"><enum>(e)</enum><header>Report</header><text>Not
			 later than 1 year after the date of the enactment of this Act, the Secretary
			 shall submit a report to the Committee on the Judiciary of the Senate and the
			 Committee on the Judiciary of the House of Representatives that describes the
			 progress that has been made in constructing the fencing, barriers, and roads
			 described in subsections (a), (b), and (c).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID79127C58394941FD9103529752A2C00B"><enum>(f)</enum><header>Authorization
			 of Appropriations</header><text>There are authorized to be appropriated such
			 sums as may be necessary to carry out this section.</text>
					</subsection></section></subtitle><subtitle id="ID9D9E24B1965845328761852001E51EA5"><enum>B</enum><header>Border Security
			 Plans, Strategies, and Reports</header>
				<section id="ID47CBD5D002604C6EA50436BFCB48C1B7"><enum>111.</enum><header>Surveillance
			 plan</header>
					<subsection id="ID2B5AB33043644A9F814B5A4BD21F45C1"><enum>(a)</enum><header>Requirement for
			 Plan</header><text>The Secretary shall develop a comprehensive plan for the
			 systematic surveillance of the international land and maritime borders of the
			 United States.</text>
					</subsection><subsection id="ID9915D5D75DFE4D5CAF71E68667F3BCDB"><enum>(b)</enum><header>Content</header><text>The
			 plan required by subsection (a) shall include the following:</text>
						<paragraph id="IDC8C53C8B54CD4BACA603A17C9993E1E5"><enum>(1)</enum><text>An assessment of
			 existing technologies employed on the international land and maritime borders
			 of the United States.</text>
						</paragraph><paragraph id="ID94A34343A30446D091447EB97BBD10B4"><enum>(2)</enum><text>A description of
			 the compatibility of new surveillance technologies with surveillance
			 technologies in use by the Secretary on the date of the enactment of this
			 Act.</text>
						</paragraph><paragraph id="ID694555E5AC004C5EB3E7451A10DB765F"><enum>(3)</enum><text>A description of
			 how the Commissioner of the United States Customs and Border Protection of the
			 Department is working, or is expected to work, with the Under Secretary for
			 Science and Technology of the Department to identify and test surveillance
			 technology.</text>
						</paragraph><paragraph id="ID0FC71D1C9E9548EE80B246B80310F8BE"><enum>(4)</enum><text>A description of
			 the specific surveillance technology to be deployed.</text>
						</paragraph><paragraph id="IDB104890716814C3387F35FE47EABBB37"><enum>(5)</enum><text>Identification of
			 any obstacles that may impede such deployment.</text>
						</paragraph><paragraph id="IDB8524DFEC90F49AC8CEB9F62E908C899"><enum>(6)</enum><text>A detailed
			 estimate of all costs associated with such deployment and with continued
			 maintenance of such technologies.</text>
						</paragraph><paragraph id="ID964CE7B5E4474FEB8336A350B53B9C00"><enum>(7)</enum><text>A description of
			 how the Secretary is working with the Administrator of the Federal Aviation
			 Administration on safety and airspace control issues associated with the use of
			 unmanned aerial vehicles.</text>
						</paragraph></subsection><subsection id="IDE3344BAC73444D748A76C1C3D33F583A"><enum>(c)</enum><header>Submission to
			 Congress</header><text>Not later than 6 months after the date of the enactment
			 of this Act, the Secretary shall submit to Congress the plan required by this
			 section.</text>
					</subsection></section><section id="IDD18FB86E8E96499D8396D854E045ABFB"><enum>112.</enum><header>National
			 Strategy for Border Security</header>
					<subsection id="ID7A38F8ECECC748CBA0CDF4D51774B671"><enum>(a)</enum><header>Requirement for
			 Strategy</header><text>The Secretary, in consultation with the heads of other
			 appropriate Federal agencies, shall develop a National Strategy for Border
			 Security that describes actions to be carried out to achieve operational
			 control over all ports of entry into the United States and the international
			 land and maritime borders of the United States.</text>
					</subsection><subsection id="IDE954B86B762C4F039A968AD6B449200D"><enum>(b)</enum><header>Content</header><text>The
			 National Strategy for Border Security shall include the following:</text>
						<paragraph id="IDD5E09FA03C894E27992DC7E194CE2F92"><enum>(1)</enum><text>The
			 implementation schedule for the comprehensive plan for systematic surveillance
			 described in section 111.</text>
						</paragraph><paragraph id="ID4EC1425C67884ED68B74E9493A7443CF"><enum>(2)</enum><text>An assessment of
			 the threat posed by terrorists and terrorist groups that may try to infiltrate
			 the United States at locations along the international land and maritime
			 borders of the United States.</text>
						</paragraph><paragraph id="ID89578166733941AFAD2EB82B4492A1DD"><enum>(3)</enum><text>A risk assessment
			 for all United States ports of entry and all portions of the international land
			 and maritime borders of the United States that includes a description of
			 activities being undertaken—</text>
							<subparagraph id="IDD17A89FA0CEC4B928BDF9DDBB98F2C2C"><enum>(A)</enum><text>to prevent the
			 entry of terrorists, other unlawful aliens, instruments of terrorism,
			 narcotics, and other contraband into the United States; and</text>
							</subparagraph><subparagraph id="IDCBB619F8C5854D58921F4844715AC6E3"><enum>(B)</enum><text>to protect
			 critical infrastructure at or near such ports of entry or borders.</text>
							</subparagraph></paragraph><paragraph id="ID55710625D0B54A758D568E10190B17EF"><enum>(4)</enum><text>An assessment of
			 the legal requirements that prevent achieving and maintaining operational
			 control over the entire international land and maritime borders of the United
			 States.</text>
						</paragraph><paragraph id="ID9F88C3A06CD64C6CA92E82AA5D575F85"><enum>(5)</enum><text>An assessment of
			 the most appropriate, practical, and cost-effective means of defending the
			 international land and maritime borders of the United States against threats to
			 security and illegal transit, including intelligence capacities, technology,
			 equipment, personnel, and training needed to address security
			 vulnerabilities.</text>
						</paragraph><paragraph id="IDAD9D18440B1F4DD580DE2ABAC747E3D9"><enum>(6)</enum><text>An assessment of
			 staffing needs for all border security functions, taking into account threat
			 and vulnerability information pertaining to the borders and the impact of new
			 security programs, policies, and technologies.</text>
						</paragraph><paragraph id="ID28963772FD414A4BA01B1FED866E7189"><enum>(7)</enum><text>A description of
			 the border security roles and missions of Federal, State, regional, local, and
			 tribal authorities, and recommendations regarding actions the Secretary can
			 carry out to improve coordination with such authorities to enable border
			 security and enforcement activities to be carried out in a more efficient and
			 effective manner.</text>
						</paragraph><paragraph id="ID242AC70711D349EBA13059E129812856"><enum>(8)</enum><text>An assessment of
			 existing efforts and technologies used for border security and the effect of
			 the use of such efforts and technologies on civil rights, personal property
			 rights, privacy rights, and civil liberties, including an assessment of efforts
			 to take into account asylum seekers, trafficking victims, unaccompanied minor
			 aliens, and other vulnerable populations.</text>
						</paragraph><paragraph id="ID3D5137910BCA45308FC69BA4B633D6B0"><enum>(9)</enum><text>A prioritized
			 list of research and development objectives to enhance the security of the
			 international land and maritime borders of the United States.</text>
						</paragraph><paragraph id="ID8F35A6EB722B434CAF39E3A94625CB16"><enum>(10)</enum><text>A description of
			 ways to ensure that the free flow of travel and commerce is not diminished by
			 efforts, activities, and programs aimed at securing the international land and
			 maritime borders of the United States.</text>
						</paragraph><paragraph id="IDF978B99648BA4F32917674441CC49043"><enum>(11)</enum><text>An assessment of
			 additional detention facilities and beds that are needed to detain unlawful
			 aliens apprehended at United States ports of entry or along the international
			 land borders of the United States.</text>
						</paragraph><paragraph id="ID765674E207324C0E95680DA5D0187C6D"><enum>(12)</enum><text>A description of
			 the performance metrics to be used to ensure accountability by the bureaus of
			 the Department in implementing such Strategy.</text>
						</paragraph><paragraph id="IDBD8C485F841B4AEF8EFE6263C281B290"><enum>(13)</enum><text>A schedule for
			 the implementation of the security measures described in such Strategy,
			 including a prioritization of security measures, realistic deadlines for
			 addressing the security and enforcement needs, an estimate of the resources
			 needed to carry out such measures, and a description of how such resources
			 should be allocated.</text>
						</paragraph></subsection><subsection id="ID4609890839C64F9C8FC9BE5022C6C1B9"><enum>(c)</enum><header>Consultation</header><text>In
			 developing the National Strategy for Border Security, the Secretary shall
			 consult with representatives of—</text>
						<paragraph id="ID70211B272A2540EC8DA601BB08D4139A"><enum>(1)</enum><text>State, local, and
			 tribal authorities with responsibility for locations along the international
			 land and maritime borders of the United States; and</text>
						</paragraph><paragraph id="IDDD0A4E27BCAE4BC4A0BF53FE69B0F074"><enum>(2)</enum><text>appropriate
			 private sector entities, nongovernmental organizations, and affected
			 communities that have expertise in areas related to border security.</text>
						</paragraph></subsection><subsection id="ID2C8C125C10244632BCC59534A29B1C37"><enum>(d)</enum><header>Coordination</header><text>The
			 National Strategy for Border Security shall be consistent with the National
			 Strategy for Maritime Security developed pursuant to Homeland Security
			 Presidential Directive 13, dated December 21, 2004.</text>
					</subsection><subsection id="IDBE9C3FA47CE043328A1C4E8E2E6071A9"><enum>(e)</enum><header>Submission to
			 Congress</header>
						<paragraph id="IDA1AF00A8EC9E43ADBA1595A71D9ABAFE"><enum>(1)</enum><header>Strategy</header><text>Not
			 later than 1 year after the date of the enactment of this Act, the Secretary
			 shall submit to Congress the National Strategy for Border Security.</text>
						</paragraph><paragraph id="IDAA8FCD9C9ADC4BC5A3A875163D38CA09"><enum>(2)</enum><header>Updates</header><text>The
			 Secretary shall submit to Congress any update of such Strategy that the
			 Secretary determines is necessary, not later than 30 days after such update is
			 developed.</text>
						</paragraph></subsection><subsection id="IDB0DABBB1C03E4C4AA3A4B7DBCD176193"><enum>(f)</enum><header>Immediate
			 action</header><text>Nothing in this section or section 111 may be construed to
			 relieve the Secretary of the responsibility to take all actions necessary and
			 appropriate to achieve and maintain operational control over the entire
			 international land and maritime borders of the United States.</text>
					</subsection></section><section id="ID1CE7F77C968241CA9D443DFDC9BA9DE9"><enum>113.</enum><header>Reports on
			 improving the exchange of information on North American security</header>
					<subsection id="ID93E0C53745C6450DB8F4A21AA308BEF8"><enum>(a)</enum><header>Requirement for
			 Reports</header><text>Not later than 1 year after the date of the enactment of
			 this Act, and annually thereafter, the Secretary of State, in coordination with
			 the Secretary and the heads of other appropriate Federal agencies, shall submit
			 to Congress a report on improving the exchange of information related to the
			 security of North America.</text>
					</subsection><subsection id="ID50FC7BA5592D4E32B841A6ED92D3618A"><enum>(b)</enum><header>Contents</header><text>Each
			 report submitted under subsection (a) shall contain a description of the
			 following:</text>
						<paragraph id="ID0E8D890C28704A67989A6D18ABAD45AD"><enum>(1)</enum><header>Security
			 clearances and document integrity</header><text>The progress made toward the
			 development of common enrollment, security, technical, and biometric standards
			 for the issuance, authentication, validation, and repudiation of secure
			 documents, including—</text>
							<subparagraph id="ID3514FB788FC74857996FA3305EBC3AA5"><enum>(A)</enum><text>technical and
			 biometric standards based on best practices and consistent with international
			 standards for the issuance, authentication, validation, and repudiation of
			 travel documents, including—</text>
								<clause id="ID6D380DDBEC6F472AB53EBD2F69FE70D4"><enum>(i)</enum><text>passports;</text>
								</clause><clause id="IDCE3CCDE5EDED4DA08EDB10A54B2181EB"><enum>(ii)</enum><text>visas;
			 and</text>
								</clause><clause id="IDF252BE329EA64E4AAA895DC5D63C10F9"><enum>(iii)</enum><text>permanent
			 resident cards;</text>
								</clause></subparagraph><subparagraph id="ID607D2976DC634F71BAC95DBC35EBF010"><enum>(B)</enum><text>working with
			 Canada and Mexico to encourage foreign governments to enact laws to combat
			 alien smuggling and trafficking, and laws to forbid the use and manufacture of
			 fraudulent travel documents and to promote information sharing;</text>
							</subparagraph><subparagraph id="IDADFCE325BDBF4673BC13133F13A3C2AC"><enum>(C)</enum><text>applying the
			 necessary pressures and support to ensure that other countries meet proper
			 travel document standards and are committed to travel document verification
			 before the citizens of such countries travel internationally, including travel
			 by such citizens to the United States; and</text>
							</subparagraph><subparagraph id="IDBB0DFE9E2FD046E89B392A8E343CFA01"><enum>(D)</enum><text>providing
			 technical assistance for the development and maintenance of a national database
			 built upon identified best practices for biometrics associated with visa and
			 travel documents.</text>
							</subparagraph></paragraph><paragraph id="ID148AE0E5F47A44F8B337A24862225D6E"><enum>(2)</enum><header>Immigration and
			 visa management</header><text>The progress of efforts to share information
			 regarding high-risk individuals who may attempt to enter Canada, Mexico, or the
			 United States, including the progress made—</text>
							<subparagraph id="IDCAA18AD1FD0146C7AB7997878A5793DD"><enum>(A)</enum><text>in implementing
			 the Statement of Mutual Understanding on Information Sharing, signed by Canada
			 and the United States in February 2003; and</text>
							</subparagraph><subparagraph id="ID78AB836CDFC647B882BAFA08BBCFB591"><enum>(B)</enum><text>in identifying
			 trends related to immigration fraud, including asylum and document fraud, and
			 to analyze such trends.</text>
							</subparagraph></paragraph><paragraph id="ID9297DA4ADE1B44C8A79B035B5D4E2942"><enum>(3)</enum><header>Visa policy
			 coordination and immigration security</header><text>The progress made by
			 Canada, Mexico, and the United States to enhance the security of North America
			 by cooperating on visa policy and identifying best practices regarding
			 immigration security, including the progress made—</text>
							<subparagraph id="ID07BAD47B6D55419E806270FC4C1BFBA2"><enum>(A)</enum><text>in enhancing
			 consultation among officials who issue visas at the consulates or embassies of
			 Canada, Mexico, or the United States throughout the world to share information,
			 trends, and best practices on visa flows;</text>
							</subparagraph><subparagraph id="IDDACDA347A2E548DDAACD149BD0F94D82"><enum>(B)</enum><text>in comparing the
			 procedures and policies of Canada and the United States related to visitor visa
			 processing, including—</text>
								<clause id="ID01731A8EE0D7403890390CAA1641ED58"><enum>(i)</enum><text>application
			 process;</text>
								</clause><clause id="ID2861DE33D02D480D8D79A7C0EB326DC8"><enum>(ii)</enum><text>interview
			 policy;</text>
								</clause><clause id="ID8E2AFAD9B41F42BE8B4927DBEFD841B6"><enum>(iii)</enum><text>general
			 screening procedures;</text>
								</clause><clause id="ID30B0EA745B714461B378DB9B3C5117EA"><enum>(iv)</enum><text>visa
			 validity;</text>
								</clause><clause id="ID9DD8A713342F4B05996F34C72408B56A"><enum>(v)</enum><text>quality control
			 measures; and</text>
								</clause><clause id="ID8F41AC13C9434794A75660597DF52C75"><enum>(vi)</enum><text>access to appeal
			 or review;</text>
								</clause></subparagraph><subparagraph id="IDB86EF462AD6846DD8E89221FA6A320DF"><enum>(C)</enum><text>in exploring
			 methods for Canada, Mexico, and the United States to waive visa requirements
			 for nationals and citizens of the same foreign countries;</text>
							</subparagraph><subparagraph id="IDC8D0C26AD8CC467B8AEC75621AF75914"><enum>(D)</enum><text>in providing
			 technical assistance for the development and maintenance of a national database
			 built upon identified best practices for biometrics associated with immigration
			 violators;</text>
							</subparagraph><subparagraph id="ID63A19B5AC6964D21B228EC0A4AE57040"><enum>(E)</enum><text>in developing and
			 implementing an immigration security strategy for North America that works
			 toward the development of a common security perimeter by enhancing technical
			 assistance for programs and systems to support advanced automated reporting and
			 risk targeting of international passengers;</text>
							</subparagraph><subparagraph id="IDD0A51BFF845349FCB895FEF0467510DA"><enum>(F)</enum><text>in sharing
			 information on lost and stolen passports on a real-time basis among immigration
			 or law enforcement officials of Canada, Mexico, and the United States;
			 and</text>
							</subparagraph><subparagraph id="ID22D9AAAE86B64DBDB4D0E4CD216B0722"><enum>(G)</enum><text>in collecting 10
			 fingerprints from each individual who applies for a visa.</text>
							</subparagraph></paragraph><paragraph id="IDCE6A0C00D08B45129FC440EC626F06BC"><enum>(4)</enum><header>North american
			 visitor overstay program</header><text>The progress made by Canada and the
			 United States in implementing parallel entry-exit tracking systems that, while
			 respecting the privacy laws of both countries, share information regarding
			 third country nationals who have overstayed their period of authorized
			 admission in either Canada or the United States.</text>
						</paragraph><paragraph id="ID72BCDAF2E76E41568129288A56A06D42"><enum>(5)</enum><header>Terrorist watch
			 lists</header><text>The progress made in enhancing the capacity of the United
			 States to combat terrorism through the coordination of counterterrorism
			 efforts, including the progress made—</text>
							<subparagraph id="ID2D058F271BD442469D44420C9CC354E1"><enum>(A)</enum><text>in developing and
			 implementing bilateral agreements between Canada and the United States and
			 between Mexico and the United States to govern the sharing of terrorist watch
			 list data and to comprehensively enumerate the uses of such data by the
			 governments of each country;</text>
							</subparagraph><subparagraph id="ID8498CFE23CE14A35BD8A20FEE053CE27"><enum>(B)</enum><text>in establishing
			 appropriate linkages among Canada, Mexico, and the United States Terrorist
			 Screening Center; and</text>
							</subparagraph><subparagraph id="IDC6F5163D31E7455D9919AE738A9E0C36"><enum>(C)</enum><text>in exploring with
			 foreign governments the establishment of a multilateral watch list mechanism
			 that would facilitate direct coordination between the country that identifies
			 an individual as an individual included on a watch list, and the country that
			 owns such list, including procedures that satisfy the security concerns and are
			 consistent with the privacy and other laws of each participating
			 country.</text>
							</subparagraph></paragraph><paragraph id="IDD8514110B5254DE2A1888D5C45C56580"><enum>(6)</enum><header>Money
			 laundering, currency smuggling, and alien smuggling</header><text>The progress
			 made in improving information sharing and law enforcement cooperation in
			 combating organized crime, including the progress made—</text>
							<subparagraph id="ID4C3EC9B5C0EA48839596084244D68A61"><enum>(A)</enum><text>in combating
			 currency smuggling, money laundering, alien smuggling, and trafficking in
			 alcohol, firearms, and explosives;</text>
							</subparagraph><subparagraph id="ID6C8A4C267D9748A69AF7A3B7636798B2"><enum>(B)</enum><text>in implementing
			 the agreement between Canada and the United States known as the Firearms
			 Trafficking Action Plan;</text>
							</subparagraph><subparagraph id="ID244D132683134F4491392AC0BE3339F5"><enum>(C)</enum><text>in determining
			 the feasibility of formulating a firearms trafficking action plan between
			 Mexico and the United States;</text>
							</subparagraph><subparagraph id="ID7605710324114C09A23F951E48553196"><enum>(D)</enum><text>in developing a
			 joint threat assessment on organized crime between Canada and the United
			 States;</text>
							</subparagraph><subparagraph id="ID7616EFF4622A425DBA1FB440101BA727"><enum>(E)</enum><text>in determining
			 the feasibility of formulating a joint threat assessment on organized crime
			 between Mexico and the United States;</text>
							</subparagraph><subparagraph id="ID7A1ABEA43B0F4225B08DDE5D28A4D0A9"><enum>(F)</enum><text>in developing
			 mechanisms to exchange information on findings, seizures, and capture of
			 individuals transporting undeclared currency; and</text>
							</subparagraph><subparagraph id="ID8D8739275F93461BA121C2C60D8044CD"><enum>(G)</enum><text>in developing and
			 implementing a plan to combat the transnational threat of illegal drug
			 trafficking.</text>
							</subparagraph></paragraph><paragraph id="ID06F792A2BF3E4EF788D2D76BAD00E3A9"><enum>(7)</enum><header>Law enforcement
			 cooperation</header><text>The progress made in enhancing law enforcement
			 cooperation among Canada, Mexico, and the United States through enhanced
			 technical assistance for the development and maintenance of a national database
			 built upon identified best practices for biometrics associated with known and
			 suspected criminals or terrorists, including exploring the formation of law
			 enforcement teams that include personnel from the United States and Mexico, and
			 appropriate procedures for such teams.</text>
						</paragraph></subsection></section><section id="ID64342321FEBB41FEAF82087F02029F83"><enum>114.</enum><header>Improving the
			 security of Mexico’s southern border</header>
					<subsection id="ID3C1D59965B9A467AB2F84A5DBE0A272F"><enum>(a)</enum><header>Technical
			 Assistance</header><text>The Secretary of State, in coordination with the
			 Secretary, shall work to cooperate with the head of Foreign Affairs Canada and
			 the appropriate officials of the Government of Mexico to establish a
			 program—</text>
						<paragraph id="IDF32CF15A6E664889B01783030843DFF4"><enum>(1)</enum><text>to assess the
			 specific needs of Guatemala and Belize in maintaining the security of the
			 international borders of such countries;</text>
						</paragraph><paragraph id="ID03431FD3495D4D28BC3F81B699F8DF50"><enum>(2)</enum><text>to use the
			 assessment made under paragraph (1) to determine the financial and technical
			 support needed by Guatemala and Belize from Canada, Mexico, and the United
			 States to meet such needs;</text>
						</paragraph><paragraph id="ID7D361C01808F48C587C367632056825F"><enum>(3)</enum><text>to provide
			 technical assistance to Guatemala and Belize to promote issuance of secure
			 passports and travel documents by such countries; and</text>
						</paragraph><paragraph id="ID0B65267A5123445BB5B440E11CE906A8"><enum>(4)</enum><text>to encourage
			 Guatemala and Belize—</text>
							<subparagraph id="IDDD938CC3A941421B8BE52A6339BB0E4C"><enum>(A)</enum><text>to control alien
			 smuggling and trafficking;</text>
							</subparagraph><subparagraph id="ID7472D0D8CF6441FFA43D9737EC9AA886"><enum>(B)</enum><text>to prevent the
			 use and manufacture of fraudulent travel documents; and</text>
							</subparagraph><subparagraph id="IDD9B2949A999D4EC5A5BDD32981A7F2F9"><enum>(C)</enum><text>to share relevant
			 information with Mexico, Canada, and the United States.</text>
							</subparagraph></paragraph></subsection><subsection id="ID9FF27CCDBF3E4CE295305EEEF16B413F"><enum>(b)</enum><header>Border Security
			 for Belize, Guatemala, and Mexico</header><text>The Secretary, in consultation
			 with the Secretary of State, shall work to cooperate—</text>
						<paragraph id="ID11E70991A5E74FDA9EC15A9A5D97507D"><enum>(1)</enum><text>with the
			 appropriate officials of the Government of Guatemala and the Government of
			 Belize to provide law enforcement assistance to Guatemala and Belize that
			 specifically addresses immigration issues to increase the ability of the
			 Government of Guatemala to dismantle human smuggling organizations and gain
			 additional control over the international border between Guatemala and Belize;
			 and</text>
						</paragraph><paragraph id="ID7FDFD82E8990460796D6E2CF4206E84F"><enum>(2)</enum><text>with the
			 appropriate officials of the Government of Belize, the Government of Guatemala,
			 the Government of Mexico, and the governments of neighboring contiguous
			 countries to establish a program to provide needed equipment, technical
			 assistance, and vehicles to manage, regulate, and patrol the international
			 borders between Mexico and Guatemala and between Mexico and Belize.</text>
						</paragraph></subsection><subsection id="ID0A5A1992FB9249ABBB515C82209A1FAF"><enum>(c)</enum><header>Tracking
			 Central American Gangs</header><text>The Secretary of State, in coordination
			 with the Secretary and the Director of the Federal Bureau of Investigation,
			 shall work to cooperate with the appropriate officials of the Government of
			 Mexico, the Government of Guatemala, the Government of Belize, and the
			 governments of other Central American countries—</text>
						<paragraph id="IDF03732C82CB64E3FBF816BD59B5CE6A6"><enum>(1)</enum><text>to assess the
			 direct and indirect impact on the United States and Central America of
			 deporting violent criminal aliens;</text>
						</paragraph><paragraph id="ID255866F9020D43FB8B26CA8F2EF34AAF"><enum>(2)</enum><text>to establish a
			 program and database to track individuals involved in Central American gang
			 activities;</text>
						</paragraph><paragraph id="ID2B9E31B82CE7414FBE89BD94CCB2F2F3"><enum>(3)</enum><text>to develop a
			 mechanism that is acceptable to the governments of Belize, Guatemala, Mexico,
			 the United States, and other appropriate countries to notify such a government
			 if an individual suspected of gang activity will be deported to that country
			 prior to the deportation and to provide support for the reintegration of such
			 deportees into that country; and</text>
						</paragraph><paragraph id="ID07B1737529634AB583E082FF31C40307"><enum>(4)</enum><text>to develop an
			 agreement to share all relevant information related to individuals connected
			 with Central American gangs.</text>
						</paragraph></subsection><subsection id="IDA7EDD6EED4BC4FB4B9F7513D8EE1A49C"><enum>(d)</enum><header>Limitations on
			 Assistance</header><text>Any funds made available to carry out this section
			 shall be subject to the limitations contained in section 551 of the Foreign
			 Operations, Export Financing, and Related Programs Appropriations Act of 2006
			 (Public Law 109–102; 119 Stat. 2218).</text>
					</subsection></section><section id="ID45FCA407637543409651D483AC212741"><enum>115.</enum><header>Combating
			 human smuggling</header>
					<subsection id="IDC628F056E2D24981923BDB55828D26F6"><enum>(a)</enum><header>Requirement for
			 Plan</header><text>The Secretary shall develop and implement a plan to improve
			 coordination between the Bureau of Immigration and Customs Enforcement and the
			 Bureau of Customs and Border Protection of the Department and any other
			 Federal, State, local, or tribal authorities, as determined appropriate by the
			 Secretary, to improve coordination efforts to combat human smuggling.</text>
					</subsection><subsection id="IDA23EB751EF0E4F48832249F7EB507D10"><enum>(b)</enum><header>Content</header><text>In
			 developing the plan required by subsection (a), the Secretary shall
			 consider—</text>
						<paragraph id="IDCB3DEC7CCDFC437FB9046AB6F2C570FD"><enum>(1)</enum><text>the
			 interoperability of databases utilized to prevent human smuggling;</text>
						</paragraph><paragraph id="IDE775F9BD97814B1B870D2A697BEB4E37"><enum>(2)</enum><text>adequate and
			 effective personnel training;</text>
						</paragraph><paragraph id="IDD415B729833947B09E2E462BC51603CB"><enum>(3)</enum><text>methods and
			 programs to effectively target networks that engage in such smuggling;</text>
						</paragraph><paragraph id="IDAD0FF5FD25DD4B7CACD1D9A51662C068"><enum>(4)</enum><text>effective
			 utilization of—</text>
							<subparagraph id="IDD037F73285554101937588CC73E1ECF5"><enum>(A)</enum><text>visas for victims
			 of trafficking and other crimes; and</text>
							</subparagraph><subparagraph id="ID1310289ABAAF4F508D8D1C2898D2D641"><enum>(B)</enum><text>investigatory
			 techniques, equipment, and procedures that prevent, detect, and prosecute
			 international money laundering and other operations that are utilized in
			 smuggling;</text>
							</subparagraph></paragraph><paragraph id="IDD9390C64D5E04F9DBE8F6BB1C5C31454"><enum>(5)</enum><text>joint measures
			 with the Secretary of State to enhance intelligence sharing and cooperation
			 with foreign governments whose citizens are preyed on by human smugglers;
			 and</text>
						</paragraph><paragraph id="IDB911163EE635486CA8BDB1974052B831"><enum>(6)</enum><text>other measures
			 that the Secretary considers appropriate to combat human smuggling.</text>
						</paragraph></subsection><subsection id="IDBB1DC115D8CA4FC7B88832D1FB43FCCB"><enum>(c)</enum><header>Report</header><text>Not
			 later than 1 year after implementing the plan described in subsection (a), the
			 Secretary shall submit to Congress a report on such plan, including any
			 recommendations for legislative action to improve efforts to combating human
			 smuggling.</text>
					</subsection><subsection id="ID9465296C3686413BB6A9402B7F6F2C06"><enum>(d)</enum><header>Savings
			 Provision</header><text>Nothing in this section may be construed to provide
			 additional authority to any State or local entity to enforce Federal
			 immigration laws.</text>
					</subsection></section><section id="ID2650C1FF7F784EC88F9DC3B05F9D1E02"><enum>116.</enum><header>Deaths at
			 United States-Mexico border</header>
					<subsection id="ID750A3613F0464B7E84D8E40D505CA610"><enum>(a)</enum><header>Collection of
			 Statistics</header><text>The Commissioner of the Bureau of Customs and Border
			 Protection shall collect statistics relating to deaths occurring at the border
			 between the United States and Mexico, including—</text>
						<paragraph id="IDBF858DA0289B46B7BD288E0E502227FE"><enum>(1)</enum><text>the causes of the
			 deaths; and</text>
						</paragraph><paragraph id="IDE0DF84852AEF4E33B0386D96765A3BC1"><enum>(2)</enum><text>the total number
			 of deaths.</text>
						</paragraph></subsection><subsection id="ID345A2840FB9D45798E29F268F5284CFA"><enum>(b)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, and annually
			 thereafter, the Commissioner of the Bureau of Customs and Border Protection
			 shall submit to the Secretary a report that—</text>
						<paragraph id="ID5321C9F9E10848A58C57A1C37B5AFAE7"><enum>(1)</enum><text>analyzes trends
			 with respect to the statistics collected under subsection (a) during the
			 preceding year; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4A30412B12604D01AB116521CDBFEC33"><enum>(2)</enum><text>recommends
			 actions to reduce the deaths described in subsection (a).</text>
						</paragraph></subsection></section></subtitle><subtitle id="ID9885153815D143BDB4D9A9955E360960"><enum>C</enum><header>Other Border
			 Security Initiatives</header>
				<section id="ID63C57F0819984991955BA2762EFAD38B"><enum>121.</enum><header>Biometric data
			 enhancements</header><text display-inline="no-display-inline">Not later than
			 October 1, 2007, the Secretary shall—</text>
					<paragraph id="ID1F1149CFC8394CD8A869950D57F9574A"><enum>(1)</enum><text>in consultation
			 with the Attorney General, enhance connectivity between the Automated Biometric
			 Fingerprint Identification System (IDENT) of the Department and the Integrated
			 Automated Fingerprint Identification System (IAFIS) of the Federal Bureau of
			 Investigation to ensure more expeditious data searches; and</text>
					</paragraph><paragraph id="ID6673F4E3E5214850957071D8D3D4A1D3"><enum>(2)</enum><text>in consultation
			 with the Secretary of State, collect all fingerprints from each alien required
			 to provide fingerprints during the alien’s initial enrollment in the integrated
			 entry and exit data system described in section 110 of the Illegal Immigration
			 Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1365a).</text>
					</paragraph></section><section id="ID53B9C94D655A4BEFB04716FE4DD6FC28"><enum>122.</enum><header>Secure
			 communication</header><text display-inline="no-display-inline">The Secretary
			 shall, as expeditiously as practicable, develop and implement a plan to improve
			 the use of satellite communications and other technologies to ensure clear and
			 secure 2-way communication capabilities—</text>
					<paragraph id="IDB8B80CBD0DF5496DAC767769CE591BE5"><enum>(1)</enum><text>among all border
			 patrol agents conducting operations between ports of entry;</text>
					</paragraph><paragraph id="IDC496DBB5E6BC4ACDAC2A5836B7033ED5"><enum>(2)</enum><text>between border
			 patrol agents and their respective border patrol stations;</text>
					</paragraph><paragraph id="ID60616A75946545089CB95F6C907EAA81"><enum>(3)</enum><text>between border
			 patrol agents and residents in remote areas along the international land
			 borders of the United States; and</text>
					</paragraph><paragraph id="ID9977E96C52EA41D885A46F18564F0AF6"><enum>(4)</enum><text>between all
			 appropriate border security agencies of the Department and State, local, and
			 tribal law enforcement agencies.</text>
					</paragraph></section><section id="ID2D257E5D5FC94294B62D8C1054685A40"><enum>123.</enum><header>Border patrol
			 training capacity review</header>
					<subsection id="IDA4805467C5794E5492B3445FC102D644"><enum>(a)</enum><header>In
			 general</header><text>The Comptroller General of the United States shall
			 conduct a review of the basic training provided to border patrol agents by the
			 Secretary to ensure that such training is provided as efficiently and
			 cost-effectively as possible.</text>
					</subsection><subsection id="ID3BE8AD32C78346E8A0146AF079B7BDCF"><enum>(b)</enum><header>Components of
			 Review</header><text>The review under subsection (a) shall include the
			 following components:</text>
						<paragraph id="ID630580D31CE440908BC65167C929242A"><enum>(1)</enum><text>An evaluation of
			 the length and content of the basic training curriculum provided to new border
			 patrol agents by the Federal Law Enforcement Training Center, including a
			 description of how such curriculum has changed since September 11, 2001, and an
			 evaluation of language and cultural diversity training programs provided within
			 such curriculum.</text>
						</paragraph><paragraph id="ID13811025ADF34B01870CB3D77D96ED07"><enum>(2)</enum><text>A review and a
			 detailed breakdown of the costs incurred by the Bureau of Customs and Border
			 Protection and the Federal Law Enforcement Training Center to train 1 new
			 border patrol agent.</text>
						</paragraph><paragraph id="ID55C4E5CF602843EBB5F27D919ADE1308"><enum>(3)</enum><text>A comparison,
			 based on the review and breakdown under paragraph (2), of the costs,
			 effectiveness, scope, and quality, including geographic characteristics, with
			 other similar training programs provided by State and local agencies, nonprofit
			 organizations, universities, and the private sector.</text>
						</paragraph><paragraph id="ID73CE836BF20441E9BCF60DECC49F1D9A"><enum>(4)</enum><text>An evaluation of
			 whether utilizing comparable non-Federal training programs, proficiency
			 testing, and long-distance learning programs may affect—</text>
							<subparagraph id="ID6B6011D488A9491EB63BA22BA98B46A8"><enum>(A)</enum><text>the
			 cost-effectiveness of increasing the number of border patrol agents trained per
			 year;</text>
							</subparagraph><subparagraph id="ID6DCEFB8B80E443978FBC76521EA724A3"><enum>(B)</enum><text>the per agent
			 costs of basic training; and</text>
							</subparagraph><subparagraph id="ID10F91172533A4C8096AD17B1D0FEB718"><enum>(C)</enum><text>the scope and
			 quality of basic training needed to fulfill the mission and duties of a border
			 patrol agent.</text>
							</subparagraph></paragraph></subsection></section><section id="IDD224917B92C4441784FC404E7A9D5EC7"><enum>124.</enum><header>US–VISIT
			 system</header><text display-inline="no-display-inline">Not later than 6 months
			 after the date of the enactment of this Act, the Secretary, in consultation
			 with the heads of other appropriate Federal agencies, shall submit to Congress
			 a schedule for—</text>
					<paragraph id="ID885A460365D44761B4955D8558BD0B58"><enum>(1)</enum><text>equipping all
			 land border ports of entry of the United States with the U.S.-Visitor and
			 Immigrant Status Indicator Technology (US–VISIT) system implemented under
			 section 110 of the Illegal Immigration Reform and Immigrant Responsibility Act
			 of 1996 (8 U.S.C. 1365a);</text>
					</paragraph><paragraph id="IDA560950204F94118B3CB788AE88A80E5"><enum>(2)</enum><text>developing and
			 deploying at such ports of entry the exit component of the US–VISIT system;
			 and</text>
					</paragraph><paragraph id="ID202A1DB6A67D479A9B53676BCC408116"><enum>(3)</enum><text>making
			 interoperable all immigration screening systems operated by the
			 Secretary.</text>
					</paragraph></section><section id="ID5571BB01CCFF4D7CA1EEA4D31CFE2E81"><enum>125.</enum><header>Document fraud
			 detection</header>
					<subsection id="ID82A1B8651A4B4CEAA27DAFB86EAA8693"><enum>(a)</enum><header>Training</header><text>Subject
			 to the availability of appropriations, the Secretary shall provide all Customs
			 and Border Protection officers with training in identifying and detecting
			 fraudulent travel documents. Such training shall be developed in consultation
			 with the head of the Forensic Document Laboratory of the Bureau of Immigration
			 and Customs Enforcement.</text>
					</subsection><subsection id="IDEC5252FB37554915B4D8CB571AFAE35B"><enum>(b)</enum><header>Forensic
			 Document Laboratory</header><text>The Secretary shall provide all Customs and
			 Border Protection officers with access to the Forensic Document
			 Laboratory.</text>
					</subsection><subsection id="ID45BC675912AE40DBA16E9B80FEC91056"><enum>(c)</enum><header>Assessment</header>
						<paragraph id="ID46E8CD9AFE6E4D398E07D49AE6AFB226"><enum>(1)</enum><header>Requirement for
			 assessment</header><text>The Inspector General of the Department shall conduct
			 an independent assessment of the accuracy and reliability of the Forensic
			 Document Laboratory.</text>
						</paragraph><paragraph id="ID5D6A4CB8548E4F488C0C351F797486F7"><enum>(2)</enum><header>Report to
			 congress</header><text>Not later than 6 months after the date of the enactment
			 of this Act, the Inspector General shall submit to Congress the findings of the
			 assessment required by paragraph (1).</text>
						</paragraph></subsection><subsection id="ID5C8BD35469944E008374EC989E85AD88"><enum>(d)</enum><header>Authorization
			 of Appropriations</header><text>There are authorized to be appropriated to the
			 Secretary such sums as may be necessary for each of fiscal years 2007 through
			 2011 to carry out this section.</text>
					</subsection></section><section id="IDC76522408C724E26B99DDF479C583E0A"><enum>126.</enum><header>Improved
			 document integrity</header>
					<subsection id="IDC0D8B050609D4AAD92E2C744E3F40D2F"><enum>(a)</enum><header>In
			 General</header><text>Section 303 of the Enhanced Border Security and Visa
			 Entry Reform Act of 2002 (8 U.S.C. 1732) is amended—</text>
						<paragraph id="ID7683E318F6984D03B1D7CB5451CDB218"><enum>(1)</enum><text>by striking
			 <quote>Attorney General</quote> each place it appears and inserting
			 <quote>Secretary of Homeland Security</quote>;</text>

				Security to verify electronically the identity and status of the
				alien.</text>

						</paragraph></subsection></section><section id="ID508F503DB5724434A0DB69C5F17B3B62"><enum>127.</enum><header>Cancellation
			 of visas</header><text display-inline="no-display-inline">Section 222(g) (8
			 U.S.C. 1202(g)) is amended—</text>
					<paragraph id="ID4C6FE736B2AE4BDBB878E763EBA29C48"><enum>(1)</enum><text>in paragraph
			 (1)—</text>

					<subsection id="IDA2F59A6490104782A963EB2811DF3D43"><enum>(a)</enum><header>Collection of
			 biometric data from aliens departing the United States</header><text>Section
			 215 (8 U.S.C. 1185) is amended—</text>
						<paragraph id="ID85530FAB44DB4961846F5EDE7F5FEC61"><enum>(1)</enum><text>by redesignating
			 subsection (c) as subsection (g);</text>
						</paragraph><paragraph id="ID7F8A026DF2C841A180E0C3C71AD7B7F2"><enum>(2)</enum><text>by moving
			 subsection (g), as redesignated by paragraph (1), to the end; and</text>
						</paragraph><paragraph id="IDE37FA6C5B05046559B974B7ACF52432C"><enum>(3)</enum><text>by inserting
			 after subsection (b) the following:</text>
							<quoted-block id="ID515344BA012B4D0F80CE84BC445BF18D" style="OLC">

				Homeland Security is authorized to require aliens departing the United States

						</paragraph></subsection><subsection id="ID2E2B8D3C5FF740BF8B8A3225266CBFC8"><enum>(b)</enum><header>Inspection of
			 applicants for admission</header><text>Section 235(d) (8 U.S.C. 1225(d)) is
			 amended by adding at the end the following:</text>

							<paragraph id="ID2844704471D543CC9229D7A2C32046D5"><enum>(5)</enum><header>Authority to
				collect biometric data</header><text>In conducting inspections under subsection
				(b), immigration officers are authorized to collect biometric data from—</text>
								<subparagraph id="IDF71332596C7740AEB857279FA0BA39D6"><enum>(A)</enum><text>any applicant for
				admission or alien seeking to transit through the United States; or</text>
								</subparagraph><subparagraph id="IDAD17E4228B1F4C568D5BC26F5224BC9D"><enum>(B)</enum><text>any lawful
				permanent resident who is entering the United States and who is not regarded as
				seeking admission pursuant to section
				101(a)(13)(C).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="ID53A273F0734E4DF0B17336568009CA8F"><enum>(c)</enum><header>Collection of
			 biometric data from alien crewmen</header><text>Section 252 (8 U.S.C. 1282) is
			 amended by adding at the end the following:</text>
						<quoted-block id="IDF8F4CCFE2A244247981B438941E6488E" style="OLC">
							<subsection id="ID96E00A8D655F485FBF0528011D7175C8"><enum>(d)</enum><text>An immigration
				officer is authorized to collect biometric data from an alien crewman seeking
				permission to land temporarily in the United
				States.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="ID76EFF39C2C8046C585AE78A6B1C741BB"><enum>(d)</enum><header>Grounds of
			 inadmissibility</header><text>Section 212 (8 U.S.C. 1182) is amended—</text>
						<paragraph id="IDCC1CC5FD20454B339AA3E526D29678C8"><enum>(1)</enum><text>in subsection
			 (a)(7), by adding at the end the following:</text>
							<quoted-block id="ID7EEE9EF6F914460CA69446E115108106" style="OLC">
								<subparagraph id="ID7E4501228E3D4CA08F00BEF960AF1B49"><enum>(C)</enum><header>Withholders of
				biometric data</header><text>Any alien who knowingly fails to comply with a
				lawful request for biometric data under section 215(c) or 235(d) is
				inadmissible.</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</paragraph><paragraph id="IDC0111CCDC9BE47AA9089FDA73351034E"><enum>(2)</enum><text>in subsection
			 (d), by inserting after paragraph (1) the following:</text>
							<quoted-block id="ID921C44BE3C15454EB1F3186C48D76F76" style="OLC">
								<paragraph id="IDA20C1DADFE0742478314C98FFD1C923A"><enum>(2)</enum><text>The Secretary of
				Homeland Security shall determine whether a ground for inadmissibility exists
				with respect to an alien described in subparagraph (C) of subsection (a)(7) and
				may waive the application of such subparagraph for an individual alien or a
				class of aliens, at the discretion of the
				Secretary.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="ID55B1A261ABCE4B2A9825702319BF7327"><enum>(e)</enum><header>Implementation</header><text>Section
			 7208 of the 9/11 Commission Implementation Act of 2004 (8 U.S.C. 1365b) is
			 amended—</text>
						<paragraph id="IDA19710C3DB244B0EB90C5EE2E01C90BE"><enum>(1)</enum><text>in subsection
			 (c), by adding at the end the following:</text>

				Register.</text>
								</paragraph><after-quoted-block>;

						</paragraph><paragraph id="ID8700F5F840CE49CA800ECB70A457A5CC"><enum>(2)</enum><text>in subsection
			 (l)—</text>

									</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph></subsection></section><section id="ID3B43A8E7A7194B11886E0AA42786FFC2"><enum>129.</enum><header>Border
			 study</header>
					<subsection id="IDA20D2E17660244A2A79CDC3C3B37BFB5"><enum>(a)</enum><header>Southern border
			 study</header><text>The Secretary, in consultation with the Attorney General,
			 the Secretary of the Interior, the Secretary of Agriculture, the Secretary of
			 Defense, the Secretary of Commerce, and the Administrator of the Environmental
			 Protection Agency, shall conduct a study on the construction of a system of
			 physical barriers along the southern international land and maritime border of
			 the United States.</text>
					</subsection><subsection id="ID783AAB3D7FF0447B95DBCA07B704179D"><enum>(b)</enum><header>Report</header><text>Not
			 later than 9 months after the date of the enactment of this Act, the Secretary
			 shall submit to Congress a report on the study described in subsection
			 (a).</text>
					</subsection></section><section id="ID8B6036C8BAF3493B8D29470B5992ED17"><enum>130.</enum><header>Secure Border
			 Initiative financial accountability</header>
					<subsection id="ID115140648A08446DAE97D0E6989C6671"><enum>(a)</enum><header>In
			 general</header><text>The Inspector General of the Department shall review each
			 contract action relating to the Secure Border Initiative having a value of more
			 than $20,000,000, to determine whether each such action fully complies with
			 applicable cost requirements, performance objectives, program milestones,
			 inclusion of small, minority, and women-owned business, and time lines. The
			 Inspector General shall complete a review under this subsection with respect to
			 each contract action—</text>
						<paragraph id="ID21A97A8B3B1C46F3A3DC176363C1E4C3"><enum>(1)</enum><text>not later than 60
			 days after the date of the initiation of the action; and</text>
						</paragraph><paragraph id="IDFB7A2FE2839046E6A74EA9B8B35BC12A"><enum>(2)</enum><text>upon the
			 conclusion of the performance of the contract.</text>
						</paragraph></subsection><subsection id="ID4D68D16ECE1F44EDB9E1BB883B516529"><enum>(b)</enum><header>Inspector
			 General</header>
						<paragraph id="IDF2D1863A15A442408D7E4D2FE97C7997"><enum>(1)</enum><header>Action</header><text>If
			 the Inspector General becomes aware of any improper conduct or wrongdoing in
			 the course of conducting a contract review under subsection (a), the Inspector
			 General shall, as expeditiously as practicable, refer information relating to
			 such improper conduct or wrongdoing to the Secretary, or to another appropriate
			 official of the Department, who shall determine whether to temporarily suspend
			 the contractor from further participation in the Secure Border
			 Initiative.</text>
						</paragraph><paragraph id="ID03B1091BDA3D4D8FBCBA8BBF7F924E6B"><enum>(2)</enum><header>Report</header><text>Upon
			 the completion of each review described in subsection (a), the Inspector
			 General shall submit to the Secretary a report containing the findings of the
			 review, including findings regarding—</text>
							<subparagraph id="ID8F0CF91C231D47B6BB55958B31B4712B"><enum>(A)</enum><text>cost
			 overruns;</text>
							</subparagraph><subparagraph id="ID9A40430AF3C24E12908B88963D3D43AF"><enum>(B)</enum><text>significant
			 delays in contract execution;</text>
							</subparagraph><subparagraph id="ID824952A3919E49DCA2D2DFA019CC2FB0"><enum>(C)</enum><text>lack of rigorous
			 departmental contract management;</text>
							</subparagraph><subparagraph id="ID43F2D370D3994639BF5210AAA4EE9E06"><enum>(D)</enum><text>insufficient
			 departmental financial oversight;</text>
							</subparagraph><subparagraph id="IDF6CE49D272E44739AC7BB5631ABD5E5D"><enum>(E)</enum><text>bundling that
			 limits the ability of small businesses to compete; or</text>
							</subparagraph><subparagraph id="ID50038A9B78CF4E70A872BDD4B667D5A2"><enum>(F)</enum><text>other high-risk
			 business practices.</text>
							</subparagraph></paragraph></subsection><subsection id="ID58DA8E288EB54742B22B723AAC654B43"><enum>(c)</enum><header>Reports by the
			 Secretary</header>
						<paragraph id="ID569BEE07152D4935BF47EB73C6240901"><enum>(1)</enum><header>In
			 general</header><text>Not later than 30 days after the receipt of each report
			 required under subsection (b)(2), the Secretary shall submit a report, to the
			 Committee on the Judiciary of the Senate and the Committee on the Judiciary of
			 the House of Representatives, that describes—</text>
							<subparagraph id="ID05EBD611C51C4E879695338ABA0F2E08"><enum>(A)</enum><text>the findings of
			 the report received from the Inspector General; and</text>
							</subparagraph><subparagraph id="ID31808704CF184FB59F10CC519359810F"><enum>(B)</enum><text>the steps the
			 Secretary has taken, or plans to take, to address the problems identified in
			 such report.</text>
							</subparagraph></paragraph><paragraph id="ID66AEFDD926BB4DB89246A8D0C0DA1E4A"><enum>(2)</enum><header>Contracts with
			 foreign companies</header><text>Not later than 60 days after the initiation of
			 each contract action with a company whose headquarters is not based in the
			 United States, the Secretary shall submit a report to the Committee on the
			 Judiciary of the Senate and the Committee on the Judiciary of the House of
			 Representatives, regarding the Secure Border Initiative.</text>
						</paragraph></subsection><subsection id="ID3C60F03BDCF84D73BDE03868472D1EE7"><enum>(d)</enum><header>Reports on
			 United States ports</header><text>Not later than 30 days after receiving
			 information regarding a proposed purchase of a contract to manage the
			 operations of a United States port by a foreign entity, the Committee on
			 Foreign Investment in the United States shall submit a report to Congress that
			 describes—</text>
						<paragraph id="ID6CCEEE24481F430E8159131EAA95AAF2"><enum>(1)</enum><text>the proposed
			 purchase;</text>
						</paragraph><paragraph id="IDB39BA9208879406F8FE0A9DAC9EF0FB3"><enum>(2)</enum><text>any security
			 concerns related to the proposed purchase; and</text>
						</paragraph><paragraph id="IDE9AEB98089BF4E80BB2C56BFEBEACF7B"><enum>(3)</enum><text>the manner in
			 which such security concerns have been addressed.</text>
						</paragraph></subsection><subsection id="IDB6490BEE692244749ED3E7AA41C5836B"><enum>(e)</enum><header>Authorization
			 of appropriations</header><text>In addition to amounts that are otherwise
			 authorized to be appropriated to the Office of the Inspector General of the
			 Department, there are authorized to be appropriated to the Office, to enable
			 the Office to carry out this section—</text>
						<paragraph id="ID75BE48E244084235A0B89B2FD2D09D58"><enum>(1)</enum><text>for fiscal year
			 2007, not less than 5 percent of the overall budget of the Office for such
			 fiscal year;</text>
						</paragraph><paragraph id="IDAC449BEA95004BC6BA4D9649BF336793"><enum>(2)</enum><text>for fiscal year
			 2008, not less than 6 percent of the overall budget of the Office for such
			 fiscal year; and</text>
						</paragraph><paragraph id="ID93C2EC92BCED41BEBAF11082618BEB55"><enum>(3)</enum><text>for fiscal year
			 2009, not less than 7 percent of the overall budget of the Office for such
			 fiscal year.</text>
						</paragraph></subsection></section><section id="ID0AD91A0944EE492BBF7345548002CACE"><enum>131.</enum><header>Mandatory
			 detention for aliens apprehended at or between ports of entry</header>
					<subsection id="IDD38355B2265E4BD4AFB5EA5DD773B0A2"><enum>(a)</enum><header>In
			 General</header><text>Beginning on October 1, 2007, an alien (other than a
			 national of Mexico) who is attempting to illegally enter the United States and
			 who is apprehended at a United States port of entry or along the international
			 land and maritime border of the United States shall be detained until removed
			 or a final decision granting admission has been determined, unless the
			 alien—</text>
						<paragraph id="ID8BB54E2065E74EE6B8FBA2F79552B6BB"><enum>(1)</enum><text>is permitted to
			 withdraw an application for admission under section 235(a)(4) of the
			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8
			 U.S.C. 1225(a)(4)) and immediately departs from the United States pursuant to
			 such section; or</text>
						</paragraph><paragraph id="ID55F49559DE824BF885C73B5DB4F20CC4"><enum>(2)</enum><text>is paroled into
			 the United States by the Secretary for urgent humanitarian reasons or
			 significant public benefit in accordance with section 212(d)(5)(A) of such Act
			 (8 U.S.C. 1182(d)(5)(A)).</text>
						</paragraph></subsection><subsection id="IDF90B3ACC8F56406E87D692BE59CCFD94"><enum>(b)</enum><header>Requirements
			 During Interim Period</header><text>Beginning 60 days after the date of the
			 enactment of this Act and before October 1, 2007, an alien described in
			 subsection (a) may be released with a notice to appear only if—</text>
						<paragraph id="IDB409F8E98BEC4D06A0C56D05421E42EE"><enum>(1)</enum><text>the Secretary
			 determines, after conducting all appropriate background and security checks on
			 the alien, that the alien does not pose a national security risk; and</text>
						</paragraph><paragraph id="IDAB6816F853E146B7A153E50A2F045A09"><enum>(2)</enum><text>the alien
			 provides a bond of not less than $5,000.</text>
						</paragraph></subsection><subsection id="ID26D8606171F04AD18BF1FF9CEB1B34F6"><enum>(c)</enum><header>Rules of
			 Construction</header>
						<paragraph id="ID26771BA8C2EA4A8F89625946451370D6"><enum>(1)</enum><header>Asylum and
			 removal</header><text>Nothing in this section shall be construed as limiting
			 the right of an alien to apply for asylum or for relief or deferral of removal
			 based on a fear of persecution.</text>
						</paragraph><paragraph id="ID5EB5CCE53A0C417BA3C33EE57F5C91E4"><enum>(2)</enum><header>Treatment of
			 certain aliens</header><text>The mandatory detention requirement in subsection
			 (a) does not apply to any alien who is a native or citizen of a country in the
			 Western Hemisphere with whose government the United States does not have full
			 diplomatic relations.</text>
						</paragraph><paragraph id="ID650A6E7042E04E6EB6F8ED4581A775CA"><enum>(3)</enum><header>Discretion</header><text>Nothing
			 in this section shall be construed as limiting the authority of the Secretary,
			 in the Secretary’s sole unreviewable discretion, to determine whether an alien
			 described in clause (ii) of section 235(b)(1)(B) of the
			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> shall
			 be detained or released after a finding of a credible fear of persecution (as
			 defined in clause (v) of such section).</text>
						</paragraph></subsection></section><section id="IDDDD09D33CEC6430889AC1C7ED5AA8E57"><enum>132.</enum><header>Evasion of
			 inspection or violation of arrival, reporting, entry, or clearance
			 requirements</header>
					<subsection id="ID2D7ADE934FDD427094CFADFA9B7D497C"><enum>(a)</enum><header>In
			 General</header><text>Chapter 27 of title 18, United States Code, is amended by
			 adding at the end the following:</text>
						<quoted-block id="ID759801C018504F0DBDD8DA110CB12597" style="USC">
							<section id="IDEDF6570D0D1E4C3D90C32E5E46A89913"><enum>555.</enum><header>Evasion of
				inspection or during violation of arrival, reporting, entry, or clearance
				requirements</header>
								<subsection id="ID01AF587115EC4448B25BEEF91C5838DF"><enum>(a)</enum><header>Prohibition</header><text>A
				person shall be punished as described in subsection (b) if such person attempts
				to elude or eludes customs, immigration, or agriculture inspection or fails to
				stop at the command of an officer or employee of the United States charged with
				enforcing the immigration, customs, or other laws of the United States at a
				port of entry or customs or immigration checkpoint.</text>
								</subsection><subsection id="ID2728D8824014458B8A352D3659D66B55"><enum>(b)</enum><header>Penalties</header><text>A
				person who commits an offense described in subsection (a) shall be—</text>
									<paragraph id="ID5AC70A7DF2F24CFF8DC241F2C0B810EB"><enum>(1)</enum><text>fined under this
				title;</text>
									</paragraph><paragraph id="IDEC1B2AA24BBE4A52B268AB35D33D76BF"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID1118D3803CC6479790786EC4BF29BD1E"><enum>(A)</enum><text>imprisoned for not more
				than 3 years, or both;</text>
										</subparagraph><subparagraph id="ID7F0ED2BFADD04E6EB7F8A984486C9EBD" indent="up1"><enum>(B)</enum><text>imprisoned for not more than 10 years,
				or both, if in commission of this violation, attempts to inflict or inflicts
				bodily injury (as defined in section 1365(g) of this title); or</text>
										</subparagraph><subparagraph id="IDC2D35848BC3E431C83CC4882AEEB8582" indent="up1"><enum>(C)</enum><text>imprisoned for any term of years or
				for life, or both, if death results, and may be sentenced to death; or</text>
										</subparagraph></paragraph><paragraph id="ID081816DEE52D47DAB601F026EEB4AB00"><enum>(3)</enum><text>both fined and
				imprisoned under this subsection.</text>
									</paragraph></subsection><subsection id="IDF9752FF946984F7F9FD333668C83C3E4"><enum>(c)</enum><header>Conspiracy</header><text>If
				2 or more persons conspire to commit an offense described in subsection (a),
				and 1 or more of such persons do any act to effect the object of the
				conspiracy, each shall be punishable as a principal, except that the sentence
				of death may not be imposed.</text>
								</subsection><subsection id="ID8CAAA6F0781C436D8111CDC51D48A060"><enum>(d)</enum><header>Prima facie
				evidence</header><text>For the purposes of seizure and forfeiture under
				applicable law, in the case of use of a vehicle or other conveyance in the
				commission of this offense, or in the case of disregarding or disobeying the
				lawful authority or command of any officer or employee of the United States
				under section 111(b), such conduct shall constitute prima facie evidence of
				smuggling aliens or
				merchandise.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="ID4694B26ACF0646498A87A4BD0AE1469D"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of sections for chapter 27 of title 18,
			 United States Code, is amended by adding at the end the following:</text>

					</subsection><subsection id="IDB52D080E3E844381A19CA62D3431CB3F"><enum>(c)</enum><header>Failure to obey
			 border enforcement officers</header><text>Section 111 of title 18, United
			 States Code, is amended by inserting after subsection (b) the following:</text>
						<quoted-block id="IDD27FF3D0D36143F68557D64F2ACE8EFD" style="OLC">
							<subsection id="ID6A475EF0AA3D42C6804970BACC5013DC"><enum>(c)</enum><header>Failure To obey
				lawful orders of border enforcement officers</header><text>Whoever willfully
				disregards or disobeys the lawful authority or command of any officer or
				employee of the United States charged with enforcing the immigration, customs,
				or other laws of the United States while engaged in, or on account of, the
				performance of official duties shall be fined under this title or imprisoned
				for not more than 5 years, or
				both.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section id="ID6EFA1F1AE8EC4AD686342215C7842FA1"><enum>133.</enum><header>Temporary
			 National Guard support for securing the southern land border of the United
			 States</header>
					<subsection id="ID87A92C9AB1234780A2B0AF5A834BF68C"><enum>(a)</enum><header>Authority To
			 provide assistance</header>
						<paragraph id="idBD3C9399276B4B1D9AAD250536026921"><enum>(1)</enum><header>Annual training
			 duty</header><text>With the approval of the Secretary of Defense, the Governor
			 of a State may order any units or personnel of the National Guard of such State
			 to perform annual training duty under section 502(a) of title 32, United States
			 Code, to carry out in any State along the southern land border of the United
			 States the activities authorized in subsection (b), for the purpose of securing
			 such border. Such duty shall not exceed 21 days in any year.</text>
						</paragraph><paragraph id="idD4EE423A481A43D08F3ACB0E83A0F247"><enum>(2)</enum><header>Other
			 support</header><text>With the approval of the Secretary of Defense, the
			 Governor of a State may order any units or personnel of the National Guard of
			 such State to perform duty under section 502(f) of title 32, United States
			 Code, to provide command, control, and continuity of support for units or
			 personnel performing annual training duty under paragraph (1).</text>
						</paragraph></subsection><subsection id="IDAE3AA742E397453EB8E75F7BAB8DB932"><enum>(b)</enum><header>Authorized
			 activities</header><text>The activities authorized by this subsection are any
			 of the following:</text>
						<paragraph id="ID0CCD3A3A48554A79990968DFA4DA35BF"><enum>(1)</enum><text>Ground
			 reconnaissance activities.</text>
						</paragraph><paragraph id="ID879E60DB9AE44AB896483C9C7A94045A"><enum>(2)</enum><text>Airborne
			 reconnaissance activities.</text>

						</paragraph><paragraph id="ID1DEBADCE74E2488EB24E95CE77BD53E4"><enum>(11)</enum><text>Ground and air
			 transportation.</text>
						</paragraph></subsection><subsection id="IDA159291E52234A2B93AABFFEF4516202"><enum>(c)</enum><header>Cooperative
			 Agreements</header><text>Units and personnel of the National Guard of a State
			 may perform activities in another State under subsection (a) only pursuant to
			 the terms of an emergency management assistance compact or other cooperative
			 arrangement entered into between Governors of such States for purposes of this
			 section, and only with the approval of the Secretary of Defense.</text>
					</subsection><subsection id="IDBB2F2CEC8C064D9B90CD53FDEA6D544B"><enum>(d)</enum><header>Coordination of
			 assistance</header><text>The Secretary shall, in consultation with the
			 Secretary of Defense and the Governors of the States concerned, coordinate the
			 performance of activities under this section by units and personnel of the
			 National Guard.</text>
					</subsection><subsection id="IDEF69143F0C0F407DBF870D4CB5A93C61"><enum>(e)</enum><header>Annual
			 training</header><text>Annual training duty performed by members of the
			 National Guard under subsection (a) shall be appropriate for the units and
			 individual members concerned, taking into account the types of units and
			 military occupational specialties of individual members performing such
			 duty.</text>
					</subsection><subsection id="ID296FB5C81494419DB09FAF14CB131307"><enum>(f)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="IDDDA9AFB96E614DD0B7C94135C8C9E79A"><enum>(1)</enum><header>Governor of a
			 state</header><text>The term <term>Governor of a State</term> means, in the
			 case of the District of Columbia, the Commanding General of the National Guard
			 of the District of Columbia.</text>
						</paragraph><paragraph id="ID9C6A9C912C404FECBBEF2D1DE5A9BDBF"><enum>(2)</enum><header>State</header><text>The
			 term <term>State</term> means each of the several States, the District of
			 Columbia, the Commonwealth of Puerto Rico, Guam, and the Virgin Islands.</text>
						</paragraph><paragraph id="ID29B9897DF7C6471983AE72ED306C187C"><enum>(3)</enum><header>State along the
			 southern border of the united states</header><text>The term <term>State along
			 the southern border of the United States</term> means each of the
			 following:</text>
							<subparagraph id="ID76C4A5F9682F4831BB9592A120EBDCC3"><enum>(A)</enum><text>The State of
			 Arizona.</text>
							</subparagraph><subparagraph id="IDACB22A96B0F44FE59AED212810C7DAA9"><enum>(B)</enum><text>The State of
			 California.</text>
							</subparagraph><subparagraph id="ID701D34280E1E4FCCB7A973EE910CB795"><enum>(C)</enum><text>The State of New
			 Mexico.</text>
							</subparagraph><subparagraph id="ID06D321AD5F184EE481D52197A46FB9E2"><enum>(D)</enum><text>The State of
			 Texas.</text>
							</subparagraph></paragraph></subsection><subsection id="ID2E7DC3A330F543A395FFEC7F2952D6AA"><enum>(g)</enum><header>Duration of
			 authority</header><text>The authority of this section shall expire on January
			 1, 2009.</text>
					</subsection><subsection id="IDFFB57D29EB5845C7AF3CBBBD6A0726A2"><enum>(h)</enum><header>Prohibition on
			 direct participation in law enforcement</header><text>Activities carried out
			 under the authority of this section shall not include the direct participation
			 of a member of the National Guard in a search, seizure, arrest, or similar
			 activity.</text>
					</subsection></section><section id="ID84705B6080A74155843868DE17B7FB52"><enum>134.</enum><header>Report on
			 incentives to encourage certain members and former Members of the Armed Forces
			 to serve in the Bureau of Customs and Border Protection</header>
					<subsection id="IDC844020228404ABF92E327B799A4C4F8"><enum>(a)</enum><header>Report
			 required</header><text>Not later than 60 days after the date of the enactment
			 of this Act, the Secretary and the Secretary of Defense shall jointly submit to
			 the appropriate committees of Congress a report assessing the desirability and
			 feasibility of offering incentives to covered members and former members of the
			 Armed Forces for the purpose of encouraging such members to serve in the Bureau
			 of Customs and Border Protection.</text>
					</subsection><subsection id="ID3BF1E5CAC5134290A855F7C4793B03EC"><enum>(b)</enum><header>Covered members
			 and former members of the Armed Forces</header><text>For purposes of this
			 section, covered members and former members of the Armed Forces are the
			 following:</text>
						<paragraph id="ID67F0FC9CF23C4F84AB28C553B4D49963"><enum>(1)</enum><text>Members of the
			 reserve components of the Armed Forces.</text>
						</paragraph><paragraph id="IDE77B79582CC84BAF9B37AB677CE8C5FE"><enum>(2)</enum><text>Former members of
			 the Armed Forces within 2 years of separation from service in the Armed
			 Forces.</text>
						</paragraph></subsection><subsection id="ID7677C668BD8F40EAB05F3160FD464473"><enum>(c)</enum><header>Requirements
			 and limitations</header>
						<paragraph id="ID98E07F4B867F4CC99B413DEC264A9490"><enum>(1)</enum><header>Nature of
			 incentives</header><text>In considering incentives for purposes of the report
			 required by subsection (a), the Secretaries shall consider such incentives,
			 whether monetary or otherwise and whether or not authorized by current law or
			 regulations, as the Secretaries jointly consider appropriate.</text>
						</paragraph><paragraph id="IDDA6657D923B1464CB5BD387EBCB4732B"><enum>(2)</enum><header>Targeting of
			 incentives</header><text>In assessing any incentive for purposes of the report,
			 the Secretaries shall give particular attention to the utility of such
			 incentive in—</text>
							<subparagraph id="ID740081F82AF74D8D9CB806310B44C080"><enum>(A)</enum><text>encouraging
			 service in the Bureau of Customs and Border Protection after service in the
			 Armed Forces by covered members and former members of the Armed Forces who have
			 provided border patrol or border security assistance to the Bureau as part of
			 their duties as members of the Armed Forces; and</text>
							</subparagraph><subparagraph id="ID798C56F46E974BA997E402987BE802C5"><enum>(B)</enum><text>leveraging
			 military training and experience by accelerating training, or allowing credit
			 to be applied to related areas of training, required for service with the
			 Bureau of Customs and Border Protection.</text>
							</subparagraph></paragraph><paragraph id="IDF2E0EAC805184FBFB2A5A18F28FA9C1D"><enum>(3)</enum><header>Payment</header><text>In
			 assessing incentives for purposes of the report, the Secretaries shall assume
			 that any costs of such incentives shall be borne by the Department.</text>
						</paragraph></subsection><subsection id="IDCD19A89A827644AF851922C8DAB2E84D"><enum>(d)</enum><header>Elements</header><text>The
			 report required by subsection (a) shall include the following:</text>
						<paragraph id="ID0DDE812F2129432AB98C08D1AC997D7B"><enum>(1)</enum><text>A description of
			 various monetary and non-monetary incentives considered for purposes of the
			 report.</text>
						</paragraph><paragraph id="ID942F623934EE4B73AE9F70A93A5E794B"><enum>(2)</enum><text>An assessment of
			 the desirability and feasibility of utilizing any such incentive for the
			 purpose specified in subsection (a), including an assessment of the particular
			 utility of such incentive in encouraging service in the Bureau of Customs and
			 Border Protection after service in the Armed Forces by covered members and
			 former members of the Armed Forces described in subsection (c)(2).</text>
						</paragraph><paragraph id="IDE8578464863B49D3B51F4B95BBC4294D"><enum>(3)</enum><text>Any other matters
			 that the Secretaries jointly consider appropriate.</text>
						</paragraph></subsection><subsection id="ID33F3BAD53D974285B4BDEA9B98B3E1E3"><enum>(e)</enum><header>Appropriate
			 committees of Congress defined</header><text>In this section, the term
			 <term>appropriate committees of Congress</term> means—</text>
						<paragraph id="IDB39E483C9EEB4434BB542D64DA0BCCE5"><enum>(1)</enum><text>the Committees on
			 Armed Services, Homeland Security and Governmental Affairs, and Appropriations
			 of the Senate; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8B543EDBE5814D85A4A605CE25D82BD0"><enum>(2)</enum><text>the Committees on
			 Armed Services, Homeland Security, and Appropriations of the House of
			 Representatives.</text>
						</paragraph></subsection></section></subtitle><subtitle id="ID0F2C191A53B74ED6AA114A83265AA6BB"><enum>D</enum><header>Border Tunnel
			 Prevention Act</header>
				<section id="ID54D19D9FC69A410FB2E6224C591AF7D6"><enum>141.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This subtitle may be
			 cited as the <quote>Border Tunnel Prevention Act</quote>.</text>
				</section><section id="ID7261BC4266BC411AAF6883735D045813"><enum>142.</enum><header>Construction
			 of border tunnel or passage</header>
					<subsection id="IDA2F20533C1464974922B1FF533B2F71D"><enum>(a)</enum><header>In
			 general</header><text>Chapter 27 of title 18, United States Code, as amended by
			 section 132, is further amended by adding at the end the following:</text>
						<quoted-block id="IDCD1B6D7986A643E7A17EA6842BF9E967" style="USC">
							<section id="IDFCB2379095E2433C85E635581B060BAD"><enum>556.</enum><header>Border tunnels
				and passages</header>
								<subsection id="IDF7068DC026AF4C23BB10602D3E3FCB6D"><enum>(a)</enum><text>Any person who
				knowingly constructs or finances the construction of a tunnel or subterranean
				passage that crosses the international border between the United States and
				another country, other than a lawfully authorized tunnel or passage known to
				the Secretary of Homeland Security and subject to inspection by the Bureau of
				Immigration and Customs Enforcement, shall be fined under this title and
				imprisoned for not more than 20 years.</text>
								</subsection><subsection id="ID150DD037F197419B92194197AFEA2044"><enum>(b)</enum><text>Any person who
				knows or recklessly disregards the construction or use of a tunnel or passage
				described in subsection (a) on land that the person owns or controls shall be
				fined under this title and imprisoned for not more than 10 years.</text>
								</subsection><subsection id="ID3B5DB85A492C4AA3BD254DCADDB23074"><enum>(c)</enum><text>Any person who
				uses a tunnel or passage described in subsection (a) to unlawfully smuggle an
				alien, goods (in violation of section 545), controlled substances, weapons of
				mass destruction (including biological weapons), or a member of a terrorist
				organization (as defined in section 212(a)(3)(B)(vi) of the
				<act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8
				U.S.C. 1182(a)(3)(B)(vi))) shall be subject to a maximum term of imprisonment
				that is twice the maximum term of imprisonment that would have otherwise been
				applicable had the unlawful activity not made use of such a tunnel or
				passage.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="ID69CC274BA57541CFA6A79EBBB85A5A56"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for chapter 27 of title 18,
			 United States Code, as amended by section 132, is further amended by adding at
			 the end the following:</text>

			 amended by inserting <quote>556,</quote> before <quote>1425,</quote>.</text>
					</subsection></section><section id="ID49D83A6F469446598A070295E1DCC4D1"><enum>143.</enum><header>Directive to
			 the United States Sentencing Commission</header>
					<subsection id="ID47500513F6964A2E82272697EEF64E46"><enum>(a)</enum><header>In
			 general</header><text>Pursuant to its authority under section 994 of title 28,
			 United States Code, and in accordance with this section, the United States
			 Sentencing Commission shall promulgate or amend sentencing guidelines to
			 provide for increased penalties for persons convicted of offenses described in
			 section 556 of title 18, United States Code, as added by section 142.</text>
					</subsection><subsection id="ID26270D4F6BC7496EAC52275576682E5E"><enum>(b)</enum><header>Requirements</header><text>In
			 carrying out this section, the United States Sentencing Commission
			 shall—</text>
						<paragraph id="IDDDA4E29646134F6DB7550D4756FEC4DC"><enum>(1)</enum><text>ensure that the
			 sentencing guidelines, policy statements, and official commentary reflect the
			 serious nature of the offenses described in section 556 of title 18, United
			 States Code, and the need for aggressive and appropriate law enforcement action
			 to prevent such offenses;</text>
						</paragraph><paragraph id="ID63A99D526F654DC58EC1C14DCA0E1BF4"><enum>(2)</enum><text>provide adequate
			 base offense levels for offenses under such section;</text>
						</paragraph><paragraph id="IDAF1EC4AEC36E406C9A43373DC80A9DD6"><enum>(3)</enum><text>account for any
			 aggravating or mitigating circumstances that might justify exceptions,
			 including—</text>
							<subparagraph id="ID155014E27479486A9C1161C31FAB7614"><enum>(A)</enum><text>the use of a
			 tunnel or passage described in subsection (a) of such section to facilitate
			 other felonies; and</text>
							</subparagraph><subparagraph id="ID2118A3F2350841DD909D6BD4455B4B49"><enum>(B)</enum><text>the circumstances
			 for which the sentencing guidelines currently provide applicable sentencing
			 enhancements;</text>
							</subparagraph></paragraph><paragraph id="IDE50E8D7331834397A1F9E3EA2C31EF95"><enum>(4)</enum><text>ensure reasonable
			 consistency with other relevant directives, other sentencing guidelines, and
			 statutes;</text>
						</paragraph><paragraph id="ID29C8C5796570492BAA465CDB4DF2244D"><enum>(5)</enum><text>make any
			 necessary and conforming changes to the sentencing guidelines and policy
			 statements; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB1C460BFC31C45C28184A9D6D10FD2F4"><enum>(6)</enum><text>ensure that the
			 sentencing guidelines adequately meet the purposes of sentencing set forth in
			 section 3553(a)(2) of title 18, United States Code.</text>
						</paragraph></subsection></section></subtitle><subtitle id="ID1FE0AD25827140BD82794AE7259E3003"><enum>E</enum><header>Rapid Response
			 Measures</header>
				<section id="IDDE666D50BA3945EDA90F16BA37942636"><enum>151.</enum><header>Deployment of
			 border patrol agents</header>
					<subsection id="ID191E6600C4F24080B2BDFC1FD1F5072C"><enum>(a)</enum><header>Emergency
			 deployment of border patrol agents</header>
						<paragraph id="ID08927307BD25455A9373DDF20E474901"><enum>(1)</enum><header>In
			 general</header><text>If the Governor of a State on an international border of
			 the United States declares an international border security emergency and
			 requests additional United States border patrol agents (referred to in this
			 subtitle as <quote>agents</quote>) from the Secretary, the Secretary, subject
			 to paragraphs (1) and (2), may provide the State with not more than 1,000
			 additional agents for the purpose of patrolling and defending the international
			 border, in order to prevent individuals from crossing the international border
			 into the United States at any location other than an authorized port of
			 entry.</text>
						</paragraph><paragraph id="ID103AD34B8FDA4A949B77EFEDE6AE8833"><enum>(2)</enum><header>Consultation</header><text>Upon
			 receiving a request for agents under paragraph (1), the Secretary, after
			 consultation with the President, shall grant such request to the extent that
			 providing such agents will not significantly impair the Department’s ability to
			 provide border security for any other State.</text>
						</paragraph><paragraph id="ID97CEC121C0804C838DDBF5B4E88F9842"><enum>(3)</enum><header>Collective
			 bargaining</header><text>Emergency deployments under this subsection shall be
			 made in accordance with all applicable collective bargaining agreements and
			 obligations.</text>
						</paragraph></subsection><subsection id="ID6700518A5F8B4E46B0E1CDC709509166"><enum>(b)</enum><header>Elimination of
			 fixed deployment of border patrol agents</header><text>The Secretary shall
			 ensure that agents are not precluded from performing patrol duties and
			 apprehending violators of law, except in unusual circumstances if the temporary
			 use of fixed deployment positions is necessary.</text>
					</subsection><subsection id="ID40952963D68B4335AC59B3E2AC7DB9D8"><enum>(c)</enum><header>Increase in
			 full-Time border patrol agents</header><text>Section 5202(a)(1) of the
			 Intelligence Reform and Terrorism Prevention Act of 2004 (118 Stat. 3734), as
			 amended by section 101(b)(2), is further amended by striking
			 <quote>2,000</quote> and inserting <quote>3,000</quote>.</text>
					</subsection></section><section id="IDEAE853DD0B3246E0AEFE9DCF1074ED36"><enum>152.</enum><header>Border patrol
			 major assets</header>
					<subsection id="ID82A72BD9131C4CBAA912D41D42289B5D"><enum>(a)</enum><header>Control of
			 border patrol assets</header><text>The United States Border Patrol shall have
			 complete and exclusive administrative and operational control over all the
			 assets utilized in carrying out its mission, including, aircraft, watercraft,
			 vehicles, detention space, transportation, and all of the personnel associated
			 with such assets.</text>
					</subsection><subsection id="IDC7D362A9F1814EC59239D72384015CC8"><enum>(b)</enum><header>Helicopters and
			 power boats</header>
						<paragraph id="ID78F302773B4D4889A3833DF9715AB3FD"><enum>(1)</enum><header>Helicopters</header><text>The
			 Secretary shall increase, by not less than 100, the number of helicopters under
			 the control of the United States Border Patrol. The Secretary shall ensure that
			 appropriate types of helicopters are procured for the various missions being
			 performed.</text>
						</paragraph><paragraph id="ID0655CE7A2FB04523A31F98B7BAA33375"><enum>(2)</enum><header>Power
			 boats</header><text>The Secretary shall increase, by not less than 250, the
			 number of power boats under the control of the United States Border Patrol. The
			 Secretary shall ensure that the types of power boats that are procured are
			 appropriate for both the waterways in which they are used and the mission
			 requirements.</text>
						</paragraph><paragraph id="ID2E3FF509E090481292F888C38C1E695A"><enum>(3)</enum><header>Use and
			 training</header><text>The Secretary shall—</text>
							<subparagraph id="ID8AD44A5CB31445648551CA878D556B0F"><enum>(A)</enum><text>establish an
			 overall policy on how the helicopters and power boats procured under this
			 subsection will be used; and</text>
							</subparagraph><subparagraph id="ID8FBC16ED82A04FC5B7DD7C6B193554BC"><enum>(B)</enum><text>implement
			 training programs for the agents who use such assets, including safe operating
			 procedures and rescue operations.</text>
							</subparagraph></paragraph></subsection><subsection id="ID4C0C3127E67641F2BB03E33F7EA8EB24"><enum>(c)</enum><header>Motor
			 vehicles</header>
						<paragraph id="ID20B9A89BEB3B4D9F9100C80BD8DE2E46"><enum>(1)</enum><header>Quantity</header><text>The
			 Secretary shall establish a fleet of motor vehicles appropriate for use by the
			 United States Border Patrol that will permit a ratio of not less than 1
			 police-type vehicle for every 3 agents. These police-type vehicles shall be
			 replaced not less than every 3 years. The Secretary shall ensure that there are
			 sufficient numbers and types of other motor vehicles to support the mission of
			 the United States Border Patrol.</text>
						</paragraph><paragraph id="ID8452DFDF9EE04B3EBD5382E54AF6E354"><enum>(2)</enum><header>Features</header><text>All
			 motor vehicles purchased for the United States Border Patrol shall—</text>
							<subparagraph id="ID8E022FE6B22945A4860F6BB339062C66"><enum>(A)</enum><text>be appropriate
			 for the mission of the United States Border Patrol; and</text>
							</subparagraph><subparagraph id="ID62D4C9AB9D8E40C599B2BF4F9AAC1044"><enum>(B)</enum><text>have a panic
			 button and a global positioning system device that is activated solely in
			 emergency situations to track the location of agents in distress.</text>
							</subparagraph></paragraph></subsection></section><section id="IDED446614712A4FF0A8A796DED622101F"><enum>153.</enum><header>Electronic
			 equipment</header>
					<subsection id="ID8994BB6239ED4D3DA7F4C947D83EFD30"><enum>(a)</enum><header>Portable
			 computers</header><text>The Secretary shall ensure that each police-type motor
			 vehicle in the fleet of the United States Border Patrol is equipped with a
			 portable computer with access to all necessary law enforcement databases and
			 otherwise suited to the unique operational requirements of the United States
			 Border Patrol.</text>
					</subsection><subsection id="IDBE88E9927C3648FAA2DF58FCF0B986AD"><enum>(b)</enum><header>Radio
			 communications</header><text>The Secretary shall augment the existing radio
			 communications system so that all law enforcement personnel working in each
			 area where United States Border Patrol operations are conducted have clear and
			 encrypted 2-way radio communication capabilities at all times. Each portable
			 communications device shall be equipped with a panic button and a global
			 positioning system device that is activated solely in emergency situations to
			 track the location of agents in distress.</text>
					</subsection><subsection id="IDF5C28F568A9A4187ADAABFFBF7B86405"><enum>(c)</enum><header>Hand-Held
			 global positioning system devices</header><text>The Secretary shall ensure that
			 each United States Border Patrol agent is issued a state-of-the-art hand-held
			 global positioning system device for navigational purposes.</text>
					</subsection><subsection id="IDC44044B2A765490085B6D677E4AFF837"><enum>(d)</enum><header>Night vision
			 equipment</header><text>The Secretary shall ensure that sufficient quantities
			 of state-of-the-art night vision equipment are procured and maintained to
			 enable each United States Border Patrol agent working during the hours of
			 darkness to be equipped with a portable night vision device.</text>
					</subsection></section><section id="ID2ECEFE6550314AC2BDDBE09F47C2D600"><enum>154.</enum><header>Personal
			 equipment</header>
					<subsection id="IDC1ABB3EDDD5141CDBFE6DACB56564297"><enum>(a)</enum><header>Body
			 armor</header><text>The Secretary shall ensure that every agent is issued
			 high-quality body armor that is appropriate for the climate and risks faced by
			 the agent. Each agent shall be permitted to select from among a variety of
			 approved brands and styles. Agents shall be strongly encouraged, but not
			 required, to wear such body armor whenever practicable. All body armor shall be
			 replaced not less than every 5 years.</text>
					</subsection><subsection id="ID01684EC8895E4CAAB7A1156682D1B13C"><enum>(b)</enum><header>Weapons</header><text>The
			 Secretary shall ensure that agents are equipped with weapons that are reliable
			 and effective to protect themselves, their fellow agents, and innocent third
			 parties from the threats posed by armed criminals. The Secretary shall ensure
			 that the policies of the Department authorize all agents to carry weapons that
			 are suited to the potential threats that they face.</text>
					</subsection><subsection id="IDF59241F259094091A808E336E3062D2A"><enum>(c)</enum><header>Uniforms</header><text>The
			 Secretary shall ensure that all agents are provided with all necessary uniform
			 items, including outerwear suited to the climate, footwear, belts, holsters,
			 and personal protective equipment, at no cost to such agents. Such items shall
			 be replaced at no cost to such agents as they become worn, unserviceable, or no
			 longer fit properly.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="IDBE361AC8E04A467783EE5D10B7A55337" section-type="subsequent-section"><enum>155.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to the Secretary such sums as may be necessary
			 for each of the fiscal years 2007 through 2011 to carry out this
			 subtitle.</text>
				</section></subtitle></title><title id="id4D191D1CBEE34403873C4BC7B0949CFC"><enum>II</enum><header>Border Law
			 Enforcement Relief</header>
			<subtitle id="ID58390F3D52C342F5B186CC859B4AAE80"><enum>A</enum><header>Border Law
			 Enforcement Relief Act</header>
				<section id="ID867DB025AB7A4063984B94A923E7C5E1"><enum>201.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This subtitle may be
			 cited as the <quote>Border Law Enforcement Relief Act of 2006</quote>.</text>
				</section><section id="IDDD776E5637BD4783A1F850E98E073574"><enum>202.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
					<paragraph id="ID8AA02C1B8E4940FFB24587B9576C0EF7"><enum>(1)</enum><text>It is the
			 obligation of the Federal Government of the United States to adequately secure
			 the Nation’s borders and prevent the flow of undocumented persons and illegal
			 drugs into the United States.</text>
					</paragraph><paragraph id="ID3CDFDEB1F421493D9FA7D258158964CD"><enum>(2)</enum><text>Despite the fact
			 that the United States Border Patrol apprehends over 1,000,000 people each year
			 trying to illegally enter the United States, according to the Congressional
			 Research Service, the net growth in the number of unauthorized aliens has
			 increased by approximately 500,000 each year. The Southwest border accounts for
			 approximately 94 percent of all migrant apprehensions each year. Currently,
			 there are an estimated 11,000,000 unauthorized aliens in the United
			 States.</text>
					</paragraph><paragraph id="ID1D67AF4463344A3A926BAFDA43909FA7"><enum>(3)</enum><text>The border region
			 is also a major corridor for the shipment of drugs. According to the El Paso
			 Intelligence Center, 65 percent of the narcotics that are sold in the markets
			 of the United States enter the country through the Southwest border.</text>
					</paragraph><paragraph id="IDCC4DACFE8E9045158BF388A482C76CCE"><enum>(4)</enum><text>Border
			 communities continue to incur significant costs due to the lack of adequate
			 border security. A 2001 study by the United States-Mexico Border Counties
			 Coalition found that law enforcement and criminal justice expenses associated
			 with illegal immigration exceed $89,000,000 annually for the Southwest border
			 counties.</text>
					</paragraph><paragraph id="ID8CD09C8833354161BE8116B243C20242"><enum>(5)</enum><text>In August 2005,
			 the States of New Mexico and Arizona declared states of emergency in order to
			 provide local law enforcement immediate assistance in addressing criminal
			 activity along the Southwest border.</text>
					</paragraph><paragraph id="ID6800DD5993E948E7829875606D6AA453"><enum>(6)</enum><text>While the Federal
			 Government provides States and localities assistance in covering costs related
			 to the detention of certain criminal aliens and the prosecution of Federal drug
			 cases, local law enforcement along the border are provided no assistance in
			 covering such expenses and must use their limited resources to combat drug
			 trafficking, human smuggling, kidnappings, the destruction of private property,
			 and other border-related crimes.</text>
					</paragraph><paragraph id="ID0F39D9075944494ABD5DD62E5AD287F2"><enum>(7)</enum><text>The United States
			 shares 5,525 miles of border with Canada and 1,989 miles with Mexico. Many of
			 the local law enforcement agencies located along the border are small, rural
			 departments charged with patrolling large areas of land. Counties along the
			 Southwest United States-Mexico border are some of the poorest in the country
			 and lack the financial resources to cover the additional costs associated with
			 illegal immigration, drug trafficking, and other border-related crimes.</text>
					</paragraph><paragraph id="ID2784636C299C4FAEB6320DD83EC7BB6A"><enum>(8)</enum><text>Federal
			 assistance is required to help local law enforcement operating along the border
			 address the unique challenges that arise as a result of their proximity to an
			 international border and the lack of overall border security in the
			 region</text>
					</paragraph></section><section id="IDDF242ACD4135453F880C05255DB4D1C4"><enum>203.</enum><header>Border relief
			 grant program</header>
					<subsection id="IDD78701CCBD224D34A802F4587AD3618B"><enum>(a)</enum><header>Grants
			 authorized</header>
						<paragraph id="IDFE7197095F0D49378E9BDBFB51C71827"><enum>(1)</enum><header>In
			 general</header><text>The Secretary is authorized to award grants, subject to
			 the availability of appropriations, to an eligible law enforcement agency to
			 provide assistance to such agency to address—</text>
							<subparagraph id="ID028AA4B4F98F4762B3884A8D4C594871"><enum>(A)</enum><text>criminal activity
			 that occurs in the jurisdiction of such agency by virtue of such agency’s
			 proximity to the United States border; and</text>
							</subparagraph><subparagraph id="ID58D52C059BD844C68C3EEE147C9E7751"><enum>(B)</enum><text>the impact of any
			 lack of security along the United States border.</text>
							</subparagraph></paragraph><paragraph id="ID22D66C52894E492189DB25D472EE6ABD"><enum>(2)</enum><header>Duration</header><text>Grants
			 may be awarded under this subsection during fiscal years 2007 through
			 2011.</text>
						</paragraph><paragraph id="ID3AE9F3105038488692A1E0EFAFC5FD39"><enum>(3)</enum><header>Competitive
			 basis</header><text>The Secretary shall award grants under this subsection on a
			 competitive basis, except that the Secretary shall give priority to
			 applications from any eligible law enforcement agency serving a
			 community—</text>
							<subparagraph id="ID6BC8DDDE20C94FF6A2F9F559367EF2C3"><enum>(A)</enum><text>with a population
			 of less than 50,000; and</text>
							</subparagraph><subparagraph id="IDC0AAC11C57754B129B1C9A0C993F04A6"><enum>(B)</enum><text>located no more
			 than 100 miles from a United States border with—</text>
								<clause id="ID74F2B92A03FF40E08281B5F837896C23"><enum>(i)</enum><text>Canada; or</text>
								</clause><clause id="ID658DAAFBD66D46A7806FA4EB67A1508C"><enum>(ii)</enum><text>Mexico.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="ID706C701BB90E4E02A26288FB51B751B4"><enum>(b)</enum><header>Use of
			 funds</header><text>Grants awarded pursuant to subsection (a) may only be used
			 to provide additional resources for an eligible law enforcement agency to
			 address criminal activity occurring along any such border, including—</text>
						<paragraph id="IDB58CD17A189C4204BB11E21A055E4608"><enum>(1)</enum><text>to obtain
			 equipment;</text>
						</paragraph><paragraph id="IDCC4187FBA9F242B8BA399D814815B59A"><enum>(2)</enum><text>to hire
			 additional personnel;</text>
						</paragraph><paragraph id="IDBF0EFF66D68C435384952AD2C6EAEB56"><enum>(3)</enum><text>to upgrade and
			 maintain law enforcement technology;</text>
						</paragraph><paragraph id="ID206D12CAD06B47C6A90DF6FDAFD899F6"><enum>(4)</enum><text>to cover
			 operational costs, including overtime and transportation costs; and</text>
						</paragraph><paragraph id="ID11325E9A1DAF46C1822CD56A18951F17"><enum>(5)</enum><text>such other
			 resources as are available to assist that agency.</text>
						</paragraph></subsection><subsection id="ID7639EBB806A642DABAD7748810D4BFB8"><enum>(c)</enum><header>Application</header>
						<paragraph id="ID3F8591F7107544769DDD3D00714A45B3"><enum>(1)</enum><header>In
			 general</header><text>Each eligible law enforcement agency seeking a grant
			 under this section shall submit an application to the Secretary at such time,
			 in such manner, and accompanied by such information as the Secretary may
			 reasonably require.</text>
						</paragraph><paragraph id="ID45D60A422F374974A825B2B6688DB0AD"><enum>(2)</enum><header>Contents</header><text>Each
			 application submitted pursuant to paragraph (1) shall—</text>
							<subparagraph id="ID70F1C858CBFB4A81A3C2101507EFD23B"><enum>(A)</enum><text>describe the
			 activities for which assistance under this section is sought; and</text>
							</subparagraph><subparagraph id="ID3C457AFF0D124A63A9FCB8128379DC1B"><enum>(B)</enum><text>provide such
			 additional assurances as the Secretary determines to be essential to ensure
			 compliance with the requirements of this section.</text>
							</subparagraph></paragraph></subsection><subsection id="IDAF9B1363FF4342128034F40013DB0CF5"><enum>(d)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="IDF7C94D0E2C7845C68D5921C5AE6701CC"><enum>(1)</enum><header>Eligible law
			 enforcement agency</header><text>The term <term>eligible law enforcement
			 agency</term> means a tribal, State, or local law enforcement agency—</text>
							<subparagraph id="IDF6F1C2956A864B1BA14962321EDA2187"><enum>(A)</enum><text>located in a
			 county no more than 100 miles from a United States border with—</text>
								<clause id="ID5BDF48161CEE40889190545747496F4B"><enum>(i)</enum><text>Canada; or</text>
								</clause><clause id="IDB9EC6990BE4C49BD8E53A41358553265"><enum>(ii)</enum><text>Mexico;
			 or</text>
								</clause></subparagraph><subparagraph id="ID241D975FAA0144DDA2A0A55D62259B35"><enum>(B)</enum><text>located in a
			 county more than 100 miles from any such border, but where such county has been
			 certified by the Secretary as a High Impact Area.</text>
							</subparagraph></paragraph><paragraph id="IDABDD854CB1C44E0C8F92F5C3D36A9928"><enum>(2)</enum><header>High impact
			 area</header><text>The term <term>High Impact Area</term> means any county
			 designated by the Secretary as such, taking into consideration—</text>
							<subparagraph id="IDC8966E35C79449FEB0867903ED456B52"><enum>(A)</enum><text>whether local law
			 enforcement agencies in that county have the resources to protect the lives,
			 property, safety, or welfare of the residents of that county;</text>
							</subparagraph><subparagraph id="ID0F9C5BAA48A341CD95219BCD02953A96"><enum>(B)</enum><text>the relationship
			 between any lack of security along the United States border and the rise, if
			 any, of criminal activity in that county; and</text>
							</subparagraph><subparagraph id="ID50E2B58919834ED185C11FF249AE7156"><enum>(C)</enum><text>any other unique
			 challenges that local law enforcement face due to a lack of security along the
			 United States border.</text>
							</subparagraph></paragraph></subsection><subsection id="ID2B7B7E8C30234043B92A64136F198375"><enum>(e)</enum><header>Authorization
			 of appropriations</header>
						<paragraph id="ID14C1450FC1AC45B0BF58F2BE5A543A8B"><enum>(1)</enum><header>In
			 general</header><text>There are authorized to be appropriated $50,000,000 for
			 each of fiscal years 2007 through 2011 to carry out the provisions of this
			 section.</text>
						</paragraph><paragraph id="ID4F7F07C9AF35404080563D875D80BC32"><enum>(2)</enum><header>Division of
			 authorized funds</header><text>Of the amounts authorized under paragraph
			 (1)—</text>
							<subparagraph id="ID902F75C788BC4A5190037315E7047AE1"><enum>(A)</enum><text><fraction>2/3</fraction>
			 shall be set aside for eligible law enforcement agencies located in the 6
			 States with the largest number of undocumented alien apprehensions; and</text>
							</subparagraph><subparagraph id="ID4766EA2311A5426BA5BDD9F91449B78B"><enum>(B)</enum><text><fraction>1/3</fraction>
			 shall be set aside for areas designated as a High Impact Area under subsection
			 (d).</text>
							</subparagraph></paragraph></subsection><subsection id="ID31AB0C5CBC454C78B0E95EB0A67E99A6"><enum>(f)</enum><header>Supplement not
			 supplant</header><text>Amounts appropriated for grants under this section shall
			 be used to supplement and not supplant other State and local public funds
			 obligated for the purposes provided under this title.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="ID9CFF35CFE8BC420D9C414CCB3B4EF945" section-type="subsequent-section"><enum>204.</enum><header>Enforcement of
			 Federal immigration law</header><text display-inline="no-display-inline">Nothing in this subtitle shall be construed
			 to authorize State or local law enforcement agencies or their officers to
			 exercise Federal immigration law enforcement authority.</text>
				</section></subtitle><subtitle id="idD3127F846D684B0F9E5330B2378D91DC"><enum>B</enum><header>Additional Law
			 Enforcement Relief</header>
				<section id="ID7D8619E7CEF44505AABB69547BC2B408"><enum>211.</enum><header>State criminal
			 alien assistance program</header>
					<subsection id="ID37FB953903B6474288E9034F53D2D296"><enum>(a)</enum><header>Reimbursement
			 for costs associated with processing criminal illegal aliens</header><text>The
			 Secretary shall reimburse States and units of local government for costs
			 associated with processing undocumented criminal aliens through the criminal
			 justice system, including—</text>
						<paragraph id="ID942FF4EC1A6F4883BC4CDB1D07C0DB21"><enum>(1)</enum><text>indigent
			 defense;</text>
						</paragraph><paragraph id="ID228FFE9DA0C5461490ED668A198C12BD"><enum>(2)</enum><text>criminal
			 prosecution;</text>
						</paragraph><paragraph id="ID9A21C4A9DC2A4D8F92F8AB472A40B2D8"><enum>(3)</enum><text>autopsies;</text>
						</paragraph><paragraph id="IDC8F6C16DD4554408B35B59A2D96396A7"><enum>(4)</enum><text>translators and
			 interpreters; and</text>
						</paragraph><paragraph id="ID6B18E5C3F571461C88DBD1071FA1E44E"><enum>(5)</enum><text>court
			 costs.</text>
						</paragraph></subsection><subsection id="IDD50292598E5A4A11A9FFCA30819FD44C"><enum>(b)</enum><header>Authorization
			 of Appropriations</header>
						<paragraph id="IDD014BA3D7E154CEEA983CC2BE61C623B"><enum>(1)</enum><header>Processing
			 criminal illegal aliens</header><text>There are authorized to be appropriated
			 $400,000,000 for each of the fiscal years 2007 through 2012 to carry out
			 subsection (a).</text>
						</paragraph><paragraph id="ID0EBCC72E6D0D4B5FA51F527DCBBE0448"><enum>(2)</enum><header>Compensation
			 upon request</header><text>Section 241(i)(5) (8 U.S.C. 1231(i)) is amended to
			 read as follows:</text>

			 and processing of illegal aliens apprehended by State and local law enforcement
			 officers</header>
					<subsection id="IDF0D4BBBC507F4C3CB28E3DCB14A4429B"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall provide sufficient transportation and
			 officers to take illegal aliens apprehended by State and local law enforcement
			 officers into custody for processing at a detention facility operated by the
			 Department.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID46591662F7154F01B5F81F696BEE531D"><enum>(b)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as may be necessary for each of fiscal years 2007 through 2011 to carry
			 out this section.</text>

			 removal of criminal aliens</header>

				237(a)(2).</text>

			 (c) that relates to presumption of deportability, by striking <quote>convicted

				United States, who has not been admitted or paroled into the United States, and
				who is apprehended within 100 miles of an international land border of the
				United States and within 14 days of
				entry.</text>
									</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph id="IDA5609E9182104B658F8E4C2EA6C748DD"><enum>(2)</enum><header>Exception</header><text>Section
			 235(b)(1)(F) (8 U.S.C. 1225(b)(1)(F)) is amended to read as follows:</text>

				or citizen of a country in the Western Hemisphere with whose government the
				United States does not have full diplomatic relations; and</text>
									</clause><clause id="id311D60156E8246E0A6166C715F92151F"><enum>(ii)</enum><text>who—</text>
										<subclause id="ID624CED21201D4EFC8C2E23D3320293A4"><enum>(I)</enum><text>arrives by
				aircraft at a port of entry; or</text>
										</subclause><subclause id="ID924FC150FB684FB08DE1396DCD6122AC"><enum>(II)</enum><text>is present in
				the United States and arrived in any manner at or between a port of
				entry.</text>
										</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDE095B66122894F2C82E87FB580C9E4C5"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date of the enactment of this Act and shall apply to all aliens apprehended or
			 convicted on or after such date.</text>
					</subsection></section><section id="ID8D451C86C2FB4DCEB120EB00BF46F1C9"><enum>214.</enum><header>Increase of
			 Federal detention space and the utilization of facilities identified for
			 closure as a result of the Defense Base Closure Realignment Act of
			 1990</header>
					<subsection id="ID44DF1270C17E460084F465AC7DF1D7C6"><enum>(a)</enum><header>Construction or
			 acquisition of detention facilities</header>
						<paragraph id="ID97B9F0C483E54EAC993EB3CF01E89E1C"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall construct or acquire, in addition to
			 existing facilities for the detention of aliens, at least 20 detention
			 facilities in the United States that have the capacity to detain a combined
			 total of not less than 20,000 individuals at any time for aliens detained
			 pending removal or a decision on removal of such aliens from the United States
			 subject to available appropriations.</text>
						</paragraph></subsection><subsection id="IDA43FE5D59FF347E3926B3C7E173BF649"><enum>(b)</enum><header>Construction of
			 or acquisition of detention facilities</header>
						<paragraph id="IDB77C7E22050546B585E6690277E2972B"><enum>(1)</enum><header>Requirement to
			 construct or acquire</header><text>The Secretary shall construct or acquire
			 additional detention facilities in the United States to accommodate the
			 detention beds required by section 5204(a) of the Intelligence Reform and
			 Terrorism Protection Act of 2004, as amended by subsection (a), subject to
			 available appropriations.</text>
						</paragraph><paragraph id="ID4FF61590D07D4520A0BE7495D25172BD"><enum>(2)</enum><header>Use of
			 alternate detention facilities</header><text>Subject to the availability of
			 appropriations, the Secretary shall fully utilize all possible options to cost
			 effectively increase available detention capacities, and shall utilize
			 detention facilities that are owned and operated by the Federal Government if
			 the use of such facilities is cost effective.</text>
						</paragraph><paragraph id="ID07587D510EB3430DB81D4ED55CA30E39"><enum>(3)</enum><header>Use of
			 installations under base closure laws</header><text>In acquiring additional
			 detention facilities under this subsection, the Secretary shall consider the
			 transfer of appropriate portions of military installations approved for closure
			 or realignment under the Defense Base Closure and Realignment Act of 1990 (part
			 A of title XXIX of Public Law 101–510; 10 U.S.C. 2687 note) for use in
			 accordance with subsection (a).</text>
						</paragraph><paragraph id="ID5069BF38519B42C29897913E1BC5CEF0"><enum>(4)</enum><header>Determination
			 of location</header><text>The location of any detention facility constructed or
			 acquired in accordance with this subsection shall be determined, with the
			 concurrence of the Secretary, by the senior officer responsible for Detention
			 and Removal Operations in the Department. The detention facilities shall be
			 located so as to enable the officers and employees of the Department to
			 increase to the maximum extent practicable the annual rate and level of
			 removals of illegal aliens from the United States.</text>
						</paragraph></subsection><subsection id="IDCC11ECD1519147E3A4146073CE9EFE25"><enum>(c)</enum><header>Annual report
			 to Congress</header><text>Not later than 1 year after the date of the enactment
			 of this Act, and annually thereafter, in consultation with the heads of other
			 appropriate Federal agencies, the Secretary shall submit to Congress an
			 assessment of the additional detention facilities and bed space needed to
			 detain unlawful aliens apprehended at United States ports of entry or along the
			 international land borders of the United States.</text>
					</subsection><subsection id="IDA76C9B4BB83D422EA434A5D47949436D"><enum>(d)</enum><header>Technical and
			 conforming amendment</header><text>Section 241(g)(1) (8 U.S.C. 1231(g)(1)) is
			 amended by striking <quote>may expend</quote> and inserting <quote>shall
			 expend</quote>.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID74AD778F058240D0B91B07B0E29F8FE5"><enum>(e)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as may be necessary to carry out this section.</text>
					</subsection></section><section id="ID22F427EDA47F49A3AAF0F92BA5CC07D7"><enum>215.</enum><header>Northern
			 Border Prosecution Initiative</header>
					<subsection id="IDAA7E055C85CC4B308700592C82975008"><enum>(a)</enum><header>Initiative
			 required</header>
						<paragraph id="ID3FD7FCB0449B47EE9920C879EF81DBB6"><enum>(1)</enum><header>In
			 general</header><text>From amounts made available to carry out this section,
			 the Attorney General, acting through the Director of the Bureau of Justice
			 Assistance of the Office of Justice Programs, shall establish and carry out a
			 program, to be known as the Northern Border Prosecution Initiative, to provide
			 funds to reimburse eligible northern border entities for costs incurred by
			 those entities for handling case dispositions of criminal cases that are
			 federally initiated but federally declined-referred.</text>
						</paragraph><paragraph id="IDE40872070DD240A28D54BEC0C763BF8F"><enum>(2)</enum><header>Relation with
			 southwestern border prosecution initiative</header><text>The program
			 established in paragraph (1) shall—</text>
							<subparagraph id="IDBCAF5CA6C13B4F9DAA5E73EA411D90CC"><enum>(A)</enum><text>be modeled after
			 the Southwestern Border Prosecution Initiative; and</text>
							</subparagraph><subparagraph id="ID07EED49F932D4C51B2CCD2E8C8E44803"><enum>(B)</enum><text>serve as a
			 partner program to that initiative to reimburse local jurisdictions for
			 processing Federal cases.</text>
							</subparagraph></paragraph></subsection><subsection id="ID0DD4B664F85D4E36807F7EB18B35D67B"><enum>(b)</enum><header>Provision and
			 allocation of funds</header><text>Funds provided under the program established
			 in subsection (a) shall be—</text>
						<paragraph id="ID0711958F1D364024808078F17DF0A7F8"><enum>(1)</enum><text>provided in the
			 form of direct reimbursements; and</text>
						</paragraph><paragraph id="IDD3CCD874E346476488B7B60453D05CC6"><enum>(2)</enum><text>allocated in a
			 manner consistent with the manner under which funds are allocated under the
			 Southwestern Border Prosecution Initiative.</text>
						</paragraph></subsection><subsection id="ID0B6814D876C54A96A8132C1D6A54E0D5"><enum>(c)</enum><header>Use of
			 funds</header><text>Funds provided to an eligible northern border entity under
			 this section may be used by the entity for any lawful purpose,
			 including:</text>
						<paragraph id="ID8D66A6773E3C49E7B2B76B3505571704"><enum>(1)</enum><text>prosecution and
			 related costs;</text>
						</paragraph><paragraph id="ID86B44AC8C9AD411E970B228B012C1DE0"><enum>(2)</enum><text>court
			 costs;</text>
						</paragraph><paragraph id="IDBE66538246B245B08BBD76A11E525639"><enum>(3)</enum><text>costs of
			 courtroom technology;</text>
						</paragraph><paragraph id="ID9B5A9282FBB1427782AD8A21B08EE51D"><enum>(4)</enum><text>costs of
			 constructing holding spaces;</text>
						</paragraph><paragraph id="ID9F95DB500BAA41CFA1C6C958A71048B8"><enum>(5)</enum><text>costs of
			 administrative staff;</text>
						</paragraph><paragraph id="IDF29909283B70488B97579A04B9C0F572"><enum>(6)</enum><text>costs of defense
			 counsel for indigent defendants; and</text>
						</paragraph><paragraph id="IDD6037C70DB744B2296FD3C99930556B2"><enum>(7)</enum><text>detention costs,
			 including pretrial and posttrial detention.</text>
						</paragraph></subsection><subsection id="IDA66AF10D79B543CDA4FA22DBB9F75621"><enum>(d)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="ID8AD17482D12B4A62A80CDFD22A7F0F1C"><enum>(1)</enum><header>Case
			 disposition</header><text>The term <term>case disposition</term>—</text>
							<subparagraph id="ID9980C44527304D409CE68C1E92386DC6"><enum>(A)</enum><text>for purposes of
			 the Northern Border Prosecution Initiative, refers to the time between the
			 arrest of a suspect and the resolution of the criminal charges through a county
			 or State judicial or prosecutorial process; and</text>
							</subparagraph><subparagraph id="IDAF4D8B1192574492A69BD47D13DE6E97"><enum>(B)</enum><text>does not include
			 incarceration time for sentenced offenders or time spent by prosecutors on
			 judicial appeals.</text>
							</subparagraph></paragraph><paragraph id="IDDD65FBCB338E43AD96166B7E7B1A3D7B"><enum>(2)</enum><header>Eligible
			 northern border entity</header><text>The term <term>eligible northern border
			 entity</term> means—</text>
							<subparagraph id="IDEFE8BCD1CF9344CFA599009264A6BE22"><enum>(A)</enum><text>the States of
			 Alaska, Idaho, Maine, Michigan, Minnesota, Montana, New Hampshire, New York,
			 North Dakota, Ohio, Pennsylvania, Vermont, Washington, and Wisconsin; or</text>
							</subparagraph><subparagraph id="ID34581C3865D0487498E7217675ABB4A6"><enum>(B)</enum><text>any unit of local
			 government within a State referred to in subparagraph (A).</text>
							</subparagraph></paragraph><paragraph id="ID9E1277AD95994B0E97AEBF1439EFFCC2"><enum>(3)</enum><header>Federally
			 declined-referred</header><text>The term <term>federally
			 declined-referred</term>—</text>
							<subparagraph id="ID46208AEAF3CC4BB18BCCE9E0CFF2D9AC"><enum>(A)</enum><text>means, with
			 respect to a criminal case, that a decision has been made in that case by a
			 United States Attorney or a Federal law enforcement agency during a Federal
			 investigation to no longer pursue Federal criminal charges against a defendant
			 and to refer such investigation to a State or local jurisdiction for possible
			 prosecution; and</text>
							</subparagraph><subparagraph id="ID79CF66B283C84524BFE2DF441C74C212"><enum>(B)</enum><text>includes a
			 decision made on a case-by-case basis as well as a decision made pursuant to a
			 general policy or practice or pursuant to prosecutorial discretion.</text>
							</subparagraph></paragraph><paragraph id="ID30F8F3AA69104E0DB6ACCF2018F0E352"><enum>(4)</enum><header>Federally
			 initiated</header><text>The term <term>federally initiated</term> means, with
			 respect to a criminal case, that the case results from a criminal investigation
			 or an arrest involving Federal law enforcement authorities for a potential
			 violation of Federal criminal law, including investigations resulting from
			 multi-jurisdictional task forces.</text>
						</paragraph></subsection><subsection id="ID9CF1EB8D46064CFEB8462801897C840A"><enum>(e)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated to
			 carry out this section $28,000,000 for fiscal year 2006 and such sums as may be
			 necessary for fiscal years thereafter.</text>
					</subsection></section><section id="ID4A1792D006944FA987930D37A2202AEE"><enum>216.</enum><header>Southwest
			 Border Prosecution Initiative</header>
					<subsection id="ID372041B3DC7342A48417A2B9A07DF11E"><enum>(a)</enum><header>Reimbursement
			 to State and local prosecutors for prosecuting federally initiated drug
			 cases</header><text>The Attorney General shall, subject to the availability of
			 appropriations, reimburse Southern Border State and county prosecutors for
			 prosecuting federally initiated and referred drug cases.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID425991DF99224946994B6EB914487708"><enum>(b)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated
			 $50,000,000 for each of the fiscal years 2007 through 2012 to carry out
			 subsection (a).</text>
					</subsection></section><section id="id513567B1E82C472BA7BC1D501CA08EFF"><enum>217.</enum><header>Law
			 enforcement authority of States and political subdivisions and transfer to
			 Federal custody</header>
					<subsection id="ID985e624c16404c358019c96a6ea6b248"><enum>(a)</enum><header>In
			 general</header><text>Title II (8 U.S.C. 1151 et. seq.) is amended by adding
			 after section 240C the following:</text>
						<quoted-block display-inline="no-display-inline" id="idD25B842343E643C69E1451A339BD198E" style="OLC">
							<section id="IDbf241ae1f22e4939b0df38257718a78b"><enum>240D.</enum><header>Law
				enforcement authority of States and political subdivisions and transfer of
				aliens to Federal custody</header>
								<subsection id="IDfc6d695f2d3949249b6e94e27fc9101d"><enum>(a)</enum><header>Authority</header><text>Notwithstanding
				any other provision of law, law enforcement personnel of a State, or a
				political subdivision of a State, have the inherent authority of a sovereign
				entity to investigate, apprehend, arrest, detain, or transfer to Federal
				custody (including transporting across State lines to detention centers) an
				alien for the purpose of assisting in the enforcement of the criminal
				provisions of the immigration laws of the United States in the normal course of
				carrying out the law enforcement duties of such personnel. This State authority
				has never been displaced or preempted by a Federal law.</text>
								</subsection><subsection id="ID78d22679e3ac4e9f96b845b811a23b0a"><enum>(b)</enum><header>Construction</header><text>Nothing
				in this section shall be construed to require law enforcement personnel of a
				State or a political subdivision to assist in the enforcement of the
				immigration laws of the United States.</text>
								</subsection><subsection id="ID41dfa241a4f14994acd60945501797be"><enum>(c)</enum><header>Transfer</header><text>If
				the head of a law enforcement entity of a State (or, if appropriate, a
				political subdivision of the State) exercising authority with respect to the
				apprehension or arrest of an alien submits a request to the Secretary of
				Homeland Security that the alien be taken into Federal custody, the Secretary
				of Homeland Security—</text>
									<paragraph id="ID0629e11b209b4c55b8060a4f13dba643"><enum>(1)</enum><text>shall—</text>
										<subparagraph id="ID6c7688b3b6b94cd9b0ed4e6c0c159a5a"><enum>(A)</enum><text>deem the request
				to include the inquiry to verify immigration status described in section 642(c)
				of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8
				U.S.C. 1373(c)), and expeditiously inform the requesting entity whether such
				individual is an alien lawfully admitted to the United States or is otherwise
				lawfully present in the United States; and</text>
										</subparagraph><subparagraph id="ID4b2b34ef0103469698f294d17c927e32"><enum>(B)</enum><text>if the individual
				is an alien who is not lawfully admitted to the United States or otherwise is
				not lawfully present in the United States—</text>
											<clause id="IDdee12afdfed64bce9d4e4126931c28f1"><enum>(i)</enum><text>take the illegal
				alien into the custody of the Federal Government not later than 72 hours
				after—</text>
												<subclause id="id5DA2EB1D361445BC9F4F0AAD53289FAF"><enum>(I)</enum><text>the conclusion of
				the State charging process or dismissal process; or</text>
												</subclause><subclause id="id2937599B09674922ACDC1FC4F60E07FF"><enum>(II)</enum><text>the illegal
				alien is apprehended, if no State charging or dismissal process is required;
				or</text>
												</subclause></clause><clause id="IDb82f8ac2578846e1a245634accaae2ac"><enum>(ii)</enum><text>request that the
				relevant State or local law enforcement agency temporarily detain or transport
				the alien to a location for transfer to Federal custody; and</text>
											</clause></subparagraph></paragraph><paragraph id="ID4b6c6f7ecd9545219ebe6cfa507da6cd"><enum>(2)</enum><text>shall designate
				at least 1 Federal, State, or local prison or jail or a private contracted
				prison or detention facility within each State as the central facility for that
				State to transfer custody of aliens to the Department of Homeland
				Security.</text>
									</paragraph></subsection><subsection id="ID2f5b8e89f36646aeac81b96dade44b4f"><enum>(d)</enum><header>Reimbursement</header>
									<paragraph id="ID7f7c2ff5947e418682d6b4c4cc88b3e6"><enum>(1)</enum><header>In
				general</header><text>The Secretary of Homeland Security shall reimburse a
				State, or a political subdivision of a State, for expenses, as verified by the
				Secretary, incurred by the State or political subdivision in the detention and
				transportation of an alien as described in subparagraphs (A) and (B) of
				subsection (c)(1).</text>
									</paragraph><paragraph id="ID5b06d89b6b144c069dc93081264aa8c7"><enum>(2)</enum><header>Cost
				computation</header><text>Compensation provided for costs incurred under
				subparagraphs (A) and (B) of subsection (c)(1) shall be the sum of—</text>
										<subparagraph id="ID56c0a1d5d6ff48f0829d311738a3d47c"><enum>(A)</enum><text>the product
				of—</text>
											<clause id="IDf66cd6f1e34f44e9ace86036f25e4d3f"><enum>(i)</enum><text>the average daily
				cost of incarceration of a prisoner in the relevant State, as determined by the
				chief executive officer of a State (or, as appropriate, a political subdivision
				of the State); multiplied by</text>
											</clause><clause id="ID59bb8ca2f8114174b9c38e8d353d8db1"><enum>(ii)</enum><text>the number of
				days that the alien was in the custody of the State or political
				subdivision;</text>
											</clause></subparagraph><subparagraph id="ID9d2e4f2f60a44e74b36c3020b476f49f"><enum>(B)</enum><text>the cost of
				transporting the alien from the point of apprehension or arrest to the location
				of detention, and if the location of detention and of custody transfer are
				different, to the custody transfer point; and</text>
										</subparagraph><subparagraph id="ID090222c5b7fa4cdba6ee1837c7d28df1"><enum>(C)</enum><text>the cost of
				uncompensated emergency medical care provided to a detained alien during the
				period between the time of transmittal of the request described in subsection
				(c) and the time of transfer into Federal custody.</text>
										</subparagraph></paragraph></subsection><subsection id="IDe9943c3dff784b97bb7aff6105428130"><enum>(e)</enum><header>Requirement for
				appropriate security</header><text>The Secretary of Homeland Security shall
				ensure that—</text>
									<paragraph id="id3B19214159724630B27A4B6BA1856345"><enum>(1)</enum><text>aliens
				incarcerated in a Federal facility pursuant to this section are held in
				facilities which provide an appropriate level of security; and</text>
									</paragraph><paragraph id="idC63D644BD94049CCA324E040282E59F8"><enum>(2)</enum><text>aliens detained
				solely for civil violations of Federal immigration law are separated within a
				facility or facilities, if practicable.</text>
									</paragraph></subsection><subsection id="ID51525f48bc8c48ec9d1be92e9c72c8b5"><enum>(f)</enum><header>Requirement for
				schedule</header><text>In carrying out this section, the Secretary of Homeland
				Security shall establish a regular circuit and schedule for the prompt
				transportation of apprehended aliens from the custody of those States, and
				political subdivisions of States, which routinely submit requests described in
				subsection (c), into Federal custody.</text>
								</subsection><subsection id="ID91c9ec11a5a54c71a11f5bd2a551d16b"><enum>(g)</enum><header>Authority for
				contracts</header>
									<paragraph id="IDec56c410451e4562bd02d5d66548d0ed"><enum>(1)</enum><header>In
				general</header><text>The Secretary of Homeland Security may enter into
				contracts or cooperative agreements with appropriate State and local law
				enforcement and detention agencies to implement this section.</text>
									</paragraph><paragraph id="ID18b7f1cb98cc4abfb2c1ef26761cf8fe"><enum>(2)</enum><header>Determination
				by Secretary</header><text>Before entering into a contract or cooperative
				agreement with a State or political subdivision of a State under paragraph (1),
				the Secretary shall determine whether the State, or if appropriate, the
				political subdivision in which the agencies are located, has in place any
				formal or informal policy that violates section 642 of the Illegal Immigration
				Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1373). The Secretary
				shall not allocate any of the funds made available under this section to any
				State or political subdivision that has in place a policy that violates such
				section.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="ID6e893c791447486397483c2f42aec4d7"><enum>(b)</enum><header>Authorization
			 of appropriations for the detention and transportation to Federal custody of
			 aliens not lawfully present</header><text>There are authorized to be
			 appropriated $850,000,000 for fiscal year 2007 and for each subsequent fiscal
			 year for the detention and removal of aliens not lawfully present in the United
			 States under the Immigration and Nationality Act (8 U.S.C. 1101 et.
			 seq.).</text>
					</subsection></section></subtitle></title><title id="id3C8B96EE27B84EEFAC9E26F53A5AFD2E"><enum>III</enum><header>Border
			 infrastructure and technology modernization</header>
			<subtitle id="ID3405CA6124554661987AB5B7D3A2AE6E"><enum>A</enum><header>Border
			 Infrastructure and Technology Modernization Act</header>
				<section id="ID9DCD8E6F47674AFB96F3D69C8430890A"><enum>301.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This subtitle may be
			 cited as the <quote>Border Infrastructure and Technology Modernization
			 Act</quote>.</text>
				</section><section id="ID307332771BA04ACBBEF0101A8B1F2656"><enum>302.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text>
					<paragraph id="IDBA5EA967CF05492BB7F16B75A19DDC4E"><enum>(1)</enum><header>Commissioner</header><text>The
			 term <term>Commissioner</term> means the Commissioner of the Bureau of Customs
			 and Border Protection of the Department.</text>
					</paragraph><paragraph id="ID5D308153D5664AA2B4F2F2D5B0F41FB3"><enum>(2)</enum><header>Maquiladora</header><text>The
			 term <term>maquiladora</term> means an entity located in Mexico that assembles
			 and produces goods from imported parts for export to the United States.</text>
					</paragraph><paragraph id="ID5A70954779DA4C38B91719D6ED1FB95E"><enum>(3)</enum><header>Northern
			 border</header><text>The term <term>northern border</term> means the
			 international border between the United States and Canada.</text>
					</paragraph><paragraph id="IDBA14AAA0958B4D1B8033EAB97BF7AC55"><enum>(4)</enum><header>Southern
			 border</header><text>The term <term>southern border</term> means the
			 international border between the United States and Mexico.</text>
					</paragraph></section><section id="ID17AFBA05538F4C81A009AADC3AB810E4"><enum>303.</enum><header>Port of Entry
			 Infrastructure Assessment Study</header>
					<subsection id="ID7080B9B4AB5748BF9CF844C41AC037EA"><enum>(a)</enum><header>Requirement To
			 update</header><text>Not later than January 31 of each year, the Administrator
			 of General Services shall update the Port of Entry Infrastructure Assessment
			 Study prepared by the Bureau of Customs and Border Protection in accordance
			 with the matter relating to the ports of entry infrastructure assessment that
			 is set out in the joint explanatory statement in the conference report
			 accompanying H.R. 2490 of the 106th Congress, 1st session (House of
			 Representatives Rep. No. 106–319, on page 67) and submit such updated study to
			 Congress.</text>
					</subsection><subsection id="IDB11A70F1CFE74C45AC535D50EEDBB728"><enum>(b)</enum><header>Consultation</header><text>In
			 preparing the updated studies required in subsection (a), the Administrator of
			 General Services shall consult with the Director of the Office of Management
			 and Budget, the Secretary, and the Commissioner.</text>
					</subsection><subsection id="IDB29AA2CFAD66463F8A07C25F6B9BA7BC"><enum>(c)</enum><header>Content</header><text>Each
			 updated study required in subsection (a) shall—</text>
						<paragraph id="ID1E96E97A7ACE4CEF8079990A4BD4AD40"><enum>(1)</enum><text>identify port of
			 entry infrastructure and technology improvement projects that would enhance
			 border security and facilitate the flow of legitimate commerce if
			 implemented;</text>
						</paragraph><paragraph id="IDFBDFEC9EF41F46EB8BA214F5323E13C9"><enum>(2)</enum><text>include the
			 projects identified in the National Land Border Security Plan required by
			 section 304; and</text>
						</paragraph><paragraph id="IDDEDDEA76AD3A456D9E72279A8CF662F1"><enum>(3)</enum><text>prioritize the
			 projects described in paragraphs (1) and (2) based on the ability of a project
			 to—</text>
							<subparagraph id="ID859C36B48AA8421CBB9B83AC8D94BFD6"><enum>(A)</enum><text>fulfill immediate
			 security requirements; and</text>
							</subparagraph><subparagraph id="ID9EACDA540E4B43D2AB65137C872C7859"><enum>(B)</enum><text>facilitate trade
			 across the borders of the United States.</text>
							</subparagraph></paragraph></subsection><subsection id="ID91BE0A8A8BFE44A6BBC864FF189D4CF8"><enum>(d)</enum><header>Project
			 implementation</header><text>The Commissioner shall implement the
			 infrastructure and technology improvement projects described in subsection (c)
			 in the order of priority assigned to each project under subsection
			 (c)(3).</text>
					</subsection><subsection id="IDD203CE7DD4344A79A67884BCBC0D166A"><enum>(e)</enum><header>Divergence from
			 priorities</header><text>The Commissioner may diverge from the priority order
			 if the Commissioner determines that significantly changed circumstances, such
			 as immediate security needs or changes in infrastructure in Mexico or Canada,
			 compellingly alter the need for a project in the United States.</text>
					</subsection></section><section id="IDD90769217D3A49ADA894D621B482B4E6"><enum>304.</enum><header>National Land
			 Border Security Plan</header>
					<subsection id="IDD3D5A58CFD424A2FA037A47641785080"><enum>(a)</enum><header>In
			 general</header><text>Not later than 1 year after the date of the enactment of
			 this Act, and annually thereafter, the Secretary, after consultation with
			 representatives of Federal, State, and local law enforcement agencies and
			 private entities that are involved in international trade across the northern
			 border or the southern border, shall submit a National Land Border Security
			 Plan to Congress.</text>
					</subsection><subsection id="ID09BC5A0929B74A858657195BF277C120"><enum>(b)</enum><header>Vulnerability
			 assessment</header>
						<paragraph id="IDD488F5015D194EA98D4D858875513C4B"><enum>(1)</enum><header>In
			 general</header><text>The plan required in subsection (a) shall include a
			 vulnerability assessment of each port of entry located on the northern border
			 or the southern border.</text>
						</paragraph><paragraph id="ID5261C271A32B4E9F89ABBBAFED9556BC"><enum>(2)</enum><header>Port security
			 coordinators</header><text>The Secretary may establish 1 or more port security
			 coordinators at each port of entry located on the northern border or the
			 southern border—</text>
							<subparagraph id="IDF1F93CB0F39646BD882657BC6C499F66"><enum>(A)</enum><text>to assist in
			 conducting a vulnerability assessment at such port; and</text>
							</subparagraph><subparagraph id="ID0048DC9E118049C2AF1FECA289E17F06"><enum>(B)</enum><text>to provide other
			 assistance with the preparation of the plan required in subsection (a).</text>
							</subparagraph></paragraph></subsection></section><section id="IDBE4A61CFBE8A4830906A8B7E04628633"><enum>305.</enum><header>Expansion of
			 commerce security programs</header>
					<subsection id="IDB51F855932354E01A74ABD0B0344309E"><enum>(a)</enum><header>Customs-Trade
			 Partnership Against Terrorism</header>
						<paragraph id="ID2BD6A3F8BB57422299F26213F2A23CF6"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Commissioner, in consultation with the Secretary, shall develop a
			 plan to expand the size and scope, including personnel, of the Customs-Trade
			 Partnership Against Terrorism programs along the northern border and southern
			 border, including—</text>
							<subparagraph id="ID4959FDC674394F2FA8A5CBC4B0EDB88D"><enum>(A)</enum><text>the Business
			 Anti-Smuggling Coalition;</text>
							</subparagraph><subparagraph id="IDF739691BD78144E69633B547AA0ECB8A"><enum>(B)</enum><text>the Carrier
			 Initiative Program;</text>
							</subparagraph><subparagraph id="ID0DAA333454AD4100B273E7185BF2AB5B"><enum>(C)</enum><text>the Americas
			 Counter Smuggling Initiative;</text>
							</subparagraph><subparagraph id="IDAF3B8EC5FDD74F89A6735974C6D2C198"><enum>(D)</enum><text>the Container
			 Security Initiative;</text>
							</subparagraph><subparagraph id="ID971074A8D09640EE9BAF517B5017DA7B"><enum>(E)</enum><text>the Free and
			 Secure Trade Initiative; and</text>
							</subparagraph><subparagraph id="IDD588C1462E4F4BE0B8423815CEBEB6C9"><enum>(F)</enum><text>other Industry
			 Partnership Programs administered by the Commissioner.</text>
							</subparagraph></paragraph><paragraph id="ID8ABBEA75FDC44A83AAF418037F5E5952"><enum>(2)</enum><header>Southern border
			 demonstration program</header><text>Not later than 180 days after the date of
			 enactment of this Act, the Commissioner shall implement, on a demonstration
			 basis, at least 1 Customs–Trade Partnership Against Terrorism program along the
			 southern border, which has been successfully implemented along the northern
			 border.</text>
						</paragraph></subsection><subsection id="ID4EBB2C22C2DA47FA8EAEF232E50C46C0"><enum>(b)</enum><header>Maquiladora
			 Demonstration Program</header><text>Not later than 180 days after the date of
			 enactment of this Act, the Commissioner shall establish a demonstration program
			 to develop a cooperative trade security system to improve supply chain
			 security.</text>
					</subsection></section><section id="IDABBD0990D7494F169BF4B387C5FA295E"><enum>306.</enum><header>Port of entry
			 technology demonstration program</header>
					<subsection id="ID3133192FD7B847448DACFAE20459A022"><enum>(a)</enum><header>Establishment</header><text>The
			 Secretary shall carry out a technology demonstration program to—</text>
						<paragraph id="IDF920E338FBAC49DFBFD4C6CDCBD1F2B1"><enum>(1)</enum><text>test and evaluate
			 new port of entry technologies;</text>
						</paragraph><paragraph id="ID1937A0EF3BE443A5ADB88E23C18E8FCF"><enum>(2)</enum><text>refine port of
			 entry technologies and operational concepts; and</text>
						</paragraph><paragraph id="IDB7C8731E759642D7A805E2E49B70D8C6"><enum>(3)</enum><text>train personnel
			 under realistic conditions.</text>
						</paragraph></subsection><subsection id="IDA65ED0A3E0FA4A3FA546FB1701FCA37E"><enum>(b)</enum><header>Technology and
			 facilities</header>
						<paragraph id="ID6E3F94E4D21C4581A2C3C3F5712839A9"><enum>(1)</enum><header>Technology
			 testing</header><text>Under the technology demonstration program, the Secretary
			 shall test technologies that enhance port of entry operations, including
			 operations related to—</text>
							<subparagraph id="ID2C9C6AF923E942F69FEB6FF63118253D"><enum>(A)</enum><text>inspections;</text>
							</subparagraph><subparagraph id="ID752CD1A2F6E94C6A8AEB5A9607B9E496"><enum>(B)</enum><text>communications;</text>
							</subparagraph><subparagraph id="ID0E13685243C84F458C7ADA584B45BA98"><enum>(C)</enum><text>port
			 tracking;</text>
							</subparagraph><subparagraph id="ID0F16812D460C4CC39F9066EF145DDB1E"><enum>(D)</enum><text>identification of
			 persons and cargo;</text>
							</subparagraph><subparagraph id="IDDD52A584B87349CD908E2F298003DF31"><enum>(E)</enum><text>sensory
			 devices;</text>
							</subparagraph><subparagraph id="IDA57877CEDDD14DD4B919207FEDAF7862"><enum>(F)</enum><text>personal
			 detection;</text>
							</subparagraph><subparagraph id="IDEDF38A1164044373A882065E75E36DD5"><enum>(G)</enum><text>decision support;
			 and</text>
							</subparagraph><subparagraph id="ID4A2A9E7C3CDB4D4AB0242E42DB7563A2"><enum>(H)</enum><text>the detection and
			 identification of weapons of mass destruction.</text>
							</subparagraph></paragraph><paragraph id="ID7D179AA9E3C24033B900589B3335C76F"><enum>(2)</enum><header>Development of
			 facilities</header><text>At a demonstration site selected pursuant to
			 subsection (c)(2), the Secretary shall develop facilities to provide
			 appropriate training to law enforcement personnel who have responsibility for
			 border security, including—</text>
							<subparagraph id="IDABF63E493ADF4B1AAA6ECF5831EB3EBC"><enum>(A)</enum><text>cross-training
			 among agencies;</text>
							</subparagraph><subparagraph id="IDE5CA4BD3359140F9889CF7AA06470D7E"><enum>(B)</enum><text>advanced law
			 enforcement training; and</text>
							</subparagraph><subparagraph id="ID86AF3C53D1EC495FB2BF28958947380A"><enum>(C)</enum><text>equipment
			 orientation.</text>
							</subparagraph></paragraph></subsection><subsection id="ID1AB2747CCC9745F8803A01498C9B7F6D"><enum>(c)</enum><header>Demonstration
			 sites</header>
						<paragraph id="ID02F685A86ED34FDE8066ADD5132DB7BA"><enum>(1)</enum><header>Number</header><text>The
			 Secretary shall carry out the demonstration program at not less than 3 sites
			 and not more than 5 sites.</text>
						</paragraph><paragraph id="ID75559A09DEAD40CB863C40472580D918"><enum>(2)</enum><header>Selection
			 criteria</header><text>To ensure that at least 1 of the facilities selected as
			 a port of entry demonstration site for the demonstration program has the most
			 up-to-date design, contains sufficient space to conduct the demonstration
			 program, has a traffic volume low enough to easily incorporate new technologies
			 without interrupting normal processing activity, and can efficiently carry out
			 demonstration and port of entry operations, at least 1 port of entry selected
			 as a demonstration site shall—</text>
							<subparagraph id="ID2F7DD141FBD1477083CE11FF68A0712C"><enum>(A)</enum><text>have been
			 established not more than 15 years before the date of the enactment of this
			 Act;</text>
							</subparagraph><subparagraph id="IDB3E9845DD0FA4FDB875EBF124462E0A5"><enum>(B)</enum><text>consist of not
			 less than 65 acres, with the possibility of expansion to not less than 25
			 adjacent acres; and</text>
							</subparagraph><subparagraph id="IDFB062E1897164B7496072F09EBEB8C95"><enum>(C)</enum><text>have serviced an
			 average of not more than 50,000 vehicles per month during the 1-year period
			 ending on the date of the enactment of this Act.</text>
							</subparagraph></paragraph></subsection><subsection id="ID46D07477561245E4AB8202267863472B"><enum>(d)</enum><header>Relationship
			 with other agencies</header><text>The Secretary shall permit personnel from an
			 appropriate Federal or State agency to utilize a demonstration site described
			 in subsection (c) to test technologies that enhance port of entry operations,
			 including technologies described in subparagraphs (A) through (H) of subsection
			 (b)(1).</text>
					</subsection><subsection id="IDF8DE19D3EE514E9582CC365FFED23194"><enum>(e)</enum><header>Report</header>
						<paragraph id="ID862A9A5A43014E759004EF51D2BB7EFA"><enum>(1)</enum><header>Requirement</header><text>Not
			 later than 1 year after the date of the enactment of this Act, and annually
			 thereafter, the Secretary shall submit to Congress a report on the activities
			 carried out at each demonstration site under the technology demonstration
			 program established under this section.</text>
						</paragraph><paragraph id="ID9A072B9F6C7449588F0565E967B0A5EE"><enum>(2)</enum><header>Content</header><text>The
			 report submitted under paragraph (1) shall include an assessment by the
			 Secretary of the feasibility of incorporating any demonstrated technology for
			 use throughout the Bureau of Customs and Border Protection.</text>
						</paragraph></subsection></section><section id="ID261D5606612E40F5817B07B506E874A0"><enum>307.</enum><header>Authorization
			 of appropriations</header>
					<subsection id="ID96770AE416804F3AACD4855A5B6E7CC8"><enum>(a)</enum><header>In
			 general</header><text>In addition to any funds otherwise available, there are
			 authorized to be appropriated—</text>
						<paragraph id="IDF675C15CA9424253B3CCC311AB38439F"><enum>(1)</enum><text>such sums as may
			 be necessary for the fiscal years 2007 through 2011 to carry out the provisions
			 of section 303(a);</text>
						</paragraph><paragraph id="ID8F76AD253E3C4A928A752F70BF52C018"><enum>(2)</enum><text>to carry out
			 section 303(d)—</text>
							<subparagraph id="ID6480CA7B8280404DAA61B853F0F0FAE4"><enum>(A)</enum><text>$100,000,000 for
			 each of the fiscal years 2007 through 2011; and</text>
							</subparagraph><subparagraph id="ID38F82A4EAC594036B547E52A25A75484"><enum>(B)</enum><text>such sums as may
			 be necessary in any succeeding fiscal year;</text>
							</subparagraph></paragraph><paragraph id="ID483EF9677D5C4A43B4A6E747AA619783"><enum>(3)</enum><text>to carry out
			 section 305(a)—</text>
							<subparagraph id="ID5640A229901541E398D0429101E5BE4E"><enum>(A)</enum><text>$30,000,000 for
			 fiscal year 2007, of which $5,000,000 shall be made available to fund the
			 demonstration project established in section 306(a)(2); and</text>
							</subparagraph><subparagraph id="IDC72C97ADFA814CBAB6FEB81270E566F8"><enum>(B)</enum><text>such sums as may
			 be necessary for the fiscal years 2008 through 2011;</text>
							</subparagraph></paragraph><paragraph id="ID639537A70E13425DB025855C2E641116"><enum>(4)</enum><text>to carry out
			 section 305(b)—</text>
							<subparagraph id="ID53B85A4C933B4DED8D5A9FD0BE2441AA"><enum>(A)</enum><text>$5,000,000 for
			 fiscal year 2007; and</text>
							</subparagraph><subparagraph id="IDD0BC95F0FC3944778FDB634887F62948"><enum>(B)</enum><text>such sums as may
			 be necessary for the fiscal years 2008 through 2011; and</text>
							</subparagraph></paragraph><paragraph id="IDA7863B8DB2D04D40A9CA108B22C422CD"><enum>(5)</enum><text>to carry out
			 section 306, provided that not more than $10,000,000 may be expended for
			 technology demonstration program activities at any 1 port of entry
			 demonstration site in any fiscal year—</text>
							<subparagraph id="ID6BCE4EE93B1D48E5BD93A5B822C1DF2D"><enum>(A)</enum><text>$50,000,000 for
			 fiscal year 2007; and</text>
							</subparagraph><subparagraph id="ID439526290BB748D6BC160B00018EEC3A"><enum>(B)</enum><text>such sums as may
			 be necessary for each of the fiscal years 2008 through 2011.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8EC80B839DD847B5ACC9492D58EE32BD"><enum>(b)</enum><header>International
			 agreements</header><text>Amounts authorized to be appropriated under this
			 subtitle may be used for the implementation of projects described in the
			 Declaration on Embracing Technology and Cooperation to Promote the Secure and
			 Efficient Flow of People and Commerce across our Shared Border between the
			 United States and Mexico, agreed to March 22, 2002, Monterrey, Mexico (commonly
			 known as the Border Partnership Action Plan) or the Smart Border Declaration
			 between the United States and Canada, agreed to December 12, 2001, Ottawa,
			 Canada that are consistent with the provisions of this subtitle.</text>
					</subsection></section></subtitle><subtitle id="id36DAE347A5884D1F872E3C84FCC462CE"><enum>B</enum><header>Additional
			 infrastructure elements</header>
				<section id="IDFEF9C8663708403A838E6B5A322E5F6F"><enum>311.</enum><header>Surveillance
			 technologies programs</header>
					<subsection id="IDD39CF5B4092E4F489411ECA2AC73FD53"><enum>(a)</enum><header>Aerial
			 surveillance program</header>
						<paragraph id="ID5C28C5F94F3B4F07845C81DE91D4E686"><enum>(1)</enum><header>In
			 general</header><text>In conjunction with the border surveillance plan
			 developed under section 5201 of the Intelligence Reform and Terrorism
			 Prevention Act of 2004 (Public Law 108–458; 8 U.S.C. 1701 note), the Secretary,
			 not later than 90 days after the date of enactment of this Act, shall develop
			 and implement a program to fully integrate and utilize aerial surveillance
			 technologies, including unmanned aerial vehicles, to enhance the security of
			 the international border between the United States and Canada and the
			 international border between the United States and Mexico. The goal of the
			 program shall be to ensure continuous monitoring of each mile of each such
			 border.</text>
						</paragraph><paragraph id="ID913BC52E519C4F50BE8D814CD987C092"><enum>(2)</enum><header>Assessment and
			 consultation requirements</header><text>In developing the program under this
			 subsection, the Secretary shall—</text>
							<subparagraph id="IDBDB6F0869D934EDFBDBA2D7A399F6AFF"><enum>(A)</enum><text>consider current
			 and proposed aerial surveillance technologies;</text>
							</subparagraph><subparagraph id="ID2023295E472D4FD2BE278C6A6B44DE0D"><enum>(B)</enum><text>assess the
			 feasibility and advisability of utilizing such technologies to address border
			 threats, including an assessment of the technologies considered best suited to
			 address respective threats;</text>
							</subparagraph><subparagraph id="IDC8104A87C4034AC98AA8639908EE3D03"><enum>(C)</enum><text>consult with the
			 Secretary of Defense regarding any technologies or equipment, which the
			 Secretary may deploy along an international border of the United States;
			 and</text>
							</subparagraph><subparagraph id="ID6BBA010C1D184B9C8D34BBE162EFE739"><enum>(D)</enum><text>consult with the
			 Administrator of the Federal Aviation Administration regarding safety, airspace
			 coordination and regulation, and any other issues necessary for implementation
			 of the program.</text>
							</subparagraph></paragraph><paragraph id="IDA067B68009BE4A45A8C02426ECA0CB5B"><enum>(3)</enum><header>Additional
			 requirements</header>
							<subparagraph id="IDA6CBE45D6CBD4BBEA55AA971BBCC1B5B"><enum>(A)</enum><header>In
			 general</header><text>The program developed under this subsection shall include
			 the use of a variety of aerial surveillance technologies in a variety of
			 topographies and areas, including populated and unpopulated areas located on or
			 near an international border of the United States, in order to evaluate, for a
			 range of circumstances—</text>
								<clause id="ID2F8CD087B84B4E138C2E184E7137F430"><enum>(i)</enum><text>the
			 significance of previous experiences with such technologies in border security
			 or critical infrastructure protection;</text>
								</clause><clause id="ID1DF3EDAECB99465D81CB793461A8FCC1"><enum>(ii)</enum><text>the cost and
			 effectiveness of various technologies for border security, including varying
			 levels of technical complexity; and</text>
								</clause><clause id="IDD5922DCD1D364B5C91D708B63003A0D1"><enum>(iii)</enum><text>liability,
			 safety, and privacy concerns relating to the utilization of such technologies
			 for border security.</text>
								</clause></subparagraph></paragraph><paragraph id="IDBC11072CA3A64492A9E9B59ED321EBF9"><enum>(4)</enum><header>Continued use
			 of aerial surveillance technologies</header><text>The Secretary may continue
			 the operation of aerial surveillance technologies while assessing the
			 effectiveness of the utilization of such technologies.</text>
						</paragraph><paragraph id="ID631E429B506C4850BB69A1EE700B91C8"><enum>(5)</enum><header>Report to
			 congress</header><text>Not later than 180 days after implementing the program
			 under this subsection, the Secretary shall submit a report to Congress
			 regarding the program developed under this subsection. The Secretary shall
			 include in the report a description of the program together with such
			 recommendations as the Secretary finds appropriate for enhancing the
			 program.</text>
						</paragraph><paragraph id="ID70963BBEF9E54547ADAB24E53A552AD2"><enum>(6)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as may be necessary to carry out this subsection.</text>
						</paragraph></subsection><subsection id="ID85060246D43F4171B32A7B609A6F5C36"><enum>(b)</enum><header>Integrated and
			 Automated Surveillance Program</header>
						<paragraph id="ID2FB26E7B13CA497E90AA7B29BEC1197F"><enum>(1)</enum><header>Requirement for
			 program</header><text>Subject to the availability of appropriations, the
			 Secretary shall establish a program to procure additional unmanned aerial
			 vehicles, cameras, poles, sensors, satellites, radar coverage, and other
			 technologies necessary to achieve operational control of the international
			 borders of the United States and to establish a security perimeter known as a
			 <quote>virtual fence</quote> along such international borders to provide a
			 barrier to illegal immigration. Such program shall be known as the Integrated
			 and Automated Surveillance Program.</text>
						</paragraph><paragraph id="IDF1424179EAC0428690F3B7CAA20AC2B2"><enum>(2)</enum><header>Program
			 components</header><text>The Secretary shall ensure, to the maximum extent
			 feasible, the Integrated and Automated Surveillance Program is carried out in a
			 manner that—</text>
							<subparagraph id="ID329D7055D8974E55800E89CEBC780578"><enum>(A)</enum><text>the technologies
			 utilized in the Program are integrated and function cohesively in an automated
			 fashion, including the integration of motion sensor alerts and cameras, whereby
			 a sensor alert automatically activates a corresponding camera to pan and tilt
			 in the direction of the triggered sensor;</text>
							</subparagraph><subparagraph id="ID62EBB5CEE4AC485081B6597F74CC6A1E"><enum>(B)</enum><text>cameras utilized
			 in the Program do not have to be manually operated;</text>
							</subparagraph><subparagraph id="ID1A06B7788D0B4E39928480733F729344"><enum>(C)</enum><text>such camera views
			 and positions are not fixed;</text>
							</subparagraph><subparagraph id="ID4BCE887FE9754CCDB9281953CB3F1917"><enum>(D)</enum><text>surveillance
			 video taken by such cameras can be viewed at multiple designated communications
			 centers;</text>
							</subparagraph><subparagraph id="ID9FE57BFF6470443D80B44DED50F72350"><enum>(E)</enum><text>a standard
			 process is used to collect, catalog, and report intrusion and response data
			 collected under the Program;</text>
							</subparagraph><subparagraph id="IDA68930DF7AC948B8848EB9EA1DA6102C"><enum>(F)</enum><text>future remote
			 surveillance technology investments and upgrades for the Program can be
			 integrated with existing systems;</text>
							</subparagraph><subparagraph id="ID05240C641FC34E71B418CB8F229A82FD"><enum>(G)</enum><text>performance
			 measures are developed and applied that can evaluate whether the Program is
			 providing desired results and increasing response effectiveness in monitoring
			 and detecting illegal intrusions along the international borders of the United
			 States;</text>
							</subparagraph><subparagraph id="ID9B9FABF49BCE4046AC20DCEC14557A8F"><enum>(H)</enum><text>plans are
			 developed under the Program to streamline site selection, site validation, and
			 environmental assessment processes to minimize delays of installing
			 surveillance technology infrastructure;</text>
							</subparagraph><subparagraph id="ID8FFAAFF58BEA4C4693C648A47F959888"><enum>(I)</enum><text>standards are
			 developed under the Program to expand the shared use of existing private and
			 governmental structures to install remote surveillance technology
			 infrastructure where possible; and</text>
							</subparagraph><subparagraph id="ID8CA3391464444BD69CFB5BD5D75304B9"><enum>(J)</enum><text>standards are
			 developed under the Program to identify and deploy the use of nonpermanent or
			 mobile surveillance platforms that will increase the Secretary’s mobility and
			 ability to identify illegal border intrusions.</text>
							</subparagraph></paragraph><paragraph id="IDAA77513FCFA649C7B7AAF15AD25001FB"><enum>(3)</enum><header>Report to
			 congress</header><text>Not later than 1 year after the initial implementation
			 of the Integrated and Automated Surveillance Program, the Secretary shall
			 submit to Congress a report regarding the Program. The Secretary shall include
			 in the report a description of the Program together with any recommendation
			 that the Secretary finds appropriate for enhancing the program.</text>
						</paragraph><paragraph id="ID4ECB45B078694C998A6F4A10CEAE8006"><enum>(4)</enum><header>Evaluation of
			 contractors</header>
							<subparagraph id="ID8C3A2589A2234B98ABFDB42D222298A0"><enum>(A)</enum><header>Requirement for
			 standards</header><text>The Secretary shall develop appropriate standards to
			 evaluate the performance of any contractor providing goods or services to carry
			 out the Integrated and Automated Surveillance Program.</text>
							</subparagraph><subparagraph id="ID549FC59ED66A437E891C1A5826E3BAD4"><enum>(B)</enum><header>Review by the
			 inspector general</header><text>The Inspector General of the Department shall
			 timely review each new contract related to the Program that has a value of more
			 than $5,000,000, to determine whether such contract fully complies with
			 applicable cost requirements, performance objectives, program milestones, and
			 schedules. The Inspector General shall report the findings of such review to
			 the Secretary in a timely manner. Not later than 30 days after the date the
			 Secretary receives a report of findings from the Inspector General, the
			 Secretary shall submit to the Committee on Homeland Security and Governmental
			 Affairs of the Senate and the Committee on Homeland Security of the House of
			 Representatives a report of such findings and a description of any the steps
			 that the Secretary has taken or plans to take in response to such
			 findings.</text>

			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as may be necessary to carry out this subsection.</text>
						</paragraph></subsection></section><section id="IDE00AF42EAD614B5EB40098E3BF924D60"><enum>312.</enum><header>Border
			 security on certain Federal land</header>
					<subsection id="ID0F5C56CA48BC4AB68DFF9751EDADB3E1"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
						<paragraph id="ID9F6061F04315489792CF51C3282D29BD"><enum>(1)</enum><header>Protected
			 land</header><text>The term <term>protected land</term> means land under the
			 jurisdiction of the Secretary concerned.</text>
						</paragraph><paragraph id="ID1C4F6DF248BD4F00B3767E2D041FC921"><enum>(2)</enum><header>Secretary
			 concerned</header><text>The term <term>Secretary concerned</term> means—</text>
							<subparagraph id="ID9120C06EDD1547EE82292E0E62DEEFCB"><enum>(A)</enum><text>with respect to
			 land under the jurisdiction of the Secretary of Agriculture, the Secretary of
			 Agriculture; and</text>
							</subparagraph><subparagraph id="ID211DB375A2B64A11A43B55D5DD24379F"><enum>(B)</enum><text>with respect to
			 land under the jurisdiction of the Secretary of the Interior, the Secretary of
			 the Interior.</text>
							</subparagraph></paragraph></subsection><subsection id="ID6898C620DC9D469391C8736DA0DDE763"><enum>(b)</enum><header>Support for
			 border security needs</header>
						<paragraph id="IDD2E5F6B8201F47A3817DC1216E1867E5"><enum>(1)</enum><header>In
			 general</header><text>To gain operational control over the international land
			 borders of the United States and to prevent the entry of terrorists, unlawful
			 aliens, narcotics, and other contraband into the United States, the Secretary,
			 in cooperation with the Secretary concerned, shall provide—</text>
							<subparagraph id="ID25DC1607BE244C47A11F4728ED71FEE5"><enum>(A)</enum><text>increased Customs
			 and Border Protection personnel to secure protected land along the
			 international land borders of the United States;</text>
							</subparagraph><subparagraph id="ID462CFE15209049CAA60A58DFF4231721"><enum>(B)</enum><text>Federal land
			 resource training for Customs and Border Protection agents dedicated to
			 protected land; and</text>
							</subparagraph><subparagraph id="IDAD76DFDDD9CF4B389B66098E83DB3D1F"><enum>(C)</enum><text>Unmanned Aerial
			 Vehicles, aerial assets, Remote Video Surveillance camera systems, and sensors
			 on protected land that is directly adjacent to the international land border of
			 the United States, with priority given to units of the National Park
			 System.</text>
							</subparagraph></paragraph><paragraph id="ID66075291C2114D3DA1EC7D6E1E883583"><enum>(2)</enum><header>Coordination</header><text>In
			 providing training for Customs and Border Protection agents under paragraph
			 (1)(B), the Secretary shall coordinate with the Secretary concerned to ensure
			 that the training is appropriate to the mission of the National Park Service,
			 the United States Fish and Wildlife Service, the Forest Service, or the
			 relevant agency of the Department of the Interior or the Department of
			 Agriculture to minimize the adverse impact on natural and cultural resources
			 from border protection activities.</text>
						</paragraph></subsection><subsection id="ID5DF3E21FB4194C1F88A0223DC6C7C7C1"><enum>(c)</enum><header>Inventory of
			 costs and activities</header><text>The Secretary concerned shall develop and
			 submit to the Secretary an inventory of costs incurred by the Secretary
			 concerned relating to illegal border activity, including the cost of equipment,
			 training, recurring maintenance, construction of facilities, restoration of
			 natural and cultural resources, recapitalization of facilities, and
			 operations.</text>
					</subsection><subsection id="ID5D186A36F1BF4B679D490B1735D57621"><enum>(d)</enum><header>Recommendations</header><text>The
			 Secretary shall—</text>
						<paragraph id="ID2DE3D273BEF343769C19562388B51734"><enum>(1)</enum><text>develop joint
			 recommendations with the National Park Service, the United States Fish and
			 Wildlife Service, and the Forest Service for an appropriate cost recovery
			 mechanism relating to items identified in subsection (c); and</text>
						</paragraph><paragraph id="ID275906455CA4497DA4C7FCB05E1EC378"><enum>(2)</enum><text>not later than
			 March 31, 2007, submit to the appropriate congressional committees (as defined
			 in section 2 of the Homeland Security Act of 2002 (6 U.S.C. 101)), including
			 the Subcommittee on National Parks of the Senate and the Subcommittee on
			 National Parks, Recreation and Public Lands of the House of Representatives,
			 the recommendations developed under paragraph (1).</text>
						</paragraph></subsection><subsection id="ID212F21DD2CC8484CA13D620D10C754FB"><enum>(e)</enum><header>Border
			 protection strategy</header><text>The Secretary, the Secretary of the Interior,
			 and the Secretary of Agriculture shall jointly develop a border protection
			 strategy that supports the border security needs of the United States in the
			 manner that best protects—</text>
						<paragraph id="ID53708BE243D04B52BA0CECE3E9256994"><enum>(1)</enum><text>units of the
			 National Park System;</text>
						</paragraph><paragraph id="ID1D3961A8767E4275B8B34DB6B316D8E0"><enum>(2)</enum><text>National Forest
			 System land;</text>
						</paragraph><paragraph id="ID9D92632865CD48E687DF6D548F9BA3E2"><enum>(3)</enum><text>land under the
			 jurisdiction of the United States Fish and Wildlife Service; and</text>
						</paragraph><paragraph id="ID034AB5611F514CAC8326C0C43A031119"><enum>(4)</enum><text>other relevant
			 land under the jurisdiction of the Department of the Interior or the Department
			 of Agriculture.</text>
						</paragraph></subsection></section><section id="ID50990BE37D19445B97A79CAA2A4A4177"><enum>313.</enum><header>Unmanned
			 aerial vehicles</header>
					<subsection id="IDD270EC2C52B54770B08FA47A2512453C"><enum>(a)</enum><header>Unmanned aerial
			 vehicles and associated infrastructure</header><text>The Secretary shall
			 acquire and maintain MQ–9 unmanned aerial vehicles for use on the border,
			 including related equipment such as—</text>
						<paragraph id="ID2FCBB0476BD0422A9F01A96E41B3561D"><enum>(1)</enum><text>additional
			 sensors;</text>
						</paragraph><paragraph id="ID43645A436B9641A4A3F119E5DA417054"><enum>(2)</enum><text>critical
			 spares;</text>
						</paragraph><paragraph id="ID124F3F507C3843639B850B99489F22A1"><enum>(3)</enum><text>satellite command
			 and control; and</text>
						</paragraph><paragraph id="ID150F96F410DD498986ACDF4BD916CEDF"><enum>(4)</enum><text>other necessary
			 equipment for operational support.</text>
						</paragraph></subsection><subsection id="ID67F2C1F907314EF2B1C890DFB46AB091"><enum>(b)</enum><header>Authorization
			 of appropriations</header>
						<paragraph id="IDDD8CFA80E1D44EE4A6871962CF585037"><enum>(1)</enum><header>In
			 general</header><text>There are authorized to be appropriated to the Secretary
			 to carry out subsection (a)—</text>
							<subparagraph id="ID8001D50104D24B699088C550F80F832F"><enum>(A)</enum><text>$178,400,000 for
			 fiscal year 2007; and</text>
							</subparagraph><subparagraph id="ID6B40BCC3DF0E4D5081EE60F6AB923BED"><enum>(B)</enum><text>$276,000,000 for
			 fiscal year 2008.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID16D0C7263AC449F7A5BBDB2174F1D665"><enum>(2)</enum><header>Availability of
			 funds</header><text>Amounts appropriated pursuant to paragraph (1) shall remain
			 available until expended.</text>
