			 Grants</header>
				<subsection commented="no" display-inline="no-display-inline" id="IDA38ECE3031D942DEA102A92F8B9F921A"><enum>(a)</enum><header>Authorization
			 and Appropriation of Funds for Federal Pell Grants</header><text display-inline="yes-display-inline">There
			 are authorized to be appropriated and there are appropriated, out of any money
			 in the Treasury not otherwise appropriated for the fiscal year ending September
			 30, 2006, for carrying out subpart 1 of part A of title IV of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1070a), $14,515,000,000.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDE50DA21CA2D349CAB9976AE085F5E810"><enum>(b)</enum><header>Authorization
			 Amount and Maximum Federal Pell Grant</header><text display-inline="yes-display-inline">Section 401(b) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1070a(b)) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID7D8D9BEB927C4E3FB8C85CD64579A8A8"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)(A), by striking clauses
			 (i) through (v) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="IDC62857B693B34D26ABCEEABD21006AA7" style="OLC">

						<subparagraph commented="no" display-inline="no-display-inline" id="IDC4473F7327374E93A94C0E52384253FC"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking
			 <quote>appropriation Act</quote> and inserting <quote>appropriation Act or

				student shall be eligible during academic year 2006–2007 shall be $4,500, less
				an amount equal to the amount determined to be the expected family contribution
				with respect to the student for that
				year.</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID90A9127E357442DF9FCD03048B2DD066"><enum>(c)</enum><header>Students With
			 Low Family Incomes</header><text display-inline="yes-display-inline">Section
			 401(b)(2) of the <act-name parsable-cite="HEA65">Higher Education Act of
			 1965</act-name> (20 U.S.C. 1070a(b)(2)) is amended further by adding at the end
			 the following:</text>
					<quoted-block act-name="Higher Education Act of 1965" display-inline="no-display-inline" id="ID1A8909CFD62F4698B4EDC01804ADC9A0" style="OLC">
						<subclause commented="no" display-inline="no-display-inline" id="IDFE423F08129E4E259AB5AD92FE89B1F4" indent="up4"><enum>(C)</enum><text display-inline="yes-display-inline">In the case of a student with a negative
				expected family contribution equal to or less than ^$750, a positive amount
				corresponding to the negative expected family contribution amount shall be
				added to the maximum basic grant for which the student is qualified, except
				that in no case shall the amount of the basic grant exceed the amount permitted
				under paragraph
				(4).</text>
						</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID725289D3514247B69F8C3E5CE184A598"><enum>(d)</enum><header>Two Pell Grants
			 in a Single Award Year</header><text display-inline="yes-display-inline">Section 401(b)(6)(A) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1070a(b)(6)(A)) is amended to read as follows:</text>
					<quoted-block act-name="Higher Education Act of 1965" display-inline="no-display-inline" id="ID9578EA1DC0354B868D5E2BA62A4D355F" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="IDE37B9301E74244B58725C7E0959CB037" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="IDDC4AFF4954494F728C763639B8B16D85"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary shall allow a student to
				receive 2 Federal Pell grants during a single award year, if—</text>
								<clause commented="no" display-inline="no-display-inline" id="IDAB09E76F29FA4B27AFD16FFAF22295CC" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">the student is enrolled full-time in a
				certificate or degree program of study at an eligible institution; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID8825A8A137C84E2E85C170AF4A2BDBCF" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the student completes course work toward
				completion of a certificate or an associate or baccalaureate degree that
				exceeds the requirements for a full academic year as defined by the
				institution.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID7F6472D51E4047EA9A5126259FE96825" section-type="subsequent-section"><enum>102.</enum><header>Income protection
			 allowance revised tables</header><text display-inline="no-display-inline">Section 478(b) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1087rr(b)) is amended to read as follows:</text>
				<quoted-block act-name="Higher Education Act of 1965" display-inline="no-display-inline" id="ID53FAD5719154417CB7EAA99E437EDCF3" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="IDCF1CE3E896134A6F9DD6974B4B87CACC"><enum>(b)</enum><header>Income
				Protection Allowance</header>
						<paragraph commented="no" display-inline="no-display-inline" id="IDAA03E4276B4040029D29CD144E2D1F96"><enum>(1)</enum><header>Revised
				tables</header><text display-inline="yes-display-inline">For each academic year
				after academic year 1993–1994, the Secretary shall publish in the Federal
				Register a revised table of income protection allowances for the purpose of
				sections 475(c)(4) and 477(b)(4). The revised table for section 475(c)(4) shall
				be developed by increasing each of the dollar amounts contained in the table in
				such section by a percentage equal to the estimated percentage increase in the
				Consumer Price Index (as determined by the Secretary) between December 1992 and
				the December next preceding the beginning of such academic year. The revised
				table for section 477(b)(4) shall be developed by using a 3-year average of the
				median expenses for a family of 4 based on the Consumer Expenditure Survey
				data, adjusted for current dollars, calculated for the lower living level. The
				results for both tables shall be rounded to the nearest $10.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC42EB82EC58147DEB8156A61E3860D5B"><enum>(2)</enum><header>Revised
				amounts</header><text display-inline="yes-display-inline">For each academic
				year after academic year 2006–2007, the Secretary shall publish in the Federal
				Register a revised income protection allowance for the purpose of section
				476(b)(1)(A)(iv)(I). Such revised allowance shall be developed by increasing
				the dollar amount contained in such section by a percentage equal to the
				estimated percentage increase in the Consumer Expenditure Survey (as determined
				by the Secretary) between December 2005 and the December next preceding the
				beginning of such academic year, and rounding the result to the nearest
				$10.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="ID9CB2EB77826B40BD988CE8CDC4F221A6" section-type="subsequent-section"><enum>103.</enum><header>Exclusion of the
			 earned income tax credit (eitc) from financial aid determinations</header><text display-inline="no-display-inline">Section 480(b) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1087vv(b)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDE8C3AACE15CB4B848D61ED7380DC6C0D"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (8); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID780BB9ED60D742F8A52AE2C38C840EDF"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (9) through
			 (14) as paragraphs (8) through (13), respectively.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID91C630AFEBC346DDBB3AFE21FE6C3244" section-type="subsequent-section"><enum>104.</enum><header>Nontraditional
			 Students Demonstration Program</header><text display-inline="no-display-inline">Title IV of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1070 et seq.) is amended by adding at the end the following:</text>
				<quoted-block act-name="Higher Education Act of 1965" display-inline="no-display-inline" id="ID44A91A1572C24ACE82011A9CF70BF8F9" style="OLC">
					<part commented="no" id="ID840533E432D349DD84113A64D94ADD44"><enum>I</enum><header>NONTRADITIONAL
				STUDENTS DEMONSTRATION PROGRAM</header>
						<section commented="no" display-inline="no-display-inline" id="ID9CB2F81D512E4C20AD4F0024B0906F3C" section-type="subsequent-section"><enum>499.</enum><header>Nontraditional
				Students Demonstration Program</header>
							<subsection commented="no" display-inline="no-display-inline" id="ID9057EC4472D24D1390B22752ECDCC16D"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">It is the purpose of this section—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID456627F1FFA7409CB719265FFD4D8576"><enum>(1)</enum><text display-inline="yes-display-inline">to allow demonstration programs that are
				strictly monitored by the Department to test the effectiveness of providing
				expanded financial assistance under this title to less than half-time students
				for not more than 3 terms over the duration of the students’ course of study,
				and to students in compressed, modular, or other alternative schedules;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9AA04CA0E14C415BB86C620DCED9B7EE"><enum>(2)</enum><text display-inline="yes-display-inline">to increase graduation rates of
				nontraditional students by enabling the nontraditional students to stay
				continuously enrolled during periods when the nontraditional students must
				temporarily attend college less than half-time; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID213DC0CC269C4008B8FA59C2F3E5B004"><enum>(3)</enum><text display-inline="yes-display-inline">to increase graduation rates of
				nontraditional students by enabling the nontraditional students to enroll in
				programs with compressed, modular, or other alternative schedules that allow
				the nontraditional students to better balance work, family, and school.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDFD4E559FFD6F4FC0B0917A9C842CE6E0"><enum>(b)</enum><header>Demonstration
				Program Authorized</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID75F849F708AF49B5BB84542BC158C173"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In accordance with
				the provisions of subsection (d), the Secretary is authorized to select
				institutions of higher education, systems of institutions of higher education,
				or consortia of institutions of higher education for voluntary participation in
				the Nontraditional Students Demonstration Program. Such program shall provide
				participating institutions, consortia, or systems with waivers, as described in
				paragraph (2), that provide the ability to offer expanded financial
				assistance—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDCBABE858DD6C47489DD6D64D239675AA"><enum>(A)</enum><text display-inline="yes-display-inline">to less than half-time students who have
				completed not less than 1 term of coursework, for not more than 3 terms over
				the duration of the students’ course of study; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDAC49195354846CCB654DCC113B31F11"><enum>(B)</enum><text display-inline="yes-display-inline">to students enrolled in programs with
				compressed, modular, or other alternative schedules.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBC2184580910401F97EA5CE6C549A94D"><enum>(2)</enum><header>Waivers</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDF7813A393B25414395DA90EABB770FAE"><enum>(A)</enum><header>Less than
				half-time students</header><text display-inline="yes-display-inline">The
				Secretary is authorized to waive, for any institution of higher education,
				system of institutions of higher education, or consortium of institutions of
				higher education participating in the Nontraditional Students Demonstration
				Program, the requirements of section 472 that relate to limiting the definition
				of the cost of attendance for less than half-time students, especially
				paragraphs (2) and (4) of such section, with the goal of allowing the
				institution, system, or consortium to use the same definition of the costs of
				attendance for less than half-time students as is used for students attending
				at least half-time.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID69D3966B34ED44F9B82327942CCF1678"><enum>(B)</enum><header>Compressed,
				modular, or other flexible schedules</header><text display-inline="yes-display-inline">The Secretary is authorized to waive for
				any institution of higher education, system of institutions of higher
				education, or consortium of institutions of higher education participating in
				the Nontraditional Students Demonstration Program, the requirements of
				subsection (a) or (b)(1) of section 481, except that no program shall be
				considered an eligible program under section 481 unless the program—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID89F7B1B6B48C49EC878E63F4276840FD"><enum>(i)</enum><text display-inline="yes-display-inline">offers at least 300 clock hours of
				instruction, 8 semester hours, or 12 quarter hours, offered during a minimum of
				10 weeks; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID0903AE8A375845F5B44D12F06264441B"><enum>(ii)</enum><text display-inline="yes-display-inline">is articulated with a certificate or degree
				program of not less than 1 year in length.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID24A1D3C2CE304CD79639E9B528738BDC"><enum>(3)</enum><header>Eligible
				applicants</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDD8857B2906684DF59E5BEBD37F564EAF"><enum>(A)</enum><header>Eligible
				institutions</header><text display-inline="yes-display-inline">Except as
				provided in subparagraph (B), an institution of higher education, a system of
				institutions of higher education, or a consortium of institutions of higher
				education shall be eligible to participate in the demonstration program
				authorized under this section only if the institution, each institution of
				higher education in the system, or each institution of higher education
				participating in the consortium, respectively—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID060B1620C7B74BDFBDAB08E581E46E63"><enum>(i)</enum><text display-inline="yes-display-inline">is eligible to participate in programs
				under this title; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDC5756543E546451294F6DC84903AE2F1"><enum>(ii)</enum><text display-inline="yes-display-inline">provides a program for which the
				institution of higher education awards an associate or bachelor’s
				degree.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5AB0F51649E9445A8C119945637A3520"><enum>(B)</enum><header>Prohibition</header><text display-inline="yes-display-inline">An institution of higher education
				described in section 102(a)(1)(C) shall not be eligible to participate in the
				demonstration program authorized under this section.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDAEB843866C6741F79D32056D72727F26"><enum>(c)</enum><header>Application</header>
								<paragraph commented="no" display-inline="no-display-inline" id="IDEBDA14A026DD4B56B54A398DBF081470"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Each institution,
				system, or consortium desiring to participate in a demonstration program under
				this section shall submit an application to the Secretary at such time and in
				such manner as the Secretary may require. An institution, system, or consortium
				may apply for a waiver of a provision described in subsection (b)(2) (A) or
				(B), or both.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID23E9BF162221461FA1F81F79EF94EB86"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">Each such application shall include—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID64ABEC3185AD4B0A90BDB0800228C9AC"><enum>(A)</enum><text display-inline="yes-display-inline">a description of programs that have
				characteristics known to be effective for nontraditional students, which will
				be carried out in support of the waiver, including programs related to student
				financial aid counseling, academic support services, study skills courses,
				remedial courses, English as a Second Language courses, individual mentoring,
				skills assessment, addressing child care needs, and creating flexible course
				schedules;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID58478C57E96944B2A284DEFDE08F5DC8"><enum>(B)</enum><text display-inline="yes-display-inline">a description of the statutory and
				regulatory requirements described in subsection (b)(2) for which a waiver is
				sought and the reasons for which the waiver is sought;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4224307E248E4F7AAB1574DE7D33DBFC"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of an institution, a system, or
				a consortium applying for a waiver of a provision described in subsection
				(b)(2)(A), a description of the less than half-time students to whom such
				expanded financial assistance will be offered;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5569F53EE7904FB8AF956AD995B0529A"><enum>(D)</enum><text display-inline="yes-display-inline">in the case of an institution, a system, or
				a consortium applying for a waiver of a provision described in subsection
				(b)(2)(B), a description of the programs with compressed, modular, or other
				alternative schedules in which students in the demonstration program will be
				enrolled;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID014145EA148F4B3E9153011119A44444"><enum>(E)</enum><text display-inline="yes-display-inline">an assurance that the institution, system,
				or consortium will offer full cooperation with the ongoing evaluations of the
				demonstration program provided for in this section; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC87084FC8DA2455E81B55D2091D16BE9"><enum>(F)</enum><text display-inline="yes-display-inline">such other information as the Secretary may
				require.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA0A2898D9F7846DBABCFB86103918676"><enum>(d)</enum><header>Selection</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID5042B9C56FB44EEEB2DBAF18BF95AD07"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">For the first 2 years
				of the demonstration program the Secretary is authorized to select for
				participation in the program not more than an aggregate of 50 institutions of
				higher education, systems of institutions of higher education, or consortia of
				institutions of higher education. For the third year of the demonstration
				program authorized under this section, not more than an aggregate of 70
				institutions, systems, or consortia, may participate in the demonstration
				program, if the Secretary determines that such expansion is warranted based on
				the evaluations and oversight conducted in accordance with subsections (f) and
				(g).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDED57EA6C05A6495BB29D0DEC5EF525F4"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">In selecting institutions, systems, or
				consortia to participate in the demonstration program in the first or
				succeeding years of the demonstration program, the Secretary shall take into
				account—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDE4DA3CABBD2E42F0875D39D19E1366B2"><enum>(A)</enum><text display-inline="yes-display-inline">the number and quality of applications
				received;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4033D0E933D1450382483E243B4F644F"><enum>(B)</enum><text display-inline="yes-display-inline">the Department’s capacity to oversee and
				monitor the participation of each institution, system, or consortium;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID822BA082A7D642A59AA101B976FDAD6B"><enum>(C)</enum><text display-inline="yes-display-inline">an institution’s, system’s, or
				consortium’s—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID41453F774C3749C7ADF92B3B7A800DD4"><enum>(i)</enum><text display-inline="yes-display-inline">financial responsibility;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID8BD3CD00A2E8480B8D0791F5F5B30E71"><enum>(ii)</enum><text display-inline="yes-display-inline">administrative capability;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID90EE221F7A974609A6ECBBEDCF982D15"><enum>(iii)</enum><text display-inline="yes-display-inline">number of matriculated students enrolled
				less than half-time, or program or programs to be offered with compressed,
				modular, or other alternative schedules; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDFB5A71FE7A114062953C2F1F38C9B004"><enum>(iv)</enum><text display-inline="yes-display-inline">ability to offer programs that have
				characteristics known to be effective for nontraditional students, including
				programs that provide student financial aid counseling, academic support
				services, study skills courses, remedial courses, English as a Second Language
				courses, individual mentoring, and skills assessment, programs that address
				child care needs, and programs that create flexible course schedules;
				and</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID09E858390B714273877A61AD062887F4"><enum>(D)</enum><text display-inline="yes-display-inline">ensuring the participation of a diverse
				group of institutions, systems, and consortia with respect to size, mission,
				and geographic distribution.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDABB87EE4DE864976B989F7F9B2E2C7C5"><enum>(e)</enum><header>Notification</header><text display-inline="yes-display-inline">The Secretary shall make available to the
				public and to the Committee on Health, Education, Labor, and Pensions of the
				Senate and the Committee on Education and the Workforce of the House of
				Representatives a list of institutions, systems, or consortia selected to
				participate in the demonstration program authorized by this section. Such
				notice shall include a listing of the specific statutory and regulatory
				requirements waived for each institution, system, or consortium and a
				description of the students served or the types of alternative schedule courses
				offered.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="IDBDDA26A84C914C81801DF9269224EB48"><enum>(f)</enum><header>Evaluations and
				Reports</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID1073A22424E3421DA3151CAC904D45C5"><enum>(1)</enum><header>Evaluations</header><text display-inline="yes-display-inline">The Secretary shall evaluate the
				demonstration program authorized under this section on an annual basis. Such
				evaluations specifically shall review—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDF1D3C37A1B414F84A17AFE96FD80DFA8"><enum>(A)</enum><text display-inline="yes-display-inline">the extent to which each institution,
				system, or consortium participating in the demonstration program has met the
				goals set forth in its application to the Secretary, including the measures of
				program quality assurance;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID02319ED2FD844EDD81AB814103096FA9"><enum>(B)</enum><text display-inline="yes-display-inline">the number and types of students
				participating in the less than half-time demonstration programs and in the
				alternative schedule programs, including the progress of participating students
				toward recognized certificates or degrees and the extent to which participation
				in such programs increased;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4E0BD6932BB84DE5BFA57FE75307954B"><enum>(C)</enum><text display-inline="yes-display-inline">issues related to student financial
				assistance for less than half-time enrollment;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB4415516792847DDAF74A8148B9DEBF0"><enum>(D)</enum><text display-inline="yes-display-inline">issues related to student financial
				assistance for students in compressed, modular, or other alternative schedule
				programs; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF201EAD7C8124A12A9403FEA120579DA"><enum>(E)</enum><text display-inline="yes-display-inline">the extent to which persistence or
				completion increased or decreased for students in the demonstration program as
				compared to a comparable group of students.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5E9332EF40BC484CA70E0967E0A45DFC"><enum>(2)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than 30 months after the first
				waiver is authorized under this section, the Secretary shall report to the
				Committee on Health, Education, Labor, and Pensions of the Senate and the
				Committee on Education and the Workforce of the House of Representatives with
				respect to—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID795984846A1141029CAE9C05F21A20D8"><enum>(A)</enum><text display-inline="yes-display-inline">the evaluations of the demonstration
				program authorized under this section; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID32D70E71BC814D4883E6DE5E92E4FE60"><enum>(B)</enum><text display-inline="yes-display-inline">any proposed statutory changes designed to
				enhance persistence and completion for students.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDCDA083342DFA4A7A9F03BC9DF6E3ED5D"><enum>(g)</enum><header>Oversight</header><text display-inline="yes-display-inline">In conducting the demonstration program
				authorized under this section, the Secretary shall, on a continuing
				basis—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="IDF5C13F6FF5B04BCE86BBA2499E52D481"><enum>(1)</enum><text display-inline="yes-display-inline">ensure the compliance of institutions,
				systems, and consortia participating in the demonstration program with the
				requirements of this title (other than the sections and regulations that are
				waived under subsection (b)(2)); and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF40705EB7D18417BBEF04B391FA27AEE"><enum>(2)</enum><text display-inline="yes-display-inline">provide technical
				assistance.</text>
								</paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title commented="no" id="ID92FAFE02C9EF406C906BADF2762EE260" style="OLC"><enum>II</enum><header>SUPPORT SERVICES</header>
			<section commented="no" display-inline="no-display-inline" id="IDA05DBD97612D40C99DA94149AC4A35CA" section-type="subsequent-section"><enum>201.</enum><header>Strengthening
			 institutions</header><text display-inline="no-display-inline">Section 311(c) of
			 the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1057(c)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID66923DE31F9440859CE517038C99E4A5"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (12) as
			 paragraph (13); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1008FADEEBA143908CADEAFC4D9DDD44"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (11) the
			 following:</text>

				courses to student goals and help students move rapidly from remedial courses
				into core courses and through program

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDC5C4CEA544B8468FA3CB23A9E48815A0" section-type="subsequent-section"><enum>202.</enum><header>Grants to increase
			 completion by improving remedial education</header><text display-inline="no-display-inline">Part A of title III of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1057 et seq.) is amended by adding at the end the following:</text>
				<quoted-block act-name="Higher Education Act of 1965" display-inline="no-display-inline" id="IDB43E18370A3F415E9A62DEAAED782D4C" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="ID1C2934F471DB4D70B919CB4D3E572C45" section-type="subsequent-section"><enum>318.</enum><header>Grants to increase
				completion by improving remedial education</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID9336B05FFBAE43EC8DDE91E3B0650482"><enum>(a)</enum><header>Authorization
				of Program</header><text display-inline="yes-display-inline">From amounts
				appropriated under subsection (k), the Secretary shall award grants, on a
				competitive basis, to eligible institutions for the purposes of improving
				remedial education, including English language instruction, to customize
				remedial courses to student goals and help students move rapidly from remedial
				courses into core program courses and through program completion.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID69C22D6E42964AFD87800E647A2A89B5"><enum>(b)</enum><header>Definition of
				Eligible Institution</header><text display-inline="yes-display-inline">In this
				section, the term <term>eligible institution</term> means an institution of
				higher education (as defined in section 101(a)) in which not less than 35
				percent of the institution’s entering first-year students are enrolled in
				remedial courses to improve reading, writing, or mathematics.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1D450720E4774ED19FFF30AFF916DAC5"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible institution seeking a grant
				under this section shall submit an application to the Secretary at such time,
				in such manner, and containing such information as the Secretary may
				require.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDE85C3AF95B6C4EC1938B5F70F7BD2CBF"><enum>(d)</enum><header>Priority for
				Replication of Proven Practices</header><text display-inline="yes-display-inline">The Secretary shall give priority to
				applications that propose to replicate practices that have proven effective
				with adults.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDB8E04175291A4564BBA468EB1D35D3CA"><enum>(e)</enum><header>Peer
				Review</header><text display-inline="yes-display-inline">The Secretary shall
				convene a peer review process to review applications for grants under this
				section and to make recommendations to the Secretary regarding the selection of
				grantees.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDE72EC6DAC8F44C1D94FA07FC7576EFCC"><enum>(f)</enum><header>Mandatory
				Activity</header><text display-inline="yes-display-inline">An eligible
				institution that receives a grant under this section shall use the grant funds
				to create bridge programs that customize remedial adult education, English as a
				Second Language, or remedial education curricula to the content of the
				certificate or degree programs or clusters of programs in which remedial
				education students enroll.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID53C909FF68724F01ABAAF8E99CDF799D"><enum>(g)</enum><header>Permissible
				Activities</header><text display-inline="yes-display-inline">An eligible
				institution that receives a grant under this section may use the grant funds to
				carry out the following:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDDBBAA6E46D454D57815E8FD7D9405DCB"><enum>(1)</enum><text display-inline="yes-display-inline">Designing and implementing innovative ways
				to improve retention in and completion of remedial education courses, such as
				enrolling students in cohorts, providing counseling, and giving small, material
				incentives for attendance and performance.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID01ACD5748CEE4FE885B0EBBA7CECD068"><enum>(2)</enum><text display-inline="yes-display-inline">Redesignating class schedules to meet the
				needs of working adults, through modular, compressed, repeated, or other
				alternative schedules.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC368ACF2C300474796C42EBA8E85C21E"><enum>(3)</enum><text display-inline="yes-display-inline">Improving the quality of teaching in
				remedial courses through professional development, reclassification of such
				teaching positions, or other means the eligible institution determines
				appropriate.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDB341F1D7AAB43FEA5A69FBB369EE6A2"><enum>(4)</enum><text display-inline="yes-display-inline">Any other activities the eligible
				institution and the Secretary determine will promote retention of and
				completion by students attending eligible institutions.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID67EC3160907E47F78FA8E3725EBF060E"><enum>(h)</enum><header>Grant
				Period</header><text display-inline="yes-display-inline">Grants made under this
				section shall be for a period of not less than 36 months and not more than 60
				months.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID64FE268FC13949358750812BA286723E"><enum>(i)</enum><header>Technical
				Assistance</header><text display-inline="yes-display-inline">The Secretary
				shall enter into a contract with a private entity to provide such technical
				assistance to grantees under this section as the Secretary determines
				appropriate.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA8B6BD20D0F74D829A19E167A1255FDE"><enum>(j)</enum><header>Evaluation</header><text display-inline="yes-display-inline">The Secretary shall conduct an evaluation
				of program impacts under the demonstration program, and shall disseminate to
				the public the findings from the evaluation and information on best practices.
				The Secretary is encouraged to partner with other funders, such as private
				foundations, to allow for use of a random assignment evaluation in at least one
				of the demonstration sites.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3CF651A42096450A95FA5103E1AB0AE8"><enum>(k)</enum><header>Authorization
				of Appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this section $50,000,000 for fiscal
				year 2007 and each of the 5 succeeding fiscal years, of which an aggregate of
				not more than 5 percent may be used to carry out subsections (i) and
				(j).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="ID01FDFE9F31E443FEB80CA550F20557B8" section-type="subsequent-section"><enum>203.</enum><header>Federal Trio
			 Programs</header><text display-inline="no-display-inline">Section 402A of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1070a–11) is amended—</text>

				first year students by assigning counselors to the students so that there is
				consistency and continuity in the academic and career advice the students
				receive.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFAAA586E4E5B4BD888C75B7136B2D60A"><enum>(B)</enum><header>Funding
				increases</header><text display-inline="yes-display-inline">The funding
				increase referred to in subparagraph (A) is—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID3D44CA57A1C449B19AEF1B166CF0C3A8"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a program authorized by
				section 402D, the amount by which the individual grant exceeds $170,000;
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDE3E436EF73CB40A0AC822D52A6F1D2BA"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a program authorized by
				section 402F, the amount by which the individual grant exceeds
				$180,000.</text>
									</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>

			 higher education expenses</header><text display-inline="yes-display-inline">Section 25A(f) of such Code (relating to
			 definitions) is amended by inserting at the end the following new
			 paragraph:</text>

				term <term>qualified higher education expenses</term> means, with respect to
				any individual described in clause (i), (ii), or (iii) of paragraph

								<subparagraph commented="no" display-inline="no-display-inline" id="IDDF4C91944A9F4B92896FA5282D5B7CDF"><enum>(A)</enum><text display-inline="yes-display-inline">tuition, books, supplies, and equipment
				required for the enrollment or attendance at an eligible educational
				institution,</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD68A602339234DF19E0A3F9700B51AA0"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of an individual with special
				needs, expenses for special needs services which are incurred in connection
				with such enrollment or attendance,</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD92328D73B8D48A584AA223DF8F3B427"><enum>(C)</enum><text display-inline="yes-display-inline">expenses for child care which are incurred
				in connection with such enrollment or attendance, and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2BF3FB4B44DF4D439F3038BFE2117683"><enum>(D)</enum><text display-inline="yes-display-inline">expenses for food, shelter, and other
				living expenses which are incurred during the period of such enrollment or
				attendance.</text>
								</subparagraph><continuation-text commented="no" continuation-text-level="paragraph">With respect to expenses described in
				subparagraph (D), only the first $250 of such expenses for any month shall be
				taken into
				account.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID35F868ADCC0C4865A74B00CAF0BAB437"><enum>(3)</enum><header>Conforming

			 (2), (3), and (4) of section 25A(g) of such Code are each amended by inserting
			 <quote>and qualified higher education expenses</quote> after <quote>qualified
			 tuition and related expenses</quote> each place it appears.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC2EFCDF70B4D42B6AAC388F039ADB5E8"><enum>(b)</enum><header>Effective
			 Date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to taxable years beginning after December 31,
			 2005.</text>

			 Internal Revenue Code of 1986 is amended by redesignating subsection (i) as

				credit allowed under this section by reason of subsection (a)(2) without regard
				to this subsection and the limitation under section 26(a).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1C6F3954A1DC4DBF9C2325438BF70B90"><enum>(2)</enum><header>No double
				benefit</header><text display-inline="yes-display-inline">The amount of the
				credit allowed under this subsection shall not be treated as a credit allowed
				under this subpart and shall reduce the amount of the credit otherwise
				allowable under subsection (a) without regard to section
				26(a).</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID28E78CA3EE8147F2919581198106C8EC"><enum>(b)</enum><header>Effective
			 Date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to taxable years beginning after December 31,

			 Lifetime Learning credit</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID6E99A42D547C4BE69CEB0137044A4D6C"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Chapter 77 of the
			 Internal Revenue Code of 1986 (relating to miscellaneous provisions) is amended
			 by redesignating section 7528 as section 7529 and inserting after section 7527
			 the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="IDB08FFCC7A60449C3A3BCBBB88D8D6B36" style="OLC">
						<section commented="no" display-inline="no-display-inline" id="ID81DF684E08654A89AB7D0D26186F868B" section-type="subsequent-section"><enum>7528.</enum><header>Advance payment of
				Lifetime Learning credit</header>
							<subsection commented="no" display-inline="no-display-inline" id="ID4B8B400EBE4F4518B732D98B58543DE4"><enum>(a)</enum><header>General
				Rule</header><text display-inline="yes-display-inline">Not later than August 1,
				2006, the Secretary shall establish a program for making payments on behalf of
				certified individuals to eligible educational institutions.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID53E30104BB7B44FA879FF5942CA2F31D"><enum>(b)</enum><header>Limitation on
				Advance Payments During any Taxable Year</header><text display-inline="yes-display-inline">The Secretary may make payments under
				subsection (a) only to the extent that the total amount of such payments made
				on behalf of any individual during the taxable year does not exceed an amount
				equal to 50 percent of so much of the qualified higher education expenses paid
				with respect to such individual as does not exceed $4,000 for such year. For
				purposes of this section, qualified higher education expenses taken into
				account with respect to any individual shall be reduced—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID373DD12665E94CB99613FEFD6B3E6D07"><enum>(1)</enum><text display-inline="yes-display-inline">by the amount of qualified tuition and
				related expenses taken into account under section 25A(b) (if any), and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID53E2AE070ADD4E01BBE61E8E7930CDC9"><enum>(2)</enum><text display-inline="yes-display-inline">under rules similar to the rules under
				section 25A(g)(2).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2B7E4F44832C4F278D3C4A6115C368A7"><enum>(c)</enum><header>Certified
				Individual</header><text display-inline="yes-display-inline">For purposes of
				this section, the term <term>certified individual</term> means any individual
				for whom a qualified education costs credit eligibility certificate is in
				effect.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID254B184562924FCAAE027A0899EEF364"><enum>(d)</enum><header>Qualified
				Education Costs Credit Eligibility Certificate</header><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>qualified education costs credit eligibility certificate</term> means a
				written statement that an individual has incurred costs which are qualified
				higher education expenses.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID7214ADA322C543DE857C2AB0A7DA23B6"><enum>(e)</enum><header>Other
				Definitions and Special Rules</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID0313E37D29784B228B17E590342DF62A"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">Any term used in this section which is also
				used in section 25A shall have the meaning given such term in section
				25A.</text>

				section, payments made under subsection (a) shall be subject to rules similar
				to the rules of section
				25A.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID19A9323952924408A296CE29F048E6DC"><enum>(b)</enum><header>Coordination of
			 Lifetime Learning Credit With Advanced Payment</header><text display-inline="yes-display-inline">Section 25A of the Internal Revenue Code of
			 1986, as amended by section 302, is amended by redesignating subsection (j) as
			 subsection (k) and by inserting after subsection (i) the following new
			 subsection:</text>
					<quoted-block display-inline="no-display-inline" id="ID020D6B254E8D4F99A8C5B4E7C108DD21" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="ID135D3156E6E1444F94D64FDD29315C9F"><enum>(j)</enum><header>Coordination
				With Advance Payment</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDB50CEC4C5EEA464BB342943A41ED6DDF"><enum>(1)</enum><header>Recapture of
				excess advance payments</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDEFFD419D283D46A7827FE030955823B7"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">If any payment is
				made to an eligible educational institution on behalf of an individual under
				section 7528 during any calendar year, then the tax imposed by this chapter on
				the applicable taxpayer for the last taxable year beginning in such calendar
				year shall be increased by the aggregate amount of such payments.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD21A22CF260449B6B59A60FEA1B9E1EB"><enum>(B)</enum><header>Applicable
				taxpayer</header><text display-inline="yes-display-inline">For purposes of
				subparagraph (A), the applicable taxpayer is—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID2A1CDF487AB145F4BD8956EE35784722"><enum>(i)</enum><text display-inline="yes-display-inline">such individual, or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDF006CAD817F142ECBD7257B36A9A992C"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case a taxpayer who is allowed a
				deduction with respect to such individual under section 151(c), such
				taxpayer.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID42F631B0FBED4A97B1BB7C42F9A4E889"><enum>(2)</enum><header>Reconciliation
				of payments advanced and credit allowed</header><text display-inline="yes-display-inline">Any increase in tax under paragraph (1)
				shall not be treated as tax imposed by this chapter for purposes of determining
				the amount of any credit (other than the credit allowed by subsection (a))
				allowable under this part and subpart
				C.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDCE37D35FADC04B68AF9BB3894C04E136"><enum>(c)</enum><header>Disclosure of
			 Return Information for Purposes of Carrying Out a Program for Advance Payment
			 of Lifetime Learning Credit</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID84550A0B0CA041D2816D92D8BA05E241"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (l) of
			 section 6103 of the Internal Revenue Code of 1986 (relating to disclosure of
			 returns and return information for purposes other than tax administration) is
			 amended by adding at the end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="ID6009DDD1C76D49DABEACBAD45E034126" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="ID43802166FEFC40508FFC9D538335BD71"><enum>(21)</enum><header>Disclosure of
				return information for purposes of carrying out a program for advance payment
				of lifetime learning credit</header><text display-inline="yes-display-inline">The Secretary may disclose to educational
				institutions for any certified individual (as defined in section 7528(c))
				return information with respect to such certified individual only to the extent
				necessary to carry out the program established by section 7528 (relating to
				advance payment of Lifetime Learning
				credit).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4B16CC2727344691ACBC9FBCC6FC31AD"><enum>(2)</enum><header>Procedures and
			 recordkeeping related to disclosures</header><text display-inline="yes-display-inline">Subsection (p) of such section is
			 amended—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="IDAAEC53B25107465EBF86BAC03A109BEB"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subpart B of part III
			 of subchapter A of chapter 61 of the Internal Revenue Code of 1986 (relating to
			 information concerning transactions with other persons) is amended by inserting
			 after section 6050T the following new section:</text>

								<subsection commented="no" display-inline="no-display-inline" id="ID1FB53EE2203B4342A22B88373A961ACC"><enum>(a)</enum><header>Requirement of
				Reporting</header><text display-inline="yes-display-inline">Every person who is
				entitled to receive payments for any month of any calendar year under section
				7528 (relating to advance payment of Lifetime Learning credit) with respect to
				any certified individual (as defined in section 7528(c)) shall, at such time as
				the Secretary may prescribe, make the return described in subsection (b) with
				respect to each such individual.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2FD16EF8444F442D880451699BDE24EB"><enum>(b)</enum><header>Form and Manner
				of Returns</header><text display-inline="yes-display-inline">A return is
				described in this subsection if such return—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="ID18524A701487489E9C5AD3DC644E473A"><enum>(1)</enum><text display-inline="yes-display-inline">is in such form as the Secretary may
				prescribe, and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7EECE81456294194B7E79C124421F013"><enum>(2)</enum><text display-inline="yes-display-inline">contains—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="ID539BE97940D0419A88CFD732A7CCD1C5"><enum>(A)</enum><text display-inline="yes-display-inline">the name, address, and TIN of each
				individual referred to in subsection (a),</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID628A17BF4A124F8DAAE3ADC828BAC332"><enum>(B)</enum><text display-inline="yes-display-inline">the amount entitled to be received for each
				year with respect to such individual under section 7528, and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6F400304DC19450FA5C777E2DE2D25F8"><enum>(C)</enum><text display-inline="yes-display-inline">such other information as the Secretary may
				prescribe.</text>
										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID150F7BA7200C48228273B9236498AC56"><enum>(c)</enum><header>Statements To
				Be Furnished to Individuals With Respect to Whom Information Is
				Required</header><text display-inline="yes-display-inline">Every person
				required to make a return under subsection (a) shall furnish to each individual
				whose name is required to be set forth in such return a written statement
				showing—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="ID7D561372CC404C32A064A8AD9FDCAFA6"><enum>(1)</enum><text display-inline="yes-display-inline">the name and address of the person required
				to make such return and the phone number of the information contact for such
				person, and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD905FCD3648C4E3FB23467D4655AC64B"><enum>(2)</enum><text display-inline="yes-display-inline">the information required to be shown on the
				return with respect to such individual.</text>
									</paragraph><continuation-text commented="no" continuation-text-level="subsection">The written statement required under
				the preceding sentence shall be furnished on or before January 31 of the year
				following the calendar year for which the return under subsection (a) is
				required to be
