			</subsection></section><section id="id8815663E7EE0458788D4AC773CCC48B6"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purpose of this Act is to—</text>
			<paragraph id="idD6B5162FAB8541D58307DC00F6AF8456"><enum>(1)</enum><text>continue the
			 progress of the Multifamily Assisted Housing Reform and Affordability Act of
			 1997, as amended by the Mark-To-Market Extension Act of 2001;</text>
			</paragraph><paragraph id="idC8D1312DFC804029BB245AF14DB2A257"><enum>(2)</enum><text>expand
			 eligibility for Mark-to-Market restructuring so as to further the preservation
			 of affordable housing in a cost-effective manner; and</text>
			</paragraph><paragraph id="id2F0EE89956EF49758988E40DB238E9CF"><enum>(3)</enum><text>provide for the
			 preservation and rehabilitation of projects damaged by Hurricanes Katrina,
			 Rita, and Wilma, or by other natural disasters.</text>
			</paragraph></section><section id="id46723BAC4BDB4C988E98F89E5F798A32"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 512 of the Multifamily Assisted
			 Housing Reform and Affordability Act of 1997 (42 U.S.C. 1473f note) is amended
			 by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id194A924C6BA341359ED44F21C7D79282" style="OLC">
				<paragraph id="idADF4CF6E7EC140D9BC8D0E1B4B6C037D"><enum>(20)</enum><header>Disaster-damaged
				eligible project</header>
					<subparagraph id="id1693453EE1544DE0907C640CC0B2A8C2"><enum>(A)</enum><header>In
				general</header><text>The term <quote>disaster-damaged eligible project</quote>
				means an otherwise eligible multifamily housing project—</text>
						<clause id="id27739A327E844229B1C026935798271F"><enum>(i)</enum><text>that is located
				in a county that was designated a major disaster area on or after January 1,
				2005, by the President pursuant to title IV of the Robert T. Stafford Disaster
				Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.);</text>
						</clause><clause id="idFAD0D7EF951B450D95F6E0D0E4DBB032"><enum>(ii)</enum><text>whose owner
				carried casualty and liability insurance covering such project in an amount
				required by the Secretary;</text>
						</clause><clause id="idAF96F8F2622F4DA8847A4024CA3939E4"><enum>(iii)</enum><text>that suffered
				damages not covered by such insurance that the Secretary determines is likely
				to exceed $5,000 per unit in connection with the natural disaster that was the
				subject of the designation described in subparagraph (A); and</text>
						</clause><clause id="id80A5BAE8F5FF4E4286AEF010BBE89A0D"><enum>(iv)</enum><text>whose owner
				requests restructuring of the project not later than 2 years after the date
				that such damage occurred.</text>
						</clause></subparagraph><subparagraph id="idBDD71721D1A04D7F8369D8C4E079D545"><enum>(B)</enum><header>Rule of
				construction</header><text>A disaster-damaged eligible project shall be
				eligible for amounts under this Act without regard to the relationship between
				rent levels for the assisted units in such project and comparable rents for the
				relevant market
				area.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id489CC5EF1D724790B8007101960E90D1"><enum>4.</enum><header>Extension of
			 Mark-to-Market program</header><text display-inline="no-display-inline">Section
			 579 of the Multifamily Assisted Housing Reform and Affordability Act of 1997
			 (42 U.S.C. 1473f note) is amended by striking <quote>October 1, 2006</quote>
			 each place that term appears and inserting <quote>October 1,
			 2011</quote>.</text>
		</section><section id="id033AFCFB39AD407084FADC9C46A63B0D"><enum>5.</enum><header>Exception
			 rents</header><text display-inline="no-display-inline">Section 514(g)(2) of the
			 Multifamily Assisted Housing Reform and Affordability Act of 1997 (42 U.S.C.
			 1473f note) is amended—</text>
			<paragraph id="idD4FAC266BF3C4A9C8098EE9CF87061F6"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>disaster-damaged
			 eligible projects and</quote> after <quote>waive this limit</quote>; and</text>
			</paragraph><paragraph id="id612C74B6FB85480EBCE493685FA539D9"><enum>(2)</enum><text>by striking
			 <quote>five percent</quote> and inserting <quote>9 percent</quote>.</text>
			</paragraph></section><section id="idA157194D4E9148468C3D3959B87DB7E7"><enum>6.</enum><header>Otherwise
			 eligible projects with at-or-below-market rents</header><text display-inline="no-display-inline">Section 512(2)(A) of the Multifamily
			 Assisted Housing Reform and Affordability Act of 1997 (42 U.S.C. 1473f note) is
			 amended—</text>
			<paragraph id="id664655C3BE90441B962E6257BCF538F2"><enum>(1)</enum><text>by inserting
			 <quote>(i)</quote> after <quote>(A)</quote>;</text>
			</paragraph><paragraph id="id6C302471B5C342D39E15B35BA11DE594"><enum>(2)</enum><text>by striking the
			 semicolon and inserting <quote>; or</quote>; and</text>
			</paragraph><paragraph id="id4CC71FD8E127477C8B5DCF9CE20BE580"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idCCC1A019EB2A40FC9AB9F4CE2F9C1CCF" style="OLC">
					<clause id="id1FB39D68ACEB48289EDA9FE9325D06AD" indent="up1"><enum>(ii)</enum><text>with rents below the level
				specified in clause (i) if the Secretary determines that—</text>
						<subclause id="id40742A42015641DB989BE078213A8A06"><enum>(I)</enum><text>such property is worthy of preservation;
				and</text>
						</subclause><subclause id="idEF7A36D6240A4515A80B589B1C2DE36A"><enum>(II)</enum><text>treating such project as an eligible
				multifamily housing project will be cost-effective to the Secretary in relation
				to alternative preservation
				options.</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id579FFC78D40A46E29461F9CB62CBF7CB"><enum>7.</enum><header>Disaster-damaged
			 eligible projects</header>
			<subsection id="id6294324D4DA0477EA80B9D977429BB2C"><enum>(a)</enum><header>Market rent
			 determinations</header><text display-inline="yes-display-inline">Section
			 514(g)(1)(B) of the Multifamily Assisted Housing Reform and Affordability Act
			 of 1997 (42 U.S.C. 1473f note) is amended by striking <quote>determined, are
			 equal</quote> and inserting the following: “determined—</text>
				<quoted-block display-inline="no-display-inline" id="id431B0DE3FE9F45B79D7CE9EC2F35BE53" style="OLC">
					<clause id="id22B3B4350B644E61B89BDBD0DB21A20B"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to a disaster-damaged eligible
				property, are equal to 100 percent of the fair market rents for the relevant
				market area (as such rents were in effect at the time of such disaster;
				and</text>
					</clause><clause id="idB2DC8CCE02B9437182B34C8059C15C2E"><enum>(ii)</enum><text>with respect to
				other eligible multifamily housing projects, are
				equal</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id61D8589C2CE149A08A42F5B4232166C8"><enum>(b)</enum><header>Owner
			 investment</header><text>Section 517(c) of the Multifamily Assisted Housing
			 Reform and Affordability Act of 1997 (42 U.S.C. 1473f note) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id8131C968ECF3454E9B61D290B14BC477" style="OLC">
					<paragraph id="id1ECB49E504184028B0EDFFAC76BADE12"><enum>(3)</enum><header>Properties
				damaged by natural disasters</header><text>With respect to a disaster-damaged
				eligible property, the owner contribution toward rehabilitation needs shall be
				determined in accordance with paragraph
				(2)(C).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id99658A68E0874F089D5D6E82893BAB02"><enum>8.</enum><header>Period of
			 eligibility for nonprofit debt relief</header><text display-inline="no-display-inline">Section 517(a)(5) of the Multifamily
			 Assisted Housing Reform and Affordability Act of 1997 (42 U.S.C. 1473f note) is
			 amended by adding at the end the following: “If such purchaser acquires such
			 project subsequent to the date of recordation of the affordability agreement
			 described in section 514(e)(6)—</text>
			<quoted-block display-inline="no-display-inline" id="id6FC47762872E446591702A3874C4442D" style="OLC">
				<paragraph id="id5EBF3BA006704179A6ABFF9D930F0F20"><enum>(1)</enum><text display-inline="yes-display-inline">such purchaser shall acquire such project
				on or before the later of—</text>
					<subparagraph id="id14A5296BAAD646619263FBEDD9730392"><enum>(A)</enum><text display-inline="yes-display-inline">5 years after the date of recordation of
				the affordability agreement; or</text>
					</subparagraph><subparagraph id="id61A98F8DEDA54055876E4BA78E66E289"><enum>(B)</enum><text display-inline="yes-display-inline">2 years after the date of enactment of the
				<short-title>Mark-to-Market Extension Act of
				2006</short-title>; and</text>
					</subparagraph></paragraph><paragraph id="id6E4E52D9BF174416B76060190C542816"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary shall have received, and
				determined acceptable, such purchaser's application for modification,
				assignment, or forgiveness prior to the acquisition of the project by such
				purchaser.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idD2970019A5EE43EAA2CF6E1F26ECCCCC"><enum>9.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act, and the
			 amendments made by this Act, shall take effect on the earlier of—</text>
			<paragraph id="id814C8AADEB6348E7910F856B5A96B5A8"><enum>(1)</enum><text>the date of
			 enactment of this Act; or</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF79185550CD64DC9988B57BD0F7D5DCF"><enum>(2)</enum><text>September 30,
			 2006.</text>
