		<official-title>To prohibit the unauthorized removal or use of personal
		  information contained in a database owned, operated, or maintained by the
		  Federal government.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Data Theft Prevention Act of
			 2006</short-title></quote>.</text>
		</section><section id="idD6B95B5E717D4B419A56924D77FA1619"><enum>2.</enum><header>Federal
			 databases</header>
			<subsection id="id9C6D6E762E1C4D06B11DA7FF2CE4907E"><enum>(a)</enum><header>In
			 general</header><text>Chapter 101 of title 18, United States Code, is amended
			 by adding at the end the following:</text>
				<quoted-block act-name="" display-inline="no-display-inline" id="id67DC6B7D1CE744D19A10B1150AF750C0" style="USC">
					<section id="id0E2D85ED485349CEA5A2D6BD6A9B9C32"><enum>2077.</enum><header>Means of
				identification and individually identifiable health information in Federal
				databases</header>
						<subsection id="id129A7FA86372479E9AF02C7B98F2EE0F"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="id989BD6011933410E97068C16B576FB58"><enum>(1)</enum><header>Federal
				database</header><text>The term <term>Federal database</term> means any
				electronic database owned, operated, or maintained by or for the Federal
				Government.</text>
							</paragraph><paragraph id="id76B561BBDEE64F66AE739FC36E29E5CF"><enum>(2)</enum><header>Individually
				identifiable health information</header><text>The term <term>individually
				identifiable health information</term> has the meaning given the term in the
				regulations issued under section 264(c) of the Health Insurance Portability and
				Accountability Act of 1996 (42 U.S.C. 1320d–2 note).</text>
							</paragraph><paragraph id="idA827A9086BF345D3AF00B29099FCFA00"><enum>(3)</enum><header>Means of
				identification</header><text>The term <term>means of identification</term> has
				the meaning given the term in section 1028 of this title.</text>
							</paragraph></subsection><subsection id="id82BBABEC99EC4067AFA69E59729C6AEC"><enum>(b)</enum><header>Unauthorized
				use</header><text>It shall be unlawful for any person knowingly and without
				authorization—</text>
							<paragraph id="id5B1FCE41AC8A4D5BAC5DCF40E02A4817"><enum>(1)</enum><text>to view, use,
				download, or remove any means of identification or individually identifiable
				health information that is in a Federal database; or</text>
							</paragraph><paragraph id="id5E660F3CB9ED4FC3BF1BF8B80795EED5"><enum>(2)</enum><text>to transfer such
				means of identification or individually identifiable health information to, or
				store such means of identification or individually identifiable health
				information in, any computer, network, database, or other format used to store
				information that is not a Federal database.</text>
							</paragraph></subsection><subsection id="idD8D5DD85E82A420FB9245957B3D62CB7"><enum>(c)</enum><header>Use for
				criminal purposes</header><text>It shall be unlawful for any person to use a
				means of identification or individually identifiable health information
				obtained directly or indirectly from a Federal database in furtherance of a
				violation of any Federal or State criminal law.</text>
						</subsection><subsection id="idC00AB1BD528F4FC1B18022C5EF0CA0EB"><enum>(d)</enum><header>Penalty</header><text>Any
				person who violates subsection (b) or (c) shall be fined not more than
				$100,000, imprisoned not more than 1 year, or
				both.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id8730FC8A8CE84545B1624C8345E95D8E"><enum>(b)</enum><header>Chapter
			 analysis</header><text>The table of sections for chapter 101 of title 18,
			 United States Code, is amended by adding after the item relating to section
			 2076 the following:</text>
