		  Department of Veterans Affairs on May 3, 2006, and for other

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Veterans and Military Privacy
			 Protection Act of 2006</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idED458C0096BB460A8EFF271FBA4CC5A3" section-type="subsequent-section"><enum>2.</enum><header>Federal Trade
			 Commission program for veterans, spouses of veterans, and others at risk of
			 identity theft</header>
			<subsection commented="no" display-inline="no-display-inline" id="idED2DD0183DC74D0F9E924F477B473841"><enum>(a)</enum><header>Program
			 required</header><text display-inline="yes-display-inline">The Federal Trade
			 Commission shall, in consultation with the Secretary of Veterans Affairs,
			 develop and implement a program to provide financial counseling and support to
			 any veteran, spouse, or other person described in subsection (e).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id60ECA3A4E26A42CC89E689597C46DA30"><enum>(b)</enum><header>Access</header><text display-inline="yes-display-inline">The program required by subsection (a)
			 shall be accessible through a toll-free telephone number (commonly referred to
			 as an <quote>800 number</quote>) established and operated by the Federal Trade
			 Commission for purposes of the program.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id8EC71BFA9FBA4CE78472D21ADB927AF2"><enum>(c)</enum><header>Elements</header><text display-inline="yes-display-inline">Under the program required by subsection
			 (a), the Federal Trade Commission shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id839479B964BC41F1A026E92BD881AAA4"><enum>(1)</enum><text display-inline="yes-display-inline">provide to veterans, spouses, and other
			 persons described in subsection (e) such financial and other counseling as the
			 Commission considers appropriate relating to identity theft and the theft of
			 data as described in that subsection; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB2A8110F061A463F9B098284E813DAD0"><enum>(2)</enum><text display-inline="yes-display-inline">upon request of any veteran, spouse, or
			 other person described in subsection (e), assist such individual in securing
			 the placement of an extended fraud alert or credit security freeze under
			 sections 605A(b)(3) and 605C of the Fair Credit Reporting Act, as added by this
			 Act, respectively.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id34D39D8C14D343F2A672C7506596185F"><enum>(d)</enum><header>Persons not
			 subject to identity theft</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id2498BFFC8DFE4D5A9D624A81D33EC322"><enum>(1)</enum><header>Notice to ftc
			 of identification of veterans or others not subject to identity
			 theft</header><text display-inline="yes-display-inline">Upon conclusively
			 identifying any veteran, spouse, or other person described in subsection (e) as
			 not being at risk of identity theft as a result of the security breach at the
			 Department of Veterans Affairs on May 3, 2006, the Secretary shall immediately
			 notify the Federal Trade Commission of such identification.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id776C708DC5394C8D9D166B521034A04F"><enum>(2)</enum><header>Notice to
			 veterans and others</header><text display-inline="yes-display-inline">The
			 program required by subsection (a) shall include mechanisms to ensure that any
			 veteran, spouse, or other person who seeks counseling and support under the
			 program after receipt by the Commission of notice under paragraph (1) covering
			 such veteran is informed that such veteran or person is no longer subject to
			 identity theft as a result of the security breach at the Department of Veterans
			 Affairs on May 3, 2006.</text>
				</paragraph></subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="id5BB5CD7B47E548F4A4620C91D08A9E9D"><enum>(e)</enum><header>Applicability</header><text display-inline="yes-display-inline">This section shall apply with respect
			 to—</text>
				<paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id1D54B70142D04E7CAB227DE47725347D"><enum>(1)</enum><text display-inline="yes-display-inline">any veteran, as defined in section 101 of
			 title 38, United States Code, who may be a victim of identity theft as a result
			 of the security breach at the Department of Veterans Affairs on May 3,
			 2006;</text>
				</paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id85B3DECDEFB94AD286492DAFF54B1DCF"><enum>(2)</enum><text display-inline="yes-display-inline">any spouse (or former spouse) of such
			 veteran who the Secretary of Veterans Affairs has conclusively identified as
			 being at risk of identity theft as a result of that security breach; and</text>
				</paragraph><paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id055E14835A574DF6B236A86922836B89"><enum>(3)</enum><text display-inline="yes-display-inline">any other person who the Secretary of
			 Veterans Affairs has conclusively identified as being at risk of identity theft
			 as a result of that security breach.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id5EB1A49BD2D8405593096A0F25AF28C8" section-type="subsequent-section"><enum>3.</enum><header>Extended consumer
			 credit fraud alerts and security freezes for veterans and other persons
			 affected by security breach</header>
			<subsection commented="no" display-inline="no-display-inline" id="id34038D72A23A40038C93FD7361C2CA51"><enum>(a)</enum><header>Automatic fraud
			 alerts</header><text display-inline="yes-display-inline">Section 605A(b) of the
			 Fair Credit Reporting Act (15 U.S.C. 1681c–1(b)) is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idC27F91F00B57419080DCA5687FCE2243" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="id8BDFFBBA35AA4C71A5ACEF8F858DB45F"><enum>(3)</enum><header>Automatic
				extended fraud alerts for certain veterans and others affected by security
				breach</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id5CE25652D16C4346BDFA3DD1DEDD0450"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Upon the direct
				request of a veteran, spouse, or other person described in subparagraph (D),
				each consumer reporting agency described in section 603(p)(1) that maintains a
				file on that individual shall take the actions specified in subparagraphs (A)
				through (C) of paragraph (1) with respect to that individual.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id97F6B5CAF208486D8242668B9DB4A55D"><enum>(B)</enum><header>Automatic
				alerts</header><text display-inline="yes-display-inline">Notwithstanding the
				requirements of paragraph (1), a veteran, spouse, or other person described in
				subparagraph (D) is not required to submit any identity theft report, proof of
				identity, or other documentation with respect to an extended fraud alert
				required by subparagraph (A).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1F358E951FCD4C3AB5613D531A2F9896"><enum>(C)</enum><header>Veterans and
				others not subject to identity theft</header><text display-inline="yes-display-inline">Upon conclusively identifying any veteran,
				spouse, or other person described in subparagraph (D) as not being at risk of
				identity theft as a result of the security breach described in subparagraph
				(A)—</text>
							<clause commented="no" display-inline="no-display-inline" id="id8288D677D42D44A4BEF2E39AF5BB6838"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary of Veterans Affairs shall
				immediately notify each consumer reporting agency and the veteran, spouse, or
				other person involved that such individual is no longer subject to identity
				theft as a result of the security breach described in subparagraph (A);
				and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id504C07A2E3C24AC1954B52C98F553E6F"><enum>(ii)</enum><text display-inline="yes-display-inline">the requirements of subparagraph (A) shall
				no longer apply with respect to any such veteran, spouse, or other person, as
				of the date of such notification.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAC1E3B46556E4F3EAB55C14C10EBF1FD"><enum>(D)</enum><header>Applicability</header><text display-inline="yes-display-inline">This paragraph shall apply to—</text>
							<clause commented="no" display-inline="no-display-inline" id="idA7AC0C73AB644A029FE1767E42668F55"><enum>(i)</enum><text display-inline="yes-display-inline">any veteran, as defined in section 101 of
				title 38, United States Code, who may be a victim of identity theft as a result
				of the security breach at the Department of Veterans Affairs on May 3,
				2006;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id47424A0B594F4E3BB7B4E262667BBEE4"><enum>(ii)</enum><text display-inline="yes-display-inline">any spouse (or former spouse) of such
				veteran who the Secretary of Veterans Affairs has conclusively identified as
				being at risk of identity theft as a result of that security breach; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id61719B0EE0FD4BA5BDD1F45ABB2E4701"><enum>(iii)</enum><text display-inline="yes-display-inline">any other person who the Secretary of
				Veterans Affairs has conclusively identified as being at risk of identity theft
				as a result of that security
				breach.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="ID45BDE07A63724273B6F9FB762B49F2CD"><enum>(b)</enum><header>Security
			 freezes for veterans</header><text display-inline="yes-display-inline">The Fair
			 Credit Reporting Act (15 U.S.C. 1681 et seq.) is amended by inserting after
			 section 605B the following:</text>
				<quoted-block changed="not-changed" display-inline="no-display-inline" id="idC5A6E0AA448B48E0A861E3803B525EE0" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="id77D597B5115B4107BC40862661F5AB91" section-type="subsequent-section"><enum>605C.</enum><header>Security freezes for certain
				veterans</header>
						<subsection commented="no" display-inline="no-display-inline" id="idE9CCB6D821B043EF885C4DE562841A54"><enum>(a)</enum><header>Applicability</header><text display-inline="yes-display-inline">This section shall apply with respect
				to—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idE6B3679A26724E9F90870C0561B47A4D"><enum>(1)</enum><text display-inline="yes-display-inline">any veteran, as defined in section 101 of
				title 38, United States Code, who may be a victim of identity theft as a result
				of the security breach at the Department of Veterans Affairs on May 3,
				2006;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23F863BB209C40D0AA3A082382A7F9B4"><enum>(2)</enum><text display-inline="yes-display-inline">any spouse (or former spouse) of such
				veteran who the Secretary of Veterans Affairs has conclusively identified as
				being at risk of identity theft as a result of that security breach; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDBF9C03933EC401491F6747FB7849195"><enum>(3)</enum><text display-inline="yes-display-inline">any other person who the Secretary of
				Veterans Affairs has conclusively identified as being at risk of identity theft
				as a result of that security breach.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID942C9E6E2AC244C3BD1F8BC4E34768A8"><enum>(b)</enum><header>Security freezes</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID01ECD9D07AF6417892DD36279CA7E745"><enum>(1)</enum><header>Emplacement</header><text display-inline="yes-display-inline">A veteran, spouse, or other person
				described in subsection (a) may include a security freeze in the file of that
				veteran, spouse, or other person maintained by a consumer reporting agency
				described in section 603(p)(1), by making a request to the consumer reporting
				agency in writing, by telephone, or through a secure electronic connection made
				available by the consumer reporting agency.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID72979D1929D34519B694F662B294C4FD"><enum>(2)</enum><header>Consumer disclosure</header><text display-inline="yes-display-inline">If a veteran, spouse, or other person
				described in subsection (a) requests a security freeze under this section, the
				consumer reporting agency shall disclose to that individual the process of
				placing and removing the security freeze and explain to that individual the
				potential consequences of the security freeze. A consumer reporting agency may
				not imply or inform a veteran, spouse, or other person described in subsection
				(a) that the placement or presence of a security freeze on the file of that
				individual may negatively affect their credit score.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9EEAE586146B4AC0A6C3869DE17E444C"><enum>(c)</enum><header>Effect of Security
				Freeze</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID30DD6AF280484CBEA32C990E8039DF1C"><enum>(1)</enum><header>Release of information
				blocked</header><text display-inline="yes-display-inline">If a security freeze
				is in place in the file of a veteran, spouse, or other person described in
				subsection (a), a consumer reporting agency may not release information from
				the file of that individual for consumer credit purposes to a third party
				without prior express written authorization from that individual.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID99D76AE20796400D932FAB39CB644520"><enum>(2)</enum><header>Information provided to third
				parties</header><text display-inline="yes-display-inline">Paragraph (2) does
				not prevent a consumer reporting agency from advising a third party that a
				security freeze is in effect with respect to the file of a veteran, spouse, or
				other person described in subsection (a). If a third party, in connection with
				an application for credit, requests access to a consumer file on which a
				security freeze is in place under this section, the third party may treat the
				application as incomplete.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2C4A767564424CEDA192A19D00CD6AE3"><enum>(3)</enum><header>Credit score not
				affected</header><text display-inline="yes-display-inline">The placement of a
				security freeze under this section may not be taken into account for any
				purpose in determining the credit score of the veteran, spouse, or other person
				to whom the security freeze relates.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID60593BC850EE4BFBB353E2A93F055FB8"><enum>(d)</enum><header>Removal; Temporary
				Suspension</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID23D79D7B9E964BEDB9EB40AA9AA71C0C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (4), a
				security freeze under this section shall remain in place until the veteran,
				spouse, or other person to whom it relates requests that the security freeze be
				removed. The veteran, spouse, or other person may remove a security freeze on
				his or her file by making a request to the consumer reporting agency in
				writing, by telephone, or through a secure electronic connection made available
				by the consumer reporting agency.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE0AF80C130774503BED08B315CF61438"><enum>(2)</enum><header>Conditions</header><text display-inline="yes-display-inline">A consumer reporting agency may remove a
				security freeze placed in the file of a veteran, spouse, or other person under
				this section only—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID5C4A2BD92B8947DF8F99ACFBCBFD7F1A"><enum>(A)</enum><text display-inline="yes-display-inline">upon request of the veteran, spouse, or
				other person, pursuant to paragraph (1); or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2B0E4FF93724451290D597E73D97E8A3"><enum>(B)</enum><text display-inline="yes-display-inline">if the agency determines that the file of
				that veteran, spouse, or other person was frozen due to a material
				misrepresentation of fact by that veteran, spouse, or other person.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6A230881239C42E8970E9E80E5B98D2F"><enum>(3)</enum><header>Notification to
				consumer</header><text display-inline="yes-display-inline">If a consumer
				reporting agency intends to remove a security freeze pursuant to paragraph
				(2)(B), the consumer reporting agency shall notify the veteran, spouse, or
				other person to whom the security freeze relates in writing prior to removing
				the freeze.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID83BA2BF8B40F47EF9E27913A8173EC42"><enum>(4)</enum><header>Temporary
				suspension</header><text display-inline="yes-display-inline">A veteran, spouse,
				or other person described in subsection (a) may have a security freeze under
				this section temporarily suspended by making a request to the consumer
				reporting agency in writing or by telephone and specifying beginning and ending
				dates for the period during which the security freeze is not to apply.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID62B4C0C7F35144DBAD2903807F2D6FF2"><enum>(e)</enum><header>Response Times; Notification of
				Other Entities</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID1DE5E7CDD8384AC38907D3F9FF230221"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A consumer reporting agency shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID0D5E1B5925C94FD48F38CA2316403F52"><enum>(A)</enum><text display-inline="yes-display-inline">place a security freeze in the file of a
				veteran, spouse, or other person under subsection (b) not later than 5 business
				days after receiving a request from the veteran, spouse, or other person under
				subsection (b)(1); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1A01D39178C64BC5BFDAAB4956ED5663"><enum>(B)</enum><text display-inline="yes-display-inline">remove or temporarily suspend a security
				freeze not later than 3 business days after receiving a request for removal or
				temporary suspension from the veteran, spouse, or other person under subsection
				(d).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5C67EC9212374A3FA91475EEDAF0A278"><enum>(2)</enum><header>Notification of other
				agencies</header><text display-inline="yes-display-inline">A consumer reporting
				agency shall notify all other consumer reporting agencies described in section
				603(p)(1) of a request under this section not later than 3 days after placing,
				removing, or temporarily suspending a security freeze in the file of the
				veteran, spouse, or other person under subsection (b), (d)(2)(A), or
				(d)(4).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBB1448E24F75452AB5A9C5BDA95DEA6E"><enum>(3)</enum><header>Implementation by other
				agencies</header><text display-inline="yes-display-inline">A consumer reporting
				agency that is notified of a request under paragraph (2) to place, remove, or
				temporarily suspend a security freeze in the file of a veteran, spouse, or
				other person shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDDA595A0F798E46719AEA6F67B2F0D90B"><enum>(A)</enum><text display-inline="yes-display-inline">request proper identification from the
				veteran, spouse, or other person, in accordance with subsection (g), not later
				than 3 business days after receiving the notification; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCDA4F5FEF2EC4472A275A9ED8F20BFCF"><enum>(B)</enum><text display-inline="yes-display-inline">place, remove, or temporarily suspend the
				security freeze on that credit report not later than 3 business days after
				receiving proper identification.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4FEC7699A29E4A2DA06E40BCDEAC1D3B"><enum>(f)</enum><header>Confirmation</header><text display-inline="yes-display-inline">Except as provided in subsection (c)(3),
				whenever a consumer reporting agency places, removes, or temporarily suspends a
				security freeze at the request of a veteran, spouse, or other person under
				subsection (b) or (d), respectively, it shall send a written confirmation
				thereof to the veteran, spouse, or other person not later than 10 business days
				after placing, removing, or temporarily suspending the security freeze. This
				subsection does not apply to the placement, removal, or temporary suspension of
				a security freeze by a consumer reporting agency because of a notification
				received under subsection (e)(2).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0CE365422A5C4375BF1720EB0CAF4B02"><enum>(g)</enum><header>ID Required</header><text display-inline="yes-display-inline">A consumer reporting agency may not place,
				remove, or temporarily suspend a security freeze in the file of a veteran,
				spouse, or other person described in subsection (a) at the request of the
				veteran, spouse, or other person, unless the veteran, spouse, or other person
				provides proper identification (within the meaning of section 610(a)(1)) and
				the regulations thereunder.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9258EBBF19424000BEB04841C8643501"><enum>(h)</enum><header>Exceptions</header><text display-inline="yes-display-inline">This section does not apply to the use of
				the file of a veteran, spouse, or other person described in subsection (a)
				maintained by a consumer reporting agency by any of the following:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID082E9720DCBD4F7794CE12B3FA5A5607"><enum>(1)</enum><text display-inline="yes-display-inline">A person or entity, or a subsidiary,
				affiliate, or agent of that person or entity, or an assignee of a financial
				obligation owing by the veteran, spouse, or other person to that person or
				entity, or a prospective assignee of a financial obligation owing by the
				veteran, spouse, or other person to that person or entity in conjunction with
				the proposed purchase of the financial obligation, with which the veteran,
				spouse, or other person has or had prior to assignment an account or contract,
				including a demand deposit account, or to whom the veteran, spouse, or other
				person issued a negotiable instrument, for the purposes of reviewing the
				account or collecting the financial obligation owing for the account, contract,
				or negotiable instrument.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFE3D6C0B057B49B082609A6BD5011FA5"><enum>(2)</enum><text display-inline="yes-display-inline">Any Federal, State, or local agency, law
				enforcement agency, trial court, or private collection agency acting pursuant
				to a court order, warrant, subpoena, or other compulsory process.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDADB3DD75374B4D1C80D25304A140D19D"><enum>(3)</enum><text display-inline="yes-display-inline">A child support agency or its agents or
				assigns acting pursuant to subtitle D of title IV of the
				<act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. et
				seq.) or similar State law.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF44FFD85D93946BA83066AECB5D5FC14"><enum>(4)</enum><text display-inline="yes-display-inline">The Department of Health and Human
				Services, a similar State agency, or the agents or assigns of the Federal or
				State agency acting to investigate medicare or medicaid fraud.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID668FF19637DE40C2815D8EB0AFC2CF97"><enum>(5)</enum><text display-inline="yes-display-inline">The Internal Revenue Service or a State or
				municipal taxing authority, or a State department of motor vehicles, or any of
				the agents or assigns of these Federal, State, or municipal agencies acting to
				investigate or collect delinquent taxes or unpaid court orders or to fulfill
				any of their other statutory responsibilities.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID49890F2F7E344D8094DE5BBE84BE7CF1"><enum>(6)</enum><text display-inline="yes-display-inline">The use of consumer credit information for
				the purposes of prescreening, as provided for under this title.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6B1F2D35EE244B89B60FC5C4BC726BAB"><enum>(7)</enum><text display-inline="yes-display-inline">Any person or entity administering a credit
				file monitoring subscription to which the veteran, spouse, or other person has
				subscribed.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD68E1390D3794B6F9EB65DC3E9A57500"><enum>(8)</enum><text display-inline="yes-display-inline">Any person or entity for the purpose of
				providing a veteran, spouse, or other person with a copy of his or her credit
				report or credit score upon request of the veteran, spouse, or other
				person.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC5F4FF7B573C493DA881D69C59D1495B"><enum>(i)</enum><header>Fees</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDB08838FFCEB0489C972E09357C5A34F8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a
				consumer reporting agency may charge a reasonable fee, for placing, removing,
				or temporarily suspending a security freeze in the file of the veteran, spouse,
				or other person described in subsection (a), which cost shall be submitted to
				and paid by the Department of Veterans Affairs, pursuant to procedures
				established by the Secretary of Veterans Affairs.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7F2635A6DA8341B09A04451602ABF6E9"><enum>(2)</enum><header>ID theft victims</header><text display-inline="yes-display-inline">A consumer reporting agency may not charge
				a fee for placing, removing, or temporarily suspending a security freeze in the
				file of a veteran, spouse, or other person described in subsection (a),
				if—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID1E3CACA296E34292B71DAC79DAFCD735"><enum>(A)</enum><text display-inline="yes-display-inline">the veteran, spouse, or other person is a
				victim of identity theft;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID45C1DCCE6ACD447DAF711B867DE0A225"><enum>(B)</enum><text display-inline="yes-display-inline">the veteran, spouse, or other person
				requests the security freeze in writing;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5C9C43238E1D42C38882354BCBE63387"><enum>(C)</enum><text display-inline="yes-display-inline">the veteran, spouse, or other person has
				filed a police report with respect to the theft, or an identity theft report
				(as defined in section 603(q)(4), within 90 days after the date on which the
				theft occurred or was discovered by the veteran, spouse, or other person;
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID882E308F86454858B57B729751532DBC"><enum>(D)</enum><text display-inline="yes-display-inline">the veteran, spouse, or other person
				provides a copy of the report to the reporting agency.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id15F34F278F9747C9B46835BAD37A5D81"><enum>(j)</enum><header>Limitation on information changes
				in frozen reports</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDB46DAAAA9ED94088A25D452B418F87D3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If a security freeze is in place in the
				file of a veteran, spouse, or other person described in subsection (a), the
				consumer reporting agency may not change any of the following official
				information in that file without sending a written confirmation of the change
				to the veteran, spouse, or other person within 30 days after the date on which
				the change is made:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDD3B0F98A5D46491EA0F50CF9EE4DED9A"><enum>(A)</enum><text display-inline="yes-display-inline">Name.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBE9E0F9D5E6B4CDE95183976618D94BB"><enum>(B)</enum><text display-inline="yes-display-inline">Date of birth.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID88F92A3D94304642A9CCFD9A9E23C251"><enum>(C)</enum><text display-inline="yes-display-inline">Social Security number.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEF101A81BBB34AD782D06435D27E4516"><enum>(D)</enum><text display-inline="yes-display-inline">Address.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3026EB13D159481194F8C3CE460FE059"><enum>(2)</enum><header>Confirmation</header><text display-inline="yes-display-inline">Paragraph (1) does not require written
				confirmation for technical modifications of the official information of a
				veteran, spouse, or other person, including name and street abbreviations,
				complete spellings, or transposition of numbers or letters. In the case of an
				address change, the written confirmation shall be sent to both the new address
				and to the former address of the veteran, spouse, or other person.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9EC46885593C4E8B9B9DB45135B55443"><enum>(k)</enum><header>Certain Entity
				Exemptions</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDF0CB328F9B5B457FB566827644634106"><enum>(1)</enum><header>Aggregators and other
				agencies</header><text display-inline="yes-display-inline">The provisions of
				this section do not apply to a consumer reporting agency that acts only as a
				reseller of credit information by assembling and merging information contained
				in the data base of another consumer reporting agency or multiple consumer
				reporting agencies, and does not maintain a permanent data base of credit
				information from which new consumer credit reports are produced.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7016BE9EBB29490991418E3A9FC5E58E"><enum>(2)</enum><header>Other exempted
				entities</header><text display-inline="yes-display-inline">The following
				entities are not required to place a security freeze in the file of a veteran,
				spouse, or other person described in subsection (a) in accordance with this
				section:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDA5932C31AB6846F49D0003284F9B9476"><enum>(A)</enum><text display-inline="yes-display-inline">A check services or fraud prevention
				services company, which issues reports on incidents of fraud or authorizations
				for the purpose of approving or processing negotiable instruments, electronic
				fund transfers, or similar methods of payments.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA72595B713914A27B6490A90BD019466"><enum>(B)</enum><text display-inline="yes-display-inline">A deposit account information service
				company, which issues reports regarding account closures due to fraud,
				substantial overdrafts, ATM abuse, or similar negative information regarding
				such veteran, spouse, or other person, to inquiring banks or other financial
				institutions for use only in reviewing the request of such veteran, spouse, or
				other person for a deposit account at the inquiring bank or financial
				institution.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="idF86BA19B84434E918901754932358A51"><enum>(c)</enum><header>Fees</header><text display-inline="yes-display-inline">Any fee associated with an extended fraud
			 alert or security freeze required by the amendments made by this section that
			 would otherwise be required to be paid by the consumer shall be paid by the
			 Department of Veterans Affairs.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id5B62EBC1366942F493876801D7E45966" section-type="subsequent-section"><enum>4.</enum><header>Penalties for identity
			 theft of veterans and others related to security breach</header><text display-inline="no-display-inline">Section 1028 of title 18, United States
			 Code, is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idA150164CFC3D45F1B7DA75694B82F8AB"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>The
			 punishment for</quote> and inserting the following <quote>Except as provided in
			 subsection (j), the punishment for</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id456A902A8B574CDF9CCC6A486FE9E4D0"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idF507A3EFC86F4E34920CEBAE85FA5BC7" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="idC401A0894E2C4DCBADF4F45AE6A63793"><enum>(j)</enum><header>Identity theft
				due to Department of Veterans Affairs security breach</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id87FACA2FBD494995B1B66EF2D78866BD"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In determining the
				punishment applicable under subsection (b), if the offense is an offense
				described in paragraph (2), the fine and term of imprisonment otherwise
				applicable under subsection (b) shall be doubled.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB0578FA789C64E5E8579928C78043E0C"><enum>(2)</enum><header>Type of
				offense</header><text display-inline="yes-display-inline">An offense described
				in this paragraph is an offense under subsection (a) that—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id2352215C46B44724B5FB32A77CC3E6DF"><enum>(A)</enum><text display-inline="yes-display-inline">involves any document or other
				information—</text>
								<clause commented="no" display-inline="no-display-inline" id="id2575E1E4E32C46069DC00ADC4DE2F788"><enum>(i)</enum><text display-inline="yes-display-inline">relating to a veteran (as defined in
				section 101 of title 38), a spouse of a veteran, or other person; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id2D1E738083DE4D2A951824EDCA19053F"><enum>(ii)</enum><text display-inline="yes-display-inline">obtained as a direct or indirect result of
				the security breach at the Department of Veterans Affairs on May 3, 2006;
				and</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA5F0ED7BB5454FFABEB9444A3B681A9D"><enum>(B)</enum><text display-inline="yes-display-inline">was committed after the date of enactment
				of this
				subsection.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id348F90263C0C4A7A819E1E8AE31FFEC8" section-type="subsequent-section"><enum>5.</enum><header>Funding</header>
			<subsection commented="no" display-inline="no-display-inline" id="id0B62C7BE8BA04F94AD831A81F504C6FB"><enum>(a)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall
			 reimburse the Federal Trade Commission for any costs incurred by the Commission
			 in carrying out this Act and the amendments made by this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id24DDC035643749808A857D3B13686EAC"><enum>(b)</enum><header>Availability of
			 funds</header><text display-inline="yes-display-inline">Amounts appropriated to
			 the Secretary and available for obligation may be utilized for purposes of
			 reimbursement of the Federal Trade Commission under subsection (a).</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idC3E7704FC8384A1AA774ABEF322E52EC" section-type="subsequent-section"><enum>6.</enum><header>Comptroller General
			 studies on data protection and other matters</header>
			<subsection commented="no" display-inline="no-display-inline" id="id166A184D6FB0469D91149B79AA3BD139"><enum>(a)</enum><header>Study on data
			 protection by Department of Veterans Affairs</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id370FBBAFFC954B9E91157BE08A9307D8"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Comptroller
			 General of the United States shall conduct a study of the data protection
			 procedures of the Department of Veterans Affairs.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1FBFB8F0E62643C1B00F10A8AA267739"><enum>(2)</enum><header>Elements</header><text display-inline="yes-display-inline">The study required by paragraph (1) shall
			 include the following:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id7006DA19091D494A8CD686F5646E8CF3"><enum>(A)</enum><text display-inline="yes-display-inline">A review and assessment of the data
			 protection procedures of the Department of Veterans Affairs in effect before
			 May 3, 2006.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6CDC8F862825470FA8338F1B542D635E"><enum>(B)</enum><text display-inline="yes-display-inline">A review and assessment of any
			 modifications of the data protection procedures of the Department of Veterans
			 Affairs adopted as a result of the loss of data resulting from the security
			 breach at the Department on May 3, 2006.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2F79DE7D71AC451FA798D06497C401C0"><enum>(b)</enum><header>Study on
			 security breach investigation by Department of Veterans Affairs</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id04484B5DDC08400D938BC9C4FFAF7348"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Comptroller
			 General of the United States shall conduct a review and assessment of the
			 investigation carried out by the Department of Veterans Affairs with respect to
			 the security breach at the Department on May 3, 2006.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA806DCFFF3E843E6BCE19D938BFFCA94"><enum>(2)</enum><header>Cooperation</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall
			 ensure that the personnel of the Department of Veterans Affairs cooperate fully
			 with the Comptroller General in the conduct of the review and assessment
			 required by paragraph (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCE874B2875F445DAB9C865B962F02EDA"><enum>(c)</enum><header>Study on FTC
			 program for veterans and others at risk of identity theft</header><text display-inline="yes-display-inline">The Comptroller General of the United
			 States shall conduct a study of the program of the Federal Trade Commission for
			 veterans, spouses of veterans, and other persons at risk of identity theft
			 required by section 2. The study shall include an assessment of the
			 effectiveness of the program in meeting the financial counseling and similar
			 needs of individuals seeking counseling and support through the program.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id7F440BC9FEBB4DC3ABAB3D30A63255E7"><enum>(d)</enum><header>Study on
			 compliance of Federal agencies with requirements on personal data</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idE6F8A6F593594547B0875AED42E54C82"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Comptroller
			 General of the United States shall conduct a study of the compliance of the
			 departments and agencies of the Federal Government with applicable requirements
			 relating to the preservation of the confidentiality of personal data.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3BFC341DCAA840CCB562DEB52F1D1423"><enum>(2)</enum><header>Elements</header><text display-inline="yes-display-inline">The study required by paragraph (1) shall
			 include the following:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id1BB78487FDE44A28AD8071BAAA71EB35"><enum>(A)</enum><text display-inline="yes-display-inline">A review and assessment of the current
			 procedures and practices of the departments and agencies of the Federal
			 Government regarding the preservation of the confidentiality of personal
			 data.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3310E7864559418494F023EFB25C689D"><enum>(B)</enum><text display-inline="yes-display-inline">A comparative analysis of the procedures
			 practices referred to in subparagraph (A) with current standards of the Federal
			 Trade Commission for the preservation of the confidentiality of personal data
			 by commercial and non-commercial private entities.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF445019071754DEC812A1C147ECFC443"><enum>(C)</enum><text display-inline="yes-display-inline">A review and assessment of the
			 modifications of the data protection procedures adopted by the Department of
			 Veterans Affairs as a result of the loss of data resulting from the security
			 breach on May 3, 2006, including an assessment of the feasibility and
			 advisability of the adoption of any such modifications by other departments and
			 agencies of the Federal Government.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id43DBDBF8093B4BA9A530026C6892280B"><enum>(D)</enum><text display-inline="yes-display-inline">An identification of recommendations for
			 improvements to the procedures and practices of the departments and agencies of
			 the Federal Government regarding the preservation of the confidentiality of
			 personal data.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB14413C28BEC46BE9A0F8824239F324A"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
			 the enactment of this Act, the Comptroller General of the United States shall
			 submit to Congress a report setting forth the results of each study conducted
			 under this section. The report shall set forth the results of each study
			 separately, and shall include such recommendations for legislative and
			 administrative action as the Comptroller General considers appropriate in light
			 of the studies.</text>
			</subsection></section><section changed="not-changed" commented="no" display-inline="no-display-inline" id="id9D5E0635037C42009C4E8C17CB8C8648" section-type="subsequent-section"><enum>7.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to the Secretary of Veterans Affairs, such sums
			 as may be necessary to carry out this Act and the amendments made by this
			 Act.</text>
