		<section id="ID7CB901362DE6404999B467AD994746E0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Canadian Waste Import Ban Act of

			 2005</short-title></quote>.</text>

		</section><section id="ID15C13A36E5E24159BE5619B7DCB5E59E"><enum>2.</enum><header>Canadian

			 municipal solid waste</header>

			<subsection id="ID903A4B9981C94BF283949F1D664360C8"><enum>(a)</enum><header>In

			 general</header><text>Subtitle D of the <act-name parsable-cite="SWDA">Solid

			 Waste Disposal Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/6941">42 U.S.C. 6941</external-xref> et seq.) is amended

			 by adding at the end the following:</text>

				<quoted-block act-name="Solid Waste Disposal Act" id="IDD66F02A7EDE84CC5BF945EDA331C2301">

					<section id="ID0264C1C4FB7D4C46A44153F747F6ABE0"><enum>4011.</enum><header>Canadian

				municipal solid waste</header>

						<subsection id="ID1A248E9313EA49C996430006A63C8235"><enum>(a)</enum><header>Definitions</header><text>In

				this section:</text>

							<paragraph id="ID886C514A244749EDBE54EA53E4038276"><enum>(1)</enum><header>Agreement</header><text>The

				term <term>Agreement</term> means—</text>

								<subparagraph id="IDD85B0D9745AB44F29034DF8D3DDB2B15"><enum>(A)</enum><text>the Agreement

				Concerning the Transboundary Movement of Hazardous Waste between the United

				States and Canada, signed at Ottawa on October 28, 1986 (TIAS 11099) and

				amended on November 25, 1992; and</text>

								</subparagraph><subparagraph id="ID7BC8F61541F0497C8CB7CCB191A20097"><enum>(B)</enum><text>any regulations

				promulgated to implement and enforce that Agreement.</text>

								</subparagraph></paragraph><paragraph id="ID020AB6D84ECE419E89A93C5BB2CF9688"><enum>(2)</enum><header>Canadian

				municipal solid waste</header><text>The term <term>Canadian municipal solid

				waste</term> means municipal solid waste that is generated in Canada.</text>

							</paragraph><paragraph id="IDD79EDE5B78A446A095D122108091FDA3"><enum>(3)</enum><header>Municipal solid

				waste</header>

								<subparagraph id="ID097F8418CFB24A1200FDC7C24EA8A4B9"><enum>(A)</enum><header>In

				general</header><text>The term <term>municipal solid waste</term> means—</text>

									<clause id="IDE78B302436414C079654247BB939FC87"><enum>(i)</enum><text>material

				discarded for disposal by—</text>

										<subclause id="IDB72F7B619E1742668677ED3E9911CBCA"><enum>(I)</enum><text>households

				(including single and multifamily residences); and</text>

										</subclause><subclause id="IDD46CDF459BED4F40BF257BAEAE3ED8C2"><enum>(II)</enum><text>public lodgings

				such as hotels and motels; and</text>

										</subclause></clause><clause id="ID8EC66E76C68A406886E3003C33F1C245"><enum>(ii)</enum><text>material

				discarded for disposal that was generated by commercial, institutional, and

				industrial sources, to the extent that the material—</text>

										<subclause id="ID8B776B79EF674651BD00EA359B9993C8"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="ID7C10CD4A37D840809EDA7E56B7856099"><enum>(aa)</enum><text>is essentially the

				same as material described in clause (i); or</text>

											</item><item id="ID3C5D066847084907A982C1FDA3B2701D" indent="up1"><enum>(bb)</enum><text>is collected and disposed of with

				material described in clause (i) as part of a normal municipal solid waste

				collection service; and</text>

											</item></subclause><subclause id="IDB91C55895B1B4C22AC6D90D6EDB1A2FB"><enum>(II)</enum><text>is not subject

				to regulation under subtitle C.</text>

										</subclause></clause></subparagraph><subparagraph id="IDA90967EF8E9347278C869CF8A5C3D778"><enum>(B)</enum><header>Inclusions</header><text>The

				term <term>municipal solid waste</term> includes—</text>

									<clause id="ID33CB3D57AFD8496980B4F138AF4E586C"><enum>(i)</enum><text>appliances;</text>

									</clause><clause id="ID1088550BDB8D4AC2969511285B4CD421"><enum>(ii)</enum><text>clothing;</text>

									</clause><clause id="ID10006CDD398B4E9695954DEE08549DC8"><enum>(iii)</enum><text>consumer

				product packaging;</text>

									</clause><clause id="IDDF5551EBB20F48C68F84BF009EC3EB80"><enum>(iv)</enum><text>cosmetics;</text>

									</clause><clause id="IDDC93453C454A4519A877AEA6439F27AF"><enum>(v)</enum><text>debris resulting

				from construction, remodeling, repair, or demolition of a structure;</text>

									</clause><clause id="ID8B072ED98A514A85B091C8BE4B5FA4A5"><enum>(vi)</enum><text>disposable

				diapers;</text>

									</clause><clause id="IDAC3471C3E72B48FAA5AE37152E2ECCEE"><enum>(vii)</enum><text>food containers

				made of glass or metal;</text>

									</clause><clause id="ID86B4DC69383047C28027294030E358D5"><enum>(viii)</enum><text>food

				waste;</text>

									</clause><clause id="ID6296AF5F42E145EAAE3EF407B6C6432C"><enum>(ix)</enum><text>household

				hazardous waste;</text>

									</clause><clause id="ID0F8829DE00514CC281FFDE08F446C600"><enum>(x)</enum><text>office

				supplies;</text>

									</clause><clause id="IDAD03107295B1430F8245AB3D3685A9CE"><enum>(xi)</enum><text>paper;

				and</text>

									</clause><clause id="IDEC7382EF54E24360BDD8FF13E97B2D43"><enum>(xii)</enum><text>yard

				waste.</text>

									</clause></subparagraph><subparagraph id="IDBB8FDCADD00E4BFE8843A3B570FBE34F"><enum>(C)</enum><header>Exclusions</header><text>The

				term <term>municipal solid waste</term> does not include—</text>

									<clause id="ID38BBD37535CC465F940716C5AC4FAA7D"><enum>(i)</enum><text>solid waste

				identified or listed as a hazardous waste under section 3001, except for

				household hazardous waste;</text>

									</clause><clause id="IDDCB89EA72437439B821737C000246FBB"><enum>(ii)</enum><text>solid waste,

				including contaminated soil and debris, resulting from—</text>

										<subclause id="ID281C77E1C12C4E6AAFC10043A0B02117"><enum>(I)</enum><text>a response action

				taken under section 104 or 106 of the Comprehensive Environmental Response,

				Compensation, and Liability Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604</external-xref>, 9606);</text>

										</subclause><subclause id="ID577C7267C356496293E24D91F4967EEE"><enum>(II)</enum><text>a response

				action taken under a State law with authorities comparable to the authorities

				contained in either of those sections; or</text>

										</subclause><subclause id="ID8576CC349D5B480B8E00B100D4001332"><enum>(III)</enum><text>a corrective

				action taken under this Act;</text>

										</subclause></clause><clause id="IDF28BA00EC86D40BEA8CE98F918711545"><enum>(iii)</enum><text>recyclable

				material—</text>

										<subclause id="ID669574718DA94BE5A15817A27561A23B"><enum>(I)</enum><text>that has been

				separated, at the source of the material, from waste destined for disposal;

				or</text>

										</subclause><subclause id="IDB7833EC82A5B4543862B5CA39D937D6E"><enum>(II)</enum><text>that has been

				managed separately from waste destined for disposal, including scrap rubber to

				be used as a fuel source;</text>

										</subclause></clause><clause id="ID4C47D7C5903F42C6A7D976A8DC16CC6D"><enum>(iv)</enum><text>a material or

				product returned from a dispenser or distributor to the manufacturer or an

				agent of the manufacturer for credit, evaluation, and possible potential

				reuse;</text>

									</clause><clause id="ID77D3F6E028A74786AD24516EAD8E58E4"><enum>(v)</enum><text>solid waste that

				is—</text>

										<subclause id="IDA324226DF1F848FCBFCAF745CA080010"><enum>(I)</enum><text>generated by an

				industrial facility; and</text>

										</subclause><subclause id="ID82A3E6B3624A4006A05385465E5ED37C"><enum>(II)</enum><text>transported for

				the purpose of treatment, storage, or disposal to a facility (which facility is

				in compliance with applicable State and local land use and zoning laws and

				regulations) or facility unit—</text>

											<item id="ID27CC7523FDBD442AB5ABCAD177ACAAA2"><enum>(aa)</enum><text>that is owned or

				operated by the generator of the waste;</text>

											</item><item id="ID3E015F7C39844C1094847496213E19A5"><enum>(bb)</enum><text>that is located

				on property owned by the generator of the waste or a company with which the

				generator is affiliated; or</text>

											</item><item id="ID822257CA703E4C8ABDFAD52DBEB40186"><enum>(cc)</enum><text>the capacity of

				which is contractually dedicated exclusively to a specific generator;</text>

											</item></subclause></clause><clause id="ID68BC8012B6DA42B4841EC2FB67C8EF4E"><enum>(vi)</enum><text>medical waste

				that is segregated from or not mixed with solid waste;</text>

									</clause><clause id="ID9C2007BFCBC842C6913DE87571711324"><enum>(vii)</enum><text>sewage sludge

				or residuals from a sewage treatment plant;</text>

									</clause><clause id="ID4A735FF225694921829CBF6299DE31A7"><enum>(viii)</enum><text>combustion ash

				generated by a resource recovery facility or municipal incinerator; or</text>

									</clause><clause id="IDECC37763C4CB4539B9F17752121363A7"><enum>(ix)</enum><text>waste from a

				manufacturing or processing (including pollution control) operation that is not

				essentially the same as waste normally generated by households.</text>

									</clause></subparagraph></paragraph></subsection><subsection id="ID2EDD2D727E19416B9911C6F7BA084C23"><enum>(b)</enum><header>Ban on Canadian

				municipal solid waste</header>

							<paragraph id="ID5DCE2510313D41AEBB11F3E1004DA5A4"><enum>(1)</enum><header>In

				general</header><text>Except as provided in paragraph (2), until the date on

				which the Administrator promulgates regulations to implement and enforce the

				Agreement (including notice and consent provisions of the Agreement), no person

				may import into any State, and no solid waste management facility may accept,

				Canadian municipal solid waste for the purpose of disposal or incineration of

				the Canadian municipal solid waste.</text>

							</paragraph><paragraph id="IDDA1B170BA8B44757AE975808A5000772"><enum>(2)</enum><header>Election by

				Governor</header><text>The Governor of a State may elect to opt out of the ban

				under paragraph (1), and consent to the importation and acceptance by the State

				of Canadian municipal solid waste before the date specified in that paragraph,

				if the Governor submits to the Administrator a notice of that election by the

				Governor.</text>

							</paragraph></subsection><subsection id="IDB339C4091EED4CACB485A7A5001F5E59"><enum>(c)</enum><header>Authority of

				Administrator</header>

							<paragraph id="ID77A93FBDEDE744D7861CDF74DE9CB393"><enum>(1)</enum><header>In

				general</header><text>Beginning immediately after the date of enactment of this

				section, the Administrator shall—</text>

								<subparagraph id="IDEF15BF6C1E96438EBEFABE68D575D490"><enum>(A)</enum><text>perform the

				functions of the Designated Authority of the United States described in the

				Agreement with respect to the importation and exportation of municipal solid

				waste under the Agreement; and</text>

								</subparagraph><subparagraph id="IDA435096087604302BC43B4262D287786"><enum>(B)</enum><text>implement and

				enforce the Agreement (including notice and consent provisions of the

				Agreement).</text>

								</subparagraph></paragraph><paragraph id="ID593E1A0EEA7A4898891D091B169D66D5"><enum>(2)</enum><header>Consent to

				importation</header><text>In considering whether to consent to the importation

				of Canadian municipal solid waste under article 3(c) of the Agreement, the

				Administrator shall—</text>

								<subparagraph id="ID344597BEA647465685D121C66E1276EE"><enum>(A)</enum><text>obtain the

				consent of each State into which the Canadian municipal solid waste is to be

				imported; and</text>

								</subparagraph><subparagraph id="ID74E07162D6944834BC2E98E0A053FAE5"><enum>(B)</enum><text>consider the

				impact of the importation on homeland security, public health, and the

				environment.</text>

								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="ID1DD14FF6EB164F39B2EA5183A034ADF3"><enum>(b)</enum><header>Conforming

			 amendment</header><text>The table of contents of the

			 <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (42 U.S.C.

			 prec. 6901) is amended by adding after the item relating to section 4010 the

			 following:</text>
