			</subsection></section><section id="idA60D20AE36AB4BF4B6347441A16F0B48" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="IDedc5b83d1ec74cde8a73525ff0b0566e"><enum>(1)</enum><text>According to the
			 Surgeon General's Conference on Children's Mental Health: A National Action
			 Agenda, mental health is a critical component of children's learning and
			 general health.</text>
			</paragraph><paragraph id="ID1d2b03c9b5814070a44dec788d92123f"><enum>(2)</enum><text>According to the
			 Surgeon General's Conference on Children's Mental Health: A National Action
			 Agenda, one in 10 children and adolescents suffer from mental illness severe
			 enough to cause some level of impairment.</text>
			</paragraph><paragraph id="ID6e6338ed0740483793bb236963a01142"><enum>(3)</enum><text>According to the
			 Surgeon General's Conference on Children's Mental Health: A National Action
			 Agenda, only one in five children and adolescents who suffer from severe mental
			 illness receive the specialty mental health services they require.</text>
			</paragraph><paragraph id="ID7f7de9ad0fb84fa0be6c5edc2c17a6bb"><enum>(4)</enum><text>According to the
			 World Health Organization, childhood neuropsychiatric disorders will rise by
			 over 50 percent by 2020, internationally, to become one of the five most common
			 causes of morbidity, mortality, and disability among children.</text>
			</paragraph><paragraph id="IDaa4128be6b674041b475730adf1ee9dc"><enum>(5)</enum><text>According to the
			 Surgeon General's Conference on Children's Mental Health: A National Action
			 Agenda, the burden of suffering experienced by children with mental illness and
			 their families has created a health crisis in this country.</text>
			</paragraph><paragraph id="ID1acfbb3acd1442888bfd32bc56f552de"><enum>(6)</enum><text>According to the
			 Surgeon General's Conference on Children's Mental Health: A National Action
			 Agenda, there is broad evidence that the nation lacks a unified infrastructure
			 to help children suffering from mental illness;</text>
			</paragraph><paragraph id="IDf0abc8ed166f49b88c12d0b0bbb8a501"><enum>(7)</enum><text>According to the
			 President's New Freedom Commission on Mental Health, President George Bush
			 identified three obstacles preventing Americans with mental illness from
			 getting the care they require: stigma that surrounds mental illness; unfair
			 treatment limitations and financial requirements placed on mental health
			 benefits in private health insurance, and; the fragmented mental health service
			 delivery system.</text>
			</paragraph><paragraph id="ID573ca47fcdf3485abd6d237868c72730"><enum>(8)</enum><text>According to the
			 Surgeon General's Conference on Children's Mental Health: A National Action
			 Agenda, one way to ensure that the country's health system meets the mental
			 health needs of children is to move towards a community-based mental health
			 delivery system that balances health promotion, disease prevention, early
			 detection, and universal access to care.</text>
			</paragraph><paragraph id="ID86a69726694a4f87b1aea6e9adc70c02"><enum>(9)</enum><text>According to the
			 President's New Freedom Commission on Mental Health, transforming the country's
			 mental health delivery system rests on two principles: services and treatments
			 must be consumer and family-centered, and; care must focus on increasing a
			 person's ability to successfully cope with life's challenges, on facilitating
			 recovery, and building resiliency.</text>
			</paragraph><paragraph id="ID5e867f0b65a34961be165676f0e60106"><enum>(10)</enum><text>According to the
			 Surgeon General's Conference on Children's Mental Health: A National Action
			 Agenda, the mental health and resiliency of children can be ensured by methods
			 that: promote public awareness of children's mental health issues and reduce
			 stigma associated with mental illness; continue to develop, disseminate, and
			 implement scientifically-proven prevention and treatment services in the field
			 of children's mental health; improve the assessment of and recognition of
			 mental health needs in children; eliminate racial, ethnic and socioeconomic
			 disparities in access to mental healthcare services; improve the infrastructure
			 for children's mental health services, including support for
			 scientifically-proven interventions across professions; increase access to and
			 coordination of quality mental healthcare services; train frontline providers
			 to recognize and manage mental health issues, and educate mental healthcare
			 providers about scientifically-proven prevention and treatment services, and;
			 monitor the access to and coordination of quality mental healthcare
			 services.</text>
			</paragraph><paragraph id="ID4f7bc7a0fbcc44c09e769f38a3812a68"><enum>(11)</enum><text>According to the
			 President's New Freedom Commission on Mental Health, the country's mental
			 health delivery system can be successfully transformed by methods that: ensure
			 Americans understand that mental health is essential to overall health; ensure
			 mental health care is consumer and family-driven; eliminate disparities in
			 mental healthcare services; ensure early mental health screening, assessment,
			 and referral services are common practices; ensure that excellent mental health
			 care is delivered and research is accelerated, and; technology is used to
			 access mental health care and information.</text>
			</paragraph></section><title id="idD149C5CE96AD40C8A47B619C3F090FEF"><enum>I</enum><header>State and
			 community activities concerning the mental health of children and
			 adolescents</header>
			<section id="id5C0A38CDE5C540CEA184ACB524537E36"><enum>101.</enum><header>Grants
			 concerning comprehensive state mental health plans</header><text display-inline="no-display-inline">Subpart
			 3 of part B of title V of the Public Health Service Act (42 U.S.C. 290bb–31 et
			 seq.) is amended by inserting after section 520A, the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA98D28C83DEE4A9BB77E39E6A3C18A12" style="OLC">
					<section id="idE54C627107FF4277BD58E64DBC9AABCB"><enum>520B.</enum><header>Comprehensive
				state mental health plans</header>
						<subsection id="ID9c56175f6898446492d96e1284021efd"><enum>(a)</enum><header>Grants</header><text>The
				Secretary, acting through the Center for Mental Health Services, shall award a
				1-year, non-renewable grant to, or enter into a 1-year cooperative agreement
				with, a State for the development and implementation by the State of a
				comprehensive State mental health plan that exclusively meets the mental health
				needs of children and adolescents, including providing for early intervention,
				prevention, and recovery oriented services and supports for children and
				adolescents, such as mental and primary health care, education, transportation,
				and housing.</text>
						</subsection><subsection id="id4CC238A96CF848F1AEC6DDA17CD40461"><enum>(b)</enum><header>Application</header><text>To
				be eligible to receive a grant or cooperative agreement under this section a
				State shall submit to the Secretary an application at such time, in such
				manner, and containing such information as the Secretary may require,
				including—</text>
							<paragraph id="idAF2654F5AB784F0F9AEDFED82C3FFC2E"><enum>(1)</enum><text>a certification
				by the governor of the State that the governor will be responsible for
				overseeing the development and implementation of the comprehensive State mental
				health plan; and</text>
							</paragraph><paragraph id="id4F7DBCD0C42B4A8D8D29CF698FD65633"><enum>(2)</enum><text>the signature of
				the governor of the State.</text>
							</paragraph></subsection><subsection id="IDd0a40b9f6a794785b571b2a790f5412e"><enum>(c)</enum><header>Requirements</header><text>The
				Comprehensive State Plan shall include the following:</text>
							<paragraph id="id20A434C79EFA4018BA189B94C888DFC0"><enum>(1)</enum><text>An evaluation of
				all the components of the current mental health system in the State, including
				the estimated number of children and adolescents requiring and receiving mental
				health services, as well as support services such as primary health care,
				education, and housing.</text>
							</paragraph><paragraph id="ID978d3688bf584302a3c88a82f37cc796"><enum>(2)</enum><text>A description of
				the long-term objectives of the State for policies concerning children and
				adolescents with mental disorders. Such objectives shall include—</text>
								<subparagraph id="id11C36FBA549045F1BA76149313F82759"><enum>(A)</enum><text>the provision of
				early intervention and prevention services to children and adolescents with, or
				who are at risk for, mental health disorders that are integrated with school
				systems, educational institutions, juvenile justice systems, substance abuse
				programs, mental health programs, primary care programs, foster care systems,
				and other child and adolescent support organizations;</text>
								</subparagraph><subparagraph id="IDf93bee7126424dbe939dd9c22f0fa39e"><enum>(B)</enum><text>a demonstrated
				collaboration among agencies that provide early intervention and prevention
				services or a certification that entities will engage in such future
				collaboration;</text>
								</subparagraph><subparagraph id="ID706765f8cd784125ab2621310192a377"><enum>(C)</enum><text>implementing or
				providing for the evaluation of children and adolescents mental health services
				that are adapted to the local community;</text>
								</subparagraph><subparagraph id="id7044C04F85524FDC991FDA929224B170"><enum>(D)</enum><text>implementing
				collaborative activities concerning child and adolescent mental health early
				intervention and prevention services;</text>
								</subparagraph><subparagraph id="ID4afc84b103f14a798ba01e073a031364"><enum>(E)</enum><text>the provision of
				timely appropriate community-based mental health care and treatment of children
				and adolescents in child and adolescent-serving settings and agencies;</text>
								</subparagraph><subparagraph id="IDc31905742dbe4eb29989d55d8d534a94"><enum>(F)</enum><text>the provision of
				adequate support and information resources to families of children and
				adolescents with, or who are at risk for, mental health disorders;</text>
								</subparagraph><subparagraph id="id7DD6935FB5544119A2143B3088E57672"><enum>(G)</enum><text>the provision of
				adequate support and information resources to advocacy organizations that serve
				children and adolescents with, or who are at risk for, mental health disorders,
				and their families;</text>
								</subparagraph><subparagraph id="ID3ff71747eb274cefbedd2f721b0a86e7"><enum>(H)</enum><text>identifying and
				offering access to services and care to children and adolescents and their
				families with diverse linguistic and cultural backgrounds;</text>
								</subparagraph><subparagraph id="IDe4be826c5c7245c287b92b41bb5a76bf"><enum>(I)</enum><text>identifying and
				offering equal access to services in all geographic regions of the
				State;</text>
								</subparagraph><subparagraph id="idE22C0EF09810448AA4DFD4497CC1D556"><enum>(J)</enum><text>identifying and
				offering appropriate access to services in geographical regions of the State
				with above-average occurrences of child and adolescent mental health
				disorders;</text>
								</subparagraph><subparagraph id="id1866928A2A8F452EBF2C73B88ED8C453"><enum>(K)</enum><text>identifying and
				offering appropriate access to services in geographical regions of the State
				with above-average rates of children and adolescents with co-occurring mental
				health and substance abuse disorders;</text>
								</subparagraph><subparagraph id="IDfad71b3bf20241ab83206ae9db3cf236"><enum>(L)</enum><text>offering
				continuous and up-to-date information to, and carrying out awareness campaigns
				that target children and adolescents, parents, legal guardians, family members,
				primary care professionals, mental health professionals, child care
				professionals, health care providers, and the general public and that highlight
				the risk factors associated with mental health disorders and the life-saving
				help and care available from early intervention and prevention services;</text>
								</subparagraph><subparagraph id="ID7f5907a2b79e4a4cad9458c84818f6ab"><enum>(M)</enum><text>ensuring that
				information and awareness campaigns on mental health disorder risk factors, and
				early intervention and prevention services, use effective and
				culturally-appropriate communication mechanisms that are targeted to and reach
				adolescents, families, schools, educational institutions, juvenile justice
				systems, substance abuse programs, mental health programs, primary care
				programs, foster care systems, and other child and adolescent support
				organizations;</text>
								</subparagraph><subparagraph id="ID74311cc49dd8462c8a393e9f6bcdc2de"><enum>(N)</enum><text>implementing a
				system to ensure that primary care professionals, mental health professionals,
				and school and child care professionals are properly trained in evidence-based
				best practices in child and adolescent mental health early intervention and
				prevention, treatment and rehabilitation services and that those professionals
				involved with providing early intervention and prevention services are properly
				trained in effectively identifying children and adolescents with or who are at
				risk for mental health disorders;</text>
								</subparagraph><subparagraph id="IDb431f8e7dd624c7cb901da68505198f0"><enum>(O)</enum><text>the provision of
				continuous training activities for primary care professionals, mental health
				professionals, and school and child care professionals on evidence-based or
				promising best practices;</text>
								</subparagraph><subparagraph id="idD0D475C9E98A48E0A69DA5E67D09EE40"><enum>(P)</enum><text>the provision of
				continuous training activities for primary care professionals, mental health
				professionals, and school and child care professionals on family and consumer
				involvement and participation;</text>
								</subparagraph><subparagraph id="ID08637eaed7ee4bf4b3a6ef9ab48aaf7c"><enum>(Q)</enum><text>conducting annual
				self-evaluations of all outcomes and activities, including consulting with
				interested families and advocacy organizations for children and
				adolescents.</text>
								</subparagraph></paragraph><paragraph id="ID26532c2fffc2479b8feff99d9fce8bd5"><enum>(3)</enum><text>A cost-assessment
				relating to the development and implementation of the State plan and a
				description of how the State will measure performance and outcomes across
				relevant agencies and service systems.</text>
							</paragraph><paragraph id="IDcf26473c981743279d7bbfcc8c291fb9"><enum>(4)</enum><text>A timeline for
				achieving the objectives described in paragraph (2).</text>
							</paragraph><paragraph id="idDFCE400C4016406D8C0E950F5BCD98CA"><enum>(5)</enum><text>An outline for
				achieving the sustainability of the objectives described in paragraph
				(2).</text>
							</paragraph></subsection><subsection id="id646DF0B63ED3407FA0D8ACE4516692A3"><enum>(d)</enum><header>Application of
				other requirements</header><text>The authorities and duties of State mental
				health planning councils provided for under sections 1914 and 1915 with respect
				to State mental health block grant planning shall apply to the development and
				the implementation of the comprehensive State mental health plan.</text>
						</subsection><subsection id="IDeac71581df2b4392bcbc4733f72a4557"><enum>(e)</enum><header>Participation
				and Implementation</header>
							<paragraph id="id299C539B8AAF43AA90CF56365D1298DA"><enum>(1)</enum><header>Participation</header><text>In
				developing and implementing the comprehensive State mental health plan under a
				grant or cooperative agreement under this section, the State shall ensure the
				participation of the State agency heads responsible for child and adolescent
				mental health, substance abuse, child welfare, medicaid, public health,
				developmental disabilities, social services, juvenile justice, housing, and
				education.</text>
							</paragraph><paragraph id="ID1ceb19da55d64c95b473f9a92a93709a"><enum>(2)</enum><header>Consultation</header><text>In
				developing and implementing the comprehensive State mental health plan under a
				grant or cooperative agreement under this section, the State shall consult
				with—</text>
								<subparagraph id="idFDCAB1E2E5C64289A700F8519D924AE5"><enum>(A)</enum><text>the Federal
				interagency coordinating committee established under section 401 of the
				<short-title>Child and Adolescent Mental Health Resiliency
				Act of 2006</short-title>;</text>
								</subparagraph><subparagraph id="id24CD730640B44F4E9AD2B5A00B22694B"><enum>(B)</enum><text>State and local
				agencies, including agencies responsible for child and adolescent mental health
				care, early intervention and prevention services under titles IV, V, and XIX of
				the Social Security Act, and the State's Children's Health Insurance Program
				under title XXI of the Social Security Act;</text>
								</subparagraph><subparagraph id="idF36B21F9345E44ABB0F5DC7172001ABB"><enum>(C)</enum><text>State mental
				health planning councils (described in section 1914);</text>
								</subparagraph><subparagraph id="idB3CC9D6838A54CFFB685F228B1D999DE"><enum>(D)</enum><text>local, State, and
				national advocacy organizations that serve children and adolescents with or who
				are at risk for mental health disorders and their families;</text>
								</subparagraph><subparagraph id="idB9EB2250FA1247B19BC0F5657BB09D68"><enum>(E)</enum><text>relevant national
				medical and other health professional and education specialty
				organizations;</text>
								</subparagraph><subparagraph id="id7EA1343ED6DC44BCAAE19212C278DD38"><enum>(F)</enum><text>children and
				adolescents with mental health disorders and children and adolescents who are
				currently receiving early intervention or prevention services;</text>
								</subparagraph><subparagraph id="id9E972E6ADEC0445188920A849EB3ED8E"><enum>(G)</enum><text>families and
				friends of children and adolescents with mental health disorders and children
				and adolescents who are currently receiving early intervention or prevention
				services;</text>
								</subparagraph><subparagraph id="idE7B1957FE2124612BC20F9C0EA16D4AB"><enum>(H)</enum><text>families and
				friends of children and adolescents who have attempted or completed
				suicide;</text>
								</subparagraph><subparagraph id="idB54F8DE3F0C5433C99649143DEB59DB5"><enum>(I)</enum><text>qualified
				professionals who possess the specialized knowledge, skills, experience,
				training, or relevant attributes needed to serve children and adolescents with
				or who are at risk for mental health disorders and their families; and</text>
								</subparagraph><subparagraph id="idADF2F0A758F64E159BBCFAE05165FBD5"><enum>(J)</enum><text>third-party
				payers, managed care organizations, and related employer and commercial
				industries.</text>
								</subparagraph></paragraph><paragraph id="id46EE7606FC0246F28DF646BB4E7DA870"><enum>(3)</enum><header>Signature</header><text>The
				Governor of the State shall sign the comprehensive State mental health plan
				application and be responsible for overseeing the development and
				implementation of the plan.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID328c5369b12d45b8b4546f26c5778103"><enum>(f)</enum><header>Satisfaction of
				other federal requirements</header><text>A State may utilize the comprehensive
				State mental health plan that meets the requirements of this section to satisfy
				the planning requirements of other Federal mental health programs administered
				by the Secretary, including as the Community Mental Health Services Block Grant
				and the Children's Mental Health Services Program, so long as the requirements
				of such programs are satisfied through the plan.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id10AD012159A945989DD0A567A8163EE3"><enum>(g)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this section $50,000,000 for fiscal year 2007, and such sums as may be
				necessary for each of fiscal years 2008 through
				2011.</text>

			</section><section id="idAB43DAAEEB4D4F64AAF7F0E948D303FC"><enum>102.</enum><header>Grants
			 concerning early intervention and prevention</header><text display-inline="no-display-inline">Title V of the Public Health Services Act
			 (42 U.S.C. 290aa et seq.) is amended by adding at the end the following:</text>

							<subsection id="idA8DA5FD367944D5DA8591D38A89F2BA9"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall award 5-year matching grants to, or
				enter into cooperative agreements with, community health centers that receive
				assistance under section 330 to enable such centers to provide child and
				adolescent mental health early intervention and prevention services to eligible
				children and adolescents, and to provide referral services to, or early
				intervention and prevention services in coordination with, community mental
				health centers and other appropriately trained providers of care.</text>
							</subsection><subsection id="idFB0D694A029E49D8AFA279899C3E4ADB"><enum>(b)</enum><header>Application</header><text>To
				be eligible to receive a grant or cooperative agreement under subsection (a) an
				entity shall—</text>
								<paragraph id="idDB78414DB26B4F6E8CB7A3338CB63672"><enum>(1)</enum><text>be a community
				health center that receives assistance under section 330;</text>
								</paragraph><paragraph id="id92E82AFF403B469A83B3E0F3BBF39363"><enum>(2)</enum><text>prepare and
				submit to the Secretary an application at such time, in such manner, and
				containing such information as the Secretary may require;</text>
								</paragraph><paragraph id="ID754182598091441f912c4fb18ce16d4c"><enum>(3)</enum><text>provide
				assurances that the entity will have appropriately qualified behavioral health
				professional staff to ensure prompt treatment or triage for referral to a
				speciality agency or provider; and</text>
								</paragraph><paragraph id="id41715638B35D469CA1AEAB4D0152650A"><enum>(4)</enum><text>provide
				assurances that the entity will encourage formal coordination with community
				mental health centers and other appropriate providers to ensure continuity of
				care.</text>
								</paragraph></subsection><subsection id="id498D24DB5704418B8625F3F2A5E2C1B7"><enum>(c)</enum><header>Identification</header><text>In
				providing services with amounts received under a grant or cooperative agreement
				under this section, an entity shall ensure that appropriate screening tools are
				used to identify at-risk children and adolescents who are eligible to receive
				care from a community health centers.</text>
							</subsection><subsection id="idA2910655AFB64AE4A62F518B9D20CEEE"><enum>(d)</enum><header>Matching
				requirement</header><text>With respect to the costs of the activities to be
				carried out by an entity under a grant or cooperative agreement under this
				section, an entity shall provide assurances that the entity will make available
				(directly or through donations from public or private entities) non-Federal
				contributions towards such costs in an amount that is not less than $1 for each
				$1 of Federal funds provided under the grant or cooperative agreement.</text>
							</subsection></section><section id="id60512CCAE18A49D78C561B2E6964B88D"><enum>597A.</enum><header>Grants for
				primary care and mental health early intervention and prevention
				services</header>
							<subsection id="idFA83D1FA67334732B883A7405B87DBA3"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall award 5-year matching grants to, or
				enter into cooperative agreements with, States, political subdivisions of
				States, consortium of political subdivisions, tribal organizations, public
				organizations, or private nonprofit organizations to enable such entities to
				provide assistance to mental health programs for early intervention and
				prevention services to children and adolescents with, or who are at-risk of,
				mental health disorders and that are in primary care settings.</text>
							</subsection><subsection id="id46CFA0A4DD69456EBB11C0B717C1EF48"><enum>(b)</enum><header>Application</header><text>To
				be eligible to receive a grant or cooperative agreement under subsection (a) an
				entity shall—</text>
								<paragraph id="id591DB581AA4D487BA1553E1733BA8BC4"><enum>(1)</enum><text>be a State, a
				political subdivision of a State, a consortia of political subdivisions, a
				tribal organization, a public organization, or private nonprofit organization;
				and</text>
								</paragraph><paragraph id="id314597EB00854EDFB6C19A17404A5130"><enum>(2)</enum><text>prepare and
				submit to the Secretary an application at such time, in such manner, and
				containing such information as the Secretary may require.</text>
								</paragraph></subsection><subsection id="id9F0ECD0A6B00497286A8793F3E1924B7"><enum>(c)</enum><header>Use of
				funds</header><text>An entity shall use amounts received under a grant or
				cooperative agreement under this section to—</text>
								<paragraph id="id2B50E890E1604E328ED65398154178CF"><enum>(1)</enum><text>provide
				appropriate child and adolescent mental health early intervention and
				prevention assessment services;</text>
								</paragraph><paragraph id="IDfad6e1cfd2bd41c3aead95c29a301451"><enum>(2)</enum><text>provide
				appropriate child and adolescent mental health treatment services;</text>
								</paragraph><paragraph id="IDf2922392fa0646c6be856fa8510f9ad9"><enum>(3)</enum><text>provide
				monitoring and referral for specialty treatment of medical or surgical
				conditions for children and adolescents ; and</text>
								</paragraph><paragraph id="IDea862f0907c94165819fa7a56f97559a"><enum>(4)</enum><text>facilitate
				networking between primary care professionals, mental health professionals, and
				child care professionals for—</text>
									<subparagraph id="idF537A8B908944A8D9A5B5629537EF327"><enum>(A)</enum><text>case management
				development;</text>
									</subparagraph><subparagraph id="idEB93466F06B24E3EB98791EAED1630C8"><enum>(B)</enum><text>professional
				mentoring; and</text>
									</subparagraph><subparagraph id="id2C1712C4B28148E0B83DAD164E585167"><enum>(C)</enum><text>enhancing the
				provision of mental health services in schools.</text>
									</subparagraph></paragraph></subsection><subsection id="idBA377A62E0434EC09ADA4E13212AD6D3"><enum>(d)</enum><header>Matching
				requirements</header><text>With respect to the costs of the activities to be
				carried out by an entity under a grant or cooperative agreement under this
				section, an entity shall provide assurances that the entity will make available
				(directly or through donations from public or private entities) non-Federal
				contributions towards such costs in an amount that is not less than $1 for each
				$1 of Federal funds provided under the grant or cooperative agreement.</text>
							</subsection></section><section id="IDd819ca54faad42e7bc9e052ecfbe374a"><enum>597B.</enum><header>Grants for
				mental health and primary care early intervention and prevention
				services</header>
							<subsection id="ID4cd3dc473d0d4fd6ba1e1430b7d16036"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall award 5-year matching grants to, or
				enter into cooperative agreements with, States, political subdivisions of
				States, consortium of political subdivisions, tribal organizations, public
				organizations, or private nonprofit organizations to enable such entities to
				provide assistance to primary care programs for children and adolescents with,
				or who are at-risk of, mental health disorders who are in mental health
				settings.</text>
							</subsection><subsection id="ID933f4257b3d84368823e3295d17cfa1d"><enum>(b)</enum><header>Application</header><text>To
				be eligible to receive a grant or cooperative agreement under subsection (a) an
				entity shall—</text>
								<paragraph id="ID25bdf3e9856045719fe33c027c1846c1"><enum>(1)</enum><text>be a State, a
				political subdivision of a State, a consortia of political subdivisions, a
				tribal organization, or a private nonprofit organization; and</text>
								</paragraph><paragraph id="ID25b42907a90f45e78585ad498e60aef2"><enum>(2)</enum><text>prepare and
				submit to the Secretary an application at such time, in such manner, and
				containing such information as the Secretary may require.</text>
								</paragraph></subsection><subsection id="ID04cb1fb9e33542989a84c47bc22ca216"><enum>(c)</enum><header>Use of
				funds</header><text>An entity shall use amounts received under a grant or
				cooperative agreement under this section to—</text>
								<paragraph id="IDade94c96595e415287f9740d0126ca6e"><enum>(1)</enum><text>provide
				appropriate primary health care services, including screening, routine
				treatment, monitoring, and referral for specialty treatment of medical or
				surgical conditions;</text>
								</paragraph><paragraph id="ID8718f167ca6e43d59a8dfe834927fa61"><enum>(2)</enum><text>provide
				appropriate monitoring of medical conditions of children and adolescents
				receiving mental health services from the applicant and refer them, as needed,
				for specialty treatment of medical or surgical conditions; and</text>
								</paragraph><paragraph id="IDf35f4c9dad6b4671809576d5d28693e9"><enum>(3)</enum><text>facilitate
				networking between primary care professionals, mental health professionals and
				child care professionals for—</text>
									<subparagraph id="IDaaeeabd8404a408eb76967029d67d1b4"><enum>(A)</enum><text>case management
				development; and</text>
									</subparagraph><subparagraph id="IDc92631ad36c04710b7537a3a6d36ab3f"><enum>(B)</enum><text>professional
				mentoring.</text>
									</subparagraph></paragraph></subsection><subsection id="IDf3b0da513eec4739ab3137bba04b76e9"><enum>(d)</enum><header>Matching
				funds</header><text>With respect to the costs of the activities to be carried
				out by an entity under a grant or cooperative agreement under this section, an
				entity shall provide assurances that the entity will make available (directly
				or through donations from public or private entities) non-Federal contributions
				towards such costs in an amount that is not less than $1 for each $1 of Federal
				funds provided under the grant or cooperative agreement.</text>
							</subsection></section><section id="idF2A88F07FD4A423DBA54A5809C800132"><enum>597C.</enum><header>Authorization
				of appropriations</header><text display-inline="no-display-inline">There is
				authorized to be appropriated to carry out this part $22,500,000 for fiscal
				year 2007, and such sums as may be necessary for each of fiscal years 2008
				through
				2011.</text>
						</section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idA60B7AA3B10B44FC9EB53C024271AF31"><enum>103.</enum><header>Activities
			 concerning mental health services in schools</header>
				<subsection id="id2C5BDAAB50E94BB4978CE34938221D91"><enum>(a)</enum><header>Efforts of
			 secretary to improve the mental health of students</header><text>The Secretary
			 of Education, in collaboration with the Secretary of Health and Human Services,
			 shall—</text>
					<paragraph id="idFB69355B2CF04FE4BC12CB775745CFCB"><enum>(1)</enum><text>encourage
			 elementary and secondary schools and educational institutions to address mental
			 health issues facing children and adolescents by—</text>
						<subparagraph id="id3BB8083E3CD849EEB4BE9CBBD71D1A11"><enum>(A)</enum><text>identifying
			 children and adolescents with, or who are at-risk for, mental health
			 disorders;</text>
						</subparagraph><subparagraph id="ID583636da423f4463b2981d32c976ed80"><enum>(B)</enum><text>providing or
			 linking children and adolescents to appropriate mental health services and
			 supports; and</text>
						</subparagraph><subparagraph id="ID478dd2d7a5f7444b94cd1df4dc45fd86"><enum>(C)</enum><text>assisting
			 families, including providing families with resources on mental health services
			 for children and adolescents and a link to relevant local and national advocacy
			 and support organizations;</text>
						</subparagraph></paragraph><paragraph id="IDfe5284b2bc234bc5af9e462e05d62c83"><enum>(2)</enum><text>collaborate on
			 expanding and fostering a mental health promotion and early intervention
			 strategy with respect to children and adolescents that focuses on emotional
			 well being and resiliency and fosters academic achievement;</text>
					</paragraph><paragraph id="ID8629ce675ca841b6b1db693e42aa1e7b"><enum>(3)</enum><text>encourage
			 elementary and secondary schools and educational institutions to use positive
			 behavioral support procedures and functional behavioral assessments on a
			 school-wide basis as an alternative to suspending or expelling children and
			 adolescents with or who are at risk for mental health needs; and</text>
					</paragraph><paragraph id="ID8ad593ebc05e43e4b7aeb415dfa81b81"><enum>(4)</enum><text>provide technical
			 assistance to elementary and secondary schools and educational institutions to
			 implement the provisions of paragraphs (1) through (3).</text>
					</paragraph></subsection><subsection id="IDedc2c40808a8444083e86b47c9e8eedb"><enum>(b)</enum><header>Grants</header>
					<paragraph id="id593828C04EAE476DA389C1A0020C8023"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Education, in collaboration with the
			 Secretary of Health and Human Services, shall award grants to, or enter into
			 cooperative agreements with, States, political subdivisions of States,
			 consortium of political subdivisions, tribal organizations, public
			 organizations, private nonprofit organizations, elementary and secondary
			 schools, and other educational institutions to provide directly or provide
			 access to mental health services and case management of services in elementary
			 and secondary schools and other educational settings.</text>
					</paragraph><paragraph id="id9739E21A6BFF4BABA465CE4DEFAB14A7"><enum>(2)</enum><header>Application</header><text>To
			 be eligible to receive a grant or cooperative agreement under paragraph (1) an
			 entity shall—</text>
						<subparagraph id="idB867B7154D36488CBDF6EA008DD1EFE8"><enum>(A)</enum><text>be a State, a
			 political subdivision of a State, a consortia of political subdivisions, a
			 tribal organization, a public organization, a private nonprofit organization,
			 an elementary or secondary school, or an educational institution; and</text>
						</subparagraph><subparagraph id="idF6E6026761734596BE99036C08F006C6"><enum>(B)</enum><text>prepare and
			 submit to the Secretary an application at such time, in such manner, and
			 containing such information as the Secretary may require, including an
			 assurance that the entity will—</text>
							<clause id="id8F0078B991C844F0AD4756DFC7AE1761"><enum>(i)</enum><text>provide directly
			 or provide access to early intervention and prevention services in settings
			 with an above average rate of children and adolescents with mental health
			 disorders;</text>
							</clause><clause id="id8832B743AB92451D9135C6A27FC73C47"><enum>(ii)</enum><text>provide directly
			 or provide access to early intervention and prevention services in settings
			 with an above average rate of children and adolescents with co-occurring mental
			 health and substance abuse disorders; and</text>
							</clause><clause id="idC7ED6393975042AD8986C734ECB15300"><enum>(iii)</enum><text>demonstrate a
			 broad collaboration of parents, primary care professionals, school and mental
			 health professionals, child care processionals including those in educational
			 settings, legal guardians, and all relevant local agencies and organizations in
			 the application for, and administration of, the grant or cooperative
			 agreement.</text>
							</clause></subparagraph></paragraph><paragraph id="id5F34E36C48094C38A2583B2220D9133E"><enum>(3)</enum><header>Use of
			 funds</header><text>An entity shall use amounts received under a grant or
			 cooperative agreement under this subsection to provide—</text>
						<subparagraph id="idBFF74F8F6EAC49DAA8F58102E89ECE30"><enum>(A)</enum><text>mental health
			 identification services;</text>
						</subparagraph><subparagraph id="ID8ac5b305f164452d8b2c718d860da98b"><enum>(B)</enum><text>early
			 intervention and prevention services to children and adolescents with or who
			 are at-risk of mental health disorders; and</text>
						</subparagraph><subparagraph id="IDd472800b815a4dc4b4987ede89d3bd7d"><enum>(C)</enum><text>mental
			 health-related training to primary care professionals, school and mental health
			 professionals, and child care professionals, including those in educational
			 settings.</text>
						</subparagraph></paragraph></subsection><subsection id="IDa547b6528dfc408ebf24a5003ecb68a4"><enum>(c)</enum><header>Counseling and
			 behavioral support guidelines</header><text>The Secretary of Education, in
			 collaboration with the Secretary of Health and Human Services, shall develop
			 and issue guidelines to elementary and secondary schools and educational
			 institutions that encourage such schools and institutions to provide counseling
			 and positive behavioral supports, including referrals for needed early
			 intervention and prevention services, treatment, and rehabilitation to children
			 and adolescents who are disruptive or who use drugs and show signs or symptoms
			 of mental health disorders. Such schools and institutions shall be encouraged
			 to provide such services to children and adolescents in lieu of suspension,
			 expulsion, or transfer to a juvenile justice system without any support
			 referral services or system of care.</text>
				</subsection><subsection id="ID1d3ac6a7cd3e4bbd8b44ba04e3f4ad80"><enum>(d)</enum><header>Study</header>
					<paragraph id="idAC42B0D81B6B47E29256AEF4F7998A0E"><enum>(1)</enum><header>In
			 general</header><text>The Government Accountability Office shall conduct a
			 study to assess the scientific validity of the Federal definition of a child or
			 adolescent with an <quote>emotional disturbance</quote> as provided for in the
			 regulations of the Department of Education under the Individuals with
			 Disabilities Education Act (20 U.S.C. 1400 et seq.), and whether, as written,
			 such definition now excludes children and adolescents inappropriately through a
			 determination that those children and adolescents are <quote>socially
			 maladjusted</quote>.</text>
					</paragraph><paragraph id="idECA46EF6C75F44E6AD525A776FA8211E"><enum>(2)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Government
			 Accountability Office shall submit to the appropriated committees of Congress a
			 report concerning the results of the study conducted under paragraph
			 (1).</text>
					</paragraph></subsection><subsection id="id1D228BCF5C094A0D92C114829C61CB84"><enum>(e)</enum><header>Rule of
			 construction</header><text>Nothing in this section shall be construed—</text>
					<paragraph id="idFDB3E99011724BCAB6D675DA2C284C2A"><enum>(1)</enum><text>to supercede the
			 provisions of section 444 of the General Education Provisions Act (20 U.S.C.
			 1232g), including the requirement of prior parental consent for the disclosure
			 of any education records; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id78A0A253E86342D388A249E4622A99E0"><enum>(2)</enum><text>to modify or
			 affect the parental notification requirements for programs authorized under the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 6301 et seq.).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDEA610AB43364481B79DEB787A8FA37C"><enum>(f)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $22,500,000 for fiscal year 2007, and such sums as may be
			 necessary for each of fiscal years 2008 through 2011.</text>
				</subsection></section><section id="id0721931C610B4D368174CA9F37AF0DED"><enum>104.</enum><header>Activities
			 concerning mental health services under the early and periodic screening,
			 diagnostic, and treatment services program</header>
				<subsection id="id1D57C883560540D6B51602F8F6857899"><enum>(a)</enum><header>Notification</header><text>The
			 Secretary of Health and Human Services, acting through the Director of the
			 Centers for Medicare and Medicaid Services, shall notify State Medicaid
			 agencies of—</text>
					<paragraph id="ID36d2cb1b792b45d88d990726b9069386"><enum>(1)</enum><text>obligations under
			 section 1905(r) of the Social Security Act with respect to the identification
			 of children and adolescents with mental health disorders and of the
			 availability of validated mechanisms that aid pediatricians and other primary
			 care professionals to incorporate such activities; and</text>
					</paragraph><paragraph id="IDa36a45b03c0b49f18cb509fe5f1f5c72"><enum>(2)</enum><text>information on
			 financing mechanisms that such agencies may use to reimburse primary care
			 professionals, mental health professionals, and child care professionals who
			 provide mental health services as authorized under such definition of early and
			 period screening, diagnostic, and treatment services.</text>
					</paragraph></subsection><subsection id="ID066620d8207d4532888ac8d36e364819"><enum>(b)</enum><header>Requirements</header><text>State
			 Medicaid agencies who receive funds for early and period screening, diagnostic,
			 and treatment services funding shall provide an annual report to the Secretary
			 of Health and Human Services that—</text>
					<paragraph id="IDe0db5ef97cb347eebb417b8029ed4e3b"><enum>(1)</enum><text>analyzes the
			 rates of eligible children and adolescents who receive mental health
			 identification services of the type described in subsection (a)(1) under the
			 medicaid program in the State;</text>
					</paragraph><paragraph id="IDf03546fc18a6452eb2b3a0a69516feec"><enum>(2)</enum><text>analyzes the ways
			 in which such agency has used financing mechanisms to reimburse primary care
			 professionals, mental health professionals, and child care professionals who
			 provide such mental health services;</text>
					</paragraph><paragraph id="IDe2b85860bad340ceb96c4112f97fc260"><enum>(3)</enum><text>identifies State
			 program rules and funding policies that may impede such agency from meeting
			 fully the Federal requirements with respect to such services under the medicaid
			 program; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf17086e474be43ce9651e9614c79d4a9"><enum>(4)</enum><text>makes
			 recommendations on how to overcome the impediments identified under paragraph
			 (3).</text>
					</paragraph></subsection></section><section id="idA603CC8BFFBE442B8317C9A3D77EDF6B"><enum>105.</enum><header>Activities
			 concerning mental health services for at-risk mothers and their
			 children</header><text display-inline="no-display-inline">Title V of the Social
			 Security Act (42 U.S.C. 701 et seq.) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id0FDC1190421E43628CEE2CC0F71AFEB8" style="OLC">
					<section id="idC9F66430E531456A90FDB0638559FCEA"><enum>511.</enum><header>Enhancing
				mental health services for at-risk mothers and their children</header>
						<subsection id="idC8C4B41F3A6E485297563B6D97A0086C"><enum>(a)</enum><header>Grants</header><text>The
				Secretary shall award grants to, or enter into cooperative agreements with,
				States, political subdivisions of States, consortium of political subdivisions,
				tribal organizations, public organizations, and private nonprofit organizations
				to provide appropriate mental health promotion and mental health services to
				at-risk mothers, grandmothers who are legal guardians, and their
				children.</text>
						</subsection><subsection id="idFA52ACEC7DF4481B8493D0F4691FA7D7"><enum>(b)</enum><header>Application</header><text>To
				be eligible to receive a grant or cooperative agreement under subsection (a) an
				entity shall—</text>
							<paragraph id="id5AAE5D39A2864301A6273C08F0756167"><enum>(1)</enum><text>be a State, a
				political subdivision of a State, a consortia of political subdivisions, a
				tribal organization, a public organization, or a private nonprofit
				organization; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4B68444825CE476DAC977E1151389617"><enum>(2)</enum><text>prepare and
				submit to the Secretary an application at such time, in such manner, and
				containing such information as the Secretary may require.</text>
							</paragraph></subsection><subsection id="id97C20B00B8FE4A468C61E31D25C75568"><enum>(c)</enum><header>Use of
				funds</header><text>Amounts received under a grant or cooperative agreement
				under this section shall be used to—</text>
							<paragraph id="id283BA213EF66442E9FBB406B5BBDF79C"><enum>(1)</enum><text>provide mental
				health early intervention, prevention, and case management services;</text>
							</paragraph><paragraph id="IDd657d90345ba4c6db5923bc3443d5d6d"><enum>(2)</enum><text>provide mental
				health treatment services; and</text>
							</paragraph><paragraph id="ID65965360e2c947ce9d2b49d6fd9f9386"><enum>(3)</enum><text>provide
				monitoring and referral for specialty treatment of medical or surgical
				conditions.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC7AB23CD0BDD456994E7BEE2B54931AD"><enum>(d)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this section, $20,000,000 for fiscal year 2007, and such sums as may be
				necessary for each of fiscal years 2008 through
				2011.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id4E57A53035FA4E38954BC643DCD0F553"><enum>106.</enum><header>Activities
			 concerning interagency case management</header><text display-inline="no-display-inline">Part L of title V of the Public Health
			 Service Act, as added by section 102, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idF108A5F466F745CABECBE826BDF10A42" style="OLC">
					<section id="idD131461AD0A4436EA721DB7D27BCF9B1"><enum>597C.</enum><header>Interagency
				case management</header>
						<subsection id="idE26F6055B3E94C3B83A5F35261BFA662"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				establish a program to foster the ability of local case managers to work across
				the mental health, substance abuse, child welfare, education, and juvenile
				justice systems in a State. As part of such program, the Secretary shall
				develop a model system that—</text>
							<paragraph id="idFCB717055D754C128D9BBD6078D1E28A"><enum>(1)</enum><text>establishes a
				training curriculum for primary care professionals, mental health
				professionals, school and child care professionals, and social workers who work
				as case managers;</text>

			 V of the Public Health Service Act, as added by section 102 and amended by
			 section 106, is further amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idB16E2287CA594B4BBDBFC8E5826638A1" style="OLC">
						<section id="idF0237F2CFF9D4F35A53EB1C6F93F44EF"><enum>597D.</enum><header>Consumer and
				family control in child and adolescent mental health service decisions</header>
							<subsection id="id57C837AD1FA945EFA68B18024C84C755"><enum>(a)</enum><header>Grants</header><text>The
				Secretary shall award grants to, or enter into cooperative agreements with,
				States, political subdivisions of States, consortium of political subdivisions,
				and tribal organizations for the development of policies and mechanisms that
				enable consumers and families to have increased control and choice over child
				and adolescent mental health services received through a publicly-funded mental
				health system.</text>
							</subsection><subsection id="id46193756665F49909E1C57EDA9A15458"><enum>(b)</enum><header>Application</header><text>To
				be eligible to receive a grant or cooperative agreement under subsection (a) an
				entity shall—</text>
								<paragraph id="idC01A51A0886D48459558BD8F6315893D"><enum>(1)</enum><text>be a State, a
				political subdivision of a State, a consortia of political subdivisions, or a
				tribal organization; and</text>
								</paragraph><paragraph id="id10DCC44789D948EB9F1164D466A86A1E"><enum>(2)</enum><text>prepare and
				submit to the Secretary an application at such time, in such manner, and
				containing such information as the Secretary may require.</text>
								</paragraph></subsection><subsection id="idD4387EAAB5C04A11BB052AE03F6FCD78"><enum>(c)</enum><header>Use of
				funds</header><text>An entity shall use amounts received under a grant or
				cooperative agreement under this section to carry out the activities described
				in subsection (a). Such activities may include—</text>
								<paragraph id="ID1d4072ca6db7489dac29bf8c4ff394aa"><enum>(1)</enum><text>the facilitation
				of mental health service planning meetings by consumer and family advocates,
				particularly peer advocates;</text>
								</paragraph><paragraph id="IDaff9a3b88c2f443f9a2feb1d3fecde44"><enum>(2)</enum><text>the development
				of consumer and family cooperatives; and</text>
								</paragraph><paragraph id="ID546d0671bd844ae5bf5241896ab4eeb9"><enum>(3)</enum><text>the facilitation
				of national networking between State political subdivisions and tribal
				organizations engaged in promoting increased consumer and family participation
				in decisions regarding mental health services for children and
				adolescents.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id880D5BA431224EF388AC7807F7EF196E"><enum>(d)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this section, $10,000,000 for fiscal year 2007, and such sums as may be
				necessary for each of fiscal years 2008 through

			 concerning information on child and adolescent mental health
			 services</header><text display-inline="no-display-inline">Part K of title V of
			 the Public Health Service Act, as added by section 102 and amended by section
			 107, is further amended by adding at the end the following:</text>

				Secretary shall award grants to, or enter into cooperative agreements with,
				private nonprofit organizations to enable such organizations to provide
				information on child and adolescent mental health and services, consumer or
				parent-to-parent support services, respite care, and other relevant support
				services to—</text>
							<paragraph id="idEFEF2A1FD47247D4BB1F7035AECE7547"><enum>(1)</enum><text>parents and legal
				guardians of children or adolescents with or who are at risk for mental health
				disorders; and</text>
							</paragraph><paragraph id="ID9867dff964034358b6d7069a05eda826"><enum>(2)</enum><text>families of
				adolescents with or who are at risk for mental health disorders.</text>
							</paragraph></subsection><subsection id="id647130E616864049B92FF224490BB79B"><enum>(b)</enum><header>Application</header><text>To
				be eligible to receive a grant or cooperative agreement under subsection (a) an
				entity shall—</text>

				nonprofit organization; and</text>

				campaign</header><text>The Secretary shall develop, coordinate, and implement
				an educational campaign to increase public understanding of mental health
				promotion, child and adolescent emotional well-being and resiliency, and risk
				factors associated with mental health disorders in children and
				adolescents.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id03E667FA41604F0EB75D5D3584FCCBDB"><enum>(b)</enum><header>Grants</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id00CD1FA90C474951A6C125F83F8117A7"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall award grants to, or enter into
				cooperative agreements with, public and private nonprofit organizations with
				qualified experience in public education to build community coalitions and
				increase public awareness of mental health promotion, child and adolescent
				emotional well-being and resiliency, and risk factors associated with mental
				health disorders in children and adolescents.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id985F6994C0DB4EBB9AF1992D3DF7E3BC"><enum>(2)</enum><header>Application</header><text>To
				be eligible to receive a grant or cooperative agreement under paragraph (1), an
				entity shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id7F5BA181496447EA8AF6B228016CF175"><enum>(A)</enum><text>be a public or
				private nonprofit organization; and</text>
								</subparagraph><subparagraph id="idE45AE5F2ABCF4425BF55037F332BDAFB"><enum>(B)</enum><text>prepare and
				submit to the Secretary an application at such time, in such manner, and
				containing such information as the Secretary may require.</text>
								</subparagraph></paragraph><paragraph id="id04422AA7515E441BBE584F1DFDE3B883"><enum>(3)</enum><header>Use of
				funds</header><text>Amounts received under a grant or contract under this
				subsection shall be used to—</text>
								<subparagraph id="ID5dcb69feb3c34e868a10b4c9ea0b0cdf"><enum>(A)</enum><text>develop community
				coalitions to support the purposes of paragraph (1); and</text>

			 assistance center concerning training and seclusion and
			 restraints</header><text display-inline="no-display-inline">Part K of title V
			 of the Public Health Service Act, as added by section 102 and amended by
			 section 109, is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB7A66EC3448A46ECAC44BCCF4CEF0595" style="OLC">
					<section id="id5DD011F7565846CB9881AEAEC5E29A04"><enum>597G.</enum><header>Technical
				assistance center concerning seclusion and restraints</header>
						<subsection id="id94DDE830DED24E52BEB3510CD9D68A5C"><enum>(a)</enum><header>Seclusion and
				restraints</header><text>Acting through the technical assistance center
				established under subsection (b), the Secretary shall—</text>
							<paragraph id="idB25CA70E436449A6B02BD0B49F5ABBDA"><enum>(1)</enum><text>develop and
				disseminate educational materials that encourage ending the use of seclusion
				and restraints in all facilities or programs in which a child or adolescent
				resides or receives care or services;</text>
							</paragraph><paragraph id="ID3726a5e9104a49f489187b921764a172"><enum>(2)</enum><text>gather, analyze,
				and disseminate information on best or promising best practices that can
				minimize conflicts between parents, legal guardians, primary care
				professionals, mental health professionals, school and child care professionals
				to create a safe environment for children and adolescents with mental health
				disorders; and</text>
							</paragraph><paragraph id="ID97d7c46c0cfc44bd95f4abadb27c4cae"><enum>(3)</enum><text>provide training
				for primary professionals, mental health professionals, and school and child
				care professionals on effective techniques or practices that serve as
				alternatives to coercive control interventions, including techniques to reduce
				challenging, aggressive, and resistant behaviors, that require seclusion and
				restraints.</text>
							</paragraph></subsection><subsection id="idB74490FAA6544473B442E01EC7E2A0FF"><enum>(b)</enum><header>Consultation</header><text>In
				carrying out this section, the Secretary shall consult with—</text>
							<paragraph id="id337AEC2F2783488AAF991A9D635C9E59"><enum>(1)</enum><text>local and
				national advocacy organizations that serve children and adolescents who may
				require the use of seclusion and restraints, and their families;</text>
							</paragraph><paragraph id="id6B031C465F074E31B5057F8069598940"><enum>(2)</enum><text>relevant national
				medical and other health and education specialty organizations; and</text>
							</paragraph><paragraph id="id2422401DC8AB4B04BD692B7F053AB544"><enum>(3)</enum><text>qualified
				professionals who possess the specialized knowledge, skills, experience, and
				relevant attributes needed to serve children and adolescents who may require
				the use of seclusion and restraints, and their families.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id19D930BE565942F7A6E00AFB77C7E19C"><enum>(c)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this section, $5,000,000 for fiscal year 2007, and such sums as may be
				necessary for each of fiscal years 2008 through
				2011.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id5A6A57CE8DB247EAAB015793C1528BF7"><enum>111.</enum><header>Technical
			 assistance centers concerning consumer and family participation</header><text display-inline="no-display-inline">Part K of title V of the Public Health
			 Service Act, as added by section 102 and amended by section 110, is further
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id65285830EC6D4E0AB34D30C20141C23B" style="OLC">
					<section id="id0D9EA092C51B4E85B1CA63DA21D57E02"><enum>597H.</enum><header>Technical
				assistance centers concerning consumer and family participation</header>
						<subsection id="id685215CF24AD4AFFB0E2686F1177DFD7"><enum>(a)</enum><header>Grants</header><text>The
				Secretary shall award 5-year grants to, or enter into cooperative agreements
				with, private nonprofit organizations for the development and implementation of
				three technical assistance centers to support full consumer and family
				participation in decision-making about mental health services for children and
				adolescents.</text>
						</subsection><subsection id="idBED5FF68E02A4D9BB26C2EA8487E7BE7"><enum>(b)</enum><header>Application</header><text>To
				be eligible to receive a grant or cooperative agreement under subsection (a) an
				entity shall—</text>
							<paragraph id="id4D2765ED82AF4E9998D2806FBA2F0353"><enum>(1)</enum><text>be a private,
				nonprofit organization that demonstrates the ability to establish and maintain
				a technical assistance center described in this section; and</text>
							</paragraph><paragraph id="id9217C438FB57438FB66969F2D7F1D1D0"><enum>(2)</enum><text>prepare and
				submit to the Secretary an application at such time, in such manner, and
				containing such information as the Secretary may require.</text>
							</paragraph></subsection><subsection id="id502E991E58EE493D9DB23AD6DC74F682"><enum>(c)</enum><header>Use of
				funds</header><text>An entity shall use amounts received under a grant or
				cooperative agreement under this section to establish a technical assistance
				center of the type referred to in subsection (a). Through such center, the
				entity shall—</text>
							<paragraph id="id71F2273451C149E68D12ADF1BEDB24CA"><enum>(1)</enum><text>collect and
				disseminate information on mental health disorders and risk factors for mental
				health disorders in children and adolescents;</text>
							</paragraph><paragraph id="id704AB6138FC44982996FB9A5D5A714E8"><enum>(2)</enum><text>collect and
				disseminate information on available resources for specific mental health
				disorders, including co-occurring mental health and substance abuse
				disorders;</text>
							</paragraph><paragraph id="IDe28c1b2eea4d48489f081920d328eace"><enum>(3)</enum><text>disseminate
				information to help consumers and families engage in illness self management
				activities and access services and resources on mental health disorder
				self-management;</text>
							</paragraph><paragraph id="ID8d3ae19b2b854efdad998d4532694a6b"><enum>(4)</enum><text>support the
				activities of self-help organizations;</text>
							</paragraph><paragraph id="IDb690bc9b15244889be762a12ba7370e3"><enum>(5)</enum><text>support the
				training of peer specialists, family specialists, primary care professionals,
				mental health professionals, and child care professionals;</text>
							</paragraph><paragraph id="ID3a398fd6788349e1a59d573228be1c8d"><enum>(6)</enum><text>provide
				assistance to consumer and family-delivered service programs and resources in
				meeting their operational and programmatic needs; and</text>
							</paragraph><paragraph id="ID7e4ee4d991f749c39f427a5ce3802fc1"><enum>(7)</enum><text>provide
				assistance to consumers and families that participate in mental health system
				advisory bodies, including state mental health planning councils.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE643F72EEF58498391C62A5CF511FBC4"><enum>(d)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this section, $5,000,000 for fiscal year 2007, and such sums as may be
				necessary for each of fiscal years 2008 through
				2011.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idB11B1A8C70D144939C2F136F73023FE0"><enum>112.</enum><header>Comprehensive
			 community mental health services for children and adolescents with serious
			 emotional disturbances</header><text display-inline="no-display-inline">Section
			 561 of the Public Health Service Act (42 U.S.C. 290ff) is amended—</text>
				<paragraph id="idF27DFA5328E64FE8AE80AC0B3548586C"><enum>(1)</enum><text>in subsection
			 (b)(1)(A), by inserting before the semicolon the following: <quote>and provides
			 assurances that the State will use grant funds in accordance with the
			 comprehensive State mental health plan submitted under section 520B</quote>;
			 and</text>
				</paragraph><paragraph id="id6FA1B44B9FA448759D50F2B8CB09CD6F"><enum>(2)</enum><text>in subsection
			 (b), by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id12A499EC432F4A37A31BFA0C65C996FC" style="OLC">
						<paragraph id="id1D4C568081CC4771B9C842C8961A9F55"><enum>(4)</enum><header>Review of
				possible impediments</header><text>A State may use amounts received under a
				grant under this section to conduct an interagency review of State mental
				health program rules and funding policies that may impede the development of
				the comprehensive State mental health plan submitted under section
				520B.</text>
						</paragraph><after-quoted-block>. </after-quoted-block></quoted-block>
				</paragraph></section><section id="idB138D0D032D644A28F1B383076B8A173"><enum>113.</enum><header>Community
			 mental health services performance partnership block grant</header><text display-inline="no-display-inline">Section 1912(b) of the Public Health Service
			 Act (42 U.S.C. 300x–2(b)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id8FEAE00ADBEE41B9A21FECB6E9608F2E" style="OLC">
					<paragraph id="ID769c5cf4c2f24f9c8b17ab79dc11eb7a"><enum>(6)</enum><header>Performance
				measures</header><text>The plan requires that performance measures be reported
				for adults and children separately.</text>
					</paragraph><paragraph id="idB51C0C798A154F5FAE3633BF6FB0ABD6"><enum>(7)</enum><header>Other mental
				health services</header><text>In addition to reporting on mental health
				services funded under a community mental health services performance
				partnership block grant, States are encouraged to report on all mental health
				services provided by the State mental health
				agency.</text>

			</section><section id="id61B320840243463F976E9C91BB39634F"><enum>114.</enum><header>Community
			 mental health services block grant program</header>
				<subsection id="id10111F44D8F544658551E894C83597E2"><enum>(a)</enum><header>In
			 general</header><text>Section 1912(b) of the Public Health Service Act (42
			 U.S.C. 300x–2(b)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id980D1B41014F4D2CA2EE4D9E122E4C5B" style="OLC">
						<paragraph id="id3ABB7A4545FB4E6EA9351EB92E863E1F"><enum>(8)</enum><header>Co-occurring
				treatment services</header><text>The plan provides for a system of support for
				the provision of co-occurring treatment services, including early intervention
				and prevention, and integrated mental health and substance abuse and services,
				for adolescents with co-occurring mental health and substance abuse disorders.
				Services shall be provided through the system under this paragraph in
				accordance with the Substance Abuse Prevention Treatment Block Grant program
				under subpart
				II.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="idF148F4439F8B4321846EA9E018F915DF"><enum>(b)</enum><header>Guidelines for
			 integrated treatment services</header><text>Section 1915 of the Public Health
			 Service Act (42 U.S.C. 300x–4) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id25784F77078F4EB7BD81E780D2B57FD3" style="OLC">
						<subsection id="id68A800B97B254F15A79A6B55D66B70F0"><enum>(c)</enum><header>Guidelines for
				integrated treatment services</header><text>The Secretary shall issue written
				policy guidelines for use by States that describe how amounts received under a
				grant under this subpart may be used to fund integrated treatment services for
				children and adolescents with mental health disorders and with co-occurring
				mental health and substance abuse disorders.</text>
						</subsection><subsection id="idDD752446CB7C43E58CA1EBD952FB31AF"><enum>(d)</enum><header>Model service
				systems forum</header><text>The Secretary, in consultation with the Attorney
				General, shall periodically convene forums to develop model service systems and
				promote awareness of the needs of children and adolescents with co-occurring
				mental health disorders and to facilitate the development of policies to meet
				those
				needs.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id6F3702974E43470993F1C12C2730234C"><enum>(c)</enum><header>Substance abuse
			 grants</header><text>Section 1928 of the Public Health Service Act (42 U.S.C.
			 300x–28) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id4F83AF73EC374D70801BBEE2E73F4552" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="idD2F661C244C34935B679DB6F743BF784"><enum>(e)</enum><header>Co-occurring
				treatment services</header><text display-inline="yes-display-inline">A State
				may use amounts received under a grant under this subpart to provide a system
				of support for the provision of co-occurring treatment services, including
				early intervention and prevention, and integrated mental health and substance
				abuse services, for children and adolescents with co-occurring mental health
				and substance abuse disorders. Services shall be provided through the system
				under this paragraph in accordance with the Community Mental Health Services
				Block Grant program under subpart I.</text>
						</subsection><subsection id="ID7d5c077d3a7b470fb48bd3347a851462"><enum>(f)</enum><header>Guidelines for
				integrated treatment services</header><text>The Secretary shall issue written
				policy guidelines, for use by States, that describe how amounts received under
				a grant under this section may be used to fund integrated treatment for
				children and adolescents with co-occurring substance abuse and mental health
				disorders.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="id55A38668A342456581602CF2245ABEC2"><enum>115.</enum><header>Grants for
			 jail diversion programs</header>
				<subsection id="id75EAA6777B3C4DE6AEA88F315379F83F"><enum></enum><text>Section 520G of
			 the Public Health Service Act (42 U.S.C. 290bb–38)—</text>

				appropriate community-based mental health and co-occurring mental illness and
				substance abuse services to children and adolescents determined to be at risk
				of contact with the law; and</text>
								</paragraph><paragraph id="idA4950045B44244DAA6D102174F143E4B"><enum>(6)</enum><text>provide for the
				inclusion of emergency mental health centers as part of jail diversion
				programs.</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="idF8E798AE2B934A5694717EEB25A0398C"><enum>(3)</enum><text>in subsection
			 (h), by adding at the end the following: <quote>As part of such evaluations,
			 the grantee shall evaluate the effectiveness of activities carried out under
			 the grant and submit reports on such evaluations to the
			 Secretary.</quote>.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id8AE87451BBB3491195ED0A7C5737E64D"><enum>116.</enum><header>Activities
			 concerning mental health services for juvenile justice populations</header>
				<subsection commented="no" display-inline="no-display-inline" id="id0882D737B85B49D5B6C27AF304444C5A"><enum>(a)</enum><header>Grants</header><text>The
			 Secretary shall award grants to, or enter into cooperative agreements with,
			 States, tribal organizations, political subdivisions of States, consortia of
			 political subdivisions, public organizations, and private nonprofit
			 organizations to provide mental health promotions and mental health services to
			 children and adolescents in juvenile justice systems.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id9F5D0C9EA4D94CB8A64C872E7CCD9119"><enum>(b)</enum><header>Application</header><text>To
			 be eligible to receive a grant or cooperative agreement under subsection (a),
			 an entity shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id9AFF45F175394D69B76FF17812DBFE3D"><enum>(1)</enum><text>be a State, a
			 tribal organization, a political subdivision of a State, a consortia of
			 political subdivisions, a public organization, or a private nonprofit
			 organization; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDAB296759B954873B81E3597F2AA92E8"><enum>(2)</enum><text>prepare and
			 submit to the Secretary an application at such time, in such manner, and
			 containing such information as the Secretary may require.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEBDA25EC08394715A08B1D20B1754DB7"><enum>(c)</enum><header>Use of
			 funds</header><text>Amounts received under a grant or cooperative agreement
			 under this section shall be used to—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idD6EA1895A01446E58FAEDA04ACDAA42D"><enum>(1)</enum><text>provide mental
			 health early intervention, prevention, and case management services;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id515A6DB26E8B44FC9BB5D24E9DFABCB0"><enum>(2)</enum><text>provide mental
			 health treatment services; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE00FC5E934D544C8B4BFF7631C54CE68"><enum>(3)</enum><text>provide
			 monitoring and referral for specialty treatment of medical or surgical
			 conditions.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA32943AE7D154FCD9FCA19E452145207"><enum>(d)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out this section, $10,000,000 for fiscal year 2007, and such sums as may be
			 necessary for each of fiscal years 2008 through 2011.</text>
				</subsection></section></title><title id="idD2B8CCF156414EEFB353A62716B7A2CA"><enum>II</enum><header>Federal
			 interagency collaboration and related activities</header>
			<section id="idA81FAB7F189F4236B3C91DBCCAC2564B"><enum>201.</enum><header>Interagency
			 coordinating committee concerning the mental health of children and
			 adolescents</header>
				<subsection id="IDdfacdd730f8e4fbe932c0d470cedd819"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services (in this
			 section referred to as the <quote>Secretary</quote>), in collaboration with the
			 Federal officials described in subsection (b), shall establish an interagency
			 coordinating committee (referred to in this section as the
			 <quote>Committee</quote>) to carry out the activities described in this section
			 relating to the mental health of children and adolescents.</text>
				</subsection><subsection id="ID33bc3c41ee0540a69b965731d815f903"><enum>(b)</enum><header>Federal
			 officials</header><text>The Federal officials described in this subsection are
			 the following:</text>
					<paragraph id="idD36B2F63964A4996BCC7FE9CA314527E"><enum>(1)</enum><text>The Secretary of
			 Education.</text>
					</paragraph><paragraph id="id4ACDAF828F6C42F19CCBD6D06DBE9002"><enum>(2)</enum><text>The Attorney
			 General.</text>
					</paragraph><paragraph id="id2BEBA711E24A4ED399564A40A7CB22E3"><enum>(3)</enum><text>The Surgeon
			 General.</text>
					</paragraph><paragraph id="id994181B72AE34CA0B821966BAE7D1879"><enum>(4)</enum><text>The Secretary of
			 the Department of Defense.</text>
					</paragraph><paragraph id="idF0B1A8C0317D46FFA696C1ED3D46D7BB"><enum>(5)</enum><text>The Secretary of
			 the Interior.</text>
					</paragraph><paragraph id="id2B45CCD8E77C40829D99010DA35B35B1"><enum>(6)</enum><text>The Commissioner
			 of Social Security.</text>
					</paragraph><paragraph id="idB4760909673C42AA9ECC793D1E0B5038"><enum>(7)</enum><text>Such other
			 Federal officials as the Secretary determines to be appropriate.</text>
					</paragraph></subsection><subsection id="IDb8362cf075394ceaa91ad2fdca94a01e"><enum>(c)</enum><header>Chairperson</header><text>The
			 Secretary shall serve as the chairperson of the Committee.</text>
				</subsection><subsection id="IDa9c767d1e85944abab8065a405450d6b"><enum>(d)</enum><header>Duties</header><text>The
			 Committee shall be responsible for policy development across the Federal
			 Government with respect to child and adolescent mental health.</text>
				</subsection><subsection id="ID97a9fa63a3ce4307896643ebb7954492"><enum>(e)</enum><header>Collaboration
			 and consultation</header><text>In carrying out the activities described in this
			 Act, and the amendments made by this Act, the Secretary shall collaborate with
			 the Committee (and the Committee shall collaborate with relevant Federal
			 agencies and mental health working groups responsible for child and adolescent
			 mental health).</text>
				</subsection><subsection id="ID300C9A54A5CD4AEC84FC3060B8F82954"><enum>(f)</enum><header>Consultation</header><text>In
			 carrying out the activities described in this Act, and the amendments made by
			 this Act, the Secretary and the Committee shall consult with—</text>
					<paragraph id="IDf5e5a3747314475fa33439bd0b55fd52"><enum>(1)</enum><text>State and local
			 agencies, including agencies responsible for child and adolescent mental health
			 care, early intervention and prevention services under titles V and XIX of the
			 Social Security Act, and the State Children's Health Insurance Program under
			 title XXI of the Social Security Act;</text>
					</paragraph><paragraph id="idC27C1EE41B284EE0BCDBD71A8F591135"><enum>(2)</enum><text>State mental
			 health planning councils (as described in section 1914);</text>
					</paragraph><paragraph id="id65C4E8E5607747C7A5349F8CF0BAEEA9"><enum>(3)</enum><text>local and
			 national organizations that serve children and adolescents with or who are at
			 risk for mental health disorders and their families;</text>
					</paragraph><paragraph id="id2C450DD22FBA49DB8263CEA9F74FDC26"><enum>(4)</enum><text>relevant national
			 medical and other health professional and education specialty
			 organizations;</text>
					</paragraph><paragraph id="id6F041ABD677B474B9CC0D7E30BA61B50"><enum>(5)</enum><text>children and
			 adolescents with mental health disorders and children and adolescents who are
			 currently receiving early intervention or prevention services;</text>
					</paragraph><paragraph id="idA9629008968F4E54951C355FF63EA663"><enum>(6)</enum><text>families and
			 friends of children and adolescents with mental health disorders and children
			 and adolescents who are currently receiving early intervention or prevention
			 services;</text>
					</paragraph><paragraph id="id09E6E2AC810D4890B8FC3F5ADC02A459"><enum>(7)</enum><text>families and
			 friends of children and adolescents who have attempted or completed
			 suicide;</text>
					</paragraph><paragraph id="id771DC7ADE515419AB5FD8D6E80DC6FC2"><enum>(8)</enum><text>qualified
			 professionals who possess the specialized knowledge, skills, experience,
			 training, or relevant attributes needed to serve children and adolescents with
			 or who are at risk for mental health disorders and their families; and</text>
					</paragraph><paragraph id="idE2F9DF06E0BB4DA5A6AE1A5D6E091EFC"><enum>(9)</enum><text>third-party
			 payers, managed care organizations, and related employer and commercial
			 industries.</text>
					</paragraph></subsection><subsection id="ID82191945D7E74EEA9E14525090414F27"><enum>(g)</enum><header>Policy
			 development</header><text>In carrying out the activities described in this Act,
			 and the amendments made by this Act, the Secretary shall—</text>
					<paragraph id="IDAD587E48111346DDBF81A60A2D3ACB53"><enum>(1)</enum><text>coordinate and
			 collaborate on policy development at the Federal level with the Committee,
			 relevant Department of Health and Human Services, Department of Education, and
			 Department of Justice agencies, and child and adolescent mental health working
			 groups; and</text>
					</paragraph><paragraph id="IDC3ACADCE52874AA3A94908B02B6291E5"><enum>(2)</enum><text>consult on policy
			 development at the Federal level with the private sector, including consumer,
			 medical, mental health advocacy groups, and other health and education
			 professional-based organizations, with respect to child and adolescent mental
			 health early intervention and prevention services.</text>
					</paragraph></subsection><subsection id="id2A846A34693044F4951970A7995FF2F8"><enum>(h)</enum><header>Reports</header>
					<paragraph id="idA96CED91C4704B10B94B5369A1D64E61"><enum>(1)</enum><header>Initial
			 report</header><text>Not later than 2 years after the date of enactment of this
			 Act, the Committee shall submit to the appropriate committees of Congress a
			 report that includes—</text>
						<subparagraph id="id76727F9CDCF74634B40E59FB9EC8FD3C"><enum>(A)</enum><text>the results of an
			 evaluation to be conducted by the Committee to analyze the effectiveness and
			 efficacy of current activities concerning the mental health of children and
			 adolescents;</text>
						</subparagraph><subparagraph id="id3FB5C39FC3084FAC8DDF3775949BD12F"><enum>(B)</enum><text>the results of an
			 evaluation to be conducted by the Committee to analyze the effectiveness and
			 efficacy of the activities carried out under grants, cooperative agreements,
			 collaborations, and consultations under this Act, the amendments made by this
			 Act, and carried out by existing Federal agencies;</text>
						</subparagraph><subparagraph id="ID80930aaad5084cdab5e084890704482a"><enum>(C)</enum><text>the results of an
			 evaluation to be conducted by the Committee to analyze identified problems and
			 challenges, including—</text>
							<clause id="idC5BD0C34B1A54C53813BED25C6E7C8B9"><enum>(i)</enum><text>fragmented mental
			 health service delivery systems for children and adolescents;</text>
							</clause><clause id="id38521AD860C942FCBC8804B81965F3ED"><enum>(ii)</enum><text>disparities
			 between Federal agencies in mental health service eligibility requirements for
			 children and adolescents;</text>
							</clause><clause id="id73FE58021A40419C94965BD2416BB045"><enum>(iii)</enum><text>disparities in
			 regulatory policies of Federal agencies concerning child and adolescent mental
			 health;</text>
							</clause><clause id="idC19D57535DBE41D7B9B848425DE874F2"><enum>(iv)</enum><text>inflexibility of
			 Federal finance systems to support evidence-based child and adolescent mental
			 health;</text>
							</clause><clause id="id86D8D0FC12844C55A7A2AB010BE937F2"><enum>(v)</enum><text>insufficient
			 training of primary care professionals, mental health professionals, and child
			 care professionals;</text>
							</clause><clause id="idBD4B15C7FD92419D8943E45B451DE86D"><enum>(vi)</enum><text>disparities and
			 fragmentation of collection and dissemination of information concerning child
			 and adolescent mental health services;</text>
							</clause><clause id="idF28BB6B48CE54AA5B4E590C82105FE54"><enum>(vii)</enum><text>inability of
			 State Medicaid agencies to meet Federal requirements concerning child and
			 adolescent mental health under the early and period screening, diagnostics and
			 treatment services requirements under the medicaid program under title XIX of
			 the Social Security Act; and</text>
							</clause><clause id="idDCEBA57ACC9E46ECB0CF1D89EEF0E16C"><enum>(viii)</enum><text>fractured
			 Federal interagency collaboration and consultation concerning child and
			 adolescent mental health;</text>
							</clause></subparagraph><subparagraph id="IDa96802e185424d1c95f4b4ed2924a408"><enum>(D)</enum><text>the
			 recommendations of the Secretary on models and methods with which to overcome
			 the problems and challenges described in subparagraph (B) for the purposes of
			 improving Federal interagency coordination and the development of Federal
			 mental health policy.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2CE6068A821944088F7A57FF9A8F4BEF"><enum>(2)</enum><header>Annual
			 report</header><text>Not later than 1 year after the date on which the initial
			 report is submitted under paragraph (1), an annually thereafter, the Committee
			 shall submit to the appropriate committees of Congress a report concerning the
			 results of updated evaluations and recommendations described in paragraph
			 (1).</text>
					</paragraph></subsection><subsection id="ID50e75ba78f3541d697d692c9f6dbdcc0"><enum>(i)</enum><header>Personnel
			 matters</header>
					<paragraph id="IDaee1879584e94fac8ad6e5431e3cd7de"><enum>(1)</enum><header>Staff and
			 compensation</header><text>Except as provided in paragraph (2), the Secretary
			 may employ, and fix the compensation of an executive director and other
			 personnel of the Committee without regard to the provisions of chapter 51 and
			 subchapter III of chapter 53 of title 5, United States Code, relating to
			 classification of positions and General Schedule pay rates.</text>
					</paragraph><paragraph id="ID2dbf543537eb4a0e82af7b7a7cb953da"><enum>(2)</enum><header>Maximum rate of
			 pay</header><text>The maximum rate of pay for the executive director and other
			 personnel employed under paragraph (1) shall not exceed the rate payable for
			 level IV of the Executive Schedule under section 5316 of title 5, United States
			 Code.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7B048D615F7E424FABDE5364B46E96A9"><enum>(j)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section, $10,000,000 for fiscal
			 year 2007, and such sums as may be necessary for each of fiscal years 2008
			 through 2011.</text>
				</subsection></section></title><title id="idDE6F9CA3065A42399386D8FE3D47D2B6"><enum>III</enum><header>Research
			 activities concerning the mental health of children and adolescents</header>
			<section id="id3DE28ADA4E094A85ABF4D0809A3274AF"><enum>301.</enum><header>Activities
			 concerning evidence-based or promising best practices</header><text display-inline="no-display-inline">Part K of title V of the Public Health
			 Service Act, as added by section 102 and amended by section 111, is further
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id75D12AF10FCA48D5BC7CD35EBCD13970" style="OLC">
					<section id="id7071AB0D3E834CA58365FC713EEB221A"><enum>597I.</enum><header>Activities
				concerning evidence-based or promising best practices</header>
						<subsection id="id22C4542BD80B42A49E826A66188CE802"><enum>(a)</enum><header>Grants</header>
							<paragraph id="idAE7241B58B8A4DC4844966924195C410"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall award grants to, and enter into
				cooperative agreements with, States, political subdivisions of States,
				consortia of political subdivisions, tribal organizations, institutions of
				higher education, or private nonprofit organizations for the development of
				child and adolescent mental health services and support systems that address
				widespread and critical gaps in a needed continuum of mental health
				service-delivery with a specific focus on encouraging the implementation of
				evidence-based or promising best practices.</text>
							</paragraph><paragraph id="id94387A7B3D334486A3FF353C1D4B7935"><enum>(2)</enum><header>Application</header><text>To
				be eligible to receive a grant or cooperative agreement under paragraph (1) an
				entity shall—</text>
								<subparagraph id="idABB0FA80011342AE8D36456A53853E16"><enum>(A)</enum><text>be a State, a
				political subdivision of a State, a consortia of political subdivisions, a
				tribal organization, an institution of higher education, or a private nonprofit
				organization; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB91CB6D3F8734B21A3A8DEF526B0A74B"><enum>(B)</enum><text>prepare and
				submit to the Secretary an application at such time, in such manner, and
				containing such information as the Secretary may require.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0333E9E9691449BFACADE8C8B6FFD6E1"><enum>(3)</enum><header>Use of
				funds</header><text>Amounts received under a grant or cooperative agreement
				under this subsection shall be used to provide for the development and
				dissemination of mental health supports and services described in paragraph
				(1), including—</text>
								<subparagraph id="id37422533F07C4219B73A67206E210927"><enum>(A)</enum><text>early
				intervention and prevention services, treatment and rehabilitation particularly
				for children and adolescents with co-occurring mental health and substance
				abuse disorders;</text>
								</subparagraph><subparagraph id="IDd182d335214e4f5d8a5d52c626f794c0"><enum>(B)</enum><text>referral
				services;</text>
								</subparagraph><subparagraph id="IDf074549e783e48b9b9595a071c290564"><enum>(C)</enum><text>integrated
				treatment services, including family therapy, particularly for children and
				adolescents with co-occurring mental health and substance abuse
				disorders;</text>
								</subparagraph><subparagraph id="id6C035D1137084752919227B31E94236D"><enum>(D)</enum><text>colocating
				primary care and mental health services in rural and urban areas;</text>
								</subparagraph><subparagraph id="ID2ef01633c4c34eedba3d49a4751dc844"><enum>(E)</enum><text>mentoring and
				other support services;</text>
								</subparagraph><subparagraph id="ID9626b33e277b4ab19946b36228a28eb4"><enum>(F)</enum><text>transition
				services;</text>
								</subparagraph><subparagraph id="ID90f9902d981543c09c3087d4f6a62d89"><enum>(G)</enum><text>respite care for
				parents, legal guardians, and families; and</text>
								</subparagraph><subparagraph id="id7D0862FBF4C04812A869E273476C7AF5"><enum>(H)</enum><text>home-based
				care.</text>
								</subparagraph></paragraph></subsection><subsection id="IDe41c19ae6889485bbd1a98deedb5ad8c"><enum>(b)</enum><header>Technical
				assistance center</header><text>The Secretary shall establish a technical
				assistance center to assist entities that receive a grant or cooperative
				agreement under subsection (a) in—</text>
							<paragraph id="id176DD69BF45A4DA3BA4D7E0B986155AF"><enum>(1)</enum><text>identifying
				widespread and critical gaps in a needed continuum of child and adolescent
				mental health service-delivery;</text>
							</paragraph><paragraph id="IDd970d5c42eaa40e290c348368d3fa7e0"><enum>(2)</enum><text>identifying and
				evaluating existing evidence-based or promising best practices with respect to
				child and adolescent mental health services and supports;</text>
							</paragraph><paragraph id="IDa2979c390e5e49a4afef6e7d83818b98"><enum>(3)</enum><text>improving the
				child and adolescent mental health service-delivery system by implementing
				evidence-based or promising best practices;</text>
							</paragraph><paragraph id="ID8a2279483ca54b94b33f324e91be848c"><enum>(4)</enum><text>training primary
				care professionals, mental health professionals, and child care professionals
				on evidence-based or promising best practices;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7cebd674dd114ebcbe8b17ddbaaa43f1"><enum>(5)</enum><text>informing
				children and adolescents, parents, legal guardians, families, advocacy
				organizations, and other interested consumer organizations on such
				evidence-based or promising best practices; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8956E723C59940A7A8AA24F5C1A4828A"><enum>(6)</enum><text>identifying
				financing structures to support the implementation of evidence-based or
				promising best practices and providing assistance on how to build appropriate
				financing structures to support those services.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id91B65D36D2984DDFBBF9669F78B5C0C2"><enum>(c)</enum><header>Authorization
				of appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to carry out this section, $12,500,000 for fiscal
				year 2007, and such sums as may be necessary for each of fiscal years 2008
				through
				2011.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id20981B2C2E314E85B18C0159476A4648"><enum>302.</enum><header>Federal
			 research concerning adolescent mental health</header><text display-inline="no-display-inline">Part K of title V of the Public Health
			 Service Act, as added by section 201 and amended by section 301, is further
			 amended by adding at the end the following:</text>

					<section id="idEBD11850DE794931B3C430D1B3CF6ED9"><enum>597J.</enum><header>Federal
				research concerning adolescent mental health</header>
						<subsection id="idB6EA62A16D1047AD9E5292ADC42EDD87"><enum>(a)</enum><header>Best
				practices</header><text>The Secretary shall provide for the conduct of research
				leading to the identification and evaluation of evidence-based or promising
				best practices, including—</text>
							<paragraph id="id3C6FDADC66E14688826E4694CA7C67DE"><enum>(1)</enum><text>early
				intervention and prevention mental health services and systems, particularly
				for children and adolescents with co-occurring mental health and substance
				abuse disorders;</text>
							</paragraph><paragraph id="IDb69d6351ad95407c96de4c195401025c"><enum>(2)</enum><text>mental health
				referral services;</text>
							</paragraph><paragraph id="ID966a60ec027c4f9481d60d66a9218f57"><enum>(3)</enum><text>integrated mental
				health treatment services, particularly for children and adolescents with
				co-occurring mental health and substance abuse disorders;</text>
							</paragraph><paragraph id="ID0763cf48ea3e4d4aa32ac30edd949290"><enum>(4)</enum><text>mentoring and
				other support services;</text>
							</paragraph><paragraph id="ID05a966c0f842421888cf073984629f63"><enum>(5)</enum><text>transition
				services; and</text>
							</paragraph><paragraph id="ID04bbfb71dc504b88bb7094ba0fb62005"><enum>(6)</enum><text>respite care for
				parents, legal guardians, and families of children and adolescents.</text>
							</paragraph></subsection><subsection id="id535BE1945A7047C194EAC26C65A6ED5F"><enum>(b)</enum><header>Identification
				of existing disparities</header><text>The Secretary shall provide for the
				conduct of research leading to the identification of factors contributing to
				the existing disparities in children and adolescents mental health care in
				areas including—</text>
							<paragraph id="ID9134499eb2604c9faa881bfc7001d2c9"><enum>(1)</enum><text>evidence-based
				early intervention and prevention, diagnosis, referral, treatment, and
				monitoring services;</text>
							</paragraph><paragraph id="ID609e3898587741b9a1df6e1032ed86f7"><enum>(2)</enum><text>psychiatric and
				psychological epidemiology in racial and ethnic minority populations;</text>
							</paragraph><paragraph id="ID812d9ed0260a4e598baed7bc5020c3d7"><enum>(3)</enum><text>therapeutic
				interventions in racial and ethnic minority populations;</text>
							</paragraph><paragraph id="ID0f82ab251eae4fa2a016b5b4a222f320"><enum>(4)</enum><text>psychopharmacology;</text>
							</paragraph><paragraph id="IDdb8cba94b0ad4b48bd8a09a71ea2f834"><enum>(5)</enum><text>mental health
				promotion and child and adolescent emotional well-being and resiliency;</text>
							</paragraph><paragraph id="IDa7e906e7e48047dfb666b6736d344e54"><enum>(6)</enum><text>lack of adequate
				service delivery systems in urban and rural regions; and</text>
							</paragraph><paragraph id="id0AF33B08905A47CF8A0CA936888B7DE6"><enum>(7)</enum><text>lack of adequate
				reimbursement rates for evidence-based early intervention and prevention,
				diagnosis, referral, treatment, and monitoring services.</text>
							</paragraph></subsection><subsection id="ID50db518f3a2d4cbbaef3b6f153375fd4"><enum>(c)</enum><header>Psychotropic
				medications</header><text>The Secretary shall provide for the conduct of
				research leading to the identification of the long-term effects of psychotropic
				medications and SSRIs and other pyschotropic medications for children and
				adolescents.</text>
						</subsection><subsection id="IDf87ff54eed324b2d93da2a07d5203a7f"><enum>(d)</enum><header>Trauma</header><text>The
				Secretary shall provide for the conduct of research leading to the
				identification of the long-term effects of trauma on the mental health of
				children and adolescents, including the effects of—</text>
							<paragraph id="IDa9f953fdb8024ad39c1e42d362806830"><enum>(1)</enum><text>violent crime,
				particularly sexual abuse;</text>
							</paragraph><paragraph id="ID69452bddc61e4246a6bad7a09c3ed21a"><enum>(2)</enum><text>physical or
				medical trauma;</text>
							</paragraph><paragraph id="IDd18f6189f7d3427a83210cca2a9cd880"><enum>(3)</enum><text>post-traumatic
				stress disorders; and</text>
							</paragraph><paragraph id="id98FE6E07A1924DF8ACEAA19FDF308781"><enum>(4)</enum><text>terrorism and
				natural disasters.</text>
							</paragraph></subsection><subsection id="ID373d73c207d445f1a74e06c85c2594a0"><enum>(e)</enum><header>Acute
				care</header><text>The Secretary shall provide for the conduct of research
				leading to the identification of factors contributing to problems in acute
				care. Such research shall address—</text>
							<paragraph id="IDb0985663efe6486f9c92de35324d5011"><enum>(1)</enum><text>synthesizing the
				acute care knowledge data base;</text>
							</paragraph><paragraph id="ID5cd59caa520e4aa0897a7ade38fa3b78"><enum>(2)</enum><text>assessing
				existing capacities and shortages in acute care;</text>
							</paragraph><paragraph id="IDb311fc1618d04b94ba72f4ffed37a7ad"><enum>(3)</enum><text>reviewing
				existing model programs that exist to ensure appropriate and effective acute
				care;</text>
							</paragraph><paragraph id="IDf763fdc30fbb4532aafde3a6bd1685dd"><enum>(4)</enum><text>developing new
				models when appropriate; and</text>
							</paragraph><paragraph id="ID623439eacf2d4d268fd9baec4a1dcccc"><enum>(5)</enum><text>proposing
				workable solutions to enhance the delivery of acute care and crisis
				intervention services.</text>
							</paragraph></subsection><subsection id="ID74b08ad7182f4028abed8f646578d961"><enum>(f)</enum><header>Recovery and
				rehabilitation</header><text>The Secretary shall provide for the conduct of
				research leading to the identification of methods and models to enhance the
				recovery and rehabilitation of children and adolescents with mental health
				disorders.</text>
						</subsection><subsection id="ID0bccc3c2e18e4fa9bcce47a6bc77ba20"><enum>(g)</enum><header>Co-occurring
				disorders</header><text>The Secretary shall provide for the conduct of research
				leading to the identification of methods and models to enhance services and
				supports for children and adolescents with co-occurring mental health and
				substance abuse and disorders.</text>
						</subsection><subsection id="IDa41733f1bade45688c2aa3eba8ed7a53"><enum>(h)</enum><header>Research
				collaboration</header><text>The Secretary shall provide for the conduct of
				research that reviews existing scientific literature on the relationship
				between mental and physical health, particularly identifying new methods and
				models to enhance the balance between mental and physical health in children
				and adolescents.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9aac4c4699504111a0e88bab75992fff"><enum>(i)</enum><header>Collaboration</header><text>In
				carrying out the activities under this section, the Secretary shall collaborate
				with the Federal interagency coordinating committee established under section
				401 of the Child and Youth Equitable Health Act of 2005, and relevant Federal
				agencies and mental health working groups responsible for child and adolescent
				mental health.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id1A71F486A98B4CC184C6BFFA3BD48F62"><enum>(j)</enum><header>Authorization
				of appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to carry out this section, $12,500,000 for fiscal
				year 2007, and such sums as may be necessary for each of fiscal years 2008
				through
				2011.</text>
