		<official-title>To amend the Help America Vote Act of 2002 to require a

		  voter-verified permanent record or hardcopy under title III of such Act, and

		  for other purposes.</official-title>

		<section id="ID9247F1252C6844769DBD9223335225FB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Voting Integrity and Verification Act

			 of 2005</short-title></quote>.</text>

		</section><section id="IDC83B901F986A4D838A1D0E800C4CFEDF"><enum>2.</enum><header>Promoting

			 accuracy, integrity, and security through preservation of a voter-verified

			 permanent paper record</header>

			<subsection id="ID39D8612E4ECF464390D9378A20B12878"><enum>(a)</enum><header>In

			 general</header><text>Section 301(a) of the Help America Vote Act of 2002

			 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481(a)">42 U.S.C.

			 15481(a)</external-xref>) is amended—</text>

				<paragraph id="ID2B7853520E4B4930BCFF6FF3F59969A5"><enum>(1)</enum><text>in paragraph

			 (1)(A)—</text>

					<subparagraph id="ID946C13E340E3435A93DF9CC93EA4CDCF"><enum>(A)</enum><text>by striking

			 clause (i) and inserting the following new clause:</text>

						<quoted-block id="ID46FC816465A742E08BCB5AB8D70EE419">

							<clause id="ID1212B8A1217744C6BAC87045B96E6DF8"><enum>(i)</enum><text>permit the voter

				to verify the accuracy of their ballot (in a private and independent manner),

				by allowing the voter to review an individual paper version of the voter’s

				ballot before the voter’s ballot is cast and counted;</text>

							</clause><after-quoted-block>;</after-quoted-block></quoted-block>

					</subparagraph><subparagraph id="ID1AEFF80AB5384376904195008ECC3609"><enum>(B)</enum><text>in clause

			 (ii)—</text>

						<clause id="IDA66EF0B1180A4DD58B4A149245E5E46D"><enum>(i)</enum><text>by

			 inserting <quote>discovered on the individual paper version of the voter’s

			 ballot</quote> after <quote>to change the ballot or correct any error</quote>;

			 and</text>

						</clause><clause id="IDE3A224870CF042578BCA913DD17653A2"><enum>(ii)</enum><text>by

			 striking <quote>and</quote> after the semicolon at the end;</text>

						</clause></subparagraph><subparagraph id="ID67C66DFF8478448FA9389B037C741A88"><enum>(C)</enum><text>by redesignating

			 clause (iii) as clause (iv); and</text>

					</subparagraph><subparagraph id="ID0000B48BA71A45C5953549E8E3A36B69"><enum>(D)</enum><text>by inserting

			 after clause (ii) the following new clause:</text>

						<quoted-block id="IDCBE72CB7AB84440196CD97D34DC29E01">

							<clause id="ID049E06F215214086AE6C67EB4CF3A307"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="IDF822EA098030409FAAB3A2FE6D43C91E"><enum>(I)</enum><text>preserve the individual

				paper version of the voter’s ballot, after the voter has certified that the

				same accurately reflects the voter’s intent, as the individual permanent paper

				record, and</text>

								</subclause><subclause id="ID2CECCCA848A94593833EAAF09164059C" indent="up1"><enum>(II)</enum><text>preserve such individual permanent paper

				record at the polling place in accordance with the provisions of paragraph

				(2)(B)(i); and</text>

								</subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block>

					</subparagraph></paragraph><paragraph id="ID499AB10AD5794BC69D3DE5C9A4079068"><enum>(2)</enum><text>in paragraph

			 (1)(B), by striking <quote>subparagraph (A)(iii)</quote> and inserting

			 <quote>subparagraph (A)(iv)</quote>; and</text>

				</paragraph><paragraph id="ID4BFA193FF0EB447AA5087E6EA9E031D9"><enum>(3)</enum><text>by striking

			 paragraph (2) and inserting the following new paragraph:</text>

						<paragraph id="ID39E89B5D09DE4783B2AC0B11C090DC40"><enum>(2)</enum><header>Manual audit

				capacity</header>

							<subparagraph id="ID2EABC791FE224B60B07FEDE06D79B4AB"><enum>(A)</enum><header>In

				general</header><text>The voting system shall produce an individual permanent

				paper record for each ballot that is cast which provides for voter verification

				of such record in accordance with paragraph (1)(A) and which meets the

				requirements of subparagraph (B).</text>

							</subparagraph><subparagraph id="IDB06D7C531F3F40BFAB48100F778FE0DD"><enum>(B)</enum><header>Manual audit

				capacity</header>

								<clause id="ID4C6B4B650D1541E19494D11F93D4CA74"><enum>(i)</enum><text>The voting system

				shall produce an individual permanent paper record for each ballot cast that is

				either—</text>

									<subclause id="IDE863C3B12E5442B08D2ACACD4890FF2D"><enum>(I)</enum><text>preserved within

				the polling place in the manner in which all other paper ballots are preserved

				within such polling place; or</text>

									</subclause><subclause id="IDFC5B70C1B4FD4DB88CF6491975579180"><enum>(II)</enum><text>in the absence

				of such manner or method, which is consistent with the manner employed by the

				jurisdiction for preserving paper ballots in general.</text>

									</subclause></clause><clause id="IDC7EAD81F6B864732A3863B6E3BC0D308"><enum>(ii)</enum><text>Each paper

				record produced under clause (i) shall be suitable for a manual audit

				equivalent or superior to that of a paper ballot voting system.</text>

								</clause><clause id="ID2ED8247E48AA46A0A17EC4C3395A994A"><enum>(iii)</enum><text>All electronic

				records produced by any voting system shall be consistent with the individual

				permanent paper records produced by such voting system. In the event of any

				inconsistencies or irregularities between any electronic records and the

				individual permanent paper records, the individual permanent paper records

				shall be the true and correct record of the votes cast.</text>

								</clause><clause id="ID9D87EFD5A8BB4FE6B8E1B6FD84D6A230"><enum>(iv)</enum><text>The individual

				permanent paper records produced under clause (i) shall be used as the official

				records for purposes of any recount or audit conducted with respect to any

				election for Federal office in which the voting system is used.</text>

								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection id="ID873D6B873F884C5AAAFEA5BAB4F85510"><enum>(b)</enum><header>Effective

			 date</header><text>The amendments made by this section shall take effect as if

			 included in the enactment of the Help America Vote Act of 2002.</text>
