		<official-title>To protect privacy by limiting the access of the

		  Government to library, bookseller, and other personal records for foreign

		  intelligence and counterintelligence purposes.</official-title>

		<section id="ID66CAC2A567B64C209EC8A400A29426B3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Library, Bookseller, and Personal

			 Records Privacy Act</short-title></quote>.</text>

		</section><section id="IDCE5DA7465C4A48059102D411653C9D57"><enum>2.</enum><header>Privacy

			 protections on Government access to library, bookseller, and other personal

			 records under Foreign Intelligence Surveillance Act of 1978</header>

			<subsection id="ID7914D4000A6C45948E56D26F8B71EB5B"><enum>(a)</enum><header>Applications

			 for orders</header><text>Subsection (b) of section 501 of the Foreign

			 Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>) is amended—</text>

				<paragraph id="ID7E34E1E778EB4482A1EA00B6D4108957"><enum>(1)</enum><text>in paragraph (1),

			 by striking <quote>and</quote> at the end;</text>

				</paragraph><paragraph id="ID1A0FF1EF372B4EB7813DA3ED91AD92B0"><enum>(2)</enum><text>in paragraph (2),

			 by striking the period at the end and inserting <quote>; and</quote>;

			 and</text>

				</paragraph><paragraph id="ID1A0C160A68A84629BC30C890EAE56763"><enum>(3)</enum><text>by adding at the

			 end the following new paragraph:</text>

					<quoted-block id="IDB7DD46B51701431291D8D1A6EBC4F179">

						<paragraph id="ID75EA5809051046F186E18C6EC12BA883"><enum>(3)</enum><text>shall specify

				that there are specific and articulable facts giving reason to believe that the

				person to whom the records pertain is a foreign power or an agent of a foreign

				power.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection id="IDD4FBFD57C7774551994F387DF2C74400"><enum>(b)</enum><header>Orders</header><text>Subsection

			 (c)(1) of that section is amended by striking <quote>finds</quote> and all that

			 follows and inserting</text>

				<quoted-block display-inline="yes-display-inline" id="IDE0C0A4B2DE734119B9B667BBDE21A9B7">

					<text>finds that—</text><subparagraph id="IDFB9FC44883F043D5915D9C7110C50817" indent="up1"><enum>(A)</enum><text>there are specific and articulable

				facts giving reason to believe that the person to whom the records pertain is a

				foreign power or an agent of a foreign power; and</text>

					</subparagraph><subparagraph id="IDDA9971959D274F658DB5385E36613194" indent="up1"><enum>(B)</enum><text>the application meets the other

				requirements of this section.</text>

					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="ID9D442F775119421AA51FE52D3EF5572C"><enum>(c)</enum><header>Oversight of

			 requests for production of records</header><text>Section 502 of that Act

			 (<external-xref legal-doc="usc" parsable-cite="usc/50/1862">50 U.S.C.

			 1862</external-xref>) is amended—</text>

				<paragraph id="ID1A4E100D77EF45588900E2A2AFC8D9F1"><enum>(1)</enum><text>in subsection

			 (a), by striking <quote>the Permanent</quote> and all that follows through

			 <quote>the Senate</quote> and inserting <quote>the Permanent Select Committee

			 on Intelligence and the Committee on the Judiciary of the House of

			 Representatives and the Select Committee on Intelligence and the Committee on

			 the Judiciary of the Senate</quote>; and</text>

				</paragraph><paragraph id="ID5CB1E9DE621D4FDEA313BB2D9D4CF9C0"><enum>(2)</enum><text>in subsection

			 (b), by striking <quote>On a semiannual basis,</quote> and all that follows

			 through <quote>a report setting forth</quote> and inserting <quote>The report

			 of the Attorney General to the Committees on the Judiciary of the House of

			 Representatives and the Senate under subsection (a) shall set

			 forth</quote>.</text>

				</paragraph></subsection></section><section id="ID6007DE32271741D7AB79D2AFF300AF9C"><enum>3.</enum><header>Privacy

			 protections on Government access to information on computer users at

			 booksellers and libraries under national security authority</header>

			<subsection id="ID044FFF7831DB47FAB3E267374FF26B41"><enum>(a)</enum><header>In

			 general</header><text>Section 2709 of title 18, United States Code, is

			 amended—</text>

				<paragraph id="ID739C19E07D9D446C8277C7007D008FF6"><enum>(1)</enum><text>by redesignating

			 subsection (e) as subsection (f); and</text>

				</paragraph><paragraph id="ID077204C906EE495AB43C53A818889BCE"><enum>(2)</enum><text>by inserting

			 after subsection (d) the following new subsection (e):</text>

					<quoted-block id="IDF2185B131D254D7FBEFAFC6D36DB352F">

						<subsection id="ID5B72D4BE30874C2389FB0052B008E7D8"><enum>(e)</enum><header>Records of

				booksellers and libraries</header><paragraph commented="no" display-inline="yes-display-inline" id="ID33BA81C6DFA4438BB08C5F00211031D6"><enum>(1)</enum><text>When a request under

				this section is made to a bookseller or library, the certification required by

				subsection (b) shall also specify that there are specific and articulable facts

				giving reason to believe that the person or entity to whom the records pertain

				is a foreign power or an agent of a foreign power.</text>

							</paragraph><paragraph id="IDF163C6BFE2424FBF81E30020A7CC8134" indent="up1"><enum>(2)</enum><text>In this subsection:</text>

								<subparagraph id="ID120786FBEDED47B29F9B765258AADB9F"><enum>(A)</enum><text>The term <term>bookseller</term> means

				a person or entity engaged in the sale, rental, or delivery of books, journals,

				magazines, or other similar forms of communication in print or

				digitally.</text>

								</subparagraph><subparagraph id="ID177555A9204548209E978CCBBC35AFC5"><enum>(B)</enum><text>The term <term>library</term> means a

				library (as that term is defined in section 213(2) of the Library Services and

				Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9122(2)">20 U.S.C. 9122(2)</external-xref>)) whose

				services include access to the Internet, books, journals, magazines,

				newspapers, or other similar forms of communication in print or digitally to

				patrons for their use, review, examination, or circulation.</text>

								</subparagraph><subparagraph id="IDA0E77F6038B84BB2BBB3B4E700329D00"><enum>(C)</enum><text>The terms <term>foreign power</term>

				and <term>agent of a foreign power</term> have the meaning given such terms in

				section 101 of the Foreign Intelligence Surveillance Act of 1978

				(<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C.

				1801</external-xref>).</text>

								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection id="IDCB41AD61148B4A04AEEE005840F2EF33"><enum>(b)</enum><header>Sunset of

			 certain modifications on access</header><text>Section 224(a) of the USA PATRIOT

			 ACT of 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/107/56">Public Law 107–56</external-xref>;

			 <external-xref legal-doc="statute-at-large" parsable-cite="stat/115/295">115

			 Stat. 295</external-xref>) is amended by inserting <quote>and section

			 505</quote> after <quote>by those sections)</quote>.</text>
