		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>21st Century Housing
			 Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idC08470EA2C23465EAAAE72A27581DFC5" section-type="subsequent-section"><enum>2.</enum><header>Investment in FHA
			 infrastructure</header>
			<subsection commented="no" display-inline="no-display-inline" id="id0E2B2B0939524267922ED58B5A2E00A4"><enum>(a)</enum><header>Human resources
			 and funding</header><text display-inline="yes-display-inline">Section 502(a) of
			 the Housing Act of 1948 (12 U.S.C. 1701c(a)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id3B1A5DD7A36D49CEA27489FE1F88A585"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>The Secretary of Housing
			 and Urban Development</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6177E549B2154F09A9AC110A9EDB4F4F" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id497A3FDA99624A4DA7126C122D92C338"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				paragraph (2), the Secretary of Housing and Urban
				Development</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD907ABCD5FA44B8B9AD0E666E749E211"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id3AA7094C1AC245878A8AA604B8B9C46D" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id471A947207764E8292C5BA3EFC3664EA"><enum>(2)</enum><header>Administration
				of FHA programs</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idC4BA63D6EA55477D8CC1762710FFAD8F"><enum>(A)</enum><header>Office
				personnel</header>
								<clause commented="no" display-inline="no-display-inline" id="idC6118BC5EC944018AF35511C8E4598D6"><enum>(i)</enum><header>Appointment</header><text display-inline="yes-display-inline">In carrying out any program through the
				Federal Housing Administration (in this section referred to as the
				<quote>Administration</quote>), the Secretary may appoint and fix the
				compensation of such officers and employees of the Administration as the
				Secretary considers necessary.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idEDB6362B45234DB0B7F3261FC682497C"><enum>(ii)</enum><header>Compensation</header><text display-inline="yes-display-inline">Any officer or employee appointed under
				clause (i) may be paid without regard to the provisions of chapter 51 and
				subchapter III of chapter 53 of title 5, United States Code, relating to
				classification and General Schedule pay rates.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6683F94524544FC3A1A443A52D6D070F"><enum>(B)</enum><header>Comparability
				of compensation with Federal Banking agencies</header><text display-inline="yes-display-inline">In fixing and directing compensation under
				subparagraph (A), the Secretary shall consult with, and maintain comparability
				with the compensation of officers and employees of the Federal Deposit
				Insurance Corporation.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE5814576EB7048708D76568235E53C93"><enum>(C)</enum><header>Personnel of
				other Federal agencies</header><text display-inline="yes-display-inline">In
				carrying out the duties of the Administration, the Secretary may use
				information, services, staff, and facilities of any Federal executive agency,
				independent agency, or department on a reimbursable basis, with the consent of
				such agency or department.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id14C36A3F7B0D4D4392A3AD4F742C0045"><enum>(D)</enum><header>Outside experts
				and consultant</header><text display-inline="yes-display-inline">In carrying
				out the duties of the Administration, the Secretary may procure temporary and
				intermittent services under section 3109(b) of title 5, United States
				Code.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4D333BBB51B047BF92F7C9271D8289D1"><enum>(E)</enum><header>Use of
				premium-generated income</header><text display-inline="yes-display-inline">To
				the extent that income derived in any fiscal year from premium fees charged
				under section 203(c) of the National Housing Act (12 U.S.C. 1709(c)) are in
				excess of the level of income estimated for that fiscal year for such premium
				fees and assumed in the baseline projection prepared by the Director of the
				Office of Management and Budget for inclusion in the President's annual budget
				request, not more than $82,000,000 of such excess amounts may be used from such
				amounts for the purpose of carrying out this
				paragraph.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEF3611859F6241488B81B206572BF659"><enum>(b)</enum><header>Information
			 technology investment</header><text display-inline="yes-display-inline">Section
			 502(a) of the Housing Act of 1948 (12 U.S.C. 1701c(a)), as amended by
			 subsection (a), is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idCAA67830A2EE483E89A9F7B9E734FC2E" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="id7E0282C392FA427E9DB8FA3393A0EECD"><enum>(3)</enum><header>Information
				technology</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id616727E65C0F43CAB288D0B86F015619"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In carrying out any
				program through the Administration, the Secretary may utilize such funds as are
				available under subparagraph (B) to ensure that an appropriate level of
				investment in information technology is maintained in order for the Secretary
				to upgrade its technology systems.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEE83BD40BD3144D9A7EF3D2BE5CD2824"><enum>(B)</enum><header>Use of
				premium-generated income</header><text display-inline="yes-display-inline">To
				the extent that income derived from premium fees charged under section 203(c)
				of the National Housing Act (12 U.S.C. 1709(c)) are in excess of the level of
				income estimated for that fiscal year for such premium fees and assumed in the
				baseline projection prepared by the Director of the Office of Management and
				Budget for inclusion in the President's annual budget request, not more than
				$72,000,000 of such excess amounts may be used from such amounts for the
				purpose of carrying out this
				paragraph.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID8B3032ED52F34094AD3C6714252E8AB4" section-type="subsequent-section"><enum>3.</enum><header>Extension of mortgage
			 term authority</header><text display-inline="no-display-inline">Section
			 203(b)(3) of the <act-name parsable-cite="NHA">National Housing Act</act-name>
			 (12 U.S.C. 1709(b)(3)) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID77548ACB94E149F1956ED2BFBF0D0819"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>thirty-five
			 years</quote> and inserting <quote>50 years</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2144640ABECA4A3DAB19642FA6E8644C"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>(or thirty years if such
			 mortgage is not approved for insurance prior to construction)</quote>.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID128F8947BA944FBB9B2954A4D7C55B7A" section-type="subsequent-section"><enum>4.</enum><header>Downpayment
			 flexibility</header><text display-inline="no-display-inline">Section 203(b)(9)
			 of the <act-name parsable-cite="NHA">National Housing Act</act-name> (12 U.S.C.
			 1709(b)(9)) is amended by striking <quote>(9)</quote> and all that follows
			 through “<added-phrase>Provided further</added-phrase>, That for” and inserting
			 the following:</text>
			<quoted-block display-inline="no-display-inline" id="id2E0C42D85B5943B590769C10E25144B5" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="IDC8A8015A835F4284942341FFFDEB6B50"><enum>(9)</enum><text display-inline="yes-display-inline">Be executed by a mortgagor who shall have
				paid on account of the property, in cash or its equivalent, an amount, if any,
				as the Secretary may determine, based on factors determined by the Secretary
				and commensurate with the likelihood of default.

		</section><section commented="no" display-inline="no-display-inline" id="id6F361E2F25214DBF9365AE34DAF77540" section-type="subsequent-section"><enum>5.</enum><header>Mortgage insurance
			 flexibility</header><text display-inline="no-display-inline">Section 203(c)(2)
			 of the <act-name parsable-cite="NHA">National Housing Act</act-name> (12 U.S.C.
			 1709(c)(2)) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id60846B48DAE84279BB159391F4C1BF86"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idCFC0D38A1E6E40DBAECD068D0D235ABB"><enum>(A)</enum><text display-inline="yes-display-inline">by striking the first sentence and
			 inserting <quote>The Secretary shall establish and collect, at the time of
			 insurance, a single premium payment, in such amount as the Secretary may
			 determine, based on factors determined by the Secretary and commensurate with
			 the likelihood of default of the homebuyer. Such premium payment shall be in an
			 amount not to exceed 3 percent of the amount of the original insured principal
			 obligation of the mortgage.</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0758331EE729489388C27E708748EE6B"><enum>(B)</enum><text display-inline="yes-display-inline">by striking the second sentence; and</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6B2B41B77026490C85BD11BA72470478"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking
			 <quote>0.50 percent</quote> and inserting <quote>1 percent</quote>.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id0E56716B6DFE43118F3238E88CD04F63" section-type="subsequent-section"><enum>6.</enum><header>Innovation for new
			 projects</header><text display-inline="no-display-inline">Section 203 of the
			 <act-name parsable-cite="NHA">National Housing Act</act-name> (12 U.S.C. 1709)
			 is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id39B0983D84744CA8BA11D276C11CE60E" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="id3D6094D1929A41ACB353BDCB22CAB923"><enum>(y)</enum><header>Waiver for new
				product initiatives</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id59DDC7EC0AE14886A5DABB437E596776"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of law, and subject to the limitation under paragraph (2), the
				Secretary may waive such requirements of this section as the Secretary
				determines appropriate for any new product initiative.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEC936FFC91154165AC7BD8AEA3372881"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">For all new product initiatives in any
				fiscal year, the Secretary may allocate an amount equal to not more than 10
				percent of the amount necessary to carry out the insurance of mortgages under
				this section for the prior fiscal
				year.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="ID2FE72ABB3651448C833581B958435F97" section-type="subsequent-section"><enum>7.</enum><header>Maximum mortgage
			 amount limit for multifamily housing in high-cost areas</header><text display-inline="no-display-inline">Sections 207(c)(3), 213(b)(2)(B)(i),
			 220(d)(3)(B)(iii)(III), 221(d)(3)(ii)(II), 221(d)(4)(ii)(II), 231(c)(2)(B), and
			 234(e)(3)(B) of the <act-name parsable-cite="NHA">National Housing
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1713(c)(3)(B)">12 U.S.C. 1713(c)(3)</external-xref>,
			 1715e(b)(2)(B)(i), 1715k(d)(3)(B)(iii)(III),
			 1715<italic>l</italic>(d)(3)(ii)(II), 1715<italic>l</italic>(d)(4)(ii)(II),
			 1715v(c)(2)(B)), and 1715y(e)(3)(B)) are each amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDB6C3D1088FA7491EB850003901C00702"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>140 percent</quote> each
			 place that term appears and inserting <quote>170 percent</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID44C26BB124B84B1B84A882BCB5758F93"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>170 percent</quote> each
			 place that term appears and inserting <quote>215 percent</quote>.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id988D6BBF27084C229D8B135765779836" section-type="subsequent-section"><enum>8.</enum><header>Increase in FHA
			 financial integrity</header><text display-inline="no-display-inline">Section
			 205(f)(2) of the <act-name parsable-cite="NHA">National Housing Act</act-name>
			 (12 U.S.C. 1711(f)(2)) is amended by striking <quote>2.0 percent</quote> and
			 inserting <quote>3.0 percent</quote>.</text>
