			<enum>1.</enum>

			<header>Short title</header>

			<text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Department of the Interior Volunteer

			 Recruitment Act of 2005</short-title></quote>.</text>

			<enum>2.</enum>

			<header>Purpose</header>

			<text display-inline="no-display-inline">The purpose of this Act is to

			 authorize the Secretary of the Interior to recruit and use volunteers to assist

			 with or facilitate the programs of the Bureau of Indian Affairs, the United

			 States Geological Survey, the Bureau of Reclamation, and the Office of the

			 Secretary.</text>

			<enum>3.</enum>

			<header>Volunteer authority</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID689D56EA2B884278A92B012CD6A027EA">

				<enum>(a)</enum>

				<header>In general</header>

				<text display-inline="yes-display-inline">The Secretary of the Interior

			 (referred to in this Act as the <quote>Secretary</quote>) may, without regard

			 to the civil service laws (including regulations), recruit, train, and accept

			 the services of individuals, contributed without compensation as volunteers, to

			 assist with or facilitate the activities administered by the Secretary through

			 the Bureau of Indian Affairs, the United States Geological Survey, the Bureau

			 of Reclamation, and the Office of the Secretary.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID96D6165F754E4B9DB17CD85D30C2AC76">

				<enum>(b)</enum>

				<header>Restrictions on activities of volunteers</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID710F5CFCB3944D02B54598DAC41C9316">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">In accepting the services of

			 volunteers, the Secretary shall not permit the use of volunteers—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDB51F71E0A41C4197A9EF92749E6F07E0">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">in law enforcement;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID87518773036E40F4AD62B4092C0936E6">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">in regulatory and enforcement

			 work;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7F05A603496843058D98F77D1C7D1A05">

						<enum>(C)</enum>

						<text display-inline="yes-display-inline">in policymaking processes;

			 or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0EC13906CB5245D5B414A9AB2336DC4A">

						<enum>(D)</enum>

						<text display-inline="yes-display-inline">to displace any

			 employee.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID06F0E0D4BAE8485FBC5D3CD1A0E23D2E">

					<enum>(2)</enum>

					<header>Private property</header>

					<text display-inline="yes-display-inline">No volunteer services

			 authorized by this Act may be conducted on private property unless the officer

			 or employee supervising the volunteer obtains from the property owner

			 appropriate consent to enter the property.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF20A062EA99E4A3493A9C3DD33CE75D9">

					<enum>(3)</enum>

					<header>Hazardous duty</header>

					<text display-inline="yes-display-inline">The Secretary may accept the

			 services of a volunteer in hazardous duty only if the Secretary determines that

			 the volunteer is skilled in performing hazardous duty activities.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1168DB83BEF74843BCD9F80171F488C0">

					<enum>(4)</enum>

					<header>Supervision</header>

					<text display-inline="yes-display-inline">The Secretary shall ensure

			 that an appropriate officer or employee of the United States provides adequate

			 and appropriate supervision of each individual that volunteers under this

			 Act.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID616F21491CB844128675D3F7219BD472">

				<enum>(c)</enum>

				<header>Provision of services and costs</header>

				<text display-inline="yes-display-inline">The Secretary may provide for

			 services and costs incidental to the use of volunteers under this Act,

			 including—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID2DA6BA323A444ED1BB9CFF4A27A7FE28">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">transportation;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4E8CA045371C40C78BEBF09F2406FB56">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">supplies;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1E16B18D18614157A5456A9081F8CD19">

					<enum>(3)</enum>

					<text display-inline="yes-display-inline">uniforms;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1889A28B25A443318FAD231DE4F2343C">

					<enum>(4)</enum>

					<text display-inline="yes-display-inline">lodging;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD56CF77F82DD47EEB058B37F91503DE8">

					<enum>(5)</enum>

					<text display-inline="yes-display-inline">without regard to the place

			 of residence of the volunteers, subsistence;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8AC905DE9EEB4C74A0C5E0886046AA83">

					<enum>(6)</enum>

					<text display-inline="yes-display-inline">recruiting;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID92CEA49890E54098A1BFC1329A43A29E">

					<enum>(7)</enum>

					<text display-inline="yes-display-inline">training;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID33FEE46826674ACC864BD36D8FE34AA1">

					<enum>(8)</enum>

					<text display-inline="yes-display-inline">supervision; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD789CDEB72E54F75865FFAB1E77D8053">

					<enum>(9)</enum>

					<text display-inline="yes-display-inline">awards and recognition,

			 including nominal cash awards.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9393486A9D5E44468B8A47F49EF82842">

				<enum>(d)</enum>

				<header>Federal employment status of volunteers</header>

				<paragraph commented="no" display-inline="no-display-inline" id="IDD4629F45BAC04385BB87D805A5AEBD03">

					<enum>(1)</enum>

					<header>In general</header>

					<text display-inline="yes-display-inline">Except as otherwise provided

			 in this subsection, a volunteer under this Act shall not be—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID1478CD59206F411B841E14FF1B011542">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">considered to be a Federal

			 employee; or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0C54C11E1BD1441FB850A93D1690FEB8">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">subject to any provision of

			 law relating to Federal employment, including provisions relating to—</text>

						<clause commented="no" display-inline="no-display-inline" id="IDCB443DD77CA34E2899DB90FFD2F6433B">

							<enum>(i)</enum>

							<text display-inline="yes-display-inline">hours of work;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID3D505962B95040F988F315ADDDE4EBB9">

							<enum>(ii)</enum>

							<text display-inline="yes-display-inline">rates of compensation;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID3B7EF1E590BF4EF6BC147C494A6FC83D">

							<enum>(iii)</enum>

							<text display-inline="yes-display-inline">leave;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID32784D077DA1418DAC4F60ED4E10544B">

							<enum>(iv)</enum>

							<text display-inline="yes-display-inline">unemployment compensation;

			 and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="IDC614091C458E438DAF8AA1FD0A7083A1">

							<enum>(v)</enum>

							<text display-inline="yes-display-inline">Federal employee

			 benefits.</text>

						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB3F691AE0BFB448582456920E21B38CD">

					<enum>(2)</enum>

					<header>Liability</header>

					<text display-inline="yes-display-inline">Volunteers under this Act

			 shall be considered to be employees of the United States for the purposes

			 of—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDF341378EE7724E41A74228416DA38694">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">chapter 171 title 28, United

			 States Code;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFED0DEE9015E434F84FC1D2D2C3E9337">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">subchapter I of chapter 81 of

			 title 5, United States Code; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA165168D4BDB4F3EB88DB48BBF4CDB8E">

						<enum>(C)</enum>

						<text display-inline="yes-display-inline">claims relating to damage to,

			 or loss of, personal property of a volunteer incident to volunteer service,

			 which shall be subject to section 3721 of title 31, United States Code.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID49A2682F8AB64FD0BB6B6D70ACEE37BF">

					<enum>(3)</enum>

					<header>Conflicts of interest</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="id157741AF8FA6438A8F6C34F411D4E6FB">

						<enum>(A)</enum>

						<header>In general</header>

						<text display-inline="yes-display-inline">Volunteers under this Act

			 shall be subject to chapter 11 of title 18, United States Code, unless the

			 Secretary, with the concurrence of the Director of the Office of Government

			 Ethics, determines that the provisions of that chapter, other than section 201,

			 shall not apply to the actions of a class of volunteers who carry out only

			 those duties or functions specified in the determination.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA73E419F6852430AA39E9AAE86002D53">

						<enum>(B)</enum>

						<header>Publication of determination</header>

						<text display-inline="yes-display-inline">The Secretary shall publish

			 in the Federal Register any determinations made under subparagraph (A).</text>
