1.This Act may be cited as
the All-Hazards Public Health
Emergency and Bioterrorism Preparedness and Response
Act
.
<enum>I</enum><header>All-hazards
public health emergency and bioterrorism preparedness and response </header>
<section id="id17F5B3E0D64E47C6AD9BC19A3D081D43"><enum>101.</enum><header>National needs
to combat threats to public health</header><text display-inline="no-display-inline">Section 319A(d) of the Public Health Service
Act (42 U.S.C. 247d–1(d)) is amended to read as follows:</text>
<quoted-block display-inline="no-display-inline" id="id74DB587D4D0043A191169ADB6001B278" style="OLC">
<subsection id="IDf9a7907bfb594e5c8c389c39c196d190"><enum>(d)</enum><header>Authorization
of Appropriations</header><text>There are authorized to be appropriated to
carry out this section $5,000,000 for fiscal year 2007 and such sums as may be
necessary for each subsequent fiscal
year.</text>
</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="id322BBFF30EAF44A5929A092098080671"><enum>102.</enum><header>Assessment of
public health needs</header><text display-inline="no-display-inline">Section
319B of the Public Health Service Act (42 U.S.C. 247d–2) is amended—</text>
<paragraph id="id264806A6DC874937A175C7BCBE9388BD"><enum>(1)</enum><text>in subsection
(a), by inserting after the first sentence the following: <quote>Such
evaluation shall also include an assessment, using the assessment guidelines
described under subsection (d), of each of the specific critical public health
threats likely to occur in the State, or consortium of 2 or more States or
political subdivision of States performing the evaluation, including threats
resulting from natural disasters, outbreaks of disease, or a terrorist attack
involving a biological, chemical, or nuclear agent, or catastrophic accident,
and the capacity of such State, and localities within the State, or consortium
of 2 or more States or political subdivisions of States, to respond to each
such threat.</quote>;</text>
</paragraph><paragraph id="id989F3790B87443138891B3E77B056EC8"><enum>(2)</enum><text>by striking
subsection (e);</text>
</paragraph><paragraph id="idCF4FEE3DEE374E35A5C5607B5C691BD7"><enum>(3)</enum><text>by redesignating
subsection (d) as subsection (e);</text>
</paragraph><paragraph id="id59095E9394F840708DD4738A2B5D6865"><enum>(4)</enum><text>by inserting
after subsection (c) the following:</text>

<subsection id="id943DBFDF8FA542C2927B7FB9D577C08E"><enum>(d)</enum><header>Assessment
guidelines</header>
<paragraph id="idE9496DBEB0ED47F7A30934864F1EF675"><enum>(1)</enum><header>In
general</header><text>Not later than 180 days after the date of enactment of
the <short-title>All-Hazards Public Health Emergency and
Bioterrorism Preparedness and Response Act</short-title> the Secretary shall
establish guidelines for each recipient of a grant under subsection (a) to use
to conduct the assessment required under such subsection. The Secretary shall
ensure that such guidelines—</text>
<subparagraph id="id068EB3AD27C045B484DD7CEBF7259140"><enum>(A)</enum><text>enable such
recipient to—</text>
<clause id="idC822EC9AF36844F8AC261B202CD0E759"><enum>(i)</enum><text>assess the
preparedness of such recipient, and all local jurisdictions within the
boundaries of such recipient, as well as businesses, individuals, healthcare
providers, and community organizations to respond to the threats described
under subsection (a), consistent with the National Response Plan prepared under
section 502(6) of the Homeland Security Act of 2002; and</text>
</clause><clause id="idA824DA83200D46748F45A83B4792B73A"><enum>(ii)</enum><text>evaluate the
progress and performance under a grant awarded under this section and section
319C–1 with respect to such preparedness;</text>
</clause></subparagraph><subparagraph id="id160AC88B72FC492BA08925B4ADFBFB65"><enum>(B)</enum><text>are based on
specific, reasonable preparedness goals that may be objectively
measured;</text>
</subparagraph><subparagraph id="id5556BD5E0EEB45AB96A410B1B925B4B7"><enum>(C)</enum><text>define the
responsibilities of the public health entities involved in preparedness and
specifically describe the activities that are the responsibility of the Federal
Government, the State and local public health authorities, healthcare
providers, and other organizations, respectively, consistent with the National
Response Plan prepared under section 502(6) of the Homeland Security Act of
2002;</text>
</subparagraph><subparagraph id="idA9F83CD54D8E4FBCB59D9359032DCFB0"><enum>(D)</enum><text>to the extent
practicable and applicable, are harmonized with the standards of the Health
Resources and Services Administration and the Joint Commission on Accreditation
of Healthcare Organizations; and</text>
</subparagraph><subparagraph id="id330A8CF5531B4327BE78B7D222A5A68D"><enum>(E)</enum><text>clearly describe
a priority system with respect to preparedness activities.</text>
</subparagraph></paragraph><paragraph id="idBB4B1D38831D4A53818C7EDFF52C0F2B"><enum>(2)</enum><header>Annual review
and update</header>
<subparagraph id="id91E933CB9C58445E9A7D115A9C08E34A"><enum>(A)</enum><header>Review</header><text>The
Secretary shall review the guidelines described under paragraph (1) on an
annual basis.</text>
</subparagraph><subparagraph id="id458B0F8F08364DD584B2F7AA5A3E30F5"><enum>(B)</enum><header>Update</header><text>Based
on the review conducted under subparagraph (A), the Secretary may update the
guidelines described under paragraph (1) as the Secretary determines
necessary.</text>
</subparagraph></paragraph><paragraph id="id840E6DD18EDC49E5A6A6539F5943280B"><enum>(3)</enum><header>Consultation</header><text>In
developing and revising the guidelines under this subsection, the Secretary
shall consult with State, local, and community public health organizations and
expert individuals.</text>
</paragraph></subsection><after-quoted-block>;
and</after-quoted-block></quoted-block>
</paragraph><paragraph id="id1A4ED2BB71D64F4F925568F25DC69BB8"><enum>(5)</enum><text>by inserting
after subsection (e), as so redesignated, the following:</text>

<subsection id="ID4504d06add264cbea7be9cc5a952c062"><enum>(f)</enum><header>Authorization
of appropriations</header><text>There are authorized to be appropriated to
carry out this section $75,000,000 for fiscal year 2007 and such sums as may be
necessary for each subsequent fiscal
year.</text>
</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section><section id="idF3486ECF35C44F8ABCA3C3B8C3AFBA94"><enum>103.</enum><header>Grants to
improve State, local, and hospital all-hazards public health emergency and
bioterrorism preparedness and response</header>
<subsection id="idA98090CC6A4943739B82DAA11E7C9FE4"><enum>(a)</enum><header>Additional
requirements</header><text>Section 319C–1(b) of the Public Health Service Act
(42 U.S.C. 247d–3a(b)) is amended by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="id2C0071697336423C9FB954D82F76E72F" style="OLC">
<paragraph id="id06205D9B4E9945D487558029262195FE"><enum>(3)</enum><header>Other
requirements</header>
<subparagraph id="id3B01D3F43B924D018E7B3F18DB019058"><enum>(A)</enum><header>Application
content</header><text>An application under paragraph (1) shall include a letter
from the Governor or chief elected official of the eligible entity involved
that includes—</text>
<clause id="id39B659E111634962956F11D740E18509"><enum>(i)</enum><text>a
description of the amount of any funds of the eligible entity involved (without
regard to any Federal funds allocated to the eligible entity) allocated to
carry out the activities described under the award under this section;</text>
</clause><clause id="id5AF7FFFB2D624058B528F8E4DE1326D5"><enum>(ii)</enum><text>includes
assurance by the Governor or chief elected official of the eligible entity
involved that the eligible entity will conduct periodic simulation exercises to
test State and local public health emergency preparedness and, as appropriate,
will test existing emergency systems and capacity in conjunction with response
to ongoing public health challenges, such as seasonal influenza; and</text>
</clause><clause id="id3CA0A838DE694262BCF927995BCF24B2"><enum>(iii)</enum><text>demonstrates
understanding by the eligible entity involved of the performance standards that
will be used to evaluate the use of the grant funds by such eligible entity
under this section.</text>
</clause></subparagraph><subparagraph id="idE20CA47DA74A425993B07DE8183F6175"><enum>(B)</enum><header>Report on use
of funding</header><text>Not later than 60 days after the last day of each
grant year in which an eligible entity described in subsection (b)(1)(A) has
received amounts under an award under this section, such eligible entity shall
submit to the Secretary a report that includes—</text>
<clause id="id94B07A9814BB44C3AE982DCBD2DECE54"><enum>(i)</enum><text>a
detailed description of the use of the funds made available under such award,
including the amounts made available directly for expenditure by local
jurisdictions through a grant, contract, or other arrangement;</text>
</clause><clause id="idED270B0266B247CF808AE9A6C8157D4B"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id2A75F622F9964146815A24CC55D28C88"><enum>(I)</enum><text>progress on the efforts
to meet the performance standards described in the application under paragraph
(1) and the assessment guidelines under section 319B(d);</text>
</subclause><subclause id="idA951A776A80749D8BA633C622A9C67CF" indent="up1"><enum>(II)</enum><text>an explanation of any failures to meet
such performance standards or guidelines; and</text>
</subclause><subclause id="idDD6398FCD1594D1DB6F0FEACB319FCB1" indent="up1"><enum>(III)</enum><text>the current capacity of the entity to
meet such performance standards and guidelines;</text>
</subclause></clause><clause id="id7791CD3DBA6A4AE296936CDC5AA878FE"><enum>(iii)</enum><text>the findings of
any simulation exercises conducted by the entity, or local jurisdiction within
the boundaries of such entity, to test emergency preparedness, and the
remediation steps taken or planned in response to such findings; and</text>
</clause><clause id="idEE3C42B7DC514940AD017099CF8D3D8D"><enum>(iv)</enum><text>a detailed
description of the State budget expenditures of the entity on public health
emergency preparedness for the fiscal year that is the subject of the
report.</text>
</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="id05B0CDDD701544A0B71BE752F928CD19"><enum>(b)</enum><header>Accountability
for eligible entities</header><text>Section 319C–1 of the Public Health Service
Act (42 U.S.C. 247d–3a) is amended—</text>
<paragraph id="id0C747CEE219D4642915C2202F42063C1"><enum>(1)</enum><text>by striking
subsection (c) and inserting the following:</text>
<quoted-block display-inline="no-display-inline" id="id26490BACAFEE40AAA8F0421C382B9217" style="OLC">
<subsection id="id4941F816DE5345B4BC44F89FA98C0A0D"><enum>(c)</enum><header>All-Hazards
public health emergency and bioterrorism preparedness and response
plan</header>
<paragraph id="id7717992978EE41DD9AA1861E03EB4E2A"><enum>(1)</enum><header>In
general</header><text>Not later than 60 days after notification of receipt of
an award under subsection (a), an eligible entity described in subsection
(b)(1)(A) shall prepare and submit to the Secretary an All-Hazards Public
Health Emergency and Bioterrorism Preparedness and Response Plan.</text>
</paragraph><paragraph id="id6D94D2D6EA9644FCA88C661686740D50"><enum>(2)</enum><header>Content of
plan</header><text>Recognizing the assessment of public health needs and
threats conducted under section 319B, an All-Hazards Public Health Emergency
and Bioterrorism Preparedness and Response Plan submitted to the Secretary
under paragraph (1) shall—</text>
<subparagraph id="id38E87CD57D9B41E0BF0FD0FB518D21AA"><enum>(A)</enum><text>include an
assessment of basic preparedness for the threats described in section 319B(a),
using the assessment guidelines established under section 319B(d);</text>
</subparagraph><subparagraph id="id99E0BD188F9548EEB2DEFAFBF7E3D736"><enum>(B)</enum><text>describe the
performance standards under subsection (i), which shall be used to measure the
performance of the eligible entity described in subsection (b)(1)(A);</text>
</subparagraph><subparagraph id="idDD49C80FC5824052AA60B97B48123066"><enum>(C)</enum><text>include a
description of activities to be carried out by the eligible entity to address
the needs and threats identified in such assessment (or an equivalent
assessment);</text>
</subparagraph><subparagraph id="id5617E4CAA9064EAE9C31616898710395"><enum>(D)</enum><text>include a
description of any simulation exercises planned by the entity to test emergency
preparedness;</text>
</subparagraph><subparagraph id="id45D84A0727D648518CD42A537F80B97A"><enum>(E)</enum><text>include a
description of the means by which the entity will provide support to, and
coordinate with, local jurisdictions in planning and in conducting simulation
exercises to test emergency preparedness, performance assessments, and other
preparedness activities; and</text>
</subparagraph><subparagraph commented="no" id="id3D52A25304054F108CCFC2D53C0299EA"><enum>(F)</enum><text>include evidence
that a majority of local jurisdictions with a majority of the population of the
entity concur with the entity's plan.</text>
</subparagraph></paragraph><paragraph id="id589E6AB75FD347419575A0CC3AA424F7"><enum>(3)</enum><header>Approval of
plan prior to receipt of funds</header>
<subparagraph id="idFBCE901F472F4BE9B2649D38E4CC6A81"><enum>(A)</enum><header>In
general</header><text>The Secretary shall dispense only 50 percent of the
amount of an award under this section for an eligible entity described in
subsection (b)(1)(A) unless the Secretary has approved the All-Hazards Public
Health Emergency and Bioterrorism Preparedness and Response Plan submitted
under paragraph (1) by such entity.</text>
</subparagraph><subparagraph id="idA393FCEB98334761A1A797D942A27F9C"><enum>(B)</enum><header>Modification</header><text>The
Secretary may require such entity to modify the All-Hazards Public Health
Emergency and Bioterrorism Preparedness and Response Plan of such eligible
entity prior to dispensing any amount of an award not dispensed under
subparagraph (A).</text>
</subparagraph><subparagraph id="id334F41DDDFAB42F094C8D1393CC96FFD"><enum>(C)</enum><header>Approval of
plan</header><text>The Secretary shall ensure that the total amount of an award
under this section is dispensed not later than 60 days after the date of
approval by the Secretary of such All-Hazards Public Health Emergency and
Bioterrorism Preparedness and Response
Plan.</text>
</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
</paragraph><paragraph id="idECC0D5E7162F4DFE96F69A5327F6C99A"><enum>(2)</enum><text>in subsection
(e)(1)(A), by striking clause (i) and inserting the following:</text>
<quoted-block display-inline="no-display-inline" id="id550509AA016241C9AE25B1789AF3BBCC" style="OLC">
<clause id="id9877DF826AFD44408FC8E45BCE28E683"><enum>(i)</enum><text>Bioterrorism,
acute outbreaks of infectious diseases, or other threats identified in an
assessment of public health needs pursuant to section
319B(a).</text>
</clause><after-quoted-block>;</after-quoted-block></quoted-block>
</paragraph><paragraph id="id574852BFF6F4446D84A7BFBD7A1249AD"><enum>(3)</enum><text>by redesignating
subsections (i) and (j) as subsections (l) and (m), respectively; and</text>
</paragraph><paragraph id="idA8A1A1EB7F0D40B0A67B3B2F262E4CA2"><enum>(4)</enum><text>by inserting
after subsection (h) the following:</text>
<quoted-block display-inline="no-display-inline" id="id4302E33370DD40A0AC8B62F67FB50896" style="OLC">
<subsection commented="no" id="idED03C17F85BF456DA9851BC1727CE622"><enum>(i)</enum><header>Performance
standards</header>
<paragraph commented="no" id="idDFC3ADB012A64476A2CCFBEF3B39813D"><enum>(1)</enum><header>In
general</header>
<subparagraph commented="no" id="idC9FAF97372A64BE6AED2ABB81D37761D"><enum>(A)</enum><header>Establishment</header><text>Not
later than 180 days after the date of enactment of the
<short-title>All-Hazards Public Health Emergency and
Bioterrorism Preparedness and Response Act</short-title>, the Secretary shall
establish measurable performance standards with respect to basic preparedness
for the public health threats described under section 319B(a).</text>
</subparagraph><subparagraph commented="no" id="id979D05DD171F491A99713C925851F35B"><enum>(B)</enum><header>Annual
review</header><text>The Secretary shall review such performance standards on
an annual basis, and revise such standards as necessary.</text>
</subparagraph></paragraph><paragraph commented="no" id="idA19051C4766D4266A1AE1BB7C4866339"><enum>(2)</enum><header>Content</header><text>The
Secretary shall ensure that such performance standards—</text>
<subparagraph commented="no" id="id5F1859C36E5A4A37AAD2093C2B907AAF"><enum>(A)</enum><text>provide guidance
to each eligible entity described in subsection (b)(1)(A) in evaluating the
performance of such entity under a grant under this section;</text>
</subparagraph><subparagraph commented="no" id="id88E8F6EE52A947F6A2337E9E9049226E"><enum>(B)</enum><text>include standards
related to—</text>
<clause commented="no" id="idD8C0D01921994970889159C028949044"><enum>(i)</enum><text>improving
laboratory capacity;</text>
</clause><clause commented="no" id="id871946F679CD4E12B7CC692FDAA67DEA"><enum>(ii)</enum><text>measuring the
capacity of States and localities to distribute and administer medical
resources from the Strategic National Stockpile during a public health
emergency;</text>
</clause><clause commented="no" id="id9EA263B7F90147DF828DEBB35B3EAE52"><enum>(iii)</enum><text>measuring the
adequacy of State and local plans to address the needs of special needs
populations (including low-income individuals and families, disabled
individuals, the homeless, individuals who do not speak English, and the
elderly) during a public health emergency;</text>
</clause><clause commented="no" id="ID0cd994f5edc74103b9cd01315dcbc389"><enum>(iv)</enum><text>measuring public
health surge capacity including planning to assure the ability of the health
care system to rapidly expand beyond normal services to meet the increased
demand for qualified personnel, medical care, and public health services, which
would include the ability to obtain additional resources as needed;</text>
</clause><clause commented="no" id="IDcd463eb6a1a043f6bc5de161af1b4a9a"><enum>(v)</enum><text>improving
emergency risk communication plans, health information dissemination, and
public participation and understanding;</text>
</clause><clause commented="no" id="IDe21053be3887416c9ca1f34bbaae5055"><enum>(vi)</enum><text>improving public
health workforce training and recruitment;</text>
</clause><clause commented="no" id="id923AA93DB22E4EE6922762866CCD9318"><enum>(vii)</enum><text>integrating
public health preparedness with State and local emergency management
plans;</text>
</clause><clause commented="no" id="id4F596479A7204E29BDF213895F2F5590"><enum>(viii)</enum><text>assuring
coherent command and control authority at the State and local levels for
emergency response; and</text>
</clause><clause commented="no" id="IDff61ca2740504dd1be49351c9460e0cf"><enum>(ix)</enum><text>any other issue
as determined appropriate by the Secretary;</text>
</clause></subparagraph><subparagraph id="idA0888753EBF44759B5C798E47FDF009C"><enum>(C)</enum><text>are based on
specific, reasonable preparedness goals that may be objectively
measured;</text>
</subparagraph><subparagraph id="idA73B855DCD0A428BB000BDFA7A4463F4"><enum>(D)</enum><text>define the
responsibilities of the public health entities involved in preparedness and
specifically describe the activities that are the responsibility of the Federal
Government, the State or local public health authority, healthcare providers,
and other organizations, respectively, consistent with the National Response
Plan prepared under section 502(6) of the Homeland Security Act of 2002;</text>
</subparagraph><subparagraph id="id4EDC0C5F713445768308B6B4F0BF2480"><enum>(E)</enum><text>to the extent
practicable and applicable, are harmonized with the standards of the Health
Resources and Services Administration and the Joint Commission on Accreditation
of Healthcare Organizations; and</text>
</subparagraph><subparagraph id="idF4658B3112B74CC09419F2C30BACDF75"><enum>(F)</enum><text>clearly describe
a priority system with respect to preparedness activities.</text>
</subparagraph></paragraph><paragraph id="idB37F4E81F3204F06ABB2339C206C3CEC"><enum>(3)</enum><header>Consultation</header><text>In
developing and revising the performance standards under this subsection, the
Secretary shall consult with State, local, and community public health
organizations and expert individuals.</text>
</paragraph></subsection><subsection id="idC7755AE8A4D54BAEB3948D6135921B61"><enum>(j)</enum><header>Biennial
evaluation; report</header>
<paragraph id="id8DD6C51C17154DBD932A98B995B6DE26"><enum>(1)</enum><header>In
general</header><text>Not later than September 30, 2008, and on a biennial
basis thereafter, the Secretary—</text>
<subparagraph id="id2FCF3132D2BD48078A7AAF948127BA8C"><enum>(A)</enum><text>shall conduct an
evaluation of each eligible entity described in subsection (b)(1)(A) with
respect to—</text>
<clause id="idAE01778DC8BC40DFB8159CD5746EBB1E"><enum>(i)</enum><text>preparedness for
the threats described under section 319B(a); and</text>
</clause><clause id="id04F0331A39924D5381759F8B6C59E264"><enum>(ii)</enum><text>the progress and
performance of such eligible entity under a grant awarded under this
section;</text>
</clause></subparagraph><subparagraph commented="no" id="id526C7CC9CE4D499DB76CB4CC484B2228"><enum>(B)</enum><text>shall include in
such evaluation an assessment of the extent to which the eligible entity meets
each performance standard established pursuant to subsection (i); and</text>
</subparagraph><subparagraph id="id5A590F0BA0004259A0D9B04F43658AB5"><enum>(C)</enum><text>may contract with
an entity to conduct such evaluation.</text>
</subparagraph></paragraph><paragraph id="id2DBC021CA3C54CD4994F51E4CE89EACA"><enum>(2)</enum><header>Report</header><text>On
a biennial basis, the Secretary shall publish by October 1, a report that
describes the outcome of each evaluation conducted under paragraph (1).</text>
</paragraph><paragraph id="idB48BBD9EC828427AA99D50F889587BC2"><enum>(3)</enum><header>Dissemination
to the public</header><text>The Secretary shall make available to the public
the report described under paragraph (2) to the extent that such availability
does not threaten national security, as determined by the Secretary.</text>
</paragraph></subsection><subsection id="idB907B528310D42B3BF938DC4714B1DEC"><enum>(k)</enum><header>Working
group</header>
<paragraph id="id689256C096D640AE97F59F634C7232A0"><enum>(1)</enum><header>In
general</header><text>The Secretary shall convene a working group that shall
develop successful means for the eligible entity described in subsection
(b)(1)(A) to disseminate information regarding best practices of preparing for
the threats described under section 319B(a) using the funding awarded under a
grant under this section.</text>
</paragraph><paragraph id="id0428D8F225DF4D9ABBBBD2BD4B76CC93"><enum>(2)</enum><header>Consultation</header><text>In
convening the working group under paragraph (1), the Secretary may consult with
national and local public health organizations, healthcare providers, and other
stakeholders that have expertise in preparedness for bioterrorism and other
public health
emergencies.</text>
</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection><subsection commented="no" id="id648E8D9D7DCF404FA16FFF0629820804"><enum>(c)</enum><header>Funding</header><text>Section
319C–1(m) of the Public Health Service Act (42 U.S.C. 247d–3a(j)), as
redesignated by subsection (b), is amended—</text>
<paragraph id="idA5D17938087A4FD29F133E5BBE0F1AEE"><enum>(1)</enum><text>in paragraph (1),
by striking subparagraph (A) and (B) and inserting the following:</text>
<quoted-block display-inline="no-display-inline" id="idEF4C672D9DFD4572B36FDE0A36D1BB99" style="OLC">
<subparagraph id="IDDD81314BD1D84965AE65705C835A5B8D"><enum>(A)</enum><header>Fiscal year
2007</header>
<clause id="IDAC936DCD30CD4018842BE90283E4184D"><enum>(i)</enum><header>Authorizations</header><text>For
the purpose of carrying out this section, there is authorized to be
appropriated $1,700,000,000 for fiscal year 2007, of which—</text>
<subclause id="IDEF84A7271E1F4BFEA543777E7E113ABB"><enum>(I)</enum><text>$950,000,000 is
authorized to be appropriated for awards pursuant to paragraph (3) (subject to
the authority of the Secretary to make awards pursuant to paragraphs (4) and
(5)); and</text>
</subclause><subclause id="IDFDD0303CD3AD420BBDDEB08DF6AB28C1"><enum>(II)</enum><text>$750,000,000 is
authorized to be appropriated—</text>
<item id="IDFB91951C06694015ACB0E87F90F134CD"><enum>(aa)</enum><text>for awards under
subsection (a) to States, notwithstanding the eligibility conditions under
subsection (b), for the purpose of enhancing the preparedness of hospitals
(including children's hospitals), clinics, health centers, and primary care
facilities for bioterrorism and other public health emergencies; and</text>
</item><item id="ID9F473FCAF88A48EC803EBCFCAA3E1663"><enum>(bb)</enum><text>for Federal,
State, and local planning and administrative activities related to such
purpose.</text>
</item></subclause></clause><clause id="ID6E020916D46D4075B593DE0D26BA4055"><enum>(ii)</enum><header>Contingent
additional authorization</header><text>If a significant change in circumstances
warrants an increase in the amount authorized to be appropriated under clause
(i) for fiscal year 2007, there are authorized to be appropriated such sums as
may be necessary for such year for carrying out this section, in addition to
the amount authorized in clause (i).</text>
</clause></subparagraph><subparagraph id="ID7C19032EE6504AD2B04E3B7A550257D4"><enum>(B)</enum><header>Fiscal year
2008</header><text>For the purpose of carrying out this section, there are
authorized to be appropriated $1,800,000,000 for fiscal year 2008, of
which—</text>

authorized for awards described under subparagraph (A)(i)(I); and</text>

authorized to be appropriated $1,800,000,000 of which—</text>

<clause id="id2DC8E3FC486448FA9A0A5675472CB0E9"><enum>(i)</enum><header>In
general</header><text>Beginning in fiscal year 2008, and each fiscal year
thereafter, the Secretary may withhold distributions of funding under an award
under this section if the Secretary determines—</text>
<subclause id="idC7CBB327D296443EBA1FA7CD4A6DF1B1"><enum>(I)</enum><text>that the eligible
entity has not sufficiently met the guidelines under section 319B(d) and
performance standards described in the application under subsection (b)(3)
involved for the previous fiscal year and has not demonstrated that efforts to
meet such guidelines and performance standards are in place;</text>
</subclause><subclause id="id780AFDA5159748A4B0A175572FC712FD"><enum>(II)</enum><text>that such
eligible entity has expended such funding for the previous fiscal year on
activities inconsistent with the applicable All-Hazards Public Health Emergency
and Bioterrorism Preparedness and Response Plan.</text>
</subclause></clause><clause id="id620B40B3E05F4986B86DBFEB936BE532"><enum>(ii)</enum><header>Exception</header><text>For
purposes of applying clause (i), the Secretary may grant a waiver with respect
to the designated activities described in clause (i)(II).</text>
</clause></subparagraph><subparagraph id="id0D9824BAACB148D4B4FC53F41B66A6B6"><enum>(B)</enum><header>Maximum
carryover amount</header>
<clause id="idB34E06D96D2B445DB0B213ABAECE1D57"><enum>(i)</enum><header>In
general</header><text>For each fiscal year, the Secretary shall determine the
maximum percentage amount of an award under this section that an eligible
entity may carryover to the succeeding fiscal year.</text>
</clause><clause id="id6BC942C1DF154F07A434C6DC87447742"><enum>(ii)</enum><header>Amount
exceeded</header><text>For each fiscal year, if the percentage amount of an
award under this section unexpended by an eligible entity exceeds the maximum
percentage permitted by the Secretary under clause (i), the eligible entity
shall return to the Secretary the portion of the unexpended amount that exceeds
the maximum amount permitted to be carried over by the Secretary.</text>
</clause><clause id="idB08FD9FC9C374F4383E4EEA2D2BCEA0C"><enum>(iii)</enum><header>Action by
Secretary</header><text>The Secretary shall redistribute any amount returned to
the Secretary under clause (ii) to other eligible entities that demonstrate
need and capacity to expend such funds appropriately within the next fiscal
year, as determined by the Secretary.</text>
</clause><clause id="id3AE53F95420A412F90C9F49855CA3957"><enum>(iv)</enum><header>Waiver</header><text>An
eligible entity may apply to the Secretary for a waiver of the maximum
percentage amount under clause (i). Such an application for a waiver shall
include an explanation why such requirement should not apply to the eligible
entity and the steps taken by such eligible entity to ensure that all funds
under an award under this section will be expended
appropriately.</text>
</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection><subsection id="idF008B2C18F5146D18ABD881E97381A8C"><enum>(d)</enum><header>Conforming
amendments</header><text>Section 319C–1 of the Public Health Service Act (42
U.S.C. 247d–3a) is amended—</text>

Secretary of Health and Human Services shall conduct a study that analyzes the
size and scope of the healthcare and public health workforces necessary to
respond to a range of common public health issues and public health
emergencies.</text>
</paragraph><paragraph id="id3FC1B81585984CAC9C4F4645D60EB9DE"><enum>(2)</enum><header>Report to
Congress</header><text>Not later than 270 days after the date of enactment of
this Act, the Secretary of Health and Human Services shall submit to Congress a
report that describes the outcomes of the study conducted pursuant to paragraph
(1), including any recommendations for legislation.</text>
</paragraph></subsection><subsection id="id1593B7C216AC4B03BA1B85023621E5C4"><enum>(b)</enum><header>Authorization
of appropriations</header><text>There are authorized to be appropriated
$1,000,000 to carry out this section.</text>

Act, beginning with fiscal year 2008, any entity that receives a grant under
this Act to provide health-related services, or any other entity as the
Secretary determines appropriate, shall, as a condition of receiving such a
grant, provide assurance to the Secretary that such entity has a plan for
operational continuity in the event of bioterrorism or other public health
emergency.</text>

waive State share requirements and to allow presumptive eligibility for any
category of eligible individuals under medicaid and SCHIP during State

preparedness workforce development</header>

Workforce Scholarship and Loan Repayment Program</header><text display-inline="no-display-inline">Part E of title VII of the
<act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
294n et seq.) is amended by adding at the end the following:</text>

Workforce Scholarship Program</header>
<subsection id="ID0252A89A50B340F6A38CD08C0DF7EACA"><enum>(a)</enum><header>Establishment</header><text>The
Secretary shall establish the Public Health Workforce Scholarship Program
(referred to in this section as the <quote>Program</quote>) to assure an
adequate supply of public health professionals to eliminate critical public
health preparedness workforce shortages in Federal, State, local, and tribal
public health agencies.</text>
</subsection><subsection id="ID3CF78A1AF00E4FDFA3F2F8B2F3289380"><enum>(b)</enum><header>Eligibility</header><text>To
be eligible to participate in the Program, an individual shall—</text>
<paragraph id="ID81B7B1E65B454296A3203377D067A68D"><enum>(1)</enum><text>be accepted for
enrollment, or be enrolled, as a full-time student—</text>
<subparagraph id="ID128D740F207946E0A72C1C4549C13A48"><enum>(A)</enum><text>in an accredited
(as determined by the Secretary) educational institution in a State or
territory; and</text>
</subparagraph><subparagraph id="ID7C89C6B168B84F2BA7C7E5F6AE0BCBA1"><enum>(B)</enum><text>in a course of
study or program, offered by such institution and approved by the Secretary,
leading to a health professions degree (graduate, undergraduate, or associate)
or certificate, which may include laboratory sciences, epidemiology,
environmental health, health communications, health education and behavioral
sciences, information sciences, or public administration;</text>
</subparagraph></paragraph><paragraph id="IDD733248DFFD04725B1C777AA57CC5206"><enum>(2)</enum><text>be a United
States citizen;</text>
</paragraph><paragraph id="IDF8DC589261D24109B3EE93E4DDAC6DBF"><enum>(3)</enum><text>submit an
application to the Secretary to participate in the Program; and</text>
</paragraph><paragraph id="ID8472E6C37EBF42518A33FE724B67C505"><enum>(4)</enum><text>sign and submit
to the Secretary, at the time of the submittal of such application, a written
contract (described in subsection (d)) to serve, upon the completion of the
course of study or program involved, for the applicable period of obligated
service in the full-time employment of a Federal, State, local, or tribal
public health agency.</text>
</paragraph></subsection><subsection id="IDC9C3CB162E8941E99A4FF56B891E8881"><enum>(c)</enum><header>Dissemination
of information</header>
<paragraph id="IDE7A76CBE3DE84C1BADC487C08014A174"><enum>(1)</enum><header>Application and
contract forms</header><text>The Secretary shall disseminate application forms
and contract forms to individuals desiring to participate in the Program. The
Secretary shall include with such forms—</text>
<subparagraph id="IDE2288B5C88AC44EA9DDBB78DC8AB40A3"><enum>(A)</enum><text>a fair summary of
the rights and liabilities of an individual whose application is approved (and
whose contract is accepted) by the Secretary, including in the summary a clear
explanation of the damages to which the United States is entitled to recover in
the case of the individual’s breach of the contract; and</text>
</subparagraph><subparagraph id="IDDD67D8B0C65F44E09EE26D39935A16D1"><enum>(B)</enum><text>information
relating to the service obligation and such other information as may be
necessary for the individual to understand the individual’s prospective
participation in the Program.</text>
</subparagraph></paragraph><paragraph id="IDED005B4FE32D476F9734E9D495AC7CAF"><enum>(2)</enum><header>Information for
schools</header><text>The Secretary shall distribute to health professions
schools and other appropriate accredited academic institutions and relevant
Federal, State, local, and tribal public health agencies, materials providing
information on the Program and shall encourage such schools, institutions, and
agencies to disseminate such materials to potentially eligible students.</text>
</paragraph><paragraph id="IDE1C32E52DFBF46E8BDCB1955BC03F919"><enum>(3)</enum><header>Understandability
and timing</header><text>The application form, contract form, and all other
information furnished by the Secretary under this section shall—</text>
<subparagraph id="IDCA7FB091F1F44F0EB8F4B70022CB9B44"><enum>(A)</enum><text>be written in a
manner calculated to be understood by the average individual applying to
participate in the Program; and</text>
</subparagraph><subparagraph id="IDD36C3ABDAC734699B4345DD7FE14412E"><enum>(B)</enum><text>be made available
by the Secretary on a date sufficiently early to ensure that such individuals
have adequate time to carefully review and evaluate such forms and
information.</text>
</subparagraph></paragraph></subsection><subsection id="ID398392CC1D7E4FFDA207541641A2430B"><enum>(d)</enum><header>Contract</header><text>The
written contract (referred to in this section) between the Secretary and an
individual shall contain—</text>
<paragraph id="ID038A475C1DFF40EE99F6312BC4DCF469"><enum>(1)</enum><text>an agreement on
the part of the Secretary that the Secretary will provide the individual with a
scholarship for a period of years (not to exceed 4 academic years) during which
the individual shall pursue an approved course of study or program to prepare
the individual to serve in the public health workforce;</text>
</paragraph><paragraph id="ID9EC1ABB82A1C489F894951AF09B27A5B"><enum>(2)</enum><text>an agreement on
the part of the individual that the individual will—</text>
<subparagraph id="IDAE55822D957342A2ACBEEEF6DEAD4B82"><enum>(A)</enum><text>maintain
full-time enrollment in the approved course of study or program described in
subsection (b)(1) until the individual completes that course of study or
program;</text>
</subparagraph><subparagraph id="ID6593E79C3A9C4BB2B456CEA9C67EBB17"><enum>(B)</enum><text>while enrolled in
the course of study or program, maintain an acceptable level of academic
standing (as determined under regulations of the Secretary by the educational
institution offering such course of study or program); and</text>
</subparagraph><subparagraph id="IDFF2D10C36D934833AA09A023968D4DB3"><enum>(C)</enum><text>immediately upon
graduation, serve in the full-time employment of a Federal, State, local, or
tribal public health agency in a position related to the course of study or
program for which the contract was awarded for a period of time (referred to in
this section as the <quote>period of obligated service</quote>) equal to the
greater of—</text>
<clause id="IDC40AA616F6434A1690D53C9777390CC2"><enum>(i)</enum><text>1
year for each academic year for which the individual was provided a scholarship
under the Program; or</text>
</clause><clause id="ID742ACE47708A4797A2592E5574AC4AD4"><enum>(ii)</enum><text>2 years;</text>
</clause></subparagraph></paragraph><paragraph id="ID8C8EC44BAC0D4903881A8050BAC00633"><enum>(3)</enum><text>an agreement by
both parties as to the nature and extent of the scholarship assistance, which
may include—</text>
<subparagraph id="ID024BA56308F246398E31A18CD2355BBB"><enum>(A)</enum><text>payment of the
tuition expenses of the individual;</text>
</subparagraph><subparagraph id="ID5A7B65B10C7B4C968FFAA394796ACB02"><enum>(B)</enum><text>payment of all
other reasonable educational expenses of the individual including fees, books,
equipment and laboratory expenses; and</text>
</subparagraph><subparagraph id="ID304D1CB376D841F99320D38E6F0C5FDE"><enum>(C)</enum><text>payment of a
stipend of not more than $1,200 per month for each month of the academic year
involved (indexed to account for increases in the Consumer Price Index);
and</text>
</subparagraph></paragraph><paragraph id="ID1DB5E3C0880A4630A54AA961958874BB"><enum>(4)</enum><text>a provision that
any financial obligation of the United States arising out of a contract entered
into under this section and any obligation of the individual which is
conditioned thereon, is contingent upon funds being appropriated for
scholarships under this section;</text>
</paragraph><paragraph id="ID990ABCDD82484F6E9FEF6F2F8FAF6DD1"><enum>(5)</enum><text>a statement of
the damages to which the United States is entitled for the individual’s breach
of the contract; and</text>
</paragraph><paragraph id="ID96AD91655FC246C99333841429668FF0"><enum>(6)</enum><text>such other
statements of the rights and liabilities of the Secretary and of the
individual, not inconsistent with the provisions of this section.</text>
</paragraph></subsection><subsection id="ID78E71E50C385486BAE057F0D089418AF"><enum>(e)</enum><header>Postponing
Obligated Service</header><text>With respect to an individual receiving a
degree or certificate from a school of medicine, public health, nursing,
osteopathic medicine, dentistry, veterinary medicine, optometry, podiatry,
pharmacy, psychology, or social work under a scholarship under the Program, the
date of the initiation of the period of obligated service may be postponed,
upon the submission by the individual of a petition for such postponement and
approval by the Secretary, to the date on which the individual completes an
approved internship, residency, or other relevant public health preparedness
advanced training program.</text>
</subsection><subsection id="ID160A0206C3A346458A7E32D8369DD065"><enum>(f)</enum><header>Administrative
Provisions</header>
<paragraph id="ID59940C93E2044539A6758202EABFFB67"><enum>(1)</enum><header>Contracts with
institutions</header><text>The Secretary may contract with an educational
institution in which a participant in the Program is enrolled, for the payment
to the educational institution of the amounts of tuition and other reasonable
educational expenses described in subsection (d)(3).</text>
</paragraph><paragraph id="ID0BD8CF25937A4B46BF414A4A514B9C1C"><enum>(2)</enum><header>Employment
ceilings</header><text>Notwithstanding any other provision of law, individuals
who have entered into written contracts with the Secretary under this section,
while undergoing academic training, shall not be counted against any employment
ceiling affecting the Department or any other Federal agency.</text>
</paragraph></subsection><subsection id="ID7933C0D80483446984A801BE3969E8B7"><enum>(g)</enum><header>Breach of
Contract</header><text>An individual who fails to comply with the contract
entered into under subsection (d) shall be subject to the same financial
penalties as provided for under section 338E for breaches of scholarship
contracts under sections 338A.</text>
</subsection></section><section id="IDF0224DB5B79F4F11BAD87C79E6A9E17B"><enum>781.</enum><header>Public Health
Workforce Loan Repayment Program</header>
<subsection id="ID5013D34F06BC431EBFC380D231D02F32"><enum>(a)</enum><header>Establishment</header><text>The
Secretary shall establish the Public Health Workforce Loan Repayment Program
(referred to in this section as the <quote>Program</quote>) to assure an
adequate supply of public health professionals to eliminate critical public
health preparedness workforce shortages in Federal, State, local, and tribal
public health agencies.</text>
</subsection><subsection id="IDA9800A4AD5B84BE9897A330EA6F3309D"><enum>(b)</enum><header>Eligibility</header><text>To
be eligible to participate in the Program, an individual shall—</text>
<paragraph id="ID5592BAA010224212BFBC2CC41D250610"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID885F22689DA144BD9B43BFDD52C24BE9"><enum>(A)</enum><text>be accepted for
enrollment, or be enrolled, as a full-time or part-time student in an
accredited academic educational institution in a State or territory in the
final year of a course of study or program offered by that institution leading
to a health professions degree or certificate, which may include a degree
(graduate, undergraduate, or associate) or certificate relating to laboratory
sciences, epidemiology, environmental health, health communications, health
education and behavioral sciences, information sciences, or public
administration; or</text>
</subparagraph><subparagraph id="ID29675DCB32C8419E9FA586DD8864D39A" indent="up1"><enum>(B)</enum><text>have graduated, within 10 years, from
an accredited educational institution in a State or territory and received a
health professions degree (graduate, undergraduate, or associate) or
certificate, which may include a degree (graduate, undergraduate, or associate)
or certificate relating to laboratory sciences, epidemiology, environmental
health, health communications, health education and behavioral sciences,
information sciences, or public administration;</text>
</subparagraph></paragraph><paragraph id="IDA427A8A0F47742138FB879117D60FC1B"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="IDA3C5CB91205A4550A268696DB97C38F4"><enum>(A)</enum><text>in the case of an
individual described in paragraph (1)(A), have accepted employment with a
Federal, State, local, or tribal public health agency, as recognized by the
Secretary, to commence upon graduation; or</text>
</subparagraph><subparagraph id="IDF9CF66B1118F46FE803BCCA3049D26AE" indent="up1"><enum>(B)</enum><text>in the case of an individual described
in paragraph (1)(B), be employed by, or have accepted employment with, a
Federal, State, local, or tribal public health agency, as recognized by the
Secretary;</text>
</subparagraph></paragraph><paragraph id="IDAA15F5CD2A53411A8B6C44FA072DC8A4"><enum>(3)</enum><text>be a United
States citizen;</text>
</paragraph><paragraph id="ID75BD420161DE44F7B40C5CAB11791D8F"><enum>(4)</enum><text>submit an
application to the Secretary to participate in the Program; and</text>
</paragraph><paragraph id="ID46B133C1C90E46B0B551C104185C9F34"><enum>(5)</enum><text>sign and submit
to the Secretary, at the time of the submittal of such application, a written
contract (described in subsection (d)) to serve for the applicable period of
obligated service in the full-time employment of a Federal, State, local, or
tribal public health agency.</text>
</paragraph></subsection><subsection id="IDC8F3446673404A26818C673513BC6E1E"><enum>(c)</enum><header>Dissemination
of Information</header>
<paragraph id="ID29C71AF8A25741EC9282BB8F74F9EC8B"><enum>(1)</enum><header>Application and
contract forms</header><text>The Secretary shall disseminate application forms
and contract forms to individuals desiring to participate in the Program. The
Secretary shall include with such forms—</text>
<subparagraph id="IDAB6311401CB747E9884826E684236C53"><enum>(A)</enum><text>a fair summary of
the rights and liabilities of an individual whose application is approved (and
whose contract is accepted) by the Secretary, including in the summary a clear
explanation of the damages to which the United States is entitled to recover in
the case of the individual’s breach of the contract; and</text>
</subparagraph><subparagraph id="ID5263931B8961404797DF450106F1ACCC"><enum>(B)</enum><text>information
relating to the service obligation and such other information as may be
necessary for the individual to understand the individual’s prospective
participation in the Program.</text>
</subparagraph></paragraph><paragraph id="IDE68D1F868F9C48D6AC92950CE301936E"><enum>(2)</enum><header>Information for
schools</header><text>The Secretary shall distribute to health professions
schools and other appropriate accredited academic institutions and relevant
Federal, State, local, and tribal public health agencies, materials providing
information on the Program and shall encourage such schools, institutions, and
agencies to disseminate such materials to potentially eligible students.</text>
</paragraph><paragraph id="ID4F6C89EC70A64D75BA5598F8E80CF80D"><enum>(3)</enum><header>Understandability
and timing</header><text>The application form, contract form, and all other
information furnished by the Secretary under this section shall—</text>
<subparagraph id="ID3955EBF04B4B4EA5B7D6F4EC8F34BFA2"><enum>(A)</enum><text>be written in a
manner calculated to be understood by the average individual applying to
participate in the Program; and</text>
</subparagraph><subparagraph id="ID853B559FC271485CA090D4B0614BBD06"><enum>(B)</enum><text>be made available
by the Secretary on a date sufficiently early to ensure that such individuals
have adequate time to carefully review and evaluate such forms and
information.</text>
</subparagraph></paragraph></subsection><subsection id="ID9C9C23B261B7492894A268F83DD894C7"><enum>(d)</enum><header>Contract</header><text>The
written contract (referred to in this section) between the Secretary and an
individual shall contain—</text>
<paragraph id="ID6FC48ECEF6FF424594F88A1C44D3D523"><enum>(1)</enum><text>an agreement on
the part of the Secretary that the Secretary will repay on behalf of the
individual loans incurred by the individual in the pursuit of the relevant
public health preparedness workforce educational degree or certificate in
accordance with the terms of the contract;</text>
</paragraph><paragraph id="ID0894061DDAF84762BEAED7AF0C5C55F4"><enum>(2)</enum><text>an agreement on
the part of the individual that the individual will serve, immediately upon
graduation in the case of an individual described in subsection (b)(1)(A)
service, or in the case of an individual described in subsection (b)(1)(B)
continue to serve, in the full-time employment of a Federal, State, local, or
tribal public health agency in a position related to the course of study or
program for which the contract was awarded for a period of time (referred to in
this section as the <quote>period of obligated service</quote>) equal to the
greater of—</text>
<subparagraph id="ID0D84220474D94F53B33DEEE4CD8DFE17"><enum>(A)</enum><text>3 years;
or</text>
</subparagraph><subparagraph id="idAB4123660F8D4F488D9DA6E9BA09BBE5"><enum>(B)</enum><text>such longer
period of time as determined appropriate by the Secretary and the
individual;</text>
</subparagraph></paragraph><paragraph id="ID3D411551AF3E49E6BF6B2330FA5915CB"><enum>(3)</enum><text>an agreement, as
appropriate, on the part of the individual to relocate for the entire period of
obligated service to a political jurisdiction designated by the Secretary to be
a priority service area in exchange for an additional loan repayment incentive
amount that does not exceed 20 percent of the individual’s eligible loan
repayment award per academic year such that the total of the loan repayment and
the incentive amount shall not exceed <fraction>1/3</fraction> of the eligible
loan balance per year;</text>
</paragraph><paragraph id="IDE8E5C956786742FCB02EFAB8DD0B73DD"><enum>(4)</enum><text>in the case of an
individual described in subsection (b)(1)(A) who is in the final year of study
and who has accepted employment with a Federal, State, local, or tribal public
health agency upon graduation, an agreement on the part of the individual to
complete the education or training, maintain an acceptable level of academic
standing (as determined by the education institution offering the course of
study or training), and agree to the period of obligated service;</text>
</paragraph><paragraph id="ID3C19FDB8491F4259A3D53AE65E444938"><enum>(5)</enum><text>a provision that
any financial obligation of the United States arising out of a contract entered
into under this section and any obligation of the individual that is
conditioned thereon, is contingent on funds being appropriated for loan
repayments under this section;</text>
</paragraph><paragraph id="ID7CB2C71B39644B9EBE6E73E4AE5148A9"><enum>(6)</enum><text>a statement of
the damages to which the United States is entitled, under this section for the
individual’s breach of the contract; and</text>
</paragraph><paragraph id="ID9D7728758D9244D9BF4D04C6A93EAE19"><enum>(7)</enum><text>such other
statements of the rights and liabilities of the Secretary and of the
individual, not inconsistent with this section.</text>
</paragraph></subsection><subsection id="IDE3E3930AD83E438AA62A9B133756D546"><enum>(e)</enum><header>Payments</header>
<paragraph id="ID4986F4D5104E4CAD8EAAAF551AA2B900"><enum>(1)</enum><header>In
general</header><text>A loan repayment provided for an individual under a
written contract under the Program shall consist of payment, in accordance with
paragraph (2), on behalf of the individual of the principal, interest, and
related expenses on government and commercial loans received by the individual
regarding the undergraduate or graduate education of the individual (or both),
which loans were made for—</text>
<subparagraph id="ID7183755E507142BCA129ECBDCF3B24CF"><enum>(A)</enum><text>tuition expenses;
or</text>
</subparagraph><subparagraph id="IDE381E7A8E8A2454287CF1F5773DAD450"><enum>(B)</enum><text>all other
reasonable educational expenses, including fees, books, and laboratory
expenses, incurred by the individual.</text>
</subparagraph></paragraph><paragraph id="ID6745F5FE66A34626AD91BF136CC1D9E7"><enum>(2)</enum><header>Payments for
years served</header>
<subparagraph id="ID92CA2CEE5AA34DE28DF4EC723B52ABCF"><enum>(A)</enum><header>In
general</header><text>For each year of obligated service that an individual
contracts to serve under subsection (d) the Secretary may pay up to $35,000 on
behalf of the individual for loans described in paragraph (1). With respect to
participants under the Program whose total eligible loans are less than
$105,000, the Secretary shall pay an amount that does not exceed
<fraction>1/3</fraction> of the eligible loan balance for each year of
obligated service of the individual.</text>
</subparagraph><subparagraph id="ID755AAD1881BB463DA957C87F3448CAA8"><enum>(B)</enum><header>Repayment
schedule</header><text>Any arrangement made by the Secretary for the making of
loan repayments in accordance with this subsection shall provide that any
repayments for a year of obligated service shall be made no later than the end
of the fiscal year in which the individual completes such year of
service.</text>
</subparagraph></paragraph><paragraph id="IDFEDF4C92DA434C07942CDD17971E9046"><enum>(3)</enum><header>Tax
liability</header><text>For the purpose of providing reimbursements for tax
liability resulting from payments under paragraph (2) on behalf of an
individual—</text>
<subparagraph id="IDF386C5B94C0D4FE5925C745ED0AB043D"><enum>(A)</enum><text>the Secretary
shall, in addition to such payments, make payments to the individual in an
amount not to exceed 39 percent of the total amount of loan repayments made for
the taxable year involved; and</text>
</subparagraph><subparagraph id="IDF1FA5D6FB72B464992149DDF146D34B0"><enum>(B)</enum><text>may make such
additional payments as the Secretary determines to be appropriate with respect
to such purpose.</text>
</subparagraph></paragraph><paragraph id="ID4C5BCA44402042CE9A3B7E775E794692"><enum>(4)</enum><header>Payment
schedule</header><text>The Secretary may enter into an agreement with the
holder of any loan for which payments are made under the Program to establish a
schedule for the making of such payments.</text>
</paragraph></subsection><subsection id="ID3DFEB939C7F34FEE835E502E2A31009C"><enum>(f)</enum><header>Postponing
obligated service</header><text>With respect to an individual receiving a
degree or certificate from a school of medicine, public health, nursing,
osteopathic medicine, dentistry, veterinary medicine, optometry, podiatry,
pharmacy, psychology, or social work, the date of the initiation of the period
of obligated service may be postponed, upon the submission by the individual of
a petition for such postponement and approval by the Secretary, to the date on
which the individual completes an approved internship, residency, or other
relevant public health preparedness advanced training program.</text>
</subsection><subsection id="ID0E828339099947A2AA2C0B3575DA06E0"><enum>(g)</enum><header>Administrative
provisions</header>
<paragraph id="ID42470CCC02A645908CB351C83139B42F"><enum>(1)</enum><header>Hiring
priority</header><text>Notwithstanding any other provision of law, Federal,
State, local, and tribal public health agencies may give hiring priority to any
individual who has qualified for and is willing to execute a contract to
participate in the Program.</text>
</paragraph><paragraph id="ID575202E981674794980C1FDC1A29053F"><enum>(2)</enum><header>Employment
ceilings</header><text>Notwithstanding any other provision of law, individuals
who have entered into written contracts with the Secretary under this section,
who are serving as full-time employees of a State, local, or tribal public
health agency, or who are in the last year of public health workforce academic
preparation, shall not be counted against any employment ceiling affecting the
Department or any other Federal agency.</text>
</paragraph></subsection><subsection id="IDB7BD983C82214EF1B1CB73ADDDD06219"><enum>(h)</enum><header>Breach of
contract</header><text>An individual who fails to comply with the contract
entered into under subsection (d) shall be subject to the same financial
penalties as provided for under section 338E for breaches of loan repayment
contracts under section 338B.</text>
</subsection></section><section id="ID79F602E8398F4119856BB2E2A0E0100B"><enum>782.</enum><header>Grants for
State and local programs</header>
<subsection id="IDC984BF60CA524760B0A693D69A121A6A"><enum>(a)</enum><header>In
general</header><text>For the purpose of operating State, local, and tribal
public health workforce loan repayment programs, the Secretary shall award a
grant to any public health agency that receives public health preparedness
cooperative agreements, or other successor cooperative agreements, from the
Department of Health and Human Services.</text>
</subsection><subsection id="ID42673CFCE9F54EA6BF97A92271F01A82"><enum>(b)</enum><header>Requirements</header><text>A
State or local loan repayment program operated with a grant under subsection
(a) shall incorporate all provisions of the Public Health Workforce Loan
Repayment Program under section 781, including the ability to designate
priority service areas within the relevant political jurisdiction.</text>
</subsection><subsection id="IDED75B53FCCEC434DBF3F48F4E999DF9C"><enum>(c)</enum><header>Administration</header><text>The
head of the State or local office that receives a grant under subsection (a)
shall be responsible for contracting and operating the loan repayment program
under the grant.</text>
</subsection><subsection id="IDEFE709ADF3F44732964073DFC26EEE5D"><enum>(d)</enum><header>Rule of
construction</header><text>Nothing in this section shall be construed to
obligate or limit any State, local, or tribal government entity from
implementing independent or supplemental public health workforce development
programs within their borders.</text>
</subsection></section><section id="IDA2921DE96F504BB08A995D01FC81348E"><enum>783.</enum><header>Catalogue of
Federal public health workforce employment opportunities</header>
<subsection id="ID1B739435D0FB4370A60CC7AEE2FA2619"><enum>(a)</enum><header>In
general</header><text>The Director of the Office of Personnel Management, in
cooperation with the Secretary, shall ensure that within the Office of
Personnel Management’s website, there is an on-line catalogue of public health
workforce employment opportunities in the Federal Government.</text>
</subsection><subsection id="ID8E09D5FA86F14FB6B32E2390CFA1A613"><enum>(b)</enum><header>Requirements</header><text>To
the extent practical, the catalogue described in subsection (a) shall
include—</text>
<paragraph id="ID32E18553FB9A446CB30B225078DCA3FF"><enum>(1)</enum><text>existing and
projected job openings in the Federal public health workforce; and</text>
</paragraph><paragraph id="ID8BEBBF2D4BC94A3394D29ABD5C94318E"><enum>(2)</enum><text>a general
discussion of the occupations that comprise the Federal public health
workforce.</text>
</paragraph></subsection><subsection id="IDC8DC1B90FFDE40F3B808F7D9047165BC"><enum>(c)</enum><header>Information</header><text>The
Secretary shall include a copy of the catalogue, or a prominent reference to
the catalogue, in—</text>
<paragraph id="ID5AF08BB74FC744D19BB605E1E0747CBC"><enum>(1)</enum><text>the information
for schools provided under section 780(c)(2) and 781(c)(2); and</text>
</paragraph><paragraph id="IDD675562BA96B4426B8F25C3419E5764A"><enum>(2)</enum><text>the application
forms provided under sections 780(c)(1) and 781(c)(1).</text>
</paragraph></subsection></section><section id="ID6F3D27B8CDFD4E41B6CE6F12A6CF06F7"><enum>784.</enum><header>Authorization
of appropriations</header>
<subsection id="IDC4323E543B184C7ABA1C4110C59875C2"><enum>(a)</enum><header>Scholarship
program</header><text>For the purpose of carrying out section 780, there is
authorized to be appropriated $35,000,000 for fiscal year 2006, and such sums
as may be necessary for each of fiscal years 2007 through 2011.</text>
</subsection><subsection id="IDF913C614165B4F4F820C48DB2BB55214"><enum>(b)</enum><header>Loan repayment
programs</header>
<paragraph id="IDE3D47D11897A4266A4012BE966BA4B40"><enum>(1)</enum><header>In
general</header><text>For the purpose of carrying out sections 781 and 782,
there is authorized to be appropriated $195,000,000 for fiscal year 2006, and
such sums as may be necessary for each of fiscal years 2007 through
2011.</text>
</paragraph><paragraph id="ID8EE6FD37BD1F4CEEBEDC5CB5F30BD49D"><enum>(2)</enum><header>Allocation</header><text>Not
less than 80 percent of the amount appropriated under paragraph (1) in each
fiscal year shall be made available to carry out section 782.</text>
</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDAC64A6DF71344B48B8D9F5EC1CB38A2C" section-type="subsequent-section"><enum>785.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this subpart, or the
application of such provision to any person or circumstance, is held to be
unconstitutional, the remainder of this subpart and the application of the
provisions of this subpart to any person or circumstance shall not be affected
thereby.</text>
