		<official-title>To make determinations by the United States Trade
		  Representative under title III of the Trade Act of 1974 reviewable by the Court
		  of International Trade and to ensure that the United States Trade
		  Representative considers petitions to enforce United States trade rights, and
		  for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Trade Complaint and Litigation
			 Accountability Improvement Measures Act</short-title></quote> or the
			 <quote><short-title>Trade CLAIM
			 Act</short-title></quote>.</text>
		</section><section id="id8351C767973446F387200891CB3791DA"><enum>2.</enum><header>Review of
			 determinations of the United States Trade Representative by the Court of
			 International Trade</header><text display-inline="no-display-inline">Section
			 1581 of title 28, United States Code, is amended—</text>
			<subsection id="idEDC97D04F6BE46D5A4B59063B7D9FDF7"><enum>(a)</enum><text>in subsection
			 (i)—</text>
				<paragraph id="id4E9392F47A5247DAAC21D11815E61504"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>subsections (a)–(h)</quote> and
			 inserting <quote>subsections (a)–(h) and (k)</quote>; and</text>
				</paragraph><paragraph id="idC1E44C34A9DB450AAF5BBDF48500FDDF"><enum>(2)</enum><text>in paragraph (4),
			 by striking <quote>subsections (a)–(h)</quote> and inserting <quote>subsections
			 (a)–(h) and (k)</quote>; and</text>
				</paragraph></subsection><subsection id="id722EA60FC4A844B0AF00264A616CECDF"><enum>(b)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id24F5EBBD5F3B471C872DCB3CE342140C" style="OLC">
					<subsection id="id64AEB95E03544E2D8E6E71F175902AEF"><enum>(k)</enum><text>The Court of
				International Trade shall have exclusive jurisdiction of any civil action
				commenced by a petitioner requesting that the United States Trade
				Representative take action under section 301 of the Trade Act of 1974 (19
				U.S.C. 2411) to review de novo any determination or action of the United States
				Trade Representative under section 301(a), 302(a)(2), 304(a)(1),
				305(a)(2)(A)(ii), 306(b), or 307(a)(1) of the Trade Act of 1974 (19 U.S.C.
				2411(a), 2412(a)(2), 2414(a)(1), 2415(a)(2)(A)(ii), 2416(b), or
				2417(a)(1)).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="idE1CE9CA65C494CB999DB286027583488"><enum>3.</enum><header>Consideration by
			 the United States Trade Representative of petitions to enforce United States
			 trade rights</header>
			<subsection id="idB9A01B13D68145E4ADD2C70692C8360E"><enum>(a)</enum><header>Actions by
			 United States Trade Representative</header><text>Section 301 of the Trade Act
			 of 1974 (19 U.S.C. 2411) is amended—</text>
				<paragraph id="idE8FCF38B659142809C1F47975865D0ED"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="id2263DEC4F7254A9280C862F5D3EAE605"><enum>(A)</enum><text>in paragraph (1)
			 in the flush text at the end, by striking <quote>, subject to the specific
			 direction, if any, of the President regarding any such action,</quote>;
			 and</text>
					</subparagraph><subparagraph id="id52CE480C866743EC914A6E31CA92B475"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
						<clause id="id77635A31CBC4463C88AB72FEBC8F07FC"><enum>(i)</enum><text>in
			 the matter preceding subparagraph (A), by striking <quote>in any case in
			 which</quote> and inserting <quote>if</quote>;</text>
						</clause><clause id="idD138EF8743B44370B2E41B8EA06EF4F4"><enum>(ii)</enum><text>in
			 subparagraph (A)(ii)(II), by striking <quote>; or</quote> and inserting a
			 semicolon; and</text>
						</clause><clause id="id8C78166E8DD0487FA0B9E3CA05E5E09E"><enum>(iii)</enum><text>by striking
			 subparagraph (B) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="id90BD4E2ACCA04D24B5D3A3278BC5538D" style="OLC">
								<subparagraph id="idCF3120E2E28D46C8AB74B30385090707"><enum>(B)</enum><text>the foreign
				country has—</text>
									<clause id="id5807F6456E8C47738FAEBCEE2EA6C9AD"><enum>(i)</enum><text>agreed to
				imminently eliminate the act, policy, or practice, or</text>
									</clause><clause id="idFC885FD236E84BA78486DE7F6DD9B84E"><enum>(ii)</enum><text>agreed to a
				solution to imminently relieve the burden or restriction on United States
				commerce resulting from the act, policy, or practice;</text>
									</clause></subparagraph><subparagraph id="id16C1BDB8B0E8495EB3978F8EE3E05EAA"><enum>(C)</enum><text>the Trade
				Representative finds that it is impossible for the foreign country to achieve
				the results described in subparagraph (B), but the foreign country agrees to
				provide to the United States compensatory trade benefits that are equivalent in
				value to the burden or restriction on United States commerce resulting from the
				acts, policy, or practice;</text>
								</subparagraph><subparagraph id="id3EE5051D8C4F47319A383F3F871711BE"><enum>(D)</enum><text>in extraordinary
				cases, the Trade Representative finds that the taking of action under this
				subsection would have an adverse impact on the United States economy
				substantially out of proportion to the benefits of such action, taking into
				account the impact of not taking such action on the credibility of the
				provisions of this chapter; or</text>
								</subparagraph><subparagraph id="idC5D495FE4B644DFDB59814665B16871B"><enum>(E)</enum><text>the Trade
				Representative finds that the taking of action under this subsection would
				cause serious harm to the national security of the United
				States.</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph id="idD532F496021F4B8983B9A2DD19FA015A"><enum>(2)</enum><text>in subsection
			 (c)(1)(D)—</text>
					<subparagraph id="idB6AB945B13C240C6AB94F080057C1F5F"><enum>(A)</enum><text>by amending
			 clauses (i) and (ii) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="id63E67177EC6644D4863A26E690CCDB2E" style="OLC">
							<clause id="id6F013938A4814CC992DBB0E06F1839E4"><enum>(i)</enum><text>imminently
				eliminate the act, policy, or practice that is the subject of the action to be
				taken under subsection (a) or (b),</text>
							</clause><clause id="idCBB00C45AEF244F698F45D0B46930A93"><enum>(ii)</enum><text>imminently
				relieve the burden or restriction on United States commerce resulting from the
				act, policy, or practice,</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="id8F094F249CD94881A46F88154CA3358F"><enum>(B)</enum><text>by amending
			 subclause (I) of clause (iii) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="id4238FE5634F5418697B89CD343B8D47E" style="OLC">
							<subclause id="id135B00B20A3C44BEA0B8A9840A4649C5"><enum>(I)</enum><text>are equivalent in
				value to the burden or restriction on United States commerce resulting from the
				act, policy, or practice,
				and</text>
							</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="idF57C6619C6684196A4B0D90A668A9CF8"><enum>(b)</enum><header>Initiation of
			 investigations</header><text>Section 302 of the Trade Act of 1974 (19 U.S.C.
			 2412) is amended—</text>
				<paragraph id="idCB2FE4BEF8564119ACCA9558DFB126C4"><enum>(1)</enum><text>in subsection
			 (a)(2), by striking the period and inserting <quote>based on whether the
			 petitioner has alleged facts that, if assumed to be true, would meet the
			 criteria set forth in section 301(a)(1).</quote>; and</text>
				</paragraph><paragraph id="id15EB8E77D6524B77BFBCCC6DA186D051"><enum>(2)</enum><text>in subsection
			 (c), by striking <quote>(a) or</quote>.</text>
				</paragraph></subsection><subsection id="id01A6ECDC0BEA4F98B5A057C1CBF949E7"><enum>(c)</enum><header>Consultations</header><text>Section
			 303 of the Trade Act of 1974 (19 U.S.C. 2413) is amended—</text>
				<paragraph id="idEA89B4CE54DB417D8E88A509B981465F"><enum>(1)</enum><text>in subsection
			 (a)(2), by striking <quote>mutually acceptable resolution</quote> and inserting
			 <quote>resolution acceptable to the Trade Representative, the foreign country,
			 and the petitioner (if any)</quote>; and</text>
				</paragraph><paragraph id="idBB2FB9F2AECE4DFFB63FD17A84AAB336"><enum>(2)</enum><text>in subsection
			 (b)(1)(A), by striking <quote>after consulting with</quote> and inserting
			 <quote>with the consent of</quote>.</text>
				</paragraph></subsection><subsection id="idC9B71E4A20244DCF8584EB3AA31358A1"><enum>(d)</enum><header>Implementation
			 of actions</header><text>Section 305(a)(1) of the Trade Act of 1974 (19 U.S.C.
			 2415(a)(1)) is amended by striking <quote>, subject to the specific direction,
			 if any, of the President regarding any such action,</quote>.</text>
			</subsection><subsection id="id92D1561386704B829B9EB4C59B9D35AC"><enum>(e)</enum><header>Monitoring of
			 foreign compliance</header><text>Section 306(b) of the Trade Act of 1974 (19
			 U.S.C. 2416(b)) is amended—</text>
				<paragraph id="id76753C4C8B1B459DA965365CEF3EB6D0"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>the Trade Representative considers</quote> and inserting
			 <quote>the Trade Representative or the petitioner (if any) considers</quote>;
			 and</text>
				</paragraph><paragraph id="id945AEF8B8EA24E518964CBEDBDD1F3CD"><enum>(2)</enum><text>in paragraph
			 (2)(A), by striking <quote>the Trade Representative considers</quote> and
			 inserting <quote>the Trade Representative or the petitioner (if any)
			 considers</quote>.</text>
				</paragraph></subsection><subsection id="id62F4B35DB1D742939F28B0EB38BD197F"><enum>(f)</enum><header>Modification
			 and termination of action</header><text>Section 307(a)(1) of the Trade Act of
			 1974 (19 U.S.C. 2417(a)(1)) is amended by striking <quote>, subject to the
			 specific direction, if any, of the President with respect to such
			 action,</quote>.</text>
