		<official-title>To improve protections for children and to hold States
		  accountable for the safe and timely placement of children across State lines,
		  and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Safe and Timely Interstate
			 Placement of Foster Children Act of 2006</short-title></quote>.</text>
		</section><section id="HAD436DC77D4842A1B0DE119472DFA559"><enum>2.</enum><header>Sense of the
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 the Congress that—</text>
			<paragraph id="HCEB0B85AF9414C8BA6EABBBB00D3A39C"><enum>(1)</enum><text>the States should
			 expeditiously ratify the revised Interstate Compact for the Placement of
			 Children recently promulgated by the American Public Human Services
			 Association;</text>
			</paragraph><paragraph id="HC276B063BA4740C382967122CE5C0000"><enum>(2)</enum><text display-inline="yes-display-inline">this Act and the revised Interstate Compact
			 for the Placement of Children should not apply to those seeking placement in a
			 licensed residential facility primarily to access clinical mental heath
			 services;</text>
			</paragraph><paragraph id="HA8E5D0521D09446DA5C0B5A33B746F16"><enum>(3)</enum><text display-inline="yes-display-inline">the States should recognize and implement
			 the deadlines for the completion and approval of home studies as provided in
			 section 4 to move children more quickly into safe, permanent homes; and</text>
			</paragraph><paragraph id="H602ED7C7921741BBA500C775046502D"><enum>(4)</enum><text display-inline="yes-display-inline">Federal policy should encourage the safe
			 and expedited placement of children into safe, permanent homes across State
			 lines.</text>
			</paragraph></section><section id="H338057D08AE04E3EB5E1F290CE64C686"><enum>3.</enum><header>Orderly and
			 timely process for interstate placement of children</header><text display-inline="no-display-inline">Section 471(a) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 671(a))
			 is amended—</text>
			<paragraph id="HA9F4B56CC34542C0B900EE61A0A28CB2"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (23);</text>
			</paragraph><paragraph id="HFC4D5678024A49E0851E5586709010AB"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (24) and inserting <quote>; and</quote>;
			 and</text>
			</paragraph><paragraph id="H924814FBB90B414892D9D2B79456E331"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="HD37657A9904B4B1FB8638FF92DEE9200">
					<paragraph id="HF026CCE6578C4F999623D1F244CF307F"><enum>(25)</enum><text>provide that the
				State shall have in effect procedures for the orderly and timely interstate
				placement of children; and procedures implemented in accordance with an
				interstate compact, if incorporating with the procedures prescribed by
				paragraph (26), shall be considered to satisfy the requirement of this
				paragraph.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H5CD71C64C301464795AFFBF4155BE600"><enum>4.</enum><header>Home
			 studies</header>
			<subsection id="HCF711CD55C754A12B392788C0615F1D3"><enum>(a)</enum><header>Orderly
			 process</header>
				<paragraph id="H475EE8A3253A4C90A3706B8FEF8BC0F1"><enum>(1)</enum><header>In
			 general</header><text>Section 471(a) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 671(a)) is
			 further amended—</text>
					<subparagraph id="H830ADC88B2384353AABDDA76D0AD6135"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (24);</text>
					</subparagraph><subparagraph id="H72A3D2083B16497B9BA437B87F3D901B"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (25) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="H49789D42F8B34CEE91BC7B93F4A2AB00"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H2F003C550D674DF1BA4233D600BE6383">
							<paragraph id="H7A2C147E57BC45018459D1E492DC63EF"><enum>(26)</enum><text>provides
				that—</text>
								<subparagraph id="H58C26915C5C441A6BCE907AA11AE9DB1"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H59548183445C40F8A6B5B9D15F3E9C26"><enum>(i)</enum><text display-inline="yes-display-inline">within 60 days after the State receives
				from another State a request to conduct a study of a home environment for
				purposes of assessing the safety and suitability of placing a child in the
				home, the State shall, directly or by contract—</text>
										<subclause id="HB99E1AA3C66C4887BF16BAC6F600D440" indent="up1"><enum>(I)</enum><text>conduct and complete the study;
				and</text>
										</subclause><subclause id="H73EBAAD5DF004F03A01E9E60159B6F31" indent="up1"><enum>(II)</enum><text>return to the other State a report on
				the results of the study, which shall address the extent to which placement in
				the home would meet the needs of the child; and</text>
										</subclause></clause><clause id="H89BC19C063D44A2BB16555CE3B7D4E71" indent="up1"><enum>(ii)</enum><text>in the case of a home study begun
				on or before September 30, 2008, if the State fails to comply with clause (i)
				within the 60-day period as a result of circumstances beyond the control of the
				State (such as a failure by a Federal agency to provide the results of a
				background check, or the failure by any entity to provide completed medical
				forms, requested by the State at least 45 days before the end of the 60-day
				period), the State shall have 75 days to comply with clause (i) if the State
				documents the circumstances involved and certifies that completing the home
				study is in the best interests of the child; except that</text>
									</clause><clause id="H3BF78A765AE0427C8DEAF34837397B98" indent="up1"><enum>(iii)</enum><text>this subparagraph shall not be
				construed to require the State to have completed, within the applicable period,
				the parts of the home study involving the education and training of the
				prospective foster or adoptive parents;</text>
									</clause></subparagraph><subparagraph id="H3485844BA9AC4FEEA3B42E2B627475A0"><enum>(B)</enum><text>the State shall
				treat any report described in subparagraph (A) that is received from another
				State or an Indian tribe (or from a private agency under contract with another
				State) as meeting any requirements imposed by the State for the completion of a
				home study before placing a child in the home, unless, within 14 days after
				receipt of the report, the State determines, based on grounds that are specific
				to the content of the report, that making a decision in reliance on the report
				would be contrary to the welfare of the child; and</text>
								</subparagraph><subparagraph id="H8E5EA0E4F4944B3B87B7DE9300AEBEC0"><enum>(C)</enum><text>the State shall
				not impose any restriction on the ability of a State agency administering, or
				supervising the administration of, a State program operated under a State plan
				approved under this part to contract with a private agency for the conduct of a
				home study described in subparagraph
				(A).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H2169679B9DCF41348477961C1F57A0F2"><enum>(2)</enum><header>Report to the
			 Congress</header><text display-inline="yes-display-inline">Within 12 months
			 after the date of the enactment of this Act, the Secretary of Health and Human
			 Services shall submit to the Committee on Ways and Means of the House of
			 Representatives and the Committee on Finance of the Senate a written report
			 on—</text>
					<subparagraph id="H2F99D0E7BC0D4F9200F9E16523ECF33"><enum>(A)</enum><text>how frequently
			 States need the extended 75-day period provided for in clause (ii) of section
			 471(a)(26)(A) of the Social Security Act in order to comply with clause (i) of
			 such section;</text>
					</subparagraph><subparagraph id="HA92573B1ED2B46F1A7CD4B4C95E7E1CF"><enum>(B)</enum><text>the reasons given
			 for utilizing the extended compliance period;</text>
					</subparagraph><subparagraph id="H71ACEF1666984267A3EB7CCC3CB44B00"><enum>(C)</enum><text>the extent to
			 which utilizing the extended compliance period leads to the resolution of the
			 circumstances beyond the control of the State; and</text>
					</subparagraph><subparagraph id="H5F40C04E11C049AA9C44BA001F5367CD"><enum>(D)</enum><text>the actions taken
			 by States and any relevant Federal agencies to resolve the need for the
			 extended compliance period.</text>
					</subparagraph></paragraph><paragraph id="H15512446EFDF4FCB894B81CDCA543DB"><enum>(3)</enum><header>Sense of the
			 Congress</header><text>It is the sense of the Congress that each State
			 should—</text>
					<subparagraph id="HD4B71B42DC034C8BB72BDD347C60FCD6"><enum>(A)</enum><text>use private
			 agencies to conduct home studies when doing so is necessary to meet the
			 requirements of section 471(a)(26) of the <act-name parsable-cite="SSA">Social
			 Security Act</act-name>; and</text>
					</subparagraph><subparagraph id="H5B20D47A1D2248068308FC93DB1700B1"><enum>(B)</enum><text>give full faith
			 and credit to any home study report completed by any other State or an Indian
			 tribe with respect to the placement of a child in foster care or for
			 adoption.</text>
					</subparagraph></paragraph></subsection><subsection id="H64F8495EC089481AA0AE9F99D5554B4D"><enum>(b)</enum><header>Timely
			 interstate home study incentive payments</header><text>Part E of title IV of
			 the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 670–679b) is amended by inserting after section 473A the following:</text>
				<quoted-block act-name="Social Security Act" id="H0F44DC47D2E3457BB5DD922EB86E8150">
					<section id="HB200DEA673F34A24B67C00CD2BA065EE"><enum>473B.</enum><header>Timely
				interstate home study incentive payments</header>
						<subsection id="H25323779BB1142B9ACBE28ED1313D3D2"><enum>(a)</enum><header>Grant
				authority</header><text>The Secretary shall make a grant to each State that is
				a home study incentive-eligible State for a fiscal year in an amount equal to
				the timely interstate home study incentive payment payable to the State under
				this section for the fiscal year, which shall be payable in the immediately
				succeeding fiscal year.</text>
						</subsection><subsection id="HB522E3E2EDE44C8CBF003868787BD700"><enum>(b)</enum><header>Home study
				incentive-eligible State</header><text>A State is a home study
				incentive-eligible State for a fiscal year if—</text>
							<paragraph id="HD4B9BF4C1B964425B953B93535D10068"><enum>(1)</enum><text>the State has a
				plan approved under this part for the fiscal year;</text>
							</paragraph><paragraph id="H9B88B314D2D9417F83EBD8566BD70224"><enum>(2)</enum><text>the State is in
				compliance with subsection (c) for the fiscal year; and</text>
							</paragraph><paragraph id="H39AA80FE3D704C4D9427A1A2BCFAE3A3"><enum>(3)</enum><text>based on data
				submitted and verified pursuant to subsection (c), the State has completed a
				timely interstate home study during the fiscal year.</text>
							</paragraph></subsection><subsection id="H72D5BD67548447DDBCA2FEEE93086134"><enum>(c)</enum><header>Data
				requirements</header>
							<paragraph id="H54D92310BC1C4139A58D755C71FB5982"><enum>(1)</enum><header>In
				general</header><text>A State is in compliance with this subsection for a
				fiscal year if the State has provided to the Secretary a written report,
				covering the preceding fiscal year, that specifies—</text>
								<subparagraph id="H57F8650C23FB4A72834496085E8632F7"><enum>(A)</enum><text>the total number
				of interstate home studies requested by the State with respect to children in
				foster care under the responsibility of the State, and with respect to each
				such study, the identity of the other State involved;</text>
								</subparagraph><subparagraph id="H45C036A1FE1A474EA8B72CDDB9B44CD5"><enum>(B)</enum><text>the total number
				of timely interstate home studies completed by the State with respect to
				children in foster care under the responsibility of other States, and with
				respect to each such study, the identity of the other State involved;
				and</text>
								</subparagraph><subparagraph id="HEE015BFEFE8E41E58F051B29636BAB32"><enum>(C)</enum><text>such other
				information as the Secretary may require in order to determine whether the
				State is a home study incentive-eligible State.</text>
								</subparagraph></paragraph><paragraph id="HDF0787D92A1E4902B35E87536B51B22B"><enum>(2)</enum><header>Verification of
				data</header><text>In determining the number of timely interstate home studies
				to be attributed to a State under this section, the Secretary shall check the
				data provided by the State under paragraph (1) against complementary data so
				provided by other States.</text>
							</paragraph></subsection><subsection id="H6F9A276AEB204275A21C04F09E00CB00"><enum>(d)</enum><header>Timely
				interstate home study incentive payments</header>
							<paragraph id="H2A6618680712492698E5F3332D2BB484"><enum>(1)</enum><header>In
				general</header><text>The timely interstate home study incentive payment
				payable to a State for a fiscal year shall be $1,500, multiplied by the number
				of timely interstate home studies attributed to the State under this section
				during the fiscal year, subject to paragraph (2).</text>
							</paragraph><paragraph id="HDDA03CBD2CB64F6AB5A76F3B1FAFA7F"><enum>(2)</enum><header>Pro rata
				adjustment if insufficient funds available</header><text>If the total amount of
				timely interstate home study incentive payments otherwise payable under this
				section for a fiscal year exceeds the total of the amounts made available
				pursuant to subsection (h) for the fiscal year (reduced (but not below zero) by
				the total of the amounts (if any) payable under paragraph (3) of this
				subsection with respect to the preceding fiscal year), the amount of each such
				otherwise payable incentive payment shall be reduced by a percentage equal
				to—</text>
								<subparagraph id="H33211811EEC14035863231ECA4B57400"><enum>(A)</enum><text>the total of the
				amounts so made available (as so reduced); divided by</text>
								</subparagraph><subparagraph id="H76C0A6779682442FA8FC78C29F1673BB"><enum>(B)</enum><text>the total of such
				otherwise payable incentive payments.</text>
								</subparagraph></paragraph><paragraph id="H2880D65BA71B4B14AD17A70002F5F9E1"><enum>(3)</enum><header>Appropriations
				available for unpaid incentive payments for prior fiscal years</header>
								<subparagraph id="H36FC22BDD2664270B9577C08CAE3EB76"><enum>(A)</enum><header>In
				general</header><text>If payments under this section are reduced under
				paragraph (2) or subparagraph (B) of this paragraph for a fiscal year, then,
				before making any other payment under this section for the next fiscal year,
				the Secretary shall pay each State whose payment was so reduced an amount equal
				to the total amount of the reductions which applied to the State, subject to
				subparagraph (B) of this paragraph.</text>
								</subparagraph><subparagraph id="H5852B7D00D784CF1BEA2F4C3C9F711A7"><enum>(B)</enum><header>Pro rata
				adjustment if insufficient funds available</header><text>If the total amount of
				payments otherwise payable under subparagraph (A) of this paragraph for a
				fiscal year exceeds the total of the amounts made available pursuant to
				subsection (h) for the fiscal year, the amount of each such payment shall be
				reduced by a percentage equal to—</text>
									<clause id="H4602ABC6B88D41FE96D2984B65542341"><enum>(i)</enum><text>the total of the
				amounts so made available; divided by</text>
									</clause><clause id="HA7F81FFAEDC04E90A287BA8BA1312B38"><enum>(ii)</enum><text>the total of such
				otherwise payable payments.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="HA3FAE4FB698C4700A08FF48DB3EC8D87"><enum>(e)</enum><header>Two-year
				availability of incentive payments</header><text>Payments to a State under this
				section in a fiscal year shall remain available for use by the State through
				the end of the next fiscal year.</text>
						</subsection><subsection id="H2746D2EE81D34BD8A8F8C39749DA9BC4"><enum>(f)</enum><header>Limitations on
				use of incentive payments</header><text>A State shall not expend an amount paid
				to the State under this section except to provide to children or families any
				service (including post-adoption services) that may be provided under part B or
				E. Amounts expended by a State in accordance with the preceding sentence shall
				be disregarded in determining State expenditures for purposes of Federal
				matching payments under sections 423, 434, and 474.</text>
						</subsection><subsection id="H058CA207CCB0444A95D18083C327FA1C"><enum>(g)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="HF2412E17977B4610AA52CE5FB9D66FBF"><enum>(1)</enum><header>Home
				study</header><text display-inline="yes-display-inline">The term <term>home
				study</term> means an evaluation of a home environment conducted in accordance
				with applicable requirements of the State in which the home is located, to
				determine whether a proposed placement of a child would meet the individual
				needs of the child, including the child’s safety, permanency, health,
				well-being, and mental, emotional, and physical development.</text>
							</paragraph><paragraph id="H16777DD559DE4EF3A2FA5783A13FB6D"><enum>(2)</enum><header>Interstate home
				study</header><text display-inline="yes-display-inline">The term
				<term>interstate home study</term> means a home study conducted by a State at
				the request of another State, to facilitate an adoptive or foster placement in
				the State of a child in foster care under the responsibility of the
				State.</text>
							</paragraph><paragraph id="H62573D001B184DAE9F9DBD1D2CAC5D50"><enum>(3)</enum><header>Timely
				interstate home study</header><text>The term <term>timely interstate home
				study</term> means an interstate home study completed by a State if the State
				provides to the State that requested the study, within 30 days after receipt of
				the request, a report on the results of the study. The preceding sentence shall
				not be construed to require the State to have completed, within the 30-day
				period, the parts of the home study involving the education and training of the
				prospective foster or adoptive parents.</text>
							</paragraph></subsection><subsection id="H86D3E9B6C2B245E1A4D8EA241F772FC6"><enum>(h)</enum><header>Limitations on
				authorization of appropriations</header>
							<paragraph id="H6A13FE424D154EEA9D00E4E1E40637A9"><enum>(1)</enum><header>In
				general</header><text>For payments under this section, there are authorized to
				be appropriated to the Secretary—</text>
								<subparagraph id="H82089FB265FD4106874D001F8023FE4E"><enum>(A)</enum><text>$10,000,000 for
				fiscal year 2007;</text>
								</subparagraph><subparagraph id="HE0330C59CB0E40DAB379430409FC3D7F"><enum>(B)</enum><text>$10,000,000 for
				fiscal year 2008;</text>
								</subparagraph><subparagraph id="H83BB3E2E71264ACA9E3564F1961DED8"><enum>(C)</enum><text>$10,000,000 for
				fiscal year 2009; and</text>
								</subparagraph><subparagraph id="HA72C09AB6A9A4E01A104D80334DACB15"><enum>(D)</enum><text>$10,000,000 for
				fiscal year 2010.</text>
								</subparagraph></paragraph><paragraph id="H9FB0E4FBBD1F445CB82D530093A64CEC"><enum>(2)</enum><header>Availability</header><text>Amounts
				appropriated under paragraph (1) are authorized to remain available until
				expended.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HED9DC71865B348059682D494F1EF378D"><enum>(c)</enum><header>Repealer</header><text>Effective
			 October 1, 2010, section 473B of the <act-name parsable-cite="SSA">Social
			 Security Act</act-name> is repealed.</text>
			</subsection></section><section id="HBC75AF7935EC47CEAF51BA50DF00DC8"><enum>5.</enum><header>Sense of the
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 the Congress that State agencies should fully cooperate with any court which
			 has authority with respect to the placement of a child in foster care or for
			 adoption, for the purpose of locating a parent of the child, and such
			 cooperation should include making available all information obtained from the
			 Federal Parent Locator Service.</text>
		</section><section id="H25F32F84D2B44AB1A18B21259EEA003C"><enum>6.</enum><header>Caseworker
			 visits</header>
			<subsection id="H13410D42343F44F088EBF98CA274DFF9"><enum>(a)</enum><header>Purchase of
			 services in interstate placement cases</header><text>Section 475(5)(A)(ii) of
			 the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 675(5)(A)(ii)) is amended by striking <quote>or of the State in which the child
			 has been placed</quote> and inserting <quote>of the State in which the child
			 has been placed, or of a private agency under contract with either such
			 State</quote>.</text>
			</subsection><subsection id="H30FBF5A097644DA79C77C14FBBB15DF4"><enum>(b)</enum><header>Increased
			 visits</header><text>Section 475(5)(A)(ii) of such Act (42 U.S.C.
			 675(5)(A)(ii)) is amended by striking <quote>12</quote> and inserting
			 <quote>6</quote>.</text>
			</subsection></section><section id="H4760952F31FA492784009315D30003CF"><enum>7.</enum><header>Health and
			 education records</header><text display-inline="no-display-inline">Section 475
			 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 675) is amended—</text>
			<paragraph id="HEF9A17C64D57417D9D964F7DE4D2E021"><enum>(1)</enum><text>in paragraph
			 (1)(C)—</text>
				<subparagraph id="H50645D93FD6944C2B3D64CCB3300C94"><enum>(A)</enum><text>by striking
			 <quote>To the extent available and accessible, the</quote> and inserting
			 <quote>The</quote>; and</text>
				</subparagraph><subparagraph id="HB21A2EF58CA14189AF15ABED26476E4C"><enum>(B)</enum><text>by inserting
			 <quote>the most recent information available regarding</quote> after
			 <quote>including</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H27E2B32DCBFD4EC5B3488B86EF71F514"><enum>(2)</enum><text>in paragraph
			 (5)(D)—</text>
				<subparagraph id="H65F26C62179E45FEB0282EBE44D0547D"><enum>(A)</enum><text>by inserting
			 <quote>a copy of the record is</quote> before <quote>supplied</quote>;
			 and</text>
				</subparagraph><subparagraph id="HF74CB1E62A0F4D74832C5044C57B4F8F"><enum>(B)</enum><text>by inserting
			 <quote>, and is supplied to the child at no cost at the time the child leaves
			 foster care if the child is leaving foster care by reason of having attained
			 the age of majority under State law</quote> before the semicolon.</text>
				</subparagraph></paragraph></section><section id="H1EE33235542A461C810095445D2475F8"><enum>8.</enum><header>Right to be heard
			 in foster care proceedings</header>
			<subsection id="HC494B15156E647EB8FABF07FE17D6607"><enum>(a)</enum><header>In
			 general</header><text>Section 475(5)(G) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 675(5)(G)) is
			 amended—</text>
				<paragraph id="H8996D4B984734443857C669357C17074"><enum>(1)</enum><text>by striking
			 <quote>an opportunity</quote> and inserting <quote>a right</quote>;</text>
				</paragraph><paragraph id="HB47BCD16EB63476FBA00CDF000FD931"><enum>(2)</enum><text>by
			 striking <quote>and opportunity</quote> and inserting <quote>and right</quote>;
			 and</text>
				</paragraph><paragraph id="HC9185728BC4A4D39B1171125C1333938"><enum>(3)</enum><text>by striking
			 <quote>review or hearing</quote> each place it appears and inserting
			 <quote>proceeding</quote>.</text>
				</paragraph></subsection><subsection id="H02C9B78B2D274864A1E029E45F589BB"><enum>(b)</enum><header>Notice of
			 proceeding</header><text display-inline="yes-display-inline">Section 438(b) of
			 such Act (42 U.S.C. 638(b)) is amended by inserting <quote>shall have in effect
			 a rule requiring State courts to ensure that foster parents, pre-adoptive
			 parents, and relative caregivers of a child in foster care under the
			 responsibility of the State are notified of any proceeding to be held with
			 respect to the child, and</quote> after <quote>highest State
			 court</quote>.</text>
			</subsection></section><section id="HA82B8420F85B4350BB05009ECF5EF89E"><enum>9.</enum><header>Court
			 improvement</header><text display-inline="no-display-inline">Section 438(a)(1)
			 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 629h(a)(1)) is amended—</text>
			<paragraph id="HB9F3D72C0697440D8000F0C7C1A67265"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (C); and</text>
			</paragraph><paragraph id="H2123860FF6C2477181262C51AF014F5D"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="H7CE6043B84524CF4B4F875AA63D15281">
					<subparagraph id="H83A8F95CDB304092AD85508B24622F92"><enum>(E)</enum><text>that determine the
				best strategy to use to expedite the interstate placement of children,
				including—</text>
						<clause id="H85C59C6DA5DA4DA6801FF19F3917BA4"><enum>(i)</enum><text>requiring courts in
				different States to cooperate in the sharing of information;</text>
						</clause><clause id="H812771E654654068853FA1485066E0D6"><enum>(ii)</enum><text>authorizing
				courts to obtain information and testimony from agencies and parties in other
				States without requiring interstate travel by the agencies and parties;
				and</text>
						</clause><clause id="H352B7D09EEDC4627939552AEEC8928A6"><enum>(iii)</enum><text>permitting the
				participation of parents, children, other necessary parties, and attorneys in
				cases involving interstate placement without requiring their interstate travel;
				and</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HA5F94E1009134EAC80AF39B9BB201645"><enum>10.</enum><header>Reasonable
			 efforts</header>
			<subsection id="H7B3146E0E1AE42DCB0DADB12DF2EA9D9"><enum>(a)</enum><header>In
			 general</header><text>Section 471(a)(15)(C) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 671(a)(15)(C)) is amended by inserting <quote>(including, if appropriate,
			 through an interstate placement)</quote> after <quote>accordance with the
			 permanency plan</quote>.</text>
			</subsection><subsection id="H94D597F7982D4451BAC18F8E03E888BC"><enum>(b)</enum><header>Permanency
			 hearing</header><text>Section 471(a)(15)(E)(i) of such Act (42 U.S.C.
			 671(a)(15)(E)(i)) is amended by inserting <quote>, which considers in-State and
			 out-of-State permanent placement options for the child,</quote> before
			 <quote>shall</quote>.</text>
			</subsection><subsection id="HE01C5605F7284BE8A387C0C8A1F418E1"><enum>(c)</enum><header>Concurrent
			 planning</header><text>Section 471(a)(15)(F) of such Act (42 U.S.C.
			 671(a)(15)(F)) is amended by inserting <quote>, including identifying
			 appropriate in-State and out-of-State placements</quote> before
			 <quote>may</quote>.</text>
			</subsection></section><section id="HBB776C01698245C2BB99F69CB1F6B703"><enum>11.</enum><header>Case
			 plans</header><text display-inline="no-display-inline">Section 475(1)(E) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 675(1)(E)) is amended by inserting <quote>to facilitate orderly and timely
			 in-State and interstate placements</quote> before the period.</text>
		</section><section id="H88B5A31CB55E478BB7BFE7BDE777314E"><enum>12.</enum><header>Case review
			 system</header><text display-inline="no-display-inline">Section 475(5)(C) of
			 the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 675(5)(C) is amended—</text>
			<paragraph id="H662ED96C6EDB4A10AC50BEF807639085"><enum>(1)</enum><text>by inserting
			 <quote>, in the case of a child who will not be returned to the parent, the
			 hearing shall consider in-State and out-of-State placement options,</quote>
			 after <quote>living arrangement</quote>; and</text>
			</paragraph><paragraph id="HA754C505C551458FA757003BB588DA54"><enum>(2)</enum><text>by inserting
			 <quote>the hearing shall determine</quote> before <quote>whether
			 the</quote>.</text>
			</paragraph></section><section id="HCAAEE1E6B95B46A2988C76D04EB41CF4"><enum>13.</enum><header>Use of
			 interjurisdictional resources</header><text display-inline="no-display-inline">Section 422(b)(12) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 622(b)(12)) is amended—</text>
			<paragraph id="HDA445E32AA3E46A4BBE95993AB39F1F5"><enum>(1)</enum><text>by striking
			 <quote>develop plans for the</quote> and inserting <quote>make</quote>;</text>
			</paragraph><paragraph id="H422ED130EB8540ABB25301D32FEC00EB"><enum>(2)</enum><text>by inserting
			 <quote>(including through contracts for the purchase of services)</quote> after
			 <quote>resources</quote>; and</text>
			</paragraph><paragraph id="HCD7E3F7030D840079CD0B7F6B3C0B1E5"><enum>(3)</enum><text>by inserting
			 <quote>, and shall eliminate legal barriers,</quote> before <quote>to
			 facilitate</quote>.</text>
			</paragraph></section><section id="HF50B6FB0971948F2A8A0D15CC363BB21"><enum>14.</enum><header>Effective
			 date</header>
			<subsection id="HA6ADFDC5176E45C98E29E58D00C31D8C"><enum>(a)</enum><header>In
			 general</header><text>Except as otherwise provided in this section, the
			 amendments made by this Act shall take effect on October 1, 2006, and shall
			 apply to payments under parts B and E of title IV of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> for calendar
			 quarters beginning on or after such date, without regard to whether regulations
			 to implement the amendments are promulgated by such date.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H1DE72AA5716547D5A4657528EF8057CB"><enum>(b)</enum><header>Delay permitted
			 if State legislation required</header><text>If the Secretary of Health and
			 Human Services determines that State legislation (other than legislation
			 appropriating funds) is required in order for a State plan under part B or E of
			 title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> to
			 meet the additional requirements imposed by the amendments made by a provision
			 of this Act, the plan shall not be regarded as failing to meet any of the
			 additional requirements before the 1st day of the 1st calendar quarter
			 beginning after the first regular session of the State legislature that begins
			 after the date of the enactment of this Act. If the State has a 2-year
			 legislative session, each year of the session is deemed to be a separate
			 regular session of the State legislature.</text>
