		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Community Water Treatment Hazards
			 Reduction Act of 2006</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id23A4581BC97D4467A5BEC4A769597E58" section-type="subsequent-section"><enum>2.</enum><header>Use of inherently
			 safer technologies at water facilities</header><text display-inline="no-display-inline">Part F of the Safe Drinking Water Act (42
			 U.S.C. 300j–21 et seq.) is amended by adding at the end the following:</text>

				<section commented="no" display-inline="no-display-inline" id="id69CD119BC29E4F66BAA678E3A0D38CE1" section-type="subsequent-section"><enum>1466.</enum><header>Use of inherently
				safer technologies at water facilities</header>
					<subsection commented="no" display-inline="no-display-inline" id="id4813E8AF964B4E16B51B43E55955B7F7"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idFD2794453F62477D9017D9C9F294ACA6"><enum>(1)</enum><header>Harmful
				intentional act</header><text display-inline="yes-display-inline">The term
				<term>harmful intentional act</term> means a terrorist attack or other
				intentional act carried out upon a water facility that is intended—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id2D19527B78DD46C89C0FDDC4EB56BDF2"><enum>(A)</enum><text display-inline="yes-display-inline">to substantially disrupt the ability of the
				water facility to provide safe and reliable—</text>
								<clause commented="no" display-inline="no-display-inline" id="id30288F82295D4793B2BA1104C1B9FC1D"><enum>(i)</enum><text display-inline="yes-display-inline">conveyance and treatment of wastewater or
				drinking water;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id9B9BCAF995504255B2C80D02F9979C75"><enum>(ii)</enum><text display-inline="yes-display-inline">disposal of effluent; or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id715F5358EF824D948986628D2C6B52B3"><enum>(iii)</enum><text display-inline="yes-display-inline">storage of a potentially hazardous chemical
				used to treat wastewater or drinking water;</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id611D79A675A94238A17123054F29B8F8"><enum>(B)</enum><text display-inline="yes-display-inline">to damage critical infrastructure;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7A2E06638FFE4C63ABB5A32F899C150F"><enum>(C)</enum><text display-inline="yes-display-inline">to have an adverse effect on the
				environment; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61F8B1B6FC2748C49300BDC19EB75A25"><enum>(D)</enum><text display-inline="yes-display-inline">to otherwise pose a significant threat to
				public health or safety.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6479394e508346b3b3aaa095a2c3ad16"><enum>(2)</enum><header>Inherently
				safer technology</header><text display-inline="yes-display-inline">The term
				<term>inherently safer technology</term> means a technology, product, raw
				material, or practice the use of which, as compared to the current use of
				technologies, products, raw materials, or practices, significantly reduces or
				eliminates—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idF5F6951A758E46388C5F385F4F8EA3D8"><enum>(A)</enum><text display-inline="yes-display-inline">the possibility of release of a substance
				of concern; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3B5779ECE41149BEB1A1F3030BB7AA91"><enum>(B)</enum><text display-inline="yes-display-inline">the hazards to public health and safety and
				the environment associated with the release or potential release of a substance
				of concern.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID73b7c822936348359cc662a8c6b3c1a6"><enum>(3)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
				Secretary of Homeland Security (or a designee).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDac8b364b89d847a68c6db718e3b96160"><enum>(4)</enum><header>Substance of
				concern</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idD03CFCCE8C134DC083F06A8CAB5ABE6D"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term
				<term>substance of concern</term> means any chemical, toxin, or other substance
				that, if transported or stored in a sufficient quantity, would have a high
				likelihood of causing casualties and economic damage if released or otherwise
				successfully targeted by a harmful intentional act, as determined by the
				Administrator, in consultation with the Secretary.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA9E56482842C49AE9A9205C815ADFEA0"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>substance of concern</term>
				includes—</text>
								<clause commented="no" display-inline="no-display-inline" id="id92BB453B7C5E4EE5AE3E3E57B92F08BA"><enum>(i)</enum><text display-inline="yes-display-inline">any substance included in Table 1 or 2
				contained in section 68.130 of title 40, Code of Federal Regulations (or a
				successor regulation), published in accordance with section 112(r)(3) of the
				Clean Air Act (42 U.S.C. 7412(r)(3)); and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idABDA6E9EB00944E081F1A335C1863767"><enum>(ii)</enum><text display-inline="yes-display-inline">any other highly hazardous gaseous toxic
				material or substance that, if transported or stored in a sufficient quantity,
				could cause casualties or economic damage if released or otherwise successfully
				targeted by a harmful intentional act, as determined by the Administrator, in
				consultation with the Secretary.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18A83028277846F9863E2A1AED9F9723"><enum>(5)</enum><header>Treatment
				works</header><text display-inline="yes-display-inline">The term
				<term>treatment works</term> has the meaning given the term in section 212 of
				the Federal Water Pollution Control Act (33 U.S.C. 1292).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID21e808196be346ed8b586c04c2e7c1ba"><enum>(6)</enum><header>Vulnerability
				zone</header><text display-inline="yes-display-inline">The term
				<term>vulnerability zone</term> means, with respect to a substance of concern,
				the geographic area that would be affected by a worst-case release of the
				substance of concern, as determined by the Administrator on the basis
				of—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id1B766DD01D164F5E83A40D29E52E03DE"><enum>(A)</enum><text display-inline="yes-display-inline">an assessment that includes the information
				described in section 112(r)(7)(B)(ii)(I) of the Clean Air Act (42 U.S.C.
				7412(r)(7)(B)(ii)(I)); or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id52E4BBB66D4D4BBBA359CEECFC34908D"><enum>(B)</enum><text display-inline="yes-display-inline">such other assessment or criteria as the
				Administrator determines to be appropriate.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0825918803194ea49fe56a2f75803fea"><enum>(7)</enum><header>Water
				facility</header><text display-inline="yes-display-inline">The term <term>water
				facility</term> means a treatment works or public water system owned or
				operated by any person.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6dbe3c58a8ab42d0b9599d87680e7a7a"><enum>(b)</enum><header>Regulations</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID67a2fa934514475db9e5f10e379742c8"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 90
				days after the date of enactment of this section, the Administrator, in
				consultation with the Secretary and other Federal, State, and local
				governmental entities, security experts, owners and operators of water
				facilities, and other interested persons shall—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idA828C1A7A61B40719FEE4769B552F763"><enum>(A)</enum><text display-inline="yes-display-inline">compile a list of all high-consequence
				water facilities, as determined in accordance with paragraph (2); and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id28C1EE463B5D45A59806B1B69EE1DE90"><enum>(B)</enum><text display-inline="yes-display-inline">notify each owner and operator of a water
				facility that is included on the list.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id304FD31BBB904FC1A9BD1B82AE0C9A33"><enum>(2)</enum><header>Identification
				of high-consequence water facilities</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idDFA0FDB6AA154A31A00333DBFA9BF8E4"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to
				subparagraph (B), in determining whether a water facility is a high-consequence
				water facility, the Administrator shall consider—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID18b127204a5b4fffbfce5d092560c5a5"><enum>(i)</enum><text display-inline="yes-display-inline">the number of people located in the
				vulnerability zone of each substance of concern that could be released at the
				water facility;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID92a488a6e1744e9ea67883ac32095776"><enum>(ii)</enum><text display-inline="yes-display-inline">the critical infrastructure (such as health
				care, governmental, or industrial facilities or centers) served by the water
				facility;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID29edd916f1434cbab67dd5abad4de12d"><enum>(iii)</enum><text display-inline="yes-display-inline">any use by the water facility of large
				quantities of 1 or more substances of concern; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID33be335501e44b228e383c201beecc53"><enum>(iv)</enum><text display-inline="yes-display-inline">the quantity and volume of annual shipments
				of substances of concern to or from the water facility.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF191F6DC7C0148B5BBC970F0B05DB3CB"><enum>(B)</enum><header>Tiers of
				facilities</header>
								<clause commented="no" display-inline="no-display-inline" id="id78ED32A9ACCB415D9CAC187C8316477B"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				clauses (ii) through (iv), the Administrator shall classify high-consequence
				water facilities designated under this paragraph into 3 tiers, and give
				priority to orders issued for, actions taken by, and other matters relating to
				the security of, high-consequence water facilities based on the tier
				classification of the high-consequence water facilities, as follows:</text>
									<subclause commented="no" display-inline="no-display-inline" id="id27DAC746B16A41B48A5A0EDEBB2EC97E"><enum>(I)</enum><header>Tier 1
				facilities</header><text display-inline="yes-display-inline">A Tier 1
				high-consequence water facility shall have a vulnerability zone that covers
				more than 100,000 individuals and shall be given the highest priority by the
				Administrator.</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id7EDC8147A5264A09882EC7AFDC6C2ABE"><enum>(II)</enum><header>Tier 2
				facilities</header><text display-inline="yes-display-inline">A Tier 2
				high-consequence water facility shall have a vulnerability zone that covers
				more than 25,000, but not more than 100,000, individuals and shall be given the
				second-highest priority by the Administrator.</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id3E166F39537E48408E81B9CC1C2823BB"><enum>(III)</enum><header>Tier 3
				facilities</header><text display-inline="yes-display-inline">A Tier 3
				high-consequence water facility shall have a vulnerability zone that covers
				more than 10,000, but not more than 25,000, individuals and shall be given the
				third-highest priority by the Administrator.</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idFA2EA79F864E42169E594C9AE2BF1371"><enum>(ii)</enum><header>Mandatory
				designation</header><text display-inline="yes-display-inline">If the
				vulnerability zone for a substance of concern at a water facility contains more
				than 10,000 individuals, the water facility shall be—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id89AB801BEF57407691B6791743923462"><enum>(I)</enum><text display-inline="yes-display-inline">considered to be a high-consequence water
				facility; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idFEA077322DAB48858019DFFD20B8A128"><enum>(II)</enum><text display-inline="yes-display-inline">classified by the Administrator to an
				appropriate tier under clause (i).</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idAD7F7E5F7FF942AF946C2B43629484E3"><enum>(iii)</enum><header>Discretionary
				classification</header><text display-inline="yes-display-inline">A water
				facility with a vulnerability zone that covers 10,000 or fewer individuals may
				be designated as a high consequence facility, on the request of the owner or
				operator of a water facility, and classified into a tier described in clause
				(i), at the discretion of the Administrator.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idA2D935B0EE9B4EE88CD3CC1A61267C0C"><enum>(iv)</enum><header>Reclassification</header><text display-inline="yes-display-inline">The Administrator—</text>
									<subclause commented="no" display-inline="no-display-inline" id="idF5D35C79B7B642559BFC828E8F10AF74"><enum>(I)</enum><text display-inline="yes-display-inline">may reclassify a high-consequence water
				facility into a tier with higher priority, as described in clause (i), based on
				an increase of population covered by the vulnerability zone or any other
				appropriate factor, as determined by the Administrator; but</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id498B8C62C46F40CCBE1810970AE82E92"><enum>(II)</enum><text display-inline="yes-display-inline">may not reclassify a high-consequence water
				facility into a tier with a lower priority, as described in clause (i), for any
				reason.</text>
									</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc3880bcd2b7a400c8d26b0e101653992"><enum>(3)</enum><header>Options
				feasibility assessment on use of inherently safer technology</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id7B2D4E4CD6A2441E9C049B12BECDDD71"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 90
				days after the date on which the owner or operator of a high-consequence water
				facility receives notice under paragraph (1)(B), the owner or operator shall
				submit to the Administrator an options feasibility assessment that
				describes—</text>
								<clause commented="no" display-inline="no-display-inline" id="idDD0E078907894759AC6CE997555BDD26"><enum>(i)</enum><text display-inline="yes-display-inline">an estimate of the costs that would be
				directly incurred by the high-consequence water facility in transitioning from
				the use of the current technology used for 1 or more substances of concern to
				inherently safer technologies; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id060D9BCA358B4EEBAE89BD7ED405AEBA"><enum>(ii)</enum><text display-inline="yes-display-inline">comparisons of the costs and benefits to
				transitioning between different inherently safer technologies, including the
				use of—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id03A5736293464E26BF744607C2F84C4D"><enum>(I)</enum><text display-inline="yes-display-inline">sodium hypochlorite;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id23657EF24F4E4405A1F53E9F084A1352"><enum>(II)</enum><text display-inline="yes-display-inline">ultraviolet light;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id64AA94E17FBE4CB29B9EF84890BDD0C5"><enum>(III)</enum><text display-inline="yes-display-inline">other inherently safer technologies that
				are in use within the applicable industry; or</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id8DF86F340BEA4981AB903315B421BA54"><enum>(IV)</enum><text display-inline="yes-display-inline">any combination of the technologies
				described in subclauses (I) through (III).</text>
									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id753FF71E272A48FE9AF60E3A609C46DC"><enum>(B)</enum><header>Considerations
				in determining estimated costs</header><text display-inline="yes-display-inline">In estimating the transition costs
				described in subparagraph (A)(i), an owner or operator of a high-consequence
				water facility shall consider—</text>
								<clause commented="no" display-inline="no-display-inline" id="IDd0a4cf1a3b8740aabfd9bf9f87ad4ecc"><enum>(i)</enum><text display-inline="yes-display-inline">the costs of capital upgrades to transition
				to the use of inherently safer technologies;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID75047ccf261e4b2fbdbc0b6eb2585dcc"><enum>(ii)</enum><text display-inline="yes-display-inline">anticipated increases in operating costs of
				the high-consequence water facility;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id71A28ACB769042C7B81DE73FB2A633E2"><enum>(iii)</enum><text display-inline="yes-display-inline">offsets that may be available to reduce or
				eliminate the transition costs, such as the savings that may be achieved
				by—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id7A9917DCEB50409080681618391868C3"><enum>(I)</enum><text display-inline="yes-display-inline">eliminating security needs (such as
				personnel and fencing);</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID1562b29adc5a4c73bfcc9998417749fe"><enum>(II)</enum><text display-inline="yes-display-inline">complying with safety regulations;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID0ddabcc200754e9686e526765e667c44"><enum>(III)</enum><text display-inline="yes-display-inline">complying with environmental regulations
				and permits;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID249f7a87d20342809b709befeb0c2627"><enum>(IV)</enum><text display-inline="yes-display-inline">complying with fire code
				requirements;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID0f9553e8f22243229853554bacfd03a8"><enum>(V)</enum><text display-inline="yes-display-inline">providing personal protective
				equipment;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID1493d5c0ffbe4848926822310e65fba0"><enum>(VI)</enum><text display-inline="yes-display-inline">installing safety devices (such as alarms
				and scrubbers);</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID2f3025c93b154605ad5b2d8e95275c8a"><enum>(VII)</enum><text display-inline="yes-display-inline">purchasing and maintaining insurance
				coverage;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="IDca1ce206e2f0448f8ac710d332c006a2"><enum>(VIII)</enum><text display-inline="yes-display-inline">conducting appropriate emergency response
				and contingency planning;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID2d963e3b58254bffb3d1bb4b06f4e50f"><enum>(IX)</enum><text display-inline="yes-display-inline">conducting employee background checks;
				and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id5B1B8C90B35C4957B53A495C937713DB"><enum>(X)</enum><text display-inline="yes-display-inline">potential liability for personal injury and
				damage to property; and</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id210D6093CF0A416896DEDD9893745D36"><enum>(iv)</enum><text display-inline="yes-display-inline">the efficacy of each technology in treating
				or neutralizing biological or chemical agents that could be introduced into a
				drinking water supply by a terrorist or act of terrorism.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa1c7d1bc079b45659d4a204f73be4bc7"><enum>(C)</enum><header>Use of
				inherently safer technologies</header>
								<clause commented="no" display-inline="no-display-inline" id="idDC488E3F17304BFA8D4C807D8E97D514"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to clause
				(ii), not later than 90 days after the date of submission of the options
				feasibility assessment required under this paragraph, the owner or operator of
				a high-consequence water facility, in consultation with the Administrator, the
				Secretary, the United States Chemical Safety and Hazard Investigation Board,
				local officials, and other interested parties, shall determine which inherently
				safer technologies are to be used by the high-consequence water
				facility.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDea15d109a9a8450a8997e2918605f572"><enum>(ii)</enum><header>Considerations</header><text display-inline="yes-display-inline">In making the determination under clause
				(i), an owner or operator—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id712E99CE58884BDE8864777932B85E37"><enum>(I)</enum><text display-inline="yes-display-inline">may consider transition costs estimated in
				the options feasibility assessment of the owner or operator (except that those
				transition costs shall not be the sole basis for the determination of the owner
				or operator);</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id06413BA80492487E893A1971A839791A"><enum>(II)</enum><text display-inline="yes-display-inline">shall consider long-term security
				enhancement of the high-consequence water facility;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id138199EA926D42298342AC554A1A6305"><enum>(III)</enum><text display-inline="yes-display-inline">shall consider comparable water facilities
				that have transitioned to inherently safer technologies; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id14153AB198164DECA541CFF50543AA0F"><enum>(IV)</enum><text display-inline="yes-display-inline">shall consider the overall security impact
				of the determination, including on the production, processing, and
				transportation of substances of concern at other facilities.</text>
									</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc3ffdfcb7544444299f50822a9c285c7"><enum>(c)</enum><header>Enforcement</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id78E564AA98074A2796E9EEDF0511D2FC"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In accordance with
				the tiers and priority system established under subsection (b)(2)(B), subject
				to paragraph (2), the Administrator—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idAF9F88AB6AE24EC1AE1455FE611BCBD9"><enum>(A)</enum><text display-inline="yes-display-inline">shall prioritize the use of inherently
				safer technologies at high-consequence facilities listed under subsection
				(b)(1);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id80BB57B42C2F46648621419E9D9B5E3C"><enum>(B)</enum><text display-inline="yes-display-inline">subject to the availability of grant funds
				under this section, not later than 90 days after the date on which the
				Administrator receives an options feasibility assessment from an owner or
				operator of a high-consequence water facility under subsection (b)(3)(A), shall
				issue an order requiring the high-consequence water facility to eliminate the
				use of 1 or more substances of concern and adopt 1 or more inherently safer
				technologies; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFA56AD1058E64FC7A739133E627AC4A8"><enum>(C)</enum><text display-inline="yes-display-inline">may seek enforcement of an order issued
				under paragraph (2) in the appropriate United States district court.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4CF249F719334F7D85A33F6B137F81C1"><enum>(2)</enum><header>De minimis
				use</header><text display-inline="yes-display-inline">Nothing in this section
				prohibits the de minimis use of a substance of concern as a residual
				disinfectant.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID17f1f67c40c24bcc8e4f323b2a3eef46"><enum>(d)</enum><header>Grants</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id8280ED889764439797450637B6D41031"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In accordance with
				the tiers and priority system established under subsection (b)(2)(B), the
				Administrator shall provide grants to high-consequence facilities (including
				high-consequence facilities subject to an order issued under subsection
				(c)(1)(C) and water facilities described in paragraph (6)) for use in paying
				capital expenditures directly required to complete the transition of the
				high-consequence water facility to the use of 1 or more inherently safer
				technologies.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id486D54B33AA949DB82F8FBD6AB1698CE"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">A high-consequence water facility that
				seeks to receive a grant under this subsection shall submit to the
				Administrator an application by such date, in such form, and containing such
				information as the Administrator shall require, including information relating
				to the transfer to inherently safer technologies, and the proposed date of such
				a transfer, described in subsection (b)(3)(B).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFF6B691C6EF8447C8E415DC1A6D4C7D9"><enum>(3)</enum><header>Deadline for
				transition</header><text display-inline="yes-display-inline">An owner or
				operator of a high-consequence water facility that is subject to an order under
				subsection (c)(1)(C) and that receives a grant under this subsection shall
				begin the transition to inherently safer technologies described in paragraph
				(1) not later than 90 days after the date of issuance of the order under
				subsection (c)(1)(C).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd9221dd0730f464e891f71d7f1533c1c"><enum>(4)</enum><header>Facility
				upgrades</header><text display-inline="yes-display-inline">An owner or operator
				of a high-consequence water facility—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idC57EA240FEFF4D4B96021F7566B00344"><enum>(A)</enum><text display-inline="yes-display-inline">may complete the transition to inherently
				safer technologies described in paragraph (1) within the scope of a greater
				facility upgrade; but</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE62A3F410ED345639CC59F8C67667ECC"><enum>(B)</enum><text display-inline="yes-display-inline">shall use amounts from a grant received
				under this subsection only for the capital expenditures directly relating to
				the transition to inherently safer technologies.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDF4F3BA728A7457B883DCE6712CC2092"><enum>(5)</enum><header>Operational
				costs</header><text display-inline="yes-display-inline">An owner or operator of
				a high-consequence water facility that receives a grant under this subsection
				may not use funds from the grant to pay or offset any ongoing operational cost
				of the high-consequence water facility.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD38265C29AD34D958C8B9EA3C30C9296"><enum>(6)</enum><header>Other
				requirements</header><text display-inline="yes-display-inline">As a condition
				of receiving a grant under this subsection, the owner or operator of a
				high-consequence water facility shall—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idD86C4A713B524AE5A837F87E97892413"><enum>(A)</enum><text display-inline="yes-display-inline">upon receipt of a grant, track all cost
				savings resulting from the transition to inherently safer technologies,
				including those savings identified in subsection (b)(4)(B)(iii); and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB70EEE8C804E4682A6A5616743A1A376"><enum>(B)</enum><text display-inline="yes-display-inline">for each fiscal year for which grant funds
				are received, return an amount to the Administrator equal to 50 percent of the
				savings achieved by the high-consequence water facility (but not to exceed the
				amount of grant funds received for the fiscal year) for use by the
				Administrator in facilitating the future transition of other high-consequence
				water facilities to the use of inherently safer technologies.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf290ebaa89af4160b0d837ea953f5166"><enum>(7)</enum><header>Interim
				transitions</header><text display-inline="yes-display-inline">A water facility
				that transitioned to the use of 1 or more inherently safer technologies after
				September 11, 2001, but before the date of enactment of this section, and that
				qualifies as a high-consequence facility under subsection (b)(2), in accordance
				with any previous report submitted by the water facility under section 112(r)
				of the Clean Air Act (42 U.S.C. 7412(r)) and as determined by the
				Administrator, shall be eligible to receive a grant under this
				subsection.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDed4c7939cbd6452f98263df5e0870f5f"><enum>(e)</enum><header>Authorization
				of appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to carry out this section $125,000,000 for each
				of fiscal years 2007 through
				2011.</text>
