		<section id="ID75BE4DDE931145BAA02F4DCED2E9412C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>State High Risk Pool Funding Extension

			 Act of 2005</short-title></quote>.</text>

		</section><section id="ID2C8C94841A1748A4BAD126AEF729DF05"><enum>2.</enum><header>Extension of

			 funding for operation of State high risk health insurance pools</header>

			<subsection id="IDE2DDAD52439D480C9A87B4F6CE5FF1BA"><enum>(a)</enum><header>Extension of

			 seed grants</header><text><external-xref legal-doc="act" parsable-cite="PHSA/2745">Section 2745</external-xref> of the

			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-45">42 U.S.C.

			 300gg–45</external-xref>) is amended—</text>

				<paragraph id="ID798129593A1A4CB5A7BC740F8CE2C0DE"><enum>(1)</enum><text>in subsection

			 (a), in the subsection heading by inserting <quote><header-in-text level="subsection">Extension of</header-in-text></quote> before

			 <quote><header-in-text level="subsection">Seed</header-in-text></quote>;

			 and</text>

				</paragraph><paragraph id="IDD011F911C0FD48688CC87C12B7FD527D"><enum>(2)</enum><text>in subsection

			 (c)(1), by striking <quote>$20,000,000</quote> and all that follows through

			 <quote>2003</quote> and inserting <quote>$15,000,000 for the period of fiscal

			 years 2005 and 2006</quote>.</text>

				</paragraph></subsection><subsection id="IDF03D93EE6FBF4D34AB2EB9D982DD1A07"><enum>(b)</enum><header>Funds for

			 operations</header><text><external-xref legal-doc="act" parsable-cite="PHSA/2745">Section 2745</external-xref> of the

			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-45">42 U.S.C.

			 300gg–45</external-xref>) is amended—</text>

				<paragraph id="ID91F2E94C4D4D442D866563451EFC11D9"><enum>(1)</enum><text>in subsection

			 (b)—</text>

					<subparagraph id="IDFAAD61F0F0734E978A70601BA80AF37A"><enum>(A)</enum><text>in the subsection

			 heading by striking <quote><header-in-text level="subsection">Matching</header-in-text></quote>; and</text>

					</subparagraph><subparagraph id="ID4F2573000A674999BE718988924083D4"><enum>(B)</enum><text>by striking

			 paragraph (2) and inserting the following:</text>

						<quoted-block id="ID1FB785D9DBCE4250B222983C1E34963D">

							<paragraph id="IDA335DFC0258F49F39249450F033DD8BF"><enum>(2)</enum><header>Allotment</header><text>The

				amounts appropriated under subsection (c)(2) for a fiscal year shall be made

				available to the States (or the entities that operate the high risk pool under

				applicable State law) as follows:</text>

								<subparagraph id="IDA9754F021AD64FFDA17B39CB36C7DA5D"><enum>(A)</enum><text>An amount equal

				to 50 percent of the appropriated amount for the fiscal year shall be allocated

				in equal amounts among each eligible State that applies for assistance under

				this subsection.</text>

								</subparagraph><subparagraph id="ID2E14D7FE26434864A81763CDE5C6A6E5"><enum>(B)</enum><text>An amount equal

				to 25 percent of the appropriated amount for the fiscal year shall be allocated

				among the States so that the amount provided to a State bears the same ratio to

				such available amount as the number of uninsured individuals in the State bears

				to the total number of uninsured individuals in all States (as determined by

				the Secretary).</text>

								</subparagraph><subparagraph id="ID3984E63B0D9E44E294958A7F8BED455F"><enum>(C)</enum><text>An amount equal

				to 25 percent of the appropriated amount for the fiscal year shall be allocated

				among the States so that the amount provided to a State bears the same ratio to

				such available amount as the number of individuals enrolled in health care

				coverage through the qualified high risk pool of the State bears to the total

				number of individuals so enrolled through qualified high risk pools in all

				States (as determined by the Secretary).</text>

								</subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>

					</subparagraph></paragraph><paragraph id="ID48B92A1A11B74762B2FF88FC4D4CC0C2"><enum>(2)</enum><text>in subsection

			 (c)(2), by striking <quote>$40,000,000</quote> and all that follows through the

			 period and inserting <quote>$75,000,000 for each of fiscal years 2005 through

			 2009 to make allotments under subsection (b)(2).</quote>.</text>

				</paragraph></subsection><subsection id="IDA526A100B7BC40FC99B46032B37A8E18"><enum>(c)</enum><header>Definitions</header><text><external-xref legal-doc="act" parsable-cite="PHSA/2745">Section 2745</external-xref> of the

			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-45">42 U.S.C.

			 300gg–45</external-xref>) is amended—</text>

				<paragraph id="ID47918268112B4D70A9A7383F73C62CFB"><enum>(1)</enum><text>in subsection

			 (d), by inserting after <quote>2744(c)(2)</quote> the following: <quote>,

			 except that with respect to subparagraph (A) of such section a State may elect

			 to provide for the enrollment of eligible individuals through an acceptable

			 alternative mechanism,</quote>; and</text>

				</paragraph><paragraph id="ID5DFA32C71D424825B3E1A1ED0C6B262A"><enum>(2)</enum><text>by adding at the

			 end the following:</text>

					<quoted-block id="IDD1178C9CE8A44932951DEE45356A2911">

						<subsection id="ID055BEF7C16954631B941F579152B9257"><enum>(e)</enum><header>Standard risk

				rate</header><text>In subsection (b)(1)(A), the term <term>standard risk

				rate</term> means a rate—</text>

							<paragraph id="IDEA0AA71910B74AB5ABCA57D199DB63A8"><enum>(1)</enum><text>determined under

				the State high risk pool by considering the premium rates charged by other

				health insurers offering health insurance coverage to individuals in the

				insurance market served;</text>

							</paragraph><paragraph id="IDF944C74D7B934BBA84CF5CA6163C0488"><enum>(2)</enum><text>that is

				established using reasonable actuarial techniques; and</text>

							</paragraph><paragraph id="IDA0CDDA15814C4BB2A7863E72EF01BB44"><enum>(3)</enum><text>that reflects

				anticipated claims experience and expenses for the coverage involved.</text>
