			<header>Findings</header>

			<text display-inline="no-display-inline">Congress makes the following

			 findings:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="IDB65BE20722994D32904FF6264E0021CB">

				<enum>(1)</enum>

				<text display-inline="yes-display-inline">Since the enactment of the

			 Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2601">29 U.S.C. 2601</external-xref> et seq.), more than

			 50,000,000 Americans have taken leave for family or medical reasons.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID83A30A9EDF0F4B21897E6BCFA7A506D9">

				<enum>(2)</enum>

				<text display-inline="yes-display-inline">Of those taking leave under

			 the Family and Medical Leave Act of 1993, 52 percent took the leave for their

			 own serious health conditions, and 26 percent took the leave to care for a new

			 child or for maternity disability reasons.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9D4928333B1D47259B3B8BE8F9961505">

				<enum>(3)</enum>

				<text display-inline="yes-display-inline">While the leave provided by

			 the Family and Medical Leave Act of 1993 has proven to be a critical resource

			 for millions of Americans, too many people are left behind because the Act

			 provides only unpaid leave.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFDF1E7F530A9493A8BC0888F21C869C6">

				<enum>(4)</enum>

				<text display-inline="yes-display-inline">According to a 2000

			 Department of Labor survey—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="IDB049E53F949948C5818BFEA0A260A700">

					<enum>(A)</enum>

					<text display-inline="yes-display-inline">3,500,000 Americans needed

			 family and medical leave but could not afford to take time off without

			 pay;</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4C799C952FD24D9FB6B35249176C7F9C">

					<enum>(B)</enum>

					<text display-inline="yes-display-inline">nearly four-fifths (78

			 percent) of those surveyed who needed the leave but did not take it said they

			 could not afford unpaid leave;</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID33B46C4D85AD4A73A58DEF7E88E4FBF4">

					<enum>(C)</enum>

					<text display-inline="yes-display-inline">9 percent of those taking

			 family and medical leave and receiving less than full pay during their longest

			 period of the leave had to go on public assistance to cover their lost wages;

			 and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID864FCADE465E4B789C55210472B22179">

					<enum>(D)</enum>

					<text display-inline="yes-display-inline">73 percent of those taking

			 family and medical leave had incomes above $30,000.</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8DBF4FE2687243329D1B01252CBD8968">

				<enum>(5)</enum>

				<text display-inline="yes-display-inline">Decades ago, only a tiny

			 fraction of mothers with infants under age 1 were in the workforce. In 2004,

			 about 55 percent of mothers with infants under age 1 were in the

			 workforce.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID94666D70CD984DFFBE006E97A18ED07E">

				<enum>(6)</enum>

				<text display-inline="yes-display-inline">Worldwide, 128 countries of

			 the 172 responding to an International Social Security Association survey in

			 1999 provided at least some paid and job protected maternity leave, and, on

			 average, provided 16 weeks of basic paid maternity leave. In some countries,

			 paid maternity leave is mandatory and in others it is voluntary.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2E5C382ACEB1470C92FF5780F4D17082">

				<enum>(7)</enum>

				<text display-inline="yes-display-inline">A European Union directive

			 mandating 14 weeks of paid maternity leave was adopted as a health and safety

			 measure in 1992.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID00981E6D9A414774A6020966009EFF24">

				<enum>(8)</enum>

				<text display-inline="yes-display-inline">Among the 29 Organization for

			 Economic Cooperation and Development (OECD) countries, the most advanced

			 industrialized countries, the average period of childbirth-related leave

			 (including maternity, paternity, and parental leaves) is 44 weeks (10 months)

			 with additional time provided in some countries for leave to care for a sick

			 child. In those countries, the average duration of paid childbirth-related

			 leave is 36 weeks.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA22415F9527C4054B5E1157B69FE0621">

				<enum>(9)</enum>

				<text display-inline="yes-display-inline">In more than half of the OECD

			 countries (16 countries), the cash benefit provided while on the paid

			 childbirth-related leave replaces between 70 and 100 percent of prior

			 wages.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEF882040CE504980A5A18180EB6F9BC8">

				<enum>(10)</enum>

				<text display-inline="yes-display-inline">Among the OECD countries,

			 adoptive mothers and adoptive parents are increasingly eligible for the paid

			 childbirth-related leave.</text>

				<header>Short title</header>

				<text display-inline="no-display-inline">This title may be cited as the

			 <quote><short-title>Family Income to Respond to

			 Significant Transitions Insurance Act</short-title></quote>.</text>

				<header>Purposes</header>

				<text display-inline="no-display-inline">The purposes of this title

			 are—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID5FB76B3994A94AAE80B42480AD3BB1AA">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">to establish a demonstration

			 program that supports the efforts of States and political subdivisions to

			 provide partial or full wage replacement, often referred to as FIRST insurance,

			 to new parents so that the new parents are able to spend time with a new infant

			 or newly adopted child, and to other employees; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0AA20C28ED0540E29B159863BCED9462">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">to learn about the most

			 effective mechanisms for providing the wage replacement assistance.</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID785B8C8ECD4243F185ECF67D8CD319F7" section-type="subsequent-section">

				<enum>103.</enum>

				<header>Definitions</header>

				<text display-inline="no-display-inline">In this title:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID13C6656EA35B4AC59C25D9B62FC8E228">

					<enum>(1)</enum>

					<header>Employer; son or daughter; State</header>

					<text display-inline="yes-display-inline">The terms

			 <term>employer</term>, <term>son or daughter</term>, and <term>State</term>

			 have the meanings given the terms in section 101 of the Family and Medical

			 Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611</external-xref>).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6BAE90BF811B4E6EA45300152600E044">

					<enum>(2)</enum>

					<header>Secretary</header>

					<text display-inline="yes-display-inline">The term

			 <term>Secretary</term> means the Secretary of Labor, acting after consultation

			 with the Secretary of Health and Human Services.</text>

				<header>Demonstration projects</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID7DCD00F42AD64E9980CD2CEE911C8047">

					<enum>(a)</enum>

					<header>Grants</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID25053937F6FC4DE8A3A2AACBE81E4E09">

						<enum>(1)</enum>

						<header>In general</header>

						<text display-inline="yes-display-inline">The Secretary shall make

			 grants to eligible entities to pay for the Federal share of the cost of

			 carrying out projects that assist families by providing, through various

			 mechanisms, wage replacement for eligible individuals who are responding

			 to—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID6DDC695D29694EB788E9DA81817708AF">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">caregiving needs resulting

			 from the birth or adoption of a son or daughter; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF1683D15358142B29BD1163E7D2EAA32">

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">other family caregiving

			 needs.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID171F6DC9FACC446B82F633007570E3EF">

						<enum>(2)</enum>

						<header>Periods</header>

						<text display-inline="yes-display-inline">The Secretary shall make the

			 grants for periods of 5 years.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID572D89FAA9A0422FB68DEB3017A6C2B8">

					<enum>(b)</enum>

					<header>Eligible entities</header>

					<text display-inline="yes-display-inline">To be eligible to receive a

			 grant under this section, an entity shall be a State or political subdivision

			 of a State.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDB6F65C4D953C47D89CBE770061FD57DD">

					<enum>(c)</enum>

					<header>Use of funds</header>

					<paragraph commented="no" display-inline="no-display-inline" id="ID6E737F065FA14310A0FE00C0E4D8BDC6">

						<enum>(1)</enum>

						<header>In general</header>

						<text display-inline="yes-display-inline">An entity that receives a

			 grant under this section may use the funds made available through the grant to

			 provide partial or full wage replacement as described in subsection (a) to

			 eligible individuals—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID5E8CA8F5C54E4ECB9FEDCDE925CF5ECC">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">directly;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID93472357250C4CEEA0B37102EB92DE82">

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">through an insurance program,

			 such as a State temporary disability insurance program or the State

			 unemployment compensation benefit program;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID69B651EE3B6F4420800013A3CF2BF7A3">

							<enum>(C)</enum>

							<text display-inline="yes-display-inline">through a private disability

			 or other insurance plan, or another mechanism provided by a private employer;

			 or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE1D980C8ABD944F08F13B0E07EDD24A1">

							<enum>(D)</enum>

							<text display-inline="yes-display-inline">through another

			 mechanism.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEC2CF7928D784C2FA085D22800D4082C">

						<enum>(2)</enum>

						<header>Period</header>

						<text display-inline="yes-display-inline">In carrying out a project

			 under this section, the entity shall provide partial or full wage replacement

			 to eligible individuals for not less than 6 weeks during a period of leave, or

			 an absence from employment, described in subsection (d)(2), during any 12-month

			 period. Wage replacement available to an individual under this paragraph shall

			 be in addition to any compensation from annual or sick leave that the

			 individual may elect to use during a period of leave, or an absence from

			 employment, described in subsection (d)(2), during any 12-month period.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD722284B6A144C05B216D8617FE7B5DF">

						<enum>(3)</enum>

						<header>Administrative costs</header>

						<text display-inline="yes-display-inline">No entity may use more than

			 10 percent of the total funds made available through the grant during the

			 5-year period of the grant to pay for the administrative costs relating to a

			 project described in subsection (a).</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3DF35F93A4204F1BA568B8EAB4048B8C">

					<enum>(d)</enum>

					<header>Eligible individuals</header>

					<text display-inline="yes-display-inline">To be eligible to receive

			 wage replacement under subsection (a), an individual shall—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID38693BCD0E7B43F4A67544C79E20AFF7">

						<enum>(1)</enum>

						<text display-inline="yes-display-inline">meet such eligibility

			 criteria as the eligible entity providing the wage replacement may specify in

			 an application described in subsection (e); and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAC46E8D57E474EC4B2CF4BBCC5B4528E">

						<enum>(2)</enum>

						<text display-inline="yes-display-inline">be—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID21C81BAB3FBA41BC9E71D462223F0814">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">an individual who is taking

			 leave, under the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2601">29 U.S.C. 2601</external-xref> et seq.), other

			 Federal, State, or local law, or a private plan, for a reason described in

			 subparagraph (A) or (B) of section 102(a)(1) of the Family and Medical Leave

			 Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612(a)(1)">29 U.S.C. 2612(a)(1)</external-xref>);</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5819512BB20547628C020023839B00B0">

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">at the option of the eligible

			 entity, an individual who—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID6492C309E0724748BE2B84DA31E6014C">

								<enum>(i)</enum>

								<text display-inline="yes-display-inline">is taking leave, under that

			 Act, other Federal, State, or local law, or a private plan, for a reason

			 described in subparagraph (C), (D), (E), or (F) of section 102(a)(1) of the

			 Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612(a)(1)">29 U.S.C. 2612(a)(1)</external-xref>);

			 or</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID0693A57CDE68445D0052DAEB285C5421">

								<enum>(ii)</enum>

								<text display-inline="yes-display-inline">leaves employment, and has an

			 absence from employment, because the individual has elected to care for a son

			 or daughter under age 1; or</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID41BADCF634AC4BC6AE364E559F23EA7D">

							<enum>(C)</enum>

							<text display-inline="yes-display-inline">at the option of the eligible

			 entity, an individual who has an absence from employment and has other

			 characteristics specified by the eligible entity in an application described in

			 subsection (e).</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID44C1F1AFDDA24762B86151DCAA00CDD7">

					<enum>(e)</enum>

					<header>Application</header>

					<text display-inline="yes-display-inline">To be eligible to receive a

			 grant under this section, an entity shall submit an application to the

			 Secretary, at such time, in such manner, and containing such information as the

			 Secretary may require, including, at a minimum—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID47B5738A15DD4EAE8F8B003733B89800">

						<enum>(1)</enum>

						<text display-inline="yes-display-inline">a plan for the project to be

			 carried out with the grant;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID570C4625D66941FE80213E4817A62CE5">

						<enum>(2)</enum>

						<text display-inline="yes-display-inline">information demonstrating

			 that the applicant consulted representatives of employers and employees,

			 including labor organizations, in developing the plan;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID86B0B99D863E4B21B7A85487E3E14FB4">

						<enum>(3)</enum>

						<text display-inline="yes-display-inline">estimates of the costs and

			 benefits of the project;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4B4B262C9B5A496EAFAF98DE098C7094">

						<enum>(4)</enum>

						<subparagraph commented="no" display-inline="yes-display-inline" id="IDD1E2E850DE364287BC3B790061F3816D"><enum>(A)</enum>

							<text display-inline="yes-display-inline">information on the number and

			 type of families to be covered by the project, and the extent of such coverage

			 in the area served under the grant; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD5028991E0774DA8A1688B16B2E4E9B7" indent="up1">

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">information on any criteria

			 or characteristics that the entity will use to determine whether an individual

			 is eligible for wage replacement under subsection (a), as described in

			 paragraphs (1) and (2)(C) of subsection (d);</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAA5E87698B974426BAC6DDA533E82E23">

						<enum>(5)</enum>

						<text display-inline="yes-display-inline">if the project will expand on

			 State and private systems of wage replacement for eligible individuals,

			 information on the manner in which the project will expand on the

			 systems;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF3E8D6F451244996AA3DA6ACDA9D2B93">

						<enum>(6)</enum>

						<text display-inline="yes-display-inline">information demonstrating the

			 manner in which the wage replacement assistance provided through the project

			 will assist families in which an individual takes leave or is absent from

					<header>Selection criteria</header>

					<text display-inline="yes-display-inline">In selecting entities to

			 receive grants for projects under this section, the Secretary shall—</text>

						<enum>(1)</enum>

						<text display-inline="yes-display-inline">take into

			 consideration—</text>

							<text display-inline="yes-display-inline">the scope of the proposed

			 projects;</text>

							<text display-inline="yes-display-inline">the cost-effectiveness,

			 feasibility, and financial soundness of the proposed projects;</text>

							<enum>(C)</enum>

							<text display-inline="yes-display-inline">the extent to which the

			 proposed projects would expand access to wage replacement in response to family

			 caregiving needs, particularly for low-wage employees, in the area served by

			 the grant; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2FAA831207CB4A1386D84FDB66A25209">

							<enum>(D)</enum>

							<text display-inline="yes-display-inline">the benefits that would be

			 offered to families and children through the proposed projects; and</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA179532BF92C41C4AC3096337808EBA8">

						<enum>(2)</enum>

						<text display-inline="yes-display-inline">to the extent feasible,

			 select entities proposing projects that utilize diverse mechanisms, including

			 expansion of State unemployment compensation benefit programs, and

			 establishment or expansion of State temporary disability insurance programs, to

			 provide the wage replacement.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4E1A1E8E1CEC44F3A54B8B3560CABE61">

					<enum>(g)</enum>

					<header>Federal share</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDE7061571F66D46408260353BB92B7BBD">

						<enum>(1)</enum>

						<header>In general</header>

						<text display-inline="yes-display-inline">The Federal share of the cost

			 described in subsection (a) shall be—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID47AB8C65AE06469F98E44EFBDDD2FD89">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">50 percent for the first year

			 of the grant period;</text>

							<text display-inline="yes-display-inline">40 percent for the second

			 year of that period;</text>

							<text display-inline="yes-display-inline">30 percent for the third year

			 of that period; and</text>

							<text display-inline="yes-display-inline">20 percent for each

			 subsequent year.</text>

						<enum>(2)</enum>

						<header>Non-federal share</header>

						<text display-inline="yes-display-inline">The non-Federal share of the

			 cost may be in cash or in kind, fairly evaluated, including plant, equipment,

			 and services and may be provided from State, local, or private sources, or

			 Federal sources other than this title.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID14797801D3A84BE49200ADE9A501F3BA">

					<enum>(h)</enum>

					<header>Supplement not supplant</header>

					<text display-inline="yes-display-inline">Funds appropriated pursuant

			 to the authority of this title shall be used to supplement and not supplant

			 other Federal, State, and local public funds and private funds expended to

			 provide wage replacement.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID6297B1B704E2471E83A2007DA2F65DEF">

					<enum>(i)</enum>

					<header>Effect on existing rights</header>

					<text display-inline="yes-display-inline">Nothing in this title shall

			 be construed to supersede, preempt, or otherwise infringe on the provisions of

			 any collective bargaining agreement or any employment benefit program or plan

			 that provides greater rights to employees than the rights established under

			 this title.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="IDE3BAED06CA14460F00D4A8B02696E8F8" section-type="subsequent-section">

				<enum>105.</enum>

				<header>Notification</header>

				<text display-inline="no-display-inline">An eligible entity that

			 provides partial or full wage replacement to an eligible individual under this

			 title shall notify (in a form and manner prescribed by the Secretary)—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDC2A189947F9A48EF9B2E8BC53BB15D53">

					<enum>(1)</enum>

					<text display-inline="yes-display-inline">the employer of the

			 individual of the amount of the wage replacement provided; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC5962D52B5634C568B4684E842D3931B">

					<enum>(2)</enum>

					<text display-inline="yes-display-inline">the individual and the

			 employer of the individual that the employer shall count an appropriate period

			 of leave, calculated under section 102(g) of the Family and Medical Leave Act

			 of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612(g)">29

			 U.S.C. 2612(g)</external-xref>), as added by section 108, against the total

			 amount of leave (if any) to which the employee is entitled under section

			 102(a)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612(a)(1)">29 U.S.C. 2612(a)(1)</external-xref>).</text>

				<enum>106.</enum>

				<header>Evaluations and reports</header>

					<enum>(a)</enum>

					<header>Available funds</header>

					<text display-inline="yes-display-inline">The Secretary shall use not

			 more than 2 percent of the funds made available under section 107 to carry out

			 this section.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5B1A8DFEF1AF4EE399FD007EB0E91589">

					<enum>(b)</enum>

					<header>Evaluations</header>

					<text display-inline="yes-display-inline">The Secretary shall, directly

			 or by contract, evaluate the effectiveness of projects carried out with grants

			 made under section 104, including conducting—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="IDA49D7973B8CD4EEC8716053971003E8E">

						<enum>(1)</enum>

						<text display-inline="yes-display-inline">research relating to the

			 projects, including research comparing—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDC0FDC3CF90CC4D10B6CE320445207D41">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">the scope of the projects,

			 including the type of insurance or other wage replacement mechanism used, the

			 method of financing used, the eligibility requirements, the level of the wage

			 replacement benefit provided (such as the percentage of salary replaced), and

			 the length of the benefit provided, for the projects;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA1F6D329F17F4DB190FA17623D787394">

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">the utilization of the

			 projects, including the characteristics of individuals who benefit from the

			 projects, particularly low-wage workers, and factors that determine the ability

			 of eligible individuals to obtain wage replacement through the projects;

			 and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBE54DCE539D24898A7A69509756C2240">

							<enum>(C)</enum>

							<text display-inline="yes-display-inline">the costs of and savings

			 achieved by the projects, including the cost-effectiveness of the projects and

			 their benefits for children and families;</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID41120E4E3A8B45788BECFF1BA6B48406">

						<enum>(2)</enum>

						<text display-inline="yes-display-inline">analysis of the overall need

			 for wage replacement; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1E38A628E20C4E2394961C603CF21ED4">

						<enum>(3)</enum>

						<text display-inline="yes-display-inline">analysis of the impact of the

			 projects on the overall availability of wage replacement.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDE9AFE2C2663A479CBE816D7043B92987">

					<enum>(c)</enum>

					<header>Reports</header>

					<paragraph commented="no" display-inline="no-display-inline" id="IDE4EA8AC8DC044C2894BCE6A7CED14598">

						<enum>(1)</enum>

						<header>Initial report</header>

						<text display-inline="yes-display-inline">Not later than 3 years after

			 the beginning of the grant period for the first grant made under section 104,

			 the Secretary shall prepare and submit to Congress a report that contains

			 information resulting from the evaluations conducted under subsection

			 (b).</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID58582048F08940D693C9BD007242E053">

						<enum>(2)</enum>

						<header>Subsequent reports</header>

						<text display-inline="yes-display-inline">Not later than 4 years after

			 the beginning of that grant period, and annually thereafter, the Secretary

			 shall prepare and submit to Congress a report that contains—</text>

				employee meets the requirements of subparagraph (E) or (F) of section

				102(a)(1), the employer of an employee may require the employee to

				provide—</text>

									<enum>(1)</enum>

									<text display-inline="yes-display-inline">a written statement

				describing the domestic violence and its effects;</text>

									<enum>(2)</enum>

									<text display-inline="yes-display-inline">documentation of the

				domestic violence involved, such as a police or court record, or documentation

				from a shelter worker, an employee of a domestic violence program, an attorney,

				a member of the clergy, or a medical or other professional, from whom the

				employee has sought assistance in addressing domestic violence and its effects;

				or</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6CBFAAC090444C0A840932D6E0E6B946">

									<enum>(3)</enum>

									<text display-inline="yes-display-inline">other corroborating

				evidence, such as a statement from any other individual with knowledge of the

				circumstances that provide the basis for the claim of domestic violence, or

				physical evidence of domestic violence, such as a photograph, torn or bloody

				clothing, or any other damaged property.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2011508439B344D68C4390E0ADAF4934">

								<enum>(g)</enum>

								<header>Confidentiality</header>

								<text display-inline="yes-display-inline">All evidence provided to

				the employer under subsection (f) of domestic violence experienced by an

				employee or the son, daughter, or parent of an employee, including a statement

				of an employee, any other documentation or corroborating evidence, and the fact

				that an employee has requested leave for the purpose of addressing, or caring

				for a son, daughter, or parent who is addressing, domestic violence and its

				effects, shall be retained in the strictest confidence by the employer, except

				to the extent that disclosure is requested, or consented to, by the employee

				for the purpose of—</text>

									<text display-inline="yes-display-inline">protecting the safety of

				the employee or a family member or co-worker of the employee; or</text>

			 directly or indirectly in the interest of an employer in relation to any

			 employee, and includes a public agency, who is subject to a law, agreement,

			 program, or plan described in subparagraph (A), but does not include any labor

			 organization (other than when acting as an employer) or anyone acting in the

			 capacity of officer or agent of such labor organization.</text>

			 to take paid or unpaid leave (including family, medical, sick, annual,

			 personal, or similar leave) from employment, pursuant to State or local law, a

			 collective bargaining agreement, or an employment benefits program or plan,

			 shall be permitted to use such leave for the purpose of addressing domestic

			 violence and its effects, or for the purpose of caring for a son or daughter or

			 parent of the employee, if such son or daughter or parent is addressing

			 domestic violence and its effects.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID76876AD3DC8F45D980F443D500F2E906">

					<enum>(c)</enum>

					<header>Certification</header>

					<text display-inline="yes-display-inline">In determining whether an

			 employee qualifies to use leave as described in subsection (b), an employer may

			 require a written statement, documentation of domestic violence, or

			 corroborating evidence consistent with section 103(f) of the Family and Medical

			 Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2613(f)">29 U.S.C. 2613(f)</external-xref>), as amended

			 by section 301(c).</text>

					<header>Prohibited acts</header>

						<enum>(1)</enum>

						<header>Interference with rights</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID3578AF0F482B4FB8B674F9E5F64BAAB5">

							<enum>(A)</enum>

							<header>Exercise of rights</header>

							<text display-inline="yes-display-inline">It shall be unlawful for any

			 employer to interfere with, restrain, or deny the exercise of or the attempt to

			 exercise, any right provided under this section.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3D4A3056D33B45449CBBC2E5F106C661">

							<enum>(B)</enum>

							<header>Discrimination</header>

							<text display-inline="yes-display-inline">It shall be unlawful for any

			 employer to discharge or in any other manner discriminate against an individual

			 for opposing any practice made unlawful by this section.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB93969DA3BB846928BBDF935E04CC452">

						<enum>(2)</enum>

						<header>Interference with proceedings or inquiries</header>

						<text display-inline="yes-display-inline">It shall be unlawful for any

			 person to discharge or in any other manner discriminate against any individual

			 because such individual—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="ID4A6652786B21437CB6F911BFBCA56C00">

							<enum>(A)</enum>

							<text display-inline="yes-display-inline">has filed any charge, or had

			 instituted or caused to be instituted any proceeding, under or related to this

			 section;</text>

							<enum>(B)</enum>

							<text display-inline="yes-display-inline">has given, or is about to

			 give, any information in connection with any inquiry or proceeding relating to

			 any right provided under this section; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6CD854B944BA4E05A780A54F55582152">

							<enum>(C)</enum>

							<text display-inline="yes-display-inline">has testified, or is about to

			 testify, in any inquiry or proceeding relating to any right provided under this

			 section.</text>

					<enum>(f)</enum>

					<header>Enforcement</header>

						<header>Public enforcement</header>

						<text display-inline="yes-display-inline">The Secretary of Labor shall

			 have the powers set forth in subsections (b), (c), (d), and (e) of section 107

			 of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2617">29 U.S.C. 2617</external-xref>) for the purpose of

			 public agency enforcement of any alleged violation of subsection (e) against

			 any employer.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID191BF817FC8F431DA4B2283D6CBAD41E">

						<enum>(2)</enum>

						<header>Private enforcement</header>

						<text display-inline="yes-display-inline">The remedies and procedures

			 set forth in section 107(a) of the Family and Medical Leave Act of 1993

			 (<external-xref legal-doc="usc" parsable-cite="usc/29/2617(a)">29 U.S.C.

			 2617(a)</external-xref>) shall be the remedies and procedures pursuant to which

			 an employee may initiate a legal action against an employer for alleged

			 violations of subsection (e).</text>

			 Act of 2005</short-title></quote>.</text>

								<enum>(a)</enum>

								<text display-inline="yes-display-inline">The Office of Personnel

				Management may, through an agreement or contract with 1 or more employing

				agencies described in subsection (b), conduct under section 4703 a

				demonstration project that assists families by providing paid leave for

				eligible individuals who are responding to—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="ID3E598C4D730C487FABE5948416A3B6A0">

									<enum>(1)</enum>

									<text display-inline="yes-display-inline">caregiving needs resulting

				from the birth or adoption of a son or daughter; or</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB7DBA639288A485C85DB3995A15FC790">

									<enum>(2)</enum>

									<text display-inline="yes-display-inline">other family caregiving

				needs.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3297AF026A6C476894B549006789A8F1">

								<enum>(b)</enum>

								<text display-inline="yes-display-inline">In carrying out a project

				under this section, an employing agency of 1 or more employees shall provide

				partial or full paid leave to eligible individuals for not less than 6 weeks

				during a period of leave, or an absence from employment, described in

				subsection (c)(2), during any 12-month period. Paid leave available to an

				individual under this subsection shall be in addition to any annual or sick

				leave that the individual may elect to use during a period of leave, or an

				absence from employment, described in subsection (c)(2), during any 12-month

				period.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="IDD8E0B98EC8BC4B0DA6F4887CF05F5EC8">

								<enum>(c)</enum>

								<text display-inline="yes-display-inline">To be eligible to receive

				paid leave under subsection (a), an individual shall—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="ID98918E8693CA43AA8E34656C64180650">

									<enum>(1)</enum>

									<text display-inline="yes-display-inline">be an employee who meets

				such eligibility criteria as the Office of Personnel Management may specify in

				a plan described in section 4703(b); and</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9D345F399B93431EB329E9D34272F236">

									<enum>(2)</enum>

									<text display-inline="yes-display-inline">be—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID269B2BF19971476D83B564ED335ED2A4">

										<enum>(A)</enum>

										<text display-inline="yes-display-inline">an individual who is taking

				leave, under this subchapter, or other Federal law, for a reason described in

				subparagraph (A) or (B) of section 6382(a)(1);</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA026D91C715E4796BCD5B13C859635BE">

										<enum>(B)</enum>

										<text display-inline="yes-display-inline">at the option of the Office

				of Personnel Management, an individual who—</text>

										<clause commented="no" display-inline="no-display-inline" id="IDA871D9142FBB44E6B03701273BA1D8FD">

											<enum>(i)</enum>

											<text display-inline="yes-display-inline">is taking leave, under this

				subchapter, or other Federal law, for a reason described in subparagraph (C),

				(D), (E), or (F) of section 6382(a)(1); or</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="IDA82EA79F9C534172A0F8D45BD8539622">

											<enum>(ii)</enum>

											<text display-inline="yes-display-inline">leaves employment, and has

				an absence from employment, because the individual has elected to care for a

				son or daughter under age 1; or</text>

										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID13EC38AC179F4C5BB0903D02F6FD49F1">

										<enum>(C)</enum>

										<text display-inline="yes-display-inline">at the option of the Office

				of Personnel Management, an individual who has an absence from employment and

				has other characteristics specified by the Office of Personnel Management in a

				plan described in section 4703(b).</text>

									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDF9B80C5D59F0482B83BE7574EE9C7650">

								<enum>(d)</enum>

								<text display-inline="yes-display-inline">An employing agency that

				provides partial or full paid leave to an eligible individual under this

				section shall notify (in a form and manner prescribed by the Office of

				Personnel Management) the individual that the employing agency shall count an

				appropriate period of leave, calculated under section 6382(f), against the

				total amount of leave (if any) to which the employee is entitled under section

				6382(a)(1).</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="IDB8B5CA1A834446849C75E4213DDE0079">

								<enum>(e)</enum>

								<paragraph commented="no" display-inline="yes-display-inline" id="IDAE9D77E597244EC38E299DBC78BC44C5"><enum>(1)</enum>

									<text display-inline="yes-display-inline">A demonstration project

				conducted under this section shall not be counted toward the 10-project limit

				established in section 4703(d)(2).</text>

									<enum>(2)</enum>

									<text display-inline="yes-display-inline">The Office of Personnel

				Management may provide a waiver for the demonstration project in accordance

				with section 4703, except that section 4703(c)(1) shall not apply to such a

				waiver.</text>

								<enum>(f)</enum>

				appropriated to carry out this section $400,000,000 for fiscal year 2006 and

				such sums as may be necessary for each subsequent fiscal year.</text>

								<text display-inline="yes-display-inline">If an employing agency

				provides an amount of partial paid leave to an employee for a period under

				section 6387, the employing agency shall—</text>

									<enum>(A)</enum>

									<text display-inline="yes-display-inline">total the amount of partial

				paid leave provided for that period;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC92A442DBA164E64999052A2B66EE6CE">

									<enum>(B)</enum>

									<text display-inline="yes-display-inline">convert the total into a

				corresponding amount of full paid leave provided for a proportionately reduced

				period; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID40CCE202FFBE41D0B57CB5CCDE64145E">

									<enum>(C)</enum>

									<text display-inline="yes-display-inline">count an amount of leave,

				equal to the period described in subparagraph (B), against the total amount of

				literacy program</term> means a program of services that are of sufficient

				intensity in terms of hours, and of sufficient duration, to make sustainable

				changes in a family and that integrate all of the following activities:</text>

									<subclause commented="no" display-inline="no-display-inline" id="ID328795EC6C0642C6A028AEBE9E331C96">

										<enum>(I)</enum>

										<text display-inline="yes-display-inline">Interactive literacy

				activities between parents and their sons and daughters.</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID8AD4169C569540D7A7645F9E5403C355">

										<enum>(II)</enum>

										<text display-inline="yes-display-inline">Training for parents on how

				to be the primary teacher for their sons and daughters and full partners in the

				education of their sons and daughters.</text>

										<enum>(III)</enum>

										<text display-inline="yes-display-inline">Parent literacy

				<term>literacy</term>, used with respect to an individual, means the ability of

				the individual to speak, read, and write English, and compute and solve

				problems, at levels of proficiency necessary—</text>

										<enum>(III)</enum>

										<text display-inline="yes-display-inline">to develop the knowledge

				potential of the individual.</text>

									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID86A9B5E5BA1140B3BFD8AA127D063600">

									<enum>(iii)</enum>

									<header>School</header>

									<text display-inline="yes-display-inline">The term

				<term>school</term> means an elementary school or secondary school (as such

				terms are defined in section 9101 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name>

				(<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C.

				7801</external-xref>)), a Head Start program assisted under the

				<act-name parsable-cite="HSA">Head Start Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831</external-xref> et

				seq.), and a child care facility operated by a provider who meets the

				applicable State or local government licensing, certification, approval, or

				registration requirements, if any.</text>

							<enum>(4)</enum>

							<header>Limitation</header>

							<text display-inline="yes-display-inline">No employee may take more

				than a total of 12 workweeks of leave under paragraphs (1) and (3) during any

				12-month period.</text>

									<enum>(i)</enum>

									<text display-inline="yes-display-inline">The term <term>family

				literacy program</term> means a program of services that are of sufficient

				intensity in terms of hours, and of sufficient duration, to make sustainable

				changes in a family and that integrate all of the following activities:</text>

									<subclause commented="no" display-inline="no-display-inline" id="ID8CB5E48F79CD459DBFAA00E3CED643E9">

										<enum>(I)</enum>

										<text display-inline="yes-display-inline">Interactive literacy

				activities between parents and their sons and daughters.</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="IDF0AFCC01FB564F8D9322D0482F96A8F2">

										<enum>(II)</enum>

										<text display-inline="yes-display-inline">Training for parents on how

				to be the primary teacher for their sons and daughters and full partners in the

				education of their sons and daughters.</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID298E217EA3844EF18765DF253B072FFD">

										<enum>(III)</enum>

										<text display-inline="yes-display-inline">Parent literacy

				training.</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID265DD36EF86546F2B961D517DE16C42D">

										<enum>(IV)</enum>

										<text display-inline="yes-display-inline">An age-appropriate

				education program for sons and daughters.</text>

									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDEA57F5C84432457586ACECB6D9673DED">

									<enum>(ii)</enum>

									<text display-inline="yes-display-inline">The term

				<term>literacy</term>, used with respect to an individual, means the ability of

				the individual to speak, read, and write English, and compute and solve

				problems, at levels of proficiency necessary—</text>

									<subclause commented="no" display-inline="no-display-inline" id="IDD2CCB6FE1935404F90249CD3A1237E2D">

										<enum>(I)</enum>

										<text display-inline="yes-display-inline">to function on the job, in

				the family of the individual, and in society;</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID6651884BE5E646E7965E55BF25765924">

										<enum>(II)</enum>

										<text display-inline="yes-display-inline">to achieve the goals of the

				individual; and</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="IDF8C4C6F90B7140BE817D18E3ADC9C860">

										<enum>(III)</enum>

										<text display-inline="yes-display-inline">to develop the knowledge

				potential of the individual.</text>

									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDCDF6B67832094D17A49E4F110000A75F">

									<enum>(iii)</enum>

									<text display-inline="yes-display-inline">The term

				<term>school</term> means an elementary school or secondary school (as such

				terms are defined in section 9101 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name>

				(<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C.

				7801</external-xref>)), a Head Start program assisted under the

				<act-name parsable-cite="HSA">Head Start Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831</external-xref> et

				seq.), and a child care facility operated by a provider who meets the

				applicable State or local government licensing, certification, approval, or

				registration requirements, if any.</text>

								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID30E9DB4290AC4021A8C39334A5F827A8" indent="up1">

							<enum>(4)</enum>

							<text display-inline="yes-display-inline">No employee may take more

				than a total of 12 workweeks of leave under paragraphs (1) and (3) during any

				12-month period.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID40D96330323A44FD97DD51227D2FA000">

					<enum>(b)</enum>

					<header>Schedule</header>

					<text display-inline="yes-display-inline">Section 6382(b)(1) of such

			 title is amended by inserting after the second sentence the following:

			 <quote>Leave under subsection (a)(3) may be taken intermittently or on a

			 reduced leave schedule.</quote>.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDDF6CC8ECC78443FB94FD493C3876BED7">

					<enum>(c)</enum>

					<header>Substitution of paid Leave</header>

					<text display-inline="yes-display-inline">Section 6382(d) of such title

			 is amended by inserting before <quote>, except</quote> the following: <quote>,

			 or for leave provided under subsection (a)(3) any of the employee’s accrued or

			 accumulated annual leave under subchapter I for any part of the 24-hour period

			 of such leave under such subsection</quote>.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3BD96E39F0004FA2893177D444D80192">

					<enum>(d)</enum>

					<header>Notice</header>

					<text display-inline="yes-display-inline">Section 6382(e) of such title

			 is amended by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="ID8E4D7435FB914EEAB202901718008ED2" style="OLC">

						<paragraph commented="no" display-inline="no-display-inline" id="ID1986DB4BBA474C6C80584CB99F6D82BB" indent="up1">

							<enum>(3)</enum>

							<text display-inline="yes-display-inline">In any case in which the

				necessity for leave under subsection (a)(3) is foreseeable, the employee shall

				provide the employing agency with not less than 7 days’ notice, before the date

				the leave is to begin, of the employee’s intention to take leave under such

				subsection. If the necessity for the leave is not foreseeable, the employee

				shall provide such notice as is practicable.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID989F1DA972CA40DF92B100BE992DCA00">

					<enum>(e)</enum>

					<header>Certification</header>

					<text display-inline="yes-display-inline">Section 6383 of such title,

			 as amended by section 302(c), is further amended by adding at the end the

			 following:</text>

						<subsection commented="no" display-inline="no-display-inline" id="IDC5741DE2F0F844309C894E66BF42D472">

							<enum>(h)</enum>

							<text display-inline="yes-display-inline">An employing agency may

				require that a request for leave under section 6382(a)(3) be supported by a

				certification issued at such time and in such manner as the Office of Personnel

				Management may by regulation prescribe.</text>

				<header>Effective date</header>

				<text display-inline="no-display-inline">This title takes effect 120

			 days after the date of enactment of this Act.</text>
