		<official-title display="yes">To amend the Homeland Security Act of 2002
		  to clarify the investigative authorities of the privacy officer of the
		  Department of Homeland Security, and for other purposes.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Privacy Officer With Enhanced Rights
			 Act of 2006</short-title></quote> or the “<short-title>POWER Act of 2006</short-title>”.</text>
		</section><section commented="no" display-inline="no-display-inline" id="IDe37443b5358043b781c7e065798a398f" section-type="subsequent-section"><enum>2.</enum><header>Authorities of the
			 privacy officer of the Department of Homeland Security</header><text display-inline="no-display-inline">Section 222 of the Homeland Security Act of
			 2002 (6 U.S.C. 142) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID059566bb66a64226a856d7b9632f253a"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">Appointment and
			 responsibilities</header-in-text>.—</quote> before <quote>The
			 Secretary</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1df8eddd375d411b8d1e136eea24d439"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idBBDD9CBBB8D4400686E73324991F7A26" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID3ec55db4bb4b4189be182e23a7cd2e10"><enum>(b)</enum><header>Authority
				<enum-in-header>T</enum-in-header>o investigate</header>
						<paragraph commented="no" display-inline="no-display-inline" id="IDfe8836d204f940c68b724488f5c3c5c4"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The senior official
				appointed under subsection (a) may—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDf67be7a3907f42a79156ab8fbe686d64"><enum>(A)</enum><text display-inline="yes-display-inline">have access to all records, reports,
				audits, reviews, documents, papers, recommendations, and other materials
				available to the Department that relate to programs and operations with respect
				to the responsibilities of the senior official under this section;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID187cf881c44c4c228679f6263740f64a"><enum>(B)</enum><text display-inline="yes-display-inline">make such investigations and reports
				relating to the administration of the programs and operations of the Department
				that are necessary or desirable as determined by that senior official;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbe9d031104274c8da5d464c14df51ffa"><enum>(C)</enum><text display-inline="yes-display-inline">require by subpoena the production, by any
				person other than a Federal agency, of all information, documents, reports,
				answers, records, accounts, papers, and other data and documentary evidence
				necessary to performance of the responsibilities of the senior official under
				this section; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc91dfc993ff14ac089a662e40241208f"><enum>(D)</enum><text display-inline="yes-display-inline">administer to or take from any person an
				oath, affirmation, or affidavit, whenever necessary to performance of the
				responsibilities of the senior official under this section.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9d53e56e1b424b95b9dac01361b92240"><enum>(2)</enum><header>Enforcement of
				subpoenas</header><text display-inline="yes-display-inline">Any subpoena issued
				under paragraph (1)(C) shall, in the case of contumacy or refusal to obey, be
				enforceable by order of any appropriate United States district court.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID587fd14ee8a141e5a11423961d5ceb21"><enum>(3)</enum><header>Effect of
				oaths</header><text display-inline="yes-display-inline">Any oath, affirmation,
				or affidavit administered or taken under paragraph (1)(D) by or before an
				employee of the Privacy Office designated for that purpose by the senior
				official appointed under subsection (a) shall have the same force and effect as
				if administered or taken by or before an officer having a seal of
				office.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDbe2d18bcd4a9426fb3dd02fc40dab760"><enum>(c)</enum><header>Supervision</header>
						<paragraph commented="no" display-inline="no-display-inline" id="idBBE18F1B851A4FC386925B4722CCC329"><enum>(1)</enum><header>In
				General</header><text display-inline="yes-display-inline">The senior official
				appointed under subsection (a) shall report to, and be under the general
				supervision of the Secretary.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC688389E356341BFBE70EBF4689DE3D1"><enum>(2)</enum><header>Notification to
				Congress</header><text display-inline="yes-display-inline">If the Secretary
				removes the senior official appointed under subsection (a) or transfers that
				senior official to another position or location within the Department, the
				Secretary shall—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id7BBF52BFEEF6470694EAFCD208448F17"><enum>(A)</enum><text display-inline="yes-display-inline">promptly submit a written notification of
				the removal or transfer to Houses of Congress; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id181587BC137B4988BEC4F81D7EF991BE"><enum>(B)</enum><text display-inline="yes-display-inline">include in any such notification the
				reasons for the removal or transfer.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2e1f15de71294021abe4a244fac9a05e"><enum>(d)</enum><header>Reports by
				senior official to Congress</header><text display-inline="yes-display-inline">The senior official appointed under
				subsection (a) shall submit reports directly to the Congress regarding
				performance of the responsibilities of the senior official under this section,
				without any prior comment or amendment by the Secretary, Deputy Secretary, or
				any other officer or employee of the Department or the Office of Management and
				Budget.</text>
