		<official-title display="yes">To establish grant programs to improve the
		  health of border area residents and for bioterrorism preparedness in the border
		  area, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="IDC248173BC427494F889795DDC3DF5846" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Border Health Security Act of
			 2006</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="IDDFEE15655F8640828C2C82CD2F814D7C" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDD4CAEFD3CD8A4D4C8F947421701493AE"><enum>(1)</enum><header>Border
			 area</header><text display-inline="yes-display-inline">The term <term>border
			 area</term> has the meaning given the term <term>United States-Mexico Border
			 Area</term> in section 8 of the United States-Mexico Border Health Commission
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/22/290n-6">22 U.S.C.
			 290n–6</external-xref>).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2AA015015378433A942FF5985E005032"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Health and Human Services.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID4E657F92C82945A5BDB5BD31E77CEE7B" section-type="subsequent-section"><enum>3.</enum><header>Border health
			 grants</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID376F0F015D4942C8A7A538A5A5404E20"><enum>(a)</enum><header>Eligible entity
			 defined</header><text display-inline="yes-display-inline">In this section, the
			 term <term>eligible entity</term> means a State, public institution of higher
			 education, local government, tribal government, nonprofit health organization,
			 or community health center receiving assistance under
			 <external-xref legal-doc="act" parsable-cite="PHSA/330">section
			 330</external-xref> of the <act-name parsable-cite="PHSA">Public Health Service
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42
			 U.S.C. 254b</external-xref>), that is located in the border area.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3FCFE5DB8DF64E88007641BD8E87C1E6"><enum>(b)</enum><header>Authorization</header><text display-inline="yes-display-inline">From funds appropriated under subsection
			 (f), the Secretary, acting through the United States members of the United
			 States-Mexico Border Health Commission, shall award grants to eligible entities
			 to address priorities and recommendations to improve the health of border area
			 residents that are established by—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID971560E658B9474FA1E900D863F1008B"><enum>(1)</enum><text display-inline="yes-display-inline">the United States members of the United
			 States-Mexico Border Health Commission;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID01582B726546443A8DBC4FB2299C3FDB"><enum>(2)</enum><text display-inline="yes-display-inline">the State border health offices; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID020076E93F8C4276B31675D98CC8921B"><enum>(3)</enum><text display-inline="yes-display-inline">the Secretary.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID414D918476AB457197A9A3EA79C2E5FB"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity that desires a grant
			 under subsection (b) shall submit an application to the Secretary at such time,
			 in such manner, and containing such information as the Secretary may
			 require.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID7F377839CA2A45918FADF88BE7FF8B3B"><enum>(d)</enum><header>Use of
			 funds</header><text display-inline="yes-display-inline">An eligible entity that
			 receives a grant under subsection (b) shall use the grant funds for—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID5BCCD9F0F5A34AEAB0AD13EBC2CA34E4"><enum>(1)</enum><text display-inline="yes-display-inline">programs relating to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDD269F7EECD634D359905921372A539E0"><enum>(A)</enum><text display-inline="yes-display-inline">maternal and child health;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID785E9B11EA1B49438220936BAF872F6B"><enum>(B)</enum><text display-inline="yes-display-inline">primary care and preventative
			 health;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9D67621DE1204324A20086AAA9F2B739"><enum>(C)</enum><text display-inline="yes-display-inline">public health and public health
			 infrastructure;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID021B4AC5B4044DF2AF401127DC98E759"><enum>(D)</enum><text display-inline="yes-display-inline">health promotion;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC26CC42299A04E1AB5335F138D171558"><enum>(E)</enum><text display-inline="yes-display-inline">oral health;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4D1CFED7E04D42A391A205E9F83D1004"><enum>(F)</enum><text display-inline="yes-display-inline">behavioral and mental health;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB37A268DF9094ACE8CA003AE15F9B3E4"><enum>(G)</enum><text display-inline="yes-display-inline">substance abuse;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEAC96309C32D42C5A78ED7C900EE1370"><enum>(H)</enum><text display-inline="yes-display-inline">health conditions that have a high
			 prevalence in the border area;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID42541A6250A24E26B44057A9A8232F1C"><enum>(I)</enum><text display-inline="yes-display-inline">medical and health services
			 research;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6A012B2C4FDE421CBC8F9CA854D81098"><enum>(J)</enum><text display-inline="yes-display-inline">workforce training and development;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID49C78EFB74B341E492ECFC9459C30398"><enum>(K)</enum><text display-inline="yes-display-inline">community health workers or
			 promotoras;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID13FFC9FB8351430884DB6717EEC3323F"><enum>(L)</enum><text display-inline="yes-display-inline">health care infrastructure problems in the
			 border area (including planning and construction grants);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7D8B8BEE3C7A40DFAE3EB4DC01A39443"><enum>(M)</enum><text display-inline="yes-display-inline">health disparities in the border
			 area;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID55E4062367DF4BEC991267D7B4AEA3F7"><enum>(N)</enum><text display-inline="yes-display-inline">environmental health;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1D29D6B6F5794C66979B8105007BE887"><enum>(O)</enum><text display-inline="yes-display-inline">health education; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID95FD260685104B14B1DDB2F441DD4BF6"><enum>(P)</enum><text display-inline="yes-display-inline">outreach and enrollment services with
			 respect to Federal programs (including programs authorized under titles XIX and
			 XXI of the <act-name parsable-cite="SSA">Social Security Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C.
			 1396</external-xref> and 1397aa)); and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID194A6C4035374C64006322E6251C4DED"><enum>(2)</enum><text display-inline="yes-display-inline">other programs determined appropriate by
			 the Secretary.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8B9E373B3FD44505A6CDE02CC2DB33E0"><enum>(e)</enum><header>Supplement, not
			 supplant</header><text display-inline="yes-display-inline">Amounts provided to
			 an eligible entity awarded a grant under subsection (b) shall be used to
			 supplement and not supplant other funds available to the eligible entity to
			 carry out the activities described in subsection (d).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0707E19B6BF344609BAB21463D7E8146"><enum>(f)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section such sums as may be
			 necessary for fiscal year 2007 and each succeeding fiscal year.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID249CEC3C83524106810042936C89DBBC" section-type="subsequent-section"><enum>4.</enum><header>Border bioterrorism
			 preparedness grants</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDB095900973914A7F93C2B8A7006FA9FB"><enum>(a)</enum><header>Eligible entity
			 defined</header><text display-inline="yes-display-inline">In this section, the
			 term <term>eligible entity</term> means a State, local government, tribal
			 government, or public health entity.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID63E6585B8EB6450880079998570004B8"><enum>(b)</enum><header>Authorization</header><text display-inline="yes-display-inline">From funds appropriated under subsection
			 (e), the Secretary shall award grants to eligible entities for bioterrorism
			 preparedness in the border area.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID499DEBFBF72A4029BDBAD4AB7B88D747"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity that desires a grant
			 under this section shall submit an application to the Secretary at such time,
			 in such manner, and containing such information as the Secretary may
			 require.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID92BF6135C72F43C4BC61E9A36303FF35"><enum>(d)</enum><header>Uses of
			 funds</header><text display-inline="yes-display-inline">An eligible entity that
			 receives a grant under subsection (b) shall use the grant funds to, in
			 coordination with State and local bioterrorism programs—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID8D978F90C775452CA2978CA61111CB40"><enum>(1)</enum><text display-inline="yes-display-inline">develop and implement bioterror
			 preparedness plans and readiness assessments and purchase items necessary for
			 such plans;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID951CF6C69842499085D3AC979C000056"><enum>(2)</enum><text display-inline="yes-display-inline">coordinate bioterrorism and emergency
			 preparedness planning in the region;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8C18F4C55C9B405CB89FCF854961B782"><enum>(3)</enum><text display-inline="yes-display-inline">improve infrastructure, including syndrome
			 surveillance and laboratory capacity;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID094E7686235D47F7A76814AAB37811A5"><enum>(4)</enum><text display-inline="yes-display-inline">create a health alert network, including
			 risk communication and information dissemination;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7F6848612CAC45E7A2002CC4C2D6922B"><enum>(5)</enum><text display-inline="yes-display-inline">educate and train clinicians,
			 epidemiologists, laboratories, and emergency personnel; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID796583BAF37F404FB41FF86718CF0560"><enum>(6)</enum><text display-inline="yes-display-inline">carry out such other activities identified
			 by the Secretary, the United States-Mexico Border Health Commission, State and
			 local public health offices, and border health offices.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7335C2CD1FB8429CBE8B558DE5FCB322"><enum>(e)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $25,000,000 for fiscal
			 year 2007 and such sums as may be necessary for each succeeding fiscal
			 year.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID02FF1B2F1D7F475A809EC0629C7B0200" section-type="subsequent-section"><enum>5.</enum><header>United States-Mexico
			 Border Health Commission Act amendments</header><text display-inline="no-display-inline">The United States-Mexico Border Health
			 Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/22/290n">22
			 U.S.C. 290n</external-xref> et seq.) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="IDE2C730F7223F4E8FBB3922BDA7FAF1E9" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="ID8C75A3E6A219460CA8EC56ABE52F6BE5" section-type="subsequent-section"><enum>9.</enum><header>Authorization of
				appropriations</header><text display-inline="no-display-inline">There is
				authorized to be appropriated to carry out this Act $10,000,000 for fiscal year
				2007 and such sums as may be necessary for each succeeding fiscal
				year.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="ID97A15300805142BF814388D894D5A520" section-type="subsequent-section"><enum>6.</enum><header>Coordination of health
			 services and surveillance</header><text display-inline="no-display-inline">The
			 Secretary may coordinate with the Secretary of Homeland Security in
			 establishing a health alert system that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDAF256662F5C1433FB1ED6F674CE8538C"><enum>(1)</enum><text display-inline="yes-display-inline">alerts clinicians and public health
			 officials of emerging disease clusters and syndromes along the border area;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD017CA2D7B3A4B91A402403DA68D6922"><enum>(2)</enum><text display-inline="yes-display-inline">is alerted to signs of health threats or
			 bioterrorism along the border area.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id41292F21261846489960BCDAC3A099A4" section-type="subsequent-section"><enum>7.</enum><header>Binational public
			 health infrastructure and health insurance</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID2979c2ea936d4f629ed87e9928c1d7f5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services shall enter into a contract with the Institute of
			 Medicine for the conduct of a study concerning binational public health
			 infrastructure and health insurance efforts. In conducting such study, the
			 Institute shall solicit input from border health experts and health insurance
			 issuers.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID330bff7deeb14e3982b39eaf2b483761"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date on
			 which the Secretary of Health and Human Services enters into the contract under
			 subsection (a), the Institute of Medicine shall submit to the Secretary and the
			 appropriate committees of Congress a report concerning the study conducted
			 under such contract. Such report shall include the recommendations of the
			 Institute on ways to expand or improve binational public health infrastructure
			 and health insurance efforts.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id8B60925B7817412DA470F501295F7D02" section-type="subsequent-section"><enum>8.</enum><header>Provision of
			 recommendations and advice to Congress</header><text display-inline="no-display-inline">Section 5 of the United States-Mexico Border
			 Health Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/22/290n">22 U.S.C. 290n–3</external-xref>) is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id42E8D4D8F1BE41B6A87A54A351965B4F" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="idFEE63055351B4BCC9447B0D326D15179"><enum>(d)</enum><header>Providing
				advice and recommendations to Congress</header><text display-inline="yes-display-inline">A member of the Commission, or an
				individual who is on the staff of the Commission, may at any time provide
				advice or recommendations to Congress concerning issues that are considered by
				the Commission. Such advice or recommendations may be provided whether or not a
				request for such is made by a member of Congress and regardless of whether the
				member or individual is authorized to provide such advice or recommendations by
				the Commission or any other Federal
				official.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
