		<official-title>To amend title XVIII of the Social Security Act to extend
		  the annual, coordinated election period under the Medicare part D prescription
		  drug program through all of 2006 and to provide for a refund of excess premiums
		  paid during 2006, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Medicare Enrollment Fairness Act
			 of 2006</short-title></quote>.</text>
		</section><section changed="not-changed" id="ID937DB9B9139D4236998487322E825AA4"><enum>2.</enum><header>Extending the
			 annual, coordinated election period through all of 2006</header>
			<subsection changed="not-changed" id="idB62A3BA116FA4248B671B6399604450E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1851(e)(3)(B)
			 of the Social Security Act (42 U.S.C. 1395w–21(e)(3)(B)) is amended—</text>
				<paragraph changed="not-changed" id="IDDB76EBD54AB848F096F7AB8E9408D426"><enum>(1)</enum><text>in clause (iii),
			 by striking <quote>May 15, 2006</quote> and inserting <quote>December 31,
			 2006</quote>; and</text>
				</paragraph><paragraph changed="not-changed" id="ID4846DEAAC59242A4AD08637D755E31B0"><enum>(2)</enum><text>by adding at the
			 end the following new sentence:</text>
					<quoted-block id="ID701D871E221948D4A6B66B1A7600FF4C" style="OLC">
						<subparagraph id="IDFB049F655F9B4207886C3C45C5B86E46"><enum></enum><text>An
				individual making an election during the period beginning on November 15, 2006,
				and ending on December 15, 2006, shall specify whether the election is to be
				effective with respect to 2006 or with respect to 2007 (or
				both).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection changed="not-changed" id="ID0E725D14AC2D419CB77481E5B6536A36"><enum>(b)</enum><header>One-Time change
			 of plan enrollment for Medicare Prescription Drug Benefit during all of
			 2006</header>
				<paragraph changed="not-changed" id="ID540E194A35BD438CA0090093A3DC34AF"><enum>(1)</enum><header>In
			 general</header><text>Section 1851(e) of the Social Security Act (42 U.S.C.
			 1395w–21(e)) is amended—</text>
					<subparagraph changed="not-changed" id="IDC5EE9078235546B2ADD421323E9D76C9"><enum>(A)</enum><text>in paragraph
			 (2)(B)—</text>
						<clause changed="not-changed" id="ID090952DD991645248A965B558CEBFD51"><enum>(i)</enum><text>in the heading,
			 by striking <quote><header-in-text level="subparagraph" style="OLC">for first 6
			 months</header-in-text></quote>;</text>
						</clause><clause changed="not-changed" id="id2F5628D5BBE8451A955323DF8560032F"><enum>(ii)</enum><text>in clause (i),
			 by striking <quote>the first 6 months of 2006,</quote> and all that follows
			 through <quote>is a Medicare+Choice eligible individual,</quote> and inserting
			 <quote>2006,</quote>; and</text>
						</clause><clause changed="not-changed" id="ID701485A73724403DBD2E892B6DB204BD"><enum>(iii)</enum><text>in clause (ii),
			 by inserting <quote>(other than during 2006)</quote> after <quote>paragraph
			 (3)</quote>; and</text>
						</clause></subparagraph><subparagraph changed="not-changed" id="ID352252F4AAC54844B1C23749B846B050"><enum>(B)</enum><text>in paragraph (4),
			 by striking <quote>2006</quote> and inserting <quote>2007</quote> each place it
			 appears.</text>
					</subparagraph></paragraph><paragraph changed="not-changed" id="ID0051335BF722410ABD2E286EADD7A79D"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 1860D–1(b)(1)(B)(iii) of the Social Security
			 Act (42 U.S.C. 1395w–101(b)(1)(B)(iii)) is amended by striking
			 <quote>subparagraphs (B) and (C) of paragraph (2)</quote> and inserting
			 <quote>paragraph (2)(C)</quote>.</text>
				</paragraph></subsection><subsection changed="not-changed" id="ID86F60034E67B4BD4BDFA6DF9017B78AC"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect as if
			 included in the enactment of section 101(a) of the Medicare Prescription Drug,
			 Improvement, and Modernization Act of 2003 (Public Law 108–173;
			 <external-xref legal-doc="statute-at-large" parsable-cite="stat/117/2071">117
			 Stat. 2071</external-xref>).</text>
			</subsection></section><section id="IDD0B29EE5657942F99F3F2AA80B01515D"><enum>3.</enum><header>Increased
			 funding for State health insurance counseling and assistance programs</header>
			<subsection id="ID5E59BE06D2464B2A9CEB129EE2302186"><enum>(a)</enum><header>In
			 General</header><text>There are hereby appropriated to the Secretary of Health
			 and Human Services (in this section referred to as the
			 <quote>Secretary</quote>) an amount equal to $2 multiplied by the total number
			 of individuals eligible for benefits under title XVIII of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395 et
			 seq.). Such funds shall—</text>
				<paragraph id="ID584AB90186884D3AAB51E28E2C9BB647"><enum>(1)</enum><text>be used by the
			 Secretary to award grants to States under section 4360 of the Omnibus Budget
			 Reconciliation Act of 1990 (42 U.S.C. 1395b–4); and</text>
				</paragraph><paragraph id="ID8BF872F3F79243508E82018CF23C2639"><enum>(2)</enum><text>remain available
			 until expended.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID83DE1471318944AEA0C80A5E8CD24869"><enum>(b)</enum><header>Allocation of
			 Grant Funds</header><text>The Secretary shall ensure that funds appropriated
			 under this section are allocated to States in an amount equal to the proportion
			 of the number of residents in the State that are eligible for benefits under
			 title XVIII of the <act-name parsable-cite="SSA">Social Security Act</act-name>
			 (42 U.S.C. 1395 et seq.) in relation to the total number of individuals
			 eligible for such benefits under such title.</text>
