		<official-title display="yes">To authorize the President to utilize
		  Federal equipment, supplies, facilities, personnel, and other non-monetary
		  resources to assist utility companies that contribute to recovery efforts from
		  the effects of a major disaster.</official-title>

		<section commented="no" display-inline="no-display-inline" id="idF04E5D4E4EBF4A07AED1F410C13247C5" section-type="section-one"><enum>1.</enum><header>Utility company disaster
			 assistance</header><text display-inline="no-display-inline">Title IV of the
			 Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5170
			 et seq.) is amended by adding at the end the following:</text>

				<section commented="no" display-inline="no-display-inline" id="idE6666DD1171E4A0C80AF2CBEBABCF1EB" section-type="subsequent-section"><enum>425.</enum><header>Utility
				companies</header>
					<subsection commented="no" display-inline="no-display-inline" id="idDCE0F163868A4A4DB56B5E361E5E2C2D"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>qualified
				utility company</term> means an entity that—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id051AAC08356641B7AA7B66E4899D2CEF"><enum>(1)</enum><text display-inline="yes-display-inline">provides—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id2E5FD30B52D34651AA520B1006D00242"><enum>(A)</enum><text display-inline="yes-display-inline">telecommunications service;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF6744B516E424B009EFBDA852C5CDDAF"><enum>(B)</enum><text display-inline="yes-display-inline">electrical power;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id69D709B78EDD4CBEA17FB0D5F49BECAE"><enum>(C)</enum><text display-inline="yes-display-inline">natural gas;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7011DB0D3FF04C6D8B25E63C45CB4B04"><enum>(D)</enum><text display-inline="yes-display-inline">water and sewer services; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBE8F8C44DFDC44909BE2552A4E9D2DF4"><enum>(E)</enum><text display-inline="yes-display-inline">any other essential service, as determined
				by the President;</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2D83E18788F74765B69B5BEC56A90E13"><enum>(2)</enum><text display-inline="yes-display-inline">is a private, for-profit entity; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80A98F4450674E41A3F1A059D5BB6D3C"><enum>(3)</enum><text display-inline="yes-display-inline">is contributing to efforts to recover from
				the effects of a major disaster.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE9A5FE4D67D1443F8BFD6C9B284D62B8"><enum>(b)</enum><header>Authorization</header><text display-inline="yes-display-inline">In a major disaster, the President may
				utilize Federal equipment, supplies, facilities, personnel, and other
				non-monetary resources to assist a qualified utility company, in exchange for
				reasonable compensation.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id62D703CABA814D0B94296D0AFA497DB6"><enum>(c)</enum><header>Compensation</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id4ABA6A14928D4F75BBCC85D2CC7031CF"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The President shall,
				by regulation, establish a mechanism to set reasonable compensation for the
				provision of assistance under subsection (b).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21D49041B26948E39769A39358ADFCF6"><enum>(2)</enum><header>Criteria</header><text display-inline="yes-display-inline">The mechanism established under paragraph
				(1)—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idD0F3CE138EBA41F98482749F3B066CE4"><enum>(A)</enum><text display-inline="yes-display-inline">shall reflect fair market value for the
				assistance provided under subsection (b) in setting compensation;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96FDE51D83A84639A64D5494A0E91CF8"><enum>(B)</enum><text display-inline="yes-display-inline">shall have streamlined procedures for
				determining compensation; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id35A84BEB1CF34B95BA843A486340A12C"><enum>(C)</enum><text display-inline="yes-display-inline">is not required to set compensation based
				on the costs to the Federal
				Government.</text>
