			 Secretary</header><text display-inline="no-display-inline">In this Act, the
			 term <term>Secretary</term> means the Secretary of Energy.</text>
		</section><title commented="no" id="id63F5376EFB504D3992B7816111A9F649" style="OLC"><enum>I</enum><header>National oil savings plan and
			 requirements</header>
			<section commented="no" display-inline="no-display-inline" id="ID55805116cb7a470a84ad931e64b385a4" section-type="subsequent-section"><enum>101.</enum><header>Oil savings target
			 and action plan</header><text display-inline="no-display-inline">Not later than
			 270 days after the date of enactment of this Act, the Director of the Office of
			 Management and Budget (referred to in this title as the
			 <quote>Director</quote>) shall publish in the Federal Register an action plan
			 consisting of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID62060fcfa8354fd6ad58cf1d98c05c58"><enum>(1)</enum><text display-inline="yes-display-inline">a list of requirements proposed or to be
			 proposed pursuant to section 102 that are authorized to be issued under law in
			 effect on the date of enactment of this Act, and this Act, that will be
			 sufficient, when taken together, to save from the baseline determined under
			 section 105—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID35123b4c87964191bbdd5d005ab20cdb"><enum>(A)</enum><text display-inline="yes-display-inline">2,500,000 barrels of oil per day on average
			 during calendar year 2016;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID46e537d40e5a46b9a5f45eec87b33e41"><enum>(B)</enum><text display-inline="yes-display-inline">7,000,000 barrels of oil per day on average
			 during calendar year 2026; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID69e8dec8ba68453abc4c36d75ab5a3cd"><enum>(C)</enum><text display-inline="yes-display-inline">10,000,000 barrels per day on average
			 during calendar year 2031; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID660e3ec87b79442cab7ddce876546d18"><enum>(2)</enum><text display-inline="yes-display-inline">a Federal Government-wide analysis
			 of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID5f66aed3d338498da9831dee9eaec1c6"><enum>(A)</enum><text display-inline="yes-display-inline">the expected oil savings from the baseline
			 to be accomplished by each requirement; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf09682867e6f488989174ab919122b21"><enum>(B)</enum><text display-inline="yes-display-inline">whether all such requirements, taken
			 together, will achieve the oil savings specified in this section.</text>
					</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="ID24528fc8035c477897cf1dd6dff69daa" section-type="subsequent-section"><enum>102.</enum><header>Standards and
			 requirements</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID5ad250ce6d034fce8ea9d0ef53709f1b"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">On or before the date
			 of publication of the action plan under section 101, the Secretary of Energy,
			 the Secretary of Transportation, the Secretary of Defense, the Secretary of
			 Agriculture, the Administrator of the Environmental Protection Agency, and the
			 head of any other agency the President determines appropriate shall each
			 propose, or issue a notice of intent to propose, regulations establishing each
			 standard or other requirement listed in the action plan that is under the
			 jurisdiction of the respective agency using authorities described in subsection
			 (b).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID912ac0947b124327a0f61707a280338f"><enum>(b)</enum><header>Authorities</header><text display-inline="yes-display-inline">The head of each agency described in
			 subsection (a) shall use to carry out this section—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id3211C4CA91D4441DBED11EC0137FC5AE"><enum>(1)</enum><text display-inline="yes-display-inline">any authority in existence on the date of
			 enactment of this Act (including regulations); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0DAD7CB664814B75AACA643244541A18"><enum>(2)</enum><text display-inline="yes-display-inline">any new authority provided under this Act
			 (including an amendment made by this Act).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDca568e3edfb946cabb90d815ad0e5347"><enum>(c)</enum><header>Final
			 regulations</header><text display-inline="yes-display-inline">Not later than 18
			 months after the date of enactment of this Act, the head of each agency
			 described in subsection (a) shall promulgate final versions of the regulations
			 required under this section.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3d1cb9aa074c40978ce680af7c5f6ea3"><enum>(d)</enum><header>Agency
			 analyses</header><text display-inline="yes-display-inline">Each proposed and
			 final regulation promulgated under this section shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDf4102744e872481e97c1135c2176b05d"><enum>(1)</enum><text display-inline="yes-display-inline">be designed to achieve at least the oil
			 savings resulting from the regulation under the action plan published under
			 section 101; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5811384942aa44ecb2cffe5348070a46"><enum>(2)</enum><text display-inline="yes-display-inline">be accompanied by an analysis by the
			 applicable agency describing the manner in which the regulation will promote
			 the achievement of the oil savings from the baseline determined under section
			 105.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDac2abff9777b4217a2474298dd36d28d" section-type="subsequent-section"><enum>103.</enum><header>Initial
			 evaluation</header>
				<subsection commented="no" display-inline="no-display-inline" id="IDa18582bda0cc474fabf02439caa64e15"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 2
			 years after the date of enactment of this Act, the Director shall publish in
			 the Federal Register a Federal Government-wide analysis of the oil savings
			 achieved from the baseline established under section 105.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID8132a33a2b2947ce9d67a2399eaa474b"><enum>(b)</enum><header>Inadequate oil
			 savings</header><text display-inline="yes-display-inline">If the oil savings
			 are less than the targets established under section 101, simultaneously with
			 the analysis required under subsection (a)—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID74cfb5a1f5f04f4583933177be6a3259"><enum>(1)</enum><text display-inline="yes-display-inline">the Director shall publish a revised action
			 plan that is adequate to achieve the targets; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7cfb9f3904b0421ba0ebc882aede7e92"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of Energy, the Secretary of
			 Transportation, and the Administrator shall propose new or revised regulations
			 under subsections (a), (b), and (c), respectively, of section 102.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDd4624c8c56234915888616630d58c617"><enum>(c)</enum><header>Final
			 regulations</header><text display-inline="yes-display-inline">Not later than
			 180 days after the date on which regulations are proposed under subsection
			 (b)(2), the Secretary of Energy, the Secretary of Transportation, and the
			 Administrator shall promulgate final versions of those regulations.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="IDb9647e97259a4bacbc2bff13b578376c" section-type="subsequent-section"><enum>104.</enum><header>Review and update of
			 action plan</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID29e56ee7c637485f9aa07ec67f245607"><enum>(a)</enum><header>Review</header><text display-inline="yes-display-inline">Not later than January 1, 2011, and every 3
			 years thereafter, the Director shall submit to Congress, and publish, a report
			 that—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDea13766f386f4140b6b95e916826b7ff"><enum>(1)</enum><text display-inline="yes-display-inline">evaluates the progress achieved in
			 implementing the oil savings targets established under section 101;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6bde967e6c344db8a97bc6deb7e3eef9"><enum>(2)</enum><text display-inline="yes-display-inline">analyzes the expected oil savings under the
			 standards and requirements established under this Act and the amendments made
			 by this Act; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID52047d386fe2447d980d45e81e5acb96"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idCA3AA0B694824BFBAF90954A6F1740A0"><enum>(A)</enum><text display-inline="yes-display-inline">analyzes the potential to achieve oil
			 savings that are in addition to the savings required by section 101; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBBC3FD7948C64C27A255393EF3F05667" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">if
			 the President determines that it is in the national interest, establishes a
			 higher oil savings target for calendar year 2017 or any subsequent calendar
			 year.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5aa9090cc72e4af1bff59a0f4901debc"><enum>(b)</enum><header>Inadequate oil
			 savings</header><text display-inline="yes-display-inline">If the oil savings
			 are less than the targets established under section 101, simultaneously with
			 the report required under subsection (a)—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID2f150fee02b34fcc8a8556911644c5cc"><enum>(1)</enum><text display-inline="yes-display-inline">the Director shall publish a revised action
			 plan that is adequate to achieve the targets; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7b98d0d6bee84f288860907aeb3cd639"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of Energy, the Secretary of
			 Transportation, and the Administrator shall propose new or revised regulations
			 under subsections (a), (b), and (c), respectively, of section 102.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID566031c2ec6247d6ac4f013d701ffe54"><enum>(c)</enum><header>Final
			 regulations</header><text display-inline="yes-display-inline">Not later than
			 180 days after the date on which regulations are proposed under subsection
			 (b)(2), the Secretary of Energy, the Secretary of Transportation, and the
			 Administrator shall promulgate final versions of those regulations.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="IDf78ab9817612400e89d705ca140b4e61" section-type="subsequent-section"><enum>105.</enum><header>Baseline and
			 analysis requirements</header><text display-inline="no-display-inline">In
			 performing the analyses and promulgating proposed or final regulations to
			 establish standards and other requirements necessary to achieve the oil savings
			 required by this title, the Secretary of Energy, the Secretary of
			 Transportation, the Secretary of Defense, the Secretary of Agriculture, the
			 Administrator of the Environmental Protection Agency, and the head of any other
			 agency the President determines to be appropriate shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID10b781cec1244abc9936ca1784fad5eb"><enum>(1)</enum><text display-inline="yes-display-inline">determine oil savings as the projected
			 reduction in oil consumption from the baseline established by the reference
			 case contained in the report of the Energy Information Administration entitled
			 <quote>Annual Energy Outlook 2005</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID119dd2e4aa754c758a3295ad5a794f7d"><enum>(2)</enum><text display-inline="yes-display-inline">determine the oil savings projections
			 required on an annual basis for each of calendar years 2009 through 2026;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID633b4a3a676b40bf9df115a8290f22ae"><enum>(3)</enum><text display-inline="yes-display-inline">account for any overlap among the standards
			 and other requirements to ensure that the projected oil savings from all the
			 promulgated standards and requirements, taken together, are as accurate as
			 practicable.</text>
				</paragraph></section></title><title commented="no" id="id8BD13B7EA43E4FDA92A3759C0FC39E59" style="OLC"><enum>II</enum><header>Federal programs for the conservation of oil
			 </header>
			<section commented="no" display-inline="no-display-inline" id="id3A4E0A52E35F49B0B6A2DEC425F65EA0" section-type="subsequent-section"><enum>201.</enum><header>Federal fleet
			 conservation requirements</header>
				<subsection commented="no" display-inline="no-display-inline" id="id0C323AEDCCB44B2AA4365FB80C6C2A27"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part J of title IV of
			 the Energy Policy and Conservation Act (42 U.S.C. 6374 et seq.) is amended by
			 adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idF25EB23692244044B91AC550E28AB77C" style="OLC">
						<section commented="no" display-inline="no-display-inline" id="id41CC4028252A4F75850B58C68975BE65" section-type="subsequent-section"><enum>400FF.</enum><header>Federal fleet
				conservation requirements</header>
							<subsection commented="no" display-inline="no-display-inline" id="ID87e1e61f24ba4f11a65a426eccf7d528"><enum>(a)</enum><header>Mandatory
				reduction in petroleum consumption</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id85196DE3C5A44BE4ADED6E391D579EF2"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				issue regulations for Federal fleets subject to section 400AA requiring that
				not later than October 1, 2009, each Federal agency achieve at least a 20
				percent reduction in petroleum consumption, as calculated from the baseline
				established by the Secretary for fiscal year 1999.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92725F17DCB841D9B9460369296651D6"><enum>(2)</enum><header>Plan</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="id028A3617C2A94CD1BC8F79E3AA931869"><enum>(A)</enum><header>Requirement</header><text display-inline="yes-display-inline">The regulations shall require each Federal
				agency to develop a plan to meet the required petroleum reduction level.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD7BC8ADC5A164C70BA3877C6DC115E81"><enum>(B)</enum><header>Measures</header><text display-inline="yes-display-inline">The plan may allow an agency to meet the
				required petroleum reduction level through—</text>
										<clause commented="no" display-inline="no-display-inline" id="idCAC28535316049A794721FD664FC44EF"><enum>(i)</enum><text display-inline="yes-display-inline">the use of alternative fuels;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idECEA30BC7669401EB332F83DE4EB2CBE"><enum>(ii)</enum><text display-inline="yes-display-inline">the acquisition of vehicles with higher
				fuel economy, including hybrid vehicles;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id5B0E2304E68D47E6A5A273ECD54EDEB6"><enum>(iii)</enum><text display-inline="yes-display-inline">the substitution of cars for light
				trucks;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idF1EFBBDBF1DF4C2DBDE2E8B482EB3AAA"><enum>(iv)</enum><text display-inline="yes-display-inline">an increase in vehicle load factors;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id2B5348FE6B5F4B58B8B8093EC4520DA1"><enum>(v)</enum><text display-inline="yes-display-inline">a decrease in vehicle miles
				traveled;</text>

				shall actively promote incentive programs that encourage Federal employees and
				contractors to reduce petroleum through the use of practices such as—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID1966420DAA1A44A3000596F3AE72DE7C"><enum>(1)</enum><header>Fuel-efficient
			 automobile</header><text display-inline="yes-display-inline">The term
			 <term>fuel-efficient automobile</term> means a passenger automobile or a
			 light-duty truck that has a fuel economy rating that is 40 percent greater than
			 the average fuel economy standard prescribed pursuant to section 32902 of title
			 49, United States Code, or other law, applicable to the passenger automobile or
			 light-duty truck.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID85090e1b38aa4b0683f14fc7fa81e28b"><enum>(2)</enum><header>Fuel-inefficient
			 automobiles</header><text display-inline="yes-display-inline">The term
			 <term>fuel-inefficient automobile</term> means a passenger automobile or a
			 light-duty truck manufactured in a model year more than 15 years before the
			 fiscal year in which appropriations are made under subsection (f) that, at the
			 time of manufacture, had a fuel economy rating that was equal to or less than
			 20 miles per gallon.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID496C126063984402A4D4F13D70BE777B"><enum>(3)</enum><header>Light-duty
			 truck</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id7748A44E96FD4809859F449DE0E5061C"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The term
			 <term>light-duty truck</term> means an automobile that is not a passenger
			 automobile.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32C27E81E5924323BF0DDC8C5A72D6FE"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>light-duty truck</term>
			 includes a pickup truck, a van, or a four-wheel-drive general utility vehicle,
			 as those terms are defined in section 600.002–85 of title 40, Code of Federal
			 Regulations.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID186DC990389F4120AE0067DCF1BBE7ED"><enum>(4)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means any of
			 the several States and the District of Columbia.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCF640295BACF4C1D81DBA47273451EEA"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a program, to
			 be known as the <quote>National Motor Vehicle Efficiency Improvement
			 Program,</quote> under which the Secretary shall provide grants to States to
			 operate voluntary programs to offer owners of fuel inefficient automobiles
			 financial incentives to replace the automobiles with fuel efficient
			 automobiles.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDC4BF4A6094D742FBBEC249FC1EDA214B"><enum>(c)</enum><header>Eligibility
			 criteria</header><text display-inline="yes-display-inline">The Secretary shall
			 approve a State plan and provide the funds made available under subsection (f),
			 if the State plan—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID46E0076B7C414B51BE00D33562654F07"><enum>(1)</enum><text display-inline="yes-display-inline">except as provided in paragraph (8),
			 requires that all passenger automobiles and light-duty trucks turned in be
			 scrapped, after allowing a period of time for the recovery of spare
			 parts;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE8BA9837CB9F403CA66CD38440A89947"><enum>(2)</enum><text display-inline="yes-display-inline">requires that all passenger automobiles and
			 light-duty trucks turned in be registered in the State in order to be
			 eligible;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID26715612FB07452F8DBDDBF5DB144696"><enum>(3)</enum><text display-inline="yes-display-inline">requires that all passenger automobiles and
			 light-duty trucks turned in be operational at the time that the passenger
			 automobiles and light-duty trucks are turned in;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB362383543A44E9A94A1DDD44FFC97CC"><enum>(4)</enum><text display-inline="yes-display-inline">restricts automobile owners (except
			 not-for-profit organizations) from turning in more than 1 passenger automobile
			 and 1 light-duty truck during a 1-year period;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFB3CC6FC577B451BA15359D428DDF6C5"><enum>(5)</enum><text display-inline="yes-display-inline">provides an appropriate payment to the
			 person recycling the scrapped passenger automobile or light-duty truck for each
			 turned-in passenger automobile or light-duty truck;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID00FB1D1F60BD4DA495C603BB626D2149"><enum>(6)</enum><text display-inline="yes-display-inline">subject to subsection (d)(2), provides a
			 minimum payment to the automobile owner for each passenger automobile and
			 light-duty truck turned in; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDefe549f3f2344a88b130f5bb43a9aba4"><enum>(7)</enum><text display-inline="yes-display-inline">provides appropriate exceptions to the
			 scrappage requirement for vehicles that qualify as antique cars under State
			 law.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID37BFFF27F7F145E6B900615E74E28885"><enum>(d)</enum><header>State
			 Plan</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idECA5A3B3C3714099B8D9E34BE03BAE22"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">To be eligible to
			 receive funds under the program, the Governor of a State shall submit to the
			 Secretary a plan to carry out a program under this section in that
			 State.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4FCD3C3E018342039F3EBEA249BFA5CB"><enum>(2)</enum><header>Additional
			 State credit</header><text display-inline="yes-display-inline">In addition to
			 the payment under subsection (c)(6), the State plan may provide a credit that
			 may be redeemed by the owner of the replaced fuel-inefficient automobile at the
			 time of purchase of the new fuel-efficient automobile.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id47149CD97C464090BB3C6E9AE929FA04"><enum>(e)</enum><header>Allocation
			 formula</header><text display-inline="yes-display-inline">The amounts
			 appropriated pursuant to subsection (f) shall be allocated among the States on
			 the basis of the number of registered motor vehicles in each State at the time
			 that the Secretary needs to compute shares under this subsection.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id778F131D2C4B4830944C77C62C2DBAD1"><enum>(f)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Secretary such sums as are necessary to
			 carry out this section, to remain available until expended.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id599E380FB11A496A8761E79CEA7FC62E" section-type="subsequent-section"><enum>203.</enum><header>Assistance to States
			 to reduce school bus idling</header>
				<subsection commented="no" display-inline="no-display-inline" id="id8A88A06B8F8642B1A375DAA2ED74822A"><enum>(a)</enum><header>Statement of
			 policy</header><text display-inline="yes-display-inline">Congress encourages
			 each local educational agency (as defined in section 9101(26) of the Elementary
			 and Secondary Education Act of 1965 (20 U.S.C. 7801(26))) that receives Federal
			 funds under the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6301
			 et seq.) to develop a policy to reduce the incidence of school bus idling at
			 schools while picking up and unloading students.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID39193a5941eb492d917467146c423895"><enum>(b)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Secretary of Energy, working in
			 coordination with the Secretary of Education, $5,000,000 for each of fiscal
			 years 2007 through 2012 for use in educating States and local education
			 agencies about—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idB9DDCE18411447F7B57EFF136023915E"><enum>(1)</enum><text display-inline="yes-display-inline">benefits of reducing school bus idling;
			 and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBAF29107C4694DE28CA53F216A5B312F"><enum>(2)</enum><text display-inline="yes-display-inline">ways in which school bus idling may be
			 reduced.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idAD5AA08E70274F3A849B64307FC0CA50" section-type="subsequent-section"><enum>204.</enum><header>Near-term vehicle
			 technology program</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID1cbf0a5c37004a4faca9a5678d124ad2"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this section are—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID91aa8702c5d74b2197afb5d719f340d5"><enum>(1)</enum><text display-inline="yes-display-inline">to enable and promote, in partnership with
			 industry, comprehensive development, demonstration, and commercialization of a
			 wide range of electric drive components, systems, and vehicles using diverse
			 electric drive transportation technologies;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7d917458b09449ee97249605e8f732e9"><enum>(2)</enum><text display-inline="yes-display-inline">to make critical public investments to help
			 private industry, institutions of higher education, National Laboratories, and
			 research institutions to expand innovation, industrial growth, and jobs in the
			 United States;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf0bf147647494ab2a0656458aeb21ba6"><enum>(3)</enum><text display-inline="yes-display-inline">to expand the availability of the existing
			 electric infrastructure for fueling light duty transportation and other on-road
			 and nonroad vehicles that are using petroleum and are mobile sources of
			 emissions—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID2150e2ee73c64273bd475a6ce123e9c4"><enum>(A)</enum><text display-inline="yes-display-inline">including the more than 3,000,000 reported
			 units (such as electric forklifts, golf carts, and similar nonroad vehicles) in
			 use on the date of enactment of this Act; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID67e8a998fc6942dcbf1a79bb60d3683d"><enum>(B)</enum><text display-inline="yes-display-inline">with the goal of enhancing the energy
			 security of the United States, reduce dependence on imported oil, and reduce
			 emissions through the expansion of grid supported mobility;</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID036d7af1a9614e5fb17a8cf375a6b1e9"><enum>(4)</enum><text display-inline="yes-display-inline">to accelerate the widespread
			 commercialization of all types of electric drive vehicle technology into all
			 sizes and applications of vehicles, including commercialization of plug-in
			 hybrid electric vehicles and plug-in hybrid fuel cell vehicles; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID230805099a5a46858605b8cd93b3d7c6"><enum>(5)</enum><text display-inline="yes-display-inline">to improve the energy efficiency of and
			 reduce the petroleum use in transportation.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID104adb54eb5d4f7d8b349e7d8176763d"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID09b336f7fdfd4edbbe47f256df24ad7f"><enum>(1)</enum><header>Battery</header><text display-inline="yes-display-inline">The term <term>battery</term> means an
			 energy storage device used in an on-road or nonroad vehicle powered in whole or
			 in part using an off-board or on-board source of electricity.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcc2d65b6205c4e94b8f07c052da6c3c9"><enum>(2)</enum><header>Electric drive
			 transportation technology</header><text display-inline="yes-display-inline">The
			 term <term>electric drive transportation technology</term> means—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID0b7fa0510fe54ef0b3daf8c014700efb"><enum>(A)</enum><text display-inline="yes-display-inline">vehicles that use an electric motor for all
			 or part of their motive power and that may or may not use off-board
			 electricity, including battery electric vehicles, fuel cell vehicles, engine
			 dominant hybrid electric vehicles, plug-in hybrid electric vehicles, plug-in
			 hybrid fuel cell vehicles, and electric rail; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID98d97564fc8d4bc091dac1171c1c1734"><enum>(B)</enum><text display-inline="yes-display-inline">equipment relating to transportation or
			 mobile sources of air pollution that use an electric motor to replace an
			 internal combustion engine for all or part of the work of the equipment,
			 including corded electric equipment linked to transportation or mobile sources
			 of air pollution.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID166213dd44d84dd4ae5d2e213e881d45"><enum>(3)</enum><header>Engine dominant
			 hybrid electric vehicle</header><text display-inline="yes-display-inline">The
			 term <term>engine dominant hybrid electric vehicle</term> means an on-road or
			 nonroad vehicle that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idEDC8599649EE4972B04549B09412D95C"><enum>(A)</enum><text display-inline="yes-display-inline">is propelled by an internal combustion
			 engine or heat engine using—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID099e978a3627422d9d8fcef58cdc2bdc"><enum>(i)</enum><text display-inline="yes-display-inline">any combustible fuel;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID872e1ca29b424cf38a46c3bdeac1891f"><enum>(ii)</enum><text display-inline="yes-display-inline">an on-board, rechargeable storage device;
			 and</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8a52d534c9b1444a91c33ebbf3151ab7"><enum>(B)</enum><text display-inline="yes-display-inline">has no means of using an off-board source
			 of electricity.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdeb49e5345bb454ebad1fbe3def75dfc"><enum>(4)</enum><header>Fuel cell
			 vehicle</header><text display-inline="yes-display-inline">The term <term>fuel
			 cell vehicle</term> means an on-road or nonroad vehicle that uses a fuel cell
			 (as defined in section 3 of the Spark M. Matsunaga Hydrogen Research,
			 Development, and Demonstration Act of 1990).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID03398357c04c487b9c89c712b2cff5fd"><enum>(5)</enum><header>Nonroad
			 vehicle</header><text display-inline="yes-display-inline">The term
			 <term>nonroad vehicle</term> has the meaning given the term in section 216 of
			 the Clean Air Act (42 U.S.C. 7550).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID47757304baa04f709a11561a70f3a7fa"><enum>(6)</enum><header>Plug-in hybrid
			 electric vehicle</header><text display-inline="yes-display-inline">The term
			 <term>plug-in hybrid electric vehicle</term> means an on-road or nonroad
			 vehicle that is propelled by an internal combustion engine or heat engine
			 using—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDecb4eadded3d4e9cbb935241bf6f8934"><enum>(A)</enum><text display-inline="yes-display-inline">any combustible fuel;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID336664e0314c40c29ea539a1c394a974"><enum>(B)</enum><text display-inline="yes-display-inline">an on-board, rechargeable storage device;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID88854706722e44c5a1172b9b21a143b7"><enum>(C)</enum><text display-inline="yes-display-inline">a means of using an off-board source of
			 electricity.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf6df8c9fb5da484fbc6ae96c7ad8c51f"><enum>(7)</enum><header>Plug-in hybrid
			 fuel cell vehicle</header><text display-inline="yes-display-inline">The term
			 <term>plug-in hybrid fuel cell vehicle</term> means a fuel cell vehicle with a
			 battery powered by an off-board source of electricity.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1516f1b46b964dc2a5f2525ffd2f874b"><enum>(c)</enum><header>Program</header><text display-inline="yes-display-inline">The Secretary shall conduct a program of
			 research, development, demonstration, and commercial application for electric
			 drive transportation technology, including—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDde834b19ae4d449a9f694abca3ad67e6"><enum>(1)</enum><text display-inline="yes-display-inline">high capacity, high efficiency
			 batteries;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1d0aeba541e24d72895bb822c9b13aa0"><enum>(2)</enum><text display-inline="yes-display-inline">high efficiency on-board and off-board
			 charging components;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf1944668d98a4121b0c7fba7231af451"><enum>(3)</enum><text display-inline="yes-display-inline">high power drive train systems for
			 passenger and commercial vehicles and for nonroad equipment;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaa6f5227ec714328827fb1484f6d2c2e"><enum>(4)</enum><text display-inline="yes-display-inline">control system development and power train
			 development and integration for plug-in hybrid electric vehicles, plug-in
			 hybrid fuel cell vehicles, and engine dominant hybrid electric vehicles,
			 including—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID71c283003f6f48f587f61b5ffafcfbf2"><enum>(A)</enum><text display-inline="yes-display-inline">development of efficient cooling
			 systems;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID29de2509d7dd4afb8b2dbf879be692a9"><enum>(B)</enum><text display-inline="yes-display-inline">analysis and development of control systems
			 that minimize the emissions profile when clean diesel engines are part of a
			 plug-in hybrid drive system; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID47ec7eb5b72241c8aa73272fba990ea6"><enum>(C)</enum><text display-inline="yes-display-inline">development of different control systems
			 that optimize for different goals, including—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDb81d0540e1204603b0ea93bc016263fa"><enum>(i)</enum><text display-inline="yes-display-inline">battery life;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID2f53c5a95ce24dc0a4c7e3093b4504ee"><enum>(ii)</enum><text display-inline="yes-display-inline">reduction of petroleum consumption;
			 and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID6035f8ab46f540639c398ddf607831e0"><enum>(iii)</enum><text display-inline="yes-display-inline">green house gas reduction;</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID70ab4e2610d04b2abde0cc3f3066d79a"><enum>(5)</enum><text display-inline="yes-display-inline">nanomaterial technology applied to both
			 battery and fuel cell systems;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0939218e0b7a4aed8cb49ed709a24aee"><enum>(6)</enum><text display-inline="yes-display-inline">large-scale demonstrations, testing, and
			 evaluation of plug-in hybrid electric vehicles in different applications with
			 different batteries and control systems, including—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID5e38606b9e1b4d25ac3cff65995250aa"><enum>(A)</enum><text display-inline="yes-display-inline">military applications;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8a2ec77f6d4b4161ab57d15da1233fbe"><enum>(B)</enum><text display-inline="yes-display-inline">mass market passenger and light-duty truck
			 applications;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID425ab3ba28e644f7b851990533d307be"><enum>(C)</enum><text display-inline="yes-display-inline">private fleet applications; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf62ed773ae1648a284dfe2b59ad92407"><enum>(D)</enum><text display-inline="yes-display-inline">medium- and heavy-duty applications;</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfdc46ec6a9694a89b0dac3bf572e68ef"><enum>(7)</enum><text display-inline="yes-display-inline">a nationwide education strategy for
			 electric drive transportation technologies providing secondary and high school
			 teaching materials and support for university education focused on electric
			 drive system and component engineering;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3c36ebf630044489ac3c8f94c24b7e28"><enum>(8)</enum><text display-inline="yes-display-inline">development, in consultation with the
			 Administrator of the Environmental Protection Agency, of procedures for testing
			 and certification of criteria pollutants, fuel economy, and petroleum use for
			 light-, medium-, and heavy-duty vehicle applications, including consideration
			 of—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDb11bda1bf10f449eb54b9230e98b7680"><enum>(A)</enum><text display-inline="yes-display-inline">the vehicle and fuel as a system, not just
			 an engine; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbeeb7e2eb75b416fb43a5cbc85055de8"><enum>(B)</enum><text display-inline="yes-display-inline">nightly off-board charging; and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID840e89f7706d41daa977d02b0db686f0"><enum>(9)</enum><text display-inline="yes-display-inline">advancement of battery and corded electric
			 transportation technologies in mobile source applications by—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDf8a680b87b4343ebafe807b774d6504a"><enum>(A)</enum><text display-inline="yes-display-inline">improvement in battery, drive train, and
			 control system technologies; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID18b0dbd377b34a889c3a04d13585e98b"><enum>(B)</enum><text display-inline="yes-display-inline">working with industry and the Administrator
			 of the Environmental Protection Agency to—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDc099558bdaea4e89b732b7d719bd991a"><enum>(i)</enum><text display-inline="yes-display-inline">understand and inventory markets;
			 and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID8c1256b97e5247128d720bb0c452dff9"><enum>(ii)</enum><text display-inline="yes-display-inline">identify and implement methods of removing
			 barriers for existing and emerging applications.</text>
							</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID72ce5d54d7994d5c94fe914075573b57"><enum>(d)</enum><header>Goals</header><text display-inline="yes-display-inline">The goals of the electric drive
			 transportation technology program established under subsection (c) shall be to
			 develop, in partnership with industry and institutions of higher education,
			 projects that focus on—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID744d013e1cec41b4aa24b3949a559f94"><enum>(1)</enum><text display-inline="yes-display-inline">innovative electric drive technology
			 developed in the United States;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID382a54359b4843a48b77e9bd0c3bfd8d"><enum>(2)</enum><text display-inline="yes-display-inline">growth of employment in the United States
			 in electric drive design and manufacturing;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb95ed13d1ecc455eb8c6c9f19f0fe4dc"><enum>(3)</enum><text display-inline="yes-display-inline">validation of the plug-in hybrid potential
			 through fleet demonstrations; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4c8a25360ca440a4b4f2db3eea59c86e"><enum>(4)</enum><text display-inline="yes-display-inline">acceleration of fuel cell commercialization
			 through comprehensive development and commercialization of the electric drive
			 technology systems that are the foundational technology of the fuel cell
			 vehicle system.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc33dc6772f624a6bbdc9b07336b3acc7"><enum>(e)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $300,000,000 for each
			 of fiscal years 2007 through 2012.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="IDee735546981f40759047e999ff2243cb" section-type="subsequent-section"><enum>205.</enum><header>Lightweight
			 materials research and development</header>
				<subsection commented="no" display-inline="no-display-inline" id="id7BCE9174408E4885B02CF9E4CBADD619"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">As soon as
			 practicable after the date of enactment of this Act, the Secretary shall
			 establish a research and development program to determine ways in which—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id310DDA9194A74A2F9555F0595F1E18CE"><enum>(1)</enum><text display-inline="yes-display-inline">the weight of vehicles may be reduced to
			 improve fuel efficiency without compromising passenger safety; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id38EDC6DF9446488993587A8C29B415E7"><enum>(2)</enum><text display-inline="yes-display-inline">the cost of lightweight materials (such as
			 steel alloys and carbon fibers) required for the construction of lighter-weight
			 vehicles may be reduced.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAC41CC53F3164053ACB36F103FACC4FE"><enum>(b)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $60,000,000 for each of
			 fiscal years 2007 through 2012.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID622d90a8af0d4c9683450d280f718786" section-type="subsequent-section"><enum>206.</enum><header>Loan guarantees for
			 fuel-efficient automobile manufacturer and suppliers</header>
				<subsection commented="no" display-inline="no-display-inline" id="idE9BA3E261F3B4920896E8ED5363FD428"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 712(a) of the
			 Energy Policy Act of 2005 (42 U.S.C. 16062(a)) is amended in the second
			 sentence by striking <quote>grants to automobile manufacturers</quote> and
			 inserting <quote>grants and loan guarantees under section 1703 to automobile
			 manufacturers and suppliers</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3f3bbb37613c4ced8fa7d80f7cac92e2"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 1703(b) of
			 the Energy Policy Act of 2005 (42 U.S.C. 16513(b)) is amended by striking
			 paragraph (8) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id14874273DA2448068CA7DDAFC0A3A2D0" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="IDc5799ed4630f4c7f871e5f0e7e046d43"><enum>(8)</enum><text display-inline="yes-display-inline">Production facilities for the manufacture
				of fuel-efficient vehicles or parts of such vehicles, including hybrid and
				advanced diesel
				vehicles.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID3a469e6d49f94c6b9893775019aa8931" section-type="subsequent-section"><enum>207.</enum><header>Funding for
			 alternative infrastructure for the distribution of transportation
			 fuels</header>
				<subsection commented="no" display-inline="no-display-inline" id="id19C20F6ECDEE4F03899E3A8F1871628A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There is established
			 in the Treasury of the United States a trust fund, to be known as the
			 <quote>Alternative Fueling Infrastructure Trust Fund</quote> (referred to in
			 this section as the <quote>Trust Fund</quote>), consisting of such amounts as
			 are deposited into the Trust Fund under subsection (b) and any interest earned
			 on investment of amounts in the Trust Fund.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idB06445BBC86D493D8E4B636E9B7B88A9"><enum>(b)</enum><header>Penalties</header><text display-inline="yes-display-inline">The Secretary of Transportation shall remit
			 90 percent of the amount collected in civil penalties under section 32912 of
			 title 49, United States Code, to the Trust Fund.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id82EBADF326CF4CC9B70EAEB0B558704D"><enum>(c)</enum><header>Grant
			 program</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id6493CC8F9DB94C05B367F0D6A611E7C9"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Energy shall obligate such sums as are available in the Trust Fund to establish
			 a grant program to increase the number of locations at which consumers may
			 purchase alternative transportation fuels.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4760DF2122904A35B8ED6E1152FD283B"><enum>(2)</enum><header>Administration</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="idD2F3C79C164B4E1E927EFE0E5F8B9C0D"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary may
			 award grants under this subsection to—</text>
							<clause commented="no" display-inline="no-display-inline" id="id38BC014646B74DD3950C9F6C92F80A8B"><enum>(i)</enum><text display-inline="yes-display-inline">individual fueling stations; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id33AA66499685424EAF46AF1979405671"><enum>(ii)</enum><text display-inline="yes-display-inline">corporations (including nonprofit
			 corporations) with demonstrated experience in the administration of grant
			 funding for the purpose of alternative fueling infrastructure.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id118B4AD88FDF4B85ACD53622844872AC"><enum>(B)</enum><header>Maximum amount
			 of grants</header><text display-inline="yes-display-inline">A grant provided
			 under this subsection may not exceed—</text>
							<clause commented="no" display-inline="no-display-inline" id="idD0CB630D1FC444FE9D1AB9CA9F0DFB0F"><enum>(i)</enum><text display-inline="yes-display-inline">$150,000 for each site of an individual
			 fueling station; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idC4F22BAE480A444C9C9F75E568D7992D"><enum>(ii)</enum><text display-inline="yes-display-inline">$500,000 for each corporation (including a
			 nonprofit corporation).</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8637368A68A24266AA292849E02A62BC"><enum>(C)</enum><header>Prioritization</header><text display-inline="yes-display-inline">The Secretary shall prioritize the
			 provision of grants under this subsection to recognized nonprofit corporations
			 that have proven experience and demonstrated technical expertise in the
			 establishment of alternative fueling infrastructure, as determined by the
			 Secretary.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id93AAD899715A4C828637DDDE3B9D1AD9"><enum>(D)</enum><header>Administrative
			 expenses</header><text display-inline="yes-display-inline">Not more than 10
			 percent of the funds provided in any grant may be used by the recipient of the
			 grant to pay administrative expenses.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id09F6998A118245D5BB3EB0CABE561BA4"><enum>(E)</enum><header>Number of
			 vehicles</header><text display-inline="yes-display-inline">In providing grants
			 under this subsection, the Secretary shall consider the number of vehicles in
			 service capable of using a specific type of alternative fuel.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id093C52BC96384B1B8F15F51A14F45A52"><enum>(F)</enum><header>Match</header><text display-inline="yes-display-inline">Grant recipients shall provide a
			 non-Federal match of not less than $1 for every $3 of grant funds received
			 under this subsection.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD4068E1176544F5F8D5F36E7E593F59F"><enum>(G)</enum><header>Locations</header><text display-inline="yes-display-inline">Each grant recipient shall select the
			 locations for each alternative fuel station to be constructed with grant funds
			 received under this subsection on a formal, open, and competitive basis.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBE986A1FDB09465FA13AA52CC9BED8C0"><enum>(H)</enum><header>Use of
			 information in selection of recipients</header><text display-inline="yes-display-inline">In selecting grant recipients under this
			 subsection, the Secretary may consider—</text>
							<clause commented="no" display-inline="no-display-inline" id="id7BE219733A964E579275E6365BFE9CFD"><enum>(i)</enum><text display-inline="yes-display-inline">public demand for each alternative fuel in
			 a particular county based on State registration records indicating the number
			 of vehicles that may be operated using alternative fuel; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id0B4816AD9EFA434E88EF0AF0D229F1EA"><enum>(ii)</enum><text display-inline="yes-display-inline">the opportunity to create or expand
			 corridors of alternative fuel stations along interstates or highways.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAF24C57A82EB4EBFBF1F751158E2BF68"><enum>(3)</enum><header>Use of grant
			 funds</header><text display-inline="yes-display-inline">Grant funds received
			 under this subsection may be used to—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idA45CB9711E484097B94F6B11F969F519"><enum>(A)</enum><text display-inline="yes-display-inline">construct new facilities to dispense
			 alternative fuels;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3E2FE73EBE354BD4B8972C55DD9A9476"><enum>(B)</enum><text display-inline="yes-display-inline">purchase equipment to upgrade, expand, or
			 otherwise improve existing alternative fuel facilities; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBF9F40890C574069AF099A4305DB96B2"><enum>(C)</enum><text display-inline="yes-display-inline">purchase equipment or pay for specific
			 turnkey fueling services by alternative fuel providers.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0D78156658AA4CB4BA38FEE49C34E7CC"><enum>(4)</enum><header>Facilities</header><text display-inline="yes-display-inline">Facilities constructed or upgraded with
			 grant funds under this subsection shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id6FC355583C4745B1A6C74AC2FCEAB533"><enum>(A)</enum><text display-inline="yes-display-inline">provide alternative fuel available to the
			 public for a period not less than 4 years;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id87EBF7DEEB5C4483976C52B67C7DF7E8"><enum>(B)</enum><text display-inline="yes-display-inline">establish a marketing plan to advance the
			 sale and use of alternative fuels;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEBFD36E63375439EB6E5DF79B520A51F"><enum>(C)</enum><text display-inline="yes-display-inline">prominently display the price of
			 alternative fuel on the marquee and in the station;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id21DD5AC6E0C94679973CD54CD087801F"><enum>(D)</enum><text display-inline="yes-display-inline">provide point of sale materials on
			 alternative fuel;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2056A38A560A455DAA913C908CAE9C4C"><enum>(E)</enum><text display-inline="yes-display-inline">clearly label the dispenser with consistent
			 materials;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2430685D300B4038AADE96BC275F5D54"><enum>(F)</enum><text display-inline="yes-display-inline">price the alternative fuel at the same
			 margin that is received for unleaded gasoline; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEE3F2F0BF32F4C78BE585E0111F93517"><enum>(G)</enum><text display-inline="yes-display-inline">support and use all available tax
			 incentives to reduce the cost of the alternative fuel to the lowest practicable
			 retail price.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAF40D9EE247041EB93A299EF9E0FBC6E"><enum>(5)</enum><header>Opening of
			 stations</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id5025441CB0834732A3C1D04B73814F9A"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than the
			 date on which each alternative fuel station begins to offer alternative fuel to
			 the public, the grant recipient that used grant funds to construct the station
			 shall notify the Secretary of the opening.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id57386C6DD63449A897A0ACAA91033390"><enum>(B)</enum><header>Website</header><text display-inline="yes-display-inline">The Secretary shall add each new
			 alternative fuel station to the alternative fuel station locator on the website
			 of the Department of Energy when the Secretary receives notification under this
			 subsection.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4641648BDA2D43AF85B2208C8E305C1A"><enum>(6)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than 180 days after the receipt
			 of a grant award under this subsection, and every 180 days thereafter, each
			 grant recipient shall submit a report to the Secretary that describes—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id55116B81D0C74DDD9C2E3AD071496FD0"><enum>(A)</enum><text display-inline="yes-display-inline">the status of each alternative fuel station
			 constructed with grant funds received under this subsection;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id005D418A87814F2D97A391C7E365187B"><enum>(B)</enum><text display-inline="yes-display-inline">the quantity of alternative fuel dispensed
			 at each station during the preceding 180-day period; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAA58E81B05E242B9B9DB84A52980B686"><enum>(C)</enum><text display-inline="yes-display-inline">the average price per gallon of the
			 alternative fuel sold at each station during the preceding 180-day
			 period.</text>
						</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id282E90FAE0C44BFABC45E66B29C3B8EA" section-type="subsequent-section"><enum>208.</enum><header>Deployment of new
			 technologies to reduce oil use in transportation</header>
				<subsection commented="no" display-inline="no-display-inline" id="idB5D6FC674FFD489CBD4B50103B7D917A"><enum>(a)</enum><header>Fuel from
			 cellulosic biomass</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID970d3746f0c043258fe9dd5762f45e73"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 provide deployment incentives under this subsection to encourage a variety of
			 projects to produce transportation fuel from cellulosic biomass, relying on
			 different feedstocks in different regions of the United States.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb1082439c3fa42e89ba2318b2887678d"><enum>(2)</enum><header>Project
			 eligibility</header><text display-inline="yes-display-inline">Incentives under
			 this subsection shall be provided on a competitive basis to projects that
			 produce fuel that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID4cd615b08c114faa90b7826727c1095d"><enum>(A)</enum><text display-inline="yes-display-inline">meet United States fuel and emission
			 specifications;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc360834bfa714d64849f92e9abbfd93b"><enum>(B)</enum><text display-inline="yes-display-inline">help diversify domestic transportation
			 energy supplies; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa1c310de83334c4681e5883872e7fb9d"><enum>(C)</enum><text display-inline="yes-display-inline">improve or maintain air, water, soil, and
			 habitat quality.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe82ac827feea41b9bb2001364b798670"><enum>(3)</enum><header>Incentives</header><text display-inline="yes-display-inline">Incentives under this subsection may
			 consist of—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID5a0d48b3632b4cb48f0ec44a6062f7bb"><enum>(A)</enum><text display-inline="yes-display-inline">loan guarantees under section 1510 of the
			 Energy Policy Act of 2005 (42 U.S.C. 16501), subject to section 1702 of that
			 Act (22 U.S.C. 16512), for the construction of production facilities and
			 supporting infrastructure; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf3904445c69d4ce2818b494509b65d32"><enum>(B)</enum><text display-inline="yes-display-inline">production payments through a reverse
			 auction in accordance with paragraph (4).</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID88b2298f9e7044c7a339337381a6be04"><enum>(4)</enum><header>Reverse
			 auction</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDd84aa979d6e546a3abad7f8d42723f59"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In providing
			 incentives under this subsection, the Secretary shall—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID7df99810f8a34e57a047eee3e8e7325e"><enum>(i)</enum><text display-inline="yes-display-inline">issue regulations under which producers of
			 fuel from cellulosic biomass may bid for production payments under paragraph
			 (3)(B); and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDb1f734a974a64a8aaac308dfdb98a184"><enum>(ii)</enum><text display-inline="yes-display-inline">solicit bids from producers of different
			 classes of transportation fuel, as the Secretary determines to be
			 appropriate.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2bdc463e4536441e9249d9d79edebc17"><enum>(B)</enum><header>Requirement</header><text display-inline="yes-display-inline">The rules under subparagraph (A) shall
			 require that incentives be provided to the producers that submit the lowest bid
			 (in terms of cents per gallon) for each class of transportation fuel from which
			 the Secretary solicits a bid.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDeef8534cdfa041a9a1e27163af499062"><enum>(b)</enum><header>Advanced
			 technology vehicles manufacturing incentive program</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID622d14e987cc49aa960b291f65451d17"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDf1aa56379c304240b0f21f04a225f4ba"><enum>(A)</enum><header>Adjusted fuel
			 economy</header><text display-inline="yes-display-inline">The term
			 <term>adjusted fuel economy</term> means the average fuel economy of a
			 manufacturer for all light duty motor vehicles produced by the manufacturer,
			 adjusted such that the fuel economy of each vehicle that qualifies for a credit
			 shall be considered to be equal to the average fuel economy for the weight
			 class of the vehicle for model year 2002.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID11d61d29a1c04935a88a04c5298b2ef9"><enum>(B)</enum><header>Advanced lean
			 burn technology motor vehicle</header><text display-inline="yes-display-inline">The term <term>advanced lean burn
			 technology motor vehicle</term> means a passenger automobile or a light truck
			 with an internal combustion engine that—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDafaec6c6902c4b499747bcb1dd2adca7"><enum>(i)</enum><text display-inline="yes-display-inline">is designed to operate primarily using more
			 air than is necessary for complete combustion of the fuel;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDbd1070dc57364747a9cf0084e441d336"><enum>(ii)</enum><text display-inline="yes-display-inline">incorporates direct injection; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID590446f9c4954b139c5c9bf6c1b1e767"><enum>(iii)</enum><text display-inline="yes-display-inline">achieves at least 125 percent of the city
			 fuel economy of vehicles in the same size class as the vehicle for model year
			 2002.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3ec0a80f4352445c9d86d643541bec6d"><enum>(C)</enum><header>Advanced
			 technology vehicle</header><text display-inline="yes-display-inline">The term
			 <term>advanced technology vehicle</term> means a light duty motor vehicle
			 that—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID2839d8c90b664f01997f640fa0f88be3"><enum>(i)</enum><text display-inline="yes-display-inline">is a hybrid motor vehicle or an advanced
			 lean burn technology motor vehicle; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID4c25ac1982ca4844bb2a33f9257eacb1"><enum>(ii)</enum><text display-inline="yes-display-inline">meets—</text>
								<subclause commented="no" display-inline="no-display-inline" id="ID2acdd41068244c109c65bee2ea785620"><enum>(I)</enum><text display-inline="yes-display-inline">the Bin 5 Tier II emission standard
			 established in regulations issued by the Administrator of the Environmental
			 Protection Agency under section 202(i) of the Clean Air Act (42 U.S.C.
			 7521(i)), or a lower-numbered Bin emission standard;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDc9290d00c93e4c29bf73b8727138e321"><enum>(II)</enum><text display-inline="yes-display-inline">any new emission standard for fine
			 particulate matter prescribed by the Administrator under that Act (42 U.S.C.
			 7401 et seq.); and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID47d85b7f4b474a35a4138d87a4487b15"><enum>(III)</enum><text display-inline="yes-display-inline">at least 125 percent of the base year city
			 fuel economy for the weight class of the vehicle.</text>
								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9786280e8c59453ebbf2d530e295dd9b"><enum>(D)</enum><header>Engineering
			 integration costs</header><text display-inline="yes-display-inline">The term
			 <term>engineering integration costs</term> includes the cost of engineering
			 tasks relating to—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID938dd577c56246e08232e3d1e6b34e87"><enum>(i)</enum><text display-inline="yes-display-inline">incorporating qualifying components into
			 the design of advanced technology vehicles; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDf796b8ca31874f8db345c9ca869d1fec"><enum>(ii)</enum><text display-inline="yes-display-inline">designing new tooling and equipment for
			 production facilities that produce qualifying components or advanced technology
			 vehicles.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe5dac654160b449b8be5c716aa9e59bc"><enum>(E)</enum><header>Hybrid motor
			 vehicle</header><text display-inline="yes-display-inline">The term <term>hybrid
			 motor vehicle</term> means a motor vehicle that draws propulsion energy from
			 onboard sources of stored energy that are—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDe7de269a230d4d8e9e11ea46a4c32473"><enum>(i)</enum><text display-inline="yes-display-inline">an internal combustion or heat engine using
			 combustible fuel; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDa7bbfc92384b4935b8dccbad606d36f4"><enum>(ii)</enum><text display-inline="yes-display-inline">a rechargeable energy storage
			 system.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7b8f7bd9969d4146890dc91d8c583aef"><enum>(F)</enum><header>Qualifying
			 components</header><text display-inline="yes-display-inline">The term
			 <term>qualifying components</term> means components that the Secretary
			 determines to be—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID855b23256ec04185bae08587f0fdfbd9"><enum>(i)</enum><text display-inline="yes-display-inline">specially designed for advanced technology
			 vehicles; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDb5284007c8284eb5853134f7ea469a9d"><enum>(ii)</enum><text display-inline="yes-display-inline">installed for the purpose of meeting the
			 performance requirements of advanced technology vehicles.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3a69fb3d49e340e5a2902b25adfd5a25"><enum>(2)</enum><header>Manufacturer
			 facility conversion awards</header><text display-inline="yes-display-inline">The Secretary shall provide facility
			 conversion funding awards under this subsection to automobile manufacturers and
			 component suppliers to pay not more than 30 percent of the cost of—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID7f2eabee25614e0b9666ca1ae3d76350"><enum>(A)</enum><text display-inline="yes-display-inline">reequipping or expanding an existing
			 manufacturing facility in the United States to produce—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDa510b6fb453a40ec8228c0b88aa5b4e5"><enum>(i)</enum><text display-inline="yes-display-inline">qualifying advanced technology vehicles;
			 or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID35c8ccf0bdcc4624a70e1faf9a22e097"><enum>(ii)</enum><text display-inline="yes-display-inline">qualifying components; and</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd55b7fc6b98249358eb12c79e23f5dc5"><enum>(B)</enum><text display-inline="yes-display-inline">engineering integration performed in the
			 United States of qualifying vehicles and qualifying components.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID127d1c75df9c4f30aaea246373fd4b81"><enum>(3)</enum><header>Period of
			 availability</header><text display-inline="yes-display-inline">An award under
			 paragraph (2) shall apply to—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDb7f076aa3ec14e4795fb2baf4c1affe0"><enum>(A)</enum><text display-inline="yes-display-inline">facilities and equipment placed in service
			 before December 30, 2017; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb5246fb941584a1293b3c512eaf8315e"><enum>(B)</enum><text display-inline="yes-display-inline">engineering integration costs incurred
			 during the period beginning on the date of enactment of this Act and ending on
			 December 30, 2017.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2eed9f477bc5464fb3d2cdd763238de4"><enum>(4)</enum><header>Improvement</header><text display-inline="yes-display-inline">The Secretary shall issue regulations that
			 require that, in order for an automobile manufacturer to be eligible for an
			 award under this subsection during a particular year, the adjusted average fuel
			 economy of the manufacturer for light duty vehicles produced by the
			 manufacturer during the most recent year for which data are available shall be
			 not less than the average fuel economy for all light duty motor vehicles of the
			 manufacturer for model year 2002.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idF9A856149F2D4224B5B65AF2F597EA1C" section-type="subsequent-section"><enum>209.</enum><header>Production
			 incentives for cellulosic biofuels</header><text display-inline="no-display-inline">Section 942(f) of the Energy Policy Act of
			 2005 (42 U.S.C. 16251(f)) is amended by striking <quote>$250,000,000</quote>
			 and inserting <quote>$200,000,000 for each of fiscal years 2007 through
			 2011</quote>.</text>

				general</header><text display-inline="yes-display-inline">Each electric utility
				that sells electricity to electric consumers shall obtain a percentage of the
				base amount of electricity it sells to electric consumers in any calendar year
				from new renewable energy or existing renewable energy. The percentage obtained
				in a calendar year shall not be less than the amount specified in the following

				renewable energy or existing renewable energy;</text>

									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5ad3bfb7578c4bcb8b8b95a4ca6ffcf8"><enum>(b)</enum><header>Renewable
				energy credit trading program</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID8ccb6d3d112e4b47ac11ef33477cbb5b"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than
				January 1, 2007, the Secretary shall establish a renewable energy credit
				trading program to permit an electric utility that does not generate or
				purchase enough electric energy from renewable energy to meet its obligations
				under subsection (a)(1) to satisfy such requirements by purchasing sufficient
				renewable energy credits.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID04caa46aab024c49b18c46c33bfcdb32"><enum>(2)</enum><header>Administration</header><text display-inline="yes-display-inline">As part of the program, the Secretary
				shall—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDe49d8d5bcda54416ba30006e14bc0076"><enum>(A)</enum><text display-inline="yes-display-inline">issue renewable energy credits to
				generators of electric energy from new renewable energy;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcecc778d51ac456f81d24dd67b92f4e0"><enum>(B)</enum><text display-inline="yes-display-inline">sell renewable energy credits to electric
				utilities at the rate of 1.5 cents per kilowatt-hour (as adjusted for inflation
				under subsection (g));</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa76183894e194bae853c80a664764889"><enum>(C)</enum><text display-inline="yes-display-inline">ensure that a kilowatt hour, including the
				associated renewable energy credit, shall be used only once for purposes of
				compliance with this section; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7fd6008f5a5a4814a422dee2e53236fe"><enum>(D)</enum><text display-inline="yes-display-inline">allow double credits for generation from
				facilities on Indian land, and triple credits for generation from small
				renewable distributed generators (meaning those no larger than 1
				megawatt).</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb8ca7305553d48299921a5ebe97f5f80"><enum>(3)</enum><header>Duration</header><text display-inline="yes-display-inline">Credits under paragraph (2)(A) may only be
				used for compliance with this section for 3 years from the date issued.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7edb737548db4cb38a932acefb626a8d"><enum>(4)</enum><header>Transfers</header><text display-inline="yes-display-inline">An electric utility that holds credits in
				excess of the amount needed to comply with subsection (a) may transfer such
				credits to another electric utility in the same utility holding company
				system.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID21f3c8224cff44939290ebbc55d52c87"><enum>(5)</enum><header>Eastern
				interconnect</header><text display-inline="yes-display-inline">In the case of a
				retail electric supplier that is a member of a power pool located in the
				Eastern Interconnect and that is subject to a State renewable portfolio
				standard program that provides for compliance primarily through the acquisition
				of certificates or credits in lieu of the direct acquisition of renewable
				power, the Secretary shall issue renewable energy credits in an amount that
				corresponds to the kilowatt-hour obligation represented by the State
				certificates and credits issued pursuant to the State program to the extent the
				State certificates and credits are associated with renewable resources eligible
				under this section.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID88d9dd8baad04f9baddeb2afaea473cc"><enum>(c)</enum><header>Enforcement</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID68796778c44945c2a32d340363bc5451"><enum>(1)</enum><header>Civil
				penalties</header><text display-inline="yes-display-inline">Any electric
				utility that fails to meet the renewable energy requirements of subsection (a)
				shall be subject to a civil penalty.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDed50934fa5ef44a49e969ca37d3040f3"><enum>(2)</enum><header>Amount of
				penalty</header><text display-inline="yes-display-inline">The amount of the
				civil penalty shall be determined by multiplying the number of kilowatt-hours
				of electric energy sold to electric consumers in violation of subsection (a) by
				the greater of 1.5 cents (adjusted for inflation under subsection (g)) or 200
				percent of the average market value of renewable energy credits during the year
				in which the violation occurred.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID21f7bc340059477282392ce723f9b0da"><enum>(3)</enum><header>Mitigation or
				waiver</header><text display-inline="yes-display-inline">The Secretary may
				mitigate or waive a civil penalty under this subsection if the electric utility
				was unable to comply with subsection (a) for reasons outside of the reasonable
				control of the utility. The Secretary shall reduce the amount of any penalty
				determined under paragraph (2) by an amount paid by the electric utility to a
				State for failure to comply with the requirement of a State renewable energy
				program if the State requirement is greater than the applicable requirement of
				subsection (a).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa0d8042754e94b3b861cdeca04b08868"><enum>(4)</enum><header>Procedure for
				assessing penalty</header><text display-inline="yes-display-inline">The
				Secretary shall assess a civil penalty under this subsection in accordance with
				the procedures prescribed by section 333(d) of the Energy Policy and
				Conservation Act of 1954 (42 U.S.C. 6303).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDd8029747080849b68b2b0b71359bb640"><enum>(d)</enum><header>State renewable
				energy account program</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID8533005e24714c30ba8b7ea961dc78a7"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				establish, not later than December 31, 2008, a State renewable energy account
				program.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaf0b8f2e07b24d31a27bc7ceeeac7b97"><enum>(2)</enum><header>Deposits</header><text display-inline="yes-display-inline">All money collected by the Secretary from
				the sale of renewable energy credits and the assessment of civil penalties
				under this section shall be deposited into the renewable energy account
				established pursuant to this subsection. The State renewable energy account
				shall be held by the Secretary and shall not be transferred to the Treasury
				Department.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1b2f133e4268457bad67c7546b53a278"><enum>(3)</enum><header>Use</header><text display-inline="yes-display-inline">Proceeds deposited in the State renewable
				energy account shall be used by the Secretary, subject to appropriations, for a
				program to provide grants to the State agency responsible for developing State
				energy conservation plans under section 362 of the Energy Policy and
				Conservation Act (42 U.S.C. 6322) for the purposes of promoting renewable
				energy production, including programs that promote technologies that reduce the
				use of electricity at customer sites such as solar water heating.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5eb39a2bd1064a9ca979ec2c2e5bcd63"><enum>(4)</enum><header>Administration</header><text display-inline="yes-display-inline">The Secretary may issue guidelines and
				criteria for grants awarded under this subsection. State energy offices
				receiving grants under this section shall maintain such records and evidence of
				compliance as the Secretary may require.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID93e2d407dc2d40338b8ee64036fada10"><enum>(5)</enum><header>Preference</header><text display-inline="yes-display-inline">In allocating funds under this program, the
				Secretary shall give preference—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID6d0051d40350461e8d67bcdf1d9cbd4b"><enum>(A)</enum><text display-inline="yes-display-inline">to States in regions which have a
				disproportionately small share of economically sustainable renewable energy
				generation capacity; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4efc4169cf89437b8ed92674b1cfa148"><enum>(B)</enum><text display-inline="yes-display-inline">to State programs to stimulate or enhance
				innovative renewable energy technologies.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID96db1e6bdabe42cc8432ceeea74986b3"><enum>(e)</enum><header>Rules</header><text display-inline="yes-display-inline">The Secretary shall issue rules
				implementing this section not later than 1 year after the date of enactment of
				this section.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID7dde22056156496eb2c0f2083c615a6a"><enum>(f)</enum><header>Exemptions</header><text display-inline="yes-display-inline">This section shall not apply in any
				calendar year to an electric utility—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="IDf2fd70cacfed470197263096cc8ff8e5"><enum>(1)</enum><text display-inline="yes-display-inline">that sold less than 4,000,000
				megawatt-hours of electric energy to electric consumers during the preceding
				calendar year; or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7decde327ff04d388e24421ca7caf5a1"><enum>(2)</enum><text display-inline="yes-display-inline">in Hawaii.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0a946710440a49a7afe77696cecb1c9e"><enum>(g)</enum><header>Inflation
				adjustment</header><text display-inline="yes-display-inline">Not later than
				December 31 of each year beginning in 2008, the Secretary shall adjust for
				inflation the price of a renewable energy credit under subsection (b)(2)(B) and
				the amount of the civil penalty per kilowatt-hour under subsection
				(c)(2).</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd39d8c3a324c40769a4f231083b806a7"><enum>(h)</enum><header>State
				programs</header><text display-inline="yes-display-inline">Nothing in this
				section shall diminish any authority of a State or political subdivision
				thereof to adopt or enforce any law or regulation respecting renewable energy,
				but, except as provided in subsection (c)(3), no such law or regulation shall
				relieve any person of any requirement otherwise applicable under this section.
				The Secretary, in consultation with States having such renewable energy
				programs, shall, to the maximum extent practicable, facilitate coordination
				between the Federal program and State programs.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9b6936009fc345ff89c3f1ef1279d7a3"><enum>(i)</enum><header>Recovery of
				costs</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID51a35a389a824d08bae118a7eefa665b"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Commission shall
				issue and enforce such regulations as are necessary to ensure that an electric
				utility recovers all prudently incurred costs associated with compliance with
				this section.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0d28c30625f040ad8695d26d7af2d44f"><enum>(2)</enum><header>Applicable
				law</header><text display-inline="yes-display-inline">A regulation under
				paragraph (1) shall be enforceable in accordance with the provisions of law
				applicable to enforcement of regulations under the Federal Power Act (16 U.S.C.
				791a et seq.).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa44c7cc6129740fc8178dcfaf2a5c609"><enum>(j)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID9e256613a91b4b8c897f4fed21dbf576"><enum>(1)</enum><header>Base amount of
				electricity</header><text display-inline="yes-display-inline">The term
				<term>base amount of electricity</term> means the total amount of electricity
				sold by an electric utility to electric consumers in a calendar year,
				excluding—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID20f13831583d4ee7ba2db97f0ed9f451"><enum>(A)</enum><text display-inline="yes-display-inline">electricity generated by a hydroelectric
				facility (including a pumped storage facility but excluding incremental
				hydropower); and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID05bc3891a7c544a4a6d12803e7ea5398"><enum>(B)</enum><text display-inline="yes-display-inline">electricity generated through the
				incineration of municipal solid waste.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0fa6479280ee4622be88dcab30b0fa29"><enum>(2)</enum><header>Distributed
				generation facility</header><text display-inline="yes-display-inline">The term
				<term>distributed generation facility</term> means a facility at a customer
				site.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfe335695308c406995661bcb06df6cbe"><enum>(3)</enum><header>Existing
				renewable energy</header><text display-inline="yes-display-inline">The term
				<term>existing renewable energy</term> means, except as provided in paragraph
				(7)(B), electric energy generated at a facility (including a distributed
				generation facility) placed in service prior to January 1, 2003, from solar,
				wind, or geothermal energy, ocean energy, biomass (as defined in section 203(a)
				of the Energy Policy Act of 2005), or landfill gas.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID36d95f2dc9ad464290f3c211404a57aa"><enum>(4)</enum><header>Geothermal
				energy</header><text display-inline="yes-display-inline">The term
				<term>geothermal energy</term> means energy derived from a geothermal deposit
				(within the meaning of section 613(e)(2) of the Internal Revenue Code of
				1986).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID54229b180138412fac628b6a61baf35e"><enum>(5)</enum><header>Incremental
				geothermal production</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDa610694006dd4093a02a25156b6cf37d"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term
				<term>incremental geothermal production</term> means for any year the excess
				of—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID4489f9595a73449d8ee8c4ac61dbd5d0"><enum>(i)</enum><text display-inline="yes-display-inline">the total kilowatt hours of electricity
				produced from a facility (including a distributed generation facility) using
				geothermal energy; over</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDf72e263061cd4ee588f6bc3b8d203874"><enum>(ii)</enum><text display-inline="yes-display-inline">the average annual kilowatt hours produced
				at such facility for 5 of the previous 7 calendar years before the date of
				enactment of this section after eliminating the highest and the lowest kilowatt
				hour production years in such 7-year period.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID051f4984dbfd4a378160a73c03621483"><enum>(B)</enum><header>Special
				rule</header><text display-inline="yes-display-inline">A facility described in
				subparagraph (A) that was placed in service at least 7 years before the date of
				enactment of this section shall commencing with the year in which such date of
				enactment occurs, reduce the amount calculated under subparagraph (A)(ii) each
				year, on a cumulative basis, by the average percentage decrease in the annual
				kilowatt hour production for the 7-year period described in subparagraph
				(A)(ii) with such cumulative sum not to exceed 30 percent.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc1722451a9034ebea755b8640438fb94"><enum>(6)</enum><header>Incremental
				hydropower</header><text display-inline="yes-display-inline">The term
				<term>incremental hydropower</term> means additional energy generated as a
				result of efficiency improvements or capacity additions made on or after the
				date of enactment of this section or the effective date of an existing
				applicable State renewable portfolio standard program at a hydroelectric
				facility that was placed in service before that date. The term does not include
				additional energy generated as a result of operational changes not directly
				associated with efficiency improvements or capacity additions. Efficiency
				improvements and capacity additions shall be measured on the basis of the same
				water flow information used to determine a historic average annual generation
				baseline for the hydroelectric facility and certified by the Secretary or the
				Federal Energy Regulatory Commission.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID688508b4d21f47c9befbb8eea44c24ec"><enum>(7)</enum><header>New renewable
				energy</header><text display-inline="yes-display-inline">The term <term>new
				renewable energy</term> means—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID413f9e62b0a34e4b889ea0dea861bc3a"><enum>(A)</enum><text display-inline="yes-display-inline">electric energy generated at a facility
				(including a distributed generation facility) placed in service on or after
				January 1, 2003, from—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID50f45da7a83245499f065c38fd37343c"><enum>(i)</enum><text display-inline="yes-display-inline">solar, wind, or geothermal energy or ocean
				energy;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID49ff69e6206a48808a1f7a55e209d35f"><enum>(ii)</enum><text display-inline="yes-display-inline">biomass (as defined in section 203(b) of
				the Energy Policy Act of 2005 (42 U.S.C. 15852(b));</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID902c7fd7a13d4afea97141860b530741"><enum>(iii)</enum><text display-inline="yes-display-inline">landfill gas; or</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDfaf6b169d2d84f299e584392bab9b58d"><enum>(iv)</enum><text display-inline="yes-display-inline">incremental hydropower; and</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbee4a9d1bef94695830f6ca253417e04"><enum>(B)</enum><text display-inline="yes-display-inline">for electric energy generated at a facility
				(including a distributed generation facility) placed in service prior to the
				date of enactment of this section—</text>
										<clause commented="no" display-inline="no-display-inline" id="IDdc64a244e0954cc1a70291ca1a84ab6a"><enum>(i)</enum><text display-inline="yes-display-inline">the additional energy above the average
				generation in the 3 years preceding the date of enactment of this section at
				the facility from—</text>
											<subclause commented="no" display-inline="no-display-inline" id="ID2039f5974d0643f3a29ac9bcbc845fd1"><enum>(I)</enum><text display-inline="yes-display-inline">solar or wind energy or ocean
				energy;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="IDf7cae35880ab4e63826ddc67d4695211"><enum>(II)</enum><text display-inline="yes-display-inline">biomass (as defined in section 203(b) of
				the Energy Policy Act of 2005 (42 U.S.C. 15852(b));</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="ID8b50412d73c3417e91ba2c70a654551b"><enum>(III)</enum><text display-inline="yes-display-inline">landfill gas; or</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="IDf4e5303fb5b048649f1e4b77416e0700"><enum>(IV)</enum><text display-inline="yes-display-inline">incremental hydropower.</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID1880b45426474756aa12b4c134568509"><enum>(ii)</enum><text display-inline="yes-display-inline">incremental geothermal production.</text>

				energy</header><text display-inline="yes-display-inline">The term <term>ocean
				energy</term> includes current, wave, tidal, and thermal energy.</text>

				Secretary, shall ensure that, of the total quantity of electric energy the
				Federal Government consumes during any fiscal year, the following amounts shall
				be renewable energy:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="IDede5c02050ee477e81f847b00534d543"><enum>(1)</enum><text display-inline="yes-display-inline">Not less than 5 percent in each of fiscal
				years 2008 and 2009.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2aad3dabc7674e32b8194fe2ee7fabdf"><enum>(D)</enum><text display-inline="yes-display-inline">the increased efficient use of existing
				water sources in interior or exterior
				applications.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id72FDA8B25E4A497FBAE197325D995D0F"><enum>(d)</enum><header>Energy and cost
			 savings in nonbuilding applications</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID1d93805990d945baac6773610f47016a"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id9C5864ED58984653B2825B6E27D55F39"><enum>(A)</enum><header>Nonbuilding
			 application</header><text display-inline="yes-display-inline">The term
			 <term>nonbuilding application</term> means—</text>
							<clause commented="no" display-inline="no-display-inline" id="idFA4CC58C62F74D48AC578199B5E7B770"><enum>(i)</enum><text display-inline="yes-display-inline">any class of vehicles, devices, or
			 equipment that is transportable under the power of the applicable vehicle,
			 device, or equipment by land, sea, or air and that consumes energy from any
			 fuel source for the purpose of—</text>
								<subclause commented="no" display-inline="no-display-inline" id="idB40A0C3160024C4FA7D14F1ADC0E2B06"><enum>(I)</enum><text display-inline="yes-display-inline">that transportation; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id8BEE29530175495B9D67C0BBEFEB152A"><enum>(II)</enum><text display-inline="yes-display-inline">maintaining a controlled environment within
			 the vehicle, device, or equipment; and</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID5653dc2878d84370b8701753a628bbb0"><enum>(ii)</enum><text display-inline="yes-display-inline">any federally-owned equipment used to
			 generate electricity or transport water.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2889a9326bb54ddba43226a1a7fa8a03"><enum>(B)</enum><header>Secondary
			 savings</header>
							<clause commented="no" display-inline="no-display-inline" id="idDA29544593AA463B8F8C7072E9B285BE"><enum>(i)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The term
			 <term>secondary savings</term> means additional energy or cost savings that are
			 a direct consequence of the energy savings that result from the energy
			 efficiency improvements that were financed and implemented pursuant to an
			 energy savings performance contract.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id9C75DA886102420BBF4F69DAFEFC417F"><enum>(ii)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>secondary savings</term>
			 includes—</text>
								<subclause commented="no" display-inline="no-display-inline" id="id8E190CE478084F619E2B07E1A68E237A"><enum>(I)</enum><text display-inline="yes-display-inline">energy and cost savings that result from a
			 reduction in the need for fuel delivery and logistical support;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id019838DA9CE74F46B093DAC497AAF541"><enum>(II)</enum><text display-inline="yes-display-inline">personnel cost savings and environmental
			 benefits; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id8A6CABAB87964AC99E31965E9F7E2D4A"><enum>(III)</enum><text display-inline="yes-display-inline">in the case of electric generation
			 equipment, the benefits of increased efficiency in the production of
			 electricity, including revenues received by the Federal Government from the
			 sale of electricity so produced.</text>
								</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB851792A473B4344B161D9CD0DFEC070"><enum>(2)</enum><header>Study</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id951D9AFB4E244187822E8828F74207CB"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">As soon as
			 practicable after the date of enactment of this Act, the Secretary and the
			 Secretary of Defense shall jointly conduct, and submit to Congress and the
			 President a report of, a study of the potential for the use of energy savings
			 performance contracts to reduce energy consumption and provide energy and cost
			 savings in nonbuilding applications.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id627082CE4B4E47748EDD1124C7416013"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">The study under this subsection shall
			 include—</text>
							<clause commented="no" display-inline="no-display-inline" id="id3CD9D27EF44741E6A0F1FE04CF22CABF"><enum>(i)</enum><text display-inline="yes-display-inline">an estimate of the potential energy and
			 cost savings to the Federal Government, including secondary savings and
			 benefits, from increased efficiency in nonbuilding applications;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID8e691f75d9324c599bf4b248c9086ed2"><enum>(ii)</enum><text display-inline="yes-display-inline">an assessment of the feasibility of
			 extending the use of energy savings performance contracts to nonbuilding
			 applications, including an identification of any regulatory or statutory
			 barriers to such use; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID74df3257ae424577b70816f30385a698"><enum>(iii)</enum><text display-inline="yes-display-inline">such recommendations as the Secretary and
			 Secretary of Defense determine to be appropriate.</text>
							</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDcdc315c6206d4b4f8e037c11a2d44b4d" section-type="subsequent-section"><enum>402.</enum><header>Deployment of new
			 technologies for high-efficiency consumer products</header>
				<subsection commented="no" display-inline="no-display-inline" id="IDc8bd78fb375643568015c1d56ed7c401"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDe9961c61dcf244848a299ac0c8119d4f"><enum>(1)</enum><header>Energy
			 savings</header><text display-inline="yes-display-inline">The term <term>energy
			 savings</term> means megawatt-hours of electricity or million British thermal
			 units of natural gas saved by a product, in comparison to projected energy
			 consumption under the energy efficiency standard applicable to the
			 product.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID50a1f19ba5334c77a3dbbd1e0c4f5500"><enum>(2)</enum><header>High-efficiency
			 consumer product</header><text display-inline="yes-display-inline">The term
			 <term>high-efficiency consumer product</term> means a covered product to which
			 an energy conservation standard applies under section 325 of the Energy Policy
			 and Conservation Act (42 U.S.C. 6295), if the energy efficiency of the product
			 exceeds the energy efficiency required under the standard.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1306a2656e5042dc86bd1dc9b6821bea"><enum>(b)</enum><header>Financial
			 incentives program</header><text display-inline="yes-display-inline">Effective
			 beginning October 1, 2006, the Secretary shall competitively award financial
			 incentives under this section for the manufacture of high-efficiency consumer
			 products.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDc2575bc40b5c4d5cb45a5e6b35a55d7b"><enum>(c)</enum><header>Requirements</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID41b71f049dbe4baaa77e551c2c9d81d1"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 make awards under this section to manufacturers of high-efficiency consumer
			 products, based on the bid of each manufacturer in terms of dollars per
			 megawatt-hour or million British thermal units saved.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8b0a302ed6e640f39950b8fd981f78a6"><enum>(2)</enum><header>Acceptance of
			 bids</header><text display-inline="yes-display-inline">In making awards under
			 this section, the Secretary shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID78ae0ffa196a4a7dabedb622f7c27d15"><enum>(A)</enum><text display-inline="yes-display-inline">solicit bids for reverse auction from
			 appropriate manufacturers, as determined by the Secretary; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID095296f8762c44cc923c0cf57252078b"><enum>(B)</enum><text display-inline="yes-display-inline">award financial incentives to the
			 manufacturers that submit the lowest bids that meet the requirements
			 established by the Secretary.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDd69623e607154273a4c1e97385953823"><enum>(d)</enum><header>Forms of
			 awards</header><text display-inline="yes-display-inline">An award for a
			 high-efficiency consumer product under this section shall be in the form of a
			 lump sum payment in an amount equal to the product obtained by
			 multiplying—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDa731c5c407804c7eac96c74b20881154"><enum>(1)</enum><text display-inline="yes-display-inline">the amount of the bid by the manufacturer
			 of the high-efficiency consumer product; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8ab16972b204460c9d1317ebab894e15"><enum>(2)</enum><text display-inline="yes-display-inline">the energy savings during the projected
			 useful life of the high-efficiency consumer product, not to exceed 10 years, as
			 determined under regulations issued by the Secretary.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idF8584A6C60D0400C874CB301D9138EB2" section-type="subsequent-section"><enum>403.</enum><header>National media
			 campaign to decrease oil and natural gas consumption</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID808837a649a14c1eaaad1989c2ca5ac6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary, acting
			 through the Assistant Secretary for Energy Efficiency and Renewable Energy
			 (referred to in this section as the <quote>Secretary</quote>), shall develop
			 and conduct a national media campaign for the purpose of decreasing oil and
			 natural gas consumption in the United States over the next decade.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2b5abef6c02d440ca84b717d45d593cd"><enum>(b)</enum><header>Contract with
			 entity</header><text display-inline="yes-display-inline">The Secretary shall
			 carry out subsection (a) directly or through—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDdf9a28db8f48428393c78dae1dd5c254"><enum>(1)</enum><text display-inline="yes-display-inline">competitively bid contracts with 1 or more
			 nationally recognized media firms for the development and distribution of
			 monthly television, radio, and newspaper public service announcements;
			 or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6ba69fbe9a204f82a7ceb536784344d1"><enum>(2)</enum><text display-inline="yes-display-inline">collective agreements with 1 or more
			 nationally recognized institutes, businesses, or nonprofit organizations for
			 the funding, development, and distribution of monthly television, radio, and
			 newspaper public service announcements.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID16bbe73472dc421491e5776b756681d8"><enum>(c)</enum><header>Use of
			 funds</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID2f0e4992e9ce40e1aa89cbf7c6b0a259"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Amounts made
			 available to carry out this section shall be used for the following:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDbf469a04815c461180b8ef31e29d3c71"><enum>(A)</enum><header>Advertising
			 costs</header>
							<clause commented="no" display-inline="no-display-inline" id="IDcd3a39b6adb240dab512244f68e11e37"><enum>(i)</enum><text display-inline="yes-display-inline">The purchase of media time and
			 space.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID9ed08941b45e43f3985f795fbd05c804"><enum>(ii)</enum><text display-inline="yes-display-inline">Creative and talent costs.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDfa088580d94c4ee39bf1549d0405c3ba"><enum>(iii)</enum><text display-inline="yes-display-inline">Testing and evaluation of
			 advertising.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDeb1bebfde273479987565114c4bc4c08"><enum>(iv)</enum><text display-inline="yes-display-inline">Evaluation of the effectiveness of the
			 media campaign.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID3e88a4654ae648308c7ad704000f4dbc"><enum>(v)</enum><text display-inline="yes-display-inline">The negotiated fees for the winning bidder
			 on requests from proposals issued either by the Secretary for purposes
			 otherwise authorized in this section.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID6033ec0e83ef449a94213ad8d914bc11"><enum>(vi)</enum><text display-inline="yes-display-inline">Entertainment industry outreach,
			 interactive outreach, media projects and activities, public information, news
			 media outreach, and corporate sponsorship and participation.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID95b5d4caa5f44041bc28910f021b32f9"><enum>(B)</enum><header>Administrative
			 costs</header><text display-inline="yes-display-inline">Operational and
			 management expenses.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7652e04697d04971a7455c27c8ffcf32"><enum>(2)</enum><header>Limitations</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary
			 shall allocate not less than 85 percent of funds made available under
			 subsection (e) for each fiscal year for the advertising functions specified
			 under paragraph (1)(A).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf6b1e5e5b7c142149ff6e7d8d12a8f6a"><enum>(d)</enum><header>Reports</header><text display-inline="yes-display-inline">The Secretary shall annually submit to
			 Congress a report that describes—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID743f49f4bafd484183995cd58d3be31f"><enum>(1)</enum><text display-inline="yes-display-inline">the strategy of the national media campaign
			 and whether specific objectives of the campaign were accomplished,
			 including—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDac692a3e31b041c5a9e6c8f7cfb2e73c"><enum>(A)</enum><text display-inline="yes-display-inline">determinations concerning the rate of
			 change of oil and natural gas consumption, in both absolute and per capita
			 terms; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID77330cd79d7a41b1a319c7fd66d99ff4"><enum>(B)</enum><text display-inline="yes-display-inline">an evaluation that enables consideration
			 whether the media campaign contributed to reduction of oil and natural gas
			 consumption;</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaa553345ce024238b9674312c668205d"><enum>(2)</enum><text display-inline="yes-display-inline">steps taken to ensure that the national
			 media campaign operates in an effective and efficient manner consistent with
			 the overall strategy and focus of the campaign;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa29748c66a40449785c3b8b7017a5b69"><enum>(3)</enum><text display-inline="yes-display-inline">plans to purchase advertising time and
			 space;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc23fc0f608de4f2a83b93cb6acfe2b8e"><enum>(4)</enum><text display-inline="yes-display-inline">policies and practices implemented to
			 ensure that Federal funds are used responsibly to purchase advertising time and
			 space and eliminate the potential for waste, fraud, and abuse; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe46280fc6d3b489fa0e98ca0af9833c8"><enum>(5)</enum><text display-inline="yes-display-inline">all contracts or cooperative agreements
			 entered into with a corporation, partnership, or individual working on behalf
			 of the national media campaign.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID86a041f51992400e89f281a9ad8ab94d"><enum>(e)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $5,000,000 for each of
			 fiscal years 2006 through 2010.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID9f8337b84da848d19171f62d4f6a48de" section-type="subsequent-section"><enum>404.</enum><header>Energy efficiency
			 resource programs</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID78e424d3c10545b896795aa852953bf2"><enum>(a)</enum><header>Electric
			 utility programs</header><text display-inline="yes-display-inline">Section 111
			 of the Public Utilities Regulatory Policy Act of 1978 (16 U.S.C. 2621) is
			 amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id9641432479C7467FBE2D390728DDF8F4" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="ID50df117517244c1b8144e67a4939a0bd"><enum>(e)</enum><header>Energy
				efficiency resource programs</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDb40b9b60a6844cea9537a780cb60be34"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID0d75274180af4f9a95e6d7f523c96a33"><enum>(A)</enum><header>Demand
				baseline</header><text display-inline="yes-display-inline">The term
				<term>demand baseline</term> means the baseline determined by the Secretary for
				an appropriate period preceding the implementation of an energy efficiency
				resource program.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDed9f53b612624c71b0b1a0408a0e81ed"><enum>(B)</enum><header>Energy
				efficiency resource programs</header><text display-inline="yes-display-inline">The term <term>energy efficiency resource
				program</term> means an energy efficiency or other demand reduction program
				that is designed to reduce annual electricity consumption or peak demand of
				consumers served by an electric utility by a percentage of the demand baseline
				of the utility that is equal to not less than 0.75 percent of the number of
				years during which the program is in effect.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6e03fe64a8f749fe90bf231e7bbe29ad"><enum>(2)</enum><header>Public
				hearings; determinations</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDbee2c0a14ad1411a899addab89b18eb9"><enum>(A)</enum><header>Public
				hearing</header><text display-inline="yes-display-inline">As soon as
				practicable after the date of enactment of this subsection, but not later than
				3 years after that date, each State regulatory authority (with respect to each
				electric utility over which the State has ratemaking authority) and each
				nonregulated electric utility shall, after notice, conduct a public hearing on
				the benefits and feasibility of carrying out an energy efficiency resource
				program.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2da583a398da4103b53d2c17e636b1d9"><enum>(B)</enum><header>Energy
				efficiency resource program</header><text display-inline="yes-display-inline">A
				State regulatory authority or nonregulated utility shall carry out an energy
				efficiency resource program if, on the basis of a hearing under subparagraph
				(A), the State regulatory authority or nonregulated utility determines that the
				program would—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDc1e2db4677dd40a09bfdcd146e134e10"><enum>(i)</enum><text display-inline="yes-display-inline">benefit end-use customers;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID462da913f7f548c3a0fd7628a54fe093"><enum>(ii)</enum><text display-inline="yes-display-inline">be cost-effective based on total resource
				cost;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID1062ff13376e4c998716144274e25bfb"><enum>(iii)</enum><text display-inline="yes-display-inline">serve the public welfare; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID2a3d0efa9ec842da907c84da0e926ad3"><enum>(iv)</enum><text display-inline="yes-display-inline">be feasible to carry out.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID60924c24ba544f53b1e060c1f10afdfe"><enum>(3)</enum><header>Implementation</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID48124ecdc41b4838bd97c49fe09fd8e5"><enum>(A)</enum><header>State
				regulatory authorities</header><text display-inline="yes-display-inline">If a
				State regulatory authority makes a determination under paragraph (2)(B), the
				State regulatory authority shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDa1b9657579b14f69886a3ca68e0b9207"><enum>(i)</enum><text display-inline="yes-display-inline">require each electric utility over which
				the State has ratemaking authority to carry out an energy efficiency resource
				program; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID0ba66b77dc2e478f8eb921021bf08321"><enum>(ii)</enum><text display-inline="yes-display-inline">allow such a utility to recover
				expenditures incurred by the utility in carrying out the energy efficiency
				resource program.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf9d54c3a3e3a4f9698a563ebc7de7aa2"><enum>(B)</enum><header>Nonregulated
				electric utilities</header><text display-inline="yes-display-inline">If a
				nonregulated electric utility makes a determination under paragraph (2)(B), the
				utility shall carry out an energy efficiency resource program.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4f7c523c9f8f4886b7c3172fa21bc3ad"><enum>(4)</enum><header>Updating
				regulations</header><text display-inline="yes-display-inline">A State
				regulatory authority or nonregulated utility may update periodically a
				determination under paragraph (2)(B) to determine whether an energy efficiency
				resource program should be—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID39caaabcc367465f9cd8b28c9bc210e6"><enum>(A)</enum><text display-inline="yes-display-inline">continued;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8a179bb0c794442eb2a6fa8e2ab5a8f0"><enum>(B)</enum><text display-inline="yes-display-inline">modified; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd828c3f385684b769ef4b034a046aa72"><enum>(C)</enum><text display-inline="yes-display-inline">terminated.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID05175725ea074dce9d30f1fc2316a7e5"><enum>(5)</enum><header>Exception</header><text display-inline="yes-display-inline">Paragraph (2) shall not apply to a State
				regulatory authority (or a nonregulated electric utility operating in the
				State) that demonstrates to the Secretary that an energy efficiency resource
				program is in effect in the
				State.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID6c041ad57fb043caa0be2b9e46ff7eb5"><enum>(b)</enum><header>Gas
			 utilities</header><text display-inline="yes-display-inline">Section 303 of the
			 Public Utilities Regulatory Policy Act of 1978 (15 U.S.C. 3203) is amended by
			 adding at the end the following:</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID54d12f60420b4cc9b27f5318050261cb"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID8f685670bda94df2bee4f80b4417daea"><enum>(A)</enum><header>Demand
				baseline</header><text display-inline="yes-display-inline">The term
				<term>demand baseline</term> means the baseline determined by the Secretary for
				an appropriate period preceding the implementation of an energy efficiency
				resource program.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd8957575f0d0493d9838679559e469ba"><enum>(B)</enum><header>Energy
				efficiency resource programs</header><text display-inline="yes-display-inline">The term <term>energy efficiency resource
				program</term> means an energy efficiency or other demand reduction program
				that is designed to reduce annual gas consumption or peak demand of consumers
				served by a gas utility by a percentage of the demand baseline of the utility
				that is equal to not less than 0.75 percent of the number of years during which
				the program is in effect.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6b7bfa9ea50d4ee7b9405a62ba99ffbb"><enum>(2)</enum><header>Public
				hearings; determinations</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID30183a07b94640f58ca859d0342add4b"><enum>(A)</enum><header>Public
				hearing</header><text display-inline="yes-display-inline">As soon as
				practicable after the date of enactment of this subsection, but not later than
				3 years after that date, each State regulatory authority (with respect to each
				gas utility over which the State has ratemaking authority) and each
				nonregulated gas utility shall, after notice, conduct a public hearing on the
				benefits and feasibility of carrying out an energy efficiency resource
				program.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7d3bcaa5bb814691833a88178767f522"><enum>(B)</enum><header>Energy
				efficiency resource program</header><text display-inline="yes-display-inline">A
				State regulatory authority or nonregulated utility shall carry out an energy
				efficiency resource program if, on the basis of a hearing under subparagraph
				(A), the State regulatory authority or nonregulated utility determines that the
				program would—</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID027046ef17f242aca827f0557d4df4a1"><enum>(iii)</enum><text display-inline="yes-display-inline">serve the public welfare; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDd0663c49b61b4bc2bf2c99ce885380c6"><enum>(iv)</enum><text display-inline="yes-display-inline">be feasible to carry out.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbe54bf9236c14129afd892b6d2641e21"><enum>(3)</enum><header>Implementation</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDf0d70d601ee14fc7a3b2d2c40dff119a"><enum>(A)</enum><header>State
				regulatory authorities</header><text display-inline="yes-display-inline">If a
				State regulatory authority makes a determination under paragraph (2)(B), the
				State regulatory authority shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID4928a6e1d1334237937853e577349a39"><enum>(i)</enum><text display-inline="yes-display-inline">require each gas utility over which the
				State has ratemaking authority to carry out an energy efficiency resource
				program; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDaea3f7a889ba4a84b54cf8548f8b6b15"><enum>(ii)</enum><text display-inline="yes-display-inline">allow such a utility to recover
				expenditures incurred by the utility in carrying out the energy efficiency
				resource program.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd4022279127249f687678156011d5f62"><enum>(B)</enum><header>Nonregulated
				gas utilities</header><text display-inline="yes-display-inline">If a
				nonregulated gas utility makes a determination under paragraph (2)(B), the
				utility shall carry out an energy efficiency resource program.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9d83203c7cd245c0ab63332b2febb129"><enum>(4)</enum><header>Updating
				regulations</header><text display-inline="yes-display-inline">A State
				regulatory authority or nonregulated utility may update periodically a
				determination under paragraph (2)(B) to determine whether an energy efficiency
				resource program should be—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDa6fa7d5945cf4a7e85eff33769b694fc"><enum>(A)</enum><text display-inline="yes-display-inline">continued;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4b5eb7f4bd744b8fb89f3c917fd1766f"><enum>(B)</enum><text display-inline="yes-display-inline">modified; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID742c7ef7f1ee4c4f8cb2df4e84af0a15"><enum>(C)</enum><text display-inline="yes-display-inline">terminated.</text>

			<section commented="no" display-inline="no-display-inline" id="id05F8C5D64E49423A94BE40DE70DA0F7E" section-type="subsequent-section"><enum>501.</enum><header>Energy emergency
			 disaster relief loans to small business and agricultural producers</header>
				<subsection commented="no" display-inline="no-display-inline" id="idE43D927A003647AF8B70FAD80A4B1866"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id95E2723832A24FA19E3CEE2D3E0182EA"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Administrator</term> means
			 the Administrator of the Small Business Administration; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF5BB967A931842A99C75B04816B999C2"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>small business
			 concern</term> has the meaning given the term in section 3 of the Small
			 Business Act (15 U.S.C. 632).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7E4E2949A68A424CA0F752EC8C7FB729"><enum>(b)</enum><header>Small Business
			 Producer Energy Emergency Disaster Loan Program</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID0EE342A5F363495DABA90251661C4FBF"><enum>(1)</enum><header>Disaster loan
			 authority</header><text display-inline="yes-display-inline">Section 7(b) of the
			 <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C. 636(b))
			 is amended by inserting immediately after paragraph (3) the following:</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="id87C594DA4568409EA6CB27FA32A76662"><enum>(A)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID72B23DF76F1142FB89AEF34275451EC5"><enum>(i)</enum><text display-inline="yes-display-inline">the term <term>base price index</term>
				means the moving average of the closing unit price on the New York Mercantile
				Exchange for heating oil, natural gas, gasoline, or propane for the 10 days
				that correspond to the trading days described in clause (ii) in each of the
				most recent 2 preceding years;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID9D480E6E988C45DBA203F653C0D862DE"><enum>(ii)</enum><text display-inline="yes-display-inline">the term <term>current price index</term>
				means the moving average of the closing unit price on the New York Mercantile
				Exchange, for the 10 most recent trading days, for contracts to purchase
				heating oil, natural gas, gasoline, or propane during the subsequent calendar
				month, commonly known as the <quote>front month</quote>; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID3B22CAAF1355425E84F74C713D9B96A2"><enum>(iii)</enum><text display-inline="yes-display-inline">the term <term>significant increase</term>
				means—</text>
										<subclause commented="no" display-inline="no-display-inline" id="IDEF203AFF4BC04CF4AF369FF336F6A80E"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to the price of heating oil,
				natural gas, gasoline, or propane, any time the current price index exceeds the
				base price index by not less than 40 percent; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID03BBDC0C9FBB41A3A57759E78FA0DC5C"><enum>(II)</enum><text display-inline="yes-display-inline">with respect to the price of kerosene, any
				increase which the Administrator, in consultation with the Secretary of Energy,
				determines to be significant.</text>
										</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCF5DB1596DC64A20BCDBF741CEA4ECF2"><enum>(B)</enum><header>Loan
				authority</header><text display-inline="yes-display-inline">The Administrator
				may make such loans, either directly or in cooperation with banks or other
				lending institutions through agreements to participate on an immediate or
				deferred basis, to assist a small business concern that has suffered or that is
				likely to suffer substantial economic injury on or after January 1, 2005, as
				the result of a significant increase in the price of heating oil, natural gas,
				gasoline, propane, or kerosene occurring on or after January 1, 2005.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID61510C824F334834B9A42CAEB8D5E966"><enum>(C)</enum><header>Interest
				rate</header><text display-inline="yes-display-inline">Any loan or guarantee
				extended pursuant to this paragraph shall be made at the same interest rate as
				economic injury loans under paragraph (2).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID983A3D74B0934DFDBA73AD63E5409C4A"><enum>(D)</enum><header>Maximum
				amount</header><text display-inline="yes-display-inline">No loan may be made
				under this paragraph, either directly or in cooperation with banks or other
				lending institutions through agreements to participate on an immediate or
				deferred basis, if the total amount outstanding and committed to the borrower
				under this subsection would exceed $1,500,000, unless such borrower constitutes
				a major source of employment in its surrounding area, as determined by the
				Administrator, in which case the Administrator, in the discretion of the
				Administrator, may waive the $1,500,000 limitation.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2AD6B4CC44C14505B39C8251EB8EACEB"><enum>(E)</enum><header>Disaster
				declaration</header><text display-inline="yes-display-inline">For purposes of
				assistance under this paragraph—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDD860099E3B44435895B93B79A133997E"><enum>(i)</enum><text display-inline="yes-display-inline">a declaration of a disaster area based on
				conditions specified in this paragraph shall be required, and shall be made by
				the President or the Administrator; or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDF021891E5F204F5A9AB2CA7DE947F0D6"><enum>(ii)</enum><text display-inline="yes-display-inline">if no declaration has been made pursuant to
				clause (i), the Governor of a State in which a significant increase in the
				price of heating oil, natural gas, gasoline, propane, or kerosene has occurred
				may certify to the Administrator that small business concerns have suffered
				economic injury as a result of such increase and are in need of financial
				assistance which is not otherwise available on reasonable terms in that State,
				and upon receipt of such certification, the Administrator may make such loans
				as would have been available under this paragraph if a disaster declaration had
				been issued.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID14239CCD9F9441138786FBE3CDA50E97"><enum>(F)</enum><header>Conversion</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				loans made under this paragraph may be used by a small business concern
				described in subparagraph (B) to convert from the use of heating oil, natural
				gas, gasoline, propane, or kerosene to a renewable or alternative energy
				source, including agriculture and urban waste, geothermal energy, cogeneration,
				solar energy, wind energy, or fuel
				cells.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID847E1F0FD6E54E709B475C908E76528D"><enum>(2)</enum><header>Conforming
			 amendments</header><text display-inline="yes-display-inline">Section 3(k) of
			 the <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C.
			 632(k)) is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID75D3677FFE09406DAE4CC66963BD492F"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>, a significant
			 increase in the price of heating oil, natural gas, gasoline, propane, or
			 kerosene,</quote> after <quote>civil disorders</quote>; and</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3303BE586A444B0290BB71ABBF654E11"><enum>(c)</enum><header>Agricultural
			 Producer Emergency Loans</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID0414E7B261F74C40ABADE0966803160E"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 321(a) of the
			 <act-name parsable-cite="CFRDA">Consolidated Farm and Rural Development
			 Act</act-name> (7 U.S.C. 1961(a)) is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID909C4278B0F24B67BEA469DAB69A3660"><enum>(A)</enum><text display-inline="yes-display-inline">in the first sentence—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDD645108B02524F1286CC6B9283A87F13"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>aquaculture operations
			 have</quote> and inserting <quote>aquaculture operations (i) have</quote>;

			 January 1, 2005, as the result of a significant increase in energy costs or
			 input costs from energy sources occurring on or after January 1, 2005, in

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4E697D0219574174895F06FD3C9058F7"><enum>(B)</enum><text display-inline="yes-display-inline">in the third sentence, by inserting before
			 the period at the end the following: <quote>or by an energy emergency declared
			 by the President or the Secretary</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID331D4F7DC9E24F1B903739BE930D86CB"><enum>(C)</enum><text display-inline="yes-display-inline">in the fourth sentence—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDB60A83D8DD144D5C965772F918183852"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>or natural
			 disaster</quote> each place that term appears and inserting <quote>, natural
			 disaster, or energy emergency</quote>; and</text>

							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2A2854FEAEE5405095A53E0B22934326"><enum>(2)</enum><header>Funding</header><text display-inline="yes-display-inline">Funds available on the date of enactment of
			 this Act for emergency loans under subtitle C of the
			 <act-name parsable-cite="CFRDA">Consolidated Farm and Rural Development
			 Act</act-name> (7 U.S.C. 1961 et seq.) shall be available to carry out the
			 amendments made by paragraph (1) to meet the needs resulting from natural
			 disasters.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID895C0350179F4367BAD7F31FE60CD634"><enum>(d)</enum><header>Guidelines and
			 rulemaking</header>
					<paragraph commented="no" display-inline="no-display-inline" id="IDB0A4F590601F4A7A9C9E40A7145E5E53"><enum>(1)</enum><header>Guidelines</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
			 enactment of this Act, the Administrator and the Secretary of Agriculture shall
			 each issue guidelines to carry out subsections (b) and (c), respectively, and
			 the amendments made thereby, which guidelines shall become effective on the
			 date of their issuance.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7CF0C8A6096F43EBA974ABD8BB250870"><enum>(2)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
			 enactment of this Act, the Administrator, after consultation with the Secretary
			 of Energy, shall promulgate regulations specifying the method for determining a
			 significant increase in the price of kerosene under section 7(b)(4)(A)(iii)(II)
			 of the <act-name parsable-cite="SBA">Small Business Act</act-name>, as added by
			 this section.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD2741C8944ED4C7ABD1315115BF9B8CC"><enum>(e)</enum><header>Reports</header>
					<paragraph commented="no" display-inline="no-display-inline" id="IDE231707D105142B48A44433E6044DF19"><enum>(1)</enum><header>Small business
			 administration</header><text display-inline="yes-display-inline">Not later than
			 12 months after the date on which the Administrator issues guidelines under
			 subsection (d)(1), and annually thereafter, until the date that is 12 months
			 after the end of the effective period of section 7(b)(4) of the Small Business
			 Act, as added by this section, the Administrator shall submit to the Committee
			 on Small Business and Entrepreneurship of the Senate and the Committee on Small
			 Business of the House of Representatives, a report on the effectiveness of the
			 assistance made available under section 7(b)(4) of the
			 <act-name parsable-cite="SBA">Small Business Act</act-name>, as added by this
			 section, including—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID87E095A17C164BF5B656614ECE01954A"><enum>(A)</enum><text display-inline="yes-display-inline">the number of small business concerns that
			 applied for a loan under such section 7(b)(4) and the number of those that
			 received such loans;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID32FCB0301BCA4FE48ABDBC80D50E5740"><enum>(B)</enum><text display-inline="yes-display-inline">the dollar value of those loans;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDB3A7314DD0A4A14973E92F03AA52793"><enum>(C)</enum><text display-inline="yes-display-inline">the States in which the small business
			 concerns that received such loans are located;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFE66265BEE424C2E968BDBBA71BF2317"><enum>(D)</enum><text display-inline="yes-display-inline">the type of energy that caused the
			 significant increase in the cost for the participating small business concerns;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3CD724C15B094C11AAA4674F01273CF4"><enum>(E)</enum><text display-inline="yes-display-inline">recommendations for ways to improve the
			 assistance provided under such section 7(b)(4), if any.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB55394CF537C4752A9D85A49BBEB2276"><enum>(2)</enum><header>Department of
			 agriculture</header><text display-inline="yes-display-inline">Not later than 12
			 months after the date on which the Secretary of Agriculture issues guidelines
			 under subsection (d)(1), and annually thereafter, until the date that is 12
			 months after the end of the effective period of the amendments made to section
			 321(a) of the Consolidated Farm and Rural Development Act (7 U.S.C. 1961(a)) by
			 this section, the Secretary shall submit to the Committee on Small Business and
			 Entrepreneurship and the Committee on Agriculture, Nutrition, and Forestry of
			 the Senate and to the Committee on Small Business and the Committee on
			 Agriculture of the House of Representatives, a report that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID893A4501731346FA9535C8AF19C2476A"><enum>(A)</enum><text display-inline="yes-display-inline">describes the effectiveness of the
			 assistance made available under section 321(a) of the
			 <act-name parsable-cite="CFRDA">Consolidated Farm and Rural Development
			 Act</act-name> (7 U.S.C. 1961(a)), as amended by this section; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC769BF1AF3FE4F738154B5D4A9783090"><enum>(B)</enum><text display-inline="yes-display-inline">contains recommendations for ways to
			 improve the assistance provided under such section 321(a).</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID26FBD152BF50400CAF0121321FE578A5"><enum>(f)</enum><header>Effective
			 Date</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID4635070F89EF4894AFB8CC66A4E91060"><enum>(1)</enum><header>Small
			 business</header><text display-inline="yes-display-inline">The amendments made
			 by subsection (b) shall apply during the 4-year period beginning on the earlier
			 of the date on which guidelines are published by the Administrator under
			 subsection (d)(1) or 30 days after the date of enactment of this Act, with
			 respect to assistance under section 7(b)(4) of the
			 <act-name parsable-cite="SBA">Small Business Act</act-name>, as added by this
			 section.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID960DEBAE05EC4694869F9E8B7E39F4CD"><enum>(2)</enum><header>Agriculture</header><text display-inline="yes-display-inline">The amendments made by subsection (c) shall
			 apply during the 4-year period beginning on the earlier of the date on which
			 guidelines are published by the Secretary of Agriculture under subsection
			 (d)(1) or 30 days after the date of enactment of this Act, with respect to
			 assistance under section 321(a) of the Consolidated Farm and Rural Development
			 Act (7 U.S.C. 1961(a)), as amended by this section.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id63DE5B7EE0EA45599DBE79A97DE33C68" section-type="subsequent-section"><enum>502.</enum><header>Efficient and safe
			 equipment replacement program for weatherization purposes</header>
				<subsection commented="no" display-inline="no-display-inline" id="id92AAC803746D4EE0B7685ED53332BB67"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part A of title IV of
			 the Energy Conservation and Production Act is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id14D46662A60A4839B6C1273EA7CB2F50"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 422 (42 U.S.C.
			 6872) as section 423; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8F901448D0384CE792B16E867596261A"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 421 (42 U.S.C.
			 6871) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id91730EDCC48446B2A8A840A2807020F3" style="OLC">
							<section commented="no" display-inline="no-display-inline" id="idD6108F16FAAD4E7DA0D37ABFF3A2BD61" section-type="subsequent-section"><enum>422.</enum><header>Efficient and safe
				equipment replacement program for weatherization purposes</header>
								<subsection commented="no" display-inline="no-display-inline" id="idE39DE250BC2F45C0B799C34E7C932ACD"><enum>(a)</enum><header>Establishment
				of program</header><text display-inline="yes-display-inline">The Secretary
				shall establish, within the Weatherization Assistance Program, a program to
				assist in the replacement of unsafe or highly inefficient heating and cooling
				units in low-income households.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="id157168773FC245D5B23BBEA6C2E66EE8"><enum>(b)</enum><header>Administration</header>
									<paragraph commented="no" display-inline="no-display-inline" id="id1413461A4F5B44C2B53E779261AD2EB9"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as otherwise
				provided in this subsection, the Secretary shall administer the program
				established under this section in accordance with this part.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id78468619B04F467998DB80EAADCE7E53"><enum>(2)</enum><header>Exemption for
				high-efficiency heating and cooling equipment expenditures</header><text display-inline="yes-display-inline">Assistance for high-efficiency heating and
				cooling equipment under this section shall be exempt from the standards
				established under section 413(b)(3) and from section 415(c).</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id68AA9386441B48B99247B937F0045C46"><enum>(3)</enum><header>Identification
				of heating and cooling system upgrades</header><text display-inline="yes-display-inline">Assistance for system upgrades under this
				section shall be based on a standard weatherization audit and appropriate
				diagnostic procedures in use by the program.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE6994F6DFBFD44039B721F60EA2FA219"><enum>(4)</enum><header>Weatherization
				of home receiving new heating or cooling system</header><text display-inline="yes-display-inline">Assistance may be perceived for a home
				receiving a new heating or cooling system under this section regardless of
				whether the home is fully weatherized in the year that the home received a new
				heating system.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAAAD3A3273ED4DE996C4DF1DF5E36611"><enum>(5)</enum><header>Fuel</header><text display-inline="yes-display-inline">The Secretary shall make no rule
				prohibiting a grantee from installing high-efficiency equipment that uses a
				fuel (including a renewable fuel) most likely to result in reliable supply and
				the lowest practicable energy bills, regardless of the fuel previously used by
				the household.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id16A4A3746FAE48659E5C83483083B9C2"><enum>(c)</enum><header>Authorization
				of appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to the Secretary to carry out this
				section—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="id7989BAB070384E9C8969F7B0CC89CB7E"><enum>(1)</enum><text display-inline="yes-display-inline">$40,000,000 for fiscal year 2006;</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFD49DEC625E54809B1D2CD160EBCBD22"><enum>(2)</enum><text display-inline="yes-display-inline">$50,000,000 for fiscal year 2007;
				and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8DF00D918ED04B6380A23AF0C062E225"><enum>(3)</enum><text display-inline="yes-display-inline">$60,000,000 for fiscal year
				2008.</text>
