		<official-title display="yes">To amend title XVIII of the Social Security
		  Act to require the sponsor of a prescription drug plan or an organization
		  offering an MA–PD plan to promptly pay claims submitted under part D, and for
		  other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Pharmacists Medicare Relief Act of
			 2006</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HC5F680DBE6734C59B7DFBD2C13025499" section-type="subsequent-section"><enum>2.</enum><header>Prompt payment by
			 prescription drug plans and MA–PD plans under part D</header>
			<subsection commented="no" display-inline="no-display-inline" id="H9E13E017C04C4B65911B47FB2932FB73"><enum>(a)</enum><header>Prompt payment
			 by prescription drug plans</header><text display-inline="yes-display-inline">Section 1860D–12(b) of the Social Security
			 Act (42 U.S.C. 1395w–112(b)) is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HDB165079970F425C838EB6F81021C77F" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="H4FA859AA47FE49B7838145AE63A42B8F"><enum>(4)</enum><header>Prompt payment
				of clean claims</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="H5ECF98370F1649B9B1007643A8DC3E01"><enum>(A)</enum><header>Prompt
				payment</header>
							<clause commented="no" display-inline="no-display-inline" id="H8CF71C75DE56474B9E0070861B13F9B3"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Each contract entered
				into with a PDP sponsor under this section with respect to a prescription drug
				plan offered by such sponsor shall provide that payment shall be issued,
				mailed, or otherwise transmitted with respect to all clean claims submitted
				under this part within the applicable number of calendar days after the date on
				which the claim is received.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H1223F96B664F46D5844FC187AAF4D6BC"><enum>(ii)</enum><header>Clean claim
				defined</header><text display-inline="yes-display-inline">In this paragraph,
				the term <quote>clean claim</quote> means a claim that has no defect or
				impropriety (including any lack of any required substantiating documentation)
				or particular circumstance requiring special treatment that prevents timely
				payment from being made on the claim under this part.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H83620010177A4C2FA22748B2E05835F3"><enum>(B)</enum><header>Applicable
				number of calendar days defined</header><text display-inline="yes-display-inline">In this paragraph, the term
				<quote>applicable number of calendar days</quote> means—</text>
							<clause commented="no" display-inline="no-display-inline" id="HE9490D296AF04E59B925B98BA6DCB91"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to claims submitted
				electronically, 14 days; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H4211B0A0EB75485FA543E36E1BC42C31"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to claims submitted otherwise,
				30 days.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAE2514426D5D4BE5AFB212277BA7F885"><enum>(C)</enum><header>Interest
				payment</header><text display-inline="yes-display-inline">If payment is not
				issued, mailed, or otherwise transmitted within the applicable number of
				calendar days (as defined in subparagraph (B)) after a clean claim is received,
				interest shall be paid at a rate equal to the weighted average of interest on
				3-month marketable Treasury securities determined for such period, increased by
				0.1 percentage point for the period beginning on the day after the required
				payment date and ending on the date on which payment is made.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H26E09494D5C1474EAB17263C11C7FC00"><enum>(D)</enum><header>Procedures
				involving claims</header>
							<clause commented="no" display-inline="no-display-inline" id="H7B1A8387B789427398D21F2D2553C25B"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">A contract entered
				into with a PDP sponsor under this section with respect to a prescription drug
				plan offered by such sponsor shall provide that, not later than 10 days after
				the date on which a clean claim is submitted, the PDP sponsor shall provide the
				claimant with a notice that acknowledges receipt of the claim by such sponsor.
				Such notice shall be considered to have been provided on the date on which the
				notice is mailed or electronically transferred.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H43F6C1CA22FA49FFB61717DBA5FAC4F3"><enum>(ii)</enum><header>Claim deemed to
				be clean</header><text display-inline="yes-display-inline">A claim is deemed to
				be a clean claim if the PDP sponsor involved does not provide notice to the
				claimant of any deficiency in the claim within 10 days of the date on which the
				claim is submitted.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H01E1EDE031CC4F608992F01C31009568"><enum>(iii)</enum><header>Claim
				determined to not be a clean claim</header>
								<subclause commented="no" display-inline="no-display-inline" id="HE2799885472B456397F15D5D6E5B9E49"><enum>(I)</enum><header>In
				general</header><text display-inline="yes-display-inline">If a PDP sponsor
				determines that a submitted claim is not a clean claim, the PDP sponsor shall,
				not later than the end of the period described in clause (ii), notify the
				claimant of such determination. Such notification shall specify all defects or
				improprieties in the claim and shall list all additional information or
				documents necessary for the proper processing and payment of the claim.</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H5A4788FA82BE43369C94883E51CCAF00"><enum>(II)</enum><header>Determination
				after submission of additional information</header><text display-inline="yes-display-inline">A claim is deemed to be a clean claim under
				this paragraph if the PDP sponsor involved does not provide notice to the
				claimant of any defect or impropriety in the claim within 10 days of the date
				on which additional information is received under subclause (I).</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H85340DA0343A48FEAAD11D872C429C5C"><enum>(III)</enum><header>Payment of
				clean portion of a claim</header><text display-inline="yes-display-inline">A
				PDP sponsor shall, as appropriate, pay any portion of a claim that would be a
				clean claim but for a defect or impropriety in a separate portion of the claim
				in accordance with subparagraph (A).</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H00F0E4837957432186F566C18EB24612"><enum>(iv)</enum><header>Obligation to
				pay</header><text display-inline="yes-display-inline">A claim submitted to a
				PDP sponsor that is not paid or contested by the provider within the applicable
				number of days (as defined in subparagraph (B)) shall be deemed to be a clean
				claim and shall be paid by the PDP sponsor in accordance with subparagraph
				(A).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HA3ED2A7BBE834796B2FA0352892B70E6"><enum>(v)</enum><header>Date of payment
				of claim</header><text display-inline="yes-display-inline">Payment of a clean
				claim under such subparagraph is considered to have been made on the date on
				which full payment is received by the provider.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDD161E8CAB5A45B0AB2F1837B86B2B1"><enum>(E)</enum><header>Private right of
				action</header>
							<clause commented="no" display-inline="no-display-inline" id="HA43581056D7648C1BC9009D4B96C037D"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Nothing in this
				paragraph shall be construed to prohibit or limit a claim or action not covered
				by the subject matter of this section that any individual or organization has
				against a provider or a PDP sponsor.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HB010E5D628C24D6E806C399FA43B61CF"><enum>(ii)</enum><header>Anti-retaliation</header><text display-inline="yes-display-inline">Consistent with applicable Federal or State
				law, a PDP sponsor shall not retaliate against an individual or provider for
				exercising a right of action under this
				subparagraph.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H93B05A0DE20C4CCA999F01BF6F05C81F"><enum>(b)</enum><header>Prompt payment
			 by MA–PD plans</header><text display-inline="yes-display-inline">Section
			 1857(f) of the Social Security Act (42 U.S.C. 1395w–27) is amended by adding at
			 the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H00B19896E46B4DA3B7B5EE597BA6A633" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="HC0AB03A39E73429ABDC8D91E8BD5E8C4"><enum>(3)</enum><header>Incorporation of
				certain prescription drug plan contract requirements</header><text display-inline="yes-display-inline">The provisions of section 1860D–12(b)(4)
				shall apply to contracts with a Medicare Advantage organization in the same
				manner as they apply to contracts with a PDP sponsor offering a prescription
				drug plan under part
				D.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB78DD08251B04324998D2005C2A690B8"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to contracts entered into or renewed on or after the
			 date of the enactment of this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HA2D30C1C4BDB476E9947A21404087070" section-type="subsequent-section"><enum>3.</enum><header>Restriction on
			 co-branding</header>
			<subsection commented="no" display-inline="no-display-inline" id="H79D49F0E7BB34E2A91A057177268BB18"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1860D–4 of
			 the Social Security Act (42 U.S.C. 1395w–104) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H4E17AB8F1BFF4EF6A6C731F5B6167C2D"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(2)(A), by striking
			 <quote>The PDP sponsor</quote> and inserting <quote>Subject to subsection (l),
			 the PDP sponsor</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFC3A194A6AF14907A6AC4B9B0005A559"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H39AF935084F54FAF9C84251F1C88F2E8" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="HC89D454A2CC040EA9FA9078000080742"><enum>(l)</enum><header>Co-branding
				prohibited</header><text display-inline="yes-display-inline">A card that is
				issued under subsection (b)(2)(A) for use under a prescription drug plan
				offered by a PDP sponsor or an MA–PD plan offered by a Medicare Advantage
				organization and any marketing materials distributed with respect to such a
				plan shall not display the name or brand of any
				pharmacy.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7963B9186D4B414D99320022F1DAD2F5"><enum>(b)</enum><header>Penalty</header><text display-inline="yes-display-inline">Section 1128B of the Social Security Act
			 (42 U.S.C. 1320a–7b) is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HF66A5D79573B419BA92F3F4F52EE00E4" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="H224A292A6028475BAB02A5C3D2731CF1"><enum>(g)</enum><text display-inline="yes-display-inline">Whoever knowingly and willfully engages in
				co-branding prohibited under section 1860D–4(l) with respect to a prescription
				drug plan offered by a PDP sponsor under part D of title XVIII or a Medicare
				Advantage plan offered by a Medicare Advantage organization under part C of
				such title, shall be guilty of a felony and upon conviction thereof shall be
				fined not more than $25,000 or imprisoned for not more than five years, or
				both.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H9407ECBA37744DDD9BBC009B4780E6C3"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to cards and marketing materials distributed on or
			 after the date that is 90 days after the date of the enactment of this
			 Act.</text>
