			 <quote><short-title>Veterans' Choice of Representation Act
			 of 2006</short-title></quote>.</text>

			 representation in veterans benefits claims cases before the Department of
			 Veterans Affairs</header>
			<subsection changed="deleted" committee-id="SSVA00" id="idD430AEA8AB524F67BF5C4F52A18F7F4D" reported-display-style="strikethrough"><enum>(a)</enum><header>Qualifications
			 and standards of conduct for individuals recognized as agents or
			 attorneys</header>
				<paragraph changed="deleted" committee-id="SSVA00" id="id73104CC4164C456691F1E63A9C0EF22E" reported-display-style="strikethrough"><enum>(1)</enum><header>Additional
			 qualifications and standards for agents and attorneys
			 generally</header><text>Subsection (a) of section 5904 of title 38, United
			 States Code, is amended—</text>
					<subparagraph id="id97511EA81450403B8C886AA6A996CFC8"><enum>(A)</enum><text>by inserting <quote>(1)</quote>
			 after <quote>(a)</quote>;</text>
					</subparagraph><subparagraph id="id83E3D6A0891C4E7AB2D2394DDB2C4F46"><enum>(B)</enum><text>by striking the second sentence;
			 and</text>
					</subparagraph><subparagraph id="idC0C46A2830864759B861EAD3AAAAF612"><enum>(C)</enum><text>by adding at the end the following
			 new paragraphs:</text>
						<quoted-block display-inline="no-display-inline" id="id65A172A298CA429990EEC1AF92D61CC9" style="OLC">
							<paragraph changed="deleted" committee-id="SSVA00" id="id97C80B77E0C340EDAD058323729E4A7F" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text>The Secretary may
				prescribe in regulations qualifications and standards of conduct for
				individuals recognized under this section, including the following:</text>
								<subparagraph changed="deleted" committee-id="SSVA00" id="idEFF8D9FCCDFF44F5BEF3AEA704A42A59" reported-display-style="strikethrough"><enum>(A)</enum><text>A requirement
				that, before being recognized, an individual—</text>
									<clause id="id00594F6AD44849E7BA5537A6F7BCD7CE"><enum>(i)</enum><text>show that such individual is of
				good moral character and in good repute, is qualified to render claimants
				valuable service, and is otherwise competent to assist claimants in presenting
				claims; and</text>
									</clause><clause id="idEB13E69FEAC94D93A11D0D8CDA20A75D"><enum>(ii)</enum><text>has such level of experience and
				specialized training as the Secretary shall specify.</text>
									</clause></subparagraph><subparagraph changed="deleted" committee-id="SSVA00" id="id764BB77394E841389116FB09A30505B1" reported-display-style="strikethrough"><enum>(B)</enum><text>A requirement that
				the individual follow such standards of conduct as the Secretary shall
				specify.</text>
								</subparagraph></paragraph><paragraph changed="deleted" committee-id="SSVA00" id="idA94A4F65072E4EAF9F1577959B85A3E3" indent="up1" reported-display-style="strikethrough"><enum>(3)</enum><text>The Secretary may
				prescribe in regulations restrictions on the amount of fees that an agent or
				attorney may charge a claimant for services rendered in the preparation,
				presentation, and prosecution of a claim before the Department.</text>
							</paragraph><paragraph changed="deleted" committee-id="SSVA00" id="idF9EBCCAF65474F279A8218F0431ED868" indent="up1" reported-display-style="strikethrough"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id9D64AEDE2586466A908883B4EB9226FE"><enum>(A)</enum><text>The Secretary may, on a
				periodic basis, collect from individuals recognized as agents or attorneys
				under this section a registration fee.</text>
								</subparagraph><subparagraph id="id2F67C70E4E3045C28DFE55240B6DE303" indent="up1"><enum>(B)</enum><text>The Secretary shall prescribe the
				amount and frequency of collection of such fees. The amount of such fees may
				include an amount, as specified by the Secretary, necessary to defray the costs
				of the Department in recognizing individuals under this section, in
				administering the collection of such fees, in administering the payment of fees
				under subsection (d), and in conducting oversight of agents or
				attorneys.</text>
								</subparagraph><subparagraph id="idE45444F289534908B7E067269DE35CBE" indent="up1"><enum>(C)</enum><text>Amounts so collected shall be
				deposited in the account from which amounts for such costs were derived, merged
				with amounts in such account, and available for the same purpose, and subject
				to the same conditions and limitations, as amounts in such
				account.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph changed="deleted" committee-id="SSVA00" id="idB39FABEA37C649AFA4BA9685C84292DE" reported-display-style="strikethrough"><enum>(2)</enum><header>Applicability to
			 representatives of veterans service organizations</header><text>Section 5902(b)
			 of such title is amended—</text>
					<subparagraph id="idAB8ACB90765B4D929F41245239650CFD"><enum>(A)</enum><text>by redesignating paragraphs (1) and
			 (2) as subparagraphs (A) and (B), respectively;</text>
					</subparagraph><subparagraph id="idA07B4C591070412F8A01078C6CC1AAA4"><enum>(B)</enum><text>by inserting <quote>(1)</quote>
			 after <quote>(b)</quote>; and</text>
					</subparagraph><subparagraph id="idBEFB4B2196034639BE8B4E30369E4CB8"><enum>(C)</enum><text>by adding at the end the following
			 new paragraph:</text>
						<quoted-block changed="deleted" display-inline="no-display-inline" id="id1DB38D619A4249F6A8E13B71187EFE0E" reported-display-style="strikethrough" style="OLC">
							<paragraph id="id1A588EE31CFB41FD8CD91D0D8B67B6C8" indent="up1"><enum>(2)</enum><text>An individual
				recognized under this section shall be subject to suspension under section
				5904(b) of this title on the same basis as an individual recognized under
				section 5904(a) of this
				title.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph changed="deleted" committee-id="SSVA00" id="idC5960B313D2F4BF69726AE19E31581EA" reported-display-style="strikethrough"><enum>(3)</enum><header>Applicability to
			 individuals recognized for particular claims</header><text>Section 5903 of such
			 title is amended—</text>
					<subparagraph id="id4FD56F31C1154176BCEC6FB455E3FD87"><enum>(A)</enum><text>by inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">In
			 general</header-in-text>.—</quote> before <quote>The Secretary</quote>;
			 and</text>
					</subparagraph><subparagraph id="id612085BB3DD34C638C44D31A0E725BD6"><enum>(B)</enum><text>by adding at the end the following
			 new subsection:</text>

							<subsection id="id5557689D0D46434B93AE448E052B5E81"><enum>(b)</enum><header>Suspension</header><text>An
				individual recognized under this section shall be subject to suspension under
				section 5904(b) of this title on the same basis as an individual recognized
				under section 5904(a) of this
				title.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection changed="deleted" committee-id="SSVA00" id="idB74F582481C3404A9142857A6E93CEA7" reported-display-style="strikethrough"><enum>(b)</enum><header>Additional bases
			 for suspension of individuals</header><text>Subsection (b) of section 5904 of
			 such title is amended—</text>
				<paragraph id="id38F15DEA591746DC9FE33340B2383A3E"><enum>(1)</enum><text>by inserting <quote>and sections
			 5902 and 5903 of this title</quote> after <quote>under this
			 section</quote>;</text>
				</paragraph><paragraph id="id168699AF67A848C1B473DADDC32B16F9"><enum>(2)</enum><text>in paragraph (4), by striking
			 <quote>or</quote> at the end;</text>
				</paragraph><paragraph id="id033646BCAE8E4249AD38075D73B5B942"><enum>(3)</enum><text>in paragraph (5), by striking the
			 period and inserting a semicolon; and</text>
				</paragraph><paragraph id="id7C8E9C3E6C4145EAB4D49EE5E2FBE3BF"><enum>(4)</enum><text>by adding at the end the following
			 new paragraphs:</text>
					<quoted-block display-inline="no-display-inline" id="id2C9D02DD32C640A28CE502AE8102D6A4" style="OLC">
						<paragraph changed="deleted" committee-id="SSVA00" id="id23087EEA8AE24CA283A2C7624D9C5B93" reported-display-style="strikethrough"><enum>(6)</enum><text>has failed to
				conduct himself or herself with due regard for the non-adversarial nature of
				any proceeding before the Department;</text>
						</paragraph><paragraph changed="deleted" committee-id="SSVA00" id="id813548D35AA3463FB4EBA05840105ED1" reported-display-style="strikethrough"><enum>(7)</enum><text>has presented
				frivolous claims, issues, or arguments to the Department; or</text>
						</paragraph><paragraph changed="deleted" committee-id="SSVA00" id="id082B31ADE4B2497694712D3A9E03CBA9" reported-display-style="strikethrough"><enum>(8)</enum><text>has failed to
				comply with any other condition specified by the Secretary in regulations
				prescribed by the Secretary for purposes of this
				subsection.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection changed="deleted" committee-id="SSVA00" id="idA113ED476D0D415DA0B78E6912D1120C" reported-display-style="strikethrough"><enum>(c)</enum><header>Repeal of
			 limitation on hiring agents or attorneys</header><text>Subsection (c) of
			 section 5904 of such title is amended by striking paragraph (1).</text>
			</subsection><subsection changed="deleted" committee-id="SSVA00" id="id8EACEADB17374173A53A14DC1D60C921" reported-display-style="strikethrough"><enum>(d)</enum><header>Modification of
			 requirements to file attorney fee agreements</header><text>Such subsection is
			 further amended—</text>
				<paragraph changed="deleted" committee-id="SSVA00" id="id66059D4191B147A1BD1D3B9D2B3A6417" reported-display-style="strikethrough"><enum>(1)</enum><text>by redesignating
			 paragraph (2) as paragraph (1); and</text>
				</paragraph><paragraph changed="deleted" committee-id="SSVA00" id="idEC1846965D2D4ACAB94D77131808CD1D" reported-display-style="strikethrough"><enum>(2)</enum><text>in that paragraph,
			 as so redesignated—</text>
					<subparagraph id="idF7DE06B934C94A829E37B25C5FEF575C"><enum>(A)</enum><text>by striking <quote>in a case
			 referred to in paragraph (1) of this subsection</quote>;</text>
					</subparagraph><subparagraph id="idBF9829C86A6A4846BD61D50661B6839B"><enum>(B)</enum><text>by striking <quote>after the Board
			 first makes a final decision in the case</quote>;</text>
					</subparagraph><subparagraph id="id828D410F1DD1403FB9F5C23022F59A60"><enum>(C)</enum><text>by striking <quote>with the Board
			 at such time as may be specified by the Board</quote> and inserting <quote>with
			 the Secretary pursuant to regulations prescribed by the Secretary</quote>;
			 and</text>
					</subparagraph><subparagraph id="id17A37967E7E94ABA8140A452DFBF9BE2"><enum>(D)</enum><text>by striking the second and third
			 sentences.</text>
					</subparagraph></paragraph></subsection><subsection changed="deleted" committee-id="SSVA00" id="id7C28077DE6BE471DA8562824F9C3196E" reported-display-style="strikethrough"><enum>(e)</enum><header>Attorney
			 fees</header><text>Such subsection is further amended by inserting after
			 paragraph (1), as redesignated by
			 <internal-xref idref="id66059D4191B147A1BD1D3B9D2B3A6417"> subsection
			 (d)(1)</internal-xref> of this section, the following new paragraph (2):</text>
				<quoted-block display-inline="no-display-inline" id="id8A1FAB0FA8F44273A9C6D091D816C50E" style="OLC">
					<paragraph id="id80C8F226660E4B9681D33F2F5AC33464" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idDDAF3BD08E8949339037F9F7C58FD11F"><enum>(A)</enum><text>The Secretary, upon the
				Secretary's own motion or at the request of the claimant, may review a fee
				agreement filed pursuant to paragraph (1) and may order a reduction in the fee
				called for in the agreement if the Secretary finds that the fee is excessive or
				unreasonable.</text>
						</subparagraph><subparagraph changed="deleted" committee-id="SSVA00" id="idBF89F90E2978422D8F8ACD5DA53DA6BD" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>A finding or order
				of the Secretary under subparagraph (A) may be reviewed by the Board of
				Veterans' Appeals under section 7104 of this
				title.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="deleted" committee-id="SSVA00" id="idF05B2D7595E74D3B9D671DB9613C00EF" reported-display-style="strikethrough"><enum>(f)</enum><header>Repeal of
			 penalty for certain acts</header><text>Section 5905 of such title is amended by
			 striking <quote>(1)</quote> and all that follows through
			 <quote>(2)</quote>.</text>
			</subsection><subsection changed="deleted" committee-id="SSVA00" id="id77C1DDC2EF4F4BB3A7CA029D48A8E7EF" reported-display-style="strikethrough"><enum>(g)</enum><header>Effective
			 date</header>
				<paragraph id="id3C0C5CDA94484CEA8198E33540AB4212"><enum>(1)</enum><header>In general</header><text>The
			 amendments made by this section shall take effect six months after the date of
			 the enactment of this Act.</text>
				</paragraph><paragraph id="id85D6144587B642649C395E7696D7A7F3"><enum>(2)</enum><header>Regulations</header><text>The
			 Secretary shall prescribe the regulations, if any, to be prescribed under the
			 amendments made by <internal-xref idref="idD430AEA8AB524F67BF5C4F52A18F7F4D">
			 subsection (a)</internal-xref> not later than the date specified in
			 <internal-xref idref="id3C0C5CDA94484CEA8198E33540AB4212"> paragraph
			 (1)</internal-xref>.</text>
				</paragraph><paragraph id="id5D3910EC05584222A0A7B98310CCD47C"><enum>(3)</enum><header>Claims</header><text>The
			 amendments made by subsections (b), (c), (d), and (e) shall apply to claims

			 generally</header><text>Subsection (a) of section 5904 of title 38, United
			 States Code, is amended—</text>
						<subparagraph id="id28d1d9ba-96d6-4980-92f7-bb2433f642cd"><enum>(A)</enum><text>by
			 inserting <quote>(1)</quote> after <quote>(a)</quote>;</text>
						</subparagraph><subparagraph id="id2415c65e-e880-44a9-9b91-2d8fa35914b2"><enum>(B)</enum><text>by
			 striking the second sentence; and</text>
						</subparagraph><subparagraph id="id3d2c7f63-bd28-4c01-9e0e-5dfb7c595e3e"><enum>(C)</enum><text>by
			 adding at the end the following new paragraphs:</text>
							<quoted-block display-inline="no-display-inline" id="ide435e0ad-693c-4cc2-992e-2b9454370156" style="OLC">
								<paragraph changed="added" committee-id="SSVA00" id="id17f19fce-f09c-41c2-8f3e-3e4fa6615f12" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The Secretary may
				prescribe in regulations qualifications and standards of conduct for
				individuals recognized under this section, including a requirement that, before
				being recognized, an individual—</text>
									<subparagraph id="id0e2655de-fcb9-40de-a37b-9714252d8f13"><enum>(A)</enum><text>show that such individual is of
				good moral character and in good repute, is qualified to render claimants
				valuable service, and is otherwise competent to assist claimants in presenting
				claims;</text>
									</subparagraph><subparagraph id="idd7381d75-e5a3-40c0-9058-de0aee1f31dd"><enum>(B)</enum><text>has
				such level of experience and specialized training as the Secretary shall
				specify; and</text>
									</subparagraph><subparagraph id="idB1DDC4DFC9EC45D6B78235129FD83447"><enum>(C)</enum><text>certifies to the Secretary that the
				individual has satisfied any qualifications and standards prescribed by the
				Secretary under this section.</text>
									</subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="id623607f5-406b-4e2f-8d1a-c80523e88321" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>The Secretary may
				prescribe in regulations reasonable restrictions on the amount of fees that an
				agent or attorney may charge a claimant for services rendered in the
				preparation, presentation, and prosecution of a claim before the
				Department.</text>
								</paragraph><paragraph changed="added" committee-id="SSVA00" id="iddb31006b-a5f8-4740-9dcd-14610fdc4c29" indent="up1" reported-display-style="italic"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id9bc98440-47ad-4d9b-86fc-3efd8965fdc0"><enum>(A)</enum><text>The Secretary may,
				on a periodic basis, collect a registration fee from individuals recognized as
				agents or attorneys under this section.</text>
									</subparagraph><subparagraph id="id8a47a20f-2a95-4734-82f9-29592f7d30d4" indent="up1"><enum>(B)</enum><text>The Secretary shall prescribe the
				amount and frequency of collection of such fees. The amount of such fees may
				include an amount, as specified by the Secretary, necessary to defray the costs
				to the Department in recognizing individuals under this section, in
				administering the collection of such fees, in administering the payment of fees
				under subsection (d), and in conducting oversight of agents or
				attorneys.</text>
									</subparagraph><subparagraph id="id5c8cfe22-b516-4482-aace-5fc75e788b3b" indent="up1"><enum>(C)</enum><text>Amounts so collected shall be
				deposited in the account from which amounts for such costs were derived, merged
				with amounts in such account, and available for the same purpose, and subject
				to the same conditions and limitations, as amounts in such
				account.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="id53ed03ed-1367-4487-9992-279e88508b2c" reported-display-style="italic"><enum>(2)</enum><header>Applicability to
			 representatives of veterans service organizations</header><text>Section 5902(b)
			 of such title is amended—</text>

			 fees</header><text>Such subsection is further amended by inserting after
			 paragraph (1), as redesignated by
			 <internal-xref idref="id66059D4191B147A1BD1D3B9D2B3A6417"> subsection
			 (d)(1)</internal-xref> of this section, the following new paragraph (2):</text>
					<quoted-block display-inline="no-display-inline" id="id5caa0316-a124-410e-9f08-5b4674236914" style="OLC">
						<paragraph id="id274b4cf0-dc8e-44a9-9510-afbf13249cd1" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id46cb502a-454f-4007-890f-2f2aa28af8bd"><enum>(A)</enum><text>The Secretary, upon
				the Secretary's own motion or at the request of the claimant, may review a fee
				agreement filed pursuant to paragraph (1) and may order a reduction in the fee
				called for in the agreement if the Secretary finds that the fee is excessive or
				unreasonable.</text>
							</subparagraph><subparagraph changed="added" committee-id="SSVA00" id="idba690eb2-e6d5-476b-949f-b88f05f0babd" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>A finding or order of the
				Secretary under subparagraph (A) may be reviewed by the Board of Veterans'
				Appeals under section 7104 of this
				title.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection changed="added" committee-id="SSVA00" id="id22109738-a26f-445d-9cfc-23f8eb3208eb" reported-display-style="italic"><enum>(f)</enum><header>Repeal of penalty for
			 certain acts</header><text>Section 5905 of such title is amended by striking
			 <quote>(1)</quote> and all that follows through <quote>(2)</quote>.</text>

			 amendments made by this section shall take effect six months after the date of
			 the enactment of this Act.</text>
					</paragraph><paragraph id="id59e1b142-cbed-416a-91d0-5d551b1dbf22"><enum>(2)</enum><header>Regulations</header><text>The
			 Secretary shall prescribe the regulations, if any, to be prescribed under the
			 amendments made by <internal-xref idref="idD430AEA8AB524F67BF5C4F52A18F7F4D">
			 subsection (a)</internal-xref> not later than the date specified in
			 <internal-xref idref="id3C0C5CDA94484CEA8198E33540AB4212"> paragraph
			 (1)</internal-xref>.</text>

			 amendments made by subsections (b), (c), (d), and (e) shall apply to claims

			 organizations for grants for the establishment of veterans cemeteries on trust
			 lands</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/2408">Section 2408</external-xref> of
			 title 38, United States Code, is amended by adding at the end the following new
			 subsection:</text>

			 of Russell Wayne Wagner from Arlington National Cemetery</header>
				<subsection changed="added" committee-id="SSVA00" id="id799CDE9E2811405592520928DA66F9E8" reported-display-style="italic"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress makes the following
			 findings:</text>
					<paragraph id="IDF529503FCEE342FA8073EB860D4730FD"><enum>(1)</enum><text>Arlington National Cemetery is a
			 National Shrine that memorializes the honorable service of men and women who
			 have defended the freedoms that all the people of the United States
			 enjoy.</text>
					</paragraph><paragraph id="IDF9D40A18AC5A4834A382FF11618530B3"><enum>(2)</enum><text>The
			 inclusion among the honored dead of the remains of persons who have committed
			 particularly notorious, heinous acts brings dishonor to the deceased and
			 disrespect to their loved ones.</text>
					</paragraph><paragraph id="ID020C175A51B54B54B16A2A866FCBA0A4"><enum>(3)</enum><text>The
			 removal of the remains of a person who has committed a heinous act would not be
			 an act of punishment against that person, but rather an act that would preserve
			 the sacredness of cemetery grounds.</text>
					</paragraph><paragraph id="idA011C623121E4E68947BF1621418769E"><enum>(4)</enum><text>In
			 November of 1997, section 2411 of title 38, United States Code, was enacted to,
			 among other things, deny burial eligibility in Arlington National Cemetery to
			 any person convicted of a State capital crime for which the person was
			 sentenced to death or life imprisonment without parole. In January of 2006,
			 section 2411 of such title was amended by section 662 of the National Defense
			 Authorization Act for Fiscal Year 2006 (Public Law 109–163) to remove parole
			 eligibility as a loophole through which convicted capital offenders could
			 retain eligibility for interment at Arlington National Cemetery.</text>
					</paragraph><paragraph id="idFB13A044CB4A4300946D756EE80FC8DC"><enum>(5)</enum><text>According to Arlington National
			 Cemetery officials, the remains of only one capital offender, Russell Wayne
			 Wagner, have been interred in Arlington National Cemetery since November of
			 1997.</text>
					</paragraph></subsection><subsection changed="added" committee-id="SSVA00" id="IDB893070D13554A1C835C30A89B2E55C4" reported-display-style="italic"><enum>(b)</enum><header>Removal of
			 remains</header>
					<paragraph changed="added" committee-id="SSVA00" id="IDF51C2C8511894D939D577C440A00AF62" reported-display-style="italic"><enum>(1)</enum><header>Removal</header><text>The
			 Secretary of the Army shall remove the remains of Russell Wayne Wagner from
			 Arlington National Cemetery.</text>
					</paragraph><paragraph changed="added" committee-id="SSVA00" id="ID98E8207F79E24109BF6E9258C1D65035" reported-display-style="italic"><enum>(2)</enum><header>Notification of
			 Next-of-Kin</header><text>The Secretary of the Army shall—</text>
						<subparagraph id="ID6C8DFEA7DF1B4EB6976AF40E740AD38F"><enum>(A)</enum><text>notify the next-of-kin of record
			 for Russell Wayne Wagner of the impending removal of his remains; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1CAC82514D114BD4954BF9A48A82EF7B"><enum>(B)</enum><text>upon removal, relinquish the
			 remains to the next-of-kin of record for Russell Wayne Wagner or, if the

			 appropriate disposition of the remains.</text>

				eligible person, be paid on an accelerated basis in accordance with this
				section.</text>

				described in this subsection is an individual who is—</text>

				either—</text>

				education that leads to employment in a high technology occupation in a high
				technology industry (as determined pursuant to regulations prescribed by the
				Secretary); or</text>
									</subparagraph><subparagraph changed="added" committee-id="SSVA00" id="id838637A2CB5243C7B4A474BE92E1A8C8" reported-display-style="italic"><enum>(B)</enum><text>an approved program of
				education lasting less than two years that (as so determined) leads to

				economy;</text>

				and</text>
										</clause></subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="ID19c8acda32d2432991aa39e87861d28d" reported-display-style="italic"><enum>(2)</enum><text>charged tuition and fees
				for the program of education that, when divided by the number of months (and
				fractions thereof) in the enrollment period, exceeds the amount equal to 200
				percent of the monthly rate of educational assistance allowance otherwise
				payable with respect to the individual under section 3531 of this title.</text>
								</paragraph></subsection><subsection changed="added" committee-id="SSVA00" id="ID8c30b30aff3a4da2a8fb499d850f996e" reported-display-style="italic"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id3EAB885CD0A6431DA1DD236650A3795B"><enum>(1)</enum><text>The amount of the
				accelerated payment of educational assistance payable with respect to an
				eligible person making an election under subsection (a) for a program of
				education shall be the lesser of—</text>
									<subparagraph changed="added" committee-id="SSVA00" id="IDf53690ddda46415797ac50cd1c107724" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>the amount equal to 60
				percent of the established charges for the program of education; or</text>
									</subparagraph><subparagraph changed="added" committee-id="SSVA00" id="IDe327053e1f81431595ca57fb5914d090" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>the aggregate amount of
				educational assistance allowance to which the individual remains entitled under
				this chapter at the time of the payment.</text>
									</subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="IDbf8021d6512d4e908e4c1017db56e095" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>In this subsection, the
				term <quote>established charges</quote>, in the case of a program of education,
				means the actual charges (as determined pursuant to regulations prescribed by
				the Secretary) for tuition and fees which similarly circumstanced nonveterans
				enrolled in the program of education would be required to pay. Established
				charges shall be determined on the following basis:</text>
									<subparagraph id="ID1f3ba091ebb24319b880e30c7704915b"><enum>(A)</enum><text>In
				the case of an individual enrolled in a program of education offered on a term,
				quarter, or semester basis, the tuition and fees charged the individual for the
				term, quarter, or semester.</text>
									</subparagraph><subparagraph id="ID0e5f152c034d4c8cbce409771d150b72"><enum>(B)</enum><text>In
				the case of an individual enrolled in a program of education not offered on a
				term, quarter, or semester basis, the tuition and fees charged the individual
				for the entire program of education.</text>
									</subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="ID8dc6fe31789140b89dae9e6104f42012" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>The educational
				institution providing the program of education for which an accelerated payment
				of educational assistance allowance is elected by an eligible person under
				subsection (a) shall certify to the Secretary the amount of the established
				charges for the program of education.</text>
								</paragraph></subsection><subsection changed="added" committee-id="SSVA00" id="IDf4c8be3d32bf458ca8cab14171f26128" reported-display-style="italic"><enum>(d)</enum><text>An accelerated payment of
				educational assistance allowance made with respect to an eligible person under
				this section for a program of education shall be made not later than the last
				day of the month immediately following the month in which the Secretary
				receives a certification from the educational institution regarding—</text>
								<paragraph id="ID02b160d31e5c40a2bb111d441e3d71aa"><enum>(1)</enum><text>the
				person’s enrollment in and pursuit of the program of education; and</text>
								</paragraph><paragraph id="ID656f67e14fb74f5c873b5958953b44a5"><enum>(2)</enum><text>the
				amount of the established charges for the program of education.</text>
								</paragraph></subsection><subsection changed="added" committee-id="SSVA00" id="ID3a919d3e68bf4513beaf05e0a3f9a29f" reported-display-style="italic"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idB192461214014B9E8D413AC9CC83AE4F"><enum>(1)</enum><text>Except as provided in
				paragraph (2), for each accelerated payment of educational assistance allowance
				made with respect to an eligible person under this section, the person's
				entitlement to educational assistance under this chapter shall be charged the
				number of months (and any fraction thereof) determined by dividing the amount
				of the accelerated payment by the full-time monthly rate of educational
				assistance allowance otherwise payable with respect to the person under section
				3531 of this title as of the beginning date of the enrollment period for the
				program of education for which the accelerated payment is made.</text>
								</paragraph><paragraph id="ID4db084b168c048cba6ca8719df7e2818" indent="up1"><enum>(2)</enum><text>If the monthly rate of educational
				assistance allowance otherwise payable with respect to an eligible person under
				section 3531 of this title increases during the enrollment period of a program
				of education for which an accelerated payment of educational assistance
				allowance is made under this section, the charge to the person's entitlement to
				educational assistance under this chapter shall be determined by prorating the
				entitlement chargeable, in the manner provided for under paragraph (1), for the
				periods covered by the initial rate and increased rate, respectively, in
				accordance with regulations prescribed by the Secretary.</text>
								</paragraph></subsection><subsection changed="added" committee-id="SSVA00" id="ID09b0a5511fa743a79e21efa683e07296" reported-display-style="italic"><enum>(f)</enum><text>The Secretary may not
				make an accelerated payment of educational assistance allowance under this
				section for a program of education with respect to an eligible person who has
				received an advance payment under section 3680(d) of this title for the same
				enrollment period.</text>
							</subsection><subsection changed="added" committee-id="SSVA00" id="ID0bd27437e23b43b4b8ba60b8992f11dd" reported-display-style="italic"><enum>(g)</enum><text>The Secretary shall
				prescribe regulations to carry out this section. The regulations shall include
				requirements, conditions, and methods for the request, issuance, delivery,
				certification of receipt and use, and recovery of overpayment of an accelerated
				payment of educational assistance allowance under this section. The regulations
				may include such elements of the regulations prescribed under section 3014A of
				this title as the Secretary considers appropriate for purposes of this
				section.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				facilities as the locations for Multiple Sclerosis Centers of Excellence
				(subject to the appropriation of sufficient funds for such purpose); and</text>
										</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id890DC45DAB0D49BCA2461BB5E1CC266C" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">establish and operate such centers at such
				locations in accordance with this section.</text>
									</paragraph></subsection><subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="HFEC6ABB816334F83B690AC339B7D94DE" reported-display-style="italic"><enum>(b)</enum><header>Existing facilities;
				geographic distribution</header><text display-inline="yes-display-inline">In
				designating locations for centers under subsection (a), the Secretary, upon the
				recommendation of the Under Secretary for Health, shall—</text>
									<paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="H7B0299B1FA7B4BB6BACC7831EE375212" reported-display-style="italic"><enum>(1)</enum><text display-inline="yes-display-inline">designate each Department health care
				facility that, as of January 1, 2005, was operating a Parkinson’s Disease
				Research, Education, and Clinical Center or a Multiple Sclerosis Center of
				Excellence unless the Secretary, on the recommendation of the Under Secretary
				for Health, determines that such facility—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="idFF38BE94B29C4185B908057F08894F9F"><enum>(A)</enum><text display-inline="yes-display-inline">does not meet the requirements of
				subsection (c);</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id20B150F0D5334A1FA82E6C467EA57391"><enum>(B)</enum><text display-inline="yes-display-inline">has not demonstrated effectiveness in
				carrying out the established purposes of such center; or</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF5C29D6B5E8F4047B37984431FB56451"><enum>(C)</enum><text display-inline="yes-display-inline">has not demonstrated the potential to carry
				out such purposes effectively in the reasonably foreseeable future; and</text>
										</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="HFD915FB3A6864D37BC8E54B16BCF3C4C" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">assure appropriate geographic distribution
				of such facilities.</text>
									</paragraph></subsection><subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="H5A86A70CBCE04E0EB1F44F697B3CFFE" reported-display-style="italic"><enum>(c)</enum><header>Minimum
				requirements</header><text display-inline="yes-display-inline">The Secretary
				may not designate a health care facility as a location for a center under
				subsection (a) unless—</text>
									<paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idE6F75DAA4E85412A96C83351666C08FA" reported-display-style="italic"><enum>(1)</enum><text display-inline="yes-display-inline">the peer review panel established under
				subsection (d) determines that the proposal submitted by such facility is among
				those proposals which meet the highest competitive standards of scientific and
				clinical merit; and</text>
									</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id8447A1B35C3F42879006901EFFEFEC54" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary, upon the recommendation of
				the Under Secretary for Health, determines that the facility has (or may
				reasonably be anticipated to develop)—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="HC9ADF2CC74634B8C996EE3C9EB3CD031"><enum>(A)</enum><text display-inline="yes-display-inline">an arrangement with an accredited medical
				school which provides education and training in neurology and with which such
				facility is affiliated under which residents receive education and training in
				innovative diagnosis and treatment of chronic neurodegenerative diseases and
				movement disorders, including Parkinson’s disease, or in the case of Multiple
				Sclerosis Centers, multiple sclerosis disease;</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB860E661421F4C1000CE7DE615DE700"><enum>(B)</enum><text display-inline="yes-display-inline">the ability to attract the participation of
				scientists who are capable of ingenuity and creativity in health-care research
				efforts;</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEF4E1AE4014C4E29004F00A22C844E80"><enum>(C)</enum><text display-inline="yes-display-inline">a policymaking advisory committee composed
				of consumers and appropriate health care and research representatives of the
				facility and of the affiliated school or schools to advise the directors of
				such facility and such center on policy matters pertaining to the activities of
				such center during the period of the operation of such center;</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF7CCD53C057944B1A4C1DF82D2328188"><enum>(D)</enum><text display-inline="yes-display-inline">the capability to conduct effectively
				evaluations of the activities of such center;</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9609D067BD9943EFB0AD8569559F4FD3"><enum>(E)</enum><text display-inline="yes-display-inline">the capability to coordinate, as part of an
				integrated national system, education, clinical, and research activities within
				all facilities with such centers;</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF97D1CF8489C40BCB80470EF11EF10B0"><enum>(F)</enum><text display-inline="yes-display-inline">the capability to jointly develop a
				consortium of providers with interest in treating neurodegenerative diseases,
				including Parkinson’s disease, and other movement disorders, or multiple
				sclerosis in the case of Multiple Sclerosis Centers, at facilities without such
				centers in order to ensure better access to state of the art diagnosis, care,
				and education for neurodegenerative disorders, or in the case of Multiple
				Sclerosis Centers, autoimmune disease affecting the central nervous system
				throughout the health care system; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H65D20A74AB534B0694D5B8EBF10000FC"><enum>(G)</enum><text display-inline="yes-display-inline">the capability to develop a national
				repository in the health care system for the collection of data on health
				services delivered to veterans seeking care for neurodegenerative diseases,
				including Parkinson’s disease, and other movement disorders, or in the case of
				Multiple Sclerosis Centers, autoimmune disease affecting the central nervous
				system.</text>
										</subparagraph></paragraph></subsection><subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="HBADB6CC927ED4B1E91E63E37001CE294" reported-display-style="italic"><enum>(d)</enum><header>Panel</header><paragraph commented="no" display-inline="yes-display-inline" id="H3FF0A1A8B5E44C46BA7BE4B2D8227551"><enum>(1)</enum><text display-inline="yes-display-inline">The Under Secretary for Health shall
				establish a panel to assess the scientific and clinical merit of proposals that
				are submitted to the Secretary for the establishment of new centers under this
				section.</text>
									</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="HDB21AB1524C14677887111321135DBD" indent="up1" reported-display-style="italic"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HA6DA22775C034B4FB2E0B2766FD27133"><enum>(A)</enum><text display-inline="yes-display-inline">The membership of the panel shall consist
				of experts in neurodegenerative diseases, including Parkinson’s disease and
				other movement disorders, and, in the case of Multiple Sclerosis Centers,
				experts in autoimmune disease affecting the central nervous system.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H23DB120BF6CC4BCB9338E016762C5B86" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Members of the panel shall serve as
				consultants to the Department for a period of no longer than 2 years except in
				the case of panelists asked to serve on the initial panel as specified in
				subparagraph (C).</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE466B521ABEF4984854B01C218E4C51" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">In order to ensure panel continuity, half
				of the members of the first panel shall be appointed for a period of 3 years
				and half for a period of 2 years.</text>
										</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="HB66DEB37B7674F9F8FD803001E1E39D8" indent="up1" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">The panel shall review each proposal
				submitted to the panel by the Under Secretary and shall submit its views on the
				relative scientific and clinical merit of each such proposal to the Under
				Secretary.</text>
									</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="HB07C81E292914F8A8E77E67D000280D4" indent="up1" reported-display-style="italic"><enum>(4)</enum><text display-inline="yes-display-inline">The panel shall not be subject to the
				Federal Advisory Committee Act.</text>
									</paragraph></subsection><subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="H20408DBB266C4018AFCE8E009BFC9FB1" reported-display-style="italic"><enum>(e)</enum><header>Adequate
				funding</header><text display-inline="yes-display-inline">Before providing
				funds for the operation of any such center at a health care facility other than
				a health care facility designated under subsection (b)(1), the Secretary shall
				ensure that—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="idA90B1A01BB9C4DE99C2302AE5F798AF6"><enum>(1)</enum><text display-inline="yes-display-inline">the Parkinson's disease center at each
				facility designated under subsection (b)(1) is receiving adequate funding to
				enable such center to function effectively in the areas of Parkinson’s disease
				research, education, and clinical activities; and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7017498177E446109C45A7649A26E237"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a new Multiple Sclerosis
				Center, that existing centers are receiving adequate funding to enable such
				centers to function effectively in the areas of multiple sclerosis research,
				education, and clinical activities.</text>
									</paragraph></subsection><subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="H5B76D5D88E004198AEA0FCA09CDEE2E1" reported-display-style="italic"><enum>(f)</enum><header>Authorization of
				appropriations</header><paragraph commented="no" display-inline="yes-display-inline" id="id9D9A1A774DED4E139F028841763EC271"><enum>(1)</enum><text display-inline="yes-display-inline">There are authorized to be appropriated
				such sums as may be necessary for the support of the research and education
				activities of the centers established under subsection (a).</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2057874F8A0E4BE7A798A1F11E18EED9" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Under Secretary for Health shall
				allocate to such centers from other funds appropriated generally for the
				Department medical services account and medical and prosthetics research
				account, as appropriate, such amounts as the Under Secretary for Health
				determines appropriate.</text>
									</paragraph></subsection><subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="H984DEC323A50412E9112F5F233005312" reported-display-style="italic"><enum>(g)</enum><header>Funding eligibility and
				priority for Parkinson's disease research</header><text display-inline="yes-display-inline">Activities of clinical and scientific
				investigation at each center established under subsection (a) for Parkinson's
				disease shall—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="id93B92C81D41445C78D6E5F05B1911DA9"><enum>(1)</enum><text display-inline="yes-display-inline">be eligible to compete for the award of
				funding from funds appropriated for the Department medical and prosthetics
				research account; and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1B960F54A39547829E74234222CCB3D9"><enum>(2)</enum><text display-inline="yes-display-inline">receive priority in the award of funding
				from such account to the extent funds are awarded to projects for research in
				Parkinson's disease and other movement disorders.</text>
									</paragraph></subsection><subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id4EBB8B34516449E29E176D71BB538B9A" reported-display-style="italic"><enum>(h)</enum><header>Funding eligibility and
				priority for multiple sclerosis research</header><text display-inline="yes-display-inline">Activities of clinical and scientific
				investigation at each center established under subsection (a) for multiple
				sclerosis shall—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="id93DE7B9AB72440F6B0C8689E10E6B8FB"><enum>(1)</enum><text display-inline="yes-display-inline">be eligible to compete for the award of
				funding from funds appropriated for the Department medical and prosthetics
				research account; and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1D5ED944C8744E499DD909CEC6E831EE"><enum>(2)</enum><text display-inline="yes-display-inline">receive priority in the award of funding
				from such account to the extent funds are awarded to projects for research in
				multiple sclerosis and other movement
				disorders.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="H1B3BE519C7584AC4837F5E00CD53AB1E" reported-display-style="italic"><enum>(2)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of chapter 73 of title 38, United States Code, is
			 amended by inserting after the item relating to section 7328 the following new

			 United States Code, is amended by adding at the end the following new
			 section:</text>

								<subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="ID0563c47ab01342faafd496d2e48574a7" reported-display-style="italic"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idE35E4C0979954FF8B523213B664ED591"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall pay each State home for
				nursing home care at the rate determined under paragraph (2), where such care
				is provided to any veteran as follows:</text>
										<subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id743035C3EAFB49D88A86D3505388417C" indent="up1" reported-display-style="italic"><enum>(A)</enum><text display-inline="yes-display-inline">Any veteran in need of such care for a
				service-connected disability.</text>
										</subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id6F7036E857834655A898F581773838FB" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">Any veteran who—</text>
											<clause commented="no" display-inline="no-display-inline" id="idF456CE268BF04C00A8D1E2BE0869608D"><enum>(i)</enum><text display-inline="yes-display-inline">has a service-connected disability rated at
				70 percent or more; and</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="idFE1685670E5C4639BB04A4EF97F58617"><enum>(ii)</enum><text display-inline="yes-display-inline">is in need of such care.</text>
											</clause></subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id6C279DC79CB342E19D44307AF3186E7D" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">The rate determined under this paragraph
				with respect to a State home is the lesser of—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="idCE5982B1C3BC4675BCEE3734146F6C42"><enum>(A)</enum><text display-inline="yes-display-inline">the applicable or prevailing rate payable
				in the geographic area in which the State home is located, as determined by the
				Secretary, for nursing home care furnished in a non-Department nursing home (as
				that term is defined in section 1720(e)(2)); or</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFE6C0B9A9BF44F77884E30ABBA0CA751"><enum>(B)</enum><text>a
				rate not to exceed the daily cost of care, as determined by the Secretary,
				following a report to the Secretary by the director of the State home.</text>
										</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idB1A3389E72174E56BB36FCD5C7AEC8FB" indent="up1" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">Payment by the Secretary under paragraph
				(1) to a State home for nursing home care provided to a veteran described in
				that paragraph constitutes payment in full to the State home for such care
				furnished to that
				veteran.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="ID2f6b27765cc54728a71fba3117e1ec05" reported-display-style="italic"><enum>(2)</enum><header>Provision of
			 prescription medicines</header><text display-inline="yes-display-inline">Such
			 section, as so added, is further amended by adding at the end the following new
			 subsection:</text>
						<quoted-block committee-id="SSVA00" display-inline="no-display-inline" id="idD443211DEE1244FB8C41E7580FC8D1AB" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="IDfb9c8049b20542c9a3c5b7d77f498bac"><enum>(b)</enum><text display-inline="yes-display-inline">The Secretary shall furnish such drugs and
				medicines as may be ordered on prescription of a duly licensed physician as
				specific therapy in the treatment of illness or injury to any veteran as
				follows:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="IDbe2c3e24d71942f3a13042a2f25d1b9e"><enum>(1)</enum><text display-inline="yes-display-inline">Any veteran who—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id16258BD8DAE5431EAFA796020A21EB49"><enum>(A)</enum><text display-inline="yes-display-inline">is not being provided nursing home care for
				which payment is payable under subsection (a); and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8CB298431AF04596AB77D0EE59F16937"><enum>(B)</enum><text display-inline="yes-display-inline">is in need of such drugs and medicines for
				a service-connected disability.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID31f3a61c303948fc9fa128adf59e1c93"><enum>(2)</enum><text display-inline="yes-display-inline">Any veteran who—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idA1674CAF7F1140768FF1D77F6C89740B"><enum>(A)</enum><text display-inline="yes-display-inline">has a service-connected disability rated at
				50 percent or more;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8F53CF5873694E729D469C05F33DE957"><enum>(B)</enum><text display-inline="yes-display-inline">is not being provided nursing home care for
				which payment is payable under subsection (a); and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id169B7744AF934DDF947EF1302E3595FB"><enum>(C)</enum><text display-inline="yes-display-inline">is in need of such drugs and
				medicines.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id396B6A8E4C7A41879B758F139E879F60" reported-display-style="italic"><enum>(3)</enum><header>Conforming

			 United States Code, is amended by adding at the end the following new
			 section:</text>

				certain health facilities as State homes</header>
								<subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="ID7fdc7a55ede447dd99cb6b6c0293f8a8" reported-display-style="italic"><enum>(a)</enum><text display-inline="yes-display-inline">The Secretary may treat a health facility,
				or certain beds in a health facility, as a State home for purposes of
				subchapter V of chapter 17 of this title if the following requirements are
				met:</text>
									<paragraph commented="no" display-inline="no-display-inline" id="ID1d6115913daf41cba2dd191475d97eac"><enum>(1)</enum><text display-inline="yes-display-inline">The facility, or certain beds in such
				facility, meets the standards for the provision of nursing home care that is
				applicable to State homes, as prescribed by the Secretary under section 8134(b)
				of this title, and such other standards relating to the facility, or certain
				beds in such facility, as the Secretary may require.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3be0c3318e9b479fb9a580cffe15afd4"><enum>(2)</enum><text display-inline="yes-display-inline">The facility, or certain beds in such
				facility, is licensed or certified by the appropriate State and local agencies
				charged with the responsibility of licensing or otherwise regulating or
				inspecting State home facilities.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID44e9c3e5bde241bb9d679a4fa7e702d1"><enum>(3)</enum><text display-inline="yes-display-inline">The State demonstrates in an application to
				the Secretary that, but for the treatment of a facility (or certain beds in
				such facility), as a State home under this subsection, a substantial number of
				veterans residing in the geographic area in which the facility is located who
				require nursing home care will not have access to such care.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1b41717c774b4c7faf16db1255f29cbc"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary determines that the treatment
				of the facility, or certain beds in such facility, as a State home best meets
				the needs of veterans for nursing home care in the geographic area in which the
				facility is located.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe0d9b2b1cc524eb79ee72f41aba04aca"><enum>(5)</enum><text display-inline="yes-display-inline">The Secretary approves the application
				submitted by the State with respect to the facility, or certain beds in such
				facility.</text>
									</paragraph></subsection><subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="IDffb45198c12a47f4b29f8c62cd8d0e5b" reported-display-style="italic"><enum>(b)</enum><text display-inline="yes-display-inline">The Secretary may not treat a health
				facility, or certain beds in a health facility, as a State home under
				subsection (a) if the Secretary determines that such treatment would increase
				the number of beds allocated to the State in excess of the limit on the number
				of beds provided for by regulations prescribed under section 8134(a) of this
				title.</text>
								</subsection><subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="IDa3344a63256a4d1dbaf758302c5ae33a" reported-display-style="italic"><enum>(c)</enum><text display-inline="yes-display-inline">The number of beds occupied by veterans in
				a health facility for which payment may be made under subchapter V of chapter
				17 of this title by reason of subsection (a) shall not exceed—</text>
									<paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idFA66ED0EC3AF406B85CC3BE730896E9E" reported-display-style="italic"><enum>(1)</enum><text display-inline="yes-display-inline">100 beds in the aggregate for all States;
				and</text>
									</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idB8EEE71497CE410A93C9BAFB6D116C76" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of any State, the difference
				between—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="id3F5EFC0C88D244E38D83622F77A49644"><enum>(A)</enum><text display-inline="yes-display-inline">the number of veterans authorized to be in
				beds in State homes in such State under regulations prescribed under section
				8134(a) of this title; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3A1212AE15134B9E9F564ADBAED4BF5D"><enum>(B)</enum><text display-inline="yes-display-inline">the number of veterans actually in beds in
				State homes (other than facilities or certain beds treated as State homes under
				subsection (a)) in such State under regulations prescribed under such
				section.</text>
										</subparagraph></paragraph></subsection><subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="IDdb0ce602e5764e95bdaa06888e89d752" reported-display-style="italic"><enum>(d)</enum><text display-inline="yes-display-inline">The number of beds in a health facility in
				a State that has been treated as a State home under subsection (a) shall be
				taken into account in determining the unmet need for beds for State homes for
				the State under section 8134(d)(1) of this title.</text>
								</subsection><subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idE97BD6112EAF4D6EAC0ACB84A653F75A" reported-display-style="italic"><enum>(e)</enum><text display-inline="yes-display-inline">The Secretary may not treat any new health
				facilities, or any new certain beds in a health facility, as a State home under
				subsection (a) after September 30,
				2009.</text>

			 Health</header>
				<subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idB8154E8EF6954572B3C3C22934D0552B" reported-display-style="italic"><enum>(a)</enum><header>Establishment</header><text>There
			 is established in the Department of Veterans Affairs within the Office of the
			 Undersecretary for Health an office to be known as the <quote>Office of Rural
			 Health</quote> (in this section referred to as the
			 <quote>Office</quote>).</text>
				</subsection><subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id99C023BEC7844563A17DC1503E3F3E02" reported-display-style="italic"><enum>(b)</enum><header>Head</header><text>The
			 Director of the Office of Rural Health shall be the head of the Office. The
			 Director of the Office of Rural Health shall be appointed by the Under
			 Secretary of Health from among individuals qualified to perform the duties of
			 the position.</text>
				</subsection><subsection changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idF0750675201349FEB32448E6E7D554F2" reported-display-style="italic"><enum>(c)</enum><header>Functions</header><text>The
			 functions of the Office are as follows:</text>
					<paragraph id="ID2250c0b08e7445c0b66ab14f0764d758"><enum>(1)</enum><text>In
			 cooperation with the medical, rehabilitation, health services, and cooperative
			 studies research programs in the Office of Policy and the Office of Research
			 and Development of the Veterans Health Administration, to assist the Under
			 Secretary for Health in conducting, coordinating, promoting, and disseminating
			 research into issues affecting veterans living in rural areas.</text>
					</paragraph><paragraph id="ID3d9109a742d343448dcf5c60f4f0906e"><enum>(2)</enum><text>To
			 work with all personnel and offices of the Department of Veterans Affairs to
			 develop, refine, and promulgate policies, best practices, lessons learned, and
			 innovative and successful programs to improve care and services for veterans
			 who reside in rural areas of the United States.</text>
					</paragraph><paragraph id="idDF74537D5AB2437C978D2816748C70B7"><enum>(3)</enum><text>To
			 designate in each Veterans Integrated Service Network (VISN) an individual who
			 shall consult on and coordinate the discharge in such Network of programs and
			 activities of the Office for veterans who reside in rural areas of the United
			 States.</text>
					</paragraph><paragraph id="id0968AA61078D48798A5535B590F58F10"><enum>(4)</enum><text>To
			 assess, in accordance with subsection (d), the effects of the implementation of
			 the fee-basis health care program of the Veterans Health Administration on the
			 delivery of health care services to veterans who reside in rural areas of the
			 United States.</text>
					</paragraph><paragraph id="IDb10a52f950f648f1807bf5d346478835"><enum>(5)</enum><text>To
			 perform such other functions and duties as the Secretary of Veterans Affairs or
			 the Under Secretary for Health consider appropriate.</text>
					</paragraph></subsection><subsection changed="added" committee-id="SSVA00" id="id402F4DB2D8B145FFABFDF1D528D7FB59" reported-display-style="italic"><enum>(d)</enum><header>Assessment of Fee-Basis
			 Health Care Program</header><text>The Director of the Office shall, in
			 consultation with the individuals designated under subsection (c)(3), conduct
			 an assessment of the effects of the implementation of the fee-basis health care
			 program of the Veterans Health Administration on the delivery of health care
			 services to veterans who reside in rural areas of the United States. In
			 conducting the assessment, the Director shall—</text>
					<paragraph id="idB05EE44143A449BA9B53AF82C52F04B5"><enum>(1)</enum><text>evaluate the effects of the
			 fee-basis health care program on the delivery of health care services to
			 veterans who reside in rural areas of the United States;</text>
					</paragraph><paragraph id="idABFC7E7A8DC243AF8DAE763325E76120"><enum>(2)</enum><text>identify various mechanisms for
			 expanding the program in order to enhance and improve health care services for
			 such veterans and determine the feasibility and advisability of implementing
			 such mechanisms; and</text>
					</paragraph><paragraph id="id97A4042282C74779B561A28F1D8A0335"><enum>(3)</enum><text>for
			 each mechanism determined under paragraph (2) to be feasible and advisable to
			 implement, make recommendations to the Under Secretary for Health on the
			 implementation of such mechanism.</text>
					</paragraph></subsection></section><section changed="added" committee-id="SSVA00" id="idE11A0824057241669B58AAAE775B488F" reported-display-style="italic" section-type="subsequent-section"><enum>405.</enum><header>Pilot program on
			 improvement of caregiver assistance services</header>
				<subsection changed="added" committee-id="SSVA00" id="id12355D834942428B8A5ED6CD29CADCA2" reported-display-style="italic"><enum>(a)</enum><header>In
			 general</header><text>Commencing not later than 120 days after the date of the
			 enactment of this Act, the Secretary of Veterans Affairs shall carry out a
			 pilot program to assess the feasibility and advisability of various mechanisms
			 to expand and improve caregiver assistance services.</text>
				</subsection><subsection changed="added" committee-id="SSVA00" id="idC3BEC58BA9E64851994E28CA20B97A3C" reported-display-style="italic"><enum>(b)</enum><header>Duration of pilot
			 program</header><text>The pilot program required by subsection (a) shall be
			 carried out during the two-year period beginning on the date of the
			 commencement of the pilot program.</text>
				</subsection><subsection changed="added" committee-id="SSVA00" id="id64F2A6B00BDE4BC1A764B08343068462" reported-display-style="italic"><enum>(c)</enum><header>Caregiver assistance
			 services</header><text>For purposes of this section, the term <term>caregiver
			 assistance services</term> are services of the Department of Veterans Affairs
			 that assist caregivers of veterans, including veterans of the Global War on
			 Terrorism. Such services including the following:</text>
					<paragraph id="idE692B0BAD7404F59A2F28209FEFC7B9B"><enum>(1)</enum><text>Adult-day health care
			 services.</text>
					</paragraph><paragraph id="id9F872F617F1F483289DE9EDC5099A203"><enum>(2)</enum><text>Coordination of services needed by
			 veterans, including services for readjustment and rehabilitation.</text>
					</paragraph><paragraph id="id50E81F7F4B9145D6838105A3A0C6C60E"><enum>(3)</enum><text>Transportation services.</text>
					</paragraph><paragraph id="id325D4D8E0FC94CDC8E92FACF84FFCF72"><enum>(4)</enum><text>Caregiver support services,
			 including education, training, and certification of family members in caregiver
			 activities.</text>
					</paragraph><paragraph id="id1D1FC8237AE04115AB4AAA75988B0142"><enum>(5)</enum><text>Home care services.</text>
					</paragraph><paragraph id="idBC0EF9E4A56C4F6D85A5A3DC68F452F7"><enum>(6)</enum><text>Respite care.</text>
					</paragraph><paragraph id="id772771EE27D943568D61258004C7D432"><enum>(7)</enum><text>Hospice services.</text>
					</paragraph><paragraph id="id299D6A7AB2EF4EA58103D9A0491A33D4"><enum>(8)</enum><text>Any
			 modalities of non-institutional long-term care.</text>
					</paragraph></subsection><subsection changed="added" committee-id="SSVA00" id="id916BDE26C52C498F9741943D682F8DEF" reported-display-style="italic"><enum>(d)</enum><header>Funding</header>
					<paragraph id="idCD7459252E9F4098BB5A60F70687F251"><enum>(1)</enum><header>Source of funds</header><text>In
			 carrying out the program required by
			 <internal-xref idref="id12355D834942428B8A5ED6CD29CADCA2"> subsection
			 (a)</internal-xref>, the Secretary shall identify, from funds available to the
			 Department of Veterans Affairs for medical care, an amount not less than
			 $5,000,000 to be available for the fiscal year that includes the date of the
			 enactment of this Act, to carry out the pilot program and to be allocated to
			 facilities of the Department pursuant to
			 <internal-xref idref="idA716F0E7F5B140BD8D2F7E375DC43112"> subsection
			 (e)</internal-xref>. Such amount shall be available without fiscal year
			 limitation.</text>
					</paragraph><paragraph id="idD54816CD9CDD426DBE0393FD592066A2"><enum>(2)</enum><header>Minimum allocation of
			 funds</header><text>In identifying available amounts pursuant to
			 <internal-xref idref="idCD7459252E9F4098BB5A60F70687F251"> paragraph
			 (1)</internal-xref>, the Secretary shall ensure that, after the allocation of
			 funds under<internal-xref idref="idA716F0E7F5B140BD8D2F7E375DC43112">
			 subsection (e)</internal-xref>, the total expenditure for programs in support
			 of caregiver assistance services is not less than $5,000,000 in excess of the
			 baseline amount.</text>
					</paragraph><paragraph id="id67E2AFC351FD4515A1716FB6FACAAFC1"><enum>(3)</enum><header>Baseline amount</header><text>For
			 purposes of <internal-xref idref="idD54816CD9CDD426DBE0393FD592066A2">
			 paragraph (2)</internal-xref>, the baseline amount is the amount of the total
			 expenditures on programs in support of caregiver assistance services for
			 veterans for the most recent fiscal year for which final expenditure amounts
			 are known, adjusted to reflect any subsequent increase in applicable costs to
			 support such services through the Veterans Health Administration.</text>
					</paragraph></subsection><subsection changed="added" committee-id="SSVA00" id="idA716F0E7F5B140BD8D2F7E375DC43112" reported-display-style="italic"><enum>(e)</enum><header>Allocation of funds to
			 Facilities</header><text>The Secretary shall allocate funds identified pursuant
			 to <internal-xref idref="idCD7459252E9F4098BB5A60F70687F251"> subsection
			 (d)(1)</internal-xref> to individual medical facilities of the Department in
			 such amounts as the Secretary determines appropriate, based upon proposals
			 submitted by such facilities for the use of such funds for improvements to the
			 support of the provision of caregiver assistance services. Special
			 consideration should be given to rural facilities, including those without a
			 long-term care facility of the Department.</text>
				</subsection><subsection changed="added" committee-id="SSVA00" id="id150A8196B98349489E7B122951A7F5E0" reported-display-style="italic"><enum>(f)</enum><header>Report</header><text>Not
			 later than one year after the date of the enactment of this Act, the Secretary
			 shall submit to the Committee on Veterans' Affairs of the Senate and the
			 Committee on Veterans' Affairs of the House of Representatives a report on the
			 implementation of this section, including—</text>
					<paragraph id="id7D7CD4753ED14DFF8DCDA1FABF49F8B2"><enum>(1)</enum><text>a
			 description and assessment of the activities carried out under the pilot
			 program;</text>
					</paragraph><paragraph id="id97956EC52C4C47648E48274C4914328F"><enum>(2)</enum><text>information on the allocation of
			 funds to facilities of the Department under
			 <internal-xref idref="idA716F0E7F5B140BD8D2F7E375DC43112"> subsection
			 (d)</internal-xref>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA31E158100354E869E1891B61BE7D807"><enum>(3)</enum><text>a
			 description of the improvements made with funds so allocated to the support of
			 the provision of caregiver assistance services.</text>
					</paragraph></subsection></section></title><title changed="added" committee-id="SSVA00" id="id0019EE127BC34BE98C34A322FBFFE417" reported-display-style="italic"><enum>V</enum><header>Homeless veterans
			 assistance</header>
			<section changed="added" committee-id="SSVA00" id="idD507A66E79144BF99167868AB9635701" reported-display-style="italic"><enum>501.</enum><header>Reaffirmation of
			 National goal to end homelessness among veterans</header>
				<subsection id="id68429DF1143640D8A6CD74EF285C3FA1"><enum>(a)</enum><header>Reaffirmation</header><text>Congress
			 reaffirms the national goal to end chronic homelessness among veterans within a
			 decade of the enactment of the Homeless Veterans Comprehensive Assistance Act
			 of 2001 (Public Law 107–95; 115 Stat. 903).</text>
				</subsection><subsection id="id68E017A327A64439921A2BCE3DA8AD40"><enum>(b)</enum><header>Reaffirmation of encouragement of
			 cooperative efforts</header><text>Congress reaffirms its encouragement, as
			 specified in the Homeless Veterans Comprehensive Assistance Act of 2001 (Public
			 Law 107–95; 115 Stat. 903), that all departments and agencies of the Federal,
			 State, and local governments, quasi-governmental organizations, private and
			 public sector entities, including community-based organizations, faith-based
			 organizations, and individuals, work cooperatively to end chronic homelessness
			 among veterans.</text>
				</subsection></section><section changed="added" committee-id="SSVA00" id="idFF59A497FF96499B8621B3C3A561E11B" reported-display-style="italic"><enum>502.</enum><header>Sense of Congress on
			 the response of the Federal Government to the needs of homeless
			 veterans</header><text display-inline="no-display-inline">It is the sense of
			 Congress that—</text>
				<paragraph id="id08321E0D1AD54B64962F7076AAD2E480"><enum>(1)</enum><text>homelessness is a significant
			 problem in the veterans community, and veterans are disproportionately
			 represented among the homeless population;</text>
				</paragraph><paragraph id="id22BB5BA2ECF14192B3D0543068E86D6B"><enum>(2)</enum><text>while many effective programs
			 assist homeless veterans to become, once again, productive and self-sufficient
			 members of their communities and society, all the essential services,
			 assistance, and support that homeless veterans require are not currently
			 provided;</text>
				</paragraph><paragraph id="idA3CD878B8A3D49319B95EFC4C00C905D"><enum>(3)</enum><text>federally funded programs for
			 homeless veterans should be held accountable for achieving clearly defined
			 results;</text>
				</paragraph><paragraph id="id86AC73EFBC24477ABC381BEEAFADF8D0"><enum>(4)</enum><text>Federal efforts to assist homeless
			 veterans should include prevention of homelessness;</text>
				</paragraph><paragraph id="id2C58B47EC6D44BADA6F3F3B20543BB4C"><enum>(5)</enum><text>Federal efforts regarding homeless
			 veterans should be particularly vigorous where women veterans have minor
			 children in their care;</text>
				</paragraph><paragraph id="id7F24FC2D1E644527BFA5488D07F67BB1"><enum>(6)</enum><text>Federal agencies, particularly the
			 Department of Veterans Affairs, the Department of Labor, and the Department of
			 Housing and Urban Development, should cooperate more fully to address the
			 problem of homelessness among veterans; and</text>
				</paragraph><paragraph id="id6FE88E72F7C44FF6BBD979873723B68D"><enum>(7)</enum><text>the
			 programs reauthorized by this title provide important housing and services to
			 homeless veterans.</text>

				</subsection><subsection changed="added" committee-id="SSVA00" id="id63369E73022C4083B255A2B924347E6E" reported-display-style="italic"><enum>(c)</enum><header>Study of effectiveness
			 of vouchers</header>
					<paragraph changed="added" committee-id="SSVA00" id="idDAB8CEE753EB4F76BC3D595285BD4B13" reported-display-style="italic"><enum>(1)</enum><header>In
			 general</header><text>For fiscal years 2007 and 2008, the Secretary of Veterans
			 Affairs shall conduct a study of the effectiveness of the voucher program under
			 section (8)(o)(19)(B) of the United States Housing Act of 1937 (42 U.S.C.
			 1437f(o)(19)(B)), as amended by subsection (a), in meeting the housing and case
			 management needs of homeless veterans who—</text>
						<subparagraph id="idB2A5D37F5A2F4D5AACBA2D793504FF7D"><enum>(A)</enum><text>have a chronic mental illnesses or
			 chronic substance use disorder; and</text>
						</subparagraph><subparagraph id="idB87FABA7E3C24C54B729ACC2D9139F7C"><enum>(B)</enum><text>are
			 participating in continuing treatment for such mental illness or substance use
			 disorder as a condition of receipt of such rental assistance.</text>
						</subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="id26BF67F9095749D3B5996D358CA594D9" reported-display-style="italic"><enum>(2)</enum><header>Comparison</header><text>As
			 part of the study required by paragraph (1) the Secretary shall compare the
			 results of the program described in that paragraph with other programs as
			 follows:</text>
						<subparagraph id="idF180E08497D5405CA5C92C36F4E9D1A9"><enum>(A)</enum><text>Programs in which the Department of
			 Veterans Affairs coordinates the delivery of housing and services to homeless
			 veterans.</text>
						</subparagraph><subparagraph id="id3E83788576A9494583DC0027932B8551"><enum>(B)</enum><text>Programs for the provision of
			 grants or per diem payments to providers of services that are designed to meet
			 the needs of homeless veterans.</text>
						</subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="id7FD73874E36F4EB4BF25B1E691497363" reported-display-style="italic"><enum>(3)</enum><header>Criteria</header><text>In
			 conducting the comparison required by paragraph (2), the Secretary shall
			 examine the following:</text>
						<subparagraph id="idF508D218CE004D09B4D1BE30C3595F56"><enum>(A)</enum><text>The
			 satisfaction of veterans targeted by the programs described in paragraph
			 (2).</text>
						</subparagraph><subparagraph id="id5FC11D0664DE42F0A449A8CB898D4C03"><enum>(B)</enum><text>The
			 health status of such veterans.</text>
						</subparagraph><subparagraph id="id07FA046D07D04596BA7C9C74978466E3"><enum>(C)</enum><text>For
			 programs that address substance use disorders, the reduction in severity of
			 such disorders in such veterans.</text>
						</subparagraph><subparagraph id="idBB625903578B4E02BDC45F8B93130B79"><enum>(D)</enum><text>The
			 housing provided such veterans under such programs.</text>
						</subparagraph><subparagraph id="id8F9A4A92E103402883471DC583C30126"><enum>(E)</enum><text>The
			 degree to which such veterans are encouraged to productive activity by such
			 programs.</text>
						</subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="idC5A8D51A159C40D29F1F97E058F0EAAE" reported-display-style="italic"><enum>(4)</enum><header>Report</header><text>Not
			 later than March 31, 2009, the Secretary shall submit to the Committee on
			 Veterans’ Affairs of the Senate and the Committee on Veterans' Affairs of the
			 House of Representatives a report on the results of the study required by
			 paragraph (1).</text>
					</paragraph></subsection></section><section changed="added" committee-id="SSVA00" id="idCF1DEDF904264679A5AA558307A4C651" reported-display-style="italic" section-type="subsequent-section"><enum>511.</enum><header>Financial assistance
			 for supportive services for very low-income veteran families in permanent
			 housing</header>
				<subsection changed="added" committee-id="SSVA00" id="ID27a9d7b73a78455b891f57171888eaae" reported-display-style="italic"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to
			 facilitate the provision of supportive services for very low-income veteran
			 families in permanent housing.</text>
				</subsection><subsection changed="added" committee-id="SSVA00" id="IDda990ca6c6964f349cc759ef107eed75" reported-display-style="italic"><enum>(b)</enum><header>Financial
			 assistance</header>
					<paragraph id="id11546756D32045AF9020B403859649F3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter V of chapter 20 of title 38,
			 United States Code, is amended by adding at the end the following new
			 section:</text>
						<quoted-block committee-id="SSVA00" display-inline="no-display-inline" id="idFF5B8A49FD0F4CEB82AFE9A2D5EFB360" style="USC">
							<section id="IDcd0a6f7e380b412db09c4d60d555f6a0"><enum>2044.</enum><header>Financial
				assistance for supportive services for very low-income veteran families in
				permanent housing</header>
								<subsection changed="added" committee-id="SSVA00" id="ID892916f43eb64ce4bb38c8b79833013f" reported-display-style="italic"><enum>(a)</enum><header>Distribution of
				financial assistance</header><paragraph commented="no" display-inline="yes-display-inline" id="id97A417C50078421595A73A7C467D0E8E"><enum>(1)</enum><text>The Secretary shall
				provide financial assistance to eligible entities approved under this section
				to provide and coordinate the provision of supportive services described in
				subsection (b) for very low-income veteran families occupying permanent
				housing.</text>
									</paragraph><paragraph changed="added" committee-id="SSVA00" id="id6775E3AB7FC947CB82C2EA37FF83894A" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>Financial assistance
				under this section shall consist of per diem payments for each such family for
				which an approved eligible entity is providing or coordinating the provision of
				supportive services.</text>
									</paragraph><paragraph changed="added" committee-id="SSVA00" id="ID6295840305a746098ea92bcf05fbac49" indent="up1" reported-display-style="italic"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id254FAE3FC541433EA4154BD90C43D583"><enum>(A)</enum><text>Subject to the
				availability of appropriations provided for such purpose, the Secretary shall
				provide to each family for which an approved eligible entity is providing or
				coordinating the provision of supportive services per diem payments in the
				amount of the daily cost of care estimated by such eligible entity (as adjusted
				by the Secretary under subparagraph (C)).</text>
										</subparagraph><subparagraph id="id219768FC262B42F791975F020627885A" indent="up1"><enum>(B)</enum><text>In no case may the amount of per
				diem paid under this paragraph exceed the rate of per diem authorized for State
				homes for domiciliary care under subsection (a)(1)(A) of section 1741 of this
				title, as adjusted by the Secretary under subsection (c) of such
				section.</text>
										</subparagraph><subparagraph id="idE4ECD4DDB55F4196A7C5A4ADC361E85E" indent="up1"><enum>(C)</enum><text>The Secretary may adjust the daily
				cost of care estimated by an eligible entity for purposes of this paragraph to
				exclude other sources of income described in subparagraph (E) that the eligible
				entity certifies to be correct.</text>
										</subparagraph><subparagraph id="idE9086D3CCE014B9F9371E66ECA2CE0DD" indent="up1"><enum>(D)</enum><text>Each eligible entity shall provide
				to the Secretary such information with respect to other sources of income as
				the Secretary may require to make the adjustment under subparagraph (C).</text>
										</subparagraph><subparagraph id="id872DF1AE6B0F4168B8633239208277F6" indent="up1"><enum>(E)</enum><text>The other sources of income
				referred to in subparagraphs (C) and (D) are payments to the eligible entity
				for furnishing services to homeless veterans under programs other than under
				this subchapter, including payments and grants from other departments and
				agencies of the Federal Government, from departments or agencies of State or
				local government, and from private entities or organizations.</text>
										</subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="id841211CBB1A547E2A42EF402135FA103" indent="up1" reported-display-style="italic"><enum>(4)</enum><text>In providing financial
				assistance under paragraph (1), the Secretary shall give preference to entities
				providing or coordinating the provision of supportive services for very
				low-income veteran families who are transitioning from homelessness to
				permanent housing.</text>
									</paragraph><paragraph changed="added" committee-id="SSVA00" id="ID6771ef500be142baa452e196b8621761" indent="up1" reported-display-style="italic"><enum>(5)</enum><text>The Secretary shall
				ensure that, to the extent practicable, financial assistance under this
				subsection is equitably distributed across geographic regions, including rural
				communities and tribal lands.</text>
									</paragraph><paragraph changed="added" committee-id="SSVA00" id="id78ED0569F3BF4E2888663C6E8F90D13A" indent="up1" reported-display-style="italic"><enum>(6)</enum><text>Each entity receiving
				financial assistance under this section to provide supportive services to a
				very low-income veteran family shall notify that family that such services are
				being paid for, in whole or in part, by the Department.</text>
									</paragraph><paragraph changed="added" committee-id="SSVA00" id="idBB9668602F4640B4B98D3CA6FEEDB04D" indent="up1" reported-display-style="italic"><enum>(7)</enum><text>The Secretary may require
				entities receiving financial assistance under this section to submit a report
				to the Secretary that describes the projects carried out with such financial
				assistance.</text>
									</paragraph></subsection><subsection changed="added" committee-id="SSVA00" id="ID3b2fd62397d5447c9e70066dfb4a0d64" reported-display-style="italic"><enum>(b)</enum><header>Supportive
				services</header><text>The supportive services referred to in subsection (a)
				are the following:</text>
									<paragraph changed="added" committee-id="SSVA00" id="IDf443a3e05277441ea8b5a8aaf4544042" reported-display-style="italic"><enum>(1)</enum><text>Services provided by an
				eligible entity or subcontractors that address the needs of very low-income
				veteran families occupying permanent housing, including—</text>
										<subparagraph id="ID37809e1f7af042f8b003cc0ca0399d83"><enum>(A)</enum><text>outreach services;</text>
										</subparagraph><subparagraph id="IDea1ca74ad3404890995f91d88dc86832"><enum>(B)</enum><text>health care services, including
				diagnosis, treatment, and counseling for mental health and substance abuse
				disorders and for post-traumatic stress disorder, if such services are not
				readily available through the Department medical center serving the geographic
				area in which the veteran family is housed;</text>
										</subparagraph><subparagraph id="ID67481b63a1574995b2382eb388848020"><enum>(C)</enum><text>habilitation and rehabilitation
				services;</text>
										</subparagraph><subparagraph id="ID666a672eea744066a76149797bbd4769"><enum>(D)</enum><text>case management services;</text>
										</subparagraph><subparagraph id="ID4f4dc62674cc45b697ff48c0fd7420ab"><enum>(E)</enum><text>daily living services;</text>
										</subparagraph><subparagraph id="ID88042b477c1f47118489e7aea9553282"><enum>(F)</enum><text>personal financial planning;</text>
										</subparagraph><subparagraph id="ID8127e15842db47398c1ebd52ef29b8d2"><enum>(G)</enum><text>transportation services;</text>
										</subparagraph><subparagraph id="ID8e6de294363e40e49c6e9dd808818fb1"><enum>(H)</enum><text>vocational counseling;</text>
										</subparagraph><subparagraph id="ID7f028f461ec34ee4acbbacd14b943dd5"><enum>(I)</enum><text>employment and training;</text>
										</subparagraph><subparagraph id="IDae47ddefa6394819877f946538a1f96d"><enum>(J)</enum><text>educational services;</text>
										</subparagraph><subparagraph id="IDe747630ea73641809b3e830effb3866c"><enum>(K)</enum><text>assistance in obtaining veterans
				benefits and other public benefits, including health care provided by the
				Department;</text>
										</subparagraph><subparagraph id="ID0883468504bf4804b97425bce1d3a1a1"><enum>(L)</enum><text>assistance in obtaining income
				support;</text>
										</subparagraph><subparagraph id="ID4ed54bc7953143ba9a806ea4ad85abea"><enum>(M)</enum><text>assistance in obtaining health
				insurance;</text>
										</subparagraph><subparagraph id="IDe0a1cf3ab2914bcc8d3db38dca991c1c"><enum>(N)</enum><text>fiduciary and representative payee
				services;</text>
										</subparagraph><subparagraph id="ID587900daa93e4c8196d6398ed837bd83"><enum>(O)</enum><text>legal services to assist the
				veteran family with reconsiderations or appeals of veterans and public benefit
				claim denials and to resolve outstanding warrants that interfere with the
				family's ability to obtain or retain housing or supportive services;</text>
										</subparagraph><subparagraph id="IDa4f8c4c40571483faf2af5eea9591de4"><enum>(P)</enum><text>child care;</text>
										</subparagraph><subparagraph id="ID5ede0d4f81934ef1b546b7537647f9b0"><enum>(Q)</enum><text>housing counseling;</text>
										</subparagraph><subparagraph id="ID652eb4ccefb849d893a5b78456eec727"><enum>(R)</enum><text>other services necessary for
				maintaining independent living; and</text>
										</subparagraph><subparagraph id="IDe453e64ce03741a88897a97a7357897f"><enum>(S)</enum><text>coordination of services under this
				paragraph.</text>
										</subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="ID670824398d16431f93ed2208922f35f9" reported-display-style="italic"><enum>(2)</enum><text>Services described in
				paragraph (1) that are delivered to very low-income veteran families who are
				homeless and who are scheduled to become residents of permanent housing within
				90 days pending the location or development of housing suitable for permanent
				housing.</text>
									</paragraph><paragraph changed="added" committee-id="SSVA00" id="IDe5a49930cc3e4c1f9996426b901ec42a" reported-display-style="italic"><enum>(3)</enum><text>Services described in
				paragraph (1) for very low-income veteran families who have voluntarily chosen
				to seek other housing after a period of tenancy in permanent housing, that are
				provided, for a period of 90 days after such families exit permanent housing or
				until such families commence receipt of other housing services adequate to meet
				their current needs, but only to the extent that services under this paragraph
				are designed to support such families in their choice to transition into
				housing that is responsive to their individual needs and preferences.</text>
									</paragraph></subsection><subsection changed="added" committee-id="SSVA00" id="ID9615d0451983444893776be19b2a0048" reported-display-style="italic"><enum>(c)</enum><header>Application for
				financial assistance</header><paragraph commented="no" display-inline="yes-display-inline" id="idC98696A1670E4D63A75D1090B2DDD15F"><enum>(1)</enum><text>An eligible entity
				seeking financial assistance under subsection (a) shall submit an application
				to the Secretary in such form, in such manner, and containing such commitments
				and information as the Secretary determines to be necessary to carry out this
				section.</text>
									</paragraph><paragraph changed="added" committee-id="SSVA00" id="id22139302D5F04DF5ADE27545F730F6A4" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>Each application
				submitted by an eligible entity under paragraph (1) shall contain—</text>
										<subparagraph changed="added" committee-id="SSVA00" id="IDbfe56e4c3f864fc09331dbefca625269" reported-display-style="italic"><enum>(A)</enum><text>a description of the
				supportive services proposed to be provided by the eligible entity;</text>
										</subparagraph><subparagraph changed="added" committee-id="SSVA00" id="IDbd97378996f34b52b7ab72161dad0635" reported-display-style="italic"><enum>(B)</enum><text>a description of the
				types of very low-income veteran families proposed to be provided such
				services;</text>
										</subparagraph><subparagraph changed="added" committee-id="SSVA00" id="ID3e5ccd2485504e278d8d50f980f7ce6b" reported-display-style="italic"><enum>(C)</enum><text>an estimate of the number
				of very low-income veteran families proposed to be provided such
				services;</text>
										</subparagraph><subparagraph changed="added" committee-id="SSVA00" id="ID81d29d93f63449d2943cdf1acda30f16" reported-display-style="italic"><enum>(D)</enum><text>evidence of the
				experience of the eligible entity in providing supportive services to very
				low-income veteran families; and</text>
										</subparagraph><subparagraph changed="added" committee-id="SSVA00" id="ID7674a2501cab455c987aa1a961985f6f" reported-display-style="italic"><enum>(E)</enum><text>a description of the
				managerial capacity of the eligible entity to—</text>
											<clause id="IDea815b00ac144cb2959f81a91aa62299"><enum>(i)</enum><text>coordinate the provision of
				supportive services with the provision of permanent housing, by the eligible
				entity or by other organizations;</text>
											</clause><clause id="ID22c8f2a1840a4eff92ed10463b4a5985"><enum>(ii)</enum><text>continuously assess the needs of
				very low-income veteran families for supportive services;</text>
											</clause><clause id="ID6de3d2cdd095416992bc66d4d772142a"><enum>(iii)</enum><text>coordinate the provision of
				supportive services with the services of the Department;</text>
											</clause><clause id="idB605A1FE67C44BECB1DB3B9F55162B7A"><enum>(iv)</enum><text>tailor supportive services to the
				needs of very low-income veteran families; and</text>
											</clause><clause id="ID9efcb9ef18c641229f153aebce3d12df"><enum>(v)</enum><text>continuously seek new sources of
				assistance to ensure the long-term provision of supportive services to very
				low-income veteran families.</text>
											</clause></subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="ID1880dc203c4944599939c283b164aa23" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>The Secretary shall
				establish criteria for the selection of eligible entities to be provided
				financial assistance under this section.</text>
									</paragraph></subsection><subsection changed="added" committee-id="SSVA00" id="ID413eb281691645beadf86ddd13620292" reported-display-style="italic"><enum>(d)</enum><header>Technical
				assistance</header><paragraph commented="no" display-inline="yes-display-inline" id="id6B2A8067E4F341B78816349C64D96785"><enum>(1)</enum><text>The Secretary shall
				provide training and technical assistance to participating eligible entities
				regarding the planning, development, and provision of supportive services to
				very low-income veteran families occupying permanent housing.</text>
									</paragraph><paragraph id="id6268BCB413494E998004036B9CFC06B8" indent="up1"><enum>(2)</enum><text>The Secretary may provide the
				training described in paragraph (1) directly or through grants or contracts
				with appropriate public or nonprofit private entities.</text>
									</paragraph></subsection><subsection changed="added" commented="no" committee-id="SSVA00" id="IDd022c47d91834ba1971494f861344da0" reported-display-style="italic"><enum>(e)</enum><header>Funding</header><paragraph commented="no" display-inline="yes-display-inline" id="id46677DF63A8E4542B4F44466336B3C9C"><enum>(1)</enum><text>From amounts
				appropriated to the Department for Medical Care, there shall be available to
				carry out this section amounts as follows:</text>
										<subparagraph commented="no" id="id1B632DA44C6148E6B96157D85C6C5864" indent="up1"><enum>(A)</enum><text>$15,000,000 for fiscal year
				2007.</text>
										</subparagraph><subparagraph commented="no" id="id95BCB4A0CA7B4C3EA9999185AC3E0A8F" indent="up1"><enum>(B)</enum><text>$20,000,000 for fiscal year
				2008.</text>
										</subparagraph><subparagraph commented="no" id="id5DBF49CE7E5E4E0C99782D938931F9B4" indent="up1"><enum>(C)</enum><text>$25,000,000 for fiscal year
				2009.</text>
										</subparagraph></paragraph><paragraph commented="no" id="idD183C22393524C22B1BBA5C0DF72E910" indent="up1"><enum>(2)</enum><text>Not more than $750,000 may be
				available under paragraph (1) in any fiscal year to provide technical
				assistance under subsection (d).</text>
									</paragraph></subsection><subsection changed="added" committee-id="SSVA00" id="id146F3D80E07346F09C7C6D571A5C62CE" reported-display-style="italic"><enum>(f)</enum><header>Definitions</header><text>In
				this section:</text>
									<paragraph changed="added" committee-id="SSVA00" id="ID8dbda94873d6435da1760228c8ef3790" reported-display-style="italic"><enum>(1)</enum><text>The term <term>consumer
				cooperative</term> has the meaning given such term in section 202 of the
				Housing Act of 1959 (12 U.S.C. 1701q).</text>
									</paragraph><paragraph changed="added" committee-id="SSVA00" id="id8D7193F1E94843D8B63C7325E4F03B7B" reported-display-style="italic"><enum>(2)</enum><text>The term <term>eligible
				entity</term> means—</text>
										<subparagraph id="ID9334f7eaae5e4c668b070b06570edc37"><enum>(A)</enum><text>a
				private nonprofit organization; or</text>
										</subparagraph><subparagraph id="ID4b3b1f4c4cf24c61ba9651e6d9eb80f7"><enum>(B)</enum><text>a
				consumer cooperative.</text>
										</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="IDA3A5236AE84342ED839136CC80E037EC" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>homeless</term> has the
				meaning given that term in section 103 of the McKinney-Vento Homeless
				Assistance Act (42 U.S.C. 11302).</text>
									</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id24BAB58E9C694DA7B4AEA95C047C088D" reported-display-style="italic"><enum>(4)</enum><text>The term <term>permanent
				housing</term> means community-based housing without a designated length of
				stay.</text>
									</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idE6DDAD21C7614C92A8F25864842CF117" reported-display-style="italic"><enum>(5)</enum><text>The term <term>private
				nonprofit organization</term> means any of the following:</text>
										<subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id95F0EB12D55D4FB6BA0C0608494ECEC6" reported-display-style="italic"><enum>(A)</enum><text>Any incorporated private
				institution or foundation—</text>
											<clause commented="no" display-inline="no-display-inline" id="id814AB952EE7B472BBA019EAAFCB7AF9D"><enum>(i)</enum><text>no
				part of the net earnings of which inures to the benefit of any member, founder,
				contributor, or individual;</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id5B89F5C36CA8419A85691928DBCB09DB"><enum>(ii)</enum><text>which has a governing board that
				is responsible for the operation of the supportive services provided under this
				section; and</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="idD6295A57EDF943DEBF9C4EC4AFC6447D"><enum>(iii)</enum><text>which is approved by the
				Secretary as to financial responsibility;</text>
											</clause></subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idD61408BE9A704824B55187B1EDE52F7D" reported-display-style="italic"><enum>(B)</enum><text>A for-profit limited
				partnership, the sole general partner of which is an organization meeting the
				requirements of clauses (i), (ii), and (iii) of subparagraph (A).</text>
										</subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id8FCAD6D009F14F9F9332D5CE4232EC64" reported-display-style="italic"><enum>(C)</enum><text>A corporation wholly
				owned and controlled by an organization meeting the requirements of clauses
				(i), (ii), and (iii) of subparagraph (A).</text>
										</subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id2D71C68FD1E245ADA4A90D2C97F696D7" reported-display-style="italic"><enum>(D)</enum><text>A tribally designated
				housing entity (as defined in section 4 of the Native American Housing
				Assistance and Self-Determination Act of 1996 (25 U.S.C. 4103)).</text>
										</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idF23F6F15A7384CF684ECF1403F726268" reported-display-style="italic"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD4268A0656C84D83B13922A23FAF35D6"><enum>(A)</enum><text>Subject to
				subparagraphs (B) and (C), the term <term>very low-income veteran family</term>
				means a veteran family whose income does not exceed 50 percent of the median
				income for the area, as determined by the Secretary in accordance with this
				paragraph.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86720AB267E942189D13018E90DBDDCC" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary shall make appropriate
				adjustments to the income requirement under subparagraph (A) based on family
				size.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6013B68CF4884C5EAAF7EBB2900D90BC" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary may establish an income
				ceiling higher or lower than 50 percent of the median income for an area if the
				Secretary determines that such variations are necessary because the area has
				unusually high or low construction costs, fair market rents (as determined
				under section 8 of the United States Housing Act of 1937 (42 U.S.C. 1437f)), or
				family incomes.</text>
										</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idE43C0B9B4BD844B0AA29A384980E9F55" reported-display-style="italic"><enum>(7)</enum><text display-inline="yes-display-inline">The term <term>veteran family</term>
				includes a veteran who is a single person and a family in which the head of
				household or the spouse of the head of household is a
				veteran.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph changed="added" committee-id="SSVA00" id="idCCDC1E769C454D97BD1A3D625461E571" reported-display-style="italic"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 20 of
			 such title is amended by inserting after the item relating to section 2043 the

			 of permanent housing program</header>
					<paragraph changed="added" commented="no" committee-id="SSVA00" id="idC57CC35AAB3B4900BB5D3B0134876574" reported-display-style="italic"><enum>(1)</enum><header>In
			 general</header><text>For fiscal years 2007 and 2008, the Secretary shall
			 conduct a study of the effectiveness of the permanent housing program under
			 section 2044 of title 38, United States Code, as amended by subsection (b), in
			 meeting the needs of very low-income veteran families, as that term is defined
			 in that section.</text>
					</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" id="id9642439E378B42A58835F08699D5C38F" reported-display-style="italic"><enum>(2)</enum><header>Comparison</header><text>In
			 the study required by paragraph (1), the Secretary shall compare the results of
			 the program referred to in that subsection with other programs of the
			 Department of Veterans Affairs dedicated to the delivery of housing and
			 services to veterans.</text>
					</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" id="id775B737893BC414EA4EC452F45F8EE9B" reported-display-style="italic"><enum>(3)</enum><header>Criteria</header><text>In
			 making the comparison required in paragraph (2), the Secretary shall examine
			 the following:</text>
						<subparagraph commented="no" id="id8FB9B95F149D4A8F89976633C74416B2"><enum>(A)</enum><text>The satisfaction of veterans
			 targeted by the programs described in paragraph (2).</text>
						</subparagraph><subparagraph commented="no" id="id044E9FEDD23743889B59FF437C2C1B32"><enum>(B)</enum><text>The health status of such
			 veterans.</text>
						</subparagraph><subparagraph commented="no" id="idB5F3F7CFE7F044C59AA272128531D3D3"><enum>(C)</enum><text>The housing provided such veterans
			 under such programs.</text>
						</subparagraph><subparagraph commented="no" id="idA47C9D34FF5A48FA98234847DD725A89"><enum>(D)</enum><text>The degree to which such veterans
			 are encouraged to productive activity by such programs.</text>
						</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id6E1B764C4987485493455F187BBB653A" reported-display-style="italic"><enum>(4)</enum><header>Report</header><text>Not
			 later than March 31, 2009, the Secretary shall submit to the Committee on
			 Veterans’ Affairs of the Senate and the Committee on Veterans' Affairs of the
			 House of Representatives a report on the results of the study required by
			 paragraph (1).</text>
					</paragraph></subsection></section></title><title changed="added" committee-id="SSVA00" id="id7D6CEF903D214B12B5FEEFF25AED24BB" reported-display-style="italic"><enum>VI</enum><header>Miscellaneous
			 benefits</header>
			<section changed="added" committee-id="SSVA00" id="ID862C3C324B0A4FAA9F96D62EAB8FB903" reported-display-style="italic"><enum>601.</enum><header>Residential
			 cooperative housing units</header>
				<subsection id="ID0BE4374432244EB49FF7602F27CB36A2"><enum>(a)</enum><header>Housing benefits for cooperative
			 apartment units</header><text>Subsection (a) of section 3710 of title 38,
			 United States Code, is amended by inserting after paragraph (11) the following
			 new paragraph:</text>
					<quoted-block changed="added" id="IDB02BB862B30949B79B098B00E89B452C" reported-display-style="italic">
						<paragraph id="ID6C0B426D2D204D1CB6C4E71BF9F14D35"><enum>(12)</enum><text>To purchase stock or
				membership in a cooperative housing corporation for the purpose of entitling
				the veteran to occupy for dwelling purposes a single family residential unit in
				a development, project, or structure owned or leased by such corporation, in
				accordance with subsection
				(h).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection changed="added" committee-id="SSVA00" id="IDDA33D14E684B4318AD2CFAF8CDE92FC9" reported-display-style="italic"><enum>(b)</enum><header>Conditions of housing
			 benefits for cooperative apartment units</header><text>Such section is further
			 amended by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="ID37CD9727BDAE4A6FB72279FF98D0532E" style="OLC">
						<subsection id="ID6B435FDE869D44B281791F093E72CF89"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="IDABD4880D848C4D678EF6131FEB994773"><enum>(1)</enum><text>A loan may not be
				guaranteed under subsection (a)(12) unless—</text>
								<subparagraph changed="added" id="ID4DC3EC7B15EC445F86AC594149ED39B2" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>the
				development, project, or structure of the cooperative housing corporation
				complies with such criteria as the Secretary prescribes in regulations;
				and</text>
								</subparagraph><subparagraph changed="added" id="ID9250FEEEC3C64F9A003640080092B717" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>the
				dwelling unit that the purchase of stock or membership in the development,
				project, or structure of the cooperative housing corporation entitles the
				purchaser to occupy is a single family residential unit.</text>
								</subparagraph></paragraph><paragraph changed="added" id="ID6ACEAB970D8B4AF6BEEDB792447D1013" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>In
				this subsection, the term <term>cooperative housing corporation</term> has the
				same meaning given such term in section 216(b)(1) of the Internal Revenue Code
				of 1986.</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="IDA3B24F1C557F42BBBA57689E73FC16A5" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>When
				applying the term <term>value of the property</term> to a loan guaranteed under
				subsection (a)(12), such term means the appraised value of the stock or
				membership entitling the purchaser to the permanent occupancy of the dwelling
				unit in the development, project, or structure of the cooperative housing
				corporation.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
