			 <quote><short-title>National Defense Enhancement and

			 National Guard Empowerment Act of 2006</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="id1FC15D05F4CC4B04B2A11AF419C13A35" section-type="subsequent-section"><enum>2.</enum><header>Expanded authority of

			 Chief of the National Guard Bureau and expanded functions of the National Guard

			 Bureau</header>

			<subsection commented="no" display-inline="no-display-inline" id="id29630C899E8F45A49C43950E830A6232"><enum>(a)</enum><header>Expanded

			 authority</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id68F12B6212054BBAA4FF864124456D0E"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Subsection (a) of

			 section 10501 of title 10, United States Code, is amended by striking

			 <quote>joint bureau of the Department of the Army and the Department of the Air

			 Force</quote> and inserting <quote>joint activity of the Department of

			 Defense</quote>.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54CBDC0026054F4DBA9114BF00038C0F"><enum>(2)</enum><header>Purpose</header><text display-inline="yes-display-inline">Subsection (b) of such section is amended

			 by striking <quote>between</quote> and all that follows and inserting

			 “between—</text>

			 function on national guard matters</header><text display-inline="yes-display-inline">Subsection (c) of section 10502 of title

			 10, United States Code, is amended by inserting <quote>to the Secretary of

			 Defense, to the Chairman of the Joint Chiefs of Staff,</quote> after

			 <quote>principal advisor</quote>.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8EDE6CBECA0342BBB8E5B01473803BE7"><enum>(2)</enum><header>Member of Joint

			 adding at the end the following new paragraph:</text>

			 redesignated by paragraph (2)(A)(i) of this subsection, is further amended by

			 striking <quote>lieutenant general</quote> and inserting

			 <quote>general</quote>.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43D92EC6244847D284E7A4D795557786"><enum>(4)</enum><header>Annual report

			 to congress on validated requirements</header><text display-inline="yes-display-inline">Section 10504 of such title is amended by

			 adding at the end the following new subsection:</text>

				later than December 31 each year, the Chief of the National Guard Bureau shall

				submit to Congress a report on the following:</text>

							<paragraph commented="no" display-inline="no-display-inline" id="id3003E86FBE824A1687F00B235C6A3845"><enum>(1)</enum><text display-inline="yes-display-inline">The requirements validated under section

				10503a(b)(1) of this title during the preceding fiscal year.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id57EBE3D9B10A4477BF70A38335773C1C"><enum>(2)</enum><text display-inline="yes-display-inline">The requirements referred to in paragraph

				(1) for which funding is to be requested in the next budget for a fiscal year

				under section 10544 of this title.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ED23DF6277B43D8A898CA29B74DB941"><enum>(3)</enum><text display-inline="yes-display-inline">The requirements referred to in paragraph

				(1) for which funding will not be requested in the next budget for a fiscal

			 functions of National Guard Bureau</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id6C60D805CA034C6DB46072682D2DFEF7"><enum>(1)</enum><header>Development of

			 charter</header><text display-inline="yes-display-inline">Section 10503 of

			 title 10, United States Code, is amended—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id1015FD7181A34E49BF5023E78433C19B"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by

			 striking <quote>The Secretary of the Army and the Secretary of the Air Force

			 shall jointly develop</quote> and inserting <quote>The Secretary of Defense, in

			 consultation with the Secretary of the Army and the Secretary of the Air Force,

			 shall develop</quote>; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBAC75A465FB747B9B7BAD02E874BAF91"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (12), by striking <quote>the

			 Secretaries</quote> and inserting <quote>the Secretary of

			 Defense</quote>.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA99FB8E1A26949E2814606B6C3252240"><enum>(2)</enum><header>Additional

			 general functions</header><text display-inline="yes-display-inline">Such

			 section is further amended—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id9ECFC2BE020947F78BEBBAE4CD8C50CC"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraph (12), as amended

			 by paragraph (1)(B) of this subsection, as paragraph (13); and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3CF16B1DB79C4862B26C75113B7F5D63"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after paragraph (11) the

			 following new paragraph (12):</text>

				Federal agencies, and with the several States, the use of National Guard

				personnel and resources for and in contingency operations, military operations

				other than war, natural disasters, support of civil authorities, and other

				circumstances.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id41651246646F428A822C742C901B6A09"><enum>(3)</enum><header>Military

			 assistance for civil authorities</header><text display-inline="yes-display-inline">Chapter 1011 of such title is further

			 amended by inserting after section 10503 the following new section:</text>

						<section commented="no" display-inline="no-display-inline" id="id0860E675DB5E4031AA827BD2C1A2FC76" section-type="subsequent-section"><enum>10503a.</enum><header>Functions of

				National Guard Bureau: military assistance to civil authorities </header>

							<subsection commented="no" display-inline="no-display-inline" id="idA887346279B04FBAB793BB919A3BF3F0"><enum>(a)</enum><header>Identification

				of additional necessary assistance</header><text display-inline="yes-display-inline">The Chief of the National Guard Bureau

				shall—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="id1BA34F3587AC4E09B2FBB3E19229AA73"><enum>(1)</enum><text display-inline="yes-display-inline">identify gaps between Federal and State

				capabilities to prepare for and respond to emergencies; and</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2B82527089674146AB671DF3649FCD86"><enum>(2)</enum><text display-inline="yes-display-inline">make recommendations to the Secretary of

				Defense on programs and activities of the National Guard for military

				assistance to civil authorities to address such gaps.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id76049147FBF3406CACD16C74A6761E9A"><enum>(b)</enum><header>Scope of

				responsibilities</header><text display-inline="yes-display-inline">In meeting

				the requirements of subsection (a), the Chief of the National Guard Bureau

				shall, in coordination with the Adjutant Generals of the States, have

				responsibilities as follows:</text>

								<paragraph commented="no" display-inline="no-display-inline" id="id2DC61CBA85EA482B887FE0E5A0FB11FF"><enum>(1)</enum><text display-inline="yes-display-inline">To validate the requirements of the several

				States and Territories with respect to military assistance to civil

				authorities.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id021407C3B0014762BD5CC064B65888BD"><enum>(2)</enum><text display-inline="yes-display-inline">To develop doctrine and training

				requirements relating to the provision of military assistance to civil

				authorities.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9AA430B87762416C9D15269A9129A09E"><enum>(3)</enum><text display-inline="yes-display-inline">To acquire equipment, materiel, and other

				supplies and services for the provision of military assistance to civil

				authorities.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB6275AFA4AFD4F2995D3CBE434030842"><enum>(4)</enum><text display-inline="yes-display-inline">To assist the Secretary of Defense in

				preparing the budget required under section 10544 of this title.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39B34113643940AE8F8AA881C615E79F"><enum>(5)</enum><text display-inline="yes-display-inline">To administer amounts provided the National

				Guard for the provision of military assistance to civil authorities.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBB032DD549E047D7964E8426FC015959"><enum>(6)</enum><text display-inline="yes-display-inline">To carry out any other responsibility

				relating to the provision of military assistance to civil authorities as the

				Secretary of Defense shall specify.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1F0C2F25AD34432C847D231F1A4E94E2"><enum>(c)</enum><header>Assistance</header><text display-inline="yes-display-inline">The Chairman of the Joint Chiefs of Staff

				shall assist the Chief of the National Guard Bureau in carrying out activities

				under this section.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="idBFD61176AC284E129F3BDD2D3FA56134"><enum>(d)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Chief of the National Guard Bureau

				shall carry out activities under this section in consultation with the

				Secretary of the Army and the Secretary of the Air

				Force.</text>

							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFAEC3E9C727F412FB23F93475FEF1ACB"><enum>(4)</enum><header>Budgeting for

			 training and equipment for military assistance to civil authorities and other

			 domestic missions</header><text display-inline="yes-display-inline">Chapter

			 1013 of title 10, United States Code, is amended by adding at the end the

			 following new section:</text>

						<section commented="no" display-inline="no-display-inline" id="idF097E19C5BBB424FB905788F56F3676F" section-type="subsequent-section"><enum>10544.</enum><header>National Guard

				training and equipment: budget for military assistance to civil authorities and

				for other domestic operations</header>

							<subsection commented="no" display-inline="no-display-inline" id="idA2E792367C204E8186E6EB139A625EE5"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">The budget

				justification documents materials submitted to Congress in support of the

				budget of the President for a fiscal year (as submitted with the budget of the

				President under section 1105(a) of title 31) shall specify separate amounts for

				training and equipment for the National Guard for purposes of military

				assistance to civil authorities and for other domestic operations during such

				fiscal year.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="id3590274C345F4FF6A2EEA833C8E17F29"><enum>(b)</enum><header>Scope of

				funding</header><text display-inline="yes-display-inline">The amounts specified

				under subsection (a) for a fiscal year shall be sufficient for purposes as

				follows:</text>

								<paragraph commented="no" display-inline="no-display-inline" id="id4EE6063735FC49DA987D6AD06413247A"><enum>(1)</enum><text display-inline="yes-display-inline">The development and implementation of

				doctrine and training requirements applicable to the assistance and operations

				described in subsection (a) for such fiscal year.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1590CAD7D5F04556BD9449DF3A6AA7A3"><enum>(2)</enum><text display-inline="yes-display-inline">The acquisition of equipment, materiel, and

				other supplies and services necessary for the provision of such assistance and

				such operations in such fiscal

				year.</text>

								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6491454B573E44C4B23FACC2A458FB45"><enum>(5)</enum><header>Limitation on

			 increase in personnel of national guard bureau</header><text display-inline="yes-display-inline">The Secretary of Defense shall, to the

			 extent practicable, ensure that no additional personnel are assigned to the

			 National Guard Bureau in order to address administrative or other requirements

			 arising out of the amendments made by this subsection.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAAC00E9C0D9C43259D7E0C78BF8F5CE2"><enum>(d)</enum><header>Conforming and

			 clerical amendments</header>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="idEEC24C1D6BEA49C98D54B29B6541C4C8"><enum>(b)</enum><header>Selection</header><text display-inline="yes-display-inline">The Assistant to the Chairman of the Joint

				Chiefs of Staff for Reserve Matters shall be selected by the Chairman from

				officers of the Army Reserve, the Navy Reserve, the Marine Corps Reserve, or

				the Air Force Reserve who—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="idBC329AE8785644BBB675CB7223AF70CA"><enum>(1)</enum><text display-inline="yes-display-inline">are recommended for such selection by the

				Secretary of the military department concerned;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF68F5FBD426D48DABF56CF002CB8A150"><enum>(2)</enum><text display-inline="yes-display-inline">have had at least 10 years of commissioned

				service in their reserve component; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6F2AF3F6FAF94E70B98CF8419AFFF775"><enum>(3)</enum><text display-inline="yes-display-inline">are in a grade above colonel or, in the

				case the Navy Reserve, captain.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6A3A20FA52204ABCB6038F4785E62B51"><enum>(c)</enum><header>Term of

				office</header><text display-inline="yes-display-inline">The Assistant to the

				Chairman of the Joint Chiefs of Staff for Reserve Matters serves at the

				pleasure of the Chairman for a term of two years and may be continued in that

				assignment in the same manner, for one additional term. However, in a time of

				war there is no limit on the number of terms.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="idB28A1B6445734530A828D270BCE1685B"><enum>(d)</enum><header>Grade</header><text display-inline="yes-display-inline">The Assistant to the Chairman of the Joint

				Chiefs of Staff for Reserve Matters while so serving, holds the grade of major

				general or, in the case of the Navy Reserve, rear admiral. The officer serving

				in the position shall be considered to be serving in a position external to

				that officer's Armed Force for purposes of section 721 of title 10, United

				States Code.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="id20AB32D2C3844CF381F6D2D4E46984EB"><enum>(e)</enum><header>Duties</header><text display-inline="yes-display-inline">The Assistant to the Chairman of the Joint

				Chiefs of Staff for Reserve Matters is an advisor to the Chairman on matters

				relating to the reserves and performs the duties prescribed for the position by

				the Chairman.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="idA2E8F570C3D445F18968779E8A8C1281"><enum>(f)</enum><header>Other reserve

				component representation on Joint Staff</header><text display-inline="yes-display-inline">The Secretary of Defense, in consultation

				with the Chairman of the Joint Chiefs of Staff, shall develop appropriate

				policy guidance to ensure that, to the maximum extent practicable, the level of

				reserve component officer representation within the Joint Staff is commensurate

				with the significant role of the reserve components within the Total

				Force.</text>

						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="id6574D269776E4C239CE1CDB03B4F59B6" section-type="subsequent-section"><enum>3.</enum><header>Promotion of eligible

			 reserve officers to lieutenant general and vice admiral grades on the

			 active-duty list</header>

			<subsection commented="no" display-inline="no-display-inline" id="idD0A77CDB97064ECAA6D5A4E99444372F"><enum>(a)</enum><header>Sense of

			 congress</header><text display-inline="yes-display-inline">It is the sense of

			 Congress that, whenever officers are considered for promotion to the grade of

			 lieutenant general, or vice admiral in the case of the Navy, on the active duty

			 list, officers of the reserve components of the Armed Forces who are eligible

			 for promotion to such grade should be considered for promotion to such

			 grade.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idAD3E82F6111E4862AE8508F81DBCACF6"><enum>(b)</enum><header>Proposal</header><text display-inline="yes-display-inline">The Secretary of Defense shall submit to

			 Congress a proposal for mechanisms to achieve the objective specified in

			 subsection (a). The proposal shall include such recommendations for legislative

			 or administrative action as the Secretary considers appropriate in order to

			 achieve that objective.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id9A2B8BDBFFCF4048B275537C9048C691"><enum>(c)</enum><header>Notice

			 accompanying nominations</header><text display-inline="yes-display-inline">The

			 President shall include with each nomination of an officer to the grade of

			 lieutenant general, or vice admiral in the case of the Navy, on the active-duty

			 list that is submitted to the Senate for consideration a certification that all

			 reserve officers who were eligible for consideration for promotion to such

			 grade were considered in the making of such nomination.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="id7ECAE52BB64143CDAAF4222C63799C9A" section-type="subsequent-section"><enum>4.</enum><header>Requirement that

			 position of Deputy Commander of the United States northern command be filled by

			 a qualified National Guard officer</header>

			<subsection commented="no" display-inline="no-display-inline" id="id63DCDBECFFE848A1AFCB4C1B2535466F"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The position of

			 Deputy Commander of the United States Northern Command shall be filled by a

			 qualified officer of the National Guard who is eligible for promotion to the

			 grade of lieutenant general.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idE5765FFD16DF4031BE10CB8A411D0159"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of the requirement in

			 subsection (a) is to ensure that information received from the National Guard

			 Bureau regarding the operation of the National Guard of the several States is

			 integrated into the plans and operations of the United States Northern

			 Command.</text>
