		  make grants to educational organizations to carry out educational programs

		  about the Holocaust.</official-title>

		<section commented="no" display-inline="no-display-inline" id="H004A90E35B6440FA87B3F834EC182074" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Simon

			 Wiesenthal Holocaust Education Assistance Act</quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="HDC484C91725D4969A8B52129002F4EF1" section-type="subsequent-section"><enum>2.</enum><header>Findings and

			 purposes</header>

			<subsection commented="no" display-inline="no-display-inline" id="H7C37CC9642194954A8CCE6479DE6E62"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress makes the following

			 findings:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H2A545E4E5BCA4DA4A0AE3986922EA64C"><enum>(1)</enum><text display-inline="yes-display-inline">The Holocaust was an historical event that

			 resulted in the systemic, state-sponsored mass murders by Nazi Germany of

			 approximately 6,000,000 Jews, along with millions of others, in the name of

			 racial purity.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7A7C9985C7284390B402AF6D62B18515"><enum>(2)</enum><text display-inline="yes-display-inline">Six States (California, Florida, Illinois,

			 Massachusetts, New Jersey, and New York) now mandate that the Holocaust be

			 taught in the educational curriculum, 11 States (Connecticut, Georgia, Indiana,

			 Nevada, North Carolina, Ohio, Pennsylvania, South Carolina, Tennessee,

			 Virginia, and Washington) recommend teaching the Holocaust but do not provide

			 sufficient funds to assist in the training and educating of teachers, and 3

			 States (Alabama, Mississippi, and West Virginia) have established councils or

			 commissions that promote Holocaust education.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4B1B3EB6F2AA47A4B6FAC992C9A98DEF"><enum>(3)</enum><text display-inline="yes-display-inline">The Holocaust is a sensitive and difficult

			 issue about which to teach, and to do so effectively, educators need

			 appropriate teaching tools and training to increase their knowledge to enhance

			 the educational experience.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H27250EF82ADF4C22BE7EC27FEDA6E6ED"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are the

			 following:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H1782FCC791244D098FDFF5D8E0A68F6F"><enum>(1)</enum><text display-inline="yes-display-inline">To educate Americans so that they

			 can—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="HCA33654668EB4ED1BDD020AB1C79446"><enum>(A)</enum><text display-inline="yes-display-inline">explore the lessons that the Holocaust

			 provides for all people; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5B335FF16A8945F7ADBFC300AAB23CF3"><enum>(B)</enum><text display-inline="yes-display-inline">be less susceptible to the falsehood of

			 Holocaust denial and to the destructive messages of hate that arise from

			 Holocaust denial.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA3E65819A06547D3BC4000568276003B"><enum>(2)</enum><text display-inline="yes-display-inline">To provide resources and support for

			 education programs that—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="HC6EAD8170EF34297AB488B0033F822ED"><enum>(A)</enum><text display-inline="yes-display-inline">portray accurate historical information

			 about the Holocaust;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2EAD072563AF4029AEF00914E64BAAC6"><enum>(B)</enum><text display-inline="yes-display-inline">sensitize communities to the circumstances

			 that gave rise to the Holocaust;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB935A95FD14841BCB071084094E23CE9"><enum>(C)</enum><text display-inline="yes-display-inline">convey the lessons that the Holocaust

			 provides for all people; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H57A50C8FCCB34A48BE0000512F2326A6"><enum>(D)</enum><text display-inline="yes-display-inline">by developing curriculum guides and

			 providing training, help teachers incorporate into their mainstream disciplines

			 the study of the Holocaust and its lessons.</text>

					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HC37D27E1A9D34997A325683B3CA9409B" section-type="subsequent-section"><enum>3.</enum><header>Authority to make

			 grants</header><text display-inline="no-display-inline">From any amounts made

			 available to carry out this Act, the Secretary may make grants under this Act

			 to educational organizations to carry out proposed or existing Holocaust

			 education programs.</text>

		</section><section commented="no" display-inline="no-display-inline" id="HBD3BBAFAF6854A2A890066F7D582C4AC" section-type="subsequent-section"><enum>4.</enum><header>Use of grant

			 amounts</header>

			<subsection commented="no" display-inline="no-display-inline" id="H0858A191F4E741D5919B7E7BD28B3B45"><enum>(a)</enum><header>In

			 General</header><text display-inline="yes-display-inline">An educational

			 organization receiving grant amounts under this Act shall use such grant

			 amounts only to carry out the Holocaust education program for which the grant

			 amounts were provided.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="HF599E764071249979E153DD5F072E1A9"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">An educational organization receiving grant

			 amounts under this Act shall comply with the following requirements:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="HC757AF32FAB7453100853676D9FD95F1"><enum>(1)</enum><header>Continuation of

			 eligibility</header><text display-inline="yes-display-inline">The educational

			 organization shall, throughout the period that the educational organization

			 receives and uses such grant amounts, continue to be an educational

			 organization.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD26F6ED412E04A4F82FCA28E87B2B460"><enum>(2)</enum><header>Supplementation

			 of existing funds</header><text display-inline="yes-display-inline">The

			 educational organization shall ensure that such grant amounts are used to

			 supplement, and not supplant, non-Federal funds that would otherwise be

			 available to the educational organization to carry out the Holocaust education

			 program for which the grant amounts were provided.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCFF9593308454591A8DE0228C1FFD70"><enum>(c)</enum><header>Additional

			 Conditions</header><text display-inline="yes-display-inline">The Secretary may

			 require additional terms and conditions in connection with the use of grant

			 amounts provided under this Act as the Secretary considers appropriate.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="HA4B75087DC004B228703E3E5DEA92E52" section-type="subsequent-section"><enum>5.</enum><header>Selection

			 criteria</header>

			<subsection commented="no" display-inline="no-display-inline" id="HA889807DDDE94F89924FBF71F14562A4"><enum>(a)</enum><header>In

			 General</header><text display-inline="yes-display-inline">The Secretary shall

			 award grant amounts under this Act in accordance with competitive criteria to

			 be established by the Secretary.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="HA040E3CD5C9C433380E85127B89C08B8"><enum>(b)</enum><header>Consultation

			 With Holocaust Educators</header><text display-inline="yes-display-inline">In

			 establishing the competitive criteria under subsection (a), the Secretary shall

			 consult with a variety of individuals, to be determined by the Secretary, who

			 are prominent educators in the field of Holocaust education.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="H29D0365A132D4DB600004E31E3A02C93" section-type="subsequent-section"><enum>6.</enum><header>Application</header><text display-inline="no-display-inline">The Secretary may award grant amounts under

			 this Act only to an educational organization that has submitted an application

			 to the Secretary at such time, in such manner, and containing such information

			 as the Secretary may require.</text>

		</section><section commented="no" display-inline="no-display-inline" id="HDE40B45356EA4D4B850707B18E5E9878" section-type="subsequent-section"><enum>7.</enum><header>Review and

			 sanctions</header>

			<subsection commented="no" display-inline="no-display-inline" id="HADCFF417C5054515AB6930786F0995AF"><enum>(a)</enum><header>Annual

			 Review</header><text display-inline="yes-display-inline">The Secretary shall

			 review at least annually each educational organization receiving grant amounts

			 under this Act to determine the extent to which the educational organization

			 has complied with the provisions of this Act.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H40A12D7A7B794DEE8CE4FB05E7A3962F"><enum>(b)</enum><header>Imposition of

			 Sanctions</header><text display-inline="yes-display-inline">The Secretary may

			 impose sanctions on an educational organization for any failure of the

			 educational organization to comply substantially with the provisions of this

			 Act. The Secretary shall establish the sanctions to be imposed for a failure to

			 comply substantially with the provisions of this Act.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="HCF41B0CAC6574B91957F50C21300A448" section-type="subsequent-section"><enum>8.</enum><header>Annual

			 report</header><text display-inline="no-display-inline">Not later than February

			 1 of each year, the Secretary shall submit to the Senate and House of

			 Representatives a report describing the activities carried out under this Act

			 and containing any related information that the Secretary considers

			 appropriate.</text>

		</section><section commented="no" display-inline="no-display-inline" id="HF30674A76D2041D2875F46C933DB8F7" section-type="subsequent-section"><enum>9.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act, the following

			 definitions shall apply:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="H065BE8E92E4549F1928988971BF464C1"><enum>(1)</enum><header>Educational

			 organization</header><text display-inline="yes-display-inline">The term

			 <term>educational organization</term> means an entity—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="HF619ECCF5DAE418F88B96E896DBB7D19"><enum>(A)</enum><text display-inline="yes-display-inline">described in section 501(c)(3) of the

			 Internal Revenue Code of 1986;</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE9978E9232854632A7D68EEE1E227D69"><enum>(B)</enum><text display-inline="yes-display-inline">exempt from tax under section 501(a) of the

			 Internal Revenue Code of 1986; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6B1830BE7727433885CCED00B0A9092C"><enum>(C)</enum><text display-inline="yes-display-inline">organized and operated for cultural,

			 literary, or educational purposes.</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0F9E69AA32CC4592A4FB55D710358EA4"><enum>(2)</enum><header>Holocaust

			 education program</header><text display-inline="yes-display-inline">The term

			 <term>Holocaust education program</term> means a program that—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="H2482827BC0DB4F0E96D0EE0019BD777C"><enum>(A)</enum><text display-inline="yes-display-inline">has as its specific and primary purpose to

			 improve awareness and understanding of the Holocaust; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBB30D2B118334F9482C8376BFFF4A170"><enum>(B)</enum><text display-inline="yes-display-inline">to achieve such purpose, furnishes one or

			 more of the following:</text>

					<clause commented="no" display-inline="no-display-inline" id="H35DC96BC4E72481C9892A7000459A9ED"><enum>(i)</enum><text display-inline="yes-display-inline">Classes, seminars, or conferences.</text>

					</clause><clause commented="no" display-inline="no-display-inline" id="HBD78542FC0B74CBD997D75A2DFBE202B"><enum>(ii)</enum><text display-inline="yes-display-inline">Educational materials.</text>

					</clause><clause commented="no" display-inline="no-display-inline" id="H190CDB6C8E9640ED831463A53E7D00AF"><enum>(iii)</enum><text display-inline="yes-display-inline">Teacher training.</text>

					</clause><clause commented="no" display-inline="no-display-inline" id="H6A3412A5288B465DBEDE3B90D96B02CA"><enum>(iv)</enum><text display-inline="yes-display-inline">Any other good or service designed to

			 improve awareness and understanding of the Holocaust.</text>

					</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0705A465EF72439082A642E2DD024401"><enum>(3)</enum><header>Holocaust</header><text display-inline="yes-display-inline">The term <term>Holocaust</term> means the

			 historical event that resulted in the systemic, state-sponsored mass murders by

			 the name of racial purity.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD1EAE5F4DCD54069B4B7A423577E00CE"><enum>(4)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the

			 Secretary of Education.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H7B4E37607091485D92B3EAC71DB797D9" section-type="subsequent-section"><enum>10.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary shall issue any regulations

			 necessary to carry out this Act.</text>

		</section><section commented="no" display-inline="no-display-inline" id="H5E2E96FC619D487AA0F4A58B14D9522F" section-type="subsequent-section"><enum>11.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">For grants

			 under this Act, there is authorized to be appropriated to the Secretary

			 $2,000,000 each fiscal year for five fiscal years, beginning with the first

			 fiscal year to commence after the date of enactment of this Act, to remain

			 available until expended.</text>
