		<section id="ID521436DEEAAD49DFB8F05DF954FFF345" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Paleontological Resources Preservation

			 Act</short-title></quote>.</text>

		</section><section id="ID097EA32662374F09AB6C3847C6149A25"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act:</text>

			<paragraph id="IDA19DE1D2DA2341178AE75ACBD58017EA"><enum>(1)</enum><header>Casual

			 collecting</header><text>The term <term>casual collecting</term> means the

			 collecting of a reasonable amount of common invertebrate and plant

			 paleontological resources for non-commercial personal use, either by surface

			 collection or the use of non-powered hand tools resulting in only negligible

			 disturbance to the Earth’s surface and other resources. As used in this

			 paragraph, the terms <term>reasonable amount</term>, <term>common invertebrate

			 and plant paleontological resources</term> and <term>negligible

			 disturbance</term> shall be determined by the Secretary.</text>

			</paragraph><paragraph id="IDF8BE28C9D9DE46AA9BDA4C47BFCD2AB5"><enum>(2)</enum><header>Secretary</header><text>The

			 term <term>Secretary</term> means the Secretary of the Interior with respect to

			 lands controlled or administered by the Secretary of the Interior or the

			 Secretary of Agriculture with respect to National Forest System Lands

			 controlled or administered by the Secretary of Agriculture.</text>

			</paragraph><paragraph id="ID20687381D049477B90793A22C210D486"><enum>(3)</enum><header>Federal

			 lands</header><text>The term <term>Federal lands</term> means—</text>

				<subparagraph id="ID43D67A9F7C9E4493896E79BC3CB8E83D"><enum>(A)</enum><text>lands controlled

			 or administered by the Secretary of the Interior, except Indian lands;

			 or</text>

				</subparagraph><subparagraph id="ID5F434D2E3BC54F2F92EB00FC441920C6"><enum>(B)</enum><text>National Forest

			 System lands controlled or administered by the Secretary of Agriculture.</text>

				</subparagraph></paragraph><paragraph id="ID0F426A5CAD3C418B99D1491A5B44E299"><enum>(4)</enum><header>Indian

			 lands</header><text>The term <term>Indian Land</term> means lands of Indian

			 tribes, or Indian individuals, which are either held in trust by the United

			 States or subject to a restriction against alienation imposed by the United

			 States.</text>

			</paragraph><paragraph id="IDA2FA1213545D48ACB2C505BE581777C4"><enum>(5)</enum><header>State</header><text>The

			 term <term>State</term> means the fifty States, the District of Columbia, the

			 Commonwealth of Puerto Rico, and any other territory or possession of the

			 United States.</text>

			</paragraph><paragraph id="ID62CFF6750B4B47BF8006DACB5EB30C2C"><enum>(6)</enum><header>Paleontological

			 resource</header><text>The term <term>paleontological resource</term> means any

			 fossilized remains, traces, or imprints of organisms, preserved in or on the

			 earth’s crust, that are of paleontological interest and that provide

			 information about the history of life on earth, except that the term does not

			 include—</text>

				<subparagraph id="ID2D151D033E9947298F2E88528890BA11"><enum>(A)</enum><text>any materials

			 associated with an archaeological resource (as defined in section 3(1) of the

			 Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470bb(1)">16 U.S.C. 470bb(1)</external-xref>); or</text>

				</subparagraph><subparagraph id="IDA0EAAB9439BA43C2B0D4B4A1992CD19A"><enum>(B)</enum><text>any cultural item

			 (as defined in section 2 of the Native American Graves Protection and

			 Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25

			 U.S.C. 3001</external-xref>)).</text>

				</subparagraph></paragraph></section><section id="IDD81B6628B1F7459B905E8ED6715012D1"><enum>3.</enum><header>Management</header>

			<subsection id="IDB18A637F8A8C4A76815008701FAC4F98"><enum>(a)</enum><header>In

			 general</header><text>The Secretary shall manage and protect paleontological

			 resources on Federal lands using scientific principles and expertise. The

			 Secretary shall develop appropriate plans for inventory, monitoring, and the

			 scientific and educational use of paleontological resources, in accordance with

			 applicable agency laws, regulations, and policies. These plans shall emphasize

			 interagency coordination and collaborative efforts where possible with

			 non-Federal partners, the scientific community, and the general public.</text>

			</subsection><subsection id="IDADF53DE563634940A5842FA243445450"><enum>(b)</enum><header>Coordination</header><text>To

			 the extent possible, the Secretary of the Interior and the Secretary of

			 Agriculture shall coordinate in the implementation of this Act.</text>

			</subsection></section><section id="ID1DAC72ED148C4FA9A352F253CF675059"><enum>4.</enum><header>Public awareness

			 and education program</header><text display-inline="no-display-inline">The

			 Secretary shall establish a program to increase public awareness about the

			 significance of paleontological resources.</text>

		</section><section id="ID31AEDEA6A0E24C26BF7278B3AAD0DC05"><enum>5.</enum><header>Collection of

			 paleontological resources</header>

			<subsection id="ID4F6A74BEE8764241AAFD094E61B44C08"><enum>(a)</enum><header>Permit

			 requirement</header>

				<paragraph id="IDA89FCCE2A52046A9A5BA38F3EDE13495"><enum>(1)</enum><header>In

			 general</header><text>Except as provided in this Act, a paleontological

			 resource may not be collected from Federal lands without a permit issued under

			 this Act by the Secretary.</text>

				</paragraph><paragraph id="IDB63FF8EB2C174D34B478093F6986031A"><enum>(2)</enum><header>Casual

			 collecting exception</header><text>The Secretary may allow casual collecting

			 without a permit on Federal lands controlled or administered by the Bureau of

			 Land Management, the Bureau of Reclamation, and the Forest Service, where such

			 collection is consistent with the laws governing the management of those

			 Federal lands and this Act.</text>

				</paragraph><paragraph id="ID294AF7840AA443F4B9A4B1AD35FC1C8C"><enum>(3)</enum><header>Previous permit

			 exception</header><text>Nothing in this section shall affect a valid permit

			 issued prior to the date of enactment of this Act.</text>

				</paragraph></subsection><subsection id="IDB7B81463F72C4D0886C4585C071DC394"><enum>(b)</enum><header>Criteria for

			 issuance of a permit</header><text>The Secretary may issue a permit for the

			 collection of a paleontological resource pursuant to an application if the

			 Secretary determines that—</text>

				<paragraph id="ID11E0AFCF178643AB9B00AE01EABFEF58"><enum>(1)</enum><text>the applicant is

			 qualified to carry out the permitted activity;</text>

				</paragraph><paragraph id="ID80017C5547674929BF11D8AD32C271FF"><enum>(2)</enum><text>the permitted

			 activity is undertaken for the purpose of furthering paleontological knowledge

			 or for public education;</text>

				</paragraph><paragraph id="ID1D70754F5B4D4963881EC6E294EEA381"><enum>(3)</enum><text>the permitted

			 activity is consistent with any management plan applicable to the Federal lands

			 concerned; and</text>

				</paragraph><paragraph id="IDBE95E1155FD042818F77084ED8215F29"><enum>(4)</enum><text>the proposed

			 methods of collecting will not threaten significant natural or cultural

			 resources.</text>

				</paragraph></subsection><subsection id="IDA4380D9CF0C243DC9ACC7E08961C173F"><enum>(c)</enum><header>Permit

			 specifications</header><text>A permit for the collection of a paleontological

			 resource issued under this section shall contain such terms and conditions as

			 the Secretary deems necessary to carry out the purposes of this Act. Every

			 permit shall include requirements that—</text>

				<paragraph id="IDD90D4C5D80E24EB0A9567CA248E996E9"><enum>(1)</enum><text>the

			 paleontological resource that is collected from Federal lands under the permit

			 will remain the property of the United States;</text>

				</paragraph><paragraph id="ID2934E5011B3646A081E87D52A4EDC58D"><enum>(2)</enum><text>the

			 paleontological resource and copies of associated records will be preserved for

			 the public in an approved repository, to be made available for scientific

			 research and public education; and</text>

				</paragraph><paragraph id="IDC1D272AF7137423BA470868747E91037"><enum>(3)</enum><text>specific locality

			 data will not be released by the permittee or repository without the written

			 permission of the Secretary.</text>

				</paragraph></subsection><subsection id="ID13D143625AD341D5896E0B0BC9508620"><enum>(d)</enum><header>Modification,

			 suspension, and revocation of permits</header>

				<paragraph id="ID8A40F79F093A4BAAAC5E3C12A0209AD6"><enum>(1)</enum><text>The Secretary may

			 modify, suspend, or revoke a permit issued under this section—</text>

					<subparagraph id="ID7D43B5B3402548EFA5EA3358C574E8D6"><enum>(A)</enum><text>for resource,

			 safety, or other management considerations; or</text>

					</subparagraph><subparagraph id="ID46572C5DF7D044AEA16CF53124FE273C"><enum>(B)</enum><text>when there is a

			 violation of term or condition of a permit issued pursuant to this

			 section.</text>

					</subparagraph></paragraph><paragraph id="IDB6AF67F82370419FAAF7259ED5EBEF7B"><enum>(2)</enum><text>The permit shall

			 be revoked if any person working under the authority of the permit is convicted

			 under

			 <deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">section 9</deleted-phrase>

						<added-phrase committee-id="SSEG00" reported-display-style="italic">section

			 7</added-phrase> or is assessed a civil penalty under

			 <deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">section 10</deleted-phrase>

						<added-phrase committee-id="SSEG00" reported-display-style="italic">section

			 8</added-phrase>.</text>

				</paragraph></subsection><subsection id="ID5AD6AF2A07684502B80A48C758D26126"><enum>(e)</enum><header>Area

			 closures</header><text>In order to protect paleontological or other resources

			 and to provide for public safety, the Secretary may restrict access to or close

			 areas under the Secretary’s jurisdiction to the collection of paleontological

			 resources.</text>

			</subsection></section><section id="ID949BD66DF9764C4C8A1BE3E5E097AF00"><enum>6.</enum><header>Curation of

			 resources</header><text display-inline="no-display-inline">Any paleontological

			 resource, and any data and records associated with the resource, collected

			 under a permit, shall be deposited in an approved repository. The Secretary may

			 enter into agreements with non-Federal repositories regarding the curation of

			 these resources, data, and records.</text>

		</section><section id="ID86469C66B99A4BADB942519A11BBCB26"><enum>7.</enum><header>Prohibited acts;

			 criminal penalties</header>

			<subsection id="ID6B88E51A538D45C2BF1748E511EAC609"><enum>(a)</enum><header>In

			 general</header><text>A person may not—</text>

				<paragraph id="ID3B8B5C30C63E4666A5F8C66EDCD6DD07"><enum>(1)</enum><text>excavate, remove,

			 damage, or otherwise alter or deface or attempt to excavate, remove, damage, or

			 otherwise alter or deface any paleontological resources located on Federal

			 lands unless such activity is conducted in accordance with this Act;</text>

				</paragraph><paragraph id="ID8B86093011F74FD3827A8E8D601E93CA"><enum>(2)</enum><text>exchange,

			 transport, export, receive, or offer to exchange, transport, export, or receive

			 any paleontological resource if, in the exercise of due care, the person knew

			 or should have known such resource to have been excavated or removed from

			 Federal lands in violation of any provisions, rule, regulation, law, ordinance,

			 or permit in effect under Federal law, including this Act; or</text>

				</paragraph><paragraph id="ID4E3F9F923A1B41A7A0FCE20C3C9DEF0A"><enum>(3)</enum><text>sell or purchase

			 or offer to sell or purchase any paleontological resource if, in the exercise

			 of due care, the person knew or should have known such resource to have been

			 excavated, removed, sold, purchased, exchanged, transported, or received from

			 Federal lands.</text>

				</paragraph></subsection><subsection id="ID6CB848A7F7364282A4C69F34236A52EA"><enum>(b)</enum><header>False labeling

			 offenses</header><text>A person may not make or submit any false record,

			 account, or label for, or any false identification of, any paleontological

			 resource excavated or removed from Federal lands.</text>

			</subsection><subsection id="ID45488FE836E943818DD3B32CDB6FCA7F"><enum>(c)</enum><header>Penalties</header><text>A

			 person who knowingly violates or counsels, procures, solicits, or employs

			 another person to violate subsection (a) or (b) shall, upon conviction, be

			 fined in accordance with title 18, United States Code, or imprisoned not more

			 than 10 years, or both; but if the sum of the commercial and paleontological

			 value of the paleontological resources involved and the cost of restoration and

			 repair of such resources does not exceed $500, such person shall be fined in

			 accordance with title 18, United States Code, or imprisoned not more than one

			 year, or both.</text>

			</subsection><subsection id="IDAE5C2555725642E69DCE726CBBC890DA"><enum>(d)</enum><header>General

			 exception</header><text>Nothing in subsection (a) shall apply to any person

			 with respect to any paleontological resource which was in the lawful possession

			 of such person prior to the date of the enactment of this Act.</text>

			</subsection></section><section id="ID9D6CD6597CE942F5B04E3EF4C3AE8216"><enum>8.</enum><header>Civil

			 penalties</header>

			<subsection id="ID7F183543E68C4FD780471614FC39202D"><enum>(a)</enum><header>In

			 general</header>

				<paragraph id="ID812A752C85E44F1C82D81435E1BB3CCA"><enum>(1)</enum><header>Hearing</header><text>A

			 person who violates any prohibition contained in an applicable regulation or

			 permit issued under this Act may be assessed a penalty by the Secretary after

			 the person is given notice and opportunity for a hearing with respect to the

			 violation. Each violation shall be considered a separate offense for purposes

			 of this section.</text>

				</paragraph><paragraph id="ID125D764206D34C97B468370EFBEE5343"><enum>(2)</enum><header>Amount of

			 penalty</header><text>The amount of such penalty assessed under paragraph (1)

			 shall be determined under regulations promulgated pursuant to this Act, taking

			 into account the following factors:</text>

					<subparagraph id="IDEE868780C7CA4F2B81C3A613F4FC9684"><enum>(A)</enum><text>The scientific or

			 fair market value, whichever is greater, of the paleontological resource

			 involved, as determined by the Secretary.</text>

					</subparagraph><subparagraph id="ID838D082515C441948014570413B28D7F"><enum>(B)</enum><text>The cost of

			 response, restoration, and repair of the resource and the paleontological site

			 involved.</text>

					</subparagraph><subparagraph id="IDD1B21CE2458E41D084C1EFD5165DB2B6"><enum>(C)</enum><text>Any other factors

			 considered relevant by the Secretary assessing the penalty.</text>

					</subparagraph></paragraph><paragraph id="IDDC7D65F1C2584401AB7184C9459173E3"><enum>(3)</enum><header>Multiple

			 offenses</header><text>In the case of a second or subsequent violation by the

			 same person, the amount of a penalty assessed under paragraph (2) may be

			 doubled.</text>

				</paragraph><paragraph id="ID5B3AD0E8B4574CC392CCC17699619AF7"><enum>(4)</enum><header>Limitation</header><text>The

			 amount of any penalty assessed under this subsection for any one violation

			 shall not exceed an amount equal to double the cost of response, restoration,

			 and repair of resources and paleontological site damage plus double the

			 scientific or fair market value of resources destroyed or not recovered.</text>

				</paragraph></subsection><subsection id="ID2A213DB2E887461385B0CB8B9B471685"><enum>(b)</enum><header>Petition for

			 judicial review; collection of unpaid assessments</header>

				<paragraph id="ID29B0FF0576944B6DBC185EF863CE38A6"><enum>(1)</enum><header>Judicial

			 review</header><text>Any person against whom an order is issued assessing a

			 penalty under subsection (a) may file a petition for judicial review of the

			 order in the United States District Court for the District of Columbia or in

			 the district in which the violation is alleged to have occurred within the

			 30-day period beginning on the date the order making the assessment was issued.

			 Upon notice of such filing, the Secretary shall promptly file such a certified

			 copy of the record on which the order was issued. The court shall hear the

			 action on the record made before the Secretary and shall sustain the action if

			 it is supported by substantial evidence on the record considered as a

			 whole.</text>

				</paragraph><paragraph id="ID8A9B9F85D7D844BB8AAC3934C9A20D21"><enum>(2)</enum><header>Failure to

			 pay</header><text>If any person fails to pay a penalty under this section

			 within 30 days—</text>

					<subparagraph id="IDA8BB49B31EEB4632A45BABC6877A580F"><enum>(A)</enum><text>after the order

			 making assessment has become final and the person has not filed a petition for

			 judicial review of the order in accordance with paragraph (1); or</text>

					</subparagraph><subparagraph id="IDD2FA603538BE4B34942B63AFC333B840"><enum>(B)</enum><text>after a court in

			 an action brought in paragraph (1) has entered a final judgment upholding the

			 assessment of the penalty, the Secretary may request the Attorney General to

			 institute a civil action in a district court of the United States for any

			 district in which the person if found, resides, or transacts business, to

			 collect the penalty (plus interest at currently prevailing rates from the date

			 of the final order or the date of the final judgment, as the case may be). The

			 district court shall have jurisdiction to hear and decide any such action. In

			 such action, the validity, amount, and appropriateness of such penalty shall

			 not be subject to review. Any person who fails to pay on a timely basis the

			 amount of an assessment of a civil penalty as described in the first sentence

			 of this paragraph shall be required to pay, in addition to such amount and

			 interest, attorneys fees and costs for collection proceedings.</text>

					</subparagraph></paragraph></subsection><subsection id="IDC6C3C2B294084243A19657B930C0B3AD"><enum>(c)</enum><header>Hearings</header><text>Hearings

			 held during proceedings instituted under subsection (a) shall be conducted in

			 accordance with section 554 of title 5, United States Code.</text>

			</subsection><subsection id="ID52198A4F727240419B17A8FAFC38D46D"><enum>(d)</enum><header>Use of

			 recovered amounts</header><text>Penalties collected under this section shall be

			 available to the Secretary and without further appropriation may be used only

			 as follows:</text>

				<paragraph id="IDD0D097FF4F4B46B1B893643332CB2980"><enum>(1)</enum><text>To protect,

			 restore, or repair the paleontological resources and sites which were the

			 subject of the action, or to acquire sites with equivalent resources, and to

			 protect, monitor, and study the resources and sites. Any acquisition shall be

			 subject to any limitations contained in the organic legislation for such

			 Federal lands.</text>

				</paragraph><paragraph id="IDAB16304E0642438A859D188F696F3B62"><enum>(2)</enum><text>To provide

			 educational materials to the public about paleontological resources and

			 sites.</text>

				</paragraph><paragraph id="IDBB8FE257489D4CC1A5903807646D14AD"><enum>(3)</enum><text>To provide for

			 the payment of rewards as provided in

			 <deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">section 11

			 </deleted-phrase><added-phrase committee-id="SSEG00" reported-display-style="italic">section 9</added-phrase>.</text>

				</paragraph></subsection></section><section id="IDFD76EF244329410A9DA1E243E6216F55"><enum>9.</enum><header>Rewards and

			 forfeiture</header>

			<subsection id="IDA9BE6C6BB0344A83A82FD02014ACA263"><enum>(a)</enum><header>Rewards</header><text>The

			 Secretary may pay from penalties collected under

			 <deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">section 9 or 10</deleted-phrase>

					<added-phrase committee-id="SSEG00" reported-display-style="italic">section 7

			 or 8</added-phrase>—</text>

				<paragraph id="IDFB40CE1B0DB24388AF20071EFEC4B8FA"><enum>(1)</enum><text>consistent with

			 amounts established in regulations by the Secretary; or</text>

				</paragraph><paragraph id="IDA2286865146A4F089BC02781F368B62E"><enum>(2)</enum><text>if no such

			 regulation exists, an amount equal to the lesser of one-half of the penalty or

			 $500, to any person who furnishes information which leads to the finding of a

			 civil violation, or the conviction of criminal violation, with respect to which

			 the penalty was paid. If several persons provided the information, the amount

			 shall be divided among the persons. No officer or employee of the United States

			 or of any State or local government who furnishes information or renders

			 service in the performance of his official duties shall be eligible for payment

			 under this subsection.</text>

				</paragraph></subsection><subsection id="ID744649214ECA48C79FFC8D3CD74FBC7E"><enum>(b)</enum><header>Forfeiture</header><text>All

			 paleontological resources with respect to which a violation under

			 <deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">section 9 or 10</deleted-phrase>

					<added-phrase committee-id="SSEG00" reported-display-style="italic">section 7

			 or 8</added-phrase> occurred and which are in the possession of any person, and

			 all vehicles and equipment of any person that were used in connection with the

			 violation, shall be subject to civil forfeiture, or upon conviction, to

			 criminal forfeiture. All provisions of law relating to the seizure, forfeiture,

			 and condemnation of property for a violation of this Act, the disposition of

			 such property or the proceeds from the sale thereof, and remission or

			 mitigation of such forfeiture, as well as the procedural provisions of chapter

			 46 of title 18, United States Code, shall apply to the seizures and forfeitures

			 incurred or alleged to have incurred under the provisions of this Act.</text>

			</subsection><subsection id="IDB5B91696A35E4590B639C108C6684A65"><enum>(c)</enum><header>Transfer of

			 seized resources</header><text>The Secretary may transfer administration of

			 seized paleontological resources to Federal or non-Federal educational

			 institutions to be used for scientific or educational purposes.</text>

			</subsection></section><section id="ID920D125B0CD9463B80F8171CA0A66EBC"><enum>10.</enum><header>Confidentiality</header><text display-inline="no-display-inline">Information concerning the nature and

			 specific location of a paleontological resource the collection of which

			 requires a permit under this Act or under any other provision of Federal law

			 shall be exempt from disclosure under section 552 of title 5, United States

			 Code, and any other law unless the Secretary determines that disclosure

			 would—</text>

			<paragraph id="ID4C66B2814D524AA78813C474E1141759"><enum>(1)</enum><text>further the

			 purposes of this Act;</text>

			</paragraph><paragraph id="ID15EEAB08239C493D98C1C77B218B3A67"><enum>(2)</enum><text>not create risk

			 of harm to or theft or destruction of the resource or the site containing the

			 resource; and</text>

			</paragraph><paragraph id="ID2AAFBBCD3E394E609604913ADCCD9CB5"><enum>(3)</enum><text>be in accordance

			 with other applicable laws.</text>

			</paragraph></section><section id="ID35F8A58C56D94FA0B35B5AC02A7B9324"><enum>11.</enum><header>Regulations</header><text display-inline="no-display-inline">As soon as practical after the date of the

			 enactment of this Act, the Secretary shall issue such regulations as are

			 appropriate to carry out this Act, providing opportunities for public notice

			 and comment.</text>

		</section><section id="IDF1D86A4F233B4E1BB0A275C6257A0F28"><enum>12.</enum><header>Savings

			 provisions</header><text display-inline="no-display-inline">Nothing in this Act

			 shall be construed to—</text>

			<paragraph id="ID21BEC9159D45472C84B96D74AABD1877"><enum>(1)</enum><text>invalidate,

			 modify, or impose any additional restrictions or permitting requirements on any

			 activities permitted at any time under the general mining laws, the mineral or

			 geothermal leasing laws, laws providing for minerals materials disposal, or

			 laws providing for the management or regulation of the activities authorized by

			 the aforementioned laws including but not limited to the Federal Land Policy

			 Management Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1701-1784">43 U.S.C. 1701–1784</external-xref>),

			 <deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">the Mining in the Parks

			 Act</deleted-phrase>

					<added-phrase committee-id="SSEG00" reported-display-style="italic">Public Law

			 94–429 (commonly known as the <quote>Mining in the Parks Act</quote>) (16

			 U.S.C. 1901 et seq.)</added-phrase>, the Surface Mining Control and Reclamation

			 Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1201-1358">30

			 U.S.C. 1201–1358</external-xref>), and the Organic Administration Act

			 (<external-xref legal-doc="usc" parsable-cite="usc/16/478">16 U.S.C.

			 478</external-xref>, 482, 551);</text>

			</paragraph><paragraph id="ID869DB9FC1DED453EBA6365DB524A948D"><enum>(2)</enum><text>invalidate,

			 modify, or impose any additional restrictions or permitting requirements on any

			 activities permitted at any time under existing laws and authorities relating

			 to reclamation and multiple uses of Federal lands;</text>

			</paragraph><paragraph id="IDAFBA7B715DA348F69F37AA8063A96AB1"><enum>(3)</enum><text>apply to, or

			 require a permit for, casual collecting of a rock, mineral, or invertebrate or

			 plant fossil that is not protected under this Act;</text>

			</paragraph><paragraph id="ID4F3FACDC1568419C9C14EBC9DDEE0A4D"><enum>(4)</enum><text>affect any lands

			 other than Federal lands or affect the lawful recovery, collection, or sale of

			 paleontological resources from lands other than Federal lands;</text>

			</paragraph><paragraph id="ID2EA1EDC0BB924BDEB0E20B499F49F2E8"><enum>(5)</enum><text>alter or diminish

			 the authority of a Federal agency under any other law to provide protection for

			 paleontological resources on Federal lands in addition to the protection

			 provided under this Act; or</text>

			</paragraph><paragraph id="ID8C027999853248AFA2F2CE96F674C023"><enum>(6)</enum><text>create any right,

			 privilege, benefit, or entitlement for any person who is not an officer or

			 employee of the United States acting in that capacity. No person who is not an

			 officer or employee of the United States acting in that capacity shall have

			 standing to file any civil action in a court of the United States to enforce

			 any provision or amendment made by this Act.</text>

			</paragraph></section><section id="IDE9BE4FC9F5404344878CCA7860757064"><enum>13.</enum><header>Authorization

			 of appropriations</header><text display-inline="no-display-inline">There are

			 authorized to be appropriated such sums as may be necessary to carry out this

			 Act.</text>
