		<official-title>To grant rights-of-way to owners of dams located in the

		  Bitterroot National Forest in the State of Montana, and for other purposes.

		  </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Bitterroot National Forest Dam and

			 Reservoir Maintenance Act</short-title></quote>.</text>

		</section><section id="idB3B9196027744472ACFE6D7CA1BFD22F"><enum>2.</enum><header>Findings and

			 purposes</header>

			<subsection id="idFF8E92FE9D8F437BBE8EB7D1E4792F6A"><enum>(a)</enum><header>Findings</header><text>Congress

			 finds that—</text>

				<paragraph id="IDd6cbc873f5ea4bd5b873ea72dc56379c"><enum>(1)</enum><text>the wilderness

			 dams in the Bitterroot National Forest in the State of Montana provide numerous

			 benefits to the people living in the Bitterroot Valley; and</text>

				</paragraph><paragraph id="idB2C1F103C5C64335A4976DBF393534A5"><enum>(2)</enum><text>those benefits

			 include—</text>

					<subparagraph id="id4464BCF2A6E647C985568E9EB56B9966"><enum>(A)</enum><text>groundwater

			 recharge;</text>

					</subparagraph><subparagraph id="id0CF028A1D8A94E8CAD9CB4BCCC31CD01"><enum>(B)</enum><text>maintenance of

			 open space by permitting sustainable family ranches and farms, rather than

			 subdividing ranches and farms;</text>

					</subparagraph><subparagraph id="idE0B684641AAC462183CEC1EF793907FD"><enum>(C)</enum><text>increased late

			 summer streamflows that support riparian and fishery habitat needs; and</text>

					</subparagraph><subparagraph id="idB4D01D3737F54A11B26C9678185B245B"><enum>(D)</enum><text>flood

			 control.</text>

					</subparagraph></paragraph></subsection><subsection id="id229A9987857B479C8966328435C7A5A6"><enum>(b)</enum><header>Purposes</header><text>The

			 purposes of this Act are—</text>

				<paragraph id="id55176992106D45B796E658EFED4A9D1F"><enum>(1)</enum><text>to grant

			 rights-of-way to owners of dams located in the Bitterroot National Forest in

			 the State of Montana; and</text>

				</paragraph><paragraph id="id2E05AECAFF8146A3A161BE9DC804260A"><enum>(2)</enum><text>to continue to

			 provide the benefits described in subsection (a).</text>

				</paragraph></subsection></section><section id="ID4A5A6761C8BE42A3B265ED10EE00ED76"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph id="ID2D1BF9EEE8DB427B8FD5E2280055C943"><enum>(1)</enum><header>Dam</header><text>The

			 term <term>dam</term> means a dam, including any reservoirs and appurtenances

			 to the dam, that is located in the Forest as of the date of enactment of this

			 Act.</text>

			</paragraph><paragraph id="IDAFAF0489A3244E34B7FD1769805436B0"><enum>(2)</enum><header>Forest</header><text>The

			 term <term>Forest</term> means the Bitterroot National Forest in the

			 State.</text>

			</paragraph><paragraph id="IDE9E84D8891F84058006122FB3D4CFEA7"><enum>(3)</enum><header>Owner</header><text>The

			 term <term>owner</term> means—</text>

				<subparagraph id="id66F51BC63B174FB1B8E32357D93119D2"><enum>(A)</enum><text>the owner of a

			 dam;</text>

				</subparagraph><subparagraph id="id3CDAA899541B4C99A4864AB202FD2E80"><enum>(B)</enum><text>the owner of a

			 water storage right for a dam; or</text>

				</subparagraph><subparagraph id="idD8664BCBF1894C01B2A84C2AC4EF359D"><enum>(C)</enum><text>the owner of

			 rights-of-way under this Act or other Federal law.</text>

				</subparagraph></paragraph><paragraph id="IDD94C92561B38491FB6B4C4BEE60042C9"><enum>(4)</enum><header>Secretaries</header><text>The

			 term <term>Secretaries</term> means the Secretary of Agriculture and the

			 Secretary of Interior.</text>

			</paragraph><paragraph id="IDAE9E240C2126457A90EE9C00AE1DE8D7"><enum>(5)</enum><header>State</header><text>The

			 term <term>State</term> means the State of Montana.</text>

			</paragraph><paragraph id="ID36DB90946A7246569B33B52B405BCCA5"><enum>(6)</enum><header>Trail</header><text>The

			 term <term>trail</term> means a trail, access route, or primitive road in the

			 Forest in existence on the date of enactment of this Act.</text>

			</paragraph></section><section id="IDFAC2856D2FF44B879379792BE5F9586D"><enum>4.</enum><header>Rights-of-way</header>

			<subsection id="ID52A935D6C3304E5EB702D4851CAECD34"><enum>(a)</enum><header>In

			 general</header><text>Notwithstanding the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et

			 seq.), the <act-name parsable-cite="NEPA69">National Environmental Policy Act

			 of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.), or any

			 other provision of law, the Secretaries shall, on the date of enactment of this

			 Act, grant to the owners, for no consideration, rights-of-way—</text>

				<paragraph id="ID8053ECB6502042F6B308C7F955DD3579"><enum>(1)</enum><text>to the trails,

			 for purposes of providing access to any dams owned by the owner; and</text>

				</paragraph><paragraph id="ID2BC855E546DA46488EEB00C4B5C517E6"><enum>(2)</enum><text>to areas of the

			 Forest adjacent to any dams owned by the owner, for purposes of the

			 construction, reconstruction, maintenance, repair, and operation of the

			 dam.</text>

				</paragraph></subsection><subsection id="IDB8A68DE2FB3C4FB89B89EF17B5E9A711"><enum>(b)</enum><header>Boundaries</header>

				<paragraph id="IDC5B3DD1833CF4ED7A89EB76826034721"><enum>(1)</enum><header>In

			 general</header><text>As soon as practicable after the date of enactment this

			 Act, the owners shall, subject to paragraphs (2) and (3), prepare a map

			 establishing the boundaries of the rights-of-way granted under subsection

			 (a).</text>

				</paragraph><paragraph id="ID33A13A84E35A4AD1B7ED15FEF8922E68"><enum>(2)</enum><header>Trails</header><text>A

			 right-of-way granted under subsection (a)(1) shall extend at least 8 feet but

			 not more than 60 feet in width from the center of the trail.</text>

				</paragraph><paragraph id="IDAEA3559BE5264163B27E4C30D8CC30D4"><enum>(3)</enum><header>Adjacent

			 areas</header><text>A right-of-way granted under subsection (a)(2)—</text>

					<subparagraph id="IDF082578A64AE4979A6C5F5DFC2844369"><enum>(A)</enum><text>shall be to areas

			 of the Forest that are located not less than 50 feet nor more than 500 feet and

			 further than 500 feet from the highwater mark and downstream dam toe to include

			 additional area determined as necessary by the owner; and</text>

					</subparagraph><subparagraph id="IDC1B007EAFE034290897DF741FACE3458"><enum>(B)</enum><text>shall include the

			 least amount of land that is necessary, as determined by the State and owner,

			 for the owner to construct, reconstruct, maintain, repair, and operate the dam,

			 including borrow material, camp sites, pasture for pack and work animals, and

			 tool and equipment storage sites.</text>

					</subparagraph></paragraph></subsection><subsection id="ID544056A165D042E5A2AB905721A728D5"><enum>(c)</enum><header>Construction,

			 maintenance, and repair</header><text>An owner granted a right-of-way under

			 subsection (a)(1) may construct, maintain, and repair the right-of-way.</text>

			</subsection><subsection id="ID1A2A29E248FD400ABA629D3B902C14AE"><enum>(d)</enum><header>Authorized

			 uses</header>

				<paragraph id="IDAAD066CC67ED4236A7DD168E989FCCCB"><enum>(1)</enum><header>Motor

			 vehicles</header><text>Notwithstanding section 4(c) of the Wilderness Act

			 (<external-xref legal-doc="usc" parsable-cite="usc/16/1113">16 U.S.C.

			 1113</external-xref>), an owner may use motor vehicles, motorized and

			 mechanized equipment, and other forms of mechanized transport—</text>

					<subparagraph id="ID1D261652E2E041F9A58CCBE2DC1D11AB"><enum>(A)</enum><text>on the

			 rights-of-way granted under subsection (a); and</text>

					</subparagraph><subparagraph id="IDF8B15A4848814200A04FBB741BA22ECB"><enum>(B)</enum><text>at the owner’s

			 dam.</text>

					</subparagraph></paragraph><paragraph id="IDC9E22B88B7EC4E0FBCF32D45E8815D9B"><enum>(2)</enum><header>Aircraft</header><text>An

			 owner may operate aircraft in the airspace over the Forest to access the dam

			 and may land the aircraft on the rights-of-way.</text>

				</paragraph></subsection><subsection id="IDA545AE93A9C9477EAA61E8677F19E4CD"><enum>(e)</enum><header>Applicable

			 law</header><text>Any activities that are carried out by an owner in a

			 right-of-way granted under subsection (a) or for the purposes referred to in

			 subsection (a)(2)—</text>

				<paragraph id="ID21E3768BB3A3432C94D4C03140DF3DDC"><enum>(1)</enum><text>shall be

			 regulated by the State, in accordance with State law; and</text>

				</paragraph><paragraph id="IDBEFF69C4C2084BFCBF1F22BA1CB6EBD7"><enum>(2)</enum><text>shall not be

			 subject to—</text>

					<subparagraph id="IDA6380A7FF3D74332A300F6ECBBB5F959"><enum>(A)</enum><text>the Wilderness

			 Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C.

			 1131</external-xref> et seq.);</text>

					</subparagraph><subparagraph id="ID8EBC3F2815064787BAA86E22DDDB2DA2"><enum>(B)</enum><text>the

			 <act-name parsable-cite="NEPA69">National Environmental Policy Act of

			 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42

			 U.S.C. 4321</external-xref> et seq.);</text>

					</subparagraph><subparagraph id="ID0FD79940477A4DC09C95C882062CD249"><enum>(C)</enum><text>the National Dam

			 Safety Program Act (33 U.S.C. 467 et seq.);</text>

					</subparagraph><subparagraph id="ID5AE0D51168F748EEBA958C9610830033"><enum>(D)</enum><text>any other Federal

			 law establishing engineering and construction standards for dams; or</text>

					</subparagraph><subparagraph id="id0BE3C695E865482F96677B6BEF3CB964"><enum>(E)</enum><text>any other

			 provision of Federal law to protect fish and wildlife or maintain water quality

			 standards.</text>

					</subparagraph></paragraph></subsection><subsection id="ID352724397BE447C1B6514726FAE986AC"><enum>(f)</enum><header>Limitation on

			 liability</header><text>An owner of a dam shall not be liable for any claim or

			 damage that may arise from the conduct of activities to construct, maintain,

			 repair, and operate the dam, except any claim or damage that arises from the

			 negligence of the owner.</text>

			</subsection><subsection id="ID2E32EF8821E049E28D055279DD70B9D3"><enum>(g)</enum><header>Subsequent

			 conveyance</header><text>The rights-of-way granted under subsection (a) may be

			 subsequently conveyed by the owner without the consent of the

			 Secretaries.</text>

			</subsection><subsection id="IDE4D3BEFBD5E946D49B366498755EA857"><enum>(h)</enum><header>Termination</header><text>A

			 right-of-way granted to an owner under subsection (a) shall terminate if the

			 State determines, after notice to the owner and a hearing, that the owner has

			 not accessed or conducted activities at the dam for 10 consecutive

			 years.</text>

			</subsection><subsection id="IDEA961F1348474AA28300BF16C9628692"><enum>(i)</enum><header>Effect</header>

				<paragraph id="ID9C5D4F97ED424AE0AA51236E14DD5652"><enum>(1)</enum><header>Water

			 rights</header><text>Nothing in this Act affects or in any way interferes with

			 laws of the State relating to the control, appropriation, use, or distribution

			 of water used in irrigation or other beneficial purposes, or any vested right

			 acquired under State law, and the Secretaries shall proceed in conformity with

			 such laws in all land and water management activities under all

			 authorities.</text>

				</paragraph><paragraph changed="not-changed" commented="no" id="ID77E0FDE040DD4F74A538C855D74D5DAB"><enum>(2)</enum><header>Existing

			 rights-of-way</header><text>The rights-of-way granted under this Act shall be

			 in addition to any rights-of-way granted to an owner under section 18 of the

			 Act of March 3, 1891 (<external-xref legal-doc="usc" parsable-cite="usc/43/946">43 U.S.C. 946</external-xref>), sections 2339 and

			 2340 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/43/661">43 U.S.C. 661</external-xref>), or any other

			 provision of law.</text>

				</paragraph><paragraph changed="not-changed" commented="no" id="id0168AE5BED6C4831879799CEBDBEA9DA"><enum>(3)</enum><header>Compensable

			 claims</header><text>Any land and water management activities taken by the

			 Secretaries which interfere with the access to or exercise of water rights or

			 rights-of-way of the owner shall create in the owner a valid and compensable

			 takings claim.</text>

				</paragraph></subsection></section></legis-body>
