		<official-title>To improve the tracking of stolen firearms and firearms

		  used in a crime, to allow more frequent inspections of gun dealers to ensure

		  compliance with Federal gun law, to enhance the penalties for gun trafficking,

		  and for other purposes.</official-title>

		<section id="idB735E735200845508BEE5DAC9F178C01" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Anti-Gun Trafficking Penalties

			 Enhancement Act of 2006</short-title></quote>.</text>

		</section><section id="id4E4777F8866B407682A9F148B9FE7449"><enum>2.</enum><header>Firearms Trace

			 System</header>

			<subsection id="id8647A3DA66C346D6B6798490C4EF1F2E"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Science, State,

			 Justice, Commerce, and Related Agencies Appropriations Act, 2006 (Public Law

			 109–108) is amended in title I, under the heading <quote><header-in-text level="subsection" style="OLC">Bureau of Alcohol, Tobacco, Firearms and

			 Explosives</header-in-text></quote>, by striking <quote><italic>Provided

			 further, </italic>That no funds appropriated under this or any other Act with

			 respect to any fiscal year may be used to disclose part or all of the contents

			 of the Firearms Trace System database</quote> and all that follows through

			 <quote>section 921(a)(10) of such title):</quote>.</text>

			</subsection><subsection id="idBDAF1C7C38F744108F1747F39B63A3E5"><enum>(b)</enum><header>Requests for

			 information</header><text>Upon receipt of a written request from a State or

			 local government or law enforcement agency for information contained in the

			 Firearms Trace System database maintained by the National Trace Center of the

			 Bureau of Alcohol, Tobacco, Firearms and Explosives (or any successor database

			 or agency), the Attorney General shall provide all data in such database that

			 is responsive to such request for information.</text>

			</subsection></section><section id="id18C57E3D38904567B5D8E5BDF7D4A65D"><enum>3.</enum><header>Stolen

			 firearms</header>

			<subsection id="idD7BEA8E5884348C7A0901EE8492ED30F"><enum>(a)</enum><header>Definition</header><text>As

			 used in this section, the term <term>firearm</term> has the meaning given the

			 term by section 921 of title 18, United States Code.</text>

			</subsection><subsection id="id45B2577E04154044BA4EC2E991D0C25D"><enum>(b)</enum><header>Federal

			 officials</header><text>If a Federal law enforcement agency investigates the

			 commission of a crime and determines that a specific firearm is known to have

			 been stolen or to have been used in such crime, the agency shall provide

			 information regarding the firearm to the Bureau of Alcohol, Firearms, Tobacco,

			 and Explosives, for inclusion in the Firearms Trace System database.</text>

			</subsection><subsection id="id3413157D0F034422B7F54AD6E63730A3"><enum>(c)</enum><header>State and local

			 officials</header><text>Section 1702 of the Omnibus Crime Control and Safe

			 Streets Act of 1968 (42 U.S.C. 3796dd–1) is amended by adding at the end the

			 following:</text>

					<subsection id="id403F724DB3C74AE0898D2CBCE0F985DE"><enum>(e)</enum><header>Stolen

				firearms</header>

						<paragraph id="id8F9C2748761B42DB8695AE7E338F5206"><enum>(1)</enum><header>Definition</header><text>As

				used in this subsection, the term <term>firearm</term> has the meaning given

				the term by section 921 of title 18, United States Code.</text>

						</paragraph><paragraph id="id510A0A1CD2894F6C8F4E138D6864AE9C"><enum>(2)</enum><header>Reporting</header><text>If

				a State or local law enforcement agency receiving a grant under this part

				investigates the commission of a crime and determines that a specific firearm

				is known to have been stolen or to have been used in such crime, the agency

				shall provide information regarding the firearm to the Bureau of Alcohol,

				Firearms, Tobacco, and Explosives, for inclusion in the Firearms Trace System

				database.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection></section><section id="id407BDFB83CE5486CB4F5E84902770591"><enum>4.</enum><header>Inspections of

			 gun dealers</header><text display-inline="no-display-inline">Section

			 923(g)(1)(B)(ii) of title 18, United States Code, is amended by striking

			 subclause (I) and inserting the following:</text>

			<quoted-block display-inline="no-display-inline" id="idCB041FC71AAF4E4D81C71A45C1655CE0" style="OLC">

				<subclause id="idEE50F39F37F7428594A536A3068DA7FC" indent="up2"><enum>(I)</enum><text>at any time that the Attorney

				General may reasonably require;

				and</text>

				</subclause><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="ID95F38E49512045C482734814D5B359DA"><enum>5.</enum><header>Illegal firearms

			 trafficking</header>

			<subsection id="IDFC374B6DCBFB42329562228C476E9926"><enum>(a)</enum><header>Increased

			 maximum term of imprisonment</header><text>Section 924 of title 18, United

			 States Code, is amended—</text>

				<paragraph id="ID29B22B34D0534A00BD49DD4BF010C146"><enum>(1)</enum><text>in subsection

			 (a)(2)—</text>

					<subparagraph id="ID3F980E4127ED47CF85CC1FABFA2DB946"><enum>(A)</enum><text>by inserting

			 <quote>(A)</quote> after <quote>(2)</quote>;</text>

					</subparagraph><subparagraph id="IDD085B62F99DE477BB34D004FA6D9AD94"><enum>(B)</enum><text>by striking

			 <quote>(d),</quote>; and</text>

					</subparagraph><subparagraph id="ID26C77A0A55EB4B3CAE1D9259DF6EF2D4"><enum>(C)</enum><text>by adding at the

			 end the following:</text>

						<quoted-block id="ID642B9716EB7D44398CFC638DADF9012D">

							<subparagraph id="ID2E362755C6EB4E5189D7C03759E99C47" indent="up2"><enum>(B)</enum><text>Whoever knowingly violates subsection

				(d) of section 922 shall be fined under this title, imprisoned not more than 20

				years, or

				both.</text>

							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>

					</subparagraph></paragraph><paragraph id="ID4E314A6DC7DA4A6A8E76E263D1044500"><enum>(2)</enum><text>in subsection

			 (g), by striking <quote>10 years, fined in accordance with</quote> and

			 inserting <quote>20 years, fined under</quote>;</text>

				</paragraph><paragraph id="IDAC19CBFBF0E1434EB135E50624C4E746"><enum>(3)</enum><text>in subsection

			 (h), by striking <quote>10 years, fined in accordance with</quote> and

			 inserting <quote>20 years, fined under</quote>; and</text>

				</paragraph><paragraph id="IDE7436AD6730F46D781A09964A9A610EA"><enum>(4)</enum><text>in subsection

			 (n), by striking <quote>10 years</quote> and inserting <quote>20

			 years</quote>.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4FCD5F077AFA4699AA00CCAE5DE765FF"><enum>(b)</enum><header>Racketeering

			 activity</header><text>Section 1961(1) of title 18, United States Code, is

			 amended by inserting <quote>section 922(d) (relating to firearms sales to

			 ineligible persons), subsections (g), (h), and (n) of section 924 (relating to

			 illegal firearms trafficking),</quote> before <quote>section

			 1028</quote>.</text>
