			<header>Short title</header>

			<text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Federal Emergency Meth Lab Cleanup

			 Funding Act of 2005</short-title></quote>.</text>

			<enum>2.</enum>

			<header>Funding from treasury forfeiture fund</header>

			<text display-inline="no-display-inline">Chapter 97 of title 31, United

			 States Code, is amended—</text>

			<paragraph id="ID7B4B214216E64EDCA67C23692021E59F">

				<enum>(1)</enum>

				<text>by redesignating section 9703 (as added by

			 <external-xref legal-doc="public-law" parsable-cite="pl/103/62">Public Law

			 103–62</external-xref>) as section 9703A;</text>

			</paragraph><paragraph id="ID4550305185B04D6CB2FE39B6932E9724">

				<enum>(2)</enum>

				<text>by moving section 9703 (as added by

			 <external-xref legal-doc="public-law" parsable-cite="pl/102/393">Public Law

			 102–393</external-xref>) so as to appear after section 9702; and</text>

			</paragraph><paragraph id="ID718494B5BB8B44319A5145646ABD1C59">

				<enum>(3)</enum>

				<text>in section 9703(a)(1), by adding at the end the following:</text>

					<subparagraph id="ID34D5DFD44752441889426EAAEDAA5E44">

						<enum>(K)</enum>

						<clause commented="no" display-inline="yes-display-inline" id="IDC4757FB1D14347D8A2034D2B34176067"><enum>(i)</enum>

							<text>Payment to the designated State, local, or tribal law

				enforcement, environmental, or health entity for experts and consultants needed

				to clean up any area formerly used as a methamphetamine laboratory.</text>

						</clause><clause id="ID10882C6BB62E4EA2939FDC3E72BE2F76" indent="up1">

							<enum>(ii)</enum>

							<text>If a methamphetamine laboratory is located on private property,

				not more than 90 percent of the costs may be paid only if—</text>

							<subclause id="ID6BBBB9D0A1B649F6919687C7FBA86647">

								<enum>(I)</enum>

								<text>the property owner did not have knowledge of the existence or

				operation of such laboratory before the law enforcement action to close it;

				or</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID2C39EA32F4544926A6406A964E50A33D"><enum>(II)</enum><text>the property owner notifies law

				enforcement not later than 24 hours after discovering the existence of such

				laboratory.</text>
