		<official-title display="yes">To enhance the management and disposal of

		  spent nuclear fuel and high-level radioactive waste, to ensure protection of

		  public health and safety, to ensure the territorial integrity and security of

		  the repository at Yucca Mountain, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Nuclear Fuel Management and Disposal

			 Act</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="id4B41DDA6851946AB9DC50385664FB667" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDcfe7c6c7f11e4d32bbeac71cb6806119"><enum>(a)</enum><header>Definitions

			 from Nuclear Waste Policy Act of 1982</header><text display-inline="yes-display-inline">In this Act, the terms

			 <term>Commission</term>, <term>disposal</term>, <term>Federal agency</term>,

			 <term>high-level radioactive waste</term>, <term>repository</term>,

			 <term>Secretary</term>, <term>State</term>, <term>spent nuclear fuel</term>,

			 and <term>Yucca Mountain site</term> have the meaning given those terms in

			 section 2 of the Nuclear Waste Policy Act of 1982 (42 U.S.C. 10101).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id240348340C6F4ED696630B9B2470DF6E"><enum>(b)</enum><header>Other

			 definitions</header><text display-inline="yes-display-inline">In this

			 Act:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID40ef4074615e49cc8a459c941846f681"><enum>(1)</enum><header>Project</header><text display-inline="yes-display-inline">The term <term>Project</term> means the

			 Yucca Mountain Project.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcb985a7c2abd46508b171ce78d11bb18"><enum>(2)</enum><header>Secretary

			 concerned</header><text display-inline="yes-display-inline">The term

			 <term>Secretary concerned</term> means the Secretary of the Air Force or the

			 Secretary of the Interior, or both, as appropriate.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC0B4AB8CFF94457B9D39A0E234198613"><enum>(3)</enum><header>Withdrawal</header><text display-inline="yes-display-inline">The term <term>Withdrawal</term> means the

			 withdrawal under section 3(a)(1) of the geographic area consisting of the land

			 described in section 3(c).</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID2ad026f490c34cccbd190ebfc4e3df25" section-type="subsequent-section"><enum>3.</enum><header>Land withdrawal and

			 reservation</header>

			<subsection commented="no" display-inline="no-display-inline" id="id71FD94C30AB44C99841F8652F331F551"><enum>(a)</enum><header>Land

			 withdrawal, jurisdiction, and reservation</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id34C40FD87F0D4A4AA68D16B0C56A358F"><enum>(1)</enum><header>Land

			 withdrawal</header><text display-inline="yes-display-inline">Subject to valid

			 existing rights and except as provided otherwise in this Act, the land

			 described in subsection (c) is withdrawn permanently from all forms of entry,

			 appropriation, and disposal under the public land laws, including, without

			 limitation, the mineral leasing laws, geothermal leasing laws, and mining

			 laws.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf1899761825c4f718c0b7b191ed94dad"><enum>(2)</enum><header>Jurisdiction</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="id971193ED752C427CBC96EFF6BDEA2B1B"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as otherwise

			 provided in this Act, the Secretary shall have jurisdiction over the

			 Withdrawal.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD96572FB71814D7E98D7E22B59BDD329"><enum>(B)</enum><header>Transfer</header><text display-inline="yes-display-inline">There is transferred to the Secretary the

			 land covered by the Withdrawal that is under the jurisdiction of the Secretary

			 concerned on the date of enactment of this Act.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcdcb0e3c004a48088214bfcd01c839c9"><enum>(3)</enum><header>Reservation</header><text display-inline="yes-display-inline">The land covered by the Withdrawal is

			 reserved for use by the Secretary for the development, preconstruction testing

			 and performance confirmation, licensing, construction, management and

			 operation, monitoring, closure, post-closure, and other activities associated

			 with the disposal of high-level radioactive waste and spent nuclear fuel under

			 the Nuclear Waste Policy Act of 1982 (42 U.S.C. 10101 et seq.).</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0b35083f7dba48eba8f484f1521c21bf"><enum>(b)</enum><header>Revocation and

			 modification of public land orders and rights-of-way</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id556AB53D75EA4BC2AFED862A71ED621A"><enum>(1)</enum><header>Public land

			 order revocation</header><text display-inline="yes-display-inline">Public Land

			 Order 6802 of September 25, 1990, as extended by Public Land Order 7534, and

			 any conditions or memoranda of understanding accompanying those land orders,

			 are revoked.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8671e167f88b4abdabfcb59120c1aa21"><enum>(2)</enum><header>Right of way

			 reservations</header><text display-inline="yes-display-inline">Project

			 right-of-way reservations N–48602 and N–47748 of January 5, 2001, are

			 revoked.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID64a135324111420ebc3183cbfe992019"><enum>(c)</enum><header>Land

			 description</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idE1C867A1E43F45A3A69CB8B07C2B7100"><enum>(1)</enum><header>Boundaries</header><text display-inline="yes-display-inline">The land and interests in land covered by

			 the Withdrawal and reserved by this Act comprise the approximately 147,000

			 acres of land in Nye County, Nevada, as generally depicted on the Yucca

			 Mountain Project Map, YMP–03–024.2, entitled <quote>Proposed Land

			 Withdrawal</quote> and dated July 21, 2005.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id88FCE63191AA4876ABDEB4B92EF4E0AD"><enum>(2)</enum><header>Legal

			 description and map</header><text display-inline="yes-display-inline">As soon

			 as practicable after the date of enactment of this Act, the Secretary of the

			 Interior shall—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID1151dc2ee6e745c98b12c9958091dba2"><enum>(A)</enum><text display-inline="yes-display-inline">publish in the Federal Register a notice

			 containing a legal description of the land covered by the Withdrawal;

			 and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID57c36333e1c84c1281adb05fbde1fb17"><enum>(B)</enum><text display-inline="yes-display-inline">file copies of the maps described in

			 paragraph (1) and the legal description of the land covered by the Withdrawal

			 with Congress, the Governor of the State of Nevada, and the Archivist of the

			 United States.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID32976a044ccc4800b3245627b555f777"><enum>(3)</enum><header>Technical

			 corrections</header><text display-inline="yes-display-inline">The maps and

			 legal description referred to in this subsection have the same force and effect

			 as if included in this Act, except that the Secretary of the Interior may

			 correct clerical and typographical errors in the maps and legal

			 description.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe5b270e185a947be876e78843d5c1c53"><enum>(d)</enum><header>Relationship to

			 other reservations</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id625D49BAE1BA495E93CB9CFED35894D9"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Subtitle A of title

			 XXX of the Military Lands Withdrawal Act of 1999 (Public Law 106–65; 113 Stat.

			 885) and Public Land Order 2568 do not apply to the land covered by the

			 Withdrawal and reserved by subsection (a).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id354EDA8D83F64C4D86385DEDCAC10A15"><enum>(2)</enum><header>Other withdrawn

			 land</header><text display-inline="yes-display-inline">This Act does not apply

			 to any other land withdrawn for use by the Department of Defense under subtitle

			 A of title XXX of the Military Lands Withdrawal Act of 1999.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID775434d9d44a41b998322a53aff6be36"><enum>(e)</enum><header>Management

			 responsibilities</header>

				<paragraph commented="no" display-inline="no-display-inline" id="IDd73c9d1d7b5c462a97db0934fba64000"><enum>(1)</enum><header>General

			 authority</header><text display-inline="yes-display-inline">The Secretary, in

			 consultation with the Secretary concerned, as applicable, shall manage the land

			 covered by the Withdrawal in accordance with the Federal Land Policy and

			 Management Act of 1976 (43 U.S.C. 1701 et seq.), this Act, and other applicable

			 law.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDea61ec235f584783be2e1c16f2c5beac"><enum>(2)</enum><header>Management

			 plan</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDe0804a2472a549f78792e0bef19a3326"><enum>(A)</enum><header>Development</header><text display-inline="yes-display-inline">Not later than 3 years after the date of

			 enactment of this Act, the Secretary, after consultation with the Secretary

			 concerned, shall develop and submit to Congress and the State of Nevada a

			 management plan for the use of the land covered by the Withdrawal.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID38601e7f82ad4afa974f0cfd07a5405d"><enum>(B)</enum><header>Priority of

			 Yucca mountain project-related issues</header><text display-inline="yes-display-inline">Subject to subparagraphs (C), (D), and (E),

			 any use of the land covered by the Withdrawal for activities not associated

			 with the Project is subject to such conditions and restrictions as the

			 Secretary considers to be necessary or desirable to permit the conduct of

			 Project-related activities.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9cf0374d092c4fcf933fa673380bdef4"><enum>(C)</enum><header>Department of

			 the air force uses</header><text display-inline="yes-display-inline">The

			 management plan may provide for the continued use by the Department of the Air

			 Force of the portion of the land covered by the Withdrawal within the Nellis

			 Air Force Base Test and Training Range under terms and conditions on which the

			 Secretary and the Secretary of the Air Force agree with respect to Air Force

			 activities.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd2ff222e270a4c5aa9676974b8bd8300"><enum>(D)</enum><header>Nevada test

			 site uses</header><text display-inline="yes-display-inline">The Secretary

			 may—</text>

						<clause commented="no" display-inline="no-display-inline" id="id46F306DE0C3240E1B635C203E8C43167"><enum>(i)</enum><text display-inline="yes-display-inline">permit the National Nuclear Security

			 Administration to continue to use the portion of the land covered by the

			 Withdrawal on the Nevada Test Site; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="idF6DA5CA0ECFA479C9B98A1FDE793F7EE"><enum>(ii)</enum><text display-inline="yes-display-inline">impose any conditions on that use that the

			 Secretary considers to be necessary to minimize any effect on Project or

			 Administration activities.</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdbf838f7ae1f4aceb0299cd1ff5b0cb4"><enum>(E)</enum><header>Other non-yucca

			 mountain project uses</header>

						<clause commented="no" display-inline="no-display-inline" id="id7F00DDC42AC24113A957165EB7C00EF0"><enum>(i)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The management plan

			 shall provide for the maintenance of wildlife habitat and the permitting by the

			 Secretary of non-Project-related uses that the Secretary considers to be

			 appropriate, including domestic livestock grazing and hunting and trapping in

			 accordance with clauses (ii) and (iii).</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID5489550f60ce4f628d0d4cd9b131e1aa"><enum>(ii)</enum><header>Grazing</header><text display-inline="yes-display-inline">Subject to regulations, policies, and

			 practices that the Secretary, after consultation with the Secretary of the

			 Interior, determines to be necessary or appropriate, the Secretary may permit

			 grazing on land covered by the Withdrawal to continue on areas on which grazing

			 was established before the date of enactment of this Act, in accordance with

			 applicable grazing laws and policies, including—</text>

							<subclause commented="no" display-inline="no-display-inline" id="id7084F474DD1B44F7A6091797B4F422D1"><enum>(I)</enum><text display-inline="yes-display-inline">the Act of June 28, 1934 (commonly known as

			 the <quote>Taylor Grazing Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/315">43 U.S.C. 315</external-xref> et seq.);</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDac49d7c4183e456b9247e06122b43a15"><enum>(II)</enum><text display-inline="yes-display-inline">title IV of the Federal Land Policy

			 Management Act of 1976 (43 U.S.C. 1751 et seq.); and</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID46535a9cf94c437ea648654b44a9c019"><enum>(III)</enum><text display-inline="yes-display-inline">the Public Rangelands Improvement Act of

			 1978 (43 U.S.C. 1901 et seq.).</text>

							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDbd8777e1e350407aa8154e1d2c488008"><enum>(iii)</enum><header>Hunting and

			 trapping</header><text display-inline="yes-display-inline">The Secretary may

			 permit hunting and trapping on land covered by the Withdrawal on areas in which

			 hunting and trapping were permitted on the day before the date of enactment of

			 this Act, except that the Secretary, after consultation with the Secretary of

			 the Interior and the State of Nevada, may designate zones in which, and

			 establish periods during which, no hunting or trapping is permitted for reasons

			 of public safety, national security, administration, or public use and

			 enjoyment.</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID477b887796e240ca874c41ee9f2bbd97"><enum>(F)</enum><header>Mining</header>

						<clause commented="no" display-inline="no-display-inline" id="ID87b8577f47f747e5b88d87edefcfa54c"><enum>(i)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as provided in

			 subparagraph (B), surface or subsurface mining or oil or gas production,

			 including slant drilling from outside the boundaries of the land covered by the

			 Withdrawal, is not permitted at any time on or under the land covered by the

			 Withdrawal.</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id26C1F8AEB1644F6585E6131731677E1C"><enum>(ii)</enum><header>Validity of

			 claims</header><text display-inline="yes-display-inline">The Secretary of the

			 Interior shall evaluate and adjudicate the validity of all mining claims on the

			 portion of land covered by the Withdrawal that, on the date of enactment of

			 this Act, was under the control of the Bureau of Land Management.</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id9911B538B7A74BB097A7057321982D8C"><enum>(iii)</enum><header>Compensation</header><text display-inline="yes-display-inline">The Secretary shall provide just

			 compensation for the acquisition of any valid property right.</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID866c6a78cf2e414f8bbee2e23990db66"><enum>(iv)</enum><header>Cind-r-lite

			 mine</header>

							<subclause commented="no" display-inline="no-display-inline" id="id84D7363DC2AE4B9E900C71C3F0F87024"><enum>(I)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Patented Mining Claim

			 No. 27–83–0002, covering the Cind-R-Lite mine, shall not be affected by

			 establishment of the Withdrawal, unless the Secretary, after consultation with

			 the Secretary of the Interior, determines that the acquisition of the mine is

			 required in furtherance of the reserved use of the land covered by the

			 Withdrawal described in subsection (a)(3).</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="idE07F8161929346D99A7F7BB05CB934AB"><enum>(II)</enum><header>Compensation</header><text display-inline="yes-display-inline">If the Secretary determines that the

			 acquisition of the mine described in subclause (I) is required, the Secretary

			 shall provide just compensation for acquisition of the mine.</text>

							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2db048b81b13449e8cd1ebb4409b3572"><enum>(G)</enum><header>Limited public

			 access</header><text display-inline="yes-display-inline">The management plan

			 may provide for limited public access to and use of the portion of the land

			 covered by the Withdrawal that is under the jurisdiction of the Bureau of Land

			 Management on the date of enactment of this Act, including for—</text>

						<clause commented="no" display-inline="no-display-inline" id="id5D9C48B39B2D4427BB6EC119B6891BBC"><enum>(i)</enum><text display-inline="yes-display-inline">continuation of the Nye County Early

			 Warning Drilling Program;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id22F0E9BF13E14548AA28CDB54F4C8D56"><enum>(ii)</enum><text display-inline="yes-display-inline">utility corridors; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id8F52DB4CAA404FBA842C5FA02A58A595"><enum>(iii)</enum><text display-inline="yes-display-inline">such other uses as the Secretary, after

			 consultation with the Secretary of the Interior, considers to be consistent

			 with the purposes of the Withdrawal.</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3064579a3b524a9cac4249f969eb6b33"><enum>(H)</enum><header>Closure</header><text display-inline="yes-display-inline">If the Secretary, after consultation with

			 the Secretary concerned, determines that the health or safety of the public or

			 the common defense or security requires the closure of a road, trail, or other

			 portion of land covered by the Withdrawal, or the airspace above land covered

			 by the Withdrawal, the Secretary—</text>

						<clause commented="no" display-inline="no-display-inline" id="id391F36ECA60D497B86737AE3699823CE"><enum>(i)</enum><text display-inline="yes-display-inline">may close the portion of land or the

			 airspace; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="idB6DB71DCB291400984428C9101F505DD"><enum>(ii)</enum><text display-inline="yes-display-inline">shall provide public notice of the

			 closure.</text>

						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7e0b25d979e143648a041a397deee361"><enum>(3)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Secretary and the Secretary concerned

			 shall implement the management plan developed under paragraph (2) in accordance

			 with terms and conditions on which the Secretary and the Secretary concerned

			 jointly agree.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDb058e5856d294392ad2be44e6b3a1cd8"><enum>(f)</enum><header>Immunity</header><text display-inline="yes-display-inline">The United States (including each

			 department and agency of the Federal Government) shall be held harmless, and

			 shall not be liable, for damages to a person or property suffered in the course

			 of any mining, mineral leasing, or geothermal leasing activity conducted on the

			 land covered by the Withdrawal.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID685820fc1748490993f22bb07d5c6478"><enum>(g)</enum><header>Land

			 acquisition</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idE133296BCCCF484B8E3345DBF4ABD1BC"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary may

			 acquire land, and interests in land within the land, covered by the

			 Withdrawal.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id962B674B766A414DB4AB36431B6F9C1B"><enum>(2)</enum><header>Method of

			 acquisition</header><text display-inline="yes-display-inline">Land and

			 interests in land described in paragraph (1) may be acquired by donation,

			 purchase, lease, exchange, easement, right-of-way, or other appropriate methods

			 using donated or appropriated funds.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id014472656B414EFCBC0C428993FFE969"><enum>(3)</enum><header>Exchange of

			 land</header><text display-inline="yes-display-inline">The Secretary of the

			 Interior shall conduct any exchange of land covered by the Withdrawal for

			 Federal land not covered by the Withdrawal.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID50e185d15d3e4bda98691f01a6aab57f" section-type="subsequent-section"><enum>4.</enum><header>Application procedures

			 and infrastructure activities</header>

			<subsection commented="no" display-inline="no-display-inline" id="idE9F307CC78A3471BB9E818E8B32A25CE"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">Section 114(b) of the Nuclear Waste Policy

			 Act of 1982 (42 U.S.C. 10134(b)) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id47F20EAAEED54E3E86B90BFD7FDC2758"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>If the President</quote>

			 and inserting the following:</text>

					<quoted-block display-inline="no-display-inline" id="id3D46B3E7ECB3462DB025EB27544D4477" style="OLC">

						<paragraph commented="no" display-inline="no-display-inline" id="id8EF83FDF62604D888C62DF709399786F"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">If the

				President</text>

						</paragraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6C8DF38463264D50AAED130A9847B9D0"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following</text>

			 procedures and infrastructure activities</header><text display-inline="yes-display-inline">Section 114(d) of the Nuclear Waste Policy

			 Act of 1982 (42 U.S.C. 10134(d)) is amended—</text>

				approves an application for construction authorization and the Secretary

				submits an application to amend the authorization to obtain permission to

				receive and possess spent nuclear fuel and high-level radioactive waste, or to

				undertake any other action concerning the repository, the Commission shall

				consider the application using expedited, informal procedures, including

				discovery procedures that minimize the burden on the parties to produce

				documents that the Commission does not need to render a decision on an action

				under this section.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id18A0058DA2DE4618AF17476554846098"><enum>(B)</enum><header>Final

				decision</header><text display-inline="yes-display-inline">The Commission shall

				issue a final decision on whether to grant permission to receive and possess

				spent nuclear fuel and high-level radioactive waste, or on any other

				application, by the date that is 1 year after the date of submission of the

				application, except that the Commission may extend that deadline by not more

				than 180 days if, not less than 30 days before the deadline, the Commission

				complies with the reporting requirements under subsection (e)(2).</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID67b045a09124483b9942ec623cbf5977"><enum>(3)</enum><header>Infrastructure

				activities</header>

							<subparagraph commented="no" display-inline="no-display-inline" id="id4CB37B6E779F41F3B383E7D106327AC5"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">At any time before or

				after the Commission issues a final decision on an application from the

				Secretary for construction authorization under this subsection, the Secretary

				may undertake infrastructure activities that the Secretary determines to be

				necessary or appropriate to support construction or operation of a repository

				at the Yucca Mountain site or transportation to the Yucca Mountain site of

				spent nuclear fuel and high level radioactive waste, including infrastructure

				activities such as—</text>

								<clause commented="no" display-inline="no-display-inline" id="idD2226914D2B746E796DCC2BB52339FBB"><enum>(i)</enum><text display-inline="yes-display-inline">safety upgrades;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="idC18E01F3184E446A999E657033191885"><enum>(ii)</enum><text display-inline="yes-display-inline">site preparation;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="idC8B7203FA43149FA881B66154F25358B"><enum>(iii)</enum><text display-inline="yes-display-inline">the construction of a rail line to connect

				the Yucca Mountain site with the national rail network, including any

				facilities to facilitate rail operations; and</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="id837DD4D56D9B46B1B54BD7B3711671AF"><enum>(iv)</enum><text display-inline="yes-display-inline">construction, upgrade, acquisition, or

				operation of electrical grids or facilities, other utilities, communication

				facilities, access roads, rail lines, and non-nuclear support

				facilities.</text>

								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06647A3047A14FD1AE965F5ED117D670"><enum>(B)</enum><header>Compliance</header>

								<clause commented="no" display-inline="no-display-inline" id="id8936BA1BE49444DBAA0B16E28D6AD76A"><enum>(i)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Secretary shall

				comply with all applicable requirements under the National Environmental Policy

				Act of 1969 (42 U.S.C. 4321 et seq.) with respect to an infrastructure activity

				undertaken under this paragraph.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="idEE473305F13743E19E0796D3523F7AA8"><enum>(ii)</enum><header>EIS</header><text display-inline="yes-display-inline">If the Secretary determines that an

				environmental impact statement or similar analysis under the National

				Environmental Policy Act of 1969 is required in connection with an

				infrastructure activity undertaken under this paragraph, the Secretary shall

				not be required to consider the need for the action, alternative actions, or a

				no-action alternative.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="idCEDA398E4468431395D41465561AC5B8"><enum>(iii)</enum><header>Other

				agencies</header>

									<subclause commented="no" display-inline="no-display-inline" id="id1A9E0F7E32854762B6805BCAA8604CC5"><enum>(I)</enum><header>In

				general</header><text display-inline="yes-display-inline">To the extent that a

				Federal agency is required to consider the potential environmental impact of an

				infrastructure activity undertaken under this paragraph, the Federal agency

				shall adopt, to the maximum extent practicable, an environmental impact

				statement or similar analysis prepared under this paragraph without further

				action.</text>

									</subclause><subclause commented="no" display-inline="no-display-inline" id="idEDEF9D91E84D48AFB0596B36D997E05F"><enum>(II)</enum><header>Effect of

				adoption of statement</header><text display-inline="yes-display-inline">Adoption of an environmental impact

				statement or similar analysis described in subclause (I) shall be considered to

				satisfy the responsibilities of the adopting agency under the National

				Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.), and no further

				action for the activity covered by the statement or analysis shall be required

				by the agency.</text>

									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0AA292C3BCC944FC93A8522DE98122CD"><enum>(C)</enum><header>Denials of

				authorization</header><text display-inline="yes-display-inline">The Commission

				may not deny construction authorization, permission to receive and possess

				spent nuclear fuel or high-level radioactive waste, or any other action

				concerning the repository on the ground that the Secretary undertook an

				infrastructure activity under this

				paragraph.</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID420bac0838db4b7093522dab0fc30df5"><enum>(c)</enum><header>Connected

			 actions</header><text display-inline="yes-display-inline">Section 114(f)(6) of

			 the Nuclear Waste Policy Act of 1982 (42 U.S.C. 10134(f)(6)) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idAADBDD58B1184FF9B925E7F338216AD8"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95E0CFFF99894DEF94F38581DCC44251"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting before the period at the end

			 the following: <quote>, or an action connected or otherwise relating to the

			 repository, to the extent the action is undertaken outside the geologic

			 repository operations area and does not require a license from the

			 Commission</quote>.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc8a0eb74f8a94f55aa306cd4b38edc17"><enum>(d)</enum><header>Expedited

			 authorizations</header><text display-inline="yes-display-inline">Section 120 of

			 the Nuclear Waste Policy Act of 1982 (42 U.S.C. 10140) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDf62f59ae27b04cf0a624f8f8f374f20e"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id42344E3BC00E414783F2361BD4F3D7EB"><enum>(A)</enum><text display-inline="yes-display-inline">in the first sentence, by inserting

			 <quote>, or the conduct of an infrastructure activity,</quote> after

			 <quote>repository</quote>;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD05BD84DF9B1464FA406C70BC68A2FAF"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>, State, local, or

			 tribal</quote> after <quote>Federal</quote> each place it appears; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0BBE850D284648179C0EE04E9408152A"><enum>(C)</enum><text display-inline="yes-display-inline">in the second sentence, by striking

			 <quote>repositories</quote> and inserting <quote>a repository or infrastructure

			 activity</quote>;</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID63a8855ee03647aab206c1d352fbf051"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>, and

			 may include terms and conditions permitted by law</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6c1912c355c3431ab60d876616e645ab"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="id0B42B18F9CE64FDDA1696009144241A6" style="OLC">

						<subsection commented="no" display-inline="no-display-inline" id="idD4D46E58A48E4E1BB147BD066B1CE092"><enum>(c)</enum><header>Failure to

				grant authorization</header><text display-inline="yes-display-inline">An agency

				or officer that fails to grant authorization by the date that is 1 year after

				the date of receipt of an application or request from the Secretary subject to

				subsection (a) shall submit to Congress a written report that explains the

				reason for not meeting that deadline or rejecting the application or

				request.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID81afe19e028e447c9f46094054d7116a"><enum>(d)</enum><header>Treatment of

				actions</header><text display-inline="yes-display-inline">For the purpose of

				applying any Federal, State, local, or tribal law or requirement, the taking of

				an action relating to a repository or an infrastructure activity shall be

				considered to be—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="id827FAA6CE12041DBAA7901886A12905C"><enum>(1)</enum><text display-inline="yes-display-inline">beneficial, and not detrimental, to the

				public interest and interstate commerce; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0532792C71264B098920B057777FF979"><enum>(2)</enum><text display-inline="yes-display-inline">consistent with the public convenience and

				necessity.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID999956fc7cd3446c9d3f334696cb7c19" section-type="subsequent-section"><enum>5.</enum><header>Nuclear waste

			 fund</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDd696587b451d4c349e379a1c5cb82182"><enum>(a)</enum><header>Crediting

			 fees</header><text display-inline="yes-display-inline">Beginning on October 1,

			 2007, and continuing through the end of the fiscal year during which

			 construction is completed for the Nevada rail line and surface facilities for

			 the fully operational repository described in the license application, fees

			 collected by the Secretary and deposited in the Nuclear Waste Fund established

			 by section 302(c) of the Nuclear Waste Policy Act of 1982 (42 U.S.C. 10222(c))

			 shall be credited to the Nuclear Waste Fund as discretionary offsetting

			 collections each year in amounts not to exceed the amounts appropriated from

			 the Nuclear Waste Fund for that year.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID723adafb83434235a85809ccd814c2c6"><enum>(b)</enum><header>Fund

			 uses</header><text display-inline="yes-display-inline">Section 302(d)(4) of the

			 Nuclear Waste Policy Act of 1982 (42 U.S.C. 10222(d)(4)) is amended by

			 inserting after <quote>with</quote> the following: <quote>infrastructure

			 activities that the Secretary determines to be necessary or appropriate to

			 support construction or operation of a repository at the Yucca Mountain site or

			 transportation to the Yucca Mountain site of spent nuclear fuel and high-level

			 radioactive waste, and</quote>.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID4cbfe545d7fe4b219bad4c9d23db4954" section-type="subsequent-section"><enum>6.</enum><header>Regulatory

			 requirements</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID6311fff53b7549e6ad817966cb46fceb"><enum>(a)</enum><header>Material

			 requirements</header><text display-inline="yes-display-inline">Notwithstanding

			 any other provision of law, no Federal, State, interstate, or local

			 requirement, either substantive or procedural, that is referred to in section

			 6001(a) of the Solid Waste Disposal Act (42 U.S.C. 6961(a)), applies to—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID755973f6a32141c0a4ffbfd1b8a0f6a3"><enum>(1)</enum><text display-inline="yes-display-inline">any material owned by the Secretary, if the

			 material is transported or stored in a package, cask, or other container that

			 the Commission has certified for transportation or storage of that type of

			 material; or</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa5e51a58fe4749799721da06e37f38f7"><enum>(2)</enum><text display-inline="yes-display-inline">any material located at the Yucca Mountain

			 site for disposal, if the management and disposal of the material is subject to

			 a license issued by the Commission.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9fbd9259f22749ef9c8a2e579e3fcefa"><enum>(b)</enum><header>Permits</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id9962D85DCE454526BE2DDBFAF545929A"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Environmental

			 Protection Agency shall be the permitting agency for purposes of issuing,

			 administering, or enforcing any new or existing air quality permit or

			 requirement applicable to a Federal facility or activity relating to the

			 Withdrawal that is subject to the Nuclear Waste Policy Act of 1982 (42 U.S.C.

			 10101 et seq.).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id77618BE84A99440EB0B5FFCA9B05EDBE"><enum>(2)</enum><header>State and local

			 activity</header><text display-inline="yes-display-inline">A State or unit of

			 local government shall not issue, administer, or enforce a new or existing air

			 quality permit or requirement affecting a Federal facility or activity that

			 is—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id052049005E814764944179E4B1F62150"><enum>(A)</enum><text display-inline="yes-display-inline">located on the land covered by the

			 Withdrawal; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEDDDD117885740248966F462D3F5D145"><enum>(B)</enum><text display-inline="yes-display-inline">subject to the Nuclear Waste Policy Act of

			 1982 (42 U.S.C. 10101 et seq.).</text>

					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idA1D473C5D62848A38E9F883DB3ED4B22" section-type="subsequent-section"><enum>7.</enum><header>Transportation</header><text display-inline="no-display-inline">The Nuclear Waste Policy Act of 1982 is

			 amended by inserting after section 180 (42 U.S.C. 10175) the following:</text>

			<quoted-block display-inline="no-display-inline" id="idD4223F9B56684CB389A419AE981900FA" style="OLC">

				<section commented="no" display-inline="no-display-inline" id="IDe7600d7cc0db4164962fe131f87a9dbc" section-type="subsequent-section"><enum>181.</enum><header>Transportation</header>

					<subsection commented="no" display-inline="no-display-inline" id="idC27BF7CB4DD34E7FA9F7018E6D156022"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Secretary may

				determine the extent to which any transportation required to carry out the

				duties of the Secretary under this Act that is regulated under the Hazardous

				Materials Transportation Authorization Act of 1994 (title I of Public Law

				103–311; 108 Stat. 1673) and amendments made by that Act shall instead be

				regulated exclusively under the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011</external-xref> et

				seq.).</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1eaddacbc0c34cb9a1785870e43e6642"><enum>(b)</enum><header>Determination

				of preemption</header><text display-inline="yes-display-inline">On request by

				the Secretary, the Secretary of Transportation may determine, pursuant to

				section 5125 of title 49, United States Code, that any requirement of a State,

				political subdivision of a State, or Indian tribe regarding transportation

				carried out by or on behalf of the Secretary in carrying out this Act is

				preempted, regardless of whether the transportation otherwise is or would be

				subject to regulation under the Hazardous Materials Transportation

				Authorization Act of 1994 (title I of Public Law 103–311; 108 Stat.

				1673).</text>

					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section commented="no" display-inline="no-display-inline" id="IDffcdab5bb511477ba9af9b703ce7a051" section-type="subsequent-section"><enum>8.</enum><header> Consideration of

			 effect of acquisition of water rights</header><text display-inline="no-display-inline">Section 124 of the Nuclear Waste Policy Act

			 of 1982 (42 U.S.C. 10144) is amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="id7942FC89946C4B28B85EEB3A9DEC00D1"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the section heading and all

			 that follows through <quote>The Secretary</quote> and inserting the

			 following:</text>

				of water</header>

						<paragraph commented="no" display-inline="no-display-inline" id="idB28F919094134A4090AF873DBD67A77F"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">Notwithstanding any

				other Federal, State, or local law, the use of water from any source in

				quantities sufficient to accomplish the purposes of this Act and to carry out

				functions of the Department under this Act shall be considered to be a use

				that—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="id50BD83E267A74FEAB15DC6C917C76B48"><enum>(A)</enum><text display-inline="yes-display-inline">is beneficial to interstate commerce;

				and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8DB2F260AEE845508A09D962FC8CEC32"><enum>(B)</enum><text display-inline="yes-display-inline">does not threaten to prove detrimental to

				the public interest.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0BF80A7538EF4C26A505B7D0E34FA2C3"><enum>(2)</enum><header>Conflicting

				state laws</header><text display-inline="yes-display-inline">A State shall not

				enact or apply a law that discriminates against a use described in paragraph

				(1).</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4EB3AEDF5ADB4124B9A411EF67DC2584"><enum>(3)</enum><header>Acquisition of

				water rights</header><text display-inline="yes-display-inline">The Secretary,

				through purchase or other means, may obtain water rights necessary to carry out

				functions of the Department under this

				Act.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID286be82fcf20481f8d6619622c02cf73" section-type="subsequent-section"><enum>9.</enum><header>Confidence in

			 availability of waste disposal</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,

			 in deciding whether to permit the construction or operation of a nuclear

			 reactor or any related facilities, the Commission shall deem, without further

			 consideration, that sufficient capacity will be available in a timely manner to

			 dispose of the spent nuclear fuel and high-level radioactive waste resulting

			 from the operation of the reactor and related facilities.</text>
