		  Act of 2003 to help reduce the increased risk of severe wildfires to

		  communities in forested areas affected by infestations of bark beetles and

		  other insects, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Rocky

			 Mountain Forest Insects Response Enhancement and Support Act</quote> or the

			 <quote>Rocky Mountain FIRES Act</quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="idE5879454BC0946D29A747EB165D48789" section-type="subsequent-section"><enum>2.</enum><header>Findings;

			 purpose</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID2b3f0195c5174b329c97ee875ff54968"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID2cf619902a28481e95b49b834e8f14a0"><enum>(1)</enum><text display-inline="yes-display-inline">fire beetles, bark beetles, and other

			 insects that feed on trees are—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id89A8EADD84D4418D9DBB1BD1424209FE"><enum>(A)</enum><text display-inline="yes-display-inline">natural parts of the Rocky Mountain forest

			 ecology; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5320A67347E8477CA3A7D78ED48EA733"><enum>(B)</enum><text display-inline="yes-display-inline">shape the forest in a beneficial manner by

			 thinning dense tree stands and promoting cyclical re-growth;</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDea2eef0182e34ab7acd96e35eca14427"><enum>(2)</enum><text display-inline="yes-display-inline">in various parts of the Rocky Mountain

			 region large-scale infestations of bark beetles and other insects, in

			 combination with other factors, have increased the likelihood of unusually

			 severe wildfires that pose a threat to individuals and properties that are

			 located in nearby communities;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf1e350ed21eb473fb87f72effc043896"><enum>(3)</enum><text display-inline="yes-display-inline">increased wildfire danger is the result of

			 numerous factors, including—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID6ef0b871e0fd43b5882124102b6ee589"><enum>(A)</enum><text display-inline="yes-display-inline">a century-long policy of suppressing small

			 fires on Federal land that, combined with a recent reduction in the quantity of

			 timber harvested on Federal land, has resulted in unusually dense vegetation

			 that can provide fuel for unusually severe wildfires;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDec241b009fd44d7ea40e546a4e423719"><enum>(B)</enum><text display-inline="yes-display-inline">a pronounced and prolonged drought that has

			 weakened trees and made the trees more susceptible to wildfire and insects;

			 and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID43fdc50105b943fd8bcf7af1d2946e62"><enum>(C)</enum><text display-inline="yes-display-inline">population growth in the mountain

			 communities adjacent to Federal land, and the development of ski areas and

			 other recreational facilities on and in the vicinity of Federal land, that have

			 increased the number of individuals, homes, and businesses at risk;</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6579b268ed0241d8bbdde2b202ee02cd"><enum>(4)</enum><text display-inline="yes-display-inline">the Healthy Forests Restoration Act of 2003

			 (16 U.S.C. 6501 et seq.) addressed the need to reduce the volume of fuel that

			 can feed the most severe fires that threaten communities; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa05ba84a93914c5c81ee7eb9f3b68a43"><enum>(5)</enum><text display-inline="yes-display-inline">provisions of that Act and other laws need

			 to be modified to help reduce the increased risk of severe wildfires to

			 communities in the Rocky Mountain region resulting from the effects of

			 widespread infestations of bark beetles and other insects.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDb4ffe263ce224e1e83793a2a0abbbcf0"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to facilitate a

			 more expeditious response by the Secretary of Agriculture and the Secretary of

			 the Interior in reducing the increased risk of severe wildfires to communities

			 in the Rocky Mountain region resulting from the effects of widespread

			 infestations of bark beetles and other insects.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="id8A4B46BC9DFA4FA1AAC83BA3C3601C33" section-type="subsequent-section"><enum>3.</enum><header>Response to widespread

			 infestations of bark beetles and other insects on Federal land in the Rocky

			 Mountain region</header>

			<subsection commented="no" display-inline="no-display-inline" id="idB1D8FE66FAA44550AAF3EDF3F68BDBCB"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 101 of the Healthy Forests

			 Restoration Act of 2003 (16 U.S.C. 6511) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDd1f1c170f13b45cdba6d79f1b7375598"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (12) through

			 (16) as paragraphs (13), (14), (16), (17), and (18), respectively;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5F36B6718B54421DAAB352F918E9C856"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (11) the

			 following:</text>

					<quoted-block display-inline="no-display-inline" id="id18959B14038B47A094AB2C05BD3B253D" style="OLC">

						<paragraph commented="no" display-inline="no-display-inline" id="ID1f33c605a20d4e31a150522ee908269e"><enum>(12)</enum><header>Insect

				emergency area</header><text display-inline="yes-display-inline">The term

				<quote>insect-emergency area</quote> means Federal land in the Rocky Mountain

				region that—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="ID4a4f2613696f4d9bb86e7627d9e46f2c"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary determines is subject to a

				widespread infestation of bark beetles and other insects;</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID554bcb4041164a60b2338b6c208ea132"><enum>(B)</enum><text display-inline="yes-display-inline">is identified for hazardous fuel reduction

				treatment in a community wildfire protection plan; and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7c0eac1cb640424897fdf4a929bf284e"><enum>(C)</enum><text display-inline="yes-display-inline">is characterized by insect-induced tree

				mortality that the Secretary determines has, or within 1 year will have,

				produced a condition such that an immediate reduction in hazardous fuels is

				required to reduce the risks to human life and property, or to a municipal

				water supply, from a severe wildfire.</text>

							</subparagraph></paragraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID885bf58e66fa4cebb1b44b2a5c2bf07a"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (14) (as

			 redesignated by paragraph (1)) the following:</text>

					<quoted-block display-inline="no-display-inline" id="id196B748EDF8A4D11B512BCF153E4CC7C" style="OLC">

						<paragraph commented="no" display-inline="no-display-inline" id="ID349b8622fe6f433596c21742bbe26622"><enum>(15)</enum><header>Rocky Mountain

				region</header><text display-inline="yes-display-inline">The term <quote>Rocky

				Mountain region</quote> means the States of Arizona, Colorado, Idaho, Montana,

				New Mexico, North Dakota, South Dakota, Utah, and

				Wyoming.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0a80e81896854628957823f7dd88f6ce"><enum>(b)</enum><header>Prioritization

			 for Federal land in Rocky Mountain region</header><text display-inline="yes-display-inline">Section 103(d)(1) of the Healthy Forests

			 Restoration Act of 2003 (16 U.S.C. 6513(d)(1)) is amended by adding at the end

			 the following:</text>

				<quoted-block display-inline="no-display-inline" id="id7C322C6895DD46C0A5D1A2E52362235E" style="OLC">

					<subparagraph commented="no" display-inline="no-display-inline" id="IDb25f32d15d0046689a76da32259d1bd5"><enum>(D)</enum><header>Prioritization

				for Federal land in Rocky Mountain region</header><text display-inline="yes-display-inline">The Secretary shall use not less than 70

				percent of the funds allocated for authorized hazardous fuel reduction projects

				in the Rocky Mountain region for—</text>

						<clause commented="no" display-inline="no-display-inline" id="IDfae2e78487e7487094b987286c164cc2"><enum>(i)</enum><text display-inline="yes-display-inline">projects in the wildland-urban interface;

				and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="IDfacd1d90b07c4efc898f8a760e6f4969"><enum>(ii)</enum><text display-inline="yes-display-inline">projects on land that—</text>

							<subclause commented="no" display-inline="no-display-inline" id="id8E3F8B9D4E6C435DBA9C7ECF63DF392F"><enum>(I)</enum><text display-inline="yes-display-inline">is in proximity to—</text>

								<item commented="no" display-inline="no-display-inline" id="id78247151229047D49B62FE7C5C5F1B5E"><enum>(aa)</enum><text display-inline="yes-display-inline">a municipal water supply system; or</text>

								</item><item commented="no" display-inline="no-display-inline" id="id9CB83895B5484CE9867FFB475A0E9634"><enum>(bb)</enum><text display-inline="yes-display-inline">a stream feeding a municipal water supply

				system in a municipal watershed; and</text>

								</item></subclause><subclause commented="no" display-inline="no-display-inline" id="id4C36385FB4714C32A9D39A0C3DDA1CE2"><enum>(II)</enum><text display-inline="yes-display-inline">has been identified for hazardous fuel

				reduction projects in community wildfire protection

				plans.</text>

							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idD3DB6C0973E2458D8B90D90BF643F492"><enum>(c)</enum><header>Alternative

			 analysis process</header><text display-inline="yes-display-inline">Section

			 104(d)(2) of the Healthy Forests Restoration Act of 2003 (16 U.S.C. 6514(d)(2))

			 is amended by inserting <quote>or on any other land identified for such a

			 project in a community wildfire protection plan for an at-risk community in or

			 adjacent to an insect-emergency area</quote> after <quote>at-risk

			 community</quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id5C4C606162BD4392B9A52BFC75B76EAE"><enum>(d)</enum><header>Insect

			 emergencies</header><text display-inline="yes-display-inline">Title I of the

			 Healthy Forests Restoration Act of 2003 (16 U.S.C. 6511 et seq.) is

			 amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID2b2d9029c2494a22967f5563ede88a40"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating sections 107 and 108 as

			 sections 109 and 110, respectively; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID79b0b167b45a426aa6c427739a9082b5"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 106 the

			 following:</text>

							<subsection commented="no" display-inline="no-display-inline" id="idB3D530062C1A4D44AF52E41A6B896A94"><enum>(a)</enum><header>Designation</header>

								<paragraph commented="no" display-inline="no-display-inline" id="idDA4A4A6C3FD243148E3AC39FEEB975A2"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary may designate

				insect-emergency areas.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD44E8D97F2A14080A25998C5D5251447"><enum>(2)</enum><header>Basis of

				designation</header><text display-inline="yes-display-inline">The Secretary

				shall designate an insect-emergency area based on the best information

				available to the Secretary, including observation of relevant insect

				infestations.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDed866ef9e7c341beb54c1ac9d057dbc1"><enum>(3)</enum><header>Initiation</header><text display-inline="yes-display-inline">The designation of an insect-emergency area

				may be made—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="id9BE7C93DB9A947CFBC877368A438E801"><enum>(A)</enum><text display-inline="yes-display-inline">on the initiative of the Secretary;

				or</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id49C0ED9B5D394BD08627FDA31AA1D275"><enum>(B)</enum><text display-inline="yes-display-inline">in response to a request by—</text>

										<clause commented="no" display-inline="no-display-inline" id="idC25BF93E5AE04B66AB8A2735398043D9"><enum>(i)</enum><text display-inline="yes-display-inline">a State agency; or</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="id9A7CB33D8B404E12865F133446FF8D81"><enum>(ii)</enum><text display-inline="yes-display-inline">a political subdivision of a State.</text>

										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4c35ecaa3030472ea435f06fd96c27a4"><enum>(4)</enum><header>Deadline</header><text display-inline="yes-display-inline">Not later than 90 days after the date of

				receipt of a request under paragraph (3)(B), the Secretary shall approve or

				deny the request.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd5b09e01b44b43058a2c35221de2e3eb"><enum>(5)</enum><header>Limitation on

				delegation</header><text display-inline="yes-display-inline">In the case of

				National Forest System land, the authority of the Secretary to make a

				designation under this section may be delegated only to a Regional

				Forester.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDff620a0b9e754b188273dc01754cd8b3"><enum>(b)</enum><header>Consultation

				and public comment</header><text display-inline="yes-display-inline">Before

				making a determination to designate an insect-emergency area, the Secretary

				shall—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="ID54254769e6ff486ebc8fe85b6948f2bb"><enum>(1)</enum><text display-inline="yes-display-inline">consult with—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="idB6AA76B972A34A79AB0ACC52256EBCD7"><enum>(A)</enum><text display-inline="yes-display-inline">any Federal agency responsible for managing

				land in an applicable community wildfire protection plan; and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0BF9A7951EF247B296227AD425BCE3C5"><enum>(B)</enum><text display-inline="yes-display-inline">appropriate State and local officials;

				and</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9ea3bb2ecf054cf2908c885e6c1956ac"><enum>(2)</enum><text display-inline="yes-display-inline">provide public notice and an opportunity to

				comment.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe3a166aae17847caa1ea1b633487958d"><enum>(c)</enum><header>Effect of

				determination</header>

								<paragraph commented="no" display-inline="no-display-inline" id="ID53121108eca3434c84ae1e3b64f1bf29"><enum>(1)</enum><header>Authorized

				hazardous fuel reduction projects</header><text display-inline="yes-display-inline">An authorized hazardous fuel reduction

				project involving land in an insect-emergency area may be categorically

				excluded from documentation in an environmental impact statement and

				environmental assessment under the <act-name parsable-cite="NEPA69">National

				Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) if—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID82851e45fa314f5891492b511113a0e5"><enum>(A)</enum><text display-inline="yes-display-inline">the project involves only land that is

				identified for hazardous-fuel reduction treatment in a community wildfire

				protection plan; and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa4191f178fdc47fd81511bb7a3d02f12"><enum>(B)</enum><text display-inline="yes-display-inline">the decision to categorically exclude the

				project is made in accordance with applicable extraordinary circumstances

				procedures required by section 1508.4 of title 40, Code of Federal Regulations

				(or a successive regulation).</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDceb7dc76944e4f68912f0476ccf233aa"><enum>(2)</enum><header>Stewardship

				projects</header><text display-inline="yes-display-inline">A stewardship

				contracting project under section 347 of the Department of the Interior and

				Related Agencies Appropriations Act, 1999 (16 U.S.C. 2104 note; 112 Stat.

				2681–298) to carry out a hazardous fuel reduction project in an

				insect-emergency area may exceed 10 years, but shall not exceed 15 years, in

				duration.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa6df5d808b24455fad0c682584f54482"><enum>(d)</enum><header>Personnel

				authority</header><text display-inline="yes-display-inline">The Secretary may

				relocate or reassign personnel of the Forest Service to provide additional

				personnel to prepare and carry out—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="id27555C0305904584B357A2212A634289"><enum>(1)</enum><text display-inline="yes-display-inline">applied silvicultural assessments under

				section 404 in response to an insect emergency; or</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA65028D340104493B7098A5D2B7A86D3"><enum>(2)</enum><text display-inline="yes-display-inline">other appropriate actions involving Federal

				land subject to an insect

				emergency.</text>

								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4634E1F1DA084FFC895CA12A2FC4F03C"><enum>(e)</enum><header>Hazardous fuel

			 reduction projects</header><text display-inline="yes-display-inline">The

			 Secretary may allocate funds made available under Section 35 of the Mineral

			 Leasing Act (30 U.S.C. 191) (as amended by section 4(b)) for hazardous fuel

			 reduction projects in designated insect emergency areas.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id0F4E2B19E49E4F3FAB3B4A27553A4AEC"><enum>(f)</enum><header>Conforming

			 amendment</header><text display-inline="yes-display-inline">The table of

			 contents for the <act-name parsable-cite="AEA54">Healthy Forests Restoration

			 Act of 2003</act-name> (16 U.S.C. 6501 note; 117 Stat. 1888) is amended by

			 striking the items relating to section 107 and 108 and inserting the

			 following:</text>

			 assistance</header><text display-inline="yes-display-inline">Section 103 of the

			 Healthy Forests Restoration Act of 2003 (16 U.S.C. 6513) is amended by adding

			 at the end the following:</text>

				general</header><text display-inline="yes-display-inline">The Secretary, in

				consultation with appropriate State agencies, shall make grants to at-risk

				communities in the Rocky Mountain region to assist the at-risk communities in

				preparing or revising a community wildfire protection plan.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52BF2F770E9340D1B9038525DDBD5FFA"><enum>(2)</enum><header>Source of

				funds</header><text display-inline="yes-display-inline">The Secretary shall use

				amounts made available under section 35(c) of the Mineral Leasing Act (30

				U.S.C. 191(c)) to carry out this

				subsection.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				at-risk communities</header><text display-inline="yes-display-inline">Notwithstanding the first sentence of

				subsection (a), $5,000,000 of the amounts paid into the Treasury under

				subsection (a) for each of fiscal years 2006 through 2010 shall be made

				available to the Secretary, without further appropriation and until expended,

				for obligation and expenditure pursuant to section 103(e) of the Healthy

				Forests Restoration Act of 2003 (16 U.S.C.

				6513(e)).</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="id33A875D2EC164734A647E6824982FBD7" section-type="subsequent-section"><enum>5.</enum><header>Additional assistance

			 for preparation of community wildfire protection plans</header><text display-inline="no-display-inline">Section 33(b)(3) of the Federal Fire

			 Prevention and Control Act of 1974 (15 U.S.C. 2229(b)(3)) is amended by

			 striking subparagraph (L) and inserting the following:</text>

			 commercial utilization grant program</header><text display-inline="yes-display-inline">The Healthy Forests Restoration Act of 2003

			 (16 U.S.C. 6531) is amended by striking section 203 and inserting the

			 following:</text>

				utilization grant program</header>

						<subsection commented="no" display-inline="no-display-inline" id="ID4ba761d5e0604cc2911632bffdee283d"><enum>(a)</enum><header>Program

				authorized</header><text display-inline="yes-display-inline">The Secretary may

				provide to owners or operators of facilities that use biomass, on an annual

				basis, grants for use in accordance with subsection (d).</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="id5BE692C0B8C34C0384973EAA993741A6"><enum>(b)</enum><header>Eligible

				recipients</header><text display-inline="yes-display-inline">A grant shall be

				awarded under this section only to an owner or operator of a facility that uses

				biomass—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDd1c644d8d9144aa68716492a9fb4434b"><enum>(1)</enum><text display-inline="yes-display-inline">as a raw material to produce—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="id06CBE5A8A3A7446CB46F7C85DC0CA949"><enum>(A)</enum><text display-inline="yes-display-inline">electricity;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6FDB5172462446D993CB8DAD6168B238"><enum>(B)</enum><text display-inline="yes-display-inline">sensible heat; or</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD3D92C45B6614C4D8549ED5E1858127F"><enum>(C)</enum><text display-inline="yes-display-inline">transportation fuel;</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5e2cfe37559c47f9a93d569223d3dca0"><enum>(2)</enum><text display-inline="yes-display-inline">for wood-based products; or</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID31561639a41746408cecd04f062f03f9"><enum>(3)</enum><text display-inline="yes-display-inline">for other commercial purposes.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID39ed870f995346e0a88ee6c81264f75a"><enum>(c)</enum><header>Priority</header><text display-inline="yes-display-inline">In making grants under this section, the

				Secretary shall give priority to applications submitted by individuals or

				entities that purchase biomass removed from land in insect-emergency areas (as

				defined in section 101) through an authorized hazardous fuel reduction project

				carried out pursuant to section 102.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4060e24ae0ab417490d176721897c43b"><enum>(d)</enum><header>Use of grant

				funds</header><text display-inline="yes-display-inline">An owner or operator

				who receives a grant pursuant to this section may use funds from the grant to

				offset the costs of purchasing biomass.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID272bdc38ead94d6292438f50df341ef8"><enum>(e)</enum><header>Relationship to

				other authority</header><text display-inline="yes-display-inline">The Secretary

				may exercise the authority provided by this section in conjunction with, or in

				addition to, any other authority of the Secretary to support or stimulate the

				use of biomass fuel.</text>

						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd07094e4d733477390e040eaf5be2a7c"><enum>(f)</enum><header>Authorization

				of appropriations</header><text display-inline="yes-display-inline">There are

				authorized to be appropriated to the Secretary to carry out this section

				$10,000,000 for each of fiscal years 2007 through

				2010.</text>

						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

						<subsection commented="no" display-inline="no-display-inline" id="id1C420BEF60D943849D02E09ABFB2EEE2"><enum>(a)</enum><header>Establishment</header>

							<paragraph commented="no" display-inline="no-display-inline" id="id95684401537C4742B09968F6392D77CB"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">To the maximum extent

				practicable, and consistent with relevant land management plans, the Secretary

				shall establish 1 or more collection points for the placement of vegetative

				material removed from Federal or other land as part of a hazardous fuel

				reduction project under title I.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8B37A8FF687B499B8C428F0763E163E5"><enum>(2)</enum><header>Conditions for

				establishment</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="id6F6BFB57687A428BB11299A8B6F8667E"><enum>(A)</enum><header>Safe

				transportation of vegetative material</header><text display-inline="yes-display-inline">No collection point shall be established

				pursuant to this section if the Secretary determines that transportation of the

				vegetative material to or from the proposed collection point would result in an

				increased risk of infestation of insects.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idECE21309B2D94D3AA0E95F1B23302E3F"><enum>(B)</enum><header>Consent of

				property owner</header><text display-inline="yes-display-inline">No collection

				point shall be established pursuant to this section on any property not owned

				by the United States without the consent of the owner of the property.</text>

								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDfe638a241bf4488e844fe4e2b286c530"><enum>(b)</enum><header>Use</header><text display-inline="yes-display-inline">Vegetative material placed at a collection

				point established under this section may be sold, donated, or otherwise made

				available to any individual or entity that agrees to remove the material from

				the collection

				point.</text>

						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id60DCC58BF24D4F778D0F07F40B212ED8"><enum>(b)</enum><header>Conforming

			 amendment</header><text display-inline="yes-display-inline">The table of
