		<official-title display="yes">To authorize the Secretary of the Interior

		  to make available cost-shared grants and enter into cooperative agreements to

		  further the goals of the Water 2025 Program by improving water conservation,

		  efficiency, and management in the Reclamation States, and for other

		  purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Bureau of Reclamation Water

			 Conservation, Efficiency, and Management Improvement

			 Act</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="id2E3EB3D87A7B417BB52E0CE513DE1D59" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="id5A13A9BE36B7444985F2A3F12D6E8816"><enum>(1)</enum><header>Non-Federal

			 entity</header><text display-inline="yes-display-inline">The term

			 <quote>non-Federal entity</quote> means a State, Indian tribe, irrigation

			 district, water district, or any other organization with water delivery

			 authority.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB9973776B78C423B9A9BA974CA2B1922"><enum>(2)</enum><header>Reclamation

			 State</header><text display-inline="yes-display-inline">The term

			 <quote>Reclamation State</quote> means each of the States of Arizona,

			 California, Colorado, Idaho, Kansas, Montana, Nebraska, Nevada, New Mexico,

			 North Dakota, Oklahoma, Oregon, South Dakota, Texas, Utah, Washington, and

			 Wyoming.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54827A0B228B4CFB82ECCE9F2EB503B2"><enum>(3)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the

			 Secretary of the Interior, acting through the Commissioner of

			 Reclamation.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id3B9AD5B0D4F34B1280F652FB85B6C897" section-type="subsequent-section"><enum>3.</enum><header>Authorization of

			 grants and cooperative agreements</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDe9589a34d7e048cc8fe12d3ece10610c"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary may, in

			 accordance with the criteria published under subsection (b), provide grants to,

			 and enter into cooperative agreements with non-Federal entities to pay the

			 Federal share of the cost of a project to plan, design, construct, or otherwise

			 implement improvements to conserve water, increase water use efficiency,

			 facilitate water markets, enhance water management, or implement other actions

			 to prevent water-related crises or conflicts in watersheds that have a nexus to

			 Federal water projects within the Reclamation States.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9ad1f150f38740c8bca7c5909d8d6b5a"><enum>(b)</enum><header>Eligibility

			 Criteria</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id8A84CBC7A91545D98128D8B373A3AB38"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than 1 year

			 after the date of enactment of this Act, the Secretary shall, consistent with

			 this Act, publish in the Federal Register criteria developed by the Secretary

			 for—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDc294b18dd0ae4db6900c101390f48584"><enum>(A)</enum><text display-inline="yes-display-inline">determining the eligibility of a

			 non-Federal entity for assistance under subsection (a); and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf31bcb5829e44cc8baa8defb51b2cf8f"><enum>(B)</enum><text display-inline="yes-display-inline">prioritizing requests for assistance under

			 subsection (a).</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6ca78e6688594476bac61864bd60b144"><enum>(2)</enum><header>Factors</header><text display-inline="yes-display-inline">The criteria developed under paragraph (1)

			 shall take into account such factors as—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID6123f52d1e014150a1d0d7c70a9daa48"><enum>(A)</enum><text display-inline="yes-display-inline">the extent to which a project under

			 subsection (a) would reduce conflict over water;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID506f876ac0ba4f3cb30d81f1241d9304"><enum>(B)</enum><text display-inline="yes-display-inline">the extent to which a project under

			 subsection (a) would—</text>

						<clause commented="no" display-inline="no-display-inline" id="id7B6919B5DD644182BB4BDC08893943A0"><enum>(i)</enum><text display-inline="yes-display-inline">increase water use efficiency; or</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id7949AA51F604427098EDB0A0E8764D1C"><enum>(ii)</enum><text display-inline="yes-display-inline">enhance water management;</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe938dc0af8754aa185d209bc00246567"><enum>(C)</enum><text display-inline="yes-display-inline">the extent to which unallocated water is

			 available in the area in which a project under subsection (a) is proposed to be

			 conducted;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID009d2bdb919246109c751604754513b6"><enum>(D)</enum><text display-inline="yes-display-inline">the extent to which a project under

			 subsection (a) involves water marketing;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfc51eb8c73a84716b2c73c4571ca6fa7"><enum>(E)</enum><text display-inline="yes-display-inline">the likelihood that the benefit of a

			 project under subsection (a) would be attained;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa3d1dabe660d41d8ac7bc13604e30f70"><enum>(F)</enum><text display-inline="yes-display-inline">whether the non-Federal entity has

			 demonstrated the ability of the non-Federal entity to pay the non-Federal

			 share;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDafce3cb3865743b7aa9342d927744ac7"><enum>(G)</enum><text display-inline="yes-display-inline">the extent to which the assistance provided

			 under subsection (a) is reasonable for the work proposed under the

			 project;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc10414a3ee3846788eb7408ceef31c75"><enum>(H)</enum><text display-inline="yes-display-inline">the involvement of the non-Federal entity

			 and stakeholders in a project under subsection (a);</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf2ffffaa70054ed99bb4504da78b2c66"><enum>(I)</enum><text display-inline="yes-display-inline">whether a project under subsection (a) is

			 related to a Bureau of Reclamation project or facility; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd49a71668cfe4a52a99a5429fa1f960c"><enum>(J)</enum><text display-inline="yes-display-inline">the extent to which a project under

			 subsection (a) would conserve water.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDcf43a047ca0d4252923f9c261dc34fef"><enum>(c)</enum><header>Federal

			 facilities</header><text display-inline="yes-display-inline">If a grant or

			 cooperative agreement under subsection (a) provides for improvements to a

			 Federal facility—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID4070210821d045f2aeb2aa7a6921ed23"><enum>(1)</enum><text display-inline="yes-display-inline">the Federal funds provided under the grant

			 or cooperative agreement may be—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id8E22FBD543D74C5D947671832710CCBF"><enum>(A)</enum><text display-inline="yes-display-inline">provided on a nonreimbursable basis to an

			 entity operating affected transferred works; or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id38AC058B42B440CBB7C667B5E0C46A26"><enum>(B)</enum><text display-inline="yes-display-inline">determined to be nonreimbursable for

			 non-transferred works; and</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9d250c5fef3c427092d22851c8a6ab81"><enum>(2)</enum><text display-inline="yes-display-inline">title to the improvements to the Federal

			 facility shall be held by the United States.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID79392abe373f4b9ca9a27096f72bc3aa"><enum>(d)</enum><header>Cost-sharing

			 requirement</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id75156BFC31F54D9288C080238F8AE6A1"><enum>(1)</enum><header>Federal

			 share</header><text display-inline="yes-display-inline">The Federal share of

			 the cost of carrying out a project assisted under subsection (a) shall be not

			 more than 50 percent.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id37F2EF3743D145D9B1FEE9AE941C636B"><enum>(2)</enum><header>Non-Federal

			 share</header><text display-inline="yes-display-inline">In calculating the

			 non-Federal share of the cost of carrying out a project under subsection (a),

			 the Secretary—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id6901DF6EA9D04F93A41845CA37D2A4B3"><enum>(A)</enum><text display-inline="yes-display-inline">may include any in-kind contributions that

			 the Secretary determines would materially contribute to the completion of

			 proposed project; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD546CA0537354309A42F09E483031379"><enum>(B)</enum><text display-inline="yes-display-inline">shall exclude any funds received from other

			 Federal agencies.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf9063b467f4449e1bb9ff2b97871ab77"><enum>(e)</enum><header>Operation and

			 maintenance costs</header><text display-inline="yes-display-inline">The

			 non-Federal share of the cost of operating and maintaining improvements

			 assisted under subsection (a) shall be 100 percent.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id560066CEF5CF4407904BD92B791D5133"><enum>(f)</enum><header>Mutual

			 benefit</header><text display-inline="yes-display-inline">Grants or cooperative

			 agreements made under this section or section 4 may be for the mutual benefit

			 of the United States and the entity that is provided the grant or enters into

			 the cooperative agreement.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDfbdd593ada774bf49c111918c4e86c4f"><enum>(g)</enum><header>Liability</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id9437F328315D48FCAC454B8ABF7DCE11"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Except as provided in

			 paragraph (2), the United States shall not be liable under Federal or State law

			 for monetary damages of any kind arising out of any act, omission, or

			 occurrence relating to any non-Federal facility constructed or improved under

			 this title.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8A05CEDAA1BB4C59BFA67C5952881836"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), the United

			 States may be held liable for damages to non-Federal facilities caused by acts

			 of negligence committed by the United States or by an employee or agent of the

			 United States.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5627E4BE402F447E82EE7E2DBCE3D013"><enum>(3)</enum><header>No additional

			 liability</header><text display-inline="yes-display-inline">Nothing in this

			 section increases the liability of the United States beyond that provided in

			 chapter 171 of title 28, United States Code (commonly known as the

			 <quote>Federal Torts Claim Act</quote>).</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDfa1093d539894a619de66b17ae7ae7b1" section-type="subsequent-section"><enum>4.</enum><header>Research

			 agreements</header><text display-inline="no-display-inline">The Secretary may

			 enter into cooperative agreements with institutions of higher education,

			 nonprofit research institutions, or organizations with water or power delivery

			 authority to fund research to conserve water, increase water use efficiency, or

			 enhance water management under such terms and conditions as the Secretary

			 determines to be appropriate.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID33d098fd29b84ac986deeb7ef47f86ca" section-type="subsequent-section"><enum>5.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in this title affects any existing

			 project-specific funding authority.</text>

		</section><section id="idC6B246B4591E4D2586C9F7998E9F1A4F"><enum>6.</enum><header>Effect on state

			 water law</header>

			<subsection id="id394EEE9B842F41DE8B6D4E1F5A1F0E2C"><enum></enum><text>Nothing in this

			 Act invalidates, preempts, or creates any exception to State water law, State

			 water rights, or any interstate compact governing water.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID46e384cd8e36447f89b5e5b02fd4fe28" section-type="subsequent-section"><enum>7.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">There is

			 authorized to be appropriated to carry out this Act $25,000,000 for each of

			 fiscal years 2007 through 2016.</text>
