		  land to Lander County, Nevada, and the Secretary of the Interior to convey

		  certain land to Eureka County, Nevada, for continued use as

		<section id="ID80EDD5D6261C431C99E47DCC8EE0A3AA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Central Nevada Rural Cemeteries

			 Act</short-title></quote>.</text>

		</section><section id="ID91956B99A73F4493A38E4B2D86FCD268"><enum>2.</enum><header>Conveyance to

			 lander county, Nevada</header>

			<subsection id="ID0D612E84DF1148EBAB2685C9803EEF15"><enum>(a)</enum><header>Findings</header><text>Congress

			 finds that—</text>

				<paragraph id="ID284F703D32D24F3A991354E5CCD4C0B1"><enum>(1)</enum><text>the historical

			 use by settlers and travelers since the late 1800’s of the cemetery known as

			 <quote>Kingston Cemetery</quote> in Kingston, Nevada, predates incorporation of

			 the land within the jurisdiction of the Forest Service on which the cemetery is

			 situated;</text>

				</paragraph><paragraph id="IDBC5977BFFB3A415285488D3F39D618E8"><enum>(2)</enum><text>it is appropriate

			 that that use be continued through local public ownership of the parcel rather

			 than through the permitting process of the Federal agency;</text>

				</paragraph><paragraph id="IDA962DD4DB46D4FA18896F65471E78ABA"><enum>(3)</enum><text>in accordance

			 with <external-xref legal-doc="public-law" parsable-cite="pl/85/569">Public Law

			 85–569</external-xref> (commonly known as the <quote>Townsite Act</quote>)

			 (<external-xref legal-doc="usc" parsable-cite="usc/16/478a">16 U.S.C.

			 478a</external-xref>), the Forest Service has conveyed to the Town of Kingston

			 1.25 acres of the land on which historic gravesites have been identified;

			 and</text>

				</paragraph><paragraph id="ID140487989E7D46AC83EE90413D9F74AF"><enum>(4)</enum><text>to ensure that

			 all areas that may have unmarked gravesites are included, and to ensure the

			 availability of adequate gravesite space in future years, an additional parcel

			 consisting of approximately 8.75 acres should be conveyed to the county so as

			 to include the total amount of the acreage included in the original permit

			 issued by the Forest Service for the cemetery.</text>

				</paragraph></subsection><subsection id="IDAEE1B760F458455B8F35939DA7AC2251"><enum>(b)</enum><header>Conveyance on

			 condition subsequent</header><text>Subject to valid existing rights and the

			 condition stated in subsection (e), the Secretary of Agriculture, acting

			 through the Chief of the Forest Service (referred to in this section as the

			 <quote>Secretary</quote>), not later than 90 days after the date of enactment

			 of this Act, shall convey to Lander County, Nevada (referred to in this section

			 as the <quote>county</quote>), for no consideration, all right, title, and

			 interest of the United States in and to the parcel of land described in

			 subsection (c).</text>

			</subsection><subsection id="ID787FC857B31E48579F8AE1F165C7F7C7"><enum>(c)</enum><header>Description of

			 land</header><text>The parcel of land referred to in subsection (b) is the

			 parcel of National Forest System land (including any improvements on the land)

			 known as <quote>Kingston Cemetery</quote>, consisting of approximately 10 acres

			 and more particularly described as

			 SW<fraction>1/4</fraction>SE<fraction>1/4</fraction>SE<fraction>1/4</fraction>

			 of section 36, T. 16N., R. 43E., Mount Diablo Meridian.</text>

			</subsection><subsection id="ID83D5AABE197A407894E4514093419F6C"><enum>(d)</enum><header>Easement</header><text>At

			 the time of the conveyance under subsection (b), subject to subsection (e)(2),

			 the Secretary shall grant the county an easement allowing access for persons

			 desiring to visit the cemetery and other cemetery purposes over Forest

			 Development Road #20307B, notwithstanding any future closing of the road for

			 other use.</text>

			</subsection><subsection id="IDBC7833DA285B483E882B99778DD2F67E"><enum>(e)</enum><header>Condition on

			 use of land</header>

				<paragraph id="IDAD257326140C41379956111BE77F5C4E"><enum>(1)</enum><header>In

			 general</header><text>The county (including its successors) shall continue the

			 use of the parcel conveyed under subsection (b) as a cemetery.</text>

				</paragraph><paragraph id="ID433782E872C94EDCA8818DD6CF80E926"><enum>(2)</enum><header>Reversion</header><text>If

			 the Secretary, after notice to the county and an opportunity for a hearing,

			 makes a finding that the county has used or permitted the use of the parcel for

			 any purpose other than the purpose specified in paragraph (1), and the county

			 fails to discontinue that use—</text>

					<subparagraph id="IDFC4955662E564815995323FCA2C75F12"><enum>(A)</enum><text>title to the

			 parcel shall revert to the Secretary, to be administered by the Secretary;

			 and</text>

					</subparagraph><subparagraph id="IDD6B0233AAE304BA4B0B8124D9CC66655"><enum>(B)</enum><text>the easement

			 granted to the county under subsection (d) shall be revoked.</text>

					</subparagraph></paragraph><paragraph id="ID07CF1CBDE3D84A27B833AEB36ED70015"><enum>(3)</enum><header>Waiver</header><text>The

			 Secretary may waive the application of subparagraph (A) or (B) of paragraph (2)

			 if the Secretary determines that a waiver would be in the best interests of the

			 United States.</text>

				</paragraph></subsection></section><section id="ID54246801C8EA4EF9936FFE3576FE6E66"><enum>3.</enum><header>Conveyance to

			 eureka county, Nevada</header>

			<subsection id="ID48908DF86D98406C82C57D07230ECA94"><enum>(a)</enum><header>Findings</header><text>Congress

			 finds that—</text>

				<paragraph id="ID6F9B81712F5C498BA0CEAE1CAE9F3AD2"><enum>(1)</enum><text>the historical

			 use by settlers and travelers since the late 1800’s of the cemetery known as

			 <quote>Maiden’s Grave Cemetery</quote> in Beowawe, Nevada, predates

			 incorporation of the land within the jurisdiction of the Bureau of Land

			 Management on which the cemetery is situated; and</text>

				</paragraph><paragraph id="ID8254C5D7F6C64BF6BFAAB8391B8ADB07"><enum>(2)</enum><text>it is appropriate

			 that that use be continued through local public ownership of the parcel rather

			 than through the permitting process of the Federal agency.</text>

				</paragraph></subsection><subsection id="ID1C143A23D44945DF9BEC3C7E8811738B"><enum>(b)</enum><header>Conveyance on

			 condition subsequent</header><text>Subject to valid existing rights and the

			 condition stated in subsection (e), the Secretary of the Interior, acting

			 through the Director of the Bureau of Land Management (referred to in this

			 section as the <quote>Secretary</quote>), not later than 90 days after the date

			 of enactment of this Act, shall convey to Eureka County, Nevada (referred to in

			 this section as the <quote>county</quote>), for no consideration, all right,

			 title, and interest of the United States in and to the parcel of land described

			 in subsection (c).</text>

			</subsection><subsection id="ID1E8D3A69E607406C892DC52F786CE363"><enum>(c)</enum><header>Description of

			 land</header><text>The parcel of land referred to in subsection (b) is the

			 parcel of public land (including any improvements on the land) known as

			 <quote>Maiden’s Grave Cemetery</quote>, consisting of approximately 10 acres

			 and more particularly described as

			 S<fraction>1/2</fraction>NE<fraction>1/4</fraction>SW<fraction>1/4</fraction>SW<fraction>1/4</fraction>,

			 N<fraction>1/2</fraction>SE<fraction>1/4</fraction>SW<fraction>1/4</fraction>SW<fraction>1/4</fraction>

			 of section 10, T.31N., R.49E., Mount Diablo Meridian.</text>

			</subsection><subsection id="ID03B54EC1AC15411F81E41771515FA84D"><enum>(d)</enum><header>Easement</header><text>At

			 the time of the conveyance under subsection (b), subject to subsection (e)(2),

			 the Secretary shall grant the county an easement allowing access for persons

			 desiring to visit the cemetery and other cemetery purposes over an appropriate

			 access route consistent with current access.</text>

			</subsection><subsection id="ID4141EFA40C0747C9BBA32DFE044082A4"><enum>(e)</enum><header>Condition on

			 use of land</header>

				<paragraph id="ID23FFEADD92064C108152D2FCB8A16A3A"><enum>(1)</enum><header>In

			 general</header><text>The county (including its successors) shall continue the

			 use of the parcel conveyed under subsection (b) as a cemetery.</text>

				</paragraph><paragraph id="IDFB9910CCCE6343529A1488BB837A18A4"><enum>(2)</enum><header>Reversion</header><text>If

			 the Secretary, after notice to the county and an opportunity for a hearing,

			 makes a finding that the county has used or permitted the use of the parcel for

			 any purpose other than the purpose specified in paragraph (1), and the county

			 fails to discontinue that use—</text>
