			 wherever in this Act an amendment or repeal is expressed in terms of an

			 amendment to, or repeal of, a section or other provision, the reference shall

			 be considered to be made to a section or other provision of the Carl D. Perkins

			 Vocational and Technical Education Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301</external-xref> et seq.).</text>

		</section><section id="IDCA563F5F5E5748B4A0D9661FDABB55DB"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">Section 2 (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301</external-xref>) is amended—</text>

			<paragraph id="IDB6E9E723D95442638F17A204B25BF985"><enum>(1)</enum><text>by striking

			 <quote>vocational</quote> each place the term appears and inserting

			 <quote>career</quote>;</text>

			</paragraph><paragraph id="ID16B37CD048BE4199BC5AB2F42873F511"><enum>(2)</enum><text>in paragraph (1),

			 by striking <quote>standards</quote> and inserting <quote>and technical

			 standards, and to assist students in meeting such standards, especially in

			 preparation for high skill, high wage, or high demand occupations in emerging

			 or established professions</quote>;</text>

			</paragraph><paragraph id="ID43E1F0AAB8A04A04BA8428FD49002077"><enum>(3)</enum><text>in paragraph (2),

			 by inserting <quote>challenging</quote> after <quote>integrate</quote>;</text>

				counselors;</text>

				partnerships among secondary schools, postsecondary institutions, area career

				technical centers, business and industry, professional associations, and

				intermediaries; and</text>

					</paragraph><paragraph id="ID5F1A1E938D5E48FAA13793BBB08C9E95"><enum>(7)</enum><text>developing a

				highly skilled workforce needed to keep America competitive in the global

				economy in conjunction with other Federal education and training programs,

				including workforce investment programs, that provide lifelong learning for the

				workforce of today and tomorrow.</text>

			</paragraph></section><section id="IDE4B4D76A847B4570845E3FCF1CB67536"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>) is amended—</text>

			<paragraph id="ID1DEE3E94613C4BFA959639D37118A3F9"><enum>(1)</enum><text>in paragraph (2),

			 by inserting <quote>, including employment statistics and information relating

			 to national, regional, and local labor market areas, as provided pursuant to

			 section 118, and career ladder information, where appropriate</quote> after

			 <quote>to enter</quote>;</text>

			</paragraph><paragraph id="ID117FFD3573644C50A00FDB6B74A692F3"><enum>(2)</enum><text>in paragraph

			 (3)—</text>

				agreement</header><text>The term <term>articulation agreement</term> means a

				written commitment, approved annually by the relevant administrators of the

				secondary and postsecondary institutions, to a program that is designed to

				provide students with a nonduplicative sequence of progressive achievement

				leading to technical skill proficiency, a credential, a certificate, or a

				degree, and linked through credit transfer agreements.</text>

					</paragraph><paragraph id="IDCED273F580B5403C9D15B09030D663FB"><enum>(5)</enum><header>Career and

				technical education</header><text>The term <term>career and technical

				education</term> means organized educational activities that—</text>

						<subparagraph id="ID212BD0F25D9946E59A540F14EE763D23"><enum>(A)</enum><text>offer a sequence

				of courses (which may include technical learning experiences) that—</text>

							<clause id="ID79F0898791F240D3B1CB948C698707E5"><enum>(i)</enum><text>provides

				individuals with the challenging academic and technical knowledge and skills

				the individuals need to prepare for further education and for careers in

				emerging and established professions; and</text>

							</clause><clause id="ID9037FAFF6B2A45C29434A6163D8E213C"><enum>(ii)</enum><text>may lead to

				technical skill proficiency, a credential, a certificate, or a degree;

				and</text>

							</clause></subparagraph><subparagraph id="ID85A2E74B03404D838D57B3B6BC345153"><enum>(B)</enum><text>include

				competency-based applied learning that contributes to the academic knowledge,

				higher-order reasoning and problem-solving skills, work attitudes, general

				employability skills, technical skills, and occupation-specific skills, of an

				individual.</text>

						</subparagraph></paragraph><paragraph id="IDD64C7FB293754D72B19BDE1F48E86D40"><enum>(6)</enum><header>Career and

				technical education student</header><text>The term <term>career and technical

				education student</term> means a student who enrolls in a clearly defined

				sequence of career and technical education courses leading to attainment of

				technical skill proficiency, a credential, a certificate, or a degree.</text>

					</paragraph><paragraph id="ID7E1837A1863C4354BAB006097C860BD7"><enum>(7)</enum><header>Career and

				technical student organization</header>

						<subparagraph id="ID95A240A4BC04416AB8EF0764008EB5ED"><enum>(A)</enum><header>In

				general</header><text>The term <term>career and technical student

				organization</term> means an organization for individuals enrolled in a career

				and technical education program that engages in career and technical education

				activities as an integral part of the instructional program.</text>

						</subparagraph><subparagraph id="ID7769A1A8205240BA957599928173B6E0"><enum>(B)</enum><header>State and

				national units</header><text>An organization described in subparagraph (A) may

				have State and national units that aggregate the work and purposes of

				instruction in career and technical education at the local level.</text>

						</subparagraph></paragraph><paragraph id="ID82677A698A0F43C7B8BF705217D21894"><enum>(8)</enum><header>Career guidance

				and academic counseling</header><text>The term <term>career guidance and

				academic counseling</term> means providing access to information regarding

				career awareness and planning with respect to an individual’s occupational and

				academic future that shall involve guidance and counseling with respect to

				career options, financial aid, and postsecondary options.</text>

					</paragraph><paragraph id="IDB6271A54059640829981DC58277A015B"><enum>(9)</enum><header>Career

				pathway</header><text>The term <term>career pathway</term> means a coordinated

				and nonduplicative sequence of courses (which may include technical learning

				experiences) and associated credits that—</text>

						<subparagraph id="IDAF353BF060744ACAA1DB2DB5DB5F37F1"><enum>(A)</enum><text>shall identify

				both secondary and postsecondary education elements;</text>

						</subparagraph><subparagraph id="ID0A220070ECB240BBB0513F46258B7AA2"><enum>(B)</enum><text>shall include

				challenging academic and career and technical education content;</text>

						</subparagraph><subparagraph id="ID876AD25E3E2D4051AF0547F5E174A074"><enum>(C)</enum><text>may include the

				opportunity for secondary students to participate in dual or concurrent

				enrollment programs or other ways to acquire postsecondary credits; and</text>

						</subparagraph><subparagraph id="IDFEC3A877B205478C97F0A11816A81A6D"><enum>(D)</enum><text>may culminate in

				technical skill proficiency, a credential, a certificate, or a degree.</text>

						</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

			</paragraph><paragraph id="IDB0B8D0C0AF7F41C5AE3B0C2A0082A700"><enum>(6)</enum><text>in paragraph (10)

			 (as redesignated by paragraph (4) of this section), by striking

			 <quote>5206</quote> and inserting <quote>5210</quote>;</text>

			</paragraph><paragraph id="ID088B8511BCD34D72BD73332724E1FF97"><enum>(7)</enum><text>by redesignating

				provides not less than a 2-year program that is acceptable for full credit

				toward a baccalaureate degree; and</text>

						</subparagraph><subparagraph id="ID6C89BA819E634AD7A29953067303A82B"><enum>(B)</enum><text>includes tribally

				controlled colleges or universities.</text>

						</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

			</paragraph><paragraph id="IDDB0AD1C231544F44AEAC187D29EC9284"><enum>(9)</enum><text>in paragraph (12)

			 (as redesignated by paragraph (7) of this section)—</text>

				means a written plan for a secondary career and technical education student,

				that—</text>

						<subparagraph id="ID86491121077946B9B0C43CFF6D408B7E"><enum>(A)</enum><text>is developed with

				career guidance and academic counseling or other professional staff, and in

				consultation with parents, not later than in the first year of secondary school

				or upon enrollment in career and technical education;</text>

						</subparagraph><subparagraph id="ID8A45B5372EC14E59BC38854BA6395382"><enum>(B)</enum><text>is reviewed

				annually and modified as needed;</text>

						</subparagraph><subparagraph id="IDC0043AACE3034A8A800133DEA24441FD"><enum>(C)</enum><text>includes relevant

				information on—</text>

							<clause id="ID982FFC9E2788413CB93912940EDF4905"><enum>(i)</enum><text>secondary school

				requirements for graduating with a diploma;</text>

							</clause><clause id="IDB51AC61C91934103912440CF87FB0F48"><enum>(ii)</enum><text>postsecondary

				education admission requirements; and</text>

							</clause><clause id="ID2861C2BD9CF347F8A96F2FE75F1FAADD"><enum>(iii)</enum><text>high skill,

				high wage, or high demand occupations and nontraditional fields in emerging and

				established professions, and labor market indicators; and</text>

							</clause></subparagraph><subparagraph id="ID2FAAE2CA9C594DA7957F707DFAD9035C"><enum>(D)</enum><text>states the

				student’s secondary school graduation goals, postsecondary education and

				training, or employment goals, and identifies 1 or more career pathways that

				correspond to the goals.</text>

						</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

				allotment</header>

				general</header><text>Notwithstanding any other provision of law and subject to

				clause (ii), no State shall receive for a fiscal year under this paragraph less

				than <fraction>1/2</fraction> of 1 percent of the excess amount described in

				subparagraph (A).</text>

								</clause><clause id="ID9A7CB095865C4EA8AF29D9550FE349B0"><enum>(ii)</enum><header>Requirement</header><text>No

				State, by reason of the application of clause (i), shall be allotted under this

				paragraph for a fiscal year more than the amount determined by

				multiplying—</text>

									<subclause id="ID9D7D87E1FBB742EBB512F11ACA89E379"><enum>(I)</enum><text>the number of

				individuals in the State counted under paragraph (2); by</text>

									</subclause><subclause id="IDBBACB428D8A04188A1703C2DC62AD6C6"><enum>(II)</enum><text>185 percent of

				the national average per pupil payment made with the excess amount described in

				subparagraph (A) for that year.</text>

									</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></section><section id="IDDB527EEA7B8D4F3BBBD931DDFD3C3709"><enum>103.</enum><header>Within State

			 allocation</header><text display-inline="no-display-inline">Section 112

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/2322">20 U.S.C.

			 2322</external-xref>) is amended—</text>

				that serve individuals with disabilities; and</text>

									</clause><clause id="ID5430E91DDFBE45198DFEB698185BAB71"><enum>(ii)</enum><text>not less than

				$60,000 shall be available for services that prepare individuals for

				nontraditional fields; and</text>

									</clause></subparagraph><subparagraph id="ID3002F9CFB6A541138716E5CE7B76D31F"><enum>(B)</enum><text>administration of

				the State plan, which may be used for the costs of—</text>

									<clause id="ID15F4CFE1892840D7BDC59A8180CB5820"><enum>(i)</enum><text>developing the

				State plan;</text>

									</clause><clause id="ID24B34FB3FC6C4803A2E2AA2D47FF63B4"><enum>(ii)</enum><text>reviewing the

				local plans;</text>

									</clause><clause id="ID407DCE5304EB426F8566105FCC71FC41"><enum>(iii)</enum><text>monitoring and

				evaluating program effectiveness;</text>

									</clause><clause id="IDBFAFFA43AED041DCA99627945BDBFC7C"><enum>(iv)</enum><text>assuring

				compliance with all applicable Federal laws;</text>

									</clause><clause id="ID1A14D3E2F4484E8EB79BB3EEF338A88E"><enum>(v)</enum><text>providing

				technical assistance; and</text>

									</clause><clause id="ID0F3850C5F9C54F3A8EB17A836191A68A"><enum>(vi)</enum><text>supporting and

				developing State data systems relevant to the provisions of this Act.</text>

									</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

					</subparagraph></paragraph><paragraph id="ID63FE91F0DD994194BE2A4F8D17B3B5AA"><enum>(2)</enum><text>in subsection

			 (b), by striking <quote>subsection (a)(3)</quote> both places the term appears

			 and inserting <quote>subsection (a)(2)(B)</quote>; and</text>

				or</text>

								</subparagraph><subparagraph id="IDD87DC0C9F320402DB25745DBD3362ABB"><enum>(B)</enum><text>areas with high

				percentages or high numbers of career and technical education students;</text>

								</subparagraph></paragraph><paragraph id="ID576D90C986BA4CD6A2CEF569834D557D"><enum>(2)</enum><text>reserve funds,

				with the approval of participating eligible recipients, for—</text>

								<subparagraph id="IDA912ECC08B05426C9E159BE5D4CD0FE3"><enum>(A)</enum><text>innovative

				statewide initiatives that demonstrate benefits for eligible recipients, which

				may include—</text>

									<clause id="IDC8300C264D304635B2F842CB25E45569"><enum>(i)</enum><text>developing and

				implementing technical assessments;</text>

									</clause><clause id="ID75136E9FF0ED463FA2730B431083EC39"><enum>(ii)</enum><text>improving the

				professional development of career and technical education teachers, faculty,

				principals, and administrators; and</text>

									</clause><clause id="IDA85EA2EC3A3F4AB089B5515B88EA9F9B"><enum>(iii)</enum><text>establishing,

				enhancing, and supporting systems for accountability data collection or

				reporting purposes; or</text>

									</clause></subparagraph><subparagraph id="IDB9D1F55B25BE45439043A3566F5D3390"><enum>(B)</enum><text>the development

				and implementation of career pathways or career clusters; and</text>

								</subparagraph></paragraph><paragraph id="ID277E6B55974748528251EB7FA77345F8"><enum>(3)</enum><text>carry out

				activities described in paragraphs (1) and (2).</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></section><section id="ID39DABCFF1B374CBB9986EACF86E6E53D"><enum>104.</enum><header>Accountability</header><text display-inline="no-display-inline">Section 113 (<external-xref legal-doc="usc" parsable-cite="usc/20/2323">20 U.S.C. 2323</external-xref>) is amended—</text>

				attainment of challenging academic content standards and student academic

				achievement standards, as adopted by the State under section 1111(b)(1) of the

				<act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

				1965</act-name> and measured by the academic assessments described in section

				1111(b)(3) of such Act, consistent with State requirements.</text>

									</clause><clause id="ID86508A28D4FD455B8416CC76CFAF2BB4"><enum>(iii)</enum><text>Student rates

				of attainment of—</text>

										<subclause id="IDBCD30DDF664F4A74835B1B3D25445EF9"><enum>(I)</enum><text>a secondary

				school diploma;</text>

										</subclause><subclause id="ID47DF719723E946BAAE77BB4289245DB4"><enum>(II)</enum><text>the recognized

				equivalent of a secondary school diploma;</text>

										</subclause><subclause id="ID5B7C135A3AAE40D4A507A0B4930C4EC1"><enum>(III)</enum><text>technical skill

				proficiency;</text>

										</subclause><subclause id="ID50CF7B1EF20F4E8DA5FC2BA4687B7C6C"><enum>(IV)</enum><text>a

				credential;</text>

										</subclause><subclause id="IDF7FFB021FC0945FBAA93D99280E8B5E2"><enum>(V)</enum><text>a certificate;

				and</text>

										</subclause><subclause id="IDC1C7BE92A5AE48A8975C9F4AAC0D5E21"><enum>(VI)</enum><text>a degree.</text>

				attainment of technical skill proficiency, a credential, a certificate, or a

				degree, or retention in postsecondary education, including transfer to a

				baccalaureate degree program.</text>

									</clause><clause id="IDD32646050D7F469FB26BFB8CA9733B2E"><enum>(iii)</enum><text>Placement in

				military service, apprenticeship programs, or employment.</text>

									</clause><clause id="ID1189B460B2074D1497E7F483C1FBD691"><enum>(iv)</enum><text>Student

				participation in, and completion of, career and technical education programs

				that lead to employment in nontraditional fields.</text>

				levels of performance established under paragraph (3) as local adjusted levels

				of performance, or negotiate with the State to reach agreement on new local

				adjusted levels of performance, for each of the core indicators of performance

				described in subparagraphs (A) and (B) of paragraph (2) for career and

				technical education activities authorized under this title. The levels of

				performance established under this subparagraph shall, at a minimum—</text>

										<subclause id="ID5CA8EA7DC22D412E8E31A52C7E46D928"><enum>(I)</enum><text>be expressed in a

				percentage or numerical form, so as to be objective, quantifiable, and

				measurable; and</text>

										</subclause><subclause id="ID6173C0F511F646B49758C8FBE253200A"><enum>(II)</enum><text>require the

				eligible recipient to make continuous and significant improvement in career and

				technical achievement of career and technical education students.</text>

										</subclause></clause><clause id="ID632EEFF893EA42EF96758F91CB17583A"><enum>(ii)</enum><header>Identification

				in the local plan</header><text>Each eligible recipient shall identify, in the

				local plan submitted under section 134, levels of performance for each of the

				core indicators of performance for the first 2 program years covered by the

				local plan.</text>

									</clause><clause id="IDC5431398018742ECA8E5E0DC559CB304"><enum>(iii)</enum><header>Agreement on

				local adjusted levels of performance for first 2 years</header><text>The

				eligible agency and each eligible recipient shall reach agreement on the

				eligible recipient’s levels of performance for each of the core indicators of

				performance for the first 2 program years covered by the local plan, taking

				into account the levels identified in the local plan under clause (ii) and the

				factors described in clause (v). The levels of performance agreed to under this

				clause shall be considered to be the local adjusted levels of performance for

				the eligible recipient for such years and shall be incorporated into the local

				plan prior to the approval of such plan.</text>

									</clause><clause id="IDD4BF5B4A21734826BD86A4603320E9BD"><enum>(iv)</enum><header>Agreement on

				local adjusted levels of performance for subsequent years</header><text>Prior

				to the third and fifth program years covered by the local plan, the eligible

				agency and each eligible recipient shall reach agreement on the local adjusted

				levels of performance for each of the core indicators of performance for the

				corresponding subsequent program years covered by the local plan, taking into

				account the factors described in clause (v). The local adjusted levels of

				performance agreed to under this clause shall be considered to be the local

				adjusted levels of performance for the eligible recipient for such years and

				shall be incorporated into the local plan.</text>

									</clause><clause id="IDC49FF4057B7D4F80A08C678F5300B05B"><enum>(v)</enum><header>Factors</header><text>The

				agreement described in clause (iii) or (iv) shall take into account—</text>

										<subclause id="ID7888FC0F4D3048EEBDC42959013ADA2F"><enum>(I)</enum><text>how the levels of

				performance involved compare with the local adjusted levels of performance

				established for other eligible recipients, taking into account factors

				including the characteristics of participants when the participants entered the

				program and the services or instruction to be provided; and</text>

										</subclause><subclause id="ID81DF8DBE2A824E3BB7C66A74EFA7E516"><enum>(II)</enum><text>the extent to

				which the local adjusted levels of performance involved promote continuous and

				significant improvement on the core indicators of performance by the eligible

				recipient.</text>

										</subclause></clause><clause id="ID1087C2783C54404C84E38E098454DB59"><enum>(vi)</enum><header>Revisions</header><text>If

				unanticipated circumstances arise with respect to an eligible recipient

				resulting in a significant change in the factor described in clause (v)(II),

				the eligible recipient may request that the local adjusted levels of

				performance agreed to under clause (iii) or (iv) be revised. The eligible

				agency shall issue objective criteria and methods for making such

				revisions.</text>

									</clause></subparagraph><subparagraph id="ID106540161EA4442C9B9909AE5F21D17D"><enum>(B)</enum><header>Levels of

				performance for additional indicators</header><text>Each eligible recipient may

				identify, in the local plan, local levels of performance for any additional

				indicators of performance described in paragraph (2)(C). Such levels shall be

				considered to be the local levels of performance for purposes of this

				title.</text>

								</subparagraph><subparagraph id="ID890B047EC13C47E78A0454F4F869096F"><enum>(C)</enum><header>Report</header><text>Each

				eligible recipient that receives an allocation under section 131 shall publicly

				report, on an annual basis, its progress in achieving the local adjusted levels

				of performance on the core indicators of performance.</text>

								</subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>

					</subparagraph></paragraph><paragraph id="ID50AEBECECB4D40EA8169152CA32182B2"><enum>(4)</enum><text>by striking

			 subsection (c)(1)(B) and inserting:</text>

					<quoted-block id="IDECC4926691A6478FBDC49C46EEEBCAFA">

						<subparagraph id="IDBDB31AB27D0F43E0A69A2B1BF572DF05"><enum>(B)</enum><text>information on

				the levels of performance achieved by the State with respect to the additional

				</paragraph></section><section id="ID2C7C3AC7CFCF406C873492D777CC9EAC"><enum>105.</enum><header>National

			 activities</header><text display-inline="no-display-inline">Section 114

				principals, and administrators (including State directors of career and

				technical education), with expertise in the integration of academic and career

				and technical education;</text>

									</clause><clause id="ID51C0C34AF9F14681B6ECB5A5DF439C10"><enum>(ii)</enum><text>experts in

				evaluation, research, and assessment;</text>

									</clause><clause id="ID641D9A9DEC4944548DFC1B8A6608B24C"><enum>(iii)</enum><text>representatives

				of labor organizations and businesses, including small businesses;</text>

									</clause><clause id="IDAAD95EEDDBC145CB98624A31A49D2D2B"><enum>(iv)</enum><text>parents;</text>

									</clause><clause id="ID88B6F77BD1824E2CA9396ED13D1A7E2D"><enum>(v)</enum><text>career guidance

				and academic counseling professionals; and</text>

									</clause><clause id="ID6450387C6052473AAA9E2A78B6840335"><enum>(vi)</enum><text>other

				individuals and intermediaries with relevant expertise.</text>

									</clause></subparagraph><subparagraph id="ID4CFC1DEC889C4C26A9EBF5872882862B"><enum>(C)</enum><header>Independent

				analysis</header><text>The advisory panel shall transmit to the Secretary and

				to the relevant committees of Congress an independent analysis of the findings

				and recommendations resulting from the assessment described in paragraph

				(3).</text>

								</subparagraph><subparagraph id="IDC5FBEACA32E54180AE8332C9D49F6D66"><enum>(D)</enum><header>FACA</header><text>The

				<act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5

				U.S.C. App.) shall not apply to the panel established under this

				paragraph.</text>

				knowledge and skills required to respond to needs of a regional or sectoral

				workforce, including small business;</text>

										</subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block>

							</subclause><subclause id="IDCA8E4C0AA84B482FA7A31892DDFF28D2"><enum>(V)</enum><text>in clause (iii)

			 (as redesignated by subclause (III) of this clause), by inserting <quote>that

				and training activities related to the applied research and demonstration

				activities described in this subsection, which may also include serving as a

				repository for information on career and technical education skills, State

				academic standards, and related materials; and</text>

										</subclause><subclause id="IDC6FBB76BD8CF4A2490FBC08CBA72C533"><enum>(III)</enum><text>the recruitment

				and retention of career and technical education teachers, faculty, counselors,

				principals, and administrators, including individuals in groups

				underrepresented in the teaching profession; and</text>

										</subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block>

							</subclause></clause><clause id="IDF78E19C790734ACC80A51CCE162C7221"><enum>(ii)</enum><text>in

			 subparagraph (B)—</text>

										</subclause><subclause id="IDFB860A59DC1A44D29D3500DC81910093"><enum>(V)</enum><text>Two

				representatives of career and technical teacher preparation

				institutions.</text>

										</subclause><subclause id="IDE8A606537B65442A85100F8E7D46523F"><enum>(VI)</enum><text>Two nationally

				recognized researchers in the field of career and technical education.</text>

										</subclause></clause><clause id="IDDBA901582F2442EAAAAEE490228F8BEF"><enum>(iii)</enum><header>Coordination</header><text>The

				independent governing board shall ensure that the research and dissemination

				activities carried out by the center are coordinated with the research

				activities carried out by the Secretary.</text>

				that such institution is not eligible for a grant under this section.</text>

								</subparagraph><subparagraph id="ID73238A15369644529CDA2A6F775DE7DA"><enum>(B)</enum><text>A determination

				regarding the calculation of the amount of a grant awarded under this

				section.</text>

								</subparagraph></paragraph><paragraph id="IDBFEF2000E7424928B87BCB988A8B5C82"><enum>(2)</enum><header>Procedure for

				appeal</header><text>To appeal a determination described in paragraph (1), a

				tribally controlled postsecondary career and technical institution

				shall—</text>

								<subparagraph id="ID2E61253F56474ABD87B2F256E0F595E6"><enum>(A)</enum><text>in the case of an

				appeal based on a determination that such institution is not eligible for a

				grant under this section, file a notice of appeal with the Secretary not later

				than 30 days after receipt of such determination; and</text>

								</subparagraph><subparagraph id="IDA9E3015B8B804BCB8D15472F5FD9580C"><enum>(B)</enum><text>in the case of an

				appeal based on a determination regarding the calculation of the amount of a

				grant awarded under this section—</text>

									<clause id="ID7670C5CF666640DBA6510ACB34D2E600"><enum>(i)</enum><text>file a notice of

				appeal with the Secretary not later than 30 days after receipt of the

				Secretary’s notification of the grant amount; and</text>

									</clause><clause id="IDD84D84C62EE0406FBF512A772C743263"><enum>(ii)</enum><text>identify the

				amount of funding that gives rise to such appeal.</text>

									</clause></subparagraph></paragraph><paragraph id="IDFBF6ECFBE7974564B906F43193DB5C2A"><enum>(3)</enum><header>Withholding of

				amount</header><text>If a tribally controlled postsecondary career and

				technical institution appeals a determination described in paragraph (1), the

				Secretary shall withhold the amount in dispute from the award of grant funds

				under this section until such time as the administrative law judge has issued a

				written decision on the appeal.</text>

							</paragraph></subsection><after-quoted-block>;

				and</after-quoted-block></quoted-block>

				</paragraph><paragraph id="IDAC9D5CF96FC14519A52C37285B7BAE2B"><enum>(6)</enum><text>by striking

			 subsection (j) (as redesignated by paragraph (4) of this section) and inserting

				application submitted under paragraph (1) shall include—</text>

								<subparagraph id="ID0833160A217B4EDA8D438F8D477675C1"><enum>(A)</enum><text>a description of

				how the State entity designated in subsection (c) will provide information

				based on labor market trends to inform program development; and</text>

								</subparagraph><subparagraph id="ID282A720DCC0848EE9B0B96435240F6DC"><enum>(B)</enum><text>information about

				the academic content standards and student academic achievement standards

				adopted by the State under section 1111(b)(1) of the

				<act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

				1965</act-name>.</text>

								</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>

				</paragraph><paragraph id="ID226F7355AB024526B9DAEE54D9F2BE42"><enum>(4)</enum><text>in subsection (c)

			 (as redesignated by paragraph (2) of this section)—</text>

			 by striking <quote>such entities;</quote> and inserting <quote>such entities,

			 with an emphasis on high skill, high wage, or high demand occupations in

			 emerging or established professions;</quote>;</text>

				career and technical education activities to be assisted that are designed to

				meet or exceed the State adjusted levels of performance, including a

				description of—</text>

								<subparagraph id="ID9E3A09D6214B43748CCC0B148D84D474"><enum>(A)</enum><text>how the eligible

				agency will support eligible recipients in developing or implementing career

				pathways for career and technical education content areas that are designed to

				meet relevant workforce needs, including how the eligible agency will—</text>

									<clause id="IDF1FF1306919E46E5912D348B82721581"><enum>(i)</enum><text>support eligible

				recipients in developing articulation agreements between secondary and

				postsecondary institutions;</text>

									</clause><clause id="ID6F0D249675204B8BB47EDB8184AE1181"><enum>(ii)</enum><text>support eligible

				recipients in using labor market information to identify career pathways that

				prepare individuals for high skill, high wage, or high demand

				occupations;</text>

									</clause><clause id="IDF1735877A12D490FB0AF66ECA6BFD710"><enum>(iii)</enum><text>make available

				information about career pathways offered by eligible recipients; and</text>

									</clause><clause id="ID2F7A18A2603943FBB04B753AB72F2668"><enum>(iv)</enum><text>consult with

				business and industry and use industry-recognized standards and assessments, if

				appropriate;</text>

									</clause></subparagraph><subparagraph id="IDE970F6EB58AD4FF8949ADFD9995B366B"><enum>(B)</enum><text>the secondary and

				postsecondary career and technical education programs to be carried out,

				including programs that will be carried out by the eligible agency to develop,

				improve, and expand access to quality technology in career and technical

				education programs;</text>

								</subparagraph><subparagraph id="IDE20979BAA9224D4AA2808C401813D5A9"><enum>(C)</enum><text>the criteria that

				will be used by the eligible agency to approve eligible recipients for funds

				under this title, including criteria to assess the extent to which the local

				plan will—</text>

									<clause id="ID21A43E5FB385494FA49CA7FC85D56A2A"><enum>(i)</enum><text>promote higher

				levels of academic achievement;</text>

									</clause><clause id="IDAA1A8A4D12E7486F8F71830A0185A02F"><enum>(ii)</enum><text>promote higher

				levels of technical skill attainment; and</text>

									</clause><clause id="ID428A0F825BBB4D58B79951DBD197F3A3"><enum>(iii)</enum><text>identify and

				address workforce needs;</text>

									</clause></subparagraph><subparagraph id="ID10253644AAE4441A869A00DF9D2BC1F2"><enum>(D)</enum><text>how programs at

				the secondary level will prepare career and technical education students,

				including special populations to graduate from high school with a

				diploma;</text>

								</subparagraph><subparagraph id="ID80FF1D3670664764A36F9A3A3D3EA56D"><enum>(E)</enum><text>how such programs

				will prepare career and technical education students, including special

				populations, both academically and technically, for opportunities in

				postsecondary education or entry into high skill, high wage, or high demand

				occupations in emerging or established occupations, and how participating

				students will be made aware of such opportunities; and</text>

								</subparagraph><subparagraph id="ID124EC4421FB04D48B1CC132730EDB279"><enum>(F)</enum><text>how funds will be

				used to improve or develop new career and technical education courses in high

				skill, high wage, or high demand occupations that are aligned with business

				needs and industry standards, as appropriate—</text>

									<clause id="IDF889612FA2084C909FA66EB7C54C1442"><enum>(i)</enum><text>at the secondary

				level that are aligned with challenging academic content standards and student

				academic achievement standards adopted by the State under section 1111(b)(1) of

				the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

				1965</act-name>; and</text>

									</clause><clause id="ID62FA8D824B794A2FA32CBA64FAD461B9"><enum>(ii)</enum><text>at the

				postsecondary level that are relevant and challenging;</text>

									</clause></subparagraph></paragraph><paragraph id="IDC1E273CC2CB04FB387497D82FDF13F28"><enum>(2)</enum><text>describes how

				career and technical education teachers, faculty, principals, administrators,

				and career guidance and academic counselors will be provided comprehensive

				initial preparation and professional development, including through programs

				and activities that—</text>

								<subparagraph id="IDF501E3852DEA42A08E98CD9DE5C8F11A"><enum>(A)</enum><text>promote the

				integration of challenging academic and career and technical education

				curriculum development, including opportunities for teachers to jointly develop

				and implement curriculum and pedagogical strategies with appropriate academic

				teachers;</text>

								</subparagraph><subparagraph id="IDEA1EDC49F8274A97AB17F0B54EDC6774"><enum>(B)</enum><text>increase the

				academic and career and technical education knowledge of career and technical

				education teachers and faculty;</text>

								</subparagraph><subparagraph id="IDB38EBEDE5C244753AB4C3E187A004258"><enum>(C)</enum><text>are high-quality,

				sustained, intensive, focused on instruction, directly related to industry

				standards, and includes structured induction and mentoring components for new

				personnel, with an emphasis on identifying and addressing the needs of local

				businesses, including small businesses;</text>

								</subparagraph><subparagraph id="IDCB953790D57D44EA85EF603BD350F90B"><enum>(D)</enum><text>ensure an

				increasing number of career and technical education teachers and faculty meet

				teacher certification and licensing requirements reflecting the needs of their

				subject area or areas;</text>

								</subparagraph><subparagraph id="ID1A457103F0B84543A358D362AD7DB761"><enum>(E)</enum><text>equip them with

				the knowledge and skills needed to work with and improve instruction for

				special populations;</text>

								</subparagraph><subparagraph id="ID2A419C0BCA124A1AB92DE8F3F7BFF1A5"><enum>(F)</enum><text>assist in

				accessing and utilizing data, including labor market indicators, student

				achievement, and assessments;</text>

								</subparagraph><subparagraph id="ID9500CD4AE5AB45EA90B6397F00CBF310"><enum>(G)</enum><text>enhance the

				leadership capacity of principals and administrators;</text>

								</subparagraph><subparagraph id="IDBB31F85521794466A0CDC3675664B60B"><enum>(H)</enum><text>are integrated

				with professional development activities that the State carries out under title

				II of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act

				of 1965</act-name> and title II of the <act-name parsable-cite="HEA65">Higher

				Education Act of 1965</act-name>; and</text>

								</subparagraph><subparagraph id="ID92F096ED9E7C4193A7250062664F4E54"><enum>(I)</enum><text>include

				strategies to expose all career and technical education students to

				comprehensive information regarding career options that lead to high skill,

				high wage, or high demand occupations and nontraditional fields;</text>

								</subparagraph></paragraph><paragraph id="IDEFB32BFECAE7454E8E77187F8043CA92"><enum>(3)</enum><text>describes efforts

				to improve—</text>

								<subparagraph id="ID7415DD44808A4D2EAA74361E9C58CB22"><enum>(A)</enum><text>the recruitment

				and retention of career and technical education teachers, faculty, counselors,

				principals, and administrators, including individuals in groups

				underrepresented in the teaching profession; and</text>

								</subparagraph><subparagraph id="IDD922B7D789FC42D4A1A63EF6BFA7E3B6"><enum>(B)</enum><text>the transition to

				teaching from business and industry, including small business;</text>

								</subparagraph></paragraph><paragraph id="ID2F629A03A87649E6872BA5812AF91D33"><enum>(4)</enum><text>describes efforts

				to improve the capacity of programs and faculty at postsecondary institutions

				to effectively prepare career and technical education personnel, including, as

				appropriate, through electronically delivered distance education, and

				articulation agreements between 2-year technical programs and postsecondary

				education programs;</text>

							</paragraph><paragraph id="ID40B54F10A6A94767A3263B269420F611"><enum>(5)</enum><text>describes how the

				eligible agency will actively involve parents, academic and career and

				technical education teachers, faculty, principals, and administrators, career

				guidance and academic counselors, local businesses (including small- and

				medium-sized businesses and business intermediaries), and labor organizations

				in the planning, development, implementation, and evaluation of such career and

				technical education programs;</text>

							</paragraph><paragraph id="ID4310A79BE42340B4B06C2C183F51547E"><enum>(6)</enum><text>describes how

				funds received by the eligible agency through the allotment made under section

				111 will be allocated—</text>

								<subparagraph id="ID2E1D9122B0D3411A8F71F158D8EE71DD"><enum>(A)</enum><text>among secondary

				school career and technical education, or postsecondary and adult career and

				technical education, or both, including the rationale for such allocation;

				and</text>

								</subparagraph><subparagraph id="ID868BDC0111A047859F55A7BFABB19CD8"><enum>(B)</enum><text>among any

				consortia that will be formed among secondary schools and eligible

				institutions, and how funds will be allocated among the members of the

				consortia, including the rationale for such allocation;</text>

								</subparagraph></paragraph><paragraph id="IDEFFF048141434A0691E9A059650BAFAF"><enum>(7)</enum><text>describes how the

				eligible agency will—</text>

								<subparagraph id="ID4EDD93F6228A4734885082E1B847DC6E"><enum>(A)</enum><text>use funds to

				improve or develop new career and technical education courses in high skill,

				high wage, or high demand occupations—</text>

									<clause id="ID217693D26B3941B89FF8B59BAE6656C4"><enum>(i)</enum><text>at the secondary

				level that are aligned with challenging academic content standards and student

				academic achievement standards adopted by the State under section 1111(b)(1) of

				the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

				1965</act-name>; and</text>

									</clause><clause id="IDBAB3DE55C54647DB853BEA19AA9DB2F1"><enum>(ii)</enum><text>at the

				postsecondary level that are challenging and aligned with business needs and

				industry standards, as appropriate;</text>

									</clause></subparagraph><subparagraph id="ID435E48E81B6A4335BEA9420D9B3330C7"><enum>(B)</enum><text>improve the

				academic and technical skills of students participating in career and technical

				education programs, including strengthening the academic, and career and

				technical, components of career and technical education programs through the

				integration of academics with career and technical education to ensure learning

				in the core academic subjects and career and technical education subjects, and

				provide students with strong experience in, and understanding of, all aspects

				of an industry;</text>

								</subparagraph><subparagraph id="ID7C0E0B014EAA47BF920634E86B6A3937"><enum>(C)</enum><text>ensure that

				students who participate in such career and technical education programs are

				taught to the same challenging academic proficiencies as are taught to all

				other students; and</text>

								</subparagraph><subparagraph id="ID2E83E257B91247C6BBE0C4EF9B50171A"><enum>(D)</enum><text>encourage

				secondary school students who participate in such career and technical

				education programs to enroll in challenging courses in core academic

				subjects;</text>

								</subparagraph></paragraph><paragraph id="ID0C0CAFCFC93141EAAE33C09AD32957D7"><enum>(8)</enum><text>describes how the

				eligible agency will annually evaluate the effectiveness of such career and

				technical education programs, and describes, to the extent practicable, how the

				eligible agency is coordinating such programs to promote relevant lifelong

				learning and ensure nonduplication with other existing Federal programs;</text>

							</paragraph><paragraph id="ID9213ECD4C4734039BAC002928F6107DE"><enum>(9)</enum><text>describes the

				eligible agency’s program strategies for special populations, including a

				description of how individuals who are members of the special

				populations—</text>

								<subparagraph id="ID746AB7D017A94372B253AEDC851FA1E1"><enum>(A)</enum><text>will be provided

				with equal access to activities assisted under this title;</text>

								</subparagraph><subparagraph id="ID2C6343B7860A4B3EAC387C4E94DCBA15"><enum>(B)</enum><text>will not be

				discriminated against on the basis of their status as members of the special

				populations; and</text>

								</subparagraph><subparagraph id="ID1550E4F5BFCD43399DB498C7017A4709"><enum>(C)</enum><text>will be provided

				with programs designed to enable the special populations to meet or exceed

				State adjusted levels of performance, and prepare special populations for

				further learning and for high skill, high wage, or high demand

				occupations;</text>

								</subparagraph></paragraph><paragraph id="IDEB41074AE6CC4E0FA9C74FF4123D5692"><enum>(10)</enum><text>how the eligible

				agency will collaborate in developing the State plan with—</text>

								<subparagraph id="IDFA80DC32E936463487E6FEA5ABA1694D"><enum>(A)</enum><text>the entity within

				the State with responsibility for elementary and secondary education;</text>

								</subparagraph><subparagraph id="ID6C2C93BFA69F4C9A8102BBE987A9E1DE"><enum>(B)</enum><text>the entity within

				the State with responsibility for public institutions engaged in postsecondary

				education;</text>

								</subparagraph><subparagraph id="ID8510E87B2186418ABDCD16FD4F3F9C3B"><enum>(C)</enum><text>State

				institutions such as State correctional institutions and institutions that

				serve individuals with disabilities; and</text>

								</subparagraph><subparagraph id="IDB66645E8ACE440F5889763FA5FB266C2"><enum>(D)</enum><text>all other

				relevant State agencies with responsibility for career and technical education

				and training and workforce development;</text>

								</subparagraph></paragraph><paragraph id="ID8072BCF6A79F4EC4AC6AD34485D6DF31"><enum>(11)</enum><text>describes what

				steps the eligible agency will take to involve representatives of eligible

				recipients in the development of the State adjusted levels of

				performance;</text>

							</paragraph><paragraph id="IDF385242F61AB4B6DBD421D4A3CECA83A"><enum>(12)</enum><text>provides

				assurances that the eligible agency will comply with the requirements of this

				title and the provisions of the State plan, including the provision of a

				financial audit of funds received under this title which may be included as

				part of an audit of other Federal or State programs;</text>

							</paragraph><paragraph id="IDFEA8D04F5E8341D1A6DD4ABB4766F270"><enum>(13)</enum><text>provides

				assurances that none of the funds expended under this title will be used to

				acquire equipment (including computer software) in any instance in which such

				acquisition results in a direct financial benefit to any organization

				representing the interests of the purchasing entity, the employees of the

				purchasing entity, or any affiliate of such an organization;</text>

							</paragraph><paragraph id="ID2B2CB4AF64494733A2C123EC53AEA748"><enum>(14)</enum><text>describes how

				the eligible agency will measure and report data relating to students

				participating in and completing career and technical education within specific

				career clusters in order to adequately measure the progress of the students,

				including special populations, at—</text>

								<subparagraph id="ID31B328F49D5C4702B1F2CF97A040F190"><enum>(A)</enum><text>the secondary

				level, disaggregated by the categories described in section 1111(h)(1)(C)(i) of

				the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

				1965</act-name>, except that such disaggregation shall not be required in a

				case in which the number of individuals in a category is insufficient to yield

				statistically reliable information or the results would reveal personally

				identifiable information about an individual; and</text>

								</subparagraph><subparagraph id="IDC4CAC8DC12A44BE7BACCF82A354E26FF"><enum>(B)</enum><text>the postsecondary

				level, disaggregated by special populations and the categories described in

				career and technical education relates to State and regional occupational

				opportunities;</text>

				as part of 501 plan</header><text>The eligible agency may submit the plan

				required under this section as part of the plan submitted under section 501 of

				the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/20/9271">20 U.S.C. 9271</external-xref>), provided that the

				plan submitted pursuant to the requirement of this section meets the

				requirements of this Act.</text>

							</paragraph></subsection><after-quoted-block>;

				</paragraph><paragraph id="ID5E12D987A0B74554A5EA139C6A714E29"><enum>(6)</enum><text>by striking

			 subsection (f).</text>

				</paragraph></section><section id="IDBBDA74D6B13449BF9206B325156E9681"><enum>112.</enum><header>Improvement

			 plans</header><text display-inline="no-display-inline">Section 123

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/2343">20 U.S.C.

			 2343</external-xref>) is amended to read as follows:</text>

				plans</header>

				improvement plan</header>

							<paragraph id="ID3EB303DB10074117B86E9B36385A7DEA"><enum>(1)</enum><header>Plan</header><text>If

				a State fails to meet the State adjusted levels of performance described in the

				report submitted under section 113(c), the eligible agency shall develop and

				implement a program improvement plan in consultation with the appropriate

				agencies, individuals, and organizations for the first program year succeeding

				the program year in which the eligible agency failed to meet the State adjusted

				levels of performance, in order to avoid a sanction under paragraph (3).</text>

							</paragraph><paragraph id="ID3D3293DEFFE64386979E3E20C64F4C16"><enum>(2)</enum><header>Technical

				assistance</header><text>If the Secretary determines that an eligible agency is

				not properly implementing the eligible agency’s responsibilities under section

				122, or is not making substantial progress in meeting the purpose of this Act,

				based on the State’s adjusted levels of performance, the Secretary shall work

				with the eligible agency to implement improvement activities consistent with

				the requirements of this Act.</text>

							</paragraph><paragraph id="ID33C40C7DAB89487389A54D2EF21774F5"><enum>(3)</enum><header>Failure</header>

								<subparagraph id="IDD6F0B627319C4A959D857488543AA5B3"><enum>(A)</enum><header>In

				general</header><text>If an eligible agency fails to meet the State adjusted

				levels of performance, has not implemented an improvement plan as described in

				paragraph (1), has shown no improvement within 1 year after implementing an

				improvement plan as described in paragraph (1), or has failed to meet the State

				adjusted levels of performance for 2 or more consecutive years, the Secretary

				may, after notice and opportunity for a hearing, withhold from the eligible

				agency all, or a portion of, the eligible agency’s allotment under this

				title.</text>

								</subparagraph><subparagraph id="ID78651991371241FCA6ED684B4A4FAB31"><enum>(B)</enum><header>Waiver for

				exceptional circumstances</header><text>The Secretary may waive the sanction in

				subparagraph (A) due to exceptional or uncontrollable circumstances such as a

				natural disaster or a precipitous and unforeseen decline in financial resources

				of the State.</text>

								</subparagraph></paragraph><paragraph id="ID1390D42C016A4684A5C4E9452D8BA9FA"><enum>(4)</enum><header>Funds resulting

				from reduced allotments</header>

								<subparagraph id="ID164A6A5B102D4C0DBFAADF3D53C46578"><enum>(A)</enum><header>In

				general</header><text>The Secretary shall use funds withheld under paragraph

				(3) for a State served by an eligible agency, to provide (through alternative

				arrangements) services and activities within the State to meet the purposes of

				this Act.</text>

								</subparagraph><subparagraph id="IDDADE1F185A594BC19328BB4C4980E869"><enum>(B)</enum><header>Redistribution</header><text>If

				the Secretary cannot satisfactorily use funds withheld under paragraph (3),

				then the amount of funds retained by the Secretary as a result of a reduction

				in an allotment made under paragraph (3) shall be redistributed to other

				eligible agencies in accordance with section 111.</text>

								</subparagraph></paragraph></subsection><subsection id="ID581C36795A304ACAA1DBF97B0BE1F115"><enum>(b)</enum><header>Local program

				improvement</header>

							<paragraph id="ID743016AA40994A03A6430A05AD24BF20"><enum>(1)</enum><header>Local

				evaluation</header><text>Each eligible agency shall evaluate annually, using

				the local adjusted levels of performance described in section 113(b)(4), the

				career and technical education activities of each eligible recipient receiving

				funds under this title.</text>

							</paragraph><paragraph id="ID47B8A061A88E4CD287BC5EE14B8A1D04"><enum>(2)</enum><header>Plan</header>

								<subparagraph id="ID0BC71E0D46704472B83C73F37BE41E87"><enum>(A)</enum><header>In

				general</header><text>If, after reviewing the evaluation, the eligible agency

				determines that an eligible recipient is not making substantial progress in

				achieving the local adjusted levels of performance, the eligible agency

				shall—</text>

									<clause id="ID4A11CA2F9185455588D82242CB6CE554"><enum>(i)</enum><text>conduct an

				assessment of the educational needs that the eligible recipient shall address

				to overcome local performance deficiencies, including the performance of

				special populations;</text>

									</clause><clause id="IDC4B28951CF3A4561807ECC4CF46C7327"><enum>(ii)</enum><text>enter into an

				improvement plan with an eligible recipient based on the results of the

				assessment, for the first program year succeeding the program year in which the

				eligible recipient failed to meet the local adjusted levels of performance,

				which plan shall demonstrate how the local performance deficiencies will be

				corrected and include instructional and other programmatic innovations of

				demonstrated effectiveness, and, where necessary, strategies for appropriate

				staffing and professional development; and</text>

									</clause><clause id="ID801A521FA25541E2957F9F90AD372CA8"><enum>(iii)</enum><text>conduct regular

				evaluations of the progress being made toward reaching the local adjusted

				levels of performance, as described in section 113(b)(4), and progress on

				implementing the improvement plan.</text>

									</clause></subparagraph><subparagraph id="ID1BFF369E945D42979296CFA79FD0E05B"><enum>(B)</enum><header>Consultation</header><text>The

				eligible agency shall conduct the activities described in subparagraph (A) in

				consultation with teachers, principals, administrators, faculty, parents, other

				school staff, appropriate agencies, and other appropriate individuals and

				organizations.</text>

								</subparagraph></paragraph><paragraph id="ID2586958FF3EC4C5B9055F2F9D4D3D896"><enum>(3)</enum><header>Technical

				assistance</header><text>If the eligible agency determines that an eligible

				recipient is not properly implementing the eligible recipient’s

				responsibilities under section 134, or is not making substantial progress in

				meeting the purpose of this Act, based on the local adjusted levels of

				performance, the eligible agency shall provide technical assistance to the

				eligible recipient to assist the eligible recipient in carrying out the

				improvement activities consistent with the requirements of this Act. An

				eligible recipient, in collaboration with the eligible agency, may request that

				the Secretary provide additional technical assistance.</text>

							</paragraph><paragraph id="IDC180A11574274D3C9E6CF71F0E97E12D"><enum>(4)</enum><header>Failure</header>

								<subparagraph id="ID8685BA13C65E43A4846EDE62D2BC0F48"><enum>(A)</enum><header>In

				general</header><text>If an eligible recipient fails to meet the local adjusted

				levels of performance as described in section 113(b)(4) and has not implemented

				an improvement plan as described in paragraph (2), has shown no improvement

				within 1 year after implementing an improvement plan as described in paragraph

				(2), or has failed to meet more than 1 of the local adjusted levels of

				performance for 2 or more consecutive years, the eligible agency may, after

				notice and opportunity for a hearing, withhold from the eligible recipient all,

				or a portion of, the eligible recipient’s allotment under this title.</text>

								</subparagraph><subparagraph id="IDA579FC02B83A4E458E9BC558CE3EDCA9"><enum>(B)</enum><header>Waiver for

				exceptional circumstances</header><text>The eligible agency may waive the

				sanction under this paragraph due to exceptional or uncontrollable

				circumstances such as organizational structure, or a natural disaster or a

				precipitous and unforeseen decline in financial resources of the eligible

				recipient.</text>

								</subparagraph></paragraph><paragraph id="IDEC8EF3A8F7554F71B656FDB164466E2A"><enum>(5)</enum><header>Funds resulting

				from reduced allotments</header><text>The eligible agency shall use funds

				withheld under paragraph (4) to provide (through alternative arrangements)

				services and activities to students within the area served by such recipient to

				meet the purpose of this Act.</text>

							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</section><section id="IDB6103CC974044AE186160F80B1E51EAB"><enum>113.</enum><header>State

			 leadership activities</header><text display-inline="no-display-inline">Section

			 124 (<external-xref legal-doc="usc" parsable-cite="usc/20/2344">20 U.S.C.

			 2344</external-xref>) is amended—</text>

				<paragraph id="ID3914AE86A81341DEB49DFA7F189EBC0E"><enum>(1)</enum><text>by striking

			 <quote>vocational</quote> each place the term appears and inserting

			 <quote>career</quote>;</text>

				lifelong learning, including through partnerships that may involve institutions

				of higher education, organizations providing career and technical education,

				businesses, and communications entities;</text>

							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>

					</subparagraph><subparagraph id="ID857938EAC53D4AB3B3C9B66A70A98DC6"><enum>(C)</enum><text>by striking

			 paragraph (3) and inserting the following:</text>

							<paragraph id="ID19196FCD9BF641FFB91C5F848A44BF98"><enum>(3)</enum><text>professional

				development programs, including providing comprehensive professional

				development (including initial teacher preparation) for career and technical

				and academic counselors at the secondary and postsecondary levels, that support

				activities described in section 122 and—</text>

								<subparagraph id="IDA930FA8093AE48AAA865D2CAAB1BDA15"><enum>(A)</enum><text>provide

				in-service and pre-service training in career and technical education programs

				and techniques, effective teaching skills based on promising practices and,

				where available and appropriate, scientifically based research, and effective

				practices to improve parental and community involvement;</text>

								</subparagraph><subparagraph id="IDF474EC8738E24F7DA63B96E18574BF0A"><enum>(B)</enum><text>improve student

				achievement in order to meet the State adjusted levels of performance

				established under section 113;</text>

								</subparagraph><subparagraph id="ID0F92BF55B4EB40D1BBF252B51CD5B544"><enum>(C)</enum><text>support education

				programs for teachers and faculty of career and technical education in public

				schools and other public school personnel who are involved in the direct

				delivery of educational services to career and technical education students to

				ensure that such personnel—</text>

									<clause id="IDBE71F402F30C40728B58D1CE794E39B8"><enum>(i)</enum><text>stay current with

				the needs, expectations, and methods of industry;</text>

									</clause><clause id="ID8B1E8ACC399A4FE2B2B472CB82422474"><enum>(ii)</enum><text>can effectively

				develop challenging, integrated academic and career and technical education

				curriculum jointly with academic teachers, to the extent practicable;

				and</text>

									</clause><clause id="IDD8CE81427DDC4606A0436DDD8BC5CE20"><enum>(iii)</enum><text>develop a

				higher level of academic and industry knowledge and skills in career and

				technical education; and</text>

									</clause></subparagraph><subparagraph id="ID7CA9C5A289B24D5AB16D95A15F27C5A2"><enum>(D)</enum><text>are integrated

				with the teacher certification or licensing and professional development

				activities that the State carries out under title II of the

				<act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

				1965</act-name> and title II of the <act-name parsable-cite="HEA65">Higher

				Education Act of 1965</act-name>;</text>

								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

					</subparagraph><subparagraph id="ID033134BA8F734CDEA8A6B70E50166347"><enum>(D)</enum><text>in paragraph (4),

			 by striking <quote>support for</quote> and inserting

			 <quote>supporting</quote>;</text>

					</subparagraph><subparagraph id="IDD4F9EDC91E1B429A81440CFE42E440AA"><enum>(E)</enum><text>in paragraph (5),

			 by striking <quote>nontraditional training and employment</quote> and inserting

				career guidance and academic counseling programs that assist students in making

				informed academic, and career and technical education, decisions, including

				encouraging secondary and postsecondary students to graduate with a diploma or

				degree, and expose students to high skill, high wage occupations and

				nontraditional fields in emerging and established professions;</text>

							</paragraph><paragraph id="ID22E10C139302487CA96661028519DFC9"><enum>(2)</enum><text>establishment of

				agreements, including articulation agreements, between secondary and

				postsecondary career and technical education programs in order to provide

				postsecondary education and training opportunities for students participating

				in such career and technical education programs, such as tech-prep

				programs;</text>

							</paragraph><paragraph id="ID61FF327CEEAC4B5195CBAC1AD6975F63"><enum>(3)</enum><text>support for

				career and technical student organizations, especially with respect to efforts

				to increase the participation of students who are members of special

				populations;</text>

							</paragraph><paragraph id="IDE7748BEC11104045A4C087CEE5092B3B"><enum>(4)</enum><text>support for

				public charter schools operating secondary career and technical education

				programs;</text>

							</paragraph><paragraph id="ID36753A501DDE4118A9B4A45EBE899DA5"><enum>(5)</enum><text>support for

				career and technical education programs that offer experience in, and

				understanding of, all aspects of an industry for which students are preparing

				to enter;</text>

							</paragraph><paragraph id="ID156671786B8B41F1B4115F3FEA138A66"><enum>(6)</enum><text>support for

				family and consumer sciences programs;</text>

							</paragraph><paragraph id="ID0BDBFF3E945A42B6BBA357FE6D472883"><enum>(7)</enum><text>support for

				partnerships between education and business or business intermediaries,

				including cooperative education and adjunct faculty arrangements at the

				secondary and postsecondary levels;</text>

							</paragraph><paragraph id="IDBC30AE4B188C4636B195BF0E45D44E48"><enum>(8)</enum><text>support to

				improve or develop new career and technical education courses and initiatives,

				including career clusters, career academies, and distance learning, that

				prepare individuals academically and technically for high skill, high wage, or

				high demand occupations;</text>

							</paragraph><paragraph id="ID731AB53844CC48A9BDB3C3115220909D"><enum>(9)</enum><text>awarding

				incentive grants to eligible recipients for exemplary performance in carrying

				out programs under this Act, which awards shall be based on local performance

				indicators, as described in section 113, in accordance with previously publicly

				disclosed priorities;</text>

							</paragraph><paragraph id="IDB5C049D587FE440B86EDC8EE5F3373E0"><enum>(10)</enum><text>providing career

				and technical education programs for adults and school dropouts to complete

				their secondary school education;</text>

							</paragraph><paragraph id="ID3E5CAEA6FD0949068A24E9FE51C17BCF"><enum>(11)</enum><text>providing

				assistance to individuals, who have participated in services and activities

				under this title, in finding an appropriate job and continuing their education

				or training through collaboration with the workforce investment system

				established under the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2801">29 U.S.C. 2801</external-xref> et

				seq.);</text>

							</paragraph><paragraph id="ID7B5936C0A6334152A0E0FE14A0F09AAC"><enum>(12)</enum><text>developing valid

				and reliable assessments of technical skills that are integrated with industry

				certification assessments where available;</text>

							</paragraph><paragraph id="ID048F8F6612444DE4AB1BAB9F6A954D81"><enum>(13)</enum><text>developing and

				enhancing data systems to collect and analyze data on secondary and

				postsecondary academic and employment outcomes;</text>

							</paragraph><paragraph id="IDBE3367773FB147DABDBB34A194755D8F"><enum>(14)</enum><text>improving—</text>

								<subparagraph id="ID3EAB0DE1FCC54F2096CEBC97FE02989A"><enum>(A)</enum><text>the recruitment

				and retention of career and technical education teachers, faculty, principals,

				administrators, and career guidance and academic counselors, including

				individuals in groups underrepresented in the teaching profession; and</text>

								</subparagraph><subparagraph id="ID84D049295F5343E5BF2751CBF100EF8B"><enum>(B)</enum><text>the transition to

				teaching from business and industry, including small business; and</text>

								</subparagraph></paragraph><paragraph id="IDCFC3BE4854DC47F9BF31A98E8C932F1B"><enum>(15)</enum><text>adopting,

				calculating, or commissioning a self-sufficiency standard.</text>

							</paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>

				</paragraph><paragraph id="ID64666907939A4962B905C69A0CEF4F8E"><enum>(5)</enum><text>in subsection

			 (d), by striking <quote>112(a)(2)</quote> and inserting

				career and technical education teachers, faculty, principals, and

				administrators to use technology, including distance learning; or</text>

								</subparagraph><subparagraph id="ID94B5D86749714AE5BE008D26EE273F6A"><enum>(B)</enum><text>encouraging

				schools to collaborate with technology industries to offer voluntary

				internships and mentoring programs;</text>

								</subparagraph></paragraph><paragraph id="ID131C17F149B94D83978A0D2ACEEA1135"><enum>(5)</enum><text>provide

				professional development programs that are consistent with section 122 to

				secondary and postsecondary teachers, faculty, principals, administrators, and

				career guidance and academic counselors who are involved in integrated career

				and technical education programs, including—</text>

								<subparagraph id="IDE120230B2EA54AF7B8E2AA6291988651"><enum>(A)</enum><text>in-service and

				pre-service training—</text>

				technical education programs and techniques;</text>

									</clause><clause id="IDC362CB2CA7464B51B39BCD5D2FDABE5F"><enum>(ii)</enum><text>in effective

				integration of challenging academic and career and technical education jointly

				with academic teachers, to the extent practicable;</text>

									</clause><clause id="ID65EF532B878F4800AF099B0D4EC10DE2"><enum>(iii)</enum><text>in effective

				teaching skills based on research that includes promising practices; and</text>

									</clause><clause id="ID88A133A068B54234B60BA7D46E7ECA71"><enum>(iv)</enum><text>in effective

				practices to improve parental and community involvement;</text>

									</clause></subparagraph><subparagraph id="ID5BF263BD7C964F699E11F355A3509B08"><enum>(B)</enum><text>support of

				education programs that provide information on all aspects of an

				industry;</text>

								</subparagraph><subparagraph id="IDFD411EF99F6F4DF0994319BD0C1E5E84"><enum>(C)</enum><text>internship

				programs that provide relevant business experience; and</text>

								</subparagraph><subparagraph id="ID95E4057CE2DC4CA093DE82742AEA91E3"><enum>(D)</enum><text>programs

				dedicated to the effective use of instructional technology;</text>

								</subparagraph></paragraph><paragraph id="ID9AD201A296C2448487DEF4F2674C81E3"><enum>(6)</enum><text>develop and

				implement evaluations of the career and technical education programs carried

				out with funds under this title, including an assessment of how the needs of

				special populations are being met;</text>

							</paragraph><paragraph id="IDE1ACAB88020743A19162F470B0EA9848"><enum>(7)</enum><text>initiate,

				improve, expand, and modernize quality career and technical education programs,

				including relevant technology;</text>

							</paragraph><paragraph id="ID2E1E2B3ACD3B4B4688CA045F18874F32"><enum>(8)</enum><text>provide services

				and activities that are of sufficient size, scope, and quality to be effective;

				and</text>

				between the eligible recipient and businesses, including small businesses and

				business intermediaries, including for—</text>

								<subparagraph id="ID1B73719C81B84B0EBF1299C9CF9D5B31"><enum>(A)</enum><text>work-related

				experience for students, such as internships, cooperative education,

				school-based enterprises, entrepreneurship, and job shadowing that are related

				to career and technical education programs;</text>

								</subparagraph><subparagraph id="ID1954796FF1E949E08DA89E384CBAF6FC"><enum>(B)</enum><text>adjunct faculty

				arrangements at the secondary and postsecondary levels; and</text>

								</subparagraph><subparagraph id="IDC5A75DEE04B6481FA73F2F226FC25D25"><enum>(C)</enum><text>industry

				experience for teachers and faculty;</text>

								</subparagraph></paragraph><paragraph id="IDA2059BA747DF4702BEB41A8747631640"><enum>(4)</enum><text>to provide

				programs for special populations;</text>

							</paragraph><paragraph id="ID25557A27E9694BAFAFBCD940894D384F"><enum>(5)</enum><text>to assist career

				and technical student organizations;</text>

							</paragraph><paragraph id="IDD49FCA89FD184C4BBF78629F3DCEFA2C"><enum>(6)</enum><text>for mentoring and

				support services;</text>

							</paragraph><paragraph id="IDD0E0FFB7103B47D9AD3BB460B6BB4277"><enum>(7)</enum><text>for leasing,

				purchasing, upgrading, or adapting instructional equipment;</text>

							</paragraph><paragraph id="IDFAC891DF36B540E7802D4550B998ECBC"><enum>(8)</enum><text>for teacher

				preparation programs that address the integration of academic and career and

				technical education and that assist individuals who are interested in becoming

				career and technical education teachers and faculty, including individuals with

				experience in business and industry;</text>

							</paragraph><paragraph id="ID66185B142A974B15B3B001002B8A1A93"><enum>(9)</enum><text>to develop and

				expand postsecondary program offerings at times and in formats that are

				convenient and accessible for working students, including through the use of

				distance education;</text>

							</paragraph><paragraph id="ID1F68B8163AEE42C7A4F4DD8DDEAC6A02"><enum>(10)</enum><text>for improving or

				developing new career and technical education courses, including development of

				new career pathways;</text>

							</paragraph><paragraph id="ID39A15B427B184C4E81F0F841771020CB"><enum>(11)</enum><text>to develop and

				support small, personalized career-themed learning communities;</text>

							</paragraph><paragraph id="ID214411A62B884AF28B3749CE72B2CF4C"><enum>(12)</enum><text>to provide

				support for family and consumer sciences programs;</text>

				one-time project costs, and the cost of pilot programs.</text>
