		<official-title>To amend the Fairness to Contact Lens Consumers Act with

		  respect to the availability of contact lenses.</official-title>

	<legis-body>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Contact Lens Consumer Protection

			 Act</short-title></quote>.</text>

		</section><section id="id4E85E856D0F14E61A4E11E5DFB9BBE5E"><enum>2.</enum><header>Contact lens

			 consumer protection</header><text display-inline="no-display-inline">The

			 Fairness to Contact Lens Consumers Act (15 U.S.C. 7601 et seq.) is amended by

			 inserting after section 7, the following new section:</text>

			<quoted-block display-inline="no-display-inline" id="idA071343463FF4099999237B007B19E67" style="OLC">

				<section id="ID80ff790324364477b218a8c386200194"><enum>7A.</enum><header>Policy

				regarding the availability of contact lenses</header>

					<subsection id="ID3201c3de25dd428f9e1586069f5a9df5"><enum>(a)</enum><header>In

				General</header><text>A manufacturer shall make any contact lens the

				manufacturer produces, markets, distributes, or sells available in a

				commercially reasonable and nondiscriminatory manner to—</text>

						<paragraph id="idC242C6B2311D4F3CA25F8CEC060BC88A"><enum>(1)</enum><text>prescribers;</text>

						</paragraph><paragraph id="idA365E050D41646848759B5D293114838"><enum>(2)</enum><text>entities

				associated with prescribers; and</text>

						</paragraph><paragraph id="id4470AC071A2840E4B219390FD423CD0A"><enum>(3)</enum><text>alternative

				channels of distribution.</text>

						</paragraph></subsection><subsection id="ID719d97c9c3884c07954e0548542cfc01"><enum>(b)</enum><header>Exclusion</header>

						<paragraph id="id3D78353713024147BEA922117977A961"><enum>(1)</enum><header>In

				general</header><text>For purposes of this section, the term <term>contact

				lens</term> does not include lenses that are described in paragraph (2).</text>

						</paragraph><paragraph id="id08AFDCCDD9C749B184235C943FEAD341"><enum>(2)</enum><header>Lenses

				described</header><text>The lenses described in this paragraph include—</text>

							<subparagraph id="id9E42482FDF77426B892B6795A2C7044F"><enum>(A)</enum><text>rigid gas

				permeable lenses;</text>

							</subparagraph><subparagraph id="id0C936AB19268430082913DDCEA5F8742"><enum>(B)</enum><text>bitoric gas

				permeable lenses;</text>

							</subparagraph><subparagraph id="idE77195209A624C258B2220A1D0DB328A"><enum>(C)</enum><text>bifocal gas

				permeable lenses;</text>

							</subparagraph><subparagraph id="id866EFA0175DE4FC78D84B2032A950F71"><enum>(D)</enum><text>keratoconus

				lenses;</text>

							</subparagraph><subparagraph id="idB432CA0E405144DDA2BFA23BAE6E4DED"><enum>(E)</enum><text>custom soft toric

				lenses; and</text>

							</subparagraph><subparagraph id="idCA290766429B43D2A064B4DB4331ED71"><enum>(F)</enum><text>any other custom

				designed lenses that are manufactured for an individual patient and are not

				mass marketed or mass produced.</text>

							</subparagraph></paragraph></subsection><subsection id="ID558bdbc508554cc8a6ae8f55013aa96a"><enum>(c)</enum><header>Definitions</header><text>In

				this section:</text>

						<paragraph id="ID60b76b2f4daf428bb6a431f20777df87"><enum>(1)</enum><header>Alternative

				channels of distribution</header><text>The term <term>alternative channels of

				distribution</term> means any mail order company, Internet retailer, pharmacy,

				buying club, department store, or mass merchandise outlet, without regard to

				whether the entity is associated with a prescriber, unless the entity is a

				competitor as defined in paragraph (2).</text>

						</paragraph><paragraph id="ID3b5d614e91544e8b91116536a34cd005"><enum>(2)</enum><header>Competitor</header><text>The

				term <term>competitor</term> means an entity that manufactures contact lenses

				and sells the lenses in direct competition with another manufacturer.</text>

						</paragraph><paragraph id="ID1f9396a94cc3495b8c41230f40222f0e"><enum>(3)</enum><header>Manufacturer</header><text>The

				term <term>manufacturer</term> includes the manufacturer and the parent company

				of the manufacturer, and any subsidiaries, affiliates, successors, and assigns

				of the manufacturer.</text>

						</paragraph></subsection><subsection id="ID4a46347774fc4607b9eeb18b2edada60"><enum>(d)</enum><header>Safe Harbor for

				Manufacturers</header><text>Nothing in this section shall be deemed to impose

				on a manufacturer an obligation to—</text>

						<paragraph id="IDdf31ff01b84c4147bc35f029c562d9f4"><enum>(1)</enum><text>sell to a

				competitor;</text>

						</paragraph><paragraph id="IDf338a3f745d14e16a7e9f3f3ab484bd4"><enum>(2)</enum><text>sell contact

				lenses to different contact lens distributors or customers at the same price,

				consistent with applicable Federal law;</text>

						</paragraph><paragraph id="IDb2e42423f3ef4d4fa3ad2f0e5d6cfdbe"><enum>(3)</enum><text>open or maintain

				any account for a seller who is not in substantial compliance with this

				Act;</text>

						</paragraph><paragraph id="IDd148aa7503be436a90c995723b745ce3"><enum>(4)</enum><text>decide whether to

				sell to a low volume account directly or through a distributor; or</text>

						</paragraph><paragraph id="IDa6bd8269872242f088e9ffe98c072149"><enum>(5)</enum><text>make available to

				sellers in all geographic areas lenses that are being test marketed on a

				limited basis in one geographic area.</text>

						</paragraph></subsection><subsection id="ID11b4e2e7b8fd473485d77fc3776d6def"><enum>(e)</enum><header>Rulemaking</header><text>The

				Federal Trade Commission shall prescribe rules to carry out this section in the

				same manner as set forth under section 8 of this Act and any rule prescribed

				under this section shall take effect not later than 60 days after the date of

				the enactment of this Act.</text>

					</subsection><subsection id="IDefa46d3387514f86bcffbfd63f78495a"><enum>(f)</enum><header>Violations</header><text>Any

				violation of this section or the rules required under subsection (e) shall be

				treated in the same manner as provided for under section 9 of this

				Act.</text>
