			 <quote><short-title>Great Lakes Fish and Wildlife
			 Restoration Act of 2006</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSEV00" id="idF2E0ADEC70CB493F91C9A5AFC16BE07D" reported-display-style="strikethrough"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph changed="deleted" committee-id="SSEV00" id="IDf47ae9a2f5734e939096e4f432a7bbbb" reported-display-style="strikethrough"><enum>(1)</enum><text>the Great Lakes
			 have fish and wildlife communities that are structurally and functionally
			 changing;</text>
			</paragraph><paragraph changed="deleted" committee-id="SSEV00" id="IDbf6c2fe8db2c456d8b220bd1eb7c95b8" reported-display-style="strikethrough"><enum>(2)</enum><text>successful fish
			 and wildlife management focuses on the lakes as ecosystems, and effective
			 management requires the coordination and integration of efforts of many
			 partners;</text>
			</paragraph><paragraph changed="deleted" committee-id="SSEV00" id="IDe00984ce79c049f9b617428f53783521" reported-display-style="strikethrough"><enum>(3)</enum><text>it is in the
			 national interest to undertake activities in the Great Lakes Basin that support
			 sustainable fish and wildlife resources of common concern provided under the
			 recommendations of the Great Lakes Regional Collaboration authorized under
			 Executive Order 13340 (69 Fed. Reg. 29043; relating to the Great Lakes
			 Interagency Task Force);</text>
			</paragraph><paragraph changed="deleted" committee-id="SSEV00" id="id1D46CB111E6348DC81B33C98D8CE5748" reported-display-style="strikethrough"><enum>(4)</enum><text>additional actions
			 and better coordination are needed to protect and effectively manage the fish
			 and wildlife resources, and the habitats upon which the resources depend, in
			 the Great Lakes Basin;</text>
			</paragraph><paragraph changed="deleted" committee-id="SSEV00" id="idCF44F061CF184299B06D94AC6979E920" reported-display-style="strikethrough"><enum>(5)</enum><text>as of the date of
			 enactment of this Act, actions are not funded that are considered essential to
			 meet the goals and objectives in managing the fish and wildlife resources, and
			 the habitats upon which the resources depend, in the Great Lakes Basin;
			 and</text>
			</paragraph><paragraph changed="deleted" committee-id="SSEV00" id="IDd72f87f801334214b230e9eef1b6f131" reported-display-style="strikethrough"><enum>(6)</enum><text>the Great Lakes
			 Fish and Wildlife Restoration Act (16 U.S.C. 941 et seq.) allows Federal
			 agencies, States, and tribes to work in an effective partnership by providing
			 the funding for restoration work.</text>
			</paragraph></section><section changed="deleted" committee-id="SSEV00" id="ID0f6517a342d44417a9edfe582ff80b9b" reported-display-style="strikethrough"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 1004 of the Great Lakes Fish and
			 Wildlife Restoration Act of 1990 (16 U.S.C. 941b) is amended—</text>
			<paragraph changed="deleted" committee-id="SSEV00" id="ID8ae827c14248404f8595be33f47dc87a" reported-display-style="strikethrough"><enum>(1)</enum><text>by striking
			 paragraphs (1), (4), and (12);</text>
			</paragraph><paragraph changed="deleted" committee-id="SSEV00" id="IDfdbd94c394904ca3b96afa8b52e81a9a" reported-display-style="strikethrough"><enum>(2)</enum><text>by redesignating
			 paragraphs (2), (3), (5), (6), (7), (8), (9), (10), (11), (13), and (14) as
			 paragraphs (1), (2), (3), (4), (5), (6), (7), (9), (10), (11), and (12),
			 respectively;</text>
			</paragraph><paragraph changed="deleted" committee-id="SSEV00" id="ID912490cdfe494cce8637d5755afbbd5d" reported-display-style="strikethrough"><enum>(3)</enum><text>in paragraph (4)
			 (as redesignated by paragraph (2)), by inserting before the semicolon at the
			 end the following: <quote>, and that has Great Lakes fish and wildlife
			 management authority in the Great Lakes Basin</quote>; and</text>
			</paragraph><paragraph changed="deleted" committee-id="SSEV00" id="IDa5133804b7e048d0b11aedfc17066401" reported-display-style="strikethrough"><enum>(4)</enum><text>by inserting after
			 paragraph (7) (as redesignated by paragraph (2)) the following:</text>

					<paragraph commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="id401FA890B1214C56B8A7BF551D2DB33A"><enum>(8)</enum><text display-inline="yes-display-inline">the term <term>regional project</term>
				means authorized activities of the United States Fish and Wildlife Service
				related to fish and wildlife resource protection, restoration, maintenance, and
				enhancement that benefit the Great Lakes
				basin;</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="deleted" committee-id="SSEV00" id="IDc82007ee71154cacbf9fffcca2b97722" reported-display-style="strikethrough"><enum>4.</enum><header>Identification,
			 review, and implementation of proposals</header><text display-inline="no-display-inline">Section 1005 of the Great Lakes Fish and
			 Wildlife Restoration Act of 1990 (16 U.S.C. 941c) is amended to read as
			 follows:</text>

				<section committee-id="SSEV00" id="IDd3eea33839224e88b77a43738b8af1c0"><enum>1005.</enum><header>Identification,
				review, and implementation of proposals and regional projects</header>
					<subsection committee-id="SSEV00" id="IDc3623888e2f04397ba9eca6eeebe6677"><enum>(a)</enum><header>In
				general</header><text>Subject to subsection (b)(2), the Director—</text>
						<paragraph committee-id="SSEV00" id="IDf1e5711e22c64bc5a5b935f5d95442e3"><enum>(1)</enum><text>shall encourage
				the development and, subject to the availability of appropriations, the
				implementation of fish and wildlife restoration proposals and regional
				projects; and</text>
						</paragraph><paragraph committee-id="SSEV00" id="ID80d8fc7a232b4122a55555532c3d7bbc"><enum>(2)</enum><text>in cooperation
				with the State Directors and Indian Tribes, shall identify, develop, and,
				subject to the availability of appropriations, implement regional projects in
				the Great Lakes Basin to be administered by Director in accordance with this
				section.</text>
						</paragraph></subsection><subsection committee-id="SSEV00" id="ID20ee9821ab6e41cdb4c5080fd761a68e"><enum>(b)</enum><header>Identification
				of proposals and regional projects</header>
						<paragraph committee-id="SSEV00" id="ID661429703b6d400b998f37e5b99e6888"><enum>(1)</enum><header>Request by the
				Director</header><text>The Director shall annually request that State Directors
				and Indian Tribes, in cooperation or partnership with other interested entities
				and in accordance with subsection (a), submit proposals or regional projects
				for the restoration of fish and wildlife resources.</text>
						</paragraph><paragraph committee-id="SSEV00" id="ID03e6452ea6f44996aecfe98b6d56ff59"><enum>(2)</enum><header>Requirements for
				proposals and regional projects</header><text>A proposal or regional project
				under paragraph (1) shall be—</text>
							<subparagraph committee-id="SSEV00" id="id675091DFCB7F4B8FB62B053E1DB07831"><enum>(A)</enum><text>submitted in the
				manner and form prescribed by the Director; and</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="id1F04066025E847E683D318F0AEE83600"><enum>(B)</enum><text>consistent
				with—</text>
								<clause committee-id="SSEV00" id="id7BB8F7F2A2FA4872A052BD6396E9059A"><enum>(i)</enum><text>the goals of the
				Great Lakes Water Quality Agreement, as amended;</text>
								</clause><clause committee-id="SSEV00" id="id6D0F1FAD0A3F4AAFAF54FCA727370481"><enum>(ii)</enum><text>the 1954 Great
				Lakes Fisheries Convention;</text>
								</clause><clause committee-id="SSEV00" id="id774C5549E49345ABAC137B54821713A8"><enum>(iii)</enum><text>the 1980 Joint
				Strategic Plan for Management of Great Lakes Fisheries, as revised in 1997, and
				Fish Community Objectives for each Great Lake and connecting water as
				established under the Joint Strategic Plan;</text>
								</clause><clause committee-id="SSEV00" id="id19227D87801F4D1EB3D8940606F62873"><enum>(iv)</enum><text>the Nonindigenous
				Aquatic Nuisance Prevention and Control Act of 1990 (16 U.S.C. 4701 et
				seq.);</text>
								</clause><clause committee-id="SSEV00" id="id491E0F633BD4458DA0425823AE1BD74A"><enum>(v)</enum><text>the North American
				Waterfowl Management Plan and joint ventures established under the plan;
				and</text>
								</clause><clause committee-id="SSEV00" id="idA3265886BC16400CBAF377779717DDB5"><enum>(vi)</enum><text>the strategies
				outlined through the Great Lakes Regional Collaboration authorized under
				Executive Order 13340 (69 Fed. Reg. 29043; relating to the Great Lakes
				Interagency Task Force).</text>
								</clause></subparagraph></paragraph><paragraph committee-id="SSEV00" id="IDdecaea7b2f70405caa32e2c548bf6175"><enum>(3)</enum><header>Sea lamprey
				authority</header><text>The Great Lakes Fishery Commission shall retain
				authority and responsibility to formulate and implement a comprehensive program
				to eradicate or minimize sea lamprey populations in the Great Lakes
				Basin.</text>
						</paragraph></subsection><subsection committee-id="SSEV00" id="IDd7513a0ee325493c991d7f6cdbaa3c47"><enum>(c)</enum><header>Review of
				proposals</header>
						<paragraph committee-id="SSEV00" id="IDcac43b74142444c5bc2a6ee82ea772d4"><enum>(1)</enum><header>Establishment of
				committee</header><text>There is established the Great Lakes Fish and Wildlife
				Restoration Proposal Review Committee, which shall operate under the guidance
				of the United States Fish and Wildlife Service.</text>
						</paragraph><paragraph committee-id="SSEV00" id="ID5b22c548524c436ea33e6feeffe60f53"><enum>(2)</enum><header>Membership and
				appointment</header>
							<subparagraph committee-id="SSEV00" id="ID260a6e887e5a4b5ead052fdf8866f87f"><enum>(A)</enum><header>In
				general</header><text>The Committee shall consist of 2 representatives of each
				of the State Directors and Indian Tribes, of whom—</text>
								<clause committee-id="SSEV00" id="idA012DF3E820D480291AC1C8CF6C9437C"><enum>(i)</enum><text>1 representative
				shall be the individual appointed by the State Director or Indian Tribe to the
				Council of Lake Committees of the Great Lakes Fishery Commission; and</text>
								</clause><clause committee-id="SSEV00" id="id8EBCC35054B1449EB0B79DD2C846DF22"><enum>(ii)</enum><text>1 representative
				shall have expertise in wildlife management.</text>
								</clause></subparagraph><subparagraph committee-id="SSEV00" id="IDb7fed2796223415d8930b6c75d8b9b1e"><enum>(B)</enum><header>Appointments</header><text>Each
				representative shall serve at the pleasure of the appointing State Director or
				Tribal Chair.</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="ID2a73a5f566c047a28ccfab7d2cf1a2e4"><enum>(C)</enum><header>Observer</header><text>The
				Great Lakes Coordinator of the United States Fish and Wildlife Service shall
				participate as an observer of the Committee.</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="IDe68bc60e62ab4c8d98381f8163f369a4"><enum>(D)</enum><header>Recusal</header><text>A
				member of the Committee shall recuse himself or herself from consideration of
				proposals that the member, or the entity that the member represents, has
				submitted.</text>
							</subparagraph></paragraph><paragraph committee-id="SSEV00" id="ID944c8b858a6e45b7b1b6ec3dc5e13b1f"><enum>(3)</enum><header>Functions</header><text>The
				Committee shall—</text>
							<subparagraph committee-id="SSEV00" id="IDa6b79c9d5814446e8ecb1e3d2ba0fb2b"><enum>(A)</enum><text>meet at least
				annually;</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="ID61a95f9872ed4138ae8ad9e58e8e82d2"><enum>(B)</enum><text>review proposals
				and special projects developed in accordance with subsection (b) to assess the
				effectiveness and appropriateness of the proposals and special projects in
				fulfilling the purposes of this title; and</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="ID349730ac481f41f98b2a57b4758d7f83"><enum>(C)</enum><text>recommend to the
				Director any of those proposals and special projects that should be funded and
				implemented under this section.</text>
							</subparagraph></paragraph></subsection><subsection committee-id="SSEV00" id="ID09e29b8598364cb08f2dd56960439fbc"><enum>(d)</enum><header>Implementation
				of proposals and regional projects</header>
						<paragraph committee-id="SSEV00" id="idDB94362C4B3646D18F32ABF5532A3C3F"><enum>(1)</enum><header>In
				general</header><text>After considering recommendations of the Committee and
				the goals specified in section 1006, the Director shall—</text>
							<subparagraph committee-id="SSEV00" id="idD2951EA3519E4459ABE27379FEA7B3E3"><enum>(A)</enum><text>select proposals
				and regional projects to be implemented; and</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="idC96B9822A79648CC9E1320B13170753B"><enum>(B)</enum><text>subject to the
				availability of appropriations and subsection (e), fund implementation of the
				proposals and regional projects.</text>
							</subparagraph></paragraph><paragraph committee-id="SSEV00" id="idB099BBD543D94EC58D2A27E69B8C232A"><enum>(2)</enum><header>Selection
				criteria</header><text>In selecting and funding proposals and regional
				projects, the Director shall take into account the effectiveness and
				appropriateness of the proposals and regional projects in fulfilling the
				purposes of other laws applicable to restoration of the fish and wildlife
				resources and habitat of the Great Lakes Basin.</text>
						</paragraph></subsection><subsection committee-id="SSEV00" id="ID1e7dd095cc6e45deaba6d311da9db541"><enum>(e)</enum><header>Cost
				sharing</header>
						<paragraph committee-id="SSEV00" id="IDa86241ff2f134464bf8b3cb4886367f8"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraphs (2) and (4), not less
				than 25 percent of the cost of implementing a proposal selected under
				subsection (d) (excluding the cost of establishing sea lamprey barriers) shall
				be paid in cash or in-kind contributions by non-Federal sources.</text>
						</paragraph><paragraph committee-id="SSEV00" id="ID858f91c9ad4f4e96b49eca875546bc3f"><enum>(2)</enum><header>Regional
				projects</header><text>Regional projects selected under subsection (d) shall be
				exempt from cost sharing if the Director determines that the authorization for
				the project does not require a non-Federal cost-share.</text>
						</paragraph><paragraph commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="IDa7f360299fb4421885ae0ddf999df26c"><enum>(3)</enum><header>Exclusion of
				Federal funds from non-federal share</header><text>The Director may not
				consider the expenditure, directly or indirectly, of Federal funds received by
				any entity to be a contribution by a non-Federal source for purposes of this
				subsection.</text>
						</paragraph><paragraph commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="idBE5B48AA00134B68BE4F7EA09D3D8089"><enum>(4)</enum><header>Effect on
				certain Indian tribes</header><text>Nothing in this subsection affects an
				Indian tribe affected by an alternative applicable cost sharing requirement
				under the <act-name parsable-cite="ISDA">Indian Self-Determination and
				Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450 et
				seq.</external-xref>).</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="deleted" committee-id="SSEV00" id="ID2710840de9184b8d857c82a26a8cf900" reported-display-style="strikethrough"><enum>5.</enum><header>Goals of United
			 States Fish and Wildlife Service programs related to Great Lakes fish and
			 wildlife resources</header><text display-inline="no-display-inline">Section
			 1006 of the Great Lakes Fish and Wildlife Restoration Act of 1990 (16 U.S.C.
			 941d) is amended by striking paragraph (1) and inserting the following:</text>

				maintaining self-sustaining fish and wildlife
				resources.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="deleted" committee-id="SSEV00" id="ID5d3682acfad046e8af82d80e1901b81c" reported-display-style="strikethrough"><enum>6.</enum><header>Establishment of
			 offices</header><text display-inline="no-display-inline">Section 1007 of the
			 Great Lakes Fish and Wildlife Restoration Act of 1990 (16 U.S.C. 941e) is
			 amended—</text>
			<paragraph changed="deleted" committee-id="SSEV00" id="id7476C0626B81495C966BCA584D9CFE39" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (a) and inserting
			 the following:</text>

					<subsection committee-id="SSEV00" id="IDf7ef951f8ad341239b0cd3c0ba4bcd8a"><enum>(a)</enum><header>Great Lakes
				Coordination Office</header>
						<paragraph committee-id="SSEV00" id="idE5B39DF4CE3B41E5A863FA9B833C54B0"><enum>(1)</enum><header>In
				general</header><text>The Director shall establish a centrally located facility
				for the coordination of all United States Fish and Wildlife Service activities
				in the Great Lakes Basin, to be known as the <quote>Great Lakes Coordination
				Office</quote>.</text>
						</paragraph><paragraph committee-id="SSEV00" id="IDe0d196ec6d25463aaf0fc08dfbd2554b"><enum>(2)</enum><header>Functional
				responsibilities</header><text>The functional responsibilities of the Great
				Lakes Coordination Office shall include—</text>
							<subparagraph committee-id="SSEV00" id="id39EE596FB9604EFFB97EB150952A0480"><enum>(A)</enum><text>intra- and
				interagency coordination;</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="id2E2E5AEA59724AC6A1199B8FF6D3C03B"><enum>(B)</enum><text>information
				distribution; and</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="id75B40F660AB741AD8FE2FE3FD8DA5586"><enum>(C)</enum><text>public
				outreach.</text>
							</subparagraph></paragraph><paragraph committee-id="SSEV00" id="IDe41d626829d74d278323f82d88bf1192"><enum>(3)</enum><header>Requirements</header><text>The
				Great Lakes Coordination Office shall—</text>
							<subparagraph committee-id="SSEV00" id="IDe9fa32a5e6e04a738d038cb9baacfd8d"><enum>(A)</enum><text>ensure that
				information acquired under this Act is made available to the public; and</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="id1DFC9664E01D404BACCAEA757CA03701"><enum>(B)</enum><text>report to the
				Director of Region 3, Great Lakes Big
				Rivers.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph changed="deleted" committee-id="SSEV00" id="id58F84FE4C3FC411C848BB93F1A4163A9" reported-display-style="strikethrough"><enum>(2)</enum><text>in subsection

				through 2012, the Director shall submit to the 8 Great Lakes States and Indian
				Tribes a report that describes—</text>

				proposals implemented under section 1005;</text>
						</paragraph><paragraph committee-id="SSEV00" id="IDe4676856c4a94e1992f1930dfbf01b50"><enum>(3)</enum><text>progress toward
				the accomplishment of the goals specified in section 1006;</text>
						</paragraph><paragraph committee-id="SSEV00" id="ID456c033601a74941880276b57669df23"><enum>(4)</enum><text>the priorities
				proposed for funding in the annual budget process under this title; and</text>
						</paragraph><paragraph committee-id="SSEV00" id="ID0373b5f822ad4b578d7e2b580f43ce6a"><enum>(5)</enum><text>actions taken in
				support of the recommendations of the Great Lakes Regional Collaboration

						</paragraph></subsection><subsection committee-id="SSEV00" id="id8A978E39C3E440EAA7DD3F22804EAA29"><enum>(c)</enum><header>Study</header>
						<paragraph committee-id="SSEV00" id="idD91FFBEE00804B5491EDA92E3F87B2C0"><enum>(1)</enum><header>In
				general</header><text>Not later than December 16, 2009, the Director, in
				consultation with State fish and wildlife resource management agencies, Indian
				Tribes, and the Great Lakes Fishery Commission, shall—</text>
							<subparagraph committee-id="SSEV00" id="ID780268cf2ec2418fa6d9fd496fa05791"><enum>(A)</enum><text>conduct a
				comprehensive study of the status, and the assessment, management, and
				restoration needs, of the fish and wildlife resources of the Great Lakes Basin,
				including a comprehensive review of the accomplishments that have been achieved
				under this title through fiscal year 2008; and</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="id49BD7FF538CF48D19A0DFBB5C1108095"><enum>(B)</enum><text>submit to the
				President of the Senate and the Speaker of the House of Representatives—</text>
								<clause committee-id="SSEV00" id="id9A99C165139F4CE49752C4E9E4E3D91B"><enum>(i)</enum><text>the study
				described in subparagraph (A); and</text>
								</clause><clause committee-id="SSEV00" id="idE3862D382D43478D855C0113C76EA17E"><enum>(ii)</enum><text>a comprehensive
				report on the findings of the study.</text>
								</clause></subparagraph></paragraph></subsection><subsection committee-id="SSEV00" id="id9ACA7182E47A4BE8BC27DF37403C212D"><enum>(d)</enum><header>Report</header><text>Not
				later than June 30, 2006, the Director shall submit to the Committee on
				Environment and Public Works of the Senate and the Committee on Resources of
				the House of Representatives the 2002 report required under this section as in
				effect on the day before the date of enactment of the
				<short-title>Great Lakes Fish and Wildlife Restoration Act
				of
				2006</short-title>.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			 appropriations</header><text display-inline="no-display-inline">Section 1009 of

				percent or $600,000 shall be allocated to the United States Fish and Wildlife
				Service to cover costs incurred in administering the proposals by any
				entity;</text>
						</subparagraph></paragraph><paragraph commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="IDe0a753bf9c934653b59e7698be768595"><enum>(2)</enum><text>$6,000,000, which
				shall be allocated to implement regional projects by the United States Fish and

			 <quote><short-title>Great Lakes Fish and Wildlife
			 Restoration Act of 2006</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSEV00" id="id2287f38c-ef30-4d35-9061-1c42925b7b27" reported-display-style="italic"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph changed="added" committee-id="SSEV00" id="idb2a04f01-7d37-4126-afa1-96f72864fb29" reported-display-style="italic"><enum>(1)</enum><text>the Great Lakes have fish
			 and wildlife communities that are structurally and functionally
			 changing;</text>
			</paragraph><paragraph changed="added" committee-id="SSEV00" id="id60b0f8e5-1272-42fc-94b4-47635dab0c82" reported-display-style="italic"><enum>(2)</enum><text>successful fish and
			 wildlife management focuses on the lakes as ecosystems, and effective
			 management requires the coordination and integration of efforts of many
			 partners;</text>
			</paragraph><paragraph changed="added" committee-id="SSEV00" id="idac0499b0-f14f-4c3b-99dd-55f28506bfb9" reported-display-style="italic"><enum>(3)</enum><text>it is in the national
			 interest to undertake activities in the Great Lakes Basin that support
			 sustainable fish and wildlife resources of common concern provided under the
			 recommendations of the Great Lakes Regional Collaboration authorized under
			 Executive Order 13340 (69 Fed. Reg. 29043; relating to the Great Lakes
			 Interagency Task Force);</text>
			</paragraph><paragraph changed="added" committee-id="SSEV00" id="idbc969f2e-4136-420e-b3fd-9a17687fcf55" reported-display-style="italic"><enum>(4)</enum><text>additional actions and
			 better coordination are needed to protect and effectively manage the fish and
			 wildlife resources, and the habitats upon which the resources depend, in the
			 Great Lakes Basin;</text>
			</paragraph><paragraph changed="added" committee-id="SSEV00" id="idf675ca35-f325-4acc-a36f-e3be2343ae55" reported-display-style="italic"><enum>(5)</enum><text>as of the date of
			 enactment of this Act, actions are not funded that are considered essential to
			 meet the goals and objectives in managing the fish and wildlife resources, and
			 the habitats upon which the resources depend, in the Great Lakes Basin;
			 and</text>
			</paragraph><paragraph changed="added" committee-id="SSEV00" id="idf0b21a6b-3e3a-4650-b595-d90d61f9a307" reported-display-style="italic"><enum>(6)</enum><text>the Great Lakes Fish and
			 Wildlife Restoration Act (16 U.S.C. 941 et seq.) allows Federal agencies,
			 States, and tribes to work in an effective partnership by providing the funding
			 for restoration work.</text>
			</paragraph></section><section changed="added" committee-id="SSEV00" id="id57cdbf1c-695c-479a-b1a0-146caa0a1c4c" reported-display-style="italic"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 1004 of the Great Lakes Fish and
			 Wildlife Restoration Act of 1990 (16 U.S.C. 941b) is amended—</text>
			<paragraph changed="added" committee-id="SSEV00" id="id4f75b957-6d65-4334-a809-b9ed3e37f6ec" reported-display-style="italic"><enum>(1)</enum><text>by striking paragraphs
			 (1), (4), and (12);</text>

			 and implementation of proposals</header><text display-inline="no-display-inline">Section 1005 of the Great Lakes Fish and
			 Wildlife Restoration Act of 1990 (16 U.S.C. 941c) is amended to read as
			 follows:</text>

				general</header><text>Subject to subsection (b)(2), the Director—</text>
						<paragraph committee-id="SSEV00" id="id50bbdea2-53c3-434e-82cc-0292c1160691"><enum>(1)</enum><text>shall encourage the
				development and, subject to the availability of appropriations, the
				implementation of fish and wildlife restoration proposals and regional projects
				based on the results of the Report; and</text>
						</paragraph><paragraph committee-id="SSEV00" id="id65800763-30cc-4c41-ac37-a09a5f73c52d"><enum>(2)</enum><text>in cooperation with the
				State Directors and Indian Tribes, shall identify, develop, and, subject to the
				availability of appropriations, implement regional projects in the Great Lakes
				Basin to be administered by Director in accordance with this section.</text>
						</paragraph></subsection><subsection committee-id="SSEV00" id="id6bc053e3-ddd5-4799-9997-c641f3f9639d"><enum>(b)</enum><header>Identification of
				proposals and regional projects</header>
						<paragraph committee-id="SSEV00" id="ide53ab4a9-a453-457c-a0d9-491163cbed7d"><enum>(1)</enum><header>Request by the
				Director</header><text>The Director shall annually request that State Directors
				and Indian Tribes, in cooperation or partnership with other interested entities
				and in accordance with subsection (a), submit proposals or regional projects
				for the restoration of fish and wildlife resources.</text>
						</paragraph><paragraph committee-id="SSEV00" id="idd0812945-f95d-4164-8496-f6e91c20d3e5"><enum>(2)</enum><header>Requirements for
				proposals and regional projects</header><text>A proposal or regional project
				under paragraph (1) shall be—</text>
							<subparagraph committee-id="SSEV00" id="idd7eb068f-7878-4931-bf49-8db1ff723a47"><enum>(A)</enum><text>submitted in the manner
				and form prescribed by the Director; and</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="id3f29c957-fd99-49bd-b51f-3e3d6288e761"><enum>(B)</enum><text>consistent with—</text>
								<clause committee-id="SSEV00" id="idb14ca789-dfbe-4357-931e-ae3a88e11f57"><enum>(i)</enum><text>the goals of the Great
				Lakes Water Quality Agreement, as amended;</text>
								</clause><clause committee-id="SSEV00" id="idaac1a479-cb69-4685-b638-397eeceb02e4"><enum>(ii)</enum><text>the 1954 Great Lakes
				Fisheries Convention;</text>
								</clause><clause committee-id="SSEV00" id="id8dad6005-e552-4ed1-a260-722b9ef955e5"><enum>(iii)</enum><text>the 1980 Joint
				Strategic Plan for Management of Great Lakes Fisheries, as revised in 1997, and
				Fish Community Objectives for each Great Lake and connecting water as
				established under the Joint Strategic Plan;</text>
								</clause><clause committee-id="SSEV00" id="idd74e0a66-363b-4f25-b06a-b1110f013c95"><enum>(iv)</enum><text>the Nonindigenous
				Aquatic Nuisance Prevention and Control Act of 1990 (16 U.S.C. 4701 et
				seq.);</text>
								</clause><clause committee-id="SSEV00" id="id127caa25-d96a-43e0-a15b-7e5ba565ea2c"><enum>(v)</enum><text>the North American
				Waterfowl Management Plan and joint ventures established under the plan;
				and</text>
								</clause><clause committee-id="SSEV00" id="idc65a7905-7ce8-4977-b2a2-94422b00633f"><enum>(vi)</enum><text>the strategies outlined
				through the Great Lakes Regional Collaboration authorized under Executive Order
				13340 (69 Fed. Reg. 29043; relating to the Great Lakes Interagency Task
				Force).</text>
								</clause></subparagraph></paragraph><paragraph committee-id="SSEV00" id="id2cc9bf18-111e-4217-ab66-06cf6f9930c3"><enum>(3)</enum><header>Sea lamprey
				authority</header><text>The Great Lakes Fishery Commission shall retain
				authority and responsibility to formulate and implement a comprehensive program
				to eradicate or minimize sea lamprey populations in the Great Lakes
				Basin.</text>
						</paragraph></subsection><subsection committee-id="SSEV00" id="idf6419905-9e2c-4fa1-8157-dc34bf690b5e"><enum>(c)</enum><header>Review of
				proposals</header>
						<paragraph committee-id="SSEV00" id="id14027d39-20e3-41dc-9c15-0e455fb7226d"><enum>(1)</enum><header>Establishment of
				committee</header><text>There is established the Great Lakes Fish and Wildlife
				Restoration Proposal Review Committee, which shall operate under the guidance
				of the United States Fish and Wildlife Service.</text>
						</paragraph><paragraph committee-id="SSEV00" id="idf0c0138f-e770-4cb5-b0c3-92920c272661"><enum>(2)</enum><header>Membership and
				appointment</header>
							<subparagraph committee-id="SSEV00" id="id17a06d20-c0bf-4db7-895e-a58861a6abb6"><enum>(A)</enum><header>In
				general</header><text>The Committee shall consist of 2 representatives of each
				of the State Directors and Indian Tribes, of whom—</text>
								<clause committee-id="SSEV00" id="id9ada1538-e2a7-4e18-9145-cdf766910ce2"><enum>(i)</enum><text>1 representative shall be
				the individual appointed by the State Director or Indian Tribe to the Council
				of Lake Committees of the Great Lakes Fishery Commission; and</text>
								</clause><clause committee-id="SSEV00" id="idaec7568c-ea9c-4fff-b9c8-3853347fd60d"><enum>(ii)</enum><text>1 representative shall
				have expertise in wildlife management.</text>
								</clause></subparagraph><subparagraph committee-id="SSEV00" id="id9431a8f6-7f6a-451b-a4b4-d60cc7b75e4a"><enum>(B)</enum><header>Appointments</header><text>Each
				representative shall serve at the pleasure of the appointing State Director or
				Tribal Chair.</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="id3b1c3035-0b17-4f69-83a2-bad0a344970f"><enum>(C)</enum><header>Observer</header><text>The
				Great Lakes Coordinator of the United States Fish and Wildlife Service shall
				participate as an observer of the Committee.</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="idff8984d8-4db3-4ef8-b8cc-74ac886e4a2b"><enum>(D)</enum><header>Recusal</header><text>A
				member of the Committee shall recuse himself or herself from consideration of
				proposals that the member, or the entity that the member represents, has
				submitted.</text>
							</subparagraph></paragraph><paragraph committee-id="SSEV00" id="id1bed4f52-4062-49ca-9dad-5dbcf15fd855"><enum>(3)</enum><header>Functions</header><text>The
				Committee shall—</text>
							<subparagraph committee-id="SSEV00" id="id5b072855-b156-4dd3-ad4a-8adc1b360b2e"><enum>(A)</enum><text>meet at least
				annually;</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="idb78f87e9-82ad-4442-bbe6-3e581b3edaad"><enum>(B)</enum><text>review proposals and
				special projects developed in accordance with subsection (b) to assess the
				effectiveness and appropriateness of the proposals and special projects in
				fulfilling the purposes of this title; and</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="idec6d4170-1031-4dc3-985a-72b3f2fd4e90"><enum>(C)</enum><text>recommend to the Director
				any of those proposals and special projects that should be funded and
				implemented under this section.</text>
							</subparagraph></paragraph></subsection><subsection committee-id="SSEV00" id="id79d36875-eabd-4ab2-a88f-d340fd254920"><enum>(d)</enum><header>Implementation of
				proposals and regional projects</header>
						<paragraph committee-id="SSEV00" id="idb1996357-4486-4057-b85e-c57957d416f7"><enum>(1)</enum><header>In
				general</header><text>After considering recommendations of the Committee and
				the goals specified in section 1006, the Director shall—</text>
							<subparagraph committee-id="SSEV00" id="id0c2201ce-cc15-4f30-8e2e-0791d3143609"><enum>(A)</enum><text>select proposals and
				regional projects to be implemented; and</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="id7ae96898-e0eb-4a73-9736-cd23a38d13d1"><enum>(B)</enum><text>subject to the
				availability of appropriations and subsection (e), fund implementation of the
				proposals and regional projects.</text>
							</subparagraph></paragraph><paragraph committee-id="SSEV00" id="id8e049c54-5d6a-4bb7-8b49-857b16257e4d"><enum>(2)</enum><header>Selection
				criteria</header><text>In selecting and funding proposals and regional
				projects, the Director shall take into account the effectiveness and
				appropriateness of the proposals and regional projects in fulfilling the
				purposes of other laws applicable to restoration of the fish and wildlife
				resources and habitat of the Great Lakes Basin.</text>
						</paragraph></subsection><subsection committee-id="SSEV00" id="id1729f911-5c1f-4fb2-80e3-718b00c6b393"><enum>(e)</enum><header>Cost sharing</header>
						<paragraph committee-id="SSEV00" id="id9b66f934-fcc6-408e-8e3f-7f412ec1442e"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraphs (2) and (4), not less
				than 25 percent of the cost of implementing a proposal selected under
				subsection (d) (excluding the cost of establishing sea lamprey barriers) shall
				be paid in cash or in-kind contributions by non-Federal sources.</text>
						</paragraph><paragraph committee-id="SSEV00" id="ideddd6d42-2377-4922-8c4e-be637166e38f"><enum>(2)</enum><header>Regional
				projects</header><text>Regional projects selected under subsection (d) shall be
				exempt from cost sharing if the Director determines that the authorization for
				the project does not require a non-Federal cost-share.</text>
						</paragraph><paragraph commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="id9c92bb3f-11b5-4def-9144-ece55c026356"><enum>(3)</enum><header>Exclusion of Federal
				funds from non-federal share</header><text>The Director may not consider the
				expenditure, directly or indirectly, of Federal funds received by any entity to
				be a contribution by a non-Federal source for purposes of this
				subsection.</text>
						</paragraph><paragraph commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="id47e1e6b7-c65d-45f3-8126-5a30d5f00e83"><enum>(4)</enum><header>Effect
				on certain Indian tribes</header><text>Nothing in this subsection affects an
				Indian tribe affected by an alternative applicable cost sharing requirement
				under the <act-name parsable-cite="ISDA">Indian Self-Determination and
				Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450 et
				seq.</external-xref>).</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				for the coordination of all United States Fish and Wildlife Service activities
				in the Great Lakes Basin, to be known as the <quote>Great Lakes Coordination
				Office</quote>.</text>
						</paragraph><paragraph committee-id="SSEV00" id="id04df6a7a-61b1-48e3-b3cf-cd23a189375c"><enum>(2)</enum><header>Functional
				responsibilities</header><text>The functional responsibilities of the Great
				Lakes Coordination Office shall include—</text>
							<subparagraph committee-id="SSEV00" id="id3e2b47f7-1765-476d-9eb8-fdf78ed24e81"><enum>(A)</enum><text>intra- and interagency
				coordination;</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="id1e6e3c29-e499-4299-8e60-78fe5a93e0bd"><enum>(B)</enum><text>information distribution;
				and</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="id1532259c-215e-4a73-b95d-ab6b95900494"><enum>(C)</enum><text>public outreach.</text>
							</subparagraph></paragraph><paragraph committee-id="SSEV00" id="idc8bd8e80-f8a9-4144-92ce-c58363503887"><enum>(3)</enum><header>Requirements</header><text>The
				Great Lakes Coordination Office shall—</text>
							<subparagraph committee-id="SSEV00" id="id75d5a471-870d-4862-9a72-c9432db91c47"><enum>(A)</enum><text>ensure that information
				acquired under this Act is made available to the public; and</text>
							</subparagraph><subparagraph committee-id="SSEV00" id="id97e10e19-9145-4f27-b47e-6bb540c96057"><enum>(B)</enum><text>report to the Director of
				Region 3, Great Lakes Big
				Rivers.</text>

				implemented under section 1005; and</text>
						</paragraph><paragraph committee-id="SSEV00" id="id88a90da4-8dcf-489c-a66c-8b9e98472e05"><enum>(3)</enum><text>progress toward the
				accomplishment of the goals specified in section 1006.</text>
						</paragraph></subsection><subsection committee-id="SSEV00" id="idad23fe96-9e73-457d-83ca-90ca918d0e07"><enum>(b)</enum><header>Public access to
				data</header><text>For each of fiscal years 2007 through 2012, the Director
				shall make available through a public access website of the Department
				information that describes—</text>
						<paragraph committee-id="SSEV00" id="id6136ae69-7eb9-46af-9319-52c6628c8105"><enum>(1)</enum><text>actions taken to solicit
				and review proposals under section 1005;</text>
						</paragraph><paragraph committee-id="SSEV00" id="idde551c79-92e9-4f35-83a4-25e7a1c4f358"><enum>(2)</enum><text>the results of proposals
				implemented under section 1005;</text>
						</paragraph><paragraph committee-id="SSEV00" id="idfa877f92-40a8-4a7a-86b7-d0d902591a9f"><enum>(3)</enum><text>progress toward the
				accomplishment of the goals specified in section 1006;</text>
						</paragraph><paragraph committee-id="SSEV00" id="ide6e5d003-2b0b-4810-b506-227de80ddb54"><enum>(4)</enum><text>the priorities proposed
				for funding in the annual budget process under this title; and</text>
						</paragraph><paragraph committee-id="SSEV00" id="id1ac033a7-2176-4b95-9bb7-d7b277913e33"><enum>(5)</enum><text>actions taken in support
				of the recommendations of the Great Lakes Regional Collaboration authorized

						</paragraph></subsection><subsection committee-id="SSEV00" id="idd4e2d3fd-ef4a-4b5d-b45f-8c44ec83247a"><enum>(c)</enum><header>Report</header><text>Not
				later than June 30, 2006, the Director shall submit to the Committee on
				Environment and Public Works of the Senate and the Committee on Resources of
				the House of Representatives the 2002 report required under this section as in
				effect on the day before the date of enactment of the
				<short-title>Great Lakes Fish and Wildlife Restoration Act
				of
				2006</short-title>.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" id="id3CAE1D25DEDE47C1B5B0D47EC1D90118" reported-display-style="italic"><enum>8.</enum><header>Continued monitoring and
			 assessment of study findings and recommendations</header><text display-inline="no-display-inline">The Director of the United States Fish and
			 Wildlife Service—</text>
			<paragraph changed="added" id="idC9B3F49800C54FCE8BDAB4974C38D993" reported-display-style="italic"><enum>(1)</enum><text display-inline="yes-display-inline">shall continue to monitor the status, and
			 the assessment, management, and restoration needs, of the fish and wildlife
			 resources of the Great Lakes Basin; and</text>
			</paragraph><paragraph changed="added" id="id23DD242008994CC1864570052A182651" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">may reassess and update, as necessary, the
			 findings and recommendations of the report entitled <quote>Great Lakes Fishery
			 Resources Restoration Study</quote>, submitted to the President of the Senate
			 and the Speaker of the House of Representatives on September 13, 1995.</text>
			</paragraph></section><section changed="added" committee-id="SSEV00" id="id6ffa0219-fdf9-42f8-91e7-e020c12d4347" reported-display-style="italic"><enum>9.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">Section 1009 of
			 the Great Lakes Fish and Wildlife Restoration Act of 1990 (16 U.S.C. 941g) is
			 amended to read as follows:</text>

				fish and wildlife restoration proposals as selected by the Director under

				of 33<fraction>1/3</fraction> percent or $6,000,000 may be allocated to
				implement regional projects by the United States Fish and Wildlife Service, as
				selected by the Director under section 1005(e); and</text>
						</subparagraph><subparagraph id="ID520afb5d67fc49089948fc4e39e41b5f"><enum>(B)</enum><text>the lesser of 5 percent
				or $600,000 shall be allocated to the United States Fish and Wildlife Service
				to cover costs incurred in administering the proposals by any entity;
				and</text>
						</subparagraph></paragraph><paragraph commented="no" committee-id="SSEV00" display-inline="no-display-inline" id="id9327cd00-99d5-4708-87f3-8accf5dfcce4"><enum>(2)</enum><text>$2,000,000, which shall
				be allocated for the activities of the Great Lakes Coordination Office in East
				Lansing, Michigan, of the Upper Great Lakes Fishery Resources Office, and the
				Lower Great Lakes Fishery Resources Office under section
				1007.</text>
