			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Combating Money Laundering and

			 Terrorist Financing Act of 2006</short-title></quote>.</text>

		</section><title id="idC96EE61E6D5A4958801A4C9991717C8E"><enum>I</enum><header>Money

			 laundering</header>

			<section id="IDc7f56cbda16746388b11326d2190428a"><enum>101.</enum><header>Specified

			 unlawful activity</header><text display-inline="no-display-inline">Section

			 1956(c)(7) of title 18, United States Code, is amended to read as

			 follows:</text>

				<quoted-block act-name="" display-inline="no-display-inline" id="idEB93AC13BA8A4F388E023AD3B198DB22" style="USC">

					<paragraph id="id3CFB4328B67C43A39F38AE6A1EE031E7"><enum>(7)</enum><text>the term

				<term>specified unlawful activity</term> means—</text>

						<subparagraph id="ID3e47490bfc934f62b00664707d617132"><enum>(A)</enum><text>any act or

				activity constituting an offense in violation of the laws of the United States

				or any State punishable by imprisonment for a term exceeding 1 year; and</text>

						</subparagraph><subparagraph id="ID0346a65851334674b6680137dd3970b2"><enum>(B)</enum><text>any act or

				activity occurring outside of the United States that would constitute an

				offense covered under subparagraph (A) if the act or activity had occurred

				within the jurisdiction of the United States or any

				State;</text>

						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</section><section commented="no" display-inline="no-display-inline" id="id3C6DE551DAE04FE088157A26A1BD227F"><enum>102.</enum><header>Making the

			 domestic money laundering statute apply to <quote>reverse money

			 laundering</quote> and interstate transportation</header>

				<subsection commented="no" display-inline="no-display-inline" id="id1087E2435E944ECEB30EFBDE28081F7B"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 1957 of title

			 18, United States Code, is amended—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idC7C52E8B041048D0A63491638461A2BA"><enum>(1)</enum><text>in the heading,

			 by inserting <quote><header-in-text level="section" style="USC">or in support

			 of criminal activity</header-in-text></quote> after <quote><header-in-text level="section" style="USC">specified unlawful

			 activity</header-in-text></quote>;</text>

					</paragraph><paragraph id="ID717398d2122a4907852cf3546402322b"><enum>(2)</enum><text>in subsection

			 (a), by striking <quote>Whoever</quote> and inserting the following:</text>

				in subsection (d)—</text>

									<clause id="idD684CCBC875A4875A41C6167C4046DE7"><enum>(i)</enum><text>conducts or attempts to conduct a

				monetary transaction involving property of a value that is greater than

				$10,000; or</text>

									</clause><clause id="id98446AC926C34260B378BE983CB6675A"><enum>(ii)</enum><text>transports, attempts to transport,

				or conspires to transport property of a value that is greater than

				$10,000;</text>

									</clause></subparagraph><subparagraph id="id932F2E2FA70146B08B24D9A312AA640D"><enum>(B)</enum><text>in or affecting interstate commerce;

				and</text>

								</subparagraph><subparagraph id="idEBC8B0476A204ECC83424013FDA9F3EF"><enum>(C)</enum><text>either—</text>

									<clause id="id3EDBF8EF55334D3BA88711E27B4ACF10"><enum>(i)</enum><text>knowing that the property was

				derived from some form of unlawful activity; or</text>

									</clause><clause id="id6B48B93DC50646BE9D071B361FC05411"><enum>(ii)</enum><text>with the intent to promote the

				carrying on of specified unlawful activity;</text>

									</clause></subparagraph><continuation-text continuation-text-level="paragraph" indent="subsection">shall be fined under this title, imprisoned for a

				term of years not to exceed the statutory maximum for the unlawful activity

				from which the property was derived or the unlawful activity being promoted, or

				both.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection><subsection id="id5AB58A880A614DA5974C700E1645DB05"><enum>(b)</enum><header>Chapter

			 Analysis</header><text>The item relating to section 1957 in the table of

			 sections for chapter 95 of title 18, United States Code, is amended to read as

			 follows:</text>

			 general</header><text>Section 986 of title 18, United States Code, is amended

			 by adding at the end the following:</text>

						<subsection id="ID3c006b9a1b2243358fedad14c1f38353"><enum>(e)</enum><header>Procedure for

				Issuing Subpoenas</header><text>The Attorney General, the Secretary of the

				Treasury, or the Secretary of Homeland Security may issue a subpoena in any

				investigation of a violation of sections 1956, 1957 or 1960, or sections 5316,

				5324, 5331 or 5332 of title 31, United States Code, in the manner set forth

				under section

				3486.</text>

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection><subsection id="IDaa2c307491a6484a9449b07176ae7550"><enum>(b)</enum><header>Grand jury and

			 trial subpoenas</header><text>Section 5318(k)(3)(A)(i) of title 31, United

			 States Code, is amended—</text>

					<paragraph id="idD3195AF5AF5044668F881422F02B95B8"><enum>(1)</enum><text>by striking

			 <quote>related to such correspondent account</quote>;</text>

					</paragraph><paragraph commented="no" id="id1AF98DE370884280AC7C21723E32A97F"><enum>(2)</enum><text>by striking

			 <quote>or the Attorney General</quote> and inserting <quote>, the Attorney

			 General, or the Secretary of Homeland Security</quote>; and</text>

			 reporting act amendment</header><text>Section 604(a)(1) of the Fair Credit

			 Reporting Act (15 U.S.C. 1681b(a)(1)) is amended—</text>

					<paragraph id="idAAAB83066AED48089FFD45415D0D1383"><enum>(1)</enum><text>by striking

			 <quote>or</quote>; and</text>

					</paragraph><paragraph id="id052F63306F2A40E99F082A417960D09F"><enum>(2)</enum><text>by inserting

			 before the period the following: <quote>, or an investigative subpoena issued

			 under section 5318 of title 31, United States Code</quote>.</text>

					</paragraph></subsection><subsection id="IDe327c1831ad7442f93e76e5b9a939936"><enum>(d)</enum><header>Obstruction of

			 justice</header><text display-inline="yes-display-inline">Section 1510(b) of

			 title 18, United States Code, is amended—</text>

			 (2)(A), by inserting <quote>or an investigative subpoena issued under section

			 5318 of title 31, United States Code</quote> after <quote>grand jury

					</paragraph></subsection><subsection id="ID8418c35742f9413ab0b0a0511c2ca437"><enum>(e)</enum><header>Right to

			 financial privacy act</header><text>Section 1120 of the Right to Financial

			 Privacy Act of 1978 (12 U.S.C. 3420) is amended—</text>

					<paragraph id="ID4c7f2659d4d34b12a989a2d6acdc2a94"><enum>(1)</enum><text>in subsection

			 (a)(1), by inserting <quote>or to the Government</quote> after <quote>to the

			 grand jury</quote>; and</text>

					</paragraph><paragraph id="ID1406b54199034f68a1e02d15f248cca5"><enum>(2)</enum><text>in subsection

			 (b)(1), by inserting <quote>, or an investigative subpoena issued pursuant to

			 section 5318 of title 31, United States Code,</quote> after <quote>grand jury

					</paragraph></subsection></section><section id="id0929549BF44A4008AB32D3F84D1F303E"><enum>104.</enum><header>Transportation

			 or transhipment of blank checks in bearer form</header><text display-inline="no-display-inline">Section 5316 of title 31, United States

			 Code, is amended by adding at the end the following:</text>

				<quoted-block act-name="" display-inline="no-display-inline" id="idBFFB6E7B77FF49A8801C15DA43F65205" style="USC">

					<subsection id="IDd4641c79806b4ebbb407ed3b50c096a2"><enum>(e)</enum><header>Monetary

				instruments with amount left blank</header><text>For purposes of this section,

				a monetary instrument in bearer form that has the amount left blank, such that

				the amount could be filled in by the bearer, shall be considered to have a

				value equal to the highest value of the funds in the account on which the

				monetary instrument is drawn during the time period the monetary instrument was

				being transported or the time period it was negotiated or was intended to be

				negotiated.</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</section><section id="id31F3F8A206BD4B70B394E795FB13C637"><enum>105.</enum><header>Bulk cash

			 smuggling</header><text display-inline="no-display-inline">Section 5332(a) of

			 title 31, United States Code, is amended—</text>

				<paragraph id="idA369CF91DC414EE1800C43400584141E"><enum>(1)</enum><text>in subsection

			 (b)(1), by striking <quote>5 years</quote> and inserting <quote>10

			 years</quote>; and</text>

				</paragraph><paragraph id="IDfa9a498f2a724e3782f8ead5bd4819f3"><enum>(2)</enum><text>by adding the end

			 the following:</text>

			 involving commingled funds and structured transactions</header><text display-inline="no-display-inline">Section 1957(f) of title 18, United States

			 Code, is amended—</text>

				<paragraph id="id9043FBDD611341C4BEA75B6F17649568"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2) by striking

			 <quote>and</quote> at the end;</text>

				</paragraph><paragraph id="idB1B6BAA3EFB9421A9A30052D7FAB5BAD"><enum>(2)</enum><text>in paragraph (3),

			 by striking the period and inserting a semicolon; and</text>

				</paragraph><paragraph id="idCD6D2BEB9FA1403C918F368E43B0A69B"><enum>(3)</enum><text>by adding at the

			 end the following:</text>

				transaction involving the transfer, withdrawal, encumbrance or other

				disposition of more than $10,000 from a bank account in which more than $10,000

				in proceeds of specified unlawful activity have been commingled with other

				funds;</text>

							</subparagraph><subparagraph id="ID6971943ebb3b40fa8241e74370b83154"><enum>(B)</enum><text>a series of

				monetary transactions in amounts under $10,000 that exceed $10,000 in the

				aggregate and that are closely related to each other in terms of such factors

				as time, the identity of the parties involved, the nature and purpose of the

				transactions, and the manner in which they are conducted; and</text>

							</subparagraph><subparagraph id="ID9a20405d80fe4316b626cd9db4c8aad6"><enum>(C)</enum><text>any financial

				transaction covered under section 1956(j) that involves more than $10,000 in

				proceeds of specified unlawful activity; and</text>

							</subparagraph></paragraph><paragraph id="ID7727350bed7741faa68d99b19a28b932"><enum>(5)</enum><text>the term

				<term>monetary transaction involving property of a value that is greater than

				$10,000</term> includes a series of monetary transactions in amounts under

				$10,000 that exceed $10,000 in the aggregate and that are closely related to

				each other in terms of such factors as time, the identity of the parties

				involved, the nature and purpose of the transactions, and the manner in which

				they are

				conducted.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></section><section id="idEF7F49E6CD0A4E29AB8FC950763EC587"><enum>107.</enum><header>Charging money

			 laundering as a course of conduct</header>

				<subsection id="IDbc88ec0395ba412988fd28b0733b666e"><enum>(a)</enum><header>In

			 general</header><text>Section 1956 of title 18, United States Code, is amended

			 by adding at the end the following:</text>

						<subsection id="IDb5fe2f3380be4b079a6e3ebbe97be2b8"><enum>(j)</enum><header>Multiple

				violations</header><text>Multiple violations of this section that are part of

				the same scheme or continuing course of conduct may be charged, at the election

				of the Government, in a single count in an indictment or

				information.</text>

			 1956(h) of title 18, United States Code, is amended by striking <quote>or

			 transmitting businesses</header>

			 title 18, United States Code, is amended by inserting the following before the

			 semicolon: <quote>, whether or not the defendant knew that the operation was

			 required to comply with such registration requirements</quote>.</text>

			 investigate</header><text>Section 1960 of title 18, United States Code, is

			 amended by adding at the end the following:</text>

			 with intent to defraud</quote> the following:</text>

				bank, or corporation;

				</subsection><subsection id="ID7e7f783b8e3f4810b53383043943e62b"><enum>(c)</enum><header>Counterfeit

			 acts</header><text>Section 470 of title 18, United States Code, is amended by

			 striking <quote>or 474</quote> and inserting <quote>474, or

			 474A</quote>.</text>

				</subsection><subsection id="ID932449a1264c4c24a60cb404a2139f89"><enum>(d)</enum><header>Materials used

			 in counterfeiting</header><text>Section 474A(b) of title 18, United States

			 Code, is amended by striking <quote>any essentially identical</quote> and

			 inserting <quote>any thing or material made after or in the similitude of

			 any</quote>.</text>

			 amendments</header>

			<section id="id6909DC4199914233A0F86A60478E542E"><enum>201.</enum><header>Technical

			 amendments to sections 1956 and 1957</header>

				<subsection id="ID30229B44A69247EBA987D6AE66A0E88B"><enum>(a)</enum><header>Unlawful

			 activity</header><text>Section 1956(c) of title 18, United States Code, is

			 amended—</text>

					<paragraph id="idD5D57DDE8DDE426BB8E901AAF6AB1E5E"><enum>(1)</enum><text>in paragraph (2),

			 by striking <quote><term>conducts</term></quote> and inserting

			 <quote><term>conduct</term></quote>; and</text>

					</paragraph><paragraph id="idE60E79BB9B0C466AB078D2CD76A2EA00"><enum>(2)</enum><text>in paragraph

			 (7)(F), by inserting <quote>, as defined in section 24(a)</quote> before the

			 semicolon.</text>

					</paragraph></subsection><subsection id="IDC357B56C0D8344AE8ECFC39488BFE7C6"><enum>(b)</enum><header>Property from

			 unlawful activity</header><text>Section 1957 of title 18, United States Code,

			 is amended—</text>

			 (a), by striking <quote>engages or attempts to engage in</quote> and inserting

			 <quote>conducts or attempts to conduct</quote>; and</text>

			 (f)—</text>
