			<header>Short title</header>

			<text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Medicare Enhancements for Needed Drugs

			 Act of 2005</short-title></quote>.</text>

			<enum>2.</enum>

			<header>GAO studies and reports on prices of prescription

			 drugs</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID6836DC97415B4399B8922F4D5F11B7B2">

				<enum>(a)</enum>

				<header>Review and reports on retail prices of prescription

			 drugs</header>

				<paragraph commented="no" display-inline="no-display-inline" id="IDEA5CE82404AB4D88AC7936CFC3F22E66">

					<enum>(1)</enum>

					<header>Initial review</header>

					<text display-inline="yes-display-inline">The Comptroller General of

			 the United States shall conduct a review of the retail cost of prescription

			 drugs in the United States during 2000 through 2003, with an emphasis on the

			 prescription drugs most utilized for individuals age 65 or older.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC9B23783C06C4FD7A90D6F58E63D8202">

					<enum>(2)</enum>

					<header>Subsequent review</header>

					<text display-inline="yes-display-inline">After conducting the review

			 under paragraph (1), the Comptroller General shall continuously review the

			 retail cost of such drugs through April 1, 2006, to determine the changes in

			 such costs.</text>

					<header>Reports</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDE0CD829A8D55493B935ACC367A292971">

						<enum>(A)</enum>

						<header>Initial review</header>

						<text display-inline="yes-display-inline">Not later than September 1,

			 2005, the Comptroller General shall submit to Congress a report on the initial

			 review conducted under paragraph (1).</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5999DFE4F558434486945A2BE4597688">

						<enum>(B)</enum>

						<header>Subsequent review</header>

						<text display-inline="yes-display-inline">Not later than July 1, 2006,

			 January 1, 2007, and July 1, 2007, the Comptroller General shall submit to

			 Congress a report on the subsequent review conducted under paragraph

			 (2).</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID24E9A74A6D084BD89A44563E5215A66E">

				<enum>(b)</enum>

				<header>Annual GAO study and report on retail and acquisition prices of

			 certain prescription drugs</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID47CDD955152541FB8B3FB0779851ED3E">

					<enum>(1)</enum>

					<header>Ongoing study</header>

					<text display-inline="yes-display-inline">The Comptroller General of

			 the United States shall conduct an ongoing study that compares the average

			 retail cost in the United States for each of the 20 most utilized prescription

			 drugs for individuals age 65 or older with—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID7D6B825DB1F14329AA000A560AA9D5FF">

						<enum>(A)</enum>

						<text display-inline="yes-display-inline">the average price at which

			 private health plans acquire each such drug;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7609679227BA48D0BD8295E4B265E5AF">

						<enum>(B)</enum>

						<text display-inline="yes-display-inline">the average price at which

			 the Department of Defense under the Defense Health Program acquires each such

			 drug;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1102C9B3750F4A1E84C8BE02F9985E9C">

						<enum>(C)</enum>

						<text display-inline="yes-display-inline">the average price at which

			 the Department of Veterans Affairs under the laws administered by the Secretary

			 of Veterans Affairs acquires each such drug; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0A8D6D4905F346549BDB1F57DA96C34E">

						<enum>(D)</enum>

						<text display-inline="yes-display-inline">the average negotiated price

			 for each such drug that eligible beneficiaries enrolled in a prescription drug

			 plan under part D of title XVIII of the <act-name parsable-cite="SSA">Social

			 Security Act</act-name>, as added by section 101 of the Medicare Prescription

			 Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law

			 108–173</external-xref>), that provides only basic prescription drug coverage

			 have access to under such plans.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID397553F9877B46C7A3E1B780C0450513">

					<enum>(2)</enum>

					<header>Annual report</header>

					<text display-inline="yes-display-inline">Not later than December 1,

			 2007, and annually thereafter, the Comptroller General shall submit to Congress

			 a report on the study conducted under paragraph (1), together with such

			 recommendations as the Comptroller General determines appropriate.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID8BC83CA8920149AE892A08B9048A9032" section-type="subsequent-section">

			<enum>3.</enum>

			<header>Inclusion of average aggregate beneficiary costs and savings in

			 comparative information for basic medicare prescription drug plans</header>

			<text display-inline="no-display-inline">Section 1860D–1(c)(3) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

			 1395w–101(c)(3)) is amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID3100A9C774F042E8B6157B2DB4BD58F3">

				<enum>(1)</enum>

				<text display-inline="yes-display-inline">in subparagraph (A)—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="ID6F4127F79A6B40B3A92F7949B30A26A3">

					<enum>(A)</enum>

					<text display-inline="yes-display-inline">in the matter preceding

			 clause (i), by striking <quote>subparagraph (B)</quote> and inserting

			 <quote>subparagraphs (B) and (C)</quote>; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1298415A5A3B4B4EB27A3B12C30551A1">

					<enum>(B)</enum>

					<text display-inline="yes-display-inline">by adding at the end the

			 following new clause:</text>

							<header>Average aggregate beneficiary costs and savings</header>

							<text display-inline="yes-display-inline">With respect to plan years

				beginning on or after January 1, 2007, the average aggregate costs, including

				deductibles and other cost-sharing, that a beneficiary will incur for covered

				part D drugs in the year under the plan compared to the average aggregate costs

				that an eligible beneficiary with no prescription drug coverage will incur for

				covered part D drugs in the year.</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID705E8CD3A6154D018D343013D6270ED9">

				<enum>(2)</enum>

				<text display-inline="yes-display-inline">by adding at the end the

			 following new subparagraph:</text>

				only for basic prescription drug plans</header>

						<text display-inline="yes-display-inline">The Secretary shall not

				provide comparative information under subparagraph (A)(vi) with respect

				to—</text>

							<enum>(i)</enum>

							<text display-inline="yes-display-inline">a prescription drug plan

				that provides supplemental prescription drug coverage; or</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID129F39DF01EC49B4B7253B39B189D233">

							<enum>(ii)</enum>

							<text display-inline="yes-display-inline">a Medicare Advantage

				plan.</text>

			<enum>4.</enum>

			<header>Negotiating fair prices for medicare prescription

			 drugs</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID7F3A73280F8341EFAC4AF44DF3647F05">

				<enum>(a)</enum>

				<header>In general</header>

				<text display-inline="yes-display-inline">

					<external-xref legal-doc="act" parsable-cite="SSA/1860D–11">Section

			 1860D–11</external-xref> of the <act-name parsable-cite="SSA">Social Security

			 Act</act-name> (42 U.S.C. 1395w–111) is amended by striking subsection (i)

			 (relating to noninterference) and by inserting the following:</text>

					<subsection commented="no" display-inline="no-display-inline" id="IDBC043DED813A45468C6D29DEF7B5262D">

						<enum>(i)</enum>

						<header>Authority To negotiate prices with manufacturers</header>

						<paragraph commented="no" display-inline="no-display-inline" id="idC7E572FB092F45D885F30CA6F28A8F9A">

							<enum>(1)</enum>

							<header>In general</header>

							<text display-inline="yes-display-inline">In order to ensure that

				beneficiaries enrolled under prescription drug plans and MA–PD plans pay the

				lowest possible price, the Secretary shall have authority similar to that of

				other Federal entities that purchase prescription drugs in bulk to negotiate

				contracts with manufacturers of covered part D drugs, consistent with the

				requirements and in furtherance of the goals of providing quality care and

				containing costs under this part.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76912DED4A334DCBB014C5E4F9843A7D">

							<enum>(2)</enum>

							<header>Mandatory responsibilities</header>

							<text display-inline="yes-display-inline">The Secretary shall be

				required to—</text>

							<subparagraph commented="no" display-inline="no-display-inline" id="idC2869149828A4F36998299684D7E2DD3">

								<enum>(A)</enum>

								<text display-inline="yes-display-inline">negotiate contracts with

				manufacturers of covered part D drugs for each fallback prescription drug plan

				under subsection (g); and</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5811AA09F7A4409CBEB2C71CF0308E66">

								<enum>(B)</enum>

								<text display-inline="yes-display-inline">participate in negotiation

				of contracts of any covered part D drug upon request of an approved

				prescription drug plan or MA–PD plan.</text>

							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5F2B1AD4EA804EE38A47E13B0EA7FF1E">

							<enum>(3)</enum>

							<header>Rule of construction</header>

							<text display-inline="yes-display-inline">Nothing in paragraph (2)

				shall be construed to limit the authority of the Secretary under paragraph (1)

				to the mandatory responsibilities under paragraph (2).</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA2C9E8A8B04A4C0A88C30ADE09054289">

				<enum>(b)</enum>

				<header>Effective date</header>

				<text display-inline="yes-display-inline">The amendment made by this

			 section shall take effect as if included in the enactment of section 101 of the

			 Medicare Prescription Drug, Improvement, and Modernization Act of 2003

			 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law

			 108–173).</external-xref></text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID427EB5E0893949C7A38D11FE990E24AE" section-type="subsequent-section">

			<enum>5.</enum>

			<header>NAIC review and report on changes in medigap policies that

			 provide coverage of prescription drugs contained in the Medicare Prescription

			 Drug, Improvement, and Modernization Act of 2003</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID5EEC637F5F784590AFFF9A171AB6920E">

				<enum>(a)</enum>

				<header>In general</header>

				<text display-inline="yes-display-inline">The Secretary of Health and

			 Human Services shall request the National Association of Insurance

			 Commissioners to conduct a review of the changes to the rules relating to

			 medicare supplemental policies that provide prescription drug coverage

			 contained in subsection (v) of section 1882 of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ss">42 U.S.C.

			 1395ss</external-xref>), as added by section 104(a) of the Medicare

			 Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law

			 108–173</external-xref>).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5096F2AC3F9C4149857F66DD321EEACE">

				<enum>(b)</enum>

				<header>Impact on medicare beneficiaries</header>

				<text display-inline="yes-display-inline">The review conducted pursuant

			 to subsection (a) should focus on the impact the changes described in such

			 subsection will have on medicare beneficiaries.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID8D564F24AB07453E9F375940E773FB38">

				<enum>(c)</enum>

				<header>Report</header>

				<text display-inline="yes-display-inline">The Secretary shall request

			 the National Association of Insurance Commissioners to submit to Congress, by

			 not later than January 1, 2006, a report on the review conducted pursuant to

			 subsection (a), together with such recommendations as the National Association

			 of Insurance Commissioners determines appropriate.</text>
