		<official-title>To prohibit termination of employment of volunteers

		  firefighters and emergency medical personnel responding to emergencies, and for

		  other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>Volunteer Firefighter and EMS

			 Personnel Job Protection Act</short-title></quote>.</text>

		</section><section id="ID93f4f10a9f1941d98c1ddb777d16fc21"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph id="IDbd4c17fef5674cf5b0029399321e1372"><enum>(1)</enum><header>Emergency</header><text>The

			 term <term>emergency</term> has the meaning given such term in section 102 of

			 the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.

			 5122).</text>

			</paragraph><paragraph id="id5FF759F600FC4ED6B14FD20D3EE2E13C"><enum>(2)</enum><header>Major

			 disaster</header><text>The term <term>major disaster</term> has the meanings

			 given such term in section 102 of the Robert T. Stafford Disaster Relief and

			 Emergency Assistance Act (42 U.S.C. 5122).</text>

			</paragraph><paragraph id="id0895BF3FDA7744B29CB4BAD807B6413E"><enum>(3)</enum><header>Qualified

			 volunteer fire department</header><text>The term <quote>qualified volunteer

			 fire department</quote> has the meaning given such term in section 150(e) of

			 the Internal Revenue Code of 1986.</text>

			</paragraph><paragraph id="IDe69e916c064e4a909d57f48337b8c57f"><enum>(4)</enum><header>Volunteer

			 emergency medical services</header><text>The term <term>volunteer emergency

			 medical services</term> means emergency medical services performed on a

			 voluntary basis for a fire department or other emergency organization.</text>

			</paragraph><paragraph id="ID72068311bc3f47e4be155e852a43c8c0"><enum>(5)</enum><header>Volunteer

			 firefighter</header><text>The term <term>volunteer firefighter</term> means an

			 individual who is a member in good standing of a qualified volunteer fire

			 department.</text>

			</paragraph></section><section id="IDb4f5c154e013438187e69495ac12dfeb"><enum>3.</enum><header>Termination of

			 employment of volunteer firefighters and emergency medical personnel

			 prohibited</header>

			<subsection id="IDb48fa1d2b8bf49b1bdcdf0663922d347"><enum>(a)</enum><header>Termination

			 prohibited</header><text>No employee may be terminated, demoted, or in any

			 other manner discriminated against in the terms and conditions of employment

			 because such employee is absent from or late to the employee's employment for

			 the purpose of serving as a volunteer firefighter or providing volunteer

			 emergency medical services as part of a response to an emergency or major

			 disaster.</text>

			</subsection><subsection id="IDfb15af1615ce464b916a73ac66042502"><enum>(b)</enum><header>Deployment</header><text>The

			 prohibition in subsection (a) shall apply to an employee serving as a volunteer

			 firefighter or providing volunteer emergency medical services if such

			 employee—</text>

				<paragraph id="id25CB8849883A47DCA23016C5AADACE16"><enum>(1)</enum><text>is specifically

			 deployed to respond to the emergency or major disaster in accordance with a

			 coordinated national deployment system such as the Emergency Management

			 Assistance Compact or a pre-existing mutual aid agreement; or</text>

				</paragraph><paragraph id="idF4ADB3E2E31E4A74BDABA92DECDAA555"><enum>(2)</enum><text>is a volunteer

			 firefighter who—</text>

					<subparagraph id="idCA00AFE5FA694C908AAD7CBC7A9BE0C4"><enum>(A)</enum><text>is a member of a

			 qualified volunteer fire department that is located in the State in which the

			 emergency or major disaster occurred;</text>

					</subparagraph><subparagraph id="idF0BBD65DDB9D4FCA9C39BE3E997CFD8F"><enum>(B)</enum><text>is not a member

			 of a qualified fire department that has a mutual aid agreement with a community

			 affected by such emergency or major disaster; and</text>

					</subparagraph><subparagraph id="idDE07A56242B34EF9A7431467D42C2DF1"><enum>(C)</enum><text>has been deployed

			 by the emergency management agency of such State to respond to such emergency

			 or major disaster.</text>

					</subparagraph></paragraph></subsection><subsection id="ID4041aabf39ed42beab5f44f533d94d48"><enum>(c)</enum><header>Limitations</header><text>The

			 prohibition in subsection (a) shall not apply to an employee who—</text>

				<paragraph id="id03557EB103B4434DBFF97F4F4A1C9E25"><enum>(1)</enum><text>is absent from

			 the employee's employment for the purpose described in subsection (a) for more

			 than 14 days per calendar year;</text>

				</paragraph><paragraph id="id71FA5C77B7C74450B2080BBAB22A3020"><enum>(2)</enum><text>responds on the

			 emergency or major disaster without being officially deployed as described in

			 subsection (b); or</text>

				</paragraph><paragraph id="id542D2B6BBA1A4ABDA547D5C47177B245"><enum>(3)</enum><text>fails to provide

			 the written verification described in subsection (e) within a reasonable period

			 of time.</text>

				</paragraph></subsection><subsection id="ID7e73528713974abab7c4c5a12d4af813"><enum>(d)</enum><header>Withholding of

			 pay</header><text>An employer may reduce an employee's regular pay for any time

			 that the employee is absent from the employee's employment for the purpose

			 described in subsection (a).</text>

			</subsection><subsection id="ID2e03b2c9654243ee90db050207db9651"><enum>(e)</enum><header>Verification</header><text>An

			 employer may require an employee to provide a written verification from the

			 official of the Federal Emergency Management Agency supervising the Federal

			 response to the emergency or major disaster or a local or State official

			 managing the local or State response to the emergency or major disaster that

			 states—</text>

				<paragraph id="id34BD34A7703E44F1A80DC3D348FB5EC8"><enum>(1)</enum><text>the employee

			 responded to the emergency or major disaster in an official capacity;

			 and</text>

				</paragraph><paragraph id="id2DBE1F42DC91435582BE94D5A57BFFCB"><enum>(2)</enum><text>the schedule and

			 dates of the employee's participation in such response.</text>

				</paragraph></subsection><subsection id="IDb015a2653ce34e87ab13d2e3a4b465ca"><enum>(f)</enum><header>Reasonable

			 notice required</header><text>An employee who may be absent from or late to the

			 employee's employment for the purpose described in subsection (a) shall—</text>

				<paragraph id="idF8D54DEC8B754C328E1368E4FAB1D959"><enum>(1)</enum><text>make a reasonable

			 effort to notify the employee's employer of such absence; and</text>

				</paragraph><paragraph id="idA51E83B74B4343838A533D1C83B30DB9"><enum>(2)</enum><text>continue to

			 provide reasonable notifications over the course of such absence.</text>

				</paragraph></subsection></section><section id="IDce6b4d04a3f94ebf94d7977a891210e7"><enum>4.</enum><header>Right of

			 Action</header>

			<subsection id="IDde1eb26ca2514fe085d5f8c6b1831f08"><enum>(a)</enum><header>Right of

			 action</header><text>An individual who has been terminated, demoted, or in any

			 other manner discriminated against in the terms and conditions of employment in

			 violation of the prohibition described in section (3) may bring, in a district

			 court of the United States of appropriate jurisdiction, a civil action against

			 individual's employer seeking—</text>

				<paragraph id="id8A93C377F0A74975A0C647F440B44C45"><enum>(1)</enum><text>reinstatement of

			 the individual's former employment;</text>

				</paragraph><paragraph id="idCEEBCC993499410A9B33976AC7E2314B"><enum>(2)</enum><text>payment of back

			 wages;</text>

				</paragraph><paragraph id="idE04DDA9440A74FBF8C3E9D961F2A8DE1"><enum>(3)</enum><text>reinstatement of

			 fringe benefits; and</text>

				</paragraph><paragraph id="idEEAA14F8B01B4FCC8D8E687DFCC0C72E"><enum>(4)</enum><text>if the employment

			 granted seniority rights, reinstatement of seniority rights.</text>

				</paragraph></subsection><subsection id="IDc28ad44f629c4f5fbbecdbe169416959"><enum>(b)</enum><header>Limitation</header><text>The

			 individual shall commence a civil action under this section not later than 1

			 year after the date of the violation of the prohibition described in section

			 3.</text>

			</subsection></section><section id="ID48a0f187ecda40cbba8edcd7a8fc45fd"><enum>5.</enum><header>Study and

			 report</header>

			<subsection id="idE300B57C7AF649F9A3EB2C040B0FCF0A"><enum>(a)</enum><header>Study</header><text>The

			 Secretary of Labor shall conduct a study on the impact that this Act could have

			 on the employers of volunteer firefighters or individuals who provide volunteer

			 emergency medical services and who may be called on to respond to an emergency

			 or major disaster.</text>

			</subsection><subsection id="id2B70F9A5A24D456FA16307E3669E40EE"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 12 months after the date of

			 the enactment of this Act, the Secretary of Labor shall submit to the

			 appropriate congressional committees a report on the study conducted under

			 subsection (a).</text>

			</subsection><subsection id="idF08742BEAC16418C98A61824AFBC497F"><enum>(c)</enum><header>Appropriate

			 congressional committees</header><text>In this section, the term

			 <quote>appropriate congressional committees</quote> means the Committee on

			 Health, Education, Labor, and Pensions and the Committee on Small Business and

			 Entrepreneurship of the Senate and the Committee on Education and the Workforce

			 and the Committee on Small Business of the House of Representatives.</text>

			</subsection></section></legis-body>
